Panpsychism is now a bona fide potential solution to the metaphysical quandary of consciousness. Much of the debate concerning the viability of panpsychism is centered on the combination problem. Intriguingly, the literature analyzing this problem displays two competing interpretations which differ in their modal force. According to the first, which we call the ‘no-necessitation view', CP consists in the absence of a priori necessitation of macro-level phenomenal facts from micro-level phenomenal facts. In contrast, the second interpretation, which we label the (...) ‘incoherence charge’, goes further by insisting that it can be positively demonstrated that micro-experiences cannot combine to yield integral macro-experiences. While conceivability arguments are vulnerable to debates over conflicting intuitions, as well as to the claim that a more complete picture will grant the desired necessitation, IC has the advantage that, if true, it removes these concerns and approaches a more final verdict. Nevertheless, while conceivability arguments are widely discussed IC has not been equally well understood or recognized. In this paper we conduct a systematic investigation and reevaluation of IC, as it applies to constitutive micropsychism. We argue that the problem is real and therefore that constitutive micropsychism is a blind alley. (shrink)

Few issues in business ethics are as polarizing as the practice of risk classification and underwrit­ ing in the insurance industry. Theorists who approach the issue from a background in economics often start from the assumption that policy-holders should be charged a rate that reflects the ex­ pected loss that they bring to the insurance scheme. Yet theorists who approach the question from a background in philosophy or civil rights law often begin with a presumption against socalled “actuarially fair” premiums (...) and in favor of “community rating,” in which everyone is charged the same price. This paper begins by examining and rejecting the three primary argu­ ments that have been given to show that actuarially fair premiums are unjust. It then considers the two primary arguments that have been offered by those who wish to defend the practice of risk classification. These arguments overshoot their target, by requiring a “freedom to under­ write” that is much greater than the level of freedom enjoyed in most other commercial transac­ tions. The paper concludes by presenting a defense of a more limited right to underwrite, one that grants the legitimacy of the central principle of risk classification, but permits specific deviations from that ideal when other important social goods are at stake. Background: The law and literature about children’s consent generally assume that patients aged under-18 cannot consent until around 12 years, and cannot refuse recommended surgery. Children deemed pre-competent do not have automatic rights to information or to protection from unwanted interventions. However, the observed practitioners tend to inform young children s, respect their consent or refusal, and help them to “want” to have the surgery. Refusal of heart transplantation by 6-year-olds is accepted. Research question: What are possible reasons to explain (...) the differences between theories and practices about the ages when children begin to be informed about elective heart surgery, and when their consent or refusal begins to be respected? Research design, participants and context: Research methods included reviews of related healthcare, law and ethics literature; observations and conversations with staff and families in two London hospitals; audio-recorded semi-structured interviews with a purposive sample of 45 healthcare professionals and related experts; interviews and a survey with parents and children aged 6- to 15-years having elective surgery (not reported in this paper); meetings with an interdisciplinary advisory group; thematic analysis of qualitative data and co-authorship of papers with participants. Ethical considerations: Approval was granted by four research ethics committees/authorities. All interviewees gave their informed written consent. Findings: Interviewees explained their views and experiences about children’s ages of competence to understand and consent or refuse, analysed by their differing emphases on informed, signified or voluntary consent. Discussion: Differing views about children’s competence to understand and consent are associated with emphases on consent as an intellectual, practical and/or emotional process. Conclusion: Greater respect for children’s practical signified, emotional voluntary and intellectual informed consent can increase respectful understanding of children’s consent. Nurses play a vital part in children's practitioner-patient relationships and physical care and therefore in all three elements of consent. (shrink)

Habermas has argued that many of the endemic socio- economic problems of Western society are either symptoms or prod ucts of a 'lopsided' process of cultural rationalization, one that has emphasized instrumental forms of rationality over communicative. But other than presenting a rather general typology of lifeworld pathologies, Habermas has not done much to specify what these problems might be, nor has he provided any 'middle-range' analysis of the mechanisms through which they might be generated. This paper discusses some of (...) the ways in which, consistent with Haber mas's general framework, rational choice theory can be used for pre cisely this task. In this analysis, rational choice theory is not presented as a comprehensive theory of action, but is employed as a critical- diagnostic tool that allows the theorist to identify undesirable social interaction patterns that arise from a broader instrumentalization of the lifeworld. Moriarty argues that the Market Failures Approach to business ethics is inapplicable to “real world” problems, because it treats “market failure” as a failure to achieve Pareto efficiency. Depending upon how it is applied, Pareto efficiency is either trivially easy to satisfy or else so demanding that no real-world market could ever satisfy it. In this Commentary, I argue that Moriarty overstates these difficulties. The regulatory structure governing markets is best understood as an attempt to maximize the number of Pareto-improving (...) exchanges that occur. There is no reason to think business self-regulation cannot be guided by the same normative-conceptual framework. (shrink)

The recent renewal of interest in the philosophy of Henri Bergson has increased both recognition of his influence on twentieth-century philosophy and attention to his relationship to phenomenology. Until now, the question of Martin Heidegger’s debt to Bergson has remained largely unanswered. Heidegger’s brief discussion of Bergson in Being and Time is geared toward explaining why he fails in his attempts to think more radically about time. Despite this dismissal, a close look at Heidegger’s early works dealing with temporality reveals (...) a sustained engagement with Bergson’s thought. In The Origin of Time, Heath Massey evaluates Heidegger’s critique of Bergson and examines how Bergson’s efforts to rethink time in terms of duration anticipate Heidegger’s own interpretation of temporality. Massey demonstrates how Heidegger follows Bergson in seeking to uncover “primordial time” by disentangling temporality from spatiality, how he associates Bergson with the tradition of philosophy that covers up this phenomenon, and how he overlooks Bergson’s ontological turn in Matter and Memory. Through close readings of early major works by both thinkers, Massey argues that Bergson is a much more radical thinker with respect to time than Heidegger allows. (shrink)

Loss of the Y‐chromosome is a common feature of species with chromosomal sex determination. However, our understanding of why some lineages frequently lose Y‐chromosomes while others do not is limited. The fragile Y hypothesis proposes that in species with chiasmatic meiosis the rate of Y‐chromosome aneuploidy and the size of the recombining region have a negative correlation. The fragile Y hypothesis provides a number of novel insights not possible under traditional models. Specifically, increased rates of Y aneuploidy may impose positive (...) selection for (i) gene movement off the Y; (ii) translocations and fusions which expand the recombining region; and (iii) alternative meiotic segregation mechanisms (achiasmatic or asynaptic). These insights as well as existing evidence for the frequency of Y‐chromosome aneuploidy raise doubt about the prospects for long‐term retention of the human Y‐chromosome despite recent evidence for stable gene content in older non‐recombining regions. Society, based on contract and voluntary exchange, is evolving, but remains only partly developed. Goods and services that meet the needs of individuals, such as food, clothing, and shelter, are amply produced and distributed through the market process. However, those that meet common or community needs, while distributed through the market, are produced politically through taxation and violence. These goods attach not to individuals but to a place; to enjoy them, individuals must go to the place where they are. Land (...) owners, all unknowingly, distribute such services contractually as they rent or sell sites. Rent or price is the market value of such services, net after disservices, as they affect each site. By distributing occupancies to those who can pay the highest price, land owners’ interests align with those of society. Without this, tenure would be precarious—by force or favor of politicians. The 18th-century separation of land from state, so little studied by historians, permitted the development of modern property in land. This change is perhaps “the greatest single step in the evolution of Society the world has ever seen.” When land owners realize that they market community services, they will organize to produce and administer them as well, and society will be made whole. This work analyzes the centrality of law in nineteenth-century historical and institutional economics and is a prehistory to the new institutional economics of the late twentieth century. In the 1830s the 'new science of law' aimed to explain the working rules of human society by using the methodologically individualist terms of economic discourse, stressing determinism and evolutionism. Practitioners stood readier than contemporary institutionalists to admit the possibilities of altruistic values, bounded rationality, and institutional inertia into their research program. Professor Pearson (...) shows that the positive analysis of law tended to push normative discussions up from the level of specific laws to that of society's political organization. The analysis suggests that the professionalization of the social sciences - and the new science's own imprecision - condemned the program to oblivion around 1930. Nonetheless, institutional economics is currently developing greater resemblances to the now-forgotten new science. (shrink)

Husserl’s early picture of explanation in the sciences has never been completely provided. This lack represents an oversight, which we here redress. In contrast to currently accepted interpretations, we demonstrate that Husserl does not adhere to the much maligned deductive-nomological (DN) model of scientific explanation. Instead, via a close reading of early Husserlian texts, we reveal that he presents a unificationist account of scientific explanation. By doing so, we disclose that Husserl’s philosophy of scientific explanation is no mere anachronism. It (...) is, instead, tenable and relevant. We discuss how Husserl and other contemporary thinkers draw theoretical inspiration from the same source—namely, Bernard Bolzano. Husserl’s theory of scientific explanation shares a common language and discusses the same themes as, for example, Phillip Kitcher and Kit Fine. To advance our novel reading, we discuss Husserl’s investigations of grounding, inter-lawful explanation, intra-mathematical explanation, and scientific unification. (shrink)

This paper makes a phenomenological contribution to the distinction between personal and subpersonal types of explanation. I expound the little-known fact that Husserl gives an account of personal level explanation via his exposition of our capacity to express the understanding of another’s motivational nexus when we are in the personalistic attitude. I show that Husserl’s unique exposition of the motivational nexus conveys its concrete, internally coherent, and intentional nature, involving relationships amongst the sense contents of acts of consciousness. Moreover, the (...) motivational nexus is a generative space of possibility and choice. I show that, for these reasons, motivational explanation is not causal, nor deductive nomological, nor does it reduce to subpersonal explanation. I finish with the comment that the uniqueness of personal level explanation points towards the possibility that the human sciences ought also employ types of explanations not found in natural sciences. Evidence-based medicine has always required integration of patient values with ‘best’ clinical evidence. It is widely recognized that scientific practices and discoveries, including those of EBM, are value-laden. But to date, the science of EBM has focused primarily on methods for reducing bias in the evidence, while the role of values in the different aspects of the EBM process has been almost completely ignored.

Heidegger claims in Being and Time that Bergson fails to overcome traditional ontology because his concept of time is fundamentally Aristotelian. On the basis of this hasty dismissal, it is tempting to conclude that Heidegger was not terribly interested in Bergson or that he only wanted to prevent readers from confusing his view of time with Bergson’s. To the contrary, a survey of Heidegger’s early lectures and writings on the issue of time reveals a strong interest in Bergson and an (...) acknowledgement of his importance as a pivotal thinker concerning time. In fact, Heidegger appropriates key aspects of Bergsonism, such as Bergson’s way of contrasting the measurement of time and its experiential origins, revealing that his ambivalence toward Bergson initially arises from concerns about his method and his concept of life rather than his understanding of time. ABSTRACT Philosophers who work on race and racism have been reluctant to embrace the notion that the United States is, or will soon be, a postracial society. For many, this view is refuted by a wealth of evidence that racism persists in many forms and that race continues to have a significant impact on one's life chances. Nevertheless, some critics of postracialism have refused to reject it in principle or have exempted a particular variety of it from their critiques. This (...) essay attempts to show that the ideal of a postracial society is actually a combination of two contradictory tendencies, each defined by its temporality. Distinguishing these tendencies allows us to see that there are two fundamentally different types of postracialism with contradictory assumptions and conflicting priorities. (shrink)

According to Hannah Arendt, the first impetus for her final project, The Life of the Mind, was her astonishment at the apparent lack of thought at the root of Adolf Eichmann’s crimes against humanity—a “manifest shallowness” which, nevertheless, “was not stupidity, but thoughtlessness.” This spectacle of the absence of thought, in the light of the immeasurable harm done to the victims of the Nazi regime, motivated her to get to the bottom of what it means to think. Since thinking is (...) often portrayed by philosophers as a withdrawal from the world, Arendt raises the question “Where are we when we think?” In pursuit of an answer, she provides a reading of Kafka’s parable “HE,” which she interprets as a description of the “region of thought” as a battleground between the past and thefuture. This parable enables Arendt to understand the activity of thinking in terms of temporality. While Kafka’s protagonist dreams of rising above the conflict and adopting a position outside time, Arendt argues that thoughtful reflection happens in the “gap between past and future” which philosophers have called the nunc stans or the moment. Rather than being timeless, in her view, thinking moves along a diagonal “thought-train” emerging from this gap. Arendt sheds more light on thinking by considering how its temporality differs from that of willing, which is determined by a primacy of the future. This difference between thinking and willing produces a conflict between them, which many philosophers have struggled to resolve. Arendt presents Hegel as a case in which this conflict is resolvednot, as we might expect, by a triumph of thought, but rather a triumph of the will. Arendt’s reflections on the temporality of thinking in Kafka and Hegel enable us to distinguish several different forms of thoughtlessness according to their dominant tense. Although Arendt does not spell out these distinctions herself, they make it possible to develop a deeper understanding of Eichmann’s thoughtlessness and its relation to evil. (shrink)

This book advances a novel theory of international justice that combines the orthodox liberal notion that the lives of individuals are what ultimately matter morally with the putatively antiliberal idea of an irreducibly collective right of self-governance. The individual and her rights are placed at center stage insofar as political states are judged legitimate if they adequately protect the human rights of their constituents and respect the rights of all others. Yet, the book argues that legitimate states have a moral (...) right to self-determination and that this right is inherently collective, irreducible to the individual rights of the persons who constitute them. Exploring the implications of these ideas, the book addresses issues pertaining to democracy, secession, international criminal law, armed intervention, political assassination, global distributive justice, and immigration. A number of the positions taken in the book run against the grain of current academic opinion: there is no human right to democracy; separatist groups can be morally entitled to secede from legitimate states; the fact that it is a matter of brute luck whether one is born in a wealthy state or a poorer one does not mean that economic inequalities across states must be minimized or even kept within certain limits; most existing states have no right against armed intervention; and it is morally permissible for a legitimate state to exclude all would-be immigrants.
