The question proposed in this dossier - what is psychoanalysis - has been asked many times over the decades, but perhaps only on a few occasions has it been the subject of a proper problematisation. This is compounded by the particular expression that is often heard in the psychoanalytic field, which is used as a mechanism of ostracism: “That’s not psychoanalysis!” Against this background, in the face of this apparent current lack of interest in definition, simultaneously with a certain urgency (...) to point out what remains outside psychoanalysis, this brief article proposes to analyze a set of texts in which Freud seeks to delimit not only what psychoanalysis is but also the mechanisms involved and the authorized places to point out the deviations of the Freudian discipline. In other words, the aim here is to show that psychoanalysis, far from being reduced to a research methodology, a modality of treatment of neurosis and/or a theory, is also defined as a _movement_. And the question of the “_ψ_-movement” will lead to a reflection on its mechanisms of (re)production and some of its historical consequences. In the light of this journey, the aim is to show that this question, which in principle may seem merely technical and “scientific”, necessarily refers to the political. (shrink)

Este artículo explora el concepto de trauma colectivo y su aplicación en el contexto histórico y social de las sociedades latinoamericanas. La transferencia del término «trauma colectivo» desde el campo del conocimiento psicológico a la esfera social e histórica plantea preguntas sobre su legitimidad y marco conceptual. El estudio examina la fidelidad de esta transferencia conceptual y su relación con la comprensión psicoanalítica temprana de los fenómenos traumáticos. El contexto cultural europeo de finales del siglo xix y principios del siglo (...) xx proporcionó la base para teorizar las consecuencias de experiencias intensas y violentas, lo que resultó en el concepto de «neurosis traumática», influenciado significativamente por el trabajo de Freud. El artículo discute la apropiación de herramientas psicoanalíticas en la crítica histórica y cultural para comprender eventos que desafían marcos tradicionales y la inteligibilidad social, como el Holocausto. La noción del trauma como una fuerza enigmática y recurrente en la experiencia histórica se explora a través del enfoque de los estudios del trauma. El artículo pone de relieve a destacados y destacadas académicas en este campo y su uso de conceptos psicoanalíticos, demostrando la preservación y aplicación significativa de estas nociones en la comprensión de fenómenos históricos y colectivos. Al acortar la brecha entre las experiencias psicológicas individuales y los traumas colectivos, los estudios del trauma ofrecen un enfoque único para interpretar y representar eventos que resisten las narrativas históricas tradicionales. We present a fully relational definition of inertial systems based in the No Arbitrariness Principle, that eliminates the need for absolute inertial frames of reference or distinguished reference systems as the ``fixed stars'' in order to formulate Newtonian mechanics. The historical roots of this approach to mechanics are discussed as well. The work is based in part in the constructivist perspective of space advanced by Piaget. We argue that inertial systems admit approximations and that what is of practical use are (...) precisely such approximations. We finally discuss a slightly larger class of systems that we call ``relatively inertial'' which are the fundamental systems in a relational view of mechanics. (shrink)

The first comprehensive survey of the criticisms of Leibniz's philosophical optimism in the first half of the eighteenth century, when what has been called the ‘debacle of the perfect world’ first began.

Accounts and analyses of the formation of scholarly and scientific communities in the early modern period by means of memory and collective identity.

While mechanics was developed under the idea of reciprocal action (interactions), electromagnetism, as we know it today, takes a form more akin to unilateral action. Interactions call for spatial relations, unilateral action calls for space, just one reference centre. In contrast, interactions are matters of relations that require at least two centres. The development of the relational electromagnetism encouraged by Gauss appears to stop around 1870 for reasons that are not completely clear but are certainly not solely scientific. By the (...) same time, Maxwell recognised the equivalence in formulae of his electromagnetism and the one advocated by Gauss and called for an explanation of why such theories so differently conceived have such a large part in common. In this work we reconstruct and update the relational electromagnetism up to the contributions of Lorentz guided by the non-arbitrariness principle (NAP) that requests arbitrary choices to be accompanied by groups of symmetries. We show that a-priori there must be two more symmetries in electromagnetism, one related to the breaking (in the description) of the relation source/detector and one relating all the perceptions of the same source by detectors moving with different (constant) relative velocities. We show that the idea of electromagnetic waves put forward in concept by Lorenz (1861-1863) before Maxwell (1865) and in formulae (1867) just after Maxwell, together with the ``least action principle'' proposed by Lorentz are enough to derive Maxwell's equations, the continuity equation and the Lorentz' force, and that there is a dual formulation in terms of fields of the receiver (as opposed to fields of the source). While Galilean transformations are associated with removing the arbitrariness implied in the election of a reference space, they will not explicitly appear in a formulation based upon a relational space although we occasionally mention their usefulness. In contrast, Lorentz' transformations will emerge in this formulation involving the relations between the perceived fields of different receivers. Moreover, the role of the full Poincaré-Lorentz group as a group of transformations of the perceived actions is elucidated. In summary, we answer Maxwell's philosophical question showing how the same theory in formulae can be abduced using different inferred entities. Each form of abduction implies as well an interpretation and a facilitation of the theoretical construction. This work relies heavily on logical concepts as abduction put forward by C. The prospective formalization of the Anthropocene as a chronostratigraphic unit by the International Commission on Stratigraphy has been intensely debated. This paper explores and assesses the stakes of this process from a philosophical perspective. I distinguish two senses of formalization—the descriptive and the evaluative—and argue that: 1) there are descriptive and evaluative formalizations of the Anthropocene beyond the confines of the ICS; 2) incoherencies between Anthropocene proposals and the ICS’s current tenets are not a decisive reason for deferring descriptive formalization; (...) and 3) the prospective evaluative formalization of the Anthropocene by the ICS would be impactful. During the second half of the nineteenth century, electronegativity has been one of the most relevant chemical concepts to explain the relationships between chemical substances and their possible reactions. Specifically, EN is a property of the substances that allows them to attract external electrons in bonding situations. The problem arises because EN cannot be measured directly. Indeed, the only way to measure it is through different properties that do can be directly measured, for instance enthalpy, ionization energies or electron affinities. (...) What is particularly troubling about this case in quantum chemistry is that the different models used to describe and quantify EN are incompatible but, in a certain sense, equivalent because the same EN scale results in all of them. By analyzing Linus Pauling’s and Robert Mulliken’s models of EN, it will be argued that, if we remain cling to a traditional representative conception of models, we cannot understand the meaning of the information provided by those models. Indeed, if we do not want to adopt an instrumentalist point of view concerning chemical knowledge, we should reconsider by virtue of what a model represents the system, or, in other words, which the factors that determine the representative power of a model are. I will propose a new perspective that incorporates the role of experimental techniques in the very notion of representation; this perspective allows us to understand how supposedly incompatible models of the same target system can be both simultaneously representative. This paper addresses a variant of the job shop scheduling problem with total tardiness minimization where task durations and due dates are uncertain. This uncertainty is modelled with intervals. Different ranking methods for intervals are considered and embedded into a genetic algorithm. A new robustness measure is proposed to compare the different ranking methods and assess their capacity to predict ‘expected delays’ of jobs. Experimental results show that dealing with uncertainty during the optimization process yields more robust solutions. A sensitivity (...) analysis also shows that the robustness of the solutions given by the solving method increases when the uncertainty grows. (shrink)

Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. Over the past decades, science funding shows a shift from recurrent block funding towards project funding mechanisms. However, our knowledge of how project funding arrangements influence the organizational and epistemic properties of research is limited. To study this relation, a bridge between science policy studies and science studies is necessary. Recent studies have analyzed the relation between the affordances and constraints of project grants and the epistemic properties of research. However, the potentially very different affordances and constraints of funding arrangements (...) such as awards, prizes and fellowships, have not yet been taken into account. Drawing on eight case studies of funding arrangements in high performing Dutch research groups, this study compares the institutional affordances and constraints of prizes with those of project grants and their effects on organizational and epistemic properties of research. We argue that the prize case studies diverge from project-funded research in three ways: 1) a more flexible use, and adaptation of use, of funds during the research process compared to project grants; 2) investments in the larger organization which have effects beyond the research project itself; and 3), closely related, greater deviation from epistemic and organizational standards. The increasing dominance of project funding arrangements in Western science systems is therefore argued to be problematic in light of epistemic and organizational innovation. Funding arrangements that offer funding without scholars having to submit a project-proposal remain crucial to support researchers and research groups to deviate from epistemic and organizational standards. En el presente trabajo intentaré poner de manifiesto las debilidades de los argumentos dados por Contessa para sustentar, como fuente del representar, a los razonamientos subrogantes válidos por sobre los sólidos. En primer lugar, analizo ciertas ventajas epistémicas del criterio sustentado sobre los RS sólidos, evidenciando, consecuentemente, los límites del criterio estipulado por Contessa. En segundo lugar, muestro que los argumentos utilizados por Contessa para descartar el criterio instituido en los RS sólidos son deficientes, ya que, en el mejor de (...) los casos, no demuestran nada y, en el peor de los casos, o bien se comete una falacia por ambigüedad o bien se comete una petición de principio. El presente trabajo se ocupa de la teoría general de Carlos Nino sobre la legítima defensa y cómo ella se enmarca, de manera más general, en su concepción sobre el liberalismo en materia penal. Se muestran dos casos problemáticos para teorías así concebidas. Se propone una alternativa para salir de estos casos problemáticos apelando a consideraciones cercanas al ideal de no dominación. This paper analyses Carlos Nino’s general theory of legitimate defense and its relation with his conception about liberalism in (...) criminal law. There are at least two problematic cases for his theory of legitimate defense. La importancia de las ciencias naturales para la vida y el pensamiento contemporáneos es reconocida ampliamente. En ética y metaética la relevancia de las ciencias naturales se encuentra estrechamente vinculada con la concepción conocida como Naturalismo ético. A pesar de que existe una vasta literatura sobre Naturalismo y Naturalismo ético no es fácil encontrar un libro que recopile lo que diferentes autores relevantes tiene para decir sobre tal tópico. El libro Ethical Naturalism. Current Debates (2012) ha venido a llenar tal (...) laguna. Este trabajo presenta el tema general del libro y analiza y critica algunas de las ideas allí desarrolladas. El propósito central es hacer algunas observaciones generales a la empresa del Naturalismo ético considerado globalmente y al mismo tiempo algunas observaciones que son relevantes sólo para algunas de las intervenciones que forman parte de la colección. The incompatibility within the context of modeling cannot be established simpliciter. The fact that modeling is understood as an activity whose representational power can only be partially established, may minimize the supposed existence of incompatible models. Indeed, it is argued from perspectivism that incompatibility can be dissolved, meaning that it becomes trivial or simply false due to the inherently pragmatic and partial nature of the act of representation and modeling. From this perspective, incompatibility can only be a consequence of a (...) misunderstanding of the very nature of modeling and representation In this sense, in order to tackle this strategy at its root from perspectivism, we will first need to outline the maximal perspectivism thesis, attempting to identify the possible escape routes that perspectivism could find in order to explain incompatibility as an illusory incompatibility. Then, we will analyze Valence Bond Model and Molecular Model of covalent bonds, and we will conclude that the dissuasive strategies used to minimize and/or disregard incompatibility prove to be fruitless. El objetivo de nuestra investigación es determinar el impacto de hábitos alimenticios en el desempeño académico. Fue evaluada los hábitos alimenticios según instrumentos validados y establecido su normalidad con Shapiro-Wilk W=0.97 y significancia p-valor=0.34. Tenemos que el consumo alimenticio también tiene distribución normal e impacta en el desempeño académico con una correlación de Pearson de 0.24 y significancia p-valor=0.04. La regresión logística establece el punto de corte de consumo igual a 38 para tener la probabilidad de un 50% de buen (...) desempeño académico. Asimismo, la estimación puntual de desempeño académico correspondiente a este corte de consumo 38 es el puntaje de 14. (shrink)

This study investigates how ownership concentration in European multinational firms is associated with these firms’ corporate social responsibility (CSR). We employ factor analysis on responsibility data from EIRiS and use a regression analysis. Using firm-level data for almost 700 European firms, we find that shareholder concentration is significantly related to such policies. That is, more concentrated ownership goes hand in hand with poorer CSR policies. In our analysis, we control for size, leverage, profitability, industry, and country of origin. We use (...) several indicators for ownership concentration. We also find that with more concentrated ownership, CSR of the firm gets worse. We suggest that especially with large shareholders, CSR would need to be included in their performance assessment. (shrink)

La biopolítica ha devenido, sin duda, una de las categorías centrales para la reflexión política contemporánea. Dada su importancia, resulta imperioso avanzar sobre algunas operaciones teóricas que no logran dar cuenta de su especificidad, en tanto que administración de la vida como forma de dominación. Al respecto, y con la intención de rehabilitar la conceptualización de la política, nos interesa demostrar cómo la aparente dicotomía entre zoé y bíos que pretende discutir Agamben no encuentra respaldo en los textos que él (...) mismo utiliza (fundamentalmente, Aristóteles y Foucault), ni tampoco en la cristalización de tales categorías en prácticas sociopolíticas (por ejemplo, la disciplina moderna con sus raíces en el monasterio cristiano). Precisamente, la identificación de la zoé ya como forma de vida es lo que nos permite comprender el interés biopolítico por gestionar la vida biológica. Así, solamente habiendo clarificado estas categorías, podrá rehabilitarse un pensamiento político sobre la política. (shrink)

Scientific pluralism has gained supporters in philosophy of science during the last decades, since it seems to accurately account for the plural and varied development of science. Arguments in defense of robust, non-merely epistemic pluralistic positions can be found in several contemporary philosophical works. According to these positions, to hold pluralism does not suppose to assume an epistemic position regarding truth and a non-realistic view on scientific theories. Monism can be thought as the “natural” opponent of scientific pluralism. In this (...) paper, we will evaluate the alleged rivalry between the two positions, paying special attention to those riskier, ontologically more robust, pluralistic proposals. We will argue that these strongest versions of pluralism fail to offer an alternative to monism: they either changes the topic or hold a weak skepticism that Hegel develops in the Phenomenology of the Spirit. Recent discussions about the microstructure of materials generally focus on the ontological aspects of the molecular structure. However, there are many types of substances that cannot be studied by means of the concept of molecule, for example, salts. For the quantum treatment of these substances, a new particle, called phonon, is introduced. Phonons are generally conceived as a pseudo-particle, that is, a mathematical device necessary to perform calculations but which does not have a "real" existence. In this context, the aim (...) of this paper will be to analyze the ontological status of phonons. For such purposes we will critically analyze the arguments that would account for the presumed nonexistence of phonons. Finally, having already demonstrated that there are not enough reasons to consider phonons as non-existing entities, we will explore some possibilities that allow us to elucidate their ontological status. En el presente texto se realiza un análisis sobre la utilidad del método de los experimentos mentales en filosofía. Dicha utilidad se da en tanto que el experimento usado sea legítimo, esto es, que cumpla con ciertas exigencias teóricas. Sin embargo, la utilidad de tal método se ve afectada por la proliferación de experimentos mentales ilegítimos. Tomando como referencia un tipo específico de experimentos mentales ilegítimos, el texto se propone presentar una explicación al anterior fenómeno basada en la relación de (...) las nociones de conocimiento y necesidad lógica. Igualmente, se presentan dos formas posibles de evitar el recurso excesivo a experimentos mentales de poca utilidad. (shrink)

Las ideas de Simón Bolívar sobre América y sobre Europa han recibido alguna atención de los investigadores. Mucho menos las que expresó sobre Asia y África. Aunque fueron marginales a su pensamiento, la reunión de sus alusiones al respecto permite arrojar alguna luz sobre la reflexión de la Independencia y sobre los cambios que el Libertador experimentó en su percepción del naciente mundo que aparecía ante sus ojos. Partiendo de una actitud orientalista y despectiva inicial, con el tiempo llegó a (...) pensar que el Oriente no podía descartarse como influencia en las instituciones americanas. (shrink)

Se estudian algunas reacciones en América Latina y se describe el proceso por el cual Renan llegó posteriormente a ser aceptado por círculos conservadores. The French historian Ernest Renan published in 1863 a Life of Jesus that questioned his divinity. The book aroused scandal and attempts of rebuttal. Se adapta al título del libro de Andre Gunder Frank para proponer un esquema de conjunto de la historia americana desde una visión no eurocéntrica y desde la historia mundial. El acento no se coloca en la relación del continente con la Europa mediterránea o atlántica, ni en procesos endógenos, sino en los contactos que mantuvo con las otras civilizaciones del Viejo Mundo: África, la Europa oriental, Rusia, el Medio Oriente, India, China y el Pacífico. Se argumenta que antes de (...) la llegada europea hubo una etapa fuertemente influida por las relaciones con Asia. Éstas continuaron aún en época colonial, en términos comerciales, demográficos y artísticos, junto a una fuerte inmigración e influencia cultural africana. Si bien la independencia supuso una serie de ilusiones sobre el fomento de las relaciones con Asia, el siglo xix fue de creciente influencia europea (demográfica, militar, política, económica, cultural). El esquema propuesto puede servir para entender mejor los procesos por los cuales en nuestros días América, como el resto del mundo, está entrando nuevamente en la órbita asiática. (shrink)

Constructivist research in Science and Technology Studies is committed to revealing the heterogeneity of technological change and the fluid boundaries between the elements involved. Its major theories, the Social Construction of Technology and Actor Network Theory, have however both been criticized for limiting themselves to the micro-level of cases, impeding a structural analysis of technological systems. This article seeks to bridge any such divides. We research the recent changes in the viticulture of Mendoza, Argentina, which underwent radical changes over the (...) past decades: once governed by low-cost yield maximization, grape production now revolves around “quality.” To show how the particular quality definition developed, we depart from a social-constructivist framework, following the sociotechnical shaping of problem-solution relationships across the wine production system. To include relevant social groups from different settings around the world, we gradually incorporate the ANT concepts of obligatory passage points, enrollment, convergence, delegation, and codes into the analysis. Combined into the concept of “sociotechnical alliance,” our analysis follows the dual process of creating agreement while establishing heterogeneous practices across settings at different levels. It shows that functioning involves alliance building and highlights the hybridity and continuous dynamics of systems at large. (shrink)

It is widely accepted among medical ethicists that competence is a necessary condition for informed consent. In this view, if a patient is incompetent to make a particular treatment decision, the decision must be based on an advance directive or made by a substitute decision-maker on behalf of the patient. We call this the competence model. According to a recent report of the United Nations (UN) High Commissioner for Human Rights, article 12 of the UN Convention on the Rights of (...) Persons with Disabilities (CRPD) presents a wholesale rejection of the competence model. The High Commissioner here adopts the interpretation of article 12 proposed by the Committee on the Rights of Persons with Disabilities. On this interpretation, CRPD article 12 renders it impermissible to deny persons with mental disabilities the right to make treatment decisions on the basis of impaired decision-making capacity and demands the replacement of all regimes of substitute decision-making by supported decision-making. In this paper, we explicate six adverse consequences of CRPD article 12 for persons with mental disabilities and propose an alternative way forward. The proposed model combines the strengths of the competence model and supported decision-making. (shrink)

El objetivo de nuestra investigación es determinar el impacto de demanda de trabajo y recursos psicológicos en el desempeño profesional. Fue evaluada la calidad laboral según instrumentos validados y establecida su normalidad. Tenemos que los recursos psicológicos y demanda de trabajo impactan en el desempeño profesional con una correlación múltiple de Pearson de 0.91. La correlación de Pearson entre calidad laboral y desempeño profesional fue de 0.69 y p valor de 0.004. La correlación de Spearman entre recursos psicológicos y desempeño (...) profesional fue de 0.735 y p valor de 0.002. (shrink)

En este ensayo intentaremos realizar una pequeña aproximación al pensamiento de Gilbert Simondon, filósofo francés cuya obra podría resumirse en sus dos tesis doctorales defendidas en 1958, una de las cuales no fue publicada de forma completa sino póstumamente. No obstante, lo dicho, tras el creciente interés en su pensamiento comenzaron a publicarse ya nacido este milenio, en particular en Argentina, sus cursos sobre percepción, imaginación, invención, información, comunicación y tecnología. A pesar de su escueta obra, Simondon es un filósofo (...) de sistema, que a partir de su teoría de la individuación intentó fundar un monismo ontogenético en el cual puedan entrar en comunicación todas las disciplinas humanas; y para ello buscó explotar todos los recursos conceptuales que brindaron las revoluciones científicas de su época. En este ensayo, sin embargo, abordaremos tan sólo el tipo de realidad o estatus ontológico que Simondon atribuía a los objetos técnicos. Para ello desarrollaremos 4 apartados y un bis. En el primero, haremos un esbozo de lo que es el método filosófico propuesto por Simondon, el cual describimos como un paradigmatismo analógico. En el segundo, desarrollaremos algunas críticas a cierto paradigmatismo particular que, según Simondon, subyace en gran parte del pensamiento occidental y que nos impide, entre otras cosas, comprender la realidad propia de los OT, a saber: el hilemorfismo. En tercer lugar, analizaremos en qué medida podemos salvar la realidad de los OT de ser reducida a mero constructo social. En cuarto lugar; analizaremos algunas analogías y disparidades entre los OT y los seres vivientes. Por último, a modo de apéndice, expondremos sucintamente un artículo de Esperanza García y Villegas Jaraleño, presentado en el último volumen de Scientia in verba, en el cual se plantea la pregunta sobre el estatus ontológico de los artefactos biotecnológicos desde una perspectiva bungeana; así como pequeñas críticas y aportes que pudiésemos hacerle desde el pensamiento simondoniano. A los cristales se los describe como a una red de átomos que puede vibrar alrededor de su posición de equilibrio. Sin embargo, el hecho de que la energía de estas ondas esté cuantificada sugiere una analogía con el campo electromagnético. En analogía con el fotón se define al fonón. Generalmente se concibe al fonón como a una cuasi-partícula, es decir, como a un instrumento matemático útil en los cálculos pero sin una existencia propia. Hoy asistimos a un inédito desafío histórico y cultural: la imparable y acrítica expansión de las Tecnologías de la Información y las Comunicaciones (TIC), en tanto estas amplían nuestras capacidades mentales y comunicativas a límites aún insospechados. Ante la radicalidad de su impacto, el desafío es empezar a vivir las TIC de una forma responsable, creativa y crítica. Hasta ahora, en cambio, las hemos vivido deslumbrados ante sus luces y ciegos ante sus sombras. En el ensayo nos preguntamos tanto “¿qué (...) hace una nueva tecnología?” como “¿qué también deshace?”. Buscamos entonces mediante una aproximación preliminar contribuir al debate acerca de los impactos existenciales, cognitivos, comunicativos y sociales de las TIC. (shrink)

The purpose of this study was to analyze the attitude of a group of cardiologists on the ethical conducts they would accept or adopt when encountered with different hypothetical situations of medical practice. Between August and September of 2011, 700 Argentine cardiologists were surveyed in situations which posed ethical dilemmas in the patient-physician relationship, among colleagues or involving financial agreements with employers or the pharmaceutical industry. Ethical conflicts were evidenced in a series of inappropriate conducts such as differential fees, trips (...) and meals sponsored by laboratories, splitting fees, overbilling, self-referral, charging for patient referral, financial compensation for ordering medical procedures, and various situations derived from the relationship with employers. In general, financial compensation from the pharmaceutical industry was more accepted than the conflictive situations which directly involved patients, colleagues or employers. The rejection of these conducts, the physicians' deontological education and the improvement of financial and organizational conditions in medical practice will help to encourage better medical professionalism and avoid unseemly behaviors. We analyze ethical policies of firms in industrialized countries and try to find out whether culture is a factor that plays a significant role in explaining country differences. We look into the firm’s human rights policy, its governance of bribery and corruption, and the comprehensiveness, implementation and communication of its codes of ethics. We use a dataset on ethical policies of almost 2,700 firms in 24 countries. We find that there are significant differences among ethical policies of firms headquartered in (...) different countries. When we associate these ethical policies with Hofstede’s cultural indicators, we find that individualism and uncertainty avoidance are positively associated with a firm’s ethical policies, whereas masculinity and power distance are negatively related to these policies. Desde los orígenes de su formación en fenomenología, Heidegger emprendió modificaciones metodológicas que tematizan el campo de la vida preteórica y llevan a la hermenéutica del Dasein creando tensiones respecto de Husserl que afectaron tanto la dimensión teórica como la personal. En este trabajo se estudia este viraje señalando sus orígenes tempranos y concentrándose en los aportes del curso Introducción a la investigación fenomenológica, del semestre de invierno de 1923/1924. Este ámbito presenta aspectos relevantes para comprender el modo en que (...) se redefine la noción de fenomenología, la estrategia de impugnación de la posición husserliana por su cartesianismo y los puntos que distancian las perspectivas respecto de la conciencia y la facticidad. El recorrido resultante ofrece elementos para comprender los puntos que llevarían poco más tarde a la fricción entre ambos pensadores que marcó profundamente la filosofía contemporánea. (shrink)

This study explores how qualitative health researchers navigate the demands of medical research ethics committees in Germany where qualitative research is subject to approval only when it is conducted in medical contexts. We present the results of a grounded theory study to investigate qualitative health researchers’ experiences with procedural ethics and the strategies they adopt to navigate its demands. Our analysis revealed six dimensions of experience and three strategies adopted by researchers to navigate the demands of medical research ethics committees. (...) All participants agreed that research ethics is of high importance in qualitative health research, but strategies to navigate the demands of medical research ethics committees ranged from avoiding, and adapting, to transforming the procedures of ethics review. Based on our findings, we provide recommendations for improving the ethics review of qualitative health research. (shrink)

According to what we propose to call “the competence model,” competence is a necessary condition for valid informed consent. If a person is not competent to make a treatment decision, the decision must be made by a substitute decision-maker on her behalf. Recent reports of various United Nations human rights bodies claim that article 12 of the Convention on the Rights of Persons with Disabilities involves a wholesale rejection of this model, regardless of whether the model is based on a (...) status, outcome, or functional approach to competence. The alleged rationale of this rejection is that denying persons the right to make their own treatment decisions based on an assessment of competence necessarily discriminates against persons with mental disorders. Based on a philosophical account of the nature of discrimination, we argue that a version of the competence model that combines supported decision-making with a functional approach to competence does not discriminate against persons with mental disorders. Furthermore, we argue that status- and outcome-based versions of the competence model are discriminatory. (shrink)
