The title of this article has been chosen deliberately, for we find interesting parallels in the careers and outlooks of Alexis de Tocqueville and the great Prussian theorist of war, Carl von Clausewitz whose master work, On War, remains sui generis. They overlapped in time, but, more importantly, their major theoretical works dealt in large measure with the same problem – the democratic revolution and its impact on politics. As Clausewitz argued, the warfare of the new era was caused by (...) the new political conditions which die French Revolution created both in France and in Europe as a whole, conditions that set in motion new means and new forces, and have thus made possible a degree of energy in war diat odierwise would have been inconceivable. Identification of those who have the potential to become knowledgeable, skilled, and compassionate physicians, and determining how best to prepare them for medical education has been an on ongoing challenge since the mid-1800s (Ludmerer 1985). When medical education was almost exclusively proprietary, the primary consideration for admission was having adequate financial resources. However, in the late 1800s, two men became the driving forces for structuring medical and premedical education in the United States. Significant variations in the way objects appear across different viewing conditions pose a challenge to the view that they have some true, determinate color. This view would seem to require that we break the symmetry between multiple appearances in favor of a single variant. A wide range of philosophical and non-philosophical writers have held that the symmetry can be broken by appealing to daylight viewing conditions—that the appearances of objects in daylight have a stronger, and perhaps unique, claim to reveal (...) their true colors. CEO compensation has received much attention from both academics and regulators. However, academics have given scant attention to understanding judgments about CEO compensation by third parties such as investors. Our study contributes to the ethics literature on CEO compensation by examining whether judgments about CEO compensation are influenced by two aspects of a company’s tone at the top—social ties between the CEO and members of the Executive Compensation Committee and the CEO’s Reputation, particularly for financial reporting and disclosures. Although, stock (...) exchanges such as NASDAQ require ECC members to be independent, CEOs still may have social connections to the ECC. In addition, CEOs develop a reputation for the quality of their company’s financial reporting and disclosures. We expect both CEO Social Ties and CEO Reputation to impact say-on-pay judgments, and that fairness perceptions about the CEO compensation will mediate the relationship. We conduct an experiment to test our hypotheses. In this study, we employ a two by two experimental design where we manipulate CEO Social Ties with members of the ECC and CEO Reputation for the quality of financial reporting disclosures . Participants were MBA students who provided a say-on-pay judgment , and judgments about the fairness of the CEO’s compensation. Results indicate that CEO Social Ties affected participants’ say-on-pay judgments, which were fully mediated by their perceptions about fairness of the CEO’s compensation. Further, the CEO’s Reputation also affected participants’ say-on-pay judgments, which were fully mediated by their perceptions about fairness of the CEO’s compensation. Pharmacogenetics and disease genetics studies are becoming increasingly prevalent, leading to a growing body of information on genetic associations for drug responsiveness and disease susceptibility with the potential to improve health care. Much of these data are presently characterized as exploratory (non‐validated or hypothesis‐generating). There is, however, a trend for research participants to be permitted (...) access to their personal data if they so choose. Researchers, sponsors, patient advocacy groups, ethics committees and regulatory authorities are consequently confronting the issue of whether, and how, study participants might receive their individual results. Noted international ethico‐legal guidelines and public policy positions in Europe and the United States are reviewed for background. The authors offer ‘Points‐to‐Consider’ regarding returning research results in the context of drug development trials based on their knowledge and experience. These considerations include: the clinical relevance of data, laboratory qualifications, informed consent procedures, confidentiality of medical information and the competency of persons providing results to participants. The discussion is framed as a benefit‐to‐risk assessment to balance the potential positive versus negative consequences to participants, while maintaining the integrity and feasibility of conducting genetic research studies. 1. The present paper is a continuation of my “Self-Ownership, World Ownership, and Equality,” which began with a description of the political philosophy of Robert Nozick. I contended in that essay that the foundational claim of Nozick's philosophy is the thesis of self-ownership, which says that each person is the morally rightful owner of his own person and powers, and, consequently, that each is free to use those powers as he wishes, provided that he does not deploy them aggressively against (...) others. To be sure, he may not harm others, and he may, if necessary, be forced not to harm them, but he should never be forced to help them, as people are in fact forced to help others, according to Nozick, by redistributive taxation. This paper links two domains of recent interest in science and technology studies, complexity and ignorance, in the context of knowledge practices observed among synthetic biologists. Synthetic biologists are recruiting concepts and methods from computer science and electrical engineering in order to design and construct novel organisms in the lab. Their field has taken shape amidst revised assessments of life’s complexity in the aftermath of the Human Genome Project. While this complexity is commonly taken to be an immanent property of (...) biological systems, this article presents an epistemological view of complexity according to which complexity relates to a specific scientific theory or model and refers to that which exceeds the theory or model’s explanatory power. This epistemological view allows us to narrate a particular story about the changing relationship between biology and synthetic biology in the last decade and accounts for early knowledge practices in synthetic biology that “ignored” biology. This article further argues that while the failure of ignorance to produce clear-cut results for synthetic biologists has led practitioners back to biology, the entanglements between different pragmatic orientations and ways of knowing trouble the implications of this return for assessments of the complexity of biological systems. Transplant coordinators play a pivotal role in the process of obtaining consent for live or dead donation of organs. The objective of the project is to unveil emotional experiences and ethical conduct of transplant coordinators using a qualitative research methodology. Ten transplant coordinators who have worked for more than 20 years in this job were recruited by using a purposive sampling technique. The transplant coordinators spoke of negative feelings and moral distress with regard to futile care of family members of (...) deceased donors as well as of living donors. Transplant coordinators experience moral distress on a daily basis; being compelled to compromise their integrity causes moral distress and moral residue, hence, training and support should be offered to them. But a defense of inequality suggested by John Rawls and elaborated by Brian Barry has often proved irresistible even to people of egalitarian outlook. The persuasive power of this defense of inequality has helped to drive authentic egalitarianism, of an old-fashioned, uncompromising kind, out of contemporary political philosophy. The attempts to mitigate the unprecedented health, economic, and social disruptions caused by the COVID-19 pandemic are largely dependent on establishing compliance to behavioral guidelines and rules that reduce the risk of infection. Here, by conducting an online survey that tested participants’ knowledge about the disease and measured demographic, attitudinal, and cognitive variables, we identify predictors of self-reported social distancing and hygiene behavior. To investigate the cognitive processes underlying health-prevention behavior in the pandemic, we co-opted the dual-process model of thinking (...) to measure participants’ propensities for automatic and intuitive thinking vs. controlled and reflective thinking. Self-reports of 17 precautionary behaviors, including regular hand washing, social distancing, and wearing a face mask, served as a dependent measure. The results of hierarchical regressions showed that age, risk-taking propensity, and concern about the pandemic predicted adoption of precautionary behavior. Variance in cognitive processes also predicted precautionary behavior: participants with higher scores for controlled thinking (measured with the Cognitive Reflection Test) reported less adherence to specific guidelines, as did respondents with a poor understanding of the infection and transmission mechanism of the COVID-19 virus. The predictive power of this model was comparable to an approach (Theory of Planned Behavior) based on attitudes to health behavior. Given these results, we propose the inclusion of measures of cognitive reflection and mental model variables in predictive models of compliance, and future studies of precautionary behavior to establish how cognitive variables are linked with people’s information processing and social norms. Cynthia B. Cohen The public wonder and concern that accompanied the birth of Dolly, the cloned sheep, four years ago died down soon after her arrival. Little has been heard about human reproductive cloning since then in the public square. This silence was pierced recently when two groups (...) each announced its intention to clone a child from a human being within the next few years.The Raelians, a religious organization, disclosed in October 2000 that they had found a grieving American couple willing to pay $500,000 to clone their deceased child and that they would proceed with cloning in a secret laboratory within the United States. A few months later, an international consortium led by Pavos Zavos, Ph.D., a University of Kentucky emeritus professor of biology, and Severino Antinori, M.D., an Italian infertility specialist, declared that it intended to clone the first human within two years at an undisclosed location outside the United States. These announcements led Representative James Greenwood (R-PA), chair of the Subcommittee on Oversight and Investigations of the House Committee on Energy and Commerce, to convene a hearing on human cloning on 28 March 2001.Why did human reproductive cloning suddenly become of concern to the House of Representatives? What will the federal government do with regard to the development of human cloning at this point in time? And what should it do to address human cloning in the long-term? I will briefly highlight the major controversies that surfaced at the hearing and then consider the broader questions. Scientific Controversies The initial question of concern to the House subcommittee members was whether cloning science has now reached the point of application to humans. Scientists at the hearing offered widely diverging views about this. Zavos testified that only a small number of cloned animals has died after birth and declared that the key to avoiding impaired human clones is to engage in prenatal screening. Consequently, it is now safe to undertake human cloning, he maintained. He was supported in this view by Brigitte Boisselier, Ph.D., visiting assistant professor [End Page 205] of chemistry at Hamilton College and scientific director of the Raelians, who argued that human cloning would not give rise to the problems that have been encountered in nonhuman mammalian cloning.However, professor of veterinary medicine Mark Westhusin, Ph.D., of Texas A&M University, and Massachusetts Institute of Technology researcher Rudolf Jaenisch, Ph.D., maintained that the same sorts of problems that have appeared in nonhuman mammalian cloning would reappear in human cloning. Westhusin stated that mammals have incurred serious defects leading to spontaneous abortion and that mammalian newborns often display severe respiratory and circulatory problems. The most likely explanation for such abnormalities, Jaenisch hypothesized, is that in cloning, the genetic reprogramming that governs the way an organism develops must take place in a much shorter period of time than in coital or in vitro reproduction. This may result in faulty reprogramming leading to dysregulation of gene expression and consequent genetic defects in cloned animals. There is good reason to think that this also would occur in human cloning, Jaenisch maintained. Until reproductive cloning research has been carried out on several generations of primates and is better understood, he argued, human cloning should not be attempted. Even then, several generations of descendants of human clones would have to be observed before scientists could be sure that it would not have a destructive impact on humans. Ethical Controversy Bioethicists who testified focused on those aspects of the ethical controversy surrounding human cloning that are of particular interest to public policy makers. Group dynamics play an important role in the social interactions of both children and adults. A large amount of research has shown that merely being allocated to arbitrarily defined groups can evoke disproportionately positive attitudes toward one’s in-group and negative attitudes toward out-groups, and that these biases emerge in early childhood. This prompts important empirical questions with far-reaching theoretical and applied significance. How robust are these inter-group biases? Can biases be mitigated by behaviors known to bond individuals and groups together? (...) How can bonds be forged across existing group divides? To explore these questions, we examined the bonding effects of interpersonal synchrony on minimally constructed groups in a controlled experiment. In-group and out-group bonding were assessed using questionnaires administered before and after a task in which groups performed movements either synchronously or non-synchronously in a between-participants design. We also developed an implicit behavioral measure, the Island Game, in which physical proximity was used as an indirect measure of interpersonal closeness. Self-report and behavioral measures showed increased bonding between groups after synchronous movement. Bonding with the out-group was significantly higher in the condition in which movements were performed synchronously than when movements were performed non-synchronously between groups. The findings are discussed in terms of their importance for the developmental social psychology of group dynamics as well as their implications for applied intervention programs. (shrink)

One of the most important concepts in Simone de Beauvoir’s existentialist and phenomenological ethics is the concept of freedom. In this article, I would like to argue that Beauvoir’s concept of freedom is problematic in being strongly constrained by its essentially active character. This constraint contradicts some of Beauvoir’s major ideas, such as the one that considers the body as a situation, as a source of activity and of freedom in itself, as well as the idea of eroticism as one (...) of the most important expressions of authenticity. I will show that Beauvoir’s concept of freedom can appear to be less constrained by the necessity to be inherently active if we look at it through the ‘crack’ provided by her conception of the erotic body as already embodying freedom. Using this ‘crack’, I will attempt to shed new light on the aspects of Beauvoir’s idea of the erotic that are productive for her conceptions of ethics and of freedom. (shrink)

Recently in Israel, a woman was mistakenly implanted with an embryo that is genetically related to another couple. Unfortunately, this case is not an isolated occurrence, as other cases of embryo mix-ups have been reported in several countries, including the USA, China, the UK and various other countries within the European Union. Cases of mixed-up embryos are ethically and legally complex: the woman who carried the pregnancy and the woman who is genetically related to the resulting child—both of whom endured (...) emotionally and physically demanding infertility treatments—along with their partners, may be unwilling to relinquish parental rights over the child.This article explores four possible approaches, found in numerous common law jurisdictions, which can be used to address cases involving embryo mix-ups. Our analysis reveals several avenues through which legal parentage can be established. It can be done through gestation and the marital presumption, genetic connections, by adhering to the principle of the best interests of the child, or by recognising multiple individuals as legal parents. We review the advantages and disadvantages of each approach, but we have one clear recommendation: resolving embryo mix-up cases should be done proactively through the establishment of legislation and guidelines, rather than relying on post hoc individual court decisions. Such legislation and guidelines should guarantee the consistency of values throughout diverse reproductive contexts and mandate that fertility clinics and medical professionals provide individuals with comprehensive information regarding the potential risks associated with assisted reproductive treatments. Statistics education at all levels includes data collected on human subjects. Thus, statistics educators have a responsibility to educate their students about the ethical aspects related to the collection of those data. The changing statistics education landscape has seen instruction moving from being formula-based to being focused on statistical reasoning. The widely implemented Guidelines for Assessment and Instruction in Statistics Education (GAISE) Report has paved the way for instructors to present introductory statistics to students in a way that is both (...) approachable and engaging. However, with technological advancement and the increase in availability of real-world datasets, it is necessary that instruction also integrate the ethical aspects around data sources, such as privacy, how the data were obtained and whether participants consent to the use of their data. In this article, we propose incorporating ethics into established curricula and integrating ethics into undergraduate-level introductory statistics courses based on recommendations in the GAISE Report. We provide a few examples of how to prompt students to constructively think about their ethical responsibilities when working with data. (shrink)

However, despite several hundred years of debate, philosophers have not reached agreement about how legal punishment can be morally justified. When ethics committees are consulted about patients who have or need court-appointed guardians, they lack empirical evidence about several common issues, including the relationship between guardianship and prolonged, potentially medically unnecessary hospitalizations for patients. To provide information about this issue, we conducted quantitative and qualitative analyses using a retrospective cohort from Veterans Healthcare Administration. To examine the relationship between guardianship appointment and hospital length of stay, we first compared 116 persons hospitalized prior to guardianship appointment to a comparison group (n (...) = 348) 3:1 matched for age, diagnosis, date of admission, and comorbidity. We then compared 91 persons hospitalized in the year following guardianship appointment to a second matched comparison group (n = 273). Mean length of stay was 30.75 days (SD = 46.70) amongst those admitted prior to guardianship, which was higher than the comparison group (M = 7.74, SD = 9.71, F = 20.75, p. (shrink)

Cognitive aging researchers have been challenged with demonstrating age-related effects above and beyond global slowing ever since Cerella raised this issue in 1990. As the literature has made clear, this has indeed proved to be a difficult task and continues to plague the field. One way that researchers have attempted to test for disproportionate age differences across task conditions is by using Brinley plots, or plotting the mean response latencies of older adults against the mean latencies for younger adults. The (...) simplicity and large proportion of variance accounted for by these models has led to the widespread use of Brinley plots over the years. However, as systematically tested here through eight cases of simulated data, it is clear that the Brinley technique is not well suited to either identify or display the underlying structure of datasets examining age-related differences in attentional control. Some of the problems with conventional Brinley plots can be resolved by using a modified Brinley plot that includes study-specific slopes linking trial types and a no-age-difference reference line. Multilevel models find all of the relevant effects, especially if applied to trial-level data, and have the advantage of incorporating study-level moderators that might account for slope heterogeneity. Ultimately, we encourage fellow cognitive aging researchers to access the code and data for this project on OSF and employ the use of multilevel models over Brinley plots. (shrink)

According to Peter Galison , science has a highly fractionated structure with multiple sub-sub-disciplines, each with its own agenda. Cooperative trading between groups is necessary for most scientific work to move forward, and it is this trading that preserves the stability of science. We argue that it is not trading per se, but trading in a gift economy that guarantees stability. We support our claims with an examination of contemporary work on magnetic resonance imaging instrumentation. Specifically, we consider: How a (...) feature improvement, intended to reduce scan time, led to substantial medical mis-diagnosis; How a technical error, when corrected, created a consumer crisis in which radiologists preferred technically flawed instruments; How new magnetic resonance theory radically altered the physical interpretation of MRI images; How the MRI instrument at first was financially supported by, and--ironically--ultimately invalidated, the accepted understanding of the nature, source and management of chronic back pain. Ultimately there are three reasons stability requires gifting. First, without a general sense of shared purpose traders will not be committed to mutual engagement; profit does not provide an adequate shared purpose for the MRI community. Second, stability requires trust, and profits are not an adequate foundation for trust. Finally, knowledge is a gift that will not keep on giving if treated simply as a source of profit. (shrink)
