ABSTRACT This paper is intended to stimulate debate amongst stakeholders in the international research community on the topic of returning individual genetic research results to study participants. Pharmacogenetics and disease genetics studies are becoming increasingly prevalent, leading to a growing body of information on genetic associations for drug responsiveness and disease susceptibility with the potential to improve health care. Much of these data are presently characterized as exploratory (non‐validated or hypothesis‐generating). There is, however, a trend for research participants to be (...) permitted access to their personal data if they so choose. Researchers, sponsors, patient advocacy groups, ethics committees and regulatory authorities are consequently confronting the issue of whether, and how, study participants might receive their individual results. Noted international ethico‐legal guidelines and public policy positions in Europe and the United States are reviewed for background. The authors offer ‘Points‐to‐Consider’ regarding returning research results in the context of drug development trials based on their knowledge and experience. These considerations include: the clinical relevance of data, laboratory qualifications, informed consent procedures, confidentiality of medical information and the competency of persons providing results to participants. The discussion is framed as a benefit‐to‐risk assessment to balance the potential positive versus negative consequences to participants, while maintaining the integrity and feasibility of conducting genetic research studies. This is a book symposium on Steffen Borge’s The Philosophy of Football. It has contributions from William Morgan, Murray Smith and Brian Weatherson with replies from Borge.

Currently, electronic agents are being designed and implemented that, unprecedentedly, will be capable of performing legally binding actions. These advances necessitate a thorough treatment of their legal consequences. In our paper, we first demonstrate that electronic agents behave structurally similar to human agents. Then we study how declarations of intention stated by an electronic agent are related to ordinary declarations of intention given by natural persons or legal entities, and also how the actions of electronic agents in this respect have (...) to be classified under German law. We discuss four different approaches of classifying agent declarations. As one of these, we propose the concept of an electronic person (i.e., agents with limited liability), enrolment of agents into an agent register, and agent liability funds as means to serve the needs of all contracting parties. A philosopher argues that state-sponsored cyberattacks against central military or civilian targets are always acts of war. What is this philosopher doing? According to conceptual analysts, the philosopher is making a claim about our concept of war. According to philosophical realists, the philosopher is making a claim about war per se. In a quickly developing literature, a third option is being explored: the philosopher is engineering the concept of war. On this view, the philosopher is making a proposal about which (...) concept we should have – even if it deviates from the extant concept, and even if it does not capture ‘what war really is’. The activity or method of proposing such revisionary definitions, as well as the metaphilosophical reflection on it, has become known as conceptual engineering. (shrink)

Ziel dieser Untersuchung ist die detaillierte linguistische Analyse von Polemik und Argumentation in diesem Streit anhand umfangreicher Textauszüge, wobei erstmals überhaupt eingehendere sprachliche Untersuchungen zu Vogt und Wagner vorgelegt werden.

Our outline points out three aspects of a new post-modern methodology in psychology: liberal, pluralistic, and more tolerant: liberal because it rejects rules that are too strict in favor of more freedom in the choice of method, pluralistic because it conveys an “almost anything goes” attitude toward methods, and more tolerant because mutual tolerance among researchers is vital for a pluralism of methods. Psychological phenomena are complex and can best be understood by using different methods. However, to get things working, (...) tolerance must actively be lived. Of course, much depends on our own willingness as researchers but also on the system’s arrangements. Psychology could be more colorful, and we could all have more fun if we were to be more committed to such a methodology. (shrink)

It is often assumed that how we talk about the world matters a great deal. This is one reason why conceptual engineers seek to improve our linguistic practices by advocating novel uses of our words, or by inventing new ones altogether. A core idea shared by conceptual engineers is that by changing our language in this way, we can reap all sorts of cognitive and practical benefits, such as improving our theorizing, combating hermeneutical injustice, or promoting social emancipation. But how (...) do changes at the linguistic level translate into any of these worthwhile benefits? In this paper, we propose the nameability account as a novel answer to this question. More specifically, we argue that what linguistic resources are readily available to us directly affects our cognitive performance on various categorization-related tasks. Consequently, our performance on such tasks can be improved by making controlled changes to our linguistic resources. We argue that this finding supports and extends recent motivations for conceptual engineering, as categorization plays an important role in both theoretical and practical contexts. (shrink)

Unlike conceptual analysis, conceptual engineering does not aim to identify the content that our current concepts do have, but the content which these concepts should have. For this method to show the results that its practitioners typically aim for, being able to change meanings seems to be a crucial presupposition. However, certain branches of semantic externalism raise doubts about whether this presupposition can be met. To the extent that meanings are determined by external factors such as causal histories or microphysical (...) structures, it seems that they cannot be changed intentionally. This paper gives an extended discussion of this ‘externalist challenge’. Pace Herman Cappelen’s recent take on this issue, it argues that the viability of conceptual engineering crucially depends on our ability to bring about meaning change. Furthermore, it argues that, contrary to first appearance, causal theories of reference do allow for a sufficient degree of meaning control. To this purpose, it argues that there is a sense of what is called ‘collective long-range control’, and that popular versions of the causal theory of reference imply that people have this kind of control over meanings. Conceptual engineering concerns the assessment and improvement of our concepts. But how can proposals to engineer concepts be implemented in the real world? This is known as the implementation challenge to conceptual engineering. In this paper, I am concerned with the meta-philosophical implications of the implementation challenge. Specifically, must we overcome the implementation challenge prior to undertaking conceptual engineering? Some critics have recently answered this question affirmatively. I intend to show that they are mistaken. I argue as follows. First, successful (...) implementation is not an integral part of conceptual engineering. Second, the idea that the value of conceptual engineering relies on successful implementation is in tension with widespread assumptions about normative theorizing. (shrink)

Multi-stakeholder initiatives have become a vital part of the organizational landscape for corporate social responsibility. Recent debates have explored whether these initiatives represent opportunities for the “democratization” of transnational corporations, facilitating civic participation in the extension of corporate responsibility, or whether they constitute new arenas for the expansion of corporate influence and the private capture of regulatory power. In this article, we explore the political dynamics of these new governance initiatives by presenting an in-depth case study of an organization often (...) heralded as a model MSI: the Forest Stewardship Council. An effort to address global deforestation in the wake of failed efforts to agree a multilateral convention on forests at the Rio Summit in 1992, the FSC was launched in 1993 as a non-state regulatory experiment: a transnational MSI, administering a global eco-labeling scheme for timber and forest products. We trace the scheme’s evolution over the past two decades, showing that while the FSC has successfully facilitated multi-sectoral determination of new standards for forestry, it has nevertheless failed to transform commercial forestry practices or stem the tide of tropical deforestation. Applying a neo-Gramscian analysis to the organizational evolution of the FSC, we examine how broader market forces and resource imbalances between non-governmental and market actors can serve to limit the effectiveness of MSIs in the current neo-liberal environment. This presents dilemmas for NGOs which can lead to their defection, ultimately undermining the organizational legitimacy of MSIs. (shrink)

In a merely verbal agreement, a misunderstanding between two parties creates the false impression of agreement: one or both parties think they agree on something, when in fact they do not. There is reason to believe that merely verbal agreements are as common as merely verbal disagreements and disputes. Unlike the latter, however, merely verbal agreements have so far been ignored by philosophers. The purpose of this paper is twofold: first, to clarify what merely verbal agreement is by considering various (...) ways of defining and refining the notion; and second, to explore the effects of merely verbal agreement on conversational common ground, collaborative action, and academic philosophy. It will be argued that merely verbal agreement is best understood in terms of divergent speaker-meanings, that it has specific negative effects on common ground, that it impedes collaborative action, and that it is likely to play a significant role in academic philosophy. To understand how small business entrepreneurs respond to government policy one has to know their risk and time preferences. Are they risk averse, or have high discount rates, such that they are hard to motivate? We have conducted a set of field experiments in Denmark that will allow a direct characterization of small business entrepreneurs in terms of these traits. We build on experimental tasks that are well established in the literature. The results do not suggest that small business entrepreneurs (...) are more or less risk averse than the general population under the assumption of Expected Utility Theory. However, we generally find an S-shaped probability weighting function for both small business entrepreneurs and non-entrepreneurs, with entrepreneurs being more optimistic about the chance of occurrence for the best outcome in lotteries with real monetary outcomes. The results also point to a significant difference in individual discount rates between entrepreneurs and non-entrepreneurs: entrepreneurs are willing to wait longer for certain rewards than the general population. Ausgehend von der systemtheoretischen Konflikttheorie Messmers, der Sach-, Beziehungs- und Machtkonflikte unterscheidet, werden auf der Basis empirischer Daten, die Video- und Audioaufzeichnungen unterschiedlicher Trainings- und Wettkampfkommunikationen sowie Interviews mit Trainern und Spielern umfassen, authentische Konfliktbeispiele aus den Sportarten Handball und Hockey analysiert. Linguistic interventions aim to change our linguistic practices. A commonly discussed type of linguistic intervention is meaning revision, which seeks to associate existing words with new or revised meanings. But why does retaining old words matter so much? Why not instead introduce new words to express the newly defined meanings? Drawing on relevant psycholinguistic research, this paper develops an empirically motivated, general, and practically useful pro tanto reason to retain rather than replace the original word during the process of conceptual (...) improvement. Ameliorative projects design and propagate new linguistic content for some expressions we use for political or social justice purposes. These projects are often driven by an anti-essentialist agenda: they aim to debunk the idea that social categories such as “woman,” “man,” or “race” are constituted by natural essences. But critics argue that nouns tend to trigger essentialist thinking. And because ameliorative projects typically retain nouns, it is argued that these projects cannot achieve their anti-essentialist goals. In response, I argue that (...) the psychological effects of noun use tend to support, rather than hinder, the anti-essentialist goals of ameliorators. (shrink)

It seems natural to think that Carnapian explication and experimental philosophy can go hand in hand. But what exactly explicators can gain from the data provided by experimental philosophers remains controversial. According to an influential proposal by Shepherd and Justus, explicators should use experimental data in the process of ‘explication preparation’. Against this proposal, Mark Pinder has recently suggested that experimental data can directly assist an explicator’s search for fruitful replacements of the explicandum. In developing his argument, he also proposes (...) a novel aspect of what makes a concept fruitful, namely, that it is taken up by the relevant community. In this paper, I defend explication preparation against Pinder’s objections and argue that his uptake proposal conflates theoretical and practical success conditions of explications. Furthermore, I argue that Pinder’s suggested experimental procedure needs substantial revision. I end by distinguishing two kinds of explication projects, and showing how experimental philosophy can contribute to each of them. (shrink)

This paper deals with two distinct topics; unwarranted questions and admittures. The traditional speech act analysis of questions needs revision, since among the felicity conditions of asking a question is believing that the question is warranted. Some questions are unwarranted according to my analysis. A question is unwarranted if the questioner is not standing in the right relation to the addressee, such that he can demand or expect a sincere answer. I use the idea of unwarranted questions to show how (...) conversational admittures can be generated. A conversational admitture is a non-intended admittance by the speaker of some state of affairs being believed by the speaker to be true. Under the assumption that the speaker is rational, the non-intended admittance is something that it is reasonable to credit the speaker with believing as an explanation of the speaker's unwillingness to be cooperative in a given conversation. In the last section I introduce what I call the Principle of Privacy, which tells us that we have a prima facie right to guard some of our thoughts, feelings, personal history, etc. I argue that the Principle of Privacy together with the ideas that there are unwarranted questions and conversational admittures, and the way unwarranted questions can be exploited to generate the latter, endows us with the right to lie in certain contexts. ; ; . This paper argues for explanatory eliminativism about topics (and cognates, such as subject matters) relative to the domain of conceptual engineering. It has become usual to think that topics serve an important explanatory role in theories of conceptual engineering, namely, to determine the limits of revision. I argue, first, that such limits can be understood either as thenormative limitspertaining to the justification of conceptual engineering, as themetaphysical limitspertaining to the identity of the concepts in question, or as theterminological limitspertaining to (...) usage of the original terminology. Second, I argue that the metaphysical reading is disputable as a theory of concepts and inconsequential for conceptual engineers, and that neither of the two leading accounts of topics that have been presented in the literature—the samesaying account and functionalism—determine the limits of revision in either of the two remaining senses. In the absence of more promising competitors, I conclude that there is no theoretical role for topics to play in theories of conceptual engineering. An upshot of my argument is that conceptual engineers should stop worrying about things like topic (dis)continuity, and instead shift their attention to the issues that really matter for justifying conceptual revisions or replacements, making terminological choices, and underpinning conceptual engineering with a theory of concepts. In the paper, I present Christopher Gauker's critique of the view that we talk to each other as a way to make ourselves understood (the received view of linguistic communication) and his alternative theory. I show that both his critique and his alternative fail, and defend the received view of linguistic communication.

This paper deals with the question of whether nature sports are to be counted among the (traditional) sports and Kevin Krein’s recent argument, based on sporting excellence, as to why they should. Krein argues that sports as such are ultimately about sporting excellence and because both so-called traditional sports and nature sports fulfil that criterion, nature sports belong in the sport domain. Here, I show that Krein’s argument rests on an equivocation between two concepts of sporting excellence. Sporting excellence in (...) traditional sports is connected to sporting success. Here agon (contest or competition) dictates or frames areté (striving for excellence). This is not the case for sporting excellence in nature sports, as these are not competitions. We are dealing with two different concepts of sporting excellence and Krein’s argument, based on sporting excellence, must be rejected. It gives no basis for including nature sports in the sport domain. (shrink)

We propose a method for estimating subjective beliefs, viewed as a subjective probability distribution. The key insight is to characterize beliefs as a parameter to be estimated from observed choices in a well-defined experimental task and to estimate that parameter as a random coefficient. The experimental task consists of a series of standard lottery choices in which the subject is assumed to use conventional risk attitudes to select one lottery or the other and then a series of betting choices in (...) which the subject is presented with a range of bookies offering odds on the outcome of some event that the subject has a belief over. Knowledge of the risk attitudes of subjects conditions the inferences about subjective beliefs. Maximum simulated likelihood methods are used to estimate a structural model in which subjects employ subjective beliefs to make bets. We present evidence that some subjective probabilities are indeed best characterized as probability distributions with non-zero variance. (shrink)

The history of photography is more than just a variety of techniques, materials, motives and styles. We the spectators of photographs, also figure as a crucial part of that history. What can be perceived in a photograph is shaped in a far-reaching manner by our own expectations and assumptions of photography’s capacity to show us something. Thus we continue to make use of techniques of observation that were established in the medium’s formative years. Looking at these pictures can be seen (...) as an operation that deals with a tension between resolution and decomposition. In the end, our interest in the microstructure of photographic imagery produces visual forms without any denotation. (shrink)

Is the endeavour to restore perceptive brain functions by electronic implants the first step on the way to create bionic cyborgs? Can we augment or multiply our senses by directly contacting computer chips to the brain? Will bio-implants influence and permanently change human psyche?

Conceptual engineers aim to revise rather than describe our concepts. But what are concepts? And how does one engineer them? Answering these questions is of central importance for implementing and theorizing about conceptual engineering. This paper discusses and criticizes two influential views of this issue: semanticism, according to which conceptual engineers aim to change linguistic meanings, and psychologism, according to which conceptual engineers aim to change psychological structures. I argue that neither of these accounts can give us the full story. (...) Instead, I propose and defend the Dual Content View of Conceptual Engineering. On this view, conceptual engineering targets concepts, where concepts are understood as having two kinds of contents: referential content and cognitive content. I show that this view is independently plausible and that it gives us a comprehensive account of conceptual engineering that helps to make progress on some of the most difficult problems surrounding conceptual engineering.
