Fake news has been the focus of debate, especially since the election of Donald Trump (2016), and remains a topic of concern in democratic countries worldwide, given (a) their threat to democratic systems and (b) the difficulty in detecting them. Despite the deployment of sophisticated computational systems to identify fake news, as well as the streamlining of fact-checking methods, appropriate fake news detection mechanisms have not yet been found. In fact, technological approaches are likely to be inefficient, given that fake (...) news are based mostly on partisanship and identity politics, and not necessarily on outright deception. However, as disinformation is inherently expressed linguistically, this is a privileged room for forensic linguistic analysis. This article builds upon a forensic linguistic analysis of fake news pieces published in English and in Portuguese, which were collected since 2019 from acknowledged fake news outlets. The preliminary empirical analysis reveals that fake news pieces employ particular linguistic features, e.g. at the levels of typography, orthography and spelling, and morphosyntax. The systematic identification of these features, which will allow mapping linguistic resources and patterns used in those contexts, contributes to scholarship, not only by enabling a streamlined development of computational detection systems, but more importantly by permitting the forensic linguistics expert to assist criminal investigations and give evidence in court. Drawing on Brown and Fraser’s (in: Giles, Scherer (eds) Social markers in speech, Cambridge University Press, Cambridge, pp 33–62, 1979) framework for the analysis of communicative situations and Fuentes Rodríguez’s (Lingüística pragmática y Análisis del discurso, Arco Libros, Madrid, 2000; in Estudios de Lingüística: Investigaciones lingüísticas en el siglo XXI, 2009. https://doi.org/10.14198/ELUA2009.Anexo3.04 ) model of pragmatic analysis, this paper examines three home-made recordings featuring some of the members of the terrorist cell responsible for the 2017 vehicle-ramming attacks in Barcelona and (...) Cambrils weighted as evidence during the trial held between November 2020 and May 2021 in the Spanish National High Court. The aim of this qualitative analysis is to test whether the linguistic evidence available supports the allegation that the participation in these recordings by one of the accused, Mohamed Houli Chemlal, had been planned by his interlocutors. Results show, first, that the exchanges analyzed present features indicative of both spontaneity and (limited) planification. Second, that Houli makes key contributions to the unfolding of the interactions shown in the recordings and that he does so in a cooperative and apparently relaxed manner, which could at best provide only partial support to his allegations. It is claimed that forensic linguistic analysis can generate valuable insights within terrorism-related legal proceedings. (shrink)

Linguistic Deception Detection DD is a well-established part of forensic linguistics and an area that continues to attract attention on the part of researchers, self-styled experts, and the public at large. In this article, the various approaches to DD within the general field of linguistics are examined. The basic method is to treat language as a form of behaviour and to equate marked linguistic behaviour with other marked forms of behaviour. Such a comparison has been identified in (...) other fields such as psychology and kinesics as being associated with stress linked to the attempt to deceive, typically in such contexts as examined here. Representative authentic examples of some of the most common linguistic indicators of deception that have been identified are discussed, dividing them into two general categories which we here introduce: language as revealer and language as concealer. We will argue that linguistic analysis for DD should be conducted relative to the subject’s individual linguistic patterns of behaviour, not on absolutes related to broad generalisations about what is supposedly normal or unmarked in the population at large. We will also briefly discuss some structured methods for linguistic analysis for DD and the prospect that technology and artificial intelligence will provide the means to automate and digitalise the linguistic DD process. We maintain that caution is advisable when considering these, as DD will, in all probability, always remain a work in progress, with the need for a flexible human evaluator ready to take into account many different aspects of the individual subject and the case in question. Advancements in digital technology have made it easy to alter faces using editing software, posing challenges for industries in verifying photograph authenticity. Digital image forensics, a scientific method, is employed to gather data and determine the veracity of faces. This study assesses the effectiveness of digital image forensics in detecting fake digital faces using tools such as Foto Forensics, Forensically Beta, and Opanda IExif. Foto Forensics analyzes JPEG picture compression levels to detect image edits, revealing metadata differences compared to the (...) original photo. Forensically Beta examines digital characteristics like color and noise levels to identify alterations. Opanda IExif scrutinizes image metadata, disclosing information about the camera used and subsequent changes. All three forensic methods effectively identify fake digital faces. Analyzing metadata differences and contrast variations between the original and altered faces proves to be an effective method for spotting alterations. Digital image forensics enhances legal and investigative processes, serving as a valuable tool for identifying digital face manipulation. Stronger digital security measures, including improved encryption, authentication, and legal regulations, are needed to protect against facial photograph manipulation. Updating legal and regulatory frameworks for digital security is vital to address increasingly sophisticated techniques used in facial photograph editing. As digital technology advances, continuous development and improvement of forensic techniques are crucial to detect digital face fabrication. Given the growing complexity of digital editing tools and the ease with which facial images can be altered, reliable methods are essential. Cybercrime has increased significantly, recently, as a result of both individual and group criminal practice, and is now a threat to individuals, organisations, and democratic systems worldwide. However, cybercrime raises two main challenges for legal systems: firstly, because cybercriminals operate online, cybercrime spans beyond the boundaries of specific jurisdictions, which constrains the operation of the police and, subsequently, the conviction of the perpetrators; secondly, since cybercriminals can operate from anywhere in the world, law enforcement agencies struggle to identify the origin (...) of the communications, especially when obfuscation strategies are used, e.g. dark web fora. Nevertheless, cybercriminals inherently use language to communicate, so the linguistic analysis of suspect communications is particularly helpful in deterring cybercriminal practice. This article reports the potential of forensic translation in the fight against cybercrime. Although the term ‘forensic translation’ is typically understood as a synonym of ‘legal translation’, it is argued that the implications of forensic translation span beyond those of legal translation, to include analyses of language rights, of the right to interpretation and translation in legal procedures (in the EU), or even investigative and intelligence practices. Translation is a pervasive activity that is conducted, not only by professional translators, but also by lay speakers of language, often using machine translation systems. The ease of use of the latter makes it particularly suitable for cross-border criminal (e.g. extortion or fraud) and cybercriminal communications (e.g. cybertrespass, cyberfraud, cyberpiracy, cyberporn or child online porn, cyberviolence or cyberstalking). This article presents the results of the analysis of cybercriminal communications from a forensic translation perspective. It demonstrates that translation is frequently used to spread cybercriminal communications, and that reverse-engineering the translational procedure will assist law enforcement agencies in narrowing down their pool of suspects and, consequently, deter cybercriminal threats. There are many different ways in which modern Corpus Linguistics can be used to enrich and broaden our understanding of legal discourse. Based on the central principle of co-occurrence and co-selection in language construction, this paper reviews current applications of Corpus Linguistics in the area of legal discourse focusing on issues ranging from phraseology, variation in legal discourse, legal translation, register and genre perspectives on legal discourse, legal discourse in forensic contexts to evaluative language in judicial settings. Over the past thirty years or so, theoretical work in such fields as legal semiotics and law and literature has argued that the legal process is profoundly rhetorical. At the same time, a number of communication-based disciplines such as semiotics, sociolinguistics and linguistic anthropology have provided, particularly in interdisciplinary combination with law, a wealth of empirical evidence on, and insight into, the micro-contexts of language and communication in the legal process. However, while these invaluable nitty-gritty analyses provide empirical support for (...) a rhetorical thesis, work in these areas has tended to ignore rhetoric as an explanatory principle. This article introduces an overarching rhetorical framework for the discursive construction and management of cases in contemporary Anglo-American legal processes. Taking ‘forensic’ as relating to the conduct of cases and ‘discourse’ as semiosis-in-practice, I argue that the practices within which forensic discourse is embedded are not, as the received legal view would have it, aimed at revealing an impartial truth but are deeply rhetorical practices aimed at persuading decision-makers to provide a remedy for a claimed wrong. By looking across forensic texts and contexts, I identify common elements of forensic discourse that can be found both in classical forensic orations and throughout the modern legal process and consider how these intersect with critical forces of agency and structure and the particularities of semiosis in situated context. An awareness of commonalities across forensic discourse can help sharpen our focus on the critical causes and consequences of individual and structural difference and point to consequential suggestions for reform. Se presentan los resultados de una investigación cualitativa hermenéutica sobre la lingüística cognitiva y la lingüística aplicada, relacionadas con otras ciencias en un contexto específico de la comunidad científica especializada. Desde una visión integral y holística de las ciencias biomédicas y humanas, asimismo, se estudian los lenguajes técnico-científicos de la ciencia y de la tecnología para facilitar la interrelación cognitiva entre las diferentes disciplinas. Este estudio permite crear capacidades para evaluar el acervo léxico en contexto, útil para la transmisión y (...) la transformación del conocimiento en un lenguaje propio acorde a la exigencia del método científico. El objetivo consistió en indagar sobre la relación de la unidad léxica con su nexo cognitivo a una unidad terminológica de uso cotidiano en la información y en la comunicación académica de la práctica médico-legal forense. Los resultados establecen diferencia y precisan cierta comprensión de la significación de unidades léxicas ambiguas de mayor relevancia y frecuencia, utilizadas en este ámbito del conocimiento, en cuatro categorías de análisis; según las características propias de la disciplina en dialogo con otras ciencias en contexto. Se evidencia la importancia de educar durante el proceso enseñanza-aprendizaje significativo de la disciplina en contexto, desde la metalingüística del objeto de estudio dimensionado y relacionado con otros objetos de estudio, que permita el proceso cognitivo del lenguaje técnico-científico transdisciplinar, la apropiación social y la circulación del conocimiento aplicado a las prácticas médico legales integrales en relación entre la Psicofarmacología, la Psiquiatría, la Antropología y la Psicología, con las ciencias biomédicas y humanas. In this work results of a qualitive hermeneutic research about a cognitive and applied linguistic related to other sciences in an specific context of a given scientific community were presented, a technical and scientific language regarding science and technology was pointed out from an integral vision in order to facilitate cognitive relationship among different disciplines. This study also allows to create capacities in order to assess vocabulary in context, useful for the transmission and transformation of knowledge according to a scientific method. The objective was directed to know about the relationship between the lexical unit and its meaning in a given communicative context and in the academic communication of a medical - legal forensic practice. The importance of educate during the teaching learning process is also mentioned in this research and the main objective is to develop an assertive medical practice among Psychopharmacology, psychiatric, anthropology and psychology with biomedical and human sciences. This review discusses Harold Berman’s, Law and Language, published by Cambridge University Press in 2013. It locates this short book in relation to Berman’s extensive body of publications in international and comparative law, and asks what contribution the book’s recent, posthumous publication can make to current debates over approaches to forensic linguistics. Particular attention is given to Berman’s conceptualisation of law as a ‘living language’, as well as to his coining of the term ‘communification’ to describe the value (...) of legal-lay dialogue in building a public sense of community and in sustaining the legitimacy of legal systems. This paper is aimed at assessing how power, control, and resistance come into play and how resistance counteracts power and control in police investigative interviewing. Considering that the Philippines was once a colony of the United States, it is essential to compare the two samples as the Philippine legal system is highly patterned after the American jurisprudence (Mercullo in JForensicRes 11:1–4, 2020). A total of 10 Philippine and American police interviews were examined. While the Philippine corpus was obtained from the Pasay City Police Station, Metro Manila, the American corpus was culled from forensicling.com, an open-access website containing forensic linguistic data. Findings revealed that power and control were employed by the police in both contexts with 109 evidential markers (50.7%) and 2,443 representative speech acts (63.3%) having the highest frequency of occurrence. What is striking is the fact that police officers in both Philippine and American contexts show power and control in their utterances to be able to achieve the goal of police interviewing, that is, to gather information and elicit voluntary responses from the interviewees. Through this study, it is hoped that interviewers will be able to explore a better system of the questioning process that may lead the interviewees to cooperate more with them and arrive at a more accurate information. Le présent article revient sur la polémique qui anime les sphères politiques européenne et française depuis les années 1990 autour de la suppression du mot « race » des textes normatifs. Au-delà des enjeux idéologiques que ce débat cristallise, il propose d’élargir la perspective d’analyse à un phénomène plus englobant : la confrontation d’ordres juridiques hétérogènes engagés dans des processus intégratifs : « le droit français et le droit communautaire diffèrent dans leur démarche en matière de lutte contre les discriminations (...) ». Si le droit français « dit » la race, il lui nie une existence normative. A l’inverse, le droit de l’Union en fait un critère distinctif susceptible d’activer des dispositions juridiques liées au principe de non-discrimination. Ce changement de paradigme conduit le juge interne à modifier son approche traditionnelle des droits de l’Homme fondée sur le principe d’égalité. Les décisions du juge et du rapporteur public portent les traces d’aménagements dénominatifs lorsqu’il raisonne dans le cadre d’une approche plus relativiste, légitimant la différence de traitement. Linguistic choices have different attributions beyond their literal meaning according to their contexts. This paper looks at the variations in the discourses seen in the written colonial agreements and treaties during the Malabar conquest. The study employs the archived documents of various discourses during this period as a part of power shifting from the local elites to the colonial power. It explores how power is intertwined in the linguistic choices of different communication files. The study employs a hybrid methodology of (...) forensic linguistics and legal history. The analysis progresses in two phases: i) the linguistic attributions of power in the communications between the local elites and the colonial authorities and ii) the comparative analysis of variations in the linguistic choices by the colonial authorities correlating their varying power positions over the given period. It explores the dynamics of the linguistic choices of the local elites initially as a powerful entity in communication with the colonial authorities. The analysis shows a variation in the linguistic choices of the colonial authorities that suggests how they are used to reflect the power positions on a scale from weaker to powerful along the timeline. The paper argues that the linguistic choices of the colonial communication files aided them in projecting their power to society and assisted as one of the tools for reiterating their power position in various contexts. Forensic authorship analysis is based on two assumptions: that every individual has a unique idiolect, and that features characteristic of that idiolect will recur with a relatively stable frequency. Yet, a speaker’s language can change with age, affective states, according to audience, or genre. Thus, studies on authorship analysis should adopt the theory that while some linguistic parameters of an idiolect can remain stable, others can change depending on various circumstances. This investigation, which takes a constructional and functional-based approach (...) to discourse-level phenomena in idiolectal stability, analyzes cross-genre data produced by nine Mexican participants throughout a twelve-year time span. This study contributes to a greater understanding of the linguistic elements that survive genre effects and are potentially useful in both investigative and evidential forensic linguistic work. We provide a detailed description of linguistic features, their specific values, and context-dependent interpretation, keeping in mind the context of expert linguistic testimony, with its preference for methods which “employ linguistically motivated analyses in combination with quantitative tools” (Solan & Tiersma, 2004, p.463). Our findings show that idiolectal style tends to remain stable across genres and communication modes in epistemic modality constructions. Epistemic markers —specifically, markers indicating low commitment by the speaker (e.g., _no sé_ ‘I don’t know’) or expressing indirectness when introducing the illocutionary force (e.g., _la verdad [es que]_ ‘the truth [is that]’)— display idiolectal stability, as these markers seem to be the most effective in terms of allowing speakers to strategically manifest the extent of their knowledge regarding what is said. Since at least as far back as the infamous Derek Bentley case of the 1950s in which an unarmed 19-year-old was convicted and executed for murder based on his alleged uttering of the words _let him have it_ to his gun-wielding accomplice, the issue of incitement has been positioned firmly as an object of interest for forensic linguists. An example of a language crime—i.e. an unlawful speech act (as reported by Shuy in Language crimes: The use and abuse of (...) language evidence in the courtroom, Wiley Blackwell, Hoboken, 1993) the features of incitement—formalized as _intentionally encouraging or assisting others to commit an offence_ in the law of England & Wales under section 44 of the Serious Crime Act 2007 (https://www.legislation.gov.uk/ukpga/2007/27/contents)—have been widely debated by linguists and legal scholars alike. This paper draws on two webinars hosted by The Hunting Office in August 2020, which were subsequently leaked by the Hunt Saboteurs Association. Featuring senior figures from the hunting community addressing a nationwide audience of hunt masters, the webinars led to a police investigation and subsequent prosecution and conviction of one of the main speakers, Mark Hankinson, for _encouraging or assisting others to commit an offence under the Hunting Act 2004_. In this paper I explore what, linguistically, is meant by _encouraging or assisting_. Through corpus-assisted pragmatic and discourse analyses I interrogate the webinars to address the question of how precisely Hankinson implied his encouragement of illegal hunting with dogs. The phenomena of collocation and semantic prosody are crucial for understanding how such meanings came to be attached to the contributions Hankinson makes to the webinars. Moreover the paper will examine the contributions of other speakers and demonstrate that the same incriminating linguistic patterns in Hankinson’s talk are also evident in that of those who were not prosecuted. The interpretation and the indirect reporting of a speaker’s communicative intentions lie at the crossroad between pragmatics, argumentation theory, and forensic linguistics. Since the leading case Masson v. New Yorker Magazine, Inc., in the United States the legal problem of determining the truth of a quotation is essentially equated with the correctness of its indirect reporting, i.e. the representation of the speaker’s intentions. For this reason, indirect reports are treated as interpretations of what the speaker intends to communicate. (...) Theoretical considerations, aimed at establishing the pragmatic meaning of an utterance and differentiating between presumptive and non-presumptive interpretation, are thus interwoven with the practical legal need of distinguishing a correct indirect report from an indirect one or a misquotation. An incorrect report or a misquotation has the dialectical effect of attributing to the misquoted party commitments that he never held, which the latter needs to rebut. This shifting of the burden of persuasion can be increased by using strategically the conflict between the presumptive interpretation of an utterance and the non-presumptive one, i.e. the different types of pragmatic ambiguity. When an interpreter is confronted with an utterance taken out of its dialogical context, his interpretative process is not guided by the actual context or intention, but rather the most frequent or prototypical dialogical setting or the most typical individual purpose that it could have served to achieve. This presumptive reconstruction can be used to provide a prima facie case that the other party needs to reject. The stronger the interpretative presumptions a speaker needs to rebut, the more effective the misquotation strategy. The conflict between the systematic and the presumptive process of interpretation can be represented as an argumentative mechanism of reconstruction of the individual intention, which allows one to assess the reasonableness of the interpretative reasoning. Agenda Relevance is the first volume in the authors' omnibus investigation of the logic of practical reasoning, under the collective title, A Practical Logic of Cognitive Systems. In this highly original approach, practical reasoning is identified as reasoning performed with comparatively few cognitive assets, including resources such as information, time and computational capacity. Unlike what is proposed in optimization models of human cognition, a practical reasoner lacks perfect information, boundless time and unconstrained access to computational complexity. The practical reasoner is (...) therefore obliged to be a cognitive economizer and to achieve his cognitive ends with considerable efficiency. Accordingly, the practical reasoner avails himself of various scarce-resource compensation strategies. He also possesses neurocognitive traits that abet him in his reasoning tasks. Prominent among these is the practical agent's striking (though not perfect) adeptness at evading irrelevant information and staying on task. On the approach taken here, irrelevancies are impediments to the attainment of cognitive ends. Thus, in its most basic sense, relevant information is cognitively helpful information. Information can then be said to be relevant for a practical reasoner to the extent that it advances or closes some cognitive agenda of his. The book explores this idea with a conceptual detail and nuance not seen the standard semantic, probabilistic and pragmatic approaches to relevance; but wherever possible, the authors seek to integrate alternative conceptions rather than reject them outright. A further attraction of the agenda-relevance approach is the extent to which its principal conceptual findings lend themselves to technically sophisticated re-expression in formal models that marshal the resources of time and action logics and label led deductive systems. Agenda Relevance is necessary reading for researchers in logic, belief dynamics, computer science, AI, psychology and neuroscience, linguistics, argumentation theory, and legal reasoning and forensic science, and will repay study by graduate students and senior undergraduates in these same fields. This article is the first attempt to justify the "next" milestone in the development of legal realism: hyperrealism. The implications of digitalization have become the new fuel for the legal realist's jurisprudence prediction theory, that is, empirical research to predict the judge's or the court's decision. Indeed, that was impossible for American realists in the early twentieth century, and all the attempts failed. Therefore, tools such as Judicial Analytics allow us to prove that personal motives and prejudices affect a dispute's (...) resolution. Based on a systemic, comparative, and interdisciplinary analysis that intermingles legal theory, data analytics and digital technologies, the article substantiates the concept of hyperrealism itself. It evaluates the advantages and disadvantages of its primary tool—judicial analytics. The authors state the necessity of creating regulatory mechanisms of "curbing" to use them to improve justice and minimize the risk of rights violations. They propose using tools of expert evaluation, standardization, and ethical regulation of forensic analysis. (shrink)

This book shows how research in linguistic pragmatics, philosophy of language, and rhetoric can be connected through argumentation to analyze a recognizably common strategy used in political and everyday conversation, namely the distortion of another’s words in an argumentative exchange. Straw man argumentation refers to the modification of a position by misquoting, misreporting or wrenching the original speaker’s statements from their context in order to attack them more easily or more effectively. Through 63 examples taken from different contexts (including political (...) and forensic discourses and dialogs) and 20 legal cases, the book analyzes the explicit and implicit types of straw man, shows how to assess the correctness of a quote or a report, and illustrates the arguments that can be used for supporting an interpretation and defending against a distortion. The tools of argumentation theory, a discipline aimed at investigating the uses of arguments by combining insights from pragmatics, logic, and communication, are applied to provide an original account of interpretation and reporting, and to describe and illustrate tactics and procedures that can be used and implemented for practical purposes.. Establishing common ground in police investigative interviews is essential in preventing misperceptions and miscommunications, to enable a witness’s best evidence to be collected. However eliciting a consistent account of an allegation from individuals with an Intellectual Disability (ID) is dependent on the skill of the interviewing police officer and the communicative competence of a witness with ID. Acknowledging the specialist nature of this process, the Youth Justice and Criminal Evidence Act in England and Wales allows trained intermediaries to facilitate communication (...) between vulnerable individuals in legal settings such as forensic interviews. Intermediaries i.e., communication specialists, often recruit legally permitted low technology communication aids such as line drawings to facilitate interviews. Typically, common ground is established through shared attention and talk but this article uses multimodality Conversation Analysis to analyse the manner in which common ground in intermediary-mediated police interviews is established in other ways, i.e., firstly, through recruiting and using low technology communication aids in real interviews, and secondly through the embodied physical actions associated with manipulating those aids. Line drawings are examined here, enabling the answers given by witnesses with an ID to be semantically aligned with the questions being asked by the interviewing officers, by establishing common ground. Aids are shown to bypass documented difficulties with attention and staying on topic that individuals with ID typically experience, thus enabling them to verbally provide investigation-relevant evidence. Argumentation theory is a distinctly multidisciplinary field of inquiry. It draws its data, assumptions, and methods from disciplines as disparate as formal logic and discourse analysis, linguistics and forensic science, philosophy and psychology, political science and education, sociology and law, and rhetoric and artificial intelligence. This presents the growing group of interested scholars and students with a problem of access, since it is even for those active in the field not common to have acquired a familiarity with relevant (...) aspects of each discipline that enters into this multidisciplinary matrix. This book offers its readers a unique comprehensive survey of the various theoretical contributions which have been made to the study of argumentation. It discusses the historical works that provide the background to the field and all major approaches and trends in contemporary research. Argument has been the subject of systematic inquiry for twenty-five hundred years. It has been graced with theories, such as formal logic or the legal theory of evidence, that have acquired a more or less settled provenance with regard to specific issues. But there has been nothing to date that qualifies as a unified general theory of argumentation, in all its richness and complexity. This being so, the argumentation theorist must have access to materials and methods that lie beyond his or her "home" subject. It is precisely on this account that this volume is offered to all the constituent research communities and their students. Apart from the historical sections, each chapter provides an economical introduction to the problems and methods that characterize a given part of the contemporary research program. Because the chapters are self-contained, they can be consulted in the order of a reader's interests or research requirements. But there is value in reading the work in its entirety. Jointly authored by the very people whose research has done much to define the current state of argumentation theory and to point the way toward more general and unified future treatments, this book is an impressively authoritative contribution to the field. In psychiatry there is no sharp boundary between the normal and the pathological. Although clear cases abound, it is often indeterminate whether a particular condition does or does not qualify as a mental disorder. For example, definitions of ‘subthreshold disorders’ and of the ‘prodromal stages’ of diseases are notoriously contentious. -/- Philosophers and linguists call concepts that lack sharp boundaries, and thus admit of borderline cases, ‘vague’. Although blurred boundaries between the normal and the pathological are a recurrent theme in (...) many publications concerned with the classification of mental disorders, systematic approaches that take into account philosophical reflections on vagueness are rare. This book provides interdisciplinary discussions about vagueness in psychiatry by bringing together scholars from psychiatry, psychology, philosophy, history, and law. Injurious speech echoes relentlessly, years after the occasion of its utterance, in the mind of the one at whom it was aimed: the bad word, splinterlike, pierces to lodge. In its violently emotional materiality, the word is indeed made flesh and dwells amongst us—often long outstaying its welcome. (...) Old word-scars embody a "knowing it by heart," as if phrases had been hurled like darts into that thickly pulsating organ, but their resonances are not amorous. Where amnesia would help us, we can't forget.This sonorousness of vindictive words might help to characterize how, say, racist speech works on and in its targets. But doesn't such speculation also risk becoming an advocacy for the cultivation of insensitivity on the part of those liable to get hurt—or worse, a criticism of their linguistic vulnerability: "They just shouldn't be so linguistically sensitive"? In any event, interpellation operates with a deep indifference as to where the side of the good may lie, and we can't realistically build an optimistic theory of the eventual recuperability of harm. Here there's no guaranteed rationality, nor any inescapable irrationality. ABSTRACTJohn Locke is famous for popularizing the method of the philosophical thought experiment in discussions of personal identity; the cases introduced in the second edition of An Essay Concerning Understanding are still employed by contemporary philosophers. Here I argue that Locke’s method is nonetheless importantly different from later efforts in ways that can help us better appreciate his larger projects. Rather than pumping the reader’s intuitions in support of his preferred account, Locke’s thought experiments serve to illustrate common errors in (...) assessments of identity that he sees as particularly prevalent and problematic. Locke defends his idea of ‘person’ otherwise, through what I call his ‘lived experiments’: observations about linguistic usage that serve to illustrate the term’s role in practical reasoning. In designing the Handbook of the History of Logic, the Editors have taken the view that the history of logic holds more than an antiquarian interest, and that a knowledge of logic's rich and sophisticated development is, in various respects, relevant to the research programmes of the present day. Ancient logic is no exception. The present volume attests to the distant origins of some of modern logic's most important features, such as can be found in the claim by the authors of the chapter on Aristotle's early logic that, from its infancy, the theory of the syllogism is an example of an intuitionistic, non-monotonic, relevantly paraconsistent logic. Similarly, in addition to its comparative earliness, what is striking about the best of the Megarian and Stoic traditions is their sophistication and originality. Logic is an indispensably important pivot of the Western intellectual tradition. But, as the chapters on Indian and Arabic logic make clear, logic's parentage extends more widely than any direct line from the Greek city states. It is hardly surprising, therefore, that for centuries logic has been an unfetteredly international enterprise, whose research programmes reach to every corner of the learned world. Like its companion volumes, Greek, Indian and Arabic Logic is the result of a design that gives to its distinguished authors as much space as would be needed to produce highly authoritative chapters, rich in detail and interpretative reach. The aim of the Editors is to have placed before the relevant intellectual communities a research tool of indispensable value. The first of them, almost at once, encourages a third: what is apartheid? An answer to the first question will be an answer to the third. Knowing what apartheid was, it is implied, we will know what apartheid is. We will know what it is in essence. But if the answer supplied to the first question (...) is the same as that to the second, the question has been begged. This answer and begged question affect not only what we understand apartheid to have been. The essence of what apartheid is has been derived from an activity of remembering that is historically contingent. Is there a way out of this circle? A path to a place where essence will in no way be trammeled by any historical excrescence—where apartheid, stamped with -heid, the Afrikaans suffix for -ness, stands forth intact, unique—where, in a final victory, apartheid's phantasy of separateness will have perfected itself in truth? Supposing that responsibility involves the unstable articulation of essence and contingency, and consequent decision in the "night of non-knowledge," would it be responsible to seek such a way out? Is it possible, on the other hand, not to embark upon, or want to embark upon, such a search?The title "Remembering Apartheid" is to be understood as shorthand for this aporia of certain knowing. It refers in the first place to ways of remembering bound up, in South Africa, with the Truth and Reconciliation Commission. These have involved not only the collection of facts anchored in recollection, a classically forensic project, but also the admission of acts of grieving and the invitation for others to participate in these acts—a participation to which I will refer, employing the word in the general sense of a mourning-with, as condolence. The word remembrance (echoing the German Gedächtnis, with its folding in of Denken) might more closely approach the inextricable interlinking, before the Commission, of epistemic and mournful practice. Yet, in traversing the aporia provisionally without eliminating it, the title of my essay lays claim to knowledge. It announces: this is apartheid, for this is what apartheid was. It thereby also seeks to acknowledge that, just as forensic evidence assembled by the Commission may be bound up with the grieving of witnesses, no claim about the nature of apartheid can be untouched by the affective demands of those who bear the burden of remembering. The legacy of apartheid of which they speak is of undiscovered bodies, of bodies denied a proper burial. They seek the help of the Commission in rectifying this state of affairs. What we hear when we listen to those witnesses is this: apartheid was a proscription on mourning, specifically of the other. Can we then not say: apartheid is, at least for those who remember the worst deeds committed under it, and who attach to them a particular affect, a proscription on mourning the other? Viewed from a purely forensic point of view, it is far from clear that we possess evidence to impeach this testimony. For Justin the art of persuasion may be useful in all areas ofpublic life but it is useless when it comes to the metaphysical truth of Christianity. Authorship Analysis (AA) is a natural language processing field that examines the previous works of writers to identify the author of a text based on its features. Studies in authorship analysis include authorship identification, authorship profiling, and authorship verification. Due to its relevance, to many applications in this field attention has been paid. It is widely used in the attribution of historical literature. Other applications include legal linguistics, criminal law, forensic investigations, and computer forensics. This paper aims to (...) provide an overview of the work done and the techniques applied in the authorship analysis domain. The examination of recent developments in this field is the principal focus. Many different criteria can be used to define a writer’s style. This paper investigates stylometric features in different author-related tasks, including lexical, syntactic, semantic, structural, and content-specific ones. A lot of classification methods have been applied to authorship analysis tasks. We examine many research studies that use different machine learning and deep learning techniques. As a means of pointing the direction for future studies, we present the most relevant methods recently proposed. The reviewed studies include documents of different types and different languages. In summary, due to the fact that each natural language has its own set of features, there is no standard technique generically applicable for solving the AA problem. (shrink)

This book introduces a new form of argumentative analysis: rhetorical heuremes. The method applies the concepts of heuristic thinking, probability, and contingency in order to develop a better understanding of complex arguments in classical oratory. A new theory is required because Greek and Roman rhetoric cannot provide detailed answers to problems of strategic argumentation in the analysis of speeches. Building on scholarship in Ciceronian oratory, this book moves beyond the extant terminology and employs a concept of heuristic reasoning derived from (...) the psychology of decision making and mathematical problem solving. The author analyses selected passages from Cicero's forensic speeches where arguments of probability are deployed, and shows that the Sophistic concept of probability can link ancient rhetoric and modern theories of argumentation. Six groups of heuremes are identified, each of which represents a form of probabilistic reasoning by which the orator plays upon the perception of the jurors. (shrink)

The Division of Investigative Oversight within the U.S. Office of Research Integrity (ORI) is responsible for conducting oversight review of institutional inquiries and investigations of possible research misconduct. It is also responsible for determining whether Public Health Service findings of research misconduct are warranted. Although ORI findings rely primarily on the scope and quality of the institution’s analyses and determinations, ORI often has been able to strengthen the original findings by employing a variety of analytical methods, often computer based. Although (...) ORI does not conduct inquiries or investigations, it has broad authority to provide assistance to institutions at all stages of their reviews of allegations. This assistance can range from providing advice on best practices, to legal assistance, to suggestions for how best to investigate specific allegations. When asked, ORI can also conduct certain forensic analyses, such as a statistical examination of questioned digits or a simple examination of a questioned figure in Photoshop. ORI will not provide opinions or render judgment on such analyses while the institution is still conducting its investigation. Such analyses can be done without knowing much else about the case.
