Despite general consent onproviding genetic information in a nondirectivefashion to preserve value neutrality andenhance client's autonomy, there is no acceptedcommon definition of what non-directivenessreally is or (...) ought to be. The study of social justice asks: what sorts of social arrangements are equitable ones? But also: how do we derive the inequitable arrangements we often observe in human societies? In particular, in spite of explicitly stated equity norms, categorical inequity tends to be the rule rather than the exception. The cultural Red King hypothesis predicts that differentials in group size may lead to inequitable outcomes for minority groups even in the absence of explicit or implicit bias. We test this prediction (...) in an experimental context where subjects divided into groups engage in repeated play of a bargaining game. We ran 14 trials involving a total of 112 participants. The results of the experiments are statistically significant and suggestive: individuals in minority groups in these experiments end up receiving fewer resources than those in majority groups. Combined with previous theoretical findings, these results give some reason to think that the cultural Red King may occur in real human groups. (shrink)

Patient rights are universal values which we have to adopt. It is not so easy, however, to put such values and principles into effect. As approaches and attitudes differ from individual to individual, from society to society, and from country to country, a uniform application of these values is difficult. If we want to reach a general conclusion about the status of patient rights in the world as whole, we should examine the situation in individual countries. As far as Turkey (...) is concerned, we can say that, although the idea of patient rights is accepted in principle, patient rights have yet to be adequately implemented. (shrink)

Germany has just started a public debate on priority-setting, rationing and cost-effectiveness due to the cost explosion within the German health care system. To date, the costs for German health care run at 11,6 % of its Gross Domestic Product (GDP, 278,3 billion €) that represents a significant increase from the 5,9 % levels present in 1970. In response, the German Parliament has enacted several major and minor legal reforms over the last three decades for the sake of cost containment (...) and maintaining stability of the health care system. The Statutory Health Insurance—SHI (Gesetzliche Krankenversicherung—GKV) is based on the fundamental principle of solidarity and provides an ethical and legal framework for implementing equity, comprehensiveness and setting the principles and rules for financing and providing health care services and benefits. Within the SHI system, several major actors can be identified: the Federal Ministry of Health, the 16 state ministries of health, the Federal Joint Committee (G-BA), the physicians (with their associations) and the hospitals (with their organizations) on the provider side, and the sickness funds with their associations on the purchasers’ side. This article reviews the structure and complexities of the German health care system with its major players and participants. The focus will be put on relevant ethical, legal and economic aspects for prioritization, rationalization, rationing and cost-effectiveness of medical benefits and services. In conclusion, this article pleads for open discussion on the challenging subject of priority-setting instead of accepting the implicit and non-transparent rationing of medical services that currently occurs at many different levels within the health care system, as it stands today. The replicator dynamics and Moran process are the main deterministic and stochastic models of evolutionary game theory. The models are connected by a mean-field relationship—the former describes the expected behavior of the latter. However, there are conditions under which their predictions diverge. I demonstrate that the divergence between their predictions is a function of standard techniques used in their analysis and of differences in the idealizations involved in each. My analysis reveals problems for stochastic stability analysis in a broad class (...) of games, demonstrates a novel domain of agreement between the dynamics, and indicates a broader moral for evolutionary modeling. Building on the emotion-centered model of voluntary work behavior, this research tests the relations between leader narcissism, followers’ malicious and benign envy, and supervisor-targeted counterproductive work behavior. Results across five studies, two experimental studies, and two field surveys indicate that leader narcissism relates positively to followers’ negative emotions, which in turn mediates the positive relation between leader narcissism and supervisor-targeted CWB. Proposed negative relations between leader narcissism and positive emotions were only partly supported. Our findings advance the understanding of envy (...) and the detrimental impact of leader narcissism on organizational functioning. (shrink)

Are critiques of the "West" peculiar to the Muslim world? Are they a reflection of a simple discontent with the international order or a conservative rejection of Western-originated, universal modernity? How should Western intellectuals and leaders respond to the Muslim critiques?

Scientific curation, where scientific evidence is selected and shared, is essential to public belief formation about science. Yet common curation practices can distort the body of evidence the public sees. Focusing on science journalism, we employ computational models to investigate how such distortions influence public belief. We consider these effects for agents with and without confirmation bias. We find that standard journalistic practices can lead to significant distortions in public belief; that preexisting errors in public belief can drive further distortions (...) in reporting; that practices that appear relatively unobjectionable can produce serious epistemic harm; and that, in some cases, common curation practices related to fairness and extreme reporting can lead to polarization. The practice of HARKing---hypothesizing after results are known---is commonly maligned as undermining the reliability of scientific findings. There are several accounts in the literature as to why HARKing undermines the reliability of findings. We argue that none of these is right and that the correct account is a Bayesian one. HARKing can indeed decrease the reliability of scientific findings, but it can also increase it; which effect HARKing produces depends on the difference of the prior odds of hypotheses characteristically selected (...) ex ante and ex post to observing data. Further, we show how misdiagnosis of HARKing can lead to misprescription in the context of the replication crisis. (shrink)

Zusammenfassung. Inzwischen ist „Dolly” mehrfach durch die Klonierungen anderer Säugetiere hinreichend bestätigt worden. Im Januar 1999 sollen Koreanische Forscher sogar den ersten menschlichen Embryo kloniert haben. Im folgenden werden zunächst biologisch-technische Grundlagen aktueller Klonierungstechnologien des Embryo-Splittings und der Zellkerntransplantation vorgestellt. Anschließend folgt eine kurze ethische Bewertung der Klonierung beim Menschen, wobei das Klonen als ein Verstoß gegen die Menschenwürde klassifiziert wird. Seit der Verabschiedung des Embryonenschutzgesetzes (ESchG) im Januar 1991 sind jetzt über neun Jahre vergangen. In Anbetracht der wissenschaftlichen Erkenntnisse (...) und des technischen Fortschrittes auf dem Gebiet der Reproduktionsmedizin in den letzten Jahre meldet das ESchG nicht nur zunehmenden Interpretationsbedarf an, sondern weist auch z.T. gravierende Strafbarkeitslücken auf. Mit dem vorliegenden Beitrag soll ein Stück weit eine auf der Basis des naturwissenschaftlichen Fortschritts fundierte ethisch-rechtliche Diskussion insbesondere vor dem Hintergrund des in die Jahre gekommenen deutschen ESchG angeregt werden. Definition of the problem: Recently, ”Dolly” has been confirmed by cloning several other mammals. In January 1999 it was even reported that Korean researchers first of all had cloned the first human embryo. In the following article some basic biological and technical aspects of modern cloning strategies, such as embryo splitting and nuclear transplantation, will be described. Subsequently, a short critical analysis will discuss the ethical problem of cloning human beings. Since the German Embryo Protection Act from January 1991 substantial (...) progress in cloning technology has been made, so that the principal question now is whether the Act is still sufficient to forbid human cloning or whether it should be revised. Arguments and conclusion: With advanced technical progress human cloning now seems to be possible. From the ethical point of view, the cloning of human beings should be rejected, as it offends the fundamental value of human dignity. On the other hand, the German Embryo Protection Act is antiquated and does not provide the required protection. This article may stimulate further discussion in the fields of ethics and jurisdiction, especially regarding to the Embryo Protection Act. (shrink)

Deep brain stimulation is an invasive technique designed to stimulate certain deep brain regions for therapeutic purposes and is currently used mainly in patients with neurodegenerative disorders, such as Parkinson’s disease. However, DBS is also used increasingly for other experimental applications, such as the treatment of psychiatric disorders, weight reduction. Apart from its therapeutic potential, DBS can cause severe adverse effects, some that might also have a significant impact on the patient’s personality and autonomy by the external stimulation of DBS (...) which effects lie beyond the individual’s control and free will. The article’s purpose is to outline the procedures of DBS currently used in therapeutic and experimental applications and to discuss the ethical concerns regarding this procedure. It will address the clinical benefit-risk-ratio, the particular ethics of research in this field, and the ethical issues raised by affecting a patient’s or an individual’s personality and autonomous behaviour. Moreover, a potential ethical guideline, the Ulysses contract is discussed for the field of clinical application as well as the question of responsibility. (shrink)

After several technological revolutions in which technologies became ever more present in our daily lives, the digital technologies that are currently being developed are actually fading away from sight. Information and Communication Technologies are not only embedded in devices that we explicitly “use” but increasingly become an intrinsic part of the material environment in which we live. How to conceptualize the role of these new technological environments in human existence? And how to anticipate the ways in which these technologies will (...) mediate our everyday lives? In order to answer these questions, we draw on two approaches that each offers a framework to conceptualize these new technological environments: Postphenomenology and Material Engagement Theory. As we will show, each on their own, these approaches fail to do justice to the new environmental role of technology and its implications for human existence. But by bringing together Postphenomenology’s account of technological mediation and Material Engagement Theory’s account of engaging with environments, it becomes possible to sufficiently account for the new environmental workings of technology. To do justice to these new workings of environmental technologies, we introduce and develop the concept of “Technological Environmentality.”. (shrink)

On 25 April 2002, the German Parliament has passed a strict new law referring to stem cell research. This law took effect on July 1, 2002. The so-called embryonic Stem Cell Act ( Stammzellgesetz — StZG ) permits the import of embryonic stem (ES) cells isolated from surplus IvF-embryos for research reasons. The production itself of ES cells from human blastocysts has been prohibited by the German Embryo Protection Act of 1990, with the exception of the use of ES cells (...) which exist already. The debate on the legitimate use of ES cells escalated, after the main German research funding agency, the Deutsche Forschungsgemeinschaft (DFG), unexpectedly published new guidelines recommending are stricted use of human ES cells for research. Meanwhile, the debate has ethically dividedsociety, political parties, government and church members into a group supporting and a group rejecting ES cell research. The arguments in favour of such a research can be summarized as arguments derived from a new ethics ofhealing calling for a therapeutic imperative, whereas the arguments against can be summarized as arguments violating the fundamental principle of human dignity as they imply the destruction of human embryos. This article willtry to present and evaluate various ethical arguments founded on the latest biological and medical data on the potential use of stem cell technologies. It will finally come to the conclusion that ES cell research is opposed to human dignity, since the procedures of isolating ES cells require the destruction and instrumentalization of human embryos. Human embryos are human beings at a very early stage of their development, fully possessing the ability of completing their development. At this very early stage, human embryos are extremely dependent and fragile, and thus vulnerable corporealities. Vulnerability and human dignity demand the protection of the embryo's corporeal integrity. Hence, this essay will try to propagate research with adult stem(AS) cells, a procedure which does not require the destruction of human embryos; with regard to the necessary plasticity, it should be emphasized that AS cells very much resemble ES cells. The question of Turkey's membership in the EU has been the subject of debates about the cosmopolitan future of Europe. Using the concept of cosmopolitanism as developed by Beck, Habermas, and Delanty, this article argues that the possibility of an antiontological and multicultural cosmopolitan European community will largely depend on how Europe answers the question of whether Turkey should be granted membership in the EU. Turkey forces a debate on three crucial areas that are directly related to the cosmopolitan future (...) of Europe: (a) Europe's geopolitical place in the global world, (b) postnational forms of a European public sphere, and (c) European identity. The potential for a multicultural and pluralistic cosmopolitanism is a two-way street, and while Turkey's membership will have a transformative impact on the EU, the membership process will also have a similar impact on Turkish democracy and modernity. Typically, public discussions of questions of social import exhibit two important properties: they are influenced by conformity bias, and the influence of conformity is expressed via social networks. We examine how social learning on networks proceeds under the influence of conformity bias. In our model, heterogeneous agents express public opinions where those expressions are driven by the competing priorities of accuracy and of conformity to one’s peers. Agents learn, by Bayesian conditionalization, from private evidence from nature, and from the public (...) declarations of other agents. Our key findings are that networks that produce configurations of social relationships that sustain a diversity of opinions empower honest communication and reliable acquisition of true beliefs, and that the networks that do this best turn out to be those which are both less centralized and less connected. The Triumph of Liberal Democratic Peace and the Dangers of Its Success” provides an overview of the “liberal democratic peace theory” that is associated with Kant and has been developed by Doyle and other contemporary scholars. The chapter examines the problem of wars that are fought in the name of democracy and the way that the liberal democratic peace theory can end up encouraging military interventions. It argues that a careful understanding of the Kantian democratic peace theory can resist the (...) urge to intervene. It employs Galtung’s notion of cultural violence to provide a critique of interventionist peace action. It concludes by advising that we work to find a way to build bridges between democracies and non-democracies. (shrink)

The lack of conceptual analysis within cognitive science results in multiple models of the same phenomena. However, these models incorporate assumptions that contradict basic structural features of the domain they are describing. This is particularly true about the domain of mathematical cognition. In this paper we argue that foundational theoretic aspects of psychological models for language and arithmetic should be clarified before postulating such models. We propose a means to clarify these foundational concepts by analyzing the distinctions between metric and (...) linguistic compositionality, which we use to assess current models of mathematical cognition. In this paper, the author aims to show that transhumanists are confused about their own conception of the posthuman: transhumanists anticipate radical transformation of the human through technology and at the same time assume that the criteria to determine what is “normal” and what is “enhanced” are univocal, both in our present time and in the future. Inspired by Nietzsche’s notion of the Overhuman, the author argues that the slightest “historical and phenomenological sense” discloses copious variations of criteria, both diachronic (...) and synchronic, for what can be considered “normal” and “enhanced.” Radical transformation through technology does not simply enable us to become “stronger,” “smarter,” or “healthier,” but it can and often will also change the very standard or yardstick with which we measure what counts as “stronger,” “smarter,” or “healthier.” Put yet differently: new and emerging technologies are not neutral means but often bring about different and, from our current perspective, foreign standards for determining what are “normal” and “enhanced” capacities. Since the qualitative meanings of these terms are themselves not fixed, it is unintelligible and too reassuring to simply predict that new technologies will enhance human beings. (shrink)

This book explores the implications of agonistic democratic theory for political practice. Fuat Gürsözlü argues that at a time when political parties exacerbate political division, political protesters are characterized as looters and terrorists, and extreme partisanship and authoritarian tendencies are on the rise, the agonistic approach offers a much-needed rethinking of political practice to critically understand challenges to democracy and envision more democratic, inclusive, and peaceful alternatives. This book investigates how we should form ourselves in a world saturated with technologies that are profoundly intruding in the very fabric of our selfhood. How do we recognize that smart technological environments, imaging technologies and smart drugs increasingly shape who and what we are and influence who we ought to be? Tackling this issue requires going beyond the persistent and stubborn inside-outside dualism and recognizing that what we consider our "inside" self is to a great extent shaped by our (...) "outside" world. Inspired by various philosophers - especially Nietzsche, Peirce and Lacan -this book demonstrates that the values, goals and ideals that humans encounter in their environments not only shape their identities but also enable them to critically relate to their present state. The author argues against understanding technological self-formation in terms of making ourselves better, stronger, and smarter. Rather, we should conceive it in terms of technological sublimation, which redefines the very notion of human enhancement. In this respect the author introduces an alternative, more suitable theory, namely Technological Sublimation Theory (TST).
