Committing financial fraud is a serious breach of business ethics. However, there are few large scale studies of financial fraud, which involve ethical considerations. In this study, we investigate the pervasive financial scandals, which by the end of 2012 involved more than a third of the US-listed Chinese companies. Based on a sample of 262 US-listed Chinese companies, we analyze factors that differentiate between firms that commit financial fraud and those that do not. We find that firms more predisposed to (...) unethical behavior, due to their low regional social trust in the home country and low respect for regulations and laws as proxied by political connections, are more likely to commit accounting and financial fraud. They take advantage of low hurdles for listing via reverse mergers and avoid third-party monitoring through poor governance and auditors. Finally, we find evidence, after these scandals, of non-fraudulent firms differentiating themselves from the fraudulent firms by sending costly signals such as insiders purchasing shares, increasing dividends, and going private. An important question about the nature of virtue is whether an agent's being virtuous requires the harmony in the agent between right action and right passion. This dissertation tries to answer this question by examining a particular virtue-- courage. ;The dissertation discusses different positions in both the West and the East on the relation of action and passion in the virtue of courage. These positions form a spectrum as follows: Mencius's view : courage does not involve battling with adverse desire (...) or feeling, since the courageous agent is fearless. Furthermore, great courage or moral courage is emotionally motivated. Aristotle's view: courage is not a form of self-control, although the courageous agent has medial fear. However, while courage is not emotionally motivated in the same way as other Aristotelian virtues, it is not an apathetic state, since it is emotionally motivated by love for the noble to a certain degree. James Wallace's view: courage sometimes is a virtue of self-control, and sometimes is not. Neither harmony between action and passion nor an internal struggle on the part of the agent is a necessary condition of courage. Robert C. Roberts's view: courage usually involves battling with the desire to flee and overcoming fear. Although there are exceptions, courage is basically a form of self-control. ;After examining the above positions, the author states her own views on the issues. The author believes that the relations between action and passion in cases of courage are various. In the case of ideal courage, an agent's action and passion are in harmony, but the agent's emotional motivation mainly comes from the agent's other virtues. In the case of ordinary courage, although the agent has to battle with adverse passion, the courageous action is not simply the outcome of the victory of will power over passion. There are both cognitive and emotional factors which contribute to the strength of will. ;Through the study of courage, the dissertation concludes that the harmony of action and passion is only a criterion of perfect virtue. In this paper, I situate C.S. Peirce's theory of knowledge and action in comparison to Chinese philosophy. My argument is that the comparison makes it important to understand Peirce's abduction and his maxim as a much more potent force in comparative philosophy. Peirce's priority of practical effects over theory is similar to Confucian conceptions of truth and action. Jon Alan Schmidt has summarized sixty-one formulations of Peirce's maxim, from which I draw the four main expressions of the maxim here. According (...) to Peirce, understanding the meaning of concepts in terms of actual effects is the core element of the maxim. This view can be seen as an echo in Wang Yangming's theory of the unity of knowledge and action. The theory is essentially a moral humanist philosophy. It integrates morality, ethics, and politics. It is similar to Peirce's pragmatic maxim, as James Liszka has explained. Finally, reflecting on the recent studies of Peirce's semiotics in China, I discuss the significance of Peirce's pragmatism in Chinese philosophy. (shrink)

Therefore, some of the recent scholarship on the topic aims to uncover the social and historical implications behind Dewey's Chinese trip, centering on how intercultural conversations occurred between "Confucius" and "John Dewey" during the period of May Fourth/New Culture Movement. Much research also reflects an attempt to synthesize and unify Western and Eastern education. A social network is a web that integrates multiple levels of interindividual social relationships and has direct associations with an individual’s health and well-being. Previous research has mainly focused on how brain and social network structures act on each other and on how the brain supports the spread of ideas and behaviors within social networks. The structure of the social network is correlated with activity in the amygdala, which links decoding and interpreting social signals and social values. The structure also (...) relies on the mentalizing network, which is central to an individual’s ability to infer the mental states of others. Network functional properties depend on multilayer brain-social networks, indicating that information transmission is supported by the default mode system, the valuation system, and the mentalizing system. From the perspective of neuroendocrinology, overwhelming evidence shows that variations in oxytocin, β-endorphin and dopamine receptor genes, including oxytocin receptor, mu opioid receptor 1 and dopamine receptor 2, predict an individual’s social network structure, whereas oxytocin also contributes to improved transmission of emotional and behavioral information from person to person. Overall, previous studies have comprehensively revealed the effects of the brain, endocrine system, and genes on social networks. Future studies are required to determine the effects of cognitive abilities, such as memory, on social networks, the characteristics and neural mechanism of social networks in mental illness and how social networks change over time through the use of longitudinal methods. Online interactions have become major channels for people to obtain and disseminate information during the new normal of COVID-19, which can also be a primary platform for rumor propagation. There are many complex psychological reasons for spreading rumors, but previous studies have not fully analyzed this problem from the perspective of the interaction between official institutions and influential users. The purpose of this study is to determine optimal strategies for official institutions considering the impact of two different influential user types (...) by designing two game-theoretic models, namely “Rumor Clarification and Interaction Model” and “Rumor Verification and Interaction Model,” which can, respectively decide whether to clarify and when to clarify. The results of this article show that clarification strategies can be decided according to the characteristics of rumors and the influential user’s reactions. Meanwhile, publishing verified information prevents trolls’ “loophole advantages” and prevents reputed personalities from spreading false information due to the vague authenticity of rumors. Results also show that the verification strategy is limited by cost, period, and verification index. (shrink)

Ludwig Wittgenstein's _Tractatus Logico-Philosophicus_ and _Philosophical Investigations_ are among the most influential philosophical books of the twentieth century, and also among the most perplexing. Wittgenstein warned again and again that he was not and would not be understood. Moreover, Wittgenstein's work seems to have little relevance to the way philosophy is done today. In _Wittgenstein in Exile_, James Klagge proposes a new way of looking at Wittgenstein -- as an exile -- that helps make sense of this. Wittgenstein's exile (...) was not, despite his wanderings from Vienna to Cambridge to Norway to Ireland, strictly geographical; rather, Klagge argues, Wittgenstein was never at home in the twentieth century. He was in exile from an earlier era -- Oswald Spengler's culture of the early nineteenth century. Klagge draws on the full range of evidence, including Wittgenstein's published work, the complete Nachlaß, correspondence, lectures, and conversations. He places Wittgenstein's work in a broad context, along a trajectory of thought that includes Job, Goethe, and Dostoyevsky. Yet Klagge also writes from an analytic philosophical perspective, discussing such topics as essentialism, private experience, relativism, causation, and eliminativism. Once we see Wittgenstein's exile, Klagge argues, we will gain a better appreciation of the difficulty of understanding Wittgenstein and his work. (shrink)

Why is American punishment so cruel? While in continental Europe great efforts are made to guarantee that prisoners are treated humanely, in America sentences have gotten longer and rehabilitation programs have fallen by the wayside. Western Europe attempts to prepare its criminals for life after prison, whereas many American prisons today leave their inhabitants reduced and debased. In the last quarter of a century, Europe has worked to ensure that the baser human inclination toward vengeance is not reflected by state (...) policy, yet America has shown a systemic drive toward ever increasing levels of harshness in its criminal policies. Why is America so short on mercy? In this deeply researched, comparative work, James Q. Whitman reaches back to the 17th and 18th centuries to trace how and why American and European practices came to diverge. Eschewing the usual historical imprisonment narratives, Whitman focuses instead on intriguing differences in the development of punishment in the age of Western democracy. European traditions of social hierarchy and state power, so consciously rejected by the American colonies, nevertheless supported a more merciful and dignified treatment of offenders. The hierarchical class system on the continent kept alive a tradition of less-degrading "high-status" punishments that eventually became applied across the board in Europe. The distinctly American, draconian regime, on the other hand, grows, Whitman argues, out of America's longstanding distrust of state power and its peculiar, broad-brush sense of egalitarianism. Low-status punishments were evenly meted out to all offenders, regardless of class or standing. America's unrelentingly harsh treatment of trangressors--this "equal opportunity degradation"-- is, in a very real sense, the dark side of the nation's much vaunted individualism. I critically discuss two dogmas of the “dynamical approach” to spacetime in general relativity, as advanced by Harvey Brown [Physical Relativity Oxford:Oxford University Press] and collaborators. The first dogma is that positing a “spacetime geometry” has no implications for the behavior of matter. The second dogma is that postulating the “Strong Equivalence Principle” suffices to ensure that matter is “adapted” to spacetime geometry. I conclude by discussing “spacetime functionalism”. The tradition, stripped (...) of religious content, is now used to foster human growth. Given such interests, psychological comparisons have become prevalent and Buddha has been understood as the first to explore the ego. This is a review of two books—Jiang’s Contexts and Dialogue and Bricklin’s Sciousness—approaching such developments from different directions. In Contexts and Dialogue, Tao Jiang worries that jumping into comparison too hastily risks losing original meanings when words are made relative to whatever structure in which they are placed. The original contexts of Yogācāra Buddhism and modern psychology both need to be understood in order to reveal existing presuppositions about how the two can be brought together. Jonathan Bricklin’s Sciousness has more hope for comparative work because he believes he has found an untapped resource for comparison in the theory of sciousness developed by William James (1842–1910). Pragmatic philosophy has yet to be compared with Buddhist traditions in depth, even though both favor practical solutions to problems over merely theoretical pondering.Jiang is a specialist in comparative philosophy. His method is to deconstruct current comparisons between different systems by recovering the original meanings of their different terminologies in their original context and in relation to the particular problems each system was addressing. Comparison can then be reconstructed out of these original contexts so that genuine similarities and differences can emerge. Regarding Yogācāra thought, the systematic theory of mind /consciousness, ālayavijñāna (“storehouse consciousness”) is at its center. This “storehouse of consciousness” is a subliminal reservoir for memories and habits that has made a correlation with the psychological unconscious tempting (pp. 9–10). However, rather than ask whether ālayavijñāna can serve the needs of modern psychology, Jiang first explores what problem it was originally meant to address. He achieves this goal by examining the seventh-century Chinese Buddhist work Cheng Weishi Lun (Discourse on the Perfection of Consciousness-only) of the Buddhist monk pilgrim Xuanzang (Hsüan-tsang, ca. 600–664). Only when this journey is complete does Jiang compare [End Page 201] ālayavijñāna to the psychological theories of Sigmund Freud (1856 –1939) and Carl Jung (1875–1961). The result Jiang argues for is that notions of transcendence and immanence are emphasized differently in the three theories of consciousness offered by Xuanzang, Freud, and Jung.Yogācārins were dealing with deep meditative states in which consciousness is supposed to cease and with the problem of how meditators could arise from such meditative states without violating the doctrine of anātman (“no-self ”). What supports the meditator in these states if no enduring substantive self exists? How can there be identity and change without substantial reification? On the other hand, how can impermanent existence account for the seeming continuity of the world we experience?The answer given by Xuanzang is that an empirical self can be embraced while a metaphysical one is rejected. However, without such a metaphysical self, the question of “whose” arises (p. 27). Whose consciousness of continuous experience is being dealt with if not that of a metaphysical self? The radical solution offered is that ālayavijñāna contains subliminal seeds that produce continuity between successive dharma moments. This solution must be possible without violating the simultaneity of cause and effect. Thus, Xuanzang spoke of dharmas as actual and bījas, seeds of the potential for production, as only potential (p. 60). Perishing dharmas are maintained by the seeds to be manifested in the future and substantive entities are not introduced because seeds are only potential (p. 42). The result is that after deep meditative states when mental activities halt, the mind can emerge from the seeds of mental activity without needing antecedent actual mental activity.Xuanzang’s approach... A strong defender of the importance of Greek philosophy in a well-rounded education, Adam published a number of Plato's works including Protagoras and Crito. Despite striking similarities there are also important differences. These include the “epistemic” orientation of Spohn’s account as opposed to the worldly or “ontic” orientation of the interventionist account, Spohn’s focus on token-level causal claims in contrast to the primary interventionist focus on type-level claims, the role of (...) temporal information in accounting for causal asymmetry, and the extent to which causal claims are “frame relative.”. That art historians have felt it necessary to emulate this effort to express personal input can be explained by our need to gain credibility in that aspect of our work that is indistinguishable in method from other historical research: the reconstruction, through documents and artifacts, of past events, conditions, and attitudes. Most of us simply ignore the ambivalence of our position; I cannot recall having heard or read discussions of it, but it is bound to creep out from under the (...) rug. If a student asks me why I think Rembrandt and Picasso are good artists—which most students are too well trained to do—and if I answer that judgments of value are not discussed by historians, I am within my rights, like a witness at a congressional hearing claiming the protection of the Fifth Amendment. But I ought to be found in contempt of the classroom. And if I try to answer seriously, I ought not begin by saying that I chose Rembrandt because he has been acknowledged by generations to have been a great artist but rather because I find more to think, feel, and speak about in his works than in those of, for example, Nicolaes Maes, and because I believe that the student stands to gain more by looking at them. I want the student to have the most rewarding experiences, and, as a result, perhaps to learn to make value discriminations of his own—even ones different from mine and from the so-called consensus of history—and ultimately to explain the grounds on which he makes them. This means having to know and to explain what I think is "rewarding." James S. He knows what is wrong with the gentile world, but was at first able to hear only half of the word of God. He heard it as he was able to receive it: as a stern word of rebuke that he was to pass on to others. That was the state of his soul. Luckily, God had chosen someone who, invincible as he was in his righteousness, knew perfectly well that it is a terrible thing to fall into the presence ofthe living God, and suspected, at some level ofhis being that if, he, Jonah were to obey God, God would certainly break through the carapace ofordered adhesion to true religion, and come into contact with a much more turbulent, stormy world, the world of shame and fear and hatred that is the underside ofall ordered righteousness. Shame is a compulsion which heeds only one command: flee! And Jonah fled. Thank heaven for Jonah's flight! Think how much more damage is caused by those who are not vulnerable to their own shame, who really do manage to fool themselves that their righteousness and God's are cut from the same cloth. Something in Jonah's being was vulnerable to the suspicion that the word ofthe living God would wreak havoc with his own carefully covered hatred and fear, the suspicion that that hatred ofothers and fear of himselfwere aspects ofthe same as yet unredeemed dimension ofhis own life. In that vulnerability was his flight, and through it, ultimately, he was reached so as to be taught how to be a bearer ofGod's word. Ifthe account were to be found in one of the synoptic Gospels, perhaps it might remain at that—there is no shortage of such stories. I have no doubt that in the background to the story we're dealing with an historical incident of a healing carried out by Jesus on a Sabbath. However, here the "miraculous healing" element doesn't receive much emphasis, nor does the Sabbath or rather, the matter ofthe Sabbath does receive a certain weight, as we will see later on, but with some very idiosyncratically Johannine touches. In any case, the purpose of this Chapter is determined by the debate about sin, sight, blindness and judgement within which it is set: these are the jeweller's artwork which show forth, and make sense of, the gem ofthe healing. Let us look at the beginning of the story. Jesus sees a man born blind, and his disciples ask him: "Master, who sinned, this man or his parents, that he was born blind?" Matthew Kramer has argued that Hume's story of the passage "from the hostilities of nature to the serenity of civilized Ufe"1 is, in effect, incoherent. It is incoherent, Kramer asserts, because "language must be in place already" (...) (Kramer, 148) in order for family groups tojoin together into larger social units by means of Humean convention. In other words, Kramer takes the view that a commonlanguage is needed amongst all the players for thé gradual establishment ofjustice by human conventions to be possible. But it is just this very thing, a relatively sophisticated common language, that can only be achieved after the establishment of the larger societal unit. Kramer therefore sees Hume's account of the origins of justice as, at best, paradoxical because "the founding of a societal unit can take place only if such a unit has already been founded" (Kramer, 149). This article shall be concerned to defend, against the thrust of Kramer's attack, the broad outlines2 of Hume's story of the origins of justice in book 3 of the Treatise. At any rate, I will argue that Hume's explicitlyahistorical accountis coherent? Butinmakingthis argument I shall be careful to place Hume's account of justice in its proper perspective. It must be recalled that Hume was attempting to explain all ofhuman morals, aesthetics and virtues in a scientific way. In this scheme,justice—for him, the stability ofpossessions or the basic rules of property—was the pre-eminent "artificial" virtue. As we shall see, no interpretation ofHume's account ofthe escape tojustice can ignore his wider concern, to explain empirically human nature and conduct. Let us start, however, with a bare summary of Kramer's thesis. Firstly, Kramer sets out Hume's core position. Justice (basic rules of property) and thus society result from the re-directing ofself-love. The process does not rely on agreement and is thus immune from one ofthe main criticisms of social contract theories (that is, how to explain the bindingness of a first ever contract).4 Rather, Hume's account is of justice emerging ever so gradually from reciprocal conventions. Where small family living is "natural"—some original or inherent Volume XVII Number 2 81 JAMES ALLAN principle—life in society is created by convention. In this sensejustice is "artificial." Secondly, two critiques of Hume's position are considered and found, by Kramer, ultimately to be unsuccessful. The first is the weakness noted above and common toall social contract analyses: from where does the bindingness of a first contract come? But Hume explicitly rejected contractarian theories as Kramer allows. Hume's conventional theory "is not of the nature of a promise:... it arises gradually, and acquires force by a slow progression, and by our repeated experience of the inconveniences of transgressing it."5 The second critique which Kramer finds abortive, and to which I shall return below, involves the role of reason in the creation of justice. Primitive reflection based on already experienced events, impressions or ideas would not be sufficient to overcome avid self-interest.6 But in response to this attack Kramer retorts that it is at most inconclusive whether the experiences of family life combined with reason could overcome self-interest on Hume's model. Thirdly, Krameroffers his own critique in the hope ofshowing that "Hume's story disrupts itself when it narrates certain events that cannot possiblymaterialize until theyhave already occurred" (Kramer, 143). Kramer's attack on the Humean conventional move tojustice, as indicated above, concentrates on language. But it is well to note carefully Kramer's interpretation of Hume's account of the building of stable, society-wide property rules. Kramer takes this to be that, "[a]s a result ofcrude reflection and the restraints offamily life, most people come to realize that a persistent demand for goods can be better filled within society than without it" (Kramer, 147; emphasis mine). Examinamos las relaciones transatlánticas que dieron forma al pensamiento de Bilbao, el desarrollo del republicanismo chileno en las secuelas de la independencia política, y las Revoluciones (...) Francesas de 1789 y 1848. Sostenemos que la “regeneración” de la república chilena se convirtió en una especie de misión histórica para Bilbao y su generación de estudiantes universitarios y jóvenes profesionales. ScanlanWriting in his own voice, in letters, notebooks, and diaries, Fyodor Dostoevsky frequently attacked the philosophy of the Russian “nihilists,” as he typically called them—Nikolay Chernyshevsky, Dmitry Pisarev, and other representatives of the radical Russian intelligentsia in the third quarter of the nineteenth century. But because Dostoevsky also used fiction to argue against them, if we wish (...) to discern the full contours of his opposition, we must turn to his stories and novels; and there we face the problem of determining to what extent, if any, the statements of his narrators and characters express his own views.This problem is particularly challenging in regard to the radicals’ “Rational Egoism,” to use the label by which the Russian variant of the theory of enlightened egoism came to be known. 1 Dostoevsky’s most sustained and spirited attack on that aspect of “nihilist” philosophy is found in Part One of Notes from Underground (1864), but it is voiced by one of the darkest, least sympathetic of all his characters—the nameless narrator and protagonist known as the Underground Man. Was this repellent creature speaking for Dostoevsky? The Underground Man, moreover, can easily be viewed as a sheer irrationalist whose rejection of Rational Egoism is a tortured emotional outburst with no logical credentials. Robert L. Jackson, in his groundbreaking study of 1958, describes the Underground Man’s thinking at one point as follows: “It is impossible to argue [End Page 549] with the rationalists: reason is on their side. All that remains is irrationally to negate reason.” 2 If those words were to be taken not simply as a moment in Jackson’s rich analysis but as a comprehensive description of the Underground Man’s attitude, it would be senseless to expect philosophically nuanced arguments from him. And we would have no grounds for thinking that Dostoevsky’s own treatment of Rational Egoism went beyond emotional rejection.Critics from Vasily Rozanov to Joseph Frank have debated the Underground Man’s stance toward Rational Egoism and its relation to Dostoevsky’s, with no sign yet of a definitive resolution. Frank’s recent treatment, presented in the third volume of his monumental literary biography of Dostoevsky, offers a helpful history of the dispute as well as his own finely elaborated interpretation of the Underground Man as an irrational opponent of Rational Egoism. 3 Frank reads Notes from Underground as satire, and he contends that the Underground Man is caught in an agonizing self-contradiction: intellectually, he accepts the basic premises of the Rational Egoists’ outlook, such as the denial of free will; but he finds that, “despite the convictions of his reason,” he cannot live with the amoral and dehumanizing implications of those premises, which strip human beings of moral responsibility. 4 From a rational point of view, of course, rejection of the implications should force the Underground Man to reject the premises as well (by the hoary logical law of modus tollendo tolens), and indeed he does at times passionately condemn them. But according to Frank, these condemnations simply show the depth of his predicament: his “intellectual acceptance” of Chernyshevsky’s determinism is conjoined with “simultaneous rejection of it with the entire intuitive-emotional level of personality identified with moral conscience,” causing him to respond irrationally in a multitude of instances. 5 Frank’s Underground Man, then, is an intellectual disciple but an emotional critic of Rational Egoism; and he is triply an irrationalist: his thinking is mired in self-contradiction, he acts irrationally as a result, and his opposition to Rational Egoism has not a rational but an “intuitive-emotional” basis.But where does this leave Dostoevsky? Must we conclude that he, too, is somehow suspended between acceptance and rejection of Rational Egoism and for that reason has created in Notes from Underground a Bakhtinian equilibrium in which neither position is clearly privileged? For Frank, certainly not. James H. Donelan describes how two poets, a philosopher, and a composer - Hölderlin, Wordsworth, Hegel, and Beethoven - developed an idea of self-consciousness based on music at the turn of the nineteenth century. This idea became an enduring cultural belief: the understanding of music as an ideal representation of the autonomous creative mind. Against a background of political and cultural upheaval, these four major figures - all born in 1770 - developed this idea in both metaphorical and actual (...) musical structures, thereby establishing both the theory and the practice of asserting self-identity in music. Beethoven still carries the image of the heroic composer today; this book describes how it originated in both his music and in how others responded to him. Bringing together the fields of philosophy, musicology, and literary criticism, Donelan shows how this development emerged from the complex changes in European cultural life taking place between 1795 and 1831.
