For decades a debate has played out in the literature about who bioethicists are, what they do, whether they can be considered professionals qua bioethicists, and, if so, what professional responsibilities they are called to uphold. Health care ethics consultants are bioethicists who work in health care settings. They have been seeking guidance documents that speak to their special relationships/duties toward those they serve. By approving a Code of Ethics and Professional Responsibilities for Health Care Ethics Consultants, the American Society (...) for Bioethics and Humanities (ASBH) has moved the professionalization debate forward in a significant way. This first code of ethics focuses on individuals who provide health care ethics consultation (HCEC) in clinical settings. The evolution of the code's development, implications for the field of HCEC and bioethics, and considerations for future directions are presented here. (shrink)

Aggregative consequentialism and several other popular moral theories are threatened with paralysis: when coupled with some plausible assumptions, they seem to imply that it is always ethically indifferent what you do. Modern cosmology teaches that the world might well contain an infinite number of happy and sad people and other candidate value-bearing locations. Aggregative ethics implies that such a world contains an infinite amount of positive value and an infinite amount of negative value. You can affect only a finite amount (...) of good or bad. In standard cardinal arithmetic, an infinite quantity is unchanged by the addition or subtraction of any finite quantity. So it appears you cannot change the value of the world. Modifications of aggregationism aimed at resolving the paralysis are only partially effective and cause severe side effects, including problems of “fanaticism”, “distortion”, and erosion of the intuitions that originally motivated the theory. Some organisations make vaccination a condition of employment. This means prospective employees must demonstrate they have been vaccinated (eg, against measles) to be hired. But it also means organisations must decide whether _existing_ employees should be expected to meet newly introduced vaccination conditions (eg, against COVID-19). Unlike prospective employees who will not be _hired_ if they do not meet vaccination conditions, existing employees who fail to meet new vaccination conditions risk being _fired_. The latter seems worse than the former. Hence, (...) objections to vaccination mandates commonly centre on the harms that will be visited on existing employees who are unwilling to be vaccinated. However, because this objection does not necessarily entail the claim that vaccination is unnecessary for the effective and safe performance of certain jobs, those making this objection should have less of an objection, or no objection at all (at least on these grounds), to introducing vaccination requirements in some cases for _prospective_ employees. Yet, in this paper, I shall argue that if one has reason to believe vaccination requirements can be justified for prospective employees, one should also believe they are justified for existing employees _despite_ any asymmetry in consequences experienced by the two groups. As a consequence, common objections made against vaccination mandates grounded solely in the harms that may be experienced by existing employees who are unwilling to be vaccinated should be considered unpersuasive. The paper presents an analysis and interpretation of axiology and ethics as seen by the writer and philosopher Ayn Rand. The author follows the assumption that, in a situation where indifference is observed with regard to values (cf. Simmel, Sloterdijk), a return of philosophical reasoning to the idea of objectivity of values could be worthwhile. Therefore, he examines a specific type of axiological objectivism that can be found in Rand’s work. In the present paper, the suggested comparison with Baden neo-Kantism (...) as well as phenomenological axiology serves to capture the specifics of Rand’s axiological approach. These lie in placing emphasis on such a relationship between facts and values in which values result from the facts of reality, as well as in the very understanding of the objectivity of values that Rand identifies with long-term life goals and identifies them as an objective necessity for an individual’s life. Following the analysis of Rand’s axiology, the author focuses on her understanding of ethics, which he places in contrast to Kant’s deontology, as well as morality, which he views through the prism of a business relationship based on the exchange of values. The aim of the paper is to, by means of an analysis and interpretation of Rand’s ideas, show that objective values can be understood as a necessary prerequisite for consequential ethics and an individual living a happy life without being anchored in transcendence or social consensus. A common theme in the historiography of Greek ethics says that modern ethics is characterized by imperative notions such as ‘duty’—and with a Judeo‐Christian notion of imperatives or commands issued by god—whereas ancient ethics supposedly deals mainly with ‘attractive notions such as ‘good’ and ‘virtue’. This thought is often juxtaposed with the idea that imperative notions betoken a conflict between one's duty and one's good, because an imperative seems to be required only to command people to do what they do (...) not wish to do, which is felt to be inappropriate to the supposed eudaimonism of Greek ethics. In fact Greek ethics makes substantial use of imperative notions, and does not attempt to show that attractive notions are more basic or preferable in ethics. (shrink)

The literature on organizational ethics has paved the way for a situated and intersubjective understanding of ethics through caring practices. In this article, we try to extend this perspective by looking beyond the interactions of caregivers among themselves or with care seekers to reveal ethics as the ongoing collective accomplishment of a variety of actors. We do so by mobilizing Strauss’s theoretical perspective of articulation work in the context of healthcare. Based on an ethnography, we show how actors of care (...) (e.g., nurses, caregivers, or doctors) operate within care arrangements that need to be frequently rearticulated to face ethical threats and protect their patients’ well-being. We distinguish three types of rearticulation corresponding to different degrees of rearticulation, individual actor stance, and specific ways of working things out. We discuss their implications for the maintenance of organizational ethics. (shrink)

Aristotelian virtue ethics does not treat motives or even character as the grounding basis for the rest of ethics, but the present agent‐based approach does. However, there are objections to agent‐basing that need to be considered. Having answered those objections, the chapter discusses three major forms of agent‐based virtue ethics: a somewhat less than plausible ”morality as inner strength” ; ”morality as universal benevolence” ; and ”morality as caring”. This chapter shows how Hume’s “sentimentalist” moral theory can be a version of virtue ethics and elaborates the kind of virtue ethics that best describes Hume’s moral philosophy. To accomplish this task, we need a definition of virtue ethics, an account of types of virtue ethical theory, and to place Hume’s ethics within this taxonomy. Three types of virtue ethics, are outlined. Hume is located within a pluralistic virtue ethics where virtue notions are central and a variety of features make (...) traits “naturally fitted” to be approved as virtues. Despite having worked in higher education for over twenty years, I am still, first and foremost, a practicing nurse. My employer requires me to be a nurse and my regulator regards what I do as nursing. My practice is regulated by the Code and informed by nursing ethics. If I am nurse, practicing nursing, does that mean that my students are my patients? This paper considers how the relationship that I have with my students can be informed by the ethics (...) of the nurse/patient relationship. After some initial theoretical preparation concerning argument from analogy, the paper identifies some areas for comparison between the two relationships. Areas of similarity and difference identify two areas of concern: Nurse education and educators regularly engage in coercion and surveillance in an attempt to increase student success, both of which would be considered outside nursing ethics. It is concluded that these coercive practices are not conducive to an environment where character is cultivated. Despite current financial and workforce pressures, nurse lecturers and more especially their managers would do well to return to the professional ethics of nursing to question and guide their practice. Sex, Gender, Ethics, and the Darwinian Evolution of Humanity examines the impact of Darwin's 'Descent of Man' on contemporary biology and the humanities. Its publication in 1871 was a founding event in anthropology. Its content was primarily concerned with the development of sexual life, social life, and intellectual life, not only as outcomes of evolution, but as components that have actively intermixed over time with the evolutionary mechanism of natural selection. The stamp of Darwinism on modern thought is still very (...) important and brings novelties to academic studies. Several fields influenced by Darwinian anthropology developed in recent decades, including evolutionary ethics, the evolution of sociality and sexual communication in animal and plant species. Sociobiology and evolutionary psychology are topics that draw heavily on Darwin's 'Descent of Man'. The understanding of Darwin's thought has also progressed greatly in recent decades, following the systematic study of Darwin's correspondence and notebooks, leading to a reassessment of the development of his thought on humans, social groups, and heredity, and how they come together in his theory of evolution. The book combines a historical perspective on Darwin's achievement and his legacy. It will be of interest to students and scholars in a variety of fields, from experimental biology to the social and historical sciences. (shrink)

Trait Selective Abortions (TSA) have come under critique as a medical practice that presents potential disabled infants as burdens and lacking the potential for meaningful lives. This paper, using the author’s background as a disabled person, contends that the philosophy underpinning TSAs reflects liberal society’s lack of a theory of needs. The author argues for a care ethics based approach informed by disability analyses to engage with TSAs.

The Political Crisis and Christian Ethics addresses themes in political philosophy in the context of a crisis in democracy after the denial of the 2020 election by the Republican candidate for president. The refusal to accept the results of the election divided the electorate and drove the president's followers to fail in their attempted coup attempt in January of 2020. Democracy is defended in Reinhold Niebuhr's writing on politics and in Barack Obama's use of the theologian's thought. It is developed (...) further in the political theory of Paul Tillich. The themes of just peacemaking are reviewed in Paul Tillich's critique of John Foster Dulles' work and in the author's critique of just peacemaking in the work of Glen Stassen. Domestically the issues of race, inequality, ecology, and healthcare are addressed from the perspective of prophetic realism. The book concludes in terms of Alfred North Whitehead's philosophy of education and religion and a vision of the good president. In summary, The Political Crisis and Christian Ethics is a volume of American, Christian political theory in a period of overcoming the trauma of 2016 with Christian ethics and political philosophy. Robert Zafft presents the too-often abstract language of business ethics in straight-forward language, laying out two themes commonly ignored: in the real world, it is often easy to lay out an ethical path but often very difficult to implement and encourage adherence to that path, and reputation is the single most important asset in business.

Building on the strengths of the first edition, the second edition of the Irwin Nicomachean Ethics features a revised translation (with little editorial intervention), expanded notes (including a summary of the argument of each chapter), an expanded Introduction, and a revised glossary.

The conduct of hostilities is very bad for the environment, yet relatively little attention has been focused on environmental military ethics by just war theorists and revisionist philosophers of war. Contemporary ecological concerns pose significant challenges to jus in bello. I begin by briefly surveying existing literature on environmental justice during wartime. While these jus in bello environmental issues have been addressed only sparsely by just war theorists, environmental jus ad bellum has rarely been tackled within JWT or the morality (...) of war. In line with the theme of this special issue, I focus my discussion of war and the natural environment primarily on the jus ad bellum level. I set out with the presumption against the use of force, and its possible exceptions. The principal question raised is whether environmental harm can trigger a new justification for war. Beyond just cause, I consider what might be a proportionate response to “environmental aggression,” or negligent harm to nature. The use of force is clearly justified in response to military attacks, against the natural environment or otherwise. Where harm to nature or its inhabitants are not caused by military aggression, just war theory criteria point in favor of responding via measures short of war. Finally, I suggest that responding by means that are not themselves harmful to nature serves to fulfill the further jus ad bellum criterion of “right intention.”. (shrink)

My aim in this chapter is to explore an analogy between logic and ethics, as Wittgenstein understands them in the Tractatus. First, I argue that Wittgenstein regards logic as a condition of the possibility of meaning, in the sense that logic makes meaningful language and thought possible. Second, I ask why Wittgenstein calls both logic and ethics ‘transcendental’. I suggest that, while logic is a condition of the possibility of semantic meaning, ethics is a condition of the possibility of existential (...) meaning. Without ethics, life could not be meaningful. Third, I show that harmony and agreement play a crucial role in Wittgenstein’s accounts of logic and ethics. A meaningful proposition can be true or false, a meaningful life can be happy or unhappy, and both truth and happiness consist in some kind of harmony or agreement with reality. (shrink)

This chapter asks two questions about the ethics of expectations: one about the nature of expectations, and one about the wrongs of expectations. On the first question, expectations involve a rich constellation of attitudes ranging from beliefs to also include imaginings, hopes, fears, and dreams. As a result, sometimes expectations act like predictions, like your expectation of rain tomorrow, sometimes prescriptions, like the expectation that your students will do the reading, sometimes like proleptic reasons like the hope that your mentee (...) will flourish, and sometimes expectations are peremptory in that they carry the force of moral law. Turning to the second question, given the multiple roles played by expectations it shouldn’t be surprising that there are also multiple ways expectations can be wrong to hold. Sometimes they wrong as beliefs do, e.g., doxastic wronging, and sometimes they result in alienation because of who holds that expectation of us. The upshot of this chapter is that getting clear on these potential ways expectations can wrong not only delivers an ethics of expectations that mirrors familiar discussions of the ethics of belief, but an ethics of expectations further opens the door for taking seriously an ethics of mental attitudes more generally. Australia II became the first foreign yacht to win the America's Cup in 1983. The boat had a revolutionary wing keel and a better underwater hull form. In official documents, Ben Lexcen is credited with the design. He is also listed as the sole inventor of the wing keel in a patent application submitted on February 5, 1982. However, as reported in _New York Times_, _Sydney Morning Herald_, and _Professional Boatbuilder_, the wing keel was in fact designed by engineer Peter (...) van Oossanen at the Netherlands Ship Model Basin in Wageningen, assisted by Dr. Joop Slooff at the National Aerospace Laboratory in Amsterdam. Based on telexes, letters, drawings, and other documents preserved in his personal archive, this paper presents van Oossanen’s account of how the revolutionary wing keel was designed. This is followed by an ethical analysis by Martin Peterson, in which he applies the American NSPE and Dutch KIVI codes of ethics to the information provided by van Oossanen. The NSPE and KIVI codes give conflicting advice about the case, and it is not obvious which document is most relevant. This impasse is resolved by applying a method of applied ethics in which similarity-based reasoning is extended to cases that are not fully similar. The key idea, presented in Peterson’s book _The Ethics of Technology_ (Peterson, The ethics of technology: A geometric analysis of five moral principles, Oxford University Press, 2017), is to use moral paradigm cases as reference points for constructing a “moral map”. The emphasis on duly in Kant's ethics is widely held to constitute a defect. Marcia W. Baron develops and assesses the criticism, which she sees as comprising two objections: that duty plays too large a role, leaving no room for the supererogatory, and that Kant places too much value on acting from duty. Clearly written and cogently argued, Kantian Ethics Almost without Apology takes on the most philosophically intriguing objections to Kant's ethics and subjects them to a rigorous yet sympathetic (...) assessment. Screening programmes are becoming increasingly popular since prevention is considered 'better than cure'. While earlier diagnosis may result in more effective treatment for some, there will be consequent harm for others due to anxiety, stigma, side-effects etc. A screening test cannot guarantee the detection of all 'abnormal' cases, therefore there will be false reassurance for some. A proper consideration of the potential benefit and harm arising from screening may lead to the conclusion that the programme should not be offered. A (...) modified utilitarian approach may be used for allocation of scarce resources in health care. Ethics has an important role in this evaluation. (shrink)

Fraudulent financial reporting, financial statements with errors so material as to require restatement, and biased reporting marred by defects such as managed earnings have plagued financial reporting in many countries in recent years. All of those failures are ethics failures that represent breaches of fiduciary duties by individuals who accepted responsibilities but did not fulfill them. The financial reporting system practiced in America is viewed by the parties involved in it as generally satisfactory. However, according to another view, the interests (...) of those primarily and secondarily responsible for those reports conflict with the interests of the intended beneficiaries, or users, of the corporate financial statements. A more realistic view of the actual operation of that reporting system shows that it is fundamentally flawed. Primary responsibility for failures rests with top management and financial management of the reporting corporation who are so strongly motivated to render favorable reports on their stewardship that they neglect their fiduciary responsibilities to investors. Secondary responsibility falls on independent auditors who are so heavily influenced by enterprise management that they, too, fail in carrying out their responsibilities to users of the audited financial statements. Ethics compromises are also found in the performances of academic accountants and members of accounting standards-setting bodies. The conflict between managements interest in reporting its performance in a favorable light and investors interest in decision-useful financial information will always exist and require regulation. However, changes in those regulations and in the basic governance arrangements involving shareholders, management, and auditors could reduce the opportunities and temptations for failures in carrying out fiduciary responsibilities. Most importantly, the close relationships between auditors and management must be loosened in favor of closer relationships between auditors and investors. (shrink)

With disparate rates of morbidity and mortality among minoritized communities, COVID-19 illuminated the need for equity-informed practices in public health. Pacia et al posit FQHCs as entities that addressed inequity when others failed. This commentary further situates how FQHCs address the public health crisis of institutional racism and related health inequities every day and presents a FQHC-led Ethics and Equity Framework and Workflow Checklist to guide ethical and equitable engagement with FQHCs.

This article reviews three new books analysing the phenomenon of neoliberalism through religious lenses and comments on how Christian ethics should navigate among various distinct uses of the term ‘neoliberalism’ and the solutions a Christian ethical approach proposes to the ways in which neoliberalism harms humans and societies.

One striking feature of apocalyptic readings of Paul—and the Protestant dogmatics that follows after such a Paulinism—is the ‘widescreen’ portrayal of Sin as Power. This account stresses the ‘three-agent drama’ of salvation and the bondage of human persons to anti-God forces. It resists moralising interpretations of human sins in favour of a starker moral cosmology. In this way, it seems to leave ‘ethics’ and ‘freedom’ in suspension. Contrast the approach of the moral theologian Oliver O’Donovan. Here, sin is a case (...) study in the difference of perspectives between dogmatics and ethics. Dogmatics, ‘making sin exceedingly sinful, quickly resorts to apocalyptic largeness of scale’. Ethics is concerned instead with ‘possible’ sins. It describes sin in phenomenological rather than ultimate terms—something to be avoided in the next moment of free agency. This article distils the theological commitments each intends to secure, observes what each risks, and seeks to determine what is at stake. It draws them together in a synthetic moral ontology, but also looks further, to an integrative account that can inform moral discernment. To this end, the final section observes how subsequent work in Pauline studies converges with discussions about structural sin in Catholic social thought. (shrink)
