It has become increasingly difficult for individuals to exercise meaningful control over the personal data they disclose to companies or to understand and track the ways in which that data is exchanged and used. These developments have led to an emerging consensus that existing privacy and data protection laws offer individuals insufficient protections against harms stemming from current data practices. However, an effective and ethically justified way forward remains elusive. To inform policy in this area, we propose the Ethical Data (...) Practices framework. The framework outlines six principles relevant to the collection and use of personal data—minimizing harm, fairly distributing benefits and burdens, respecting autonomy, transparency, accountability, and inclusion—and translates these principles into action-guiding practical imperatives for companies that process personal data. In addition to informing policy, the practical imperatives can be voluntarily adopted by companies to promote ethical data practices. (shrink)

The distinction between lying and mere misleading is commonly tied to the distinction between saying and conversationally implicating. Many definitions of lying are based on the idea that liars say something they believe to be false, while misleaders put forward a believed-false conversational implicature. The aim of this paper is to motivate, spell out, and defend an alternative approach, on which lying and misleading differ in terms of commitment: liars, but not misleaders, commit themselves to something they believe to be (...) false. This approach entails that lying and misleading involve speech-acts of different force. While lying requires the committal speech-act of asserting, misleading involves the non-committal speech-act of suggesting. The approach leads to a broader definition of lying that can account for lies that are told while speaking non-literally or with the help of presuppositions, and it allows for a parallel definition of misleading, which so far is lacking in the debate. In Emanuel Adler's distinctive constructivist approach to international relations theory, international practices evolve in tandem with collective knowledge of the material and social worlds. This book - comprising a selection of his journal publications, a new introduction and three previously unpublished articles - points IR constructivism in a novel direction, characterized as 'communitarian'. Adler's synthesis does not herald the end of the nation-state; nor does it suggest that agency is unimportant in international life. Rather, it argues that what mediates (...) between individual and state agency and social structures are communities of practice, which are the wellspring and repositories of collective meanings and social practices. The concept of communities of practice casts new light on epistemic communities and security communities, helping to explain why certain ideas congeal into human practices and others do not, and which social mechanisms can facilitate the emergence of normatively better communities. ABSTRACT Copredication, as exhibited by sentences such as ‘That book is heavy but informative,’ is commonly seen as a phenomenon that is tied to sentences featuring polysemous expressions. David Liebesman and Ofra Magidor have recently attacked this view by arguing that ‘book’ has a single context-sensitive sense. The first aim of the present paper is to show that Liebesman and Magidor are wrong to claim that ‘book’ is univocal, but that they may nonetheless be right to question that copredication requires (...) polysemy. In the science and values literature, scholars have shown how science is influenced and shaped by values, often in opposition to the ‘value free’ ideal of science. In this paper, we aim to contribute to the science and values literature by showing that the relation between science and values flows not only from values into scientific practice, but also from (allegedly neutral) science to values themselves. The extant literature in the ‘science and values’ field focuses by and large on reconstructing, (...) post hoc, how values have influenced science; our reconstruction of the case studies, instead, aims to show that scientific concepts and methods _too, because of specific identifiable characteristics,_ can promote some values rather than (or at the expense of) others. We explain this bidirectional relation in analogy to debates on the normativity of technical artifacts and on feminist approaches in science, and we illustrate our claims with cases from the health sciences and machine learning. While our arguments in this paper also draw on post hoc reconstructions, we intend to show where, in the science in the making, we should engage not only with the question whether a practice is value-laden, but also how specific conceptual and methodological choices can influence values down the road. All in all, these considerations expand the ways in which philosophers can contribute to more value-aware scientific practices. (shrink)

Lying requires asserting a disbelieved proposition, that much is widely accepted in the debate on how to define lying. But what else is required? Does lying require a particular linguistic manner of expression, such as saying? Does the proposition asserted have to be false (and not merely disbelieved)? And does lying require an intention to deceive? Sam Berstler defends a general moral advantage for misleading over lying by arguing that liars, but not misleaders, act unfairly toward the other members of their linguistic community. This article spells out three difficulties for Berstler’s account. First, though Berstler aims to avoid an error theory, it is dubitable that her account fits with intuitions on the matter. Second, there are some lies that do not exhibit the unfairness Berstler identifies. Third, fairness is not the only morally relevant difference between (...) lying and misleading. (shrink)

Sometimes speakers try to lie and inadvertently assert something true. Subjectivists about lying hold that such speakers are lying despite telling the truth. Objectivists hold that such speakers are not lying: they try to lie but fail. The first aim of this paper is to point to novel cases supporting subjectivism that do not involve speakers inadvertently asserting something true. Its second aim is to use these and other cases to explore the distinction between lying and trying to lie. Which (...) factors can thwart an attempt at lying? In which situations do we judge that a speaker has tried to lie but failed? Attending to these questions not only offers insights into the act of lying, but also helps to scrutinise the objectivist strategy of explaining away intuitions about apparent cases of lying while telling the truth. Příčiny mohou být v ambicích každého jedince a souvisejí s jeho morálními kvalitami. Kromě toho autor však hovoří o komplexu faktorů, které vyrůstají ze sociálního prostředí a ovlivňují výskyt plagiátorství v současné společnosti. Některé z těchto faktorů jej přímo podporují. Hlavní myšlenkou textu je, že systém hodnocení vědeckého výzkumu by měl dbát o smysluplnost textů a snížení formalismu. Pak by plagiátorství nebylo odmítáno (...) pouze de iure, ale také de facto. COVID-19 vaccines are likely to be scarce for years to come. Many countries, from India to the U.K., have demonstrated vaccine nationalism. What are the ethical limits to this vaccine nationalism? Neither extreme nationalism nor extreme cosmopolitanism is ethically justifiable. Instead, we propose the fair priority for residents framework, in which governments can retain COVID-19 vaccine doses for their residents only to the extent that they are needed to maintain a noncrisis level of mortality while they are implementing reasonable public (...) health interventions. Practically, a noncrisis level of mortality is that experienced during a bad influenza season, which society considers an acceptable background risk. Governments take action to limit mortality from influenza, but there is no emergency that includes severe lockdowns. This “flu-risk standard” is a nonarbitrary and generally accepted heuristic. Mortality above the flu-risk standard justifies greater governmental interventions, including retaining vaccines for a country's own citizens over global need. The precise level of vaccination needed to meet the flu-risk standard will depend upon empirical factors related to the pandemic. This links the ethical principles to the scientific data emerging from the emergency. Thus, the FPR framework recognizes that governments should prioritize procuring vaccines for their country when doing so is necessary to reduce mortality to noncrisis flu-like levels. But after that, a government is obligated to do its part to share vaccines to reduce risks of mortality for people in other countries. We consider and reject objections to the FPR framework based on a country: having developed a vaccine, raising taxes to pay for vaccine research and purchase, wanting to eliminate economic and social burdens, and being ineffective in combating COVID-19 through public health interventions. Four ethical values — maximizing benefits, treating equally, promoting and rewarding instrumental value, and giving priority to the worst off — yield six specific recommendations for allocating medical resources in the Covid-19 pandemic: maximize benefits; prioritize health workers; do not allocate on a first-come, first-served basis; be responsive to evidence; recognize research participation; and apply the same principles to all Covid-19 and non–Covid-19 patients.

The article begins with a sketch of the relation of interaction to language and to culture, and of the students of interaction to the students of language and of culture. A 10-second segment of recorded interaction at a family dinner is then examined in a fashion meant to preserve the integrity1 of what is being done interactionally while incorporating attention to the deployment of various facets of the language that is used, and its relationship to simultaneously ongoing bodily doings. An (...) interactional practice – whining – from that episode is then juxtaposed with the same practice in several other segments of interaction in the interests of developing a more formal, transsituational account. The viability of research focused on phenomena in an analytically distinct domain of events while preserving the integrity of the occasions in which instances of the phenomenon occurred is then reviewed, using a case study of the conjoint use of phonetic analysis and conversation analysis. The article concludes with a reply to Levinson's article in this special issue of the journal, and uses the occasion to sketch the relationship between interaction and so-called ‘macro’ social and cultural formations such as kinship. Machine learning (ML) has been praised as a tool that can advance science and knowledge in radical ways. However, it is not clear exactly how radical are the novelties that ML generates. In this article, I argue that this question can only be answered contextually, because outputs generated by ML have to be evaluated on the basis of the theory of the science to which ML is applied. In particular, I analyze the problem of novelty of ML outputs in the (...) context of molecular biology. In order to do this, I first clarify the nature of the models generated by ML. Next, I distinguish three ways in which a model can be novel (from the weakest to the strongest). Third, I dissect the way ML algorithms work and generate models in molecular biology and genomics. On these bases, I argue that ML is either a tool to identify instances of knowledge already present and codified, or to generate models that are novel in a weak sense. The notable contribution of ML to scientific discovery in the context of biology is that it can aid humans in overcoming potential bias by exploring more systematically the space of possible hypotheses implied by a theory. In several recent papers and a monograph, Andreas Stokke argues that questions can be misleading, but that they cannot be lies. The aim of this paper is to show that ordinary speakers disagree. We show that ordinary speakers judge certain kinds of insincere questions to be lies, namely questions carrying a believed-false presupposition the speaker intends to convey. These judgements are robust and remain so when the participants are given the possibility of classifying the utterances as misleading or as deceiving. (...) The judgements contrast with judgements participants give about cases of misleading or deceptive behaviour, and they pattern with judgements participants make about declarative lies. Finally, the possibility of lying with non-declaratives is not confined to questions: ordinary speakers also judge utterances of imperative, exclamative and optative sentences carrying believed-false presuppositions to be lies. We analyze recent criticisms of the use of hyperreal probabilities as expressed by Pruss, Easwaran, Parker, and Williamson. We show that the alleged arbitrariness of hyperreal fields can be avoided by working in the Kanovei–Shelah model or in saturated models. We argue that some of the objections to hyperreal probabilities arise from hidden biases that favor Archimedean models. We discuss the advantage of the hyperreals over transferless fields with infinitesimals. In Paper II we analyze two underdetermination theorems by Pruss and (...) show that they hinge upon parasitic external hyperreal-valued measures, whereas internal hyperfinite measures are not underdetermined. ABSTRACTA probability model is underdetermined when there is no rational reason to assign a particular infinitesimal value as the probability of single events. Pruss claims that hyperreal probabilities are underdetermined. The claim is based upon external hyperreal-valued measures. We show that internal hyperfinite measures are not underdetermined. The importance of internality stems from the fact that Robinson’s transfer principle only applies to internal entities. We also evaluate the claim that transferless ordered fields may have advantages over hyperreals in probabilistic modeling. (...) Simonet, Emanuel Nicolas Cortes Victoria's new Mental Health Act 2014 came into operation on 1st July 2014. Corresponding with international standards, the new Act aims to strengthen the human rights of persons with mental illness. This is supported by the inclusion of a recovery framework which promotes a collaborative treatment approach, procedures that reduce the duration of compulsory treatment, as well as better mental health service oversight and safeguards. The article begins with an effort to clarify and differentiate a variety of terms used by analysts in dealing with mentions of persons in conversation and other forms of talk-in-interaction — such terms as person-reference, identifying, describing, categorizing, and the like. This effort leads to the observation that `reference to persons' and `membership categorization' are quite distinct sets of practices, with most reference to persons not being done by membership categories, and most uses of membership categorization devices being in the (...) service of actions other than referring. Two interactional sequences whose analysis turns on a connection to talk earlier in the occasion are then examined; first, to establish what is going on interactionally without respect to the mentioning of persons, and then as exercises in examining the various ways person-reference and membership categorization can figure in a stretch of interaction. Turns-at-talk are fundamental units of participation in talk-in-interaction, and turn-constructional-units are the basic building blocks for turns. Possible completion of a TCU is, in principle, the possible completion of the turn, but multi-unit turns are not uncommon, and participants have practices for constructing multi-unit turns and for recognizing them in the course of their production. This article offers an account of one practice usable by speakers and recipients to convey and recognize the designed completion of a multi-TCU turn and/or a (...) multi-turn sequence in which ‘answering’ is being done: returning to, or ‘re-using’, a word or phrase from the start of the turn or sequence, whether articulated by same or different speaker, whether used to refer to same or different referents. This practice is one of the resources by which the overall structural organization of an interactional unit and its local realization are mutually realized. (shrink)

It is widely held that all lies are assertions: the traditional definition of lying entails that, in order to lie, speakers have to assert something they believe to be false. It is also widely held that assertion contrasts with presupposition and, in particular, that one cannot assert something by presupposing it. Together, these views imply that speakers cannot lie with presuppositions—a view that Andreas Stokke has recently explicitly defended. The aim of this paper is to argue that speakers can lie (...) with presuppositions, and to discuss some of the implications this outcome has for current research on lying, assertion and presupposition. Nowadays, novel techniques such as Reciprocal effortless in vitro fertilization (ReIVF) enable two individuals to “carry the same pregnancy,” that is to “carry” the same embryo in both their bodies. However, even though these techniques are likely to be increasingly requested, little is known about their safety and efficacy, and much less about their bioethical legitimacy and issues. Considering their uniqueness, this study assesses the compatibility of ReIVF as well as of another similar technique with the classical principles of medical (...) ethics: autonomy, beneficence, nonmaleficence, and justice. The aim is twofold: (i) to start investigating whether these techniques and their underlying reasons are, or could ever be, bioethically justifiable and (ii) to make clinicians and any other potentially interested persons such as researchers, lawmakers and prospective parents themselves are more aware of the health and social implications of using these techniques. Hence, after a brief overview of the technical aspects of the procedures that allow two persons to carry the same pregnancy, this study offers a general moral framework that can be useful for starting to address some relevant aspects of these procedures, such as their benefits and harms on the health of the individuals involved, the reasons behind their use, and the possibility that they might be covered by states in the future. Finally, this study provides a bioethical overview on ReIVF as well as on similar techniques considering different perspectives, while also suggesting some questions and recommendations for further research. We barely talk about them and seldom know their names. Philosophy has always overlooked them; even biology considers them as mere decoration on the tree of life. And yet plants give life to the Earth: they produce the atmosphere that surrounds us and they are the origin of the oxygen that animates us. Plants embody the most direct, elementary connection that life can establish with the world. In this book, philosopher Emanuele Coccia argues that, as the very creator of atmosphere, (...) plants occupy the fundamental position from which we should analyze all elements of life. From this standpoint, we can no longer perceive the world as a simple collection of objects or a universal space containing all things, but as the site of a veritable metaphysical mixture. One implication of Coccia’s claim is that since the atmosphere of life is rendered possible through plants alone, life only perpetuates itself through the very circle of consumption undertaken by plants. In other words, life exists only insofar as it consumes other life, removing any moral or ethical considerations from the equation. In contrast to trends of thought which discuss nature and the cosmos in general terms, Coccia’s account brings the infinitely small together with the infinitely big, offering a radical redefinition of the place of humanity within the realm of life. Faced as we are with ever more complex and urgent ecological questions, this path-breaking account of the life of plants will appeal not only to students and scholars of philosophy but to a wide range of readers interested in our relation to the natural world. Many recent definitions of lying are based on the notion of what is said. This paper argues that says-based definitions of lying cannot account for lies involving non-literal speech, such as metaphor, hyperbole, loose use or irony. It proposes that lies should instead be defined in terms of assertion, where what is asserted need not coincide with what is said. And it points to possible implications this outcome might have for the ethics of lying.

Recently, biologists have argued that data - driven biology fosters a new scientific methodology; namely, one that is irreducible to traditional methodologies of molecular biology defined as the discovery strategies elucidated by mechanistic philosophy. Here I show how data - driven studies can be included into the traditional mechanistic approach in two respects. On the one hand, some studies provide eliminative inferential procedures to prioritize and develop mechanistic hypotheses. On the other, different studies play an exploratory role in providing useful (...) generalizations to complement the procedure of prioritization. Overall this paper aims to shed light on the structure of contemporary research in molecular biology. (shrink)

Background: The health professionals are involved in the paths of care for patients with different medical conditions. Their life is frequently characterized by psychopathological outcomes so that it is possible to identify consistent burdens. Besides the possibility to develop pathological outcomes, some protective factors such as resilience play a fundamental role in facilitating the adaptation process and the management of maladaptive patterns. Personal characteristics and specific indexes such as burdens and resilience are essential variables useful to study in-depth ongoing conditions (...) and possible interventions. The study was aimed at highlighting the presence and the relations among factors as personal variables, burdens, and resilience, to understand health professionals' specific structure and functions.Methods: The observation group was composed of 210 participants, 55 males, and 155 females, aged from 18 to 30 years old with a mean age of 25.92 years old. The study considered personal characteristics of the subjects, such as age, gender, years of study, days of work per week, hours of work per week, and years of work. Our study had been conducted with the use of measures related to burdens and resilience.Results: The performed analyses consisted of descriptive statistics, correlations, and regressions among the considered variables. Several significant correlations emerged among personal characteristics, CBI, and RSA variables. Specifically, age and work commitment indexes appeared to be significantly related to the development of burdens, differently from the years of study. Significant correlations emerged among personal and RSA variables, indicating precise directions for both domains. Age and gender were identified as predictors to perform multivariate regression analyses concerning CBI factors. Significant dependence relations emerged with reference to all CBI variables.Conclusion: Pathological outcomes and resilience factors represent two sides of the health professionals' experiences, also known as “invisible patients.” Greater knowledge about present conditions and future possibilities is a well-known need in literature so that the current analyses considered fundamental factors. In line with state of the art, future studies are needed in order to deepen elusive phenomena underlying maladjustment. (shrink)

O presente artigo se propõe a examinar criticamente o atual e dominante paradigma político, que aqui definiremos como terrorismo legal de Estado. Para tanto, fez-se necessário o recurso a três autores cujas reflexões buscam compreender a sua natureza e os seus principais modos de atuação, a saber, o filósofo italiano Giorgio Agambem, o jurista argentino Raúl Zaffaroni e o sociólogo francês Loic Wacquant. A partir das obras agambenianas Homo Sacer. O poder soberano e a vida nua I e Estado de (...) Exceção, elucidaremos o conceito de estado de exceção e o processo que, ao transformá-lo em prática permanente, marcou o ingresso definitivo do Estado na lógica do terrorismo. A materialização deste exercício de poder se dá – sobretudo nas conjunturas do continente americano, a referência empírica da pesquisa aqui apresentada – principalmente por meio da eliminação pelo encarceramento, levada a cabo por um direito penal punitivista que será compreendido à luz das obras O inimigo no direito penal (Zaffaroni) e Crime e castigo nos Estados Unidos: de Nixon a Clinton (Wacquant). This paper defends stage theory against the argument from diachronic counting. It argues that stage theorists can appeal to quantifier domain restriction in order to accommodate intuitions about diachronic counting sentences. Two approaches involving domain restriction are discussed. According to the first, domains of counting are usually restricted to stages at the time of utterance. This approach explains intuitions in many cases, but is theoretically costly and delivers wrong counts if diachronic counting is combined with fission or fusion. On the (...) second approach, domains of counting are usually restricted in an indeterminate way, so as to include at most one member of any maximal class of counterpart-interrelated stages (with respect to a certain utterance). This view can accommodate all the relevant intuitions about counting sentences, and it fits well with a new stage-theoretic view of reference that allows speakers to refer to both present and past stages. Theorists in the debate on how to define lying disagree whether it is possible to lie with pictures. At the same time, they agree that definitions of lying should be consistent with how laypersons use the term ‘lie’. This calls for an empirical perspective on whether ordinary usage allows for pictorial lies. The present paper provides some initial data on this question by reporting an experiment with 623 participants investigating layperson judgements about cases of insincere linguistic and pictorial communication. In this article, we propose the Fair Priority Model for COVID-19 vaccine distribution, and emphasize three fundamental values we believe should be considered when distributing a COVID-19 vaccine among countries: Benefiting people and limiting harm, prioritizing the disadvantaged, and equal moral concern for all individuals. The Priority Model addresses these values by focusing on mitigating three types of harms caused by COVID-19: death and permanent organ damage, indirect health consequences, such as health care system strain and stress, as well as (...) economic destruction. It proposes proceeding in three phases: the first addresses premature death, the second long-term health issues and economic harms, and the third aims to contain viral transmission fully and restore pre-pandemic activity. -/- To those who may deem an ethical framework irrelevant because of the belief that many countries will pursue "vaccine nationalism," we argue such a framework still has broad relevance. Reasonable national partiality would permit countries to focus on vaccine distribution within their borders up until the rate of transmission is below 1, at which point there would not be sufficient vaccine-preventable harm to justify retaining a vaccine. When a government reaches the limit of national partiality, it should release vaccines for other countries. -/- We also argue against two other recent proposals. Distributing a vaccine proportional to a country's population mistakenly assumes that equality requires treating differently situated countries identically. Prioritizing countries according to the number of front-line health care workers, the proportion of the population over 65, and the number of people with comorbidities within each country may exacerbate disadvantage and end up giving the vaccine in large part to wealthy nations. Although there is no lack of reasons for conversation analysis to be reluctant to adopt a cognitivist idiom and paradigm in studying talk and other conduct in interaction, examination of the literature with an open mind will disclose attentiveness to such themes in the conversation-analytic literature nonetheless. The pursuit of such themes however, cannot be appropriately and successfully conducted under the aegis of currently dominant cognitivist paradigms. One central analytic resource in CA work is the notion of a ‘possible X’, (...) a resource which is here described and exemplified for three discrete ‘values’ of ‘X’. The understanding of how such ‘possible Xs’ could work for participants in interaction invites understanding by analysts by reference to a ‘multiple passes’ model of uptake, a characterization which for now can be no more than metaphoric. Here is a venue at which conversation-analysts and neuro/cognitive analysts might usefully try to work together. (shrink)

RESUMO Este artigo tem como objetivo discutir a questão da materialidade significante do corpo no enlace discursivo do político imbricado nas fronteiras com o social, a partir das obras de Dan Halter. Para tanto, proponho um diálogo teórico-analítico entre a perspectiva dialógica desenvolvida pelo russo Mikhail Bakhtin e a perspectiva do materialismo-histórico, tendo como base o dispositivo teórico da Análise do Discurso francesa, a fim de analisar o objeto de estudo em questão na relação corpo, memória e discurso. Nesse sentido, (...) ao trabalhar com a imbricação entre a materialidade verbal e não verbal, busco lançar olhar sobre duas obras do artista zimbabueano Dan Halter, considerando, desse modo, os efeitos de sentido que deslizam metafórica e metonimicamente para outros sentidos do corpo que se desdobram em diferentes imagens do sujeito, tendo em vista os processos de estruturação do conflito e da tensividade do/no social a partir dos espaços ocupados por estes corpos e atravessados que são pelo simbólico, pela ideologia e pela história. ABSTRACT This article aims to discuss the question of the signifying materiality of the body in the discursive interlacement of the political imbricated on the frontiers with the social, based on the works of Dan Halter. To this end, we propose a theoretical-analytical dialogue between the dialogical perspective developed by Russian Mikhail Bakhtin and the historical-materialism perspective, based on the theoretical assumptions of the French Discourse Analysis, in order to analyze the object of this study in its relation with body, memory, and discourse. In this sense, by working with the imbrication between verbal and non-verbal materiality, we intend to focus on two specific works by Zimbabwean artist Dan Halter, considering the meaning effects that slide metaphorically and metonymically to other senses of the body that unfold in different images of the subject, in view of the processes that structure the conflict and tensivity of the social from the spaces occupied by these bodies and crossed by the symbolic, by ideology, and history. Drawing on evolutionary epistemology, process ontology, and a social-cognition approach, this book suggests cognitive evolution, an evolutionary-constructivist social and normative theory of change and stability of international social orders. It argues that practices and their background knowledge survive preferentially, communities of practice serve as their vehicle, and social orders evolve. As an evolutionary theory of world ordering, which does not borrow from the natural sciences, it explains why certain configurations of practices organize and govern social orders epistemically and normatively, and (...) why and how these configurations evolve from one social order to another. Suggesting a multiple and overlapping international social orders' approach, the book uses three running cases of contested orders - Europe's contemporary social order, the cyberspace order, and the corporate order - to illustrate the theory. Based on the concepts of common humanity and epistemological security, the author also submits a normative theory of better practices and of bounded progress. (shrink)

Emanuele Maffi argues that the Theaetetus, one of the most difficult dialogues of Plato, demonstrates the unbridgeable distance between philosophy and sophia, confirmed by the aporetic outcome of the dialogue. The purpose of this work is to demonstrate that this distance is not necessarily an evil, because in the impossibility of reaching sophia lies the very condition of the existence of philosophy. While all other Platonic works attempt to explain the best ways to inhabit the space of philosophy, the Theaetetus (...) sets the conditions for what constitutes the space of philosophy. (shrink)
