Keyword analysis is used to compare the reporting strategies of three major UK newspapers on the topic of Edward Snowden and state surveillance. Differences are identified in the reporting strategies of The Guardian, Daily Mail and The Sun that provide insight into the ideology of the British press. There is significant variation in the style, content and stances of each newspaper towards state surveillance, as well as clear evidence of ideology within each paper: The Guardian is critical of (...) surveillance and defensive of its decision to publish classified documents; the Daily Mail focuses heavily on personalisation and the personal life of Edward Snowden; and The Sun perpetuates an us/them ideology that is highly supportive of state surveillance. These differences are motivated by each newspaper’s ideology, news values and audience considerations and demonstrate how British newspapers offer radically different perspectives on the same events. When Edward Snowden decided in 2013 to hand over thousands of classified documents to reporters, he launched a firestorm of criticism aimed at both himself and the US National Security Agency. The NSA’s collection of metadata ended in 2015 as a direct result of Snowden’s revelations. He continues to leak classified documents from his political asylum in Russia. This article uses just war theory, theories of civil disobedience, and Church teaching on resistance to political authority to examine (...) Snowden’s whistleblower decision. The article recalls the triple-pronged normative structure of familiar liberal democratic theorists of civil disobedience, who argued that conscientious law-breaking should rest on political, moral and legal claims. In opposition to a certain tendency among recent theoreticians of civil disobedience to reduce this complex multi-pronged normativity to one or two prongs, I use the case of Edward Snowden’s whistle-blowing to illustrate and defend the triple-pronged approach. In particular, any sound as well as effective model of civil disobedience needs (...) to highlight its legal underpinnings: conscientious law-breaking should be conceived as ultimately resting on – or expressing basic fidelity to – the law or legality. Only by taking this legal prong seriously can civil disobedients fully acknowledge the pluralistic character of modern societies. Against some radical critics, I argue that this legal approach does not in fact necessarily favor the legal or political status quo. Despite the many strengths of Kimberley Brownlee’s model of conscientious law-breaking, it misses the importance of this legal prong and sometimes rests on a problematic anti-legalism. Consequently, she offers an incomplete model of civil disobedience that cannot sufficiently explain why Snowden and others whose actions fall under the rubric of civil disobedience rely so extensively on legal arguments. This article responds to William Scheuerman’s analysis of Edward Snowden as someone whose acts fit within John Rawls’ account of civil disobedience understood as a public, non-violent, conscientious breach of law performed with overall fidelity to law and a willingness to accept punishment. It rejects the narrow Rawlsian notion in favour of a broader notion of civil disobedience understood as a constrained, conscientious and communicative breach of law that demonstrates opposition to law or policy and a desire for (...) lasting change. The article shows that, according to Rawls’ unduly narrow conception, Edward Snowden is not a civil disobedient. But, according to the more plausible, broader conception, he is. It then identifies some advantages of the broader conception in contemporary analyses of new forms of disobedience, including globalized disobedience and digital disobedience. (shrink)

Whatever else one might say concerning the legality, morality, and prudence of his actions, Edward Snowden, the former U.S. National Security Agency contractor, is right about the notion of publicity and informed consent, which together constitute the hallmark of democratic public policy. In order to be morally justifiable, any strategy or policy involving the body politic must be one to which it would voluntarily assent when fully informed about it. This, in essence, was Snowden's argument for leaking, (...) in June 2013, the documents that revealed the massive NSA surveillance program: So long as there's broad support amongst a people, it can be argued there's a level of legitimacy even to the most invasive and morally wrong program, as it was an informed and willing decision.... However, programs that are implemented in secret, out of public oversight, lack that legitimacy, and that's a problem. It also represents a dangerous normalization of “governing in the dark,” where decisions with enormous public impact occur without any public input. (shrink)

PurposeThis paper aims to present results of a study that focused on the question of how computer and data experts think about Internet and social media surveillance after Edward Snowden’s revelations about the existence of mass-surveillance systems of the Internet such as Prism, XKeyscore and Tempora. Computer and data experts’ views are of particular relevance because they are confronted day by day with questions about the processing of personal data, privacy and data protection.Design/methodology/approachThe authors conducted two focus groups (...) with a total of ten experts based in London. As London is considered by some as the surveillance capital of the world, and has a thriving Internet industry, it provided a well-suited context.FindingsThe focus group discussions featured three topics that are of crucial importance for understanding Internet and social media surveillance: the political economy surveillance in general; surveillance in the context of the Snowden revelations; and the question what the best political reactions are to the existence of a surveillance-industrial complex that results in political and economic control of the Internet and social media. The focus groups provided indications that computer and data experts are pre-eminently informed on how Internet surveillance works, are capable of critically assessing its implications for society and have ideas about on what should be done politically.Originality/valueStudies of privacy and surveillance after Edward Snowden’s revelations have taken on a new dimension: Large-scale covert surveillance is conducted in a collaborative endeavour of secret services, private communications corporations and security companies. More than mere whistleblowers, Edward Snowden, Julian Assange, and Chelsea Manning are exemplary figures who are inventing new political practices and calling old conceptions of the state and citizenship into question.

PurposeAs part of an international study of knowledge of and attitudes to Snowden’s revelations about the activities of the National Security Agency/Government Communications Headquarters, this paper aims to deal with Germany, taking its socio-cultural and political environment surrounding privacy and state surveillance into account.Design/methodology/approachA questionnaire was answered by 76 German University students. The quantitative responses to the survey were statistically analysed as well as qualitative considerations of free text answers.FindingsSnowden’s revelations have had an important influence over German students’ attitudes (...) toward privacy and state surveillance, and show concerns over the privacy risks associated with Internet activity.Practical implicationsThe study results imply a need to build a collective awareness of the importance of the right to privacy and its responsibilities, the available technological options for individuals to exert their own privacy and security and the democratic means to agree and enforce appropriate legal restrictions on state surveillance.Social implicationsYoung Germans support Snowden’s actions and would be more willing to emulate him in Germany than in the USA. While many believe that people must give up some privacy and freedom for security, few seem to believe that current US or German approaches are valid and justified.Originality/valueThis study is the first attempt to investigate the social impact of Snowden’s revelations on German students’ attitudes toward privacy and state surveillance as part of cross-cultural analyses between eight countries. In 2013, following the leaks by Edward Snowden, The Guardian published a number of classified NSA documents. Both leaking and publishing leaks violate the law prohibiting unauthorized disclosures. Accordingly, there are two potential targets for prosecution: the leakers and the press. In practice, however, only the leakers are prosecuted: Snowden is facing a threat of 30 years’ imprisonment; no charges have been made against The Guardian. If both leaking and publishing leaks violate the law, why prosecute only (...) the leakers and not the press? I consider and reject two arguments. The first claims that the press has special moral claims by virtue of its rights or its role. The second argument states that the leakers commit a greater wrong than the press. I conclude that the current prosecution practice is inconsistent: prosecutors should either prosecute both or neither. (shrink)

There is a long-running debate as to whether privacy is a matter of control or access. This has become more important following revelations made by Edward Snowden in 2013 regarding the collection of vast swathes of data from the Internet by signals intelligence agencies such as NSA and GCHQ. The nature of this collection is such that if the control account is correct then there has been a significant invasion of people's privacy. If, though, the access account is (...) correct then there has not been an invasion of privacy on the scale suggested by the control account. I argue that the control account of privacy is mistaken. However, the consequences of this are not that the seizing control of personal information is unproblematic. I argue that the control account, while mistaken, seems plausible for two reasons. The first is that a loss of control over my information entails harm to the rights and interests that privacy protects. The second is that a loss of control over my information increases the risk that my information will be accessed and that my privacy will be violated. Seizing control of another's information is therefore harmful, even though it may not entail a violation of privacy. Indeed, seizing control of another's information may be more harmful than actually violating their privacy. (shrink)

PurposeThis paper aims to deal with the attitudes towards and social impact of Edward Snowden’s revelations in Japan, taking the Japanese socio-cultural and political environment surrounding privacy and state surveillance into account.Design/methodology/approachA questionnaire survey of 1,820 university students and semi-structured follow-up interviews with 56 respondents were conducted, in addition to reviews of the literature on privacy and state surveillance in Japan. Purpose This study aims to analyse the impacts of Edward Snowden’s revelations in Spain focusing on issues of privacy and state surveillance. This research takes into consideration the Spanish context from a multidimensional perspective: social, cultural, legal and political. Design/methodology/approach The paper reviews the Spanish privacy and state surveillance situation. Responses to a questionnaire were collected from 207 university students studying at Universitat Rovira i Virgili or Burgos University. The quantitative responses to the survey were statistically analysed as (...) well as qualitative considerations of free-text answers. Findings The survey outcomes demonstrate that a majority of respondents are aware of Snowden’s revelations, but only a few have even considered taking serious actions to improve their online privacy. One of the most relevant findings is that Spanish citizens find it acceptable to lose privacy and be subject to state surveillance if that provides a benefit in security. Practical implications The research points out the importance of privacy in a multicultural environment. A sensitised society is a keystone for the healthy and balanced development of state surveillance policy and practice. Social implications Training programmes are a critical dimension to ensure awareness across society regarding privacy and digital technologies. Suitable educational policies and curricula at all levels should be fostered. Originality/value Privacy and state surveillance based on information and communication technologies is an emerging research topic with important consequences for social values and ethics. This study provides an overview of Spanish higher education students’ attitudes in these areas. (shrink)

Purpose This study aims to test the attitudes towards and social consequences of Edward Snowden’s revelations in New Zealand, taking into account New Zealand’s socio-cultural and political environment especially as regards privacy and state surveillance. Design/methodology/approach A questionnaire survey of 66 university students and semi-structured follow-up interviews with 18 respondents were conducted, in addition to reviews of the literature on privacy and state surveillance in New Zealand. The outcomes of the survey were statistically analysed and qualitative analyses of (...) the interview results were also performed. Findings Despite a lack of detailed knowledge concerning Snowden’s revelations and a relative lack of knowledge of domestic law enforcement agencies, as well as those devoted to protecting human rights and privacy, the revelations have had a noticeable effect on New Zealand youngsters’ attitudes towards privacy and state surveillance, mainly evidenced in their willingness to emulate Snowden’s actions and in their changed online behaviour, thereby demonstrating a chilling effect. Practical implications The study results suggest younger New Zealanders are aware of and concerned with their privacy and that the government should better publicise the existing mechanisms for protecting human rights and privacy as well as for whistle-blowing by individuals to give effect to the aspirations of younger citizens in particular. Social implications The results of this study, based on a questionnaire survey, indicates that state surveillance and other threats to privacy are issues of concern to younger New Zealanders and that better public education is needed as to the mechanisms that are available for citizens to protect their privacy and human rights. Originality/value This study is the first attempt to investigate the social impact of Snowden’s revelations on New Zealand youngsters’ attitudes toward privacy and state surveillance as part of cross-cultural analyses between eight countries. During the process of E. coli nucleotide excision repair, DNA damage recognition and processing are achieved by the action of the uvrA, uvrB, and uvrC gene products. The availability of highly purified proteins has lead to a detailed molecular description of E. coli nucleotide excision repair that serves as a model for similar processes in eukaryotes. An interesting aspect of this repair system is the protein complex's ability to work on a vast array of DNA lesions that differ widely in (...) their chemical composition and molecular architecture. Here we propose a model for damage recognition in which the UvrB protein serves as the component that confers enhanced specificity to a preincision complex. We hypothesize that one major determinant for the formation of a stable preincision complex appears to be the disruption of base stacking interactions by DNA lesions. (shrink)

This article reconsiders Sartre's seminal 1945 talk, “Existentialism is a Humanism,” and the stakes of the humanism debate in France by looking at the immediate political context that has been overlooked in previous discussions of the text. It analyses the political discussion of the term “humanism” during the French national elections of 1945 and the rumbling debate over Sartre's philosophy that culminated in his presentation to the Club Maintenant, just one week after France went to the polls. A consideration of (...) this context helps explain both the rise, and later the decline, of existentialism in France, when, in the changing political climate, humanism lost its centrality, setting the stage for new antihumanist criticisms of Sartre's work. Psychopathy is associated with a deficit in affective processes and might be reflected in the inability to extract the emotional content of a stimulus. Across two experiments, we measured the interference effect from emotional images that were irrelevant to the processing of simultaneous target stimuli and examined if this interference was moderated by psychometrically defined traits of psychopathy. In Experiment 1, we showed this emotional distraction effect was reduced as a function of psychopathic traits related to cold-heartedness and occurred for (...) both positively- and negatively-valenced images. Experiment 2 attempted to test the automaticity of the effects by presenting the emotional stimuli briefly so that the emotion was difficult to report. Again, high visibility images produced strong effects that were moderated by the cold-heatedness/meanness traits of psychopathy, but the low-visibility images did not evoke the emotional distractor effect. Our results strongly support the notion that psychopathic traits related to cold-heartedness/meanness are associated with an inability to automatically process the emotional content of images. Concurrent analysis (CA) is a process of synthesizing conceptually equivalent data for the purpose of producing a coherent and predictive model in social science. The process of CA is detailed. In short, CA uses Thagard's concept of coherence as a method of explicating links between mental representations. The product is a wide analysis of all pertinent data. This paper provides a philosophical justification for the need and function of CA. The paper is divided into three sections. The first section reviews (...) some problems with the metasynthetic literature. The purpose of this is that CA can be initially understood as a branch of this type of synthesis. The second section links Risjord's post‐paradigmatic position to Rorty's version of pragmatism in order to show the importance of the concept of coherence to these views. The reason for linking these issues is that CA is grounded in rejection of ontological priority. Instead it prioritises a pragmatic conception of coherence. The final section details the mechanics of CA. Concurrent analysis is presented as the most coherent method of synthesizing certain types of narrative evidence if pragmatism is prioritized over ontology. Examples are given from published studies using CA to illustrate the detail of the analysis and the practical value of the product. The examples show that CA appears useful under certain circumstances. These circumstances will be specified, and strengths and weaknesses of the method will be discussed. (shrink)
