Over the last decade, many of the legal disputes that have arisen in the context of national security have concerned information - the withholding of it, the suppression of it, the collection of it, or the safeguarding of it. Frequently, these disputes have involved an argument known as the "mosaic" theory. The theory is straightforward: Seemingly insignificant information may become significant when combined with other information. Insofar as it states a fact about the world, the mosaic theory is uncontroversial. Usually, (...) though, the mosaic theory is offered not as description but as argument. For example, it is offered as a justification for the government's withholding of information that would otherwise be released to the public, or for the government's silencing of citizens who would otherwise have a right to speak, or for the government's collection of information that citizens would otherwise keep confidential. When the mosaic theory is used in support of normative claims, the theory is controversial. I do not propose to resolve this controversy here, but by examining three distinct contexts in which the government has invoked the theory, we can gain insight into the theory's merits. (shrink)

The application of artificial intelligence (AI) to judicial decision-making has already begun in many jurisdictions around the world. While AI seems to promise greater fairness, access to justice, and legal certainty, issues of discrimination and transparency have emerged and put liberal democratic principles under pressure, most notably in the context of bail decisions. Despite this, there has been no systematic analysis of the risks to liberal democratic values from implementing AI into judicial decision-making. This article sets out to fill this (...) void by identifying and engaging with challenges arising from artificial judicial decision-making, focusing on three pillars of liberal democracy, namely equal treatment of citizens, transparency, and judicial independence. Methodologically, the work takes a comparative perspective between human and artificial decision-making, using the former as a normative benchmark to evaluate the latter. -/- The chapter first argues that AI that would improve on equal treatment of citizens has already been developed, but not yet adopted. Second, while the lack of transparency in AI decision-making poses severe risks which ought to be addressed, AI can also increase the transparency of options and trade-offs that policy makers face when considering the consequences of artificial judicial decision-making. Such transparency of options offers tremendous benefits from a democratic perspective. Third, the overall shift of power from human intuition to advanced AI may threaten judicial independence, and with it the separation of powers. While improvements regarding discrimination and transparency are available or on the horizon, it remains unclear how judicial independence can be protected, especially with the potential development of advanced artificial judicial intelligence (AAJI). Working out the political and legal infrastructure to reap the fruits of artificial judicial intelligence in a safe and stable manner should become a priority of future research in this area. The methodological and scientific analysis of historical practice stands opposed to an approach based on the reflection on the historicity of human identity. Previous attempts to overcome this discrepancy have been prevented from seeking recourse in Hegel's historical thought, since it is still seen as representing a substantialist and tangible philosophy of history and therefore as being theoretically obsolete. It is argued that a chief obstacle to a naturalistic explanation of the origins of mind is human exceptionalism, as exemplified in the 17th century by Descartes, and in the 20th century by Noam Chomsky. As an antidote to human exceptionalism we turn to the account of aesthetic judgment in Darwin’s Descent of Man, according to which the mental capacities of humans differ from those of lower animals only in degree, not in kind. Thoroughgoing naturalistic explanation of these capacities is (...) made easier by shifting away from the substance-metaphysical implications of the search for an account of mind, toward a dispositional account of the origins of mindfulness. The responsibility of deconstruction is to disrupt those taken‐for‐granted meanings of curriculum discourses by opening them up and releasing them from their metaphysical assumptions to see what or who may have been overlooked, marginalised and omitted in the process of curriculum‐making. The new model of knowledge formulated in The Schools White Paper for the General Certificate in Secondary Education examinations (GCSE6) is located within a challenging curriculum framework in which grade boundaries are raised, end‐of‐module examinations are replaced with end‐of‐course examinations and opportunities to re‐sit examinations through the course of the programme of study are removed. In kritischer Auseinandersetzung mit Heidegger und Gadamer entwickelt er einen neuen Ansatz, der phänomenologische, hermeneutische und strukturanalytische Verfahren zusammenführt. In this paper, I will argue that ageing can be construed as disease. First, the concept of disease is discussed, where the distinction is made between two lines of thought, an objectivist and a subjectivist one. After determining the disease conception to be used throughout the argument, it is proposed that senescence could be seen as disease. Three common counterarguments are discussed, none of which appears strong enough to effectively counter the advocated view. In the third section, two potential implications (...) of the view advocated here will be briefly touched upon. These are the quest for a cure or treatment for ageing and the general attitude towards the elderly. It is concluded that, utilizing an objective disease concept, ageing could be seen as a disease. None of the considered counterarguments packs enough of a punch to discard this. The implications are complex and intertwined, but need not be negative. (shrink)

The priority of secured credit has repeatedly and famously been attacked for allowing the exploitation of certain types of unsecured creditor. It has also been blamed for creating inefficiencies. This paper examines these arguments specifically as applied to this jurisdiction, and using both theoretical analysis and recent empirical data, suggests none of them can be sustained. It is argued that security is unlikely to lead to the exploitation of involuntary, ‘uninformed’, or ‘unsophisticated’ creditors, since the perverse incentives it allegedly creates (...) for the debtor's management are likely to be outweighed by the managers' liquidation‐related costs. It is then pointed out that both exploitation‐based and inefficiency‐based attacks on the priority of secured credit depend on the assumption that secured credit is generally cheaper than unsecured credit, and further, that this is why debtors prefer to borrow on a secured rather than unsecured basis. Recent evidence from this jurisdiction is used to challenge this assumption. This has dramatic implications for the attacks on security, which are discussed. The paper concludes with the demonstration that secured credit, by inducing creditors to lend when they would not do so without being offered priority, is mutually value‐enhancing for all types of creditor, including unsecured ones. We live in a world in which scientific expertise and its epistemic authority become more important. On the other hand, the financial interests in research, which could potentially corrupt science, are increasing. Due to these two tendencies, a concern for the integrity of scientific research becomes increasingly vital. This concern is, however, hollow if we do not have a clear account of research integrity. Therefore, it is important that we explicate this concept. Following Rudolf Carnap’s characterization of the task of (...) explication, this means that we should develop a concept that is (1) similar to our common sense notion of research integrity, (2) exact, (3) fruitful, and (4) as simple as possible. Since existing concepts do not meet these four requirements, we develop a new concept in this article. We describe a concept of epistemic integrity that is based on the property of deceptiveness, and argue that this concept does meet Carnap’s four requirements of explication. To illustrate and support our claims we use several examples from scientific practice, mainly from biomedical research. (shrink)

The present ecological crisis imposes a rethinking of the relation between the human being and the rest of nature. Traditional theological articulations of this relation have proven problematic where they foster separatism and anthropocentrism, which give a false report on the relation and have a negative impact on thinking and acting in relation to nature. One place to begin rethinking is through an exploration of the affirmation that the human being is “made in the image of God,”imago dei. Some ways (...) of construing the theological meaning of this designation are more helpful than others. Science has recognized the extent to which the human being is not only dependent upon but even emergent from nature. We are made of the same “stuff” that makes up the rest of the universe. We are nature. The place of the human being is much more modest, recent, and precarious than usually acknowledged in theological reflection. New ways of interpreting our role within nature must evolve out of this new understanding. Philip Hefner has proposed that we think of the human being as created co-creator. His is a distinctive and promising contribution. This essay responds with both affirmations and friendly questions. (shrink)

This study explores the impact of CEO ability on corporate environmental sustainability information disclosure. We take samples from Chinese A-share listed companies from 2010 to 2019 and use the ordinary least squares as a baseline regression model to check the relationship between CEO ability and corporate environmental sustainability information disclosure. Our findings are robust to different corporate environmental sustainability information disclosure measures and CEO ability. We found a positive association between CEO ability and corporate environmental sustainability information disclosure; thus, firms (...) with a more able CEO are more likely to disclose more corporate environmental sustainability information. Our results also found a significant negative interaction coefficient between CEO ability and CEO career concerns. As the CEO grows older, his/her ability decreases; therefore, corporate environmental sustainability information disclosure reduces. Furthermore, we document that a female CEO strengthens the relationship between CEO ability and corporate environmental sustainability information disclosure. The study results are important for understanding corporate environmental responsibility development and implementation, particularly in China. (shrink)

The current paper highlights a new, interactive Shiny App that can be used to aid in understanding and teaching the important task of conducting a prior sensitivity analysis when implementing Bayesian estimation methods. In this paper, we discuss the importance of examining prior distributions through a sensitivity analysis. We argue that conducting a prior sensitivity analysis is equally important when so-called diffuse priors are implemented as it is with subjective priors. As a proof of concept, we conducted a small simulation (...) study, which illustrates the impact of priors on final model estimates. The findings from the simulation study highlight the importance of conducting a sensitivity analysis of priors. This concept is further extended through an interactive Shiny App that we developed. The Shiny App allows users to explore the impact of various forms of priors using empirical data. We introduce this Shiny App and thoroughly detail an example using a simple multiple regression model that users at all levels can understand. In this paper, we highlight how to determine the different settings for a prior sensitivity analysis, how to visually and statistically compare results obtained in the sensitivity analysis, and how to display findings and write up disparate results obtained across the sensitivity analysis. The goal is that novice users can follow the process outlined here and work within the interactive Shiny App to gain a deeper understanding of the role of prior distributions and the importance of a sensitivity analysis when implementing Bayesian methods. The intended audience is broad and can include those with limited exposure to Bayesian methods or the specific model presented here. (shrink)

Respecto de esta última, se presentan aplicaciones al estudio de la Identidad Cultural de la Región de los Ríos, debido (...) a las características de este territorio como nueva región. El concepto resultante describe el fenómeno como un sentido del ser regional presente en la semiosfera cultural, formando parte de la memoria y del imaginario colectivo, manifestado en el modo de la unidad temática de una narración histórica coherente y ordenada, progresivamente más compleja y heterogénea, que combina la progresión lineal de los subtemas y el tema constante de la identidad cultural regional. Regarding the latter, applications to the study of the Cultural Identity of the Region de los Rios are presented, due to the characteristics of this territory as a new region. The resulting concept describes the phenomenon as a sense of the regional being present in the cultural semiosphere, forming part of the collective memory and imaginary, manifested in the way of the thematic unity of a coherent and ordered historical narrative, progressively more complex and heterogeneous, which combines the linear progression of the subthemes and the constant theme of regional cultural identity. This article analyzes these two sub-problems in more detail, and assesses several strategies to deal with them, resulting in some specific recommendations that indicate what governments should do to make the research agenda in (...) the health sciences less distorted.
