This essay challenges a "meta-theory" in just war analysis that purports to bridge the divide between just war and pacifism. According to the meta-theory, just war and pacifism share a common presumption against killing that can be overridden only under conditions stipulated by the just war criteria. Proponents of this meta-theory purport that their interpretation leads to ecumenical consensus between "just warriors" and pacifists, and makes the just war theory more effective in reducing recourse to war. Engagement with the new (...) meta-theory reveals, however, that these purported advantages are illusory, made possible only by ignoring fundamental questions about the nature and function of political authority that are crucial to all moral reflection on the problem of war. We surveyed 223 APA members to investigate the roles of therapists' sex, theoretical orientation, interpersonal boundaries, and clients' sex in predicting therapists' assessments of the ethicality of nonerotic dual relationships with their clients. Results indicated that therapists' sex, interpersonal boundaries, and theoretical orientation influenced ethical judgments of these relationships. Theoretical and practical implications of our findings are discussed.

Clinical ethical support services (CESS) represent a multifaceted field of aims, consultancy models, and methodologies. Nevertheless, the overall aim of CESS can be summed up as contributing to healthcare of high ethical standards by improving ethically competent decision‐making in clinical healthcare. In order to support clinical care adequately, CESS must pay systematic attention to all real‐life ethical issues, including those which do not fall within the ‘favourite’ ethical issues of the day. In this paper we attempt to capture a comprehensive (...) overview of categories of ethical tensions in clinical care. We present an analytical exposition of ethical structural features in judgement‐based clinical care predicated on the assumption of the moral equality of human beings and the assessment of where healthcare contexts pose a challenge to achieving moral equality. The account and the emerging overview is worked out so that it can be easily contextualized with regards to national healthcare systems and specific branches of healthcare, as well as local healthcare institutions. By considering how the account and the overview can be applied to i) improve the ethical competence of healthcare personnel and consultants by broadening their sensitivity to ethical tensions, ii) identify neglected areas for ethical research, and iii) clarify the ethical responsibility of healthcare institutions' leadership, as well as specifying required institutionalized administration, we conclude that the proposed account should be considered useful for CESS. In this paper, I address some of the shortcomings of established clinical ethics centring on personal autonomy and consent and what I label the Doctrine of Respecting Personal Autonomy in Healthcare. I discuss two implications of this doctrine: 1) the practice for treating patients who are considered to have borderline decision-making competence and 2) the practice of surrogate decision-making in general. I argue that none of these practices are currently aligned with respectful treatment of vulnerable individuals. Because of ‘structural arbitrariness’ (...) in the whole process of how we assess decision-making competence, this area is open to disrespectful treatment of people. The practice of surrogate decision- making on the basis of a single person's judgment is arguably not consistent with ethical and political requirements derived from the doctrine itself. In response to the inadequacies of the doctrine, I suggest a framework for reasonableness in surrogate decision-making which might allow practice to avoid the problems above. I conclude by suggesting an extended concept of Patient Autonomy which integrates both personal autonomy and the regulative idea of morality that is required by reasonableness in deciding for non-competent others. IN THIS ESSAY WE ARGUE FOR A RECONFIGURATION OF JUST WAR THEORY around the principle of just intention. A just intention—based just war theory can overcome problems inherent in two alternative "ideal-typical" accounts of just war theory. The "internationalist" account argues for the promotion of justice, by analogy to its pursuit in domestic politics. The "realist" account, on the other hand, favors the particular manifestations of justice within states. Taken together, these two accounts complement each other and emphasize genuine goods. (...) The possibility of taken them together, however, arises only out of consideration of just war theory as a peacemaking activity, ordered to the end, or intention, of this political act. If just war theory is not so understood, there is no possibility of drawing together these two complementary accounts. (shrink)

BackgroundIn the context of limited health care budgets in countries where Neglected Tropical Diseases (NTDs) are endemic, scaling up disease control interventions entails the setting of priorities. However, solutions based solely on cost‐effectiveness analyses may lead to biased and insufficiently justified priorities.ObjectivesThe objectives of this paper are to 1) demonstrate how a range of equity concerns can be used to identify feasible priority setting criteria, 2) show how these criteria can be fed into a multi‐criteria decision‐making matrix, and 3) discuss (...) the conditions under which this decision‐making procedure should be carried out in a real‐world decision‐making context.MethodsThis paper draws on elements from theories of decision analysis and ethical theories of fair resource allocation. We explore six typical NTD interventions by employing a modified multi‐criteria decision analysis model with predefined criteria, drawn from a priority setting guide under development by the WHO. To identify relevant evidence for the six chosen interventions, we searched the PubMed and Cochrane databases.DiscussionOur in vitro multi‐criteria decision analysis suggested that case management for visceral leishmaniasis should be given a higher priority than mass campaigns to prevent soil‐transmitted helminthic infections. This seems to contradict current health care priorities and recommendations in the literature. We also consider procedural conditions that should be met in a contextualised decision‐making process and we stress the limitations of this study exercise.ConclusionBy exploring how several criteria relevant to the multi‐facetted characteristics of NTDs can be taken into account simultaneously, we are able to suggest how improved priority settings among NTDs can be realised. The empirical validity of the locality (LOC) principle of relativity is used to argue in favour of a local hidden variable theory (HVT) for individual quantum processes. It is shown that such a HVT may reproduce the statistical predictions of quantum mechanics (QM), provided the reproducibility of initial hidden variable states is limited. This means that in a HVT limits should be set to the validity of the notion of counterfactual definiteness (CFD). This is supported by the empirical evidence that (...) past, present, and future are basically distinct. Our argumentation is contrasted with a recent one by Stapp resulting in the opposite conclusion, i.e. nonlocality or the existence of faster-than-light influences. We argue that Stapp’s argumentation still depends in an implicit, but crucial, way on both the notions of hidden variables and of CFD. In addition, some implications of our results for the debate between Bohr and Einstein, Podolsky and Rosen are discussed. (shrink)

Changing faces of war and war-like situations have led in recent years to new forms of military deployment. They range from the so called "war on terrorism" with e.g Operation Enduring Freedom or humanitarian interventions (e.g. Kosovo 1999) to deployments within disaster relief missions as lately in Haiti. These pose not only moral, legal, and organizational challenges to states and the international community but also put individual soldiers and military (medical) personnel in situations that their classical formation does not prepare (...) them for. For they face (i) situations not sufficiently covered/ regulated by international humanitarian (IHL) law and/or (ii) tasks that are not within the range of the "classical soldier". These changing needs require new forms of education in the military and highlight the role of ethical education as many of the dilemmas cannot be resolved by sole reference to the IHL. In addition to a solid knowledge of the law of armed conflict (LOAC), military personnel should therefore acquire fundamental skills of ethical reasoning in dilemma situations. Our article aims at (i) outlining the goals of a military medical ethics education that responds to these needs and the practical challenges of present-day military deployment and (ii) present how the ICMM tries to integrate these goals in its educational program. Seven unknown letters from 1823 to 1831 are published. The famous discoverer of the mammal's egg and founder of the modern embryology Karl Ernst von Baer (1792–1876), born as a German in Estonia and then anatomist and zoologist at Königsberg University, wrote them to his publisher Ludwig F. Froriep in Weimar and his son and successor. Robert F. Baer offered his co-work with a dictionary of natural history (which he criticized), he proposed a map of all research voyages (...) everywhere in the world, and he sent a few small papers about local birds. To Robert F. Baer gave some recommendations concerning his career; he asked for details of a death elephant, and he told that they were awaiting the cholera. (shrink)

New York: Cambridge University Press, 2002. Pp. viii + 228. Cloth, $55.00.Gregory Moore's Nietzsche, Biology and Metaphor is a well-written book on a topic of growing importance in Nietzsche studies. Not only concerned with offering an interpretation of Nietzsche in terms of biology and metaphor, Moore's approach offers a literary contextualization of Darwinism in the history of (...) ideas but also in terms of an important reflection on the idea of decadence so important to Nietzsche and so influential in theorizing public health and law in the twentieth century, most perniciously in its deadly expressions in Nazi propaganda. Moore is thus able to bridge the fields of the more specifically linguistic study of metaphor and source-scholarship. To Moore's great credit, he seeks to emphasize the extent to which Nietzsche's thought was developed in active correspondence with the scientific literature and debates of his age. But this reviewer thinks it important to warn those with classical or traditional interest in metaphor that the text presupposes that the reader (and this is also to say that Moore) knows a Nietzschean metaphor when he sees one.Moore begins with the question of Nietzsche's Darwinism, focusing on the physiology of power to explore the relations between Darwin, Spencer, Lamarck, and Rolph, but also Nietzsche's favorites, Malthus and Lange, etc. The discussion of the history of the reception of Darwin's ideas is careful and extensive and offers an insightful clarification of Darwin (necessary to distinguish Darwin from Darwinism, "social" and otherwise). Some readers will find it even more Anglophone than seems justified by Darwin's heritage, despite Moore's passing references to Cuvier and (at rather greater length) Haeckel and Roux.This reviewer notes that the latter references have been well-discussed in the German literature and to some great part Moore is fair to this tradition even if it is also true that the discussion never enters the level of the history of science as this reader, for one, might have wished. In the case of Moore's interpretation of Nietzsche's texts, the readings sometimes suggest a reprise of what has come to be the consensus (and not just among Nietzsche scholars) of views on Nietzsche's thinking. Thus where certain secondary authors are in force in Moore's well-documented account (Pick, Moles, and Ruse), others are missing. Indeed, in the case of Nietzsche and Darwinism, Frederick Gregory's Nature Lost? Natural Science and the German Theological Traditions of the Nineteenth Century (Cambridge, 1992) offers an important supplement. Another book that seems to have been overlooked is Timothy Lenoir, The Strategy of Life: Teleology and Mechanics in Nineteenth Century German Biology (Dordrecht, 1982), and those interested in von Baer and other proponents of teleology in biology will find Lenoir's broader account useful.The second half of the book addresses degeneration and like most contemporary discussions, Moore's book is charged with the political history of the last century. Moore reviews the association of decadence with jazz music and—via physiognomy as its external signifier—to the ugly, the Jew, the Black, and, of course, to women who broke with the family role. As an instantiation, Moore uncovers the nineteenth century antipathy to "allegedly aberrant behavior such as masturbation and homosexuality" in Nietzsche's "restrictive" [End Page 348] (133) view of sexuality and precocious eroticism (134) as degeneration. However, the issue of masturbation is complicated. The nineteenth-century perspective on masturbation was less a matter of prudishness than a judgment backed with considerable social and medical force, which equated the practice with sickness or criminality, the counterpart to which today would be our judgment with regard to an addiction to cocaine or heroine. This censure drove Wagner's "exposure" of Nietzsche's personal dependence on this practice. Readers interested in this question can either take themselves to the easy-to-find because eponymous chapter in Marc Wiener's Richard Wagner and the Anti-Semitic Imagination (Lincoln, 1995) or to David B. Following the publication of 7 letters from Baer to the Frorieps by H.E. Müller-Dietz inNTM N.S. 1 (1993), 2 further letters from Baer and 8 from the Frorieps are published. A curious technical problem in the presentation of the journalNotizen published by Froriep in his Landes-industriecomptoir in Weimar is discussed at length. Froriep recommends his son Robert, to whom Baer sends several enquiries and commissions, which Robert deals with carefully (1831 in Jena, 1849 in Paris). Robert explains (...) in great detail his intention to leave Jena for Berlin in 1831. After his father's death in 1847 he returns to take charge of the Landesindustriecomptoir and begins to cooperate with the newly founded Russian Geographic Society as publisher on behalf of the Society. But about 1850 the cooperation is discontinued by the Russians, and Froriep, who is in economic difficulties, asks Baer (who lives and works in St. Petersburg) urgently (but in vain) to help him with the Society. Early zoological researches by P.S. Pallas and K.E. von Baer in their letters to the zoologists of Berlin. The centenaries which are celebrated in 1991 and 1992 in memory of P.S. Pallas (1791) and K.E. von Baer (born 1792) caused the following studies of hitherto unpublished sources, preserved in the collections of the Museum für naturkunde in Berlin. The earliest zoological works of Pallas are discussed in relation to his last publication on the “Zoographia Rosso-Asiatica” which should have (...) been finished in Berlin. Some years after the death of Pallas, Baer also contacted the Berlin zoologists K.A. Rudolphi and M.H. Lichtenstein, asking for help, when he was going to establish zoology and a zoological museum at the University of Königsberg. (shrink)

The rise of the mechanistic worldview in the seventeenth century had a major impact on views of biological generation. Many seventeenth century naturalists rejected the old animist thesis. However, the alternative view of gradual mechanistic formation in embryology didn’t convince either. How to articulate the peculiarity of life? Researchers in the seventeenth century proposed both “animist” and mechanistic theories of life. In the eighteenth century again a controversy in biology arose regarding the explanation of generation. Some adhered to the view (...) that life is a physical property of matter (e.g. Buffon), others saw living entities as the result of the development of pre-existing germs (e.g. Bonnet). Naturalists, lacked a convincing account that could guide their research. In interaction with leading naturalists of his time Immanuel Kant articulated an approach to explaining generation. Kant’s account, delineated in his Kritik der Urteilskraft (Critique of the power of judgment) (1790), is a combination of Newtonian non-reductionist mechanism in explanation, and a concept of natural end comparable to Stahl’s formal conception of organic bodies. It consists of two claims: a) in biology only mechanical explanation is explanatory, and b) living entities contain some original organisation, which is mechanically unexplainable. In the nineteenth century this approach influenced naturalists as Müller, Virchow, and Von Baer, in their physiological research. Dissatisfied with a sheer mechanistic or, on the other hand, a sheer teleological approach, they appreciated the Kantian account of mechanical explanation of natural ends. In Germany, in the second halve of the nineteenth century, Ernst Haeckel reopened the debate about abiogenesis, which still continuous. (shrink)

The concept of the gene has been the central organizing theme of 20th century biology. Biology has become increasingly influential both for philosophers seeking a naturalized basis for epistemology, ethics, and the understanding of the mind, as well as for the human sciences generally. The central task of this work is to get the story right about genes and in so doing provide a critical and enabling resourse for use in the further pursuit of human self-understanding. ;The work begins with (...) a wide-ranging historical reconstruction and conceptual analysis of the meaning of "the gene" that results in defining and distinguishing two different "genes". Each of these can be seen as an heir to one of the two major historical trends in explaining the source of biological order---preformationism and epigenesis. The preformationist gene predicts phenotypes but only on an instrumental basis where immediate medical and/or economic benefits can be had. The gene of epigenesis , by contrast, is a developmental resource that provides templates for RNA and protein synthesis but has in itself no determinate relationship to organismal phenotypes. The seemingly prevalent idea that genes constitute information for traits is based, I argue, upon an unwarranted conflation of these two senses which is in effect held together by rhetorical glue. Beyond this historical, conceptual, and rhetorical inquiry the bulk of the dissertation then concerns itself with an empirically up-to-date analysis of the cell and molecular basis of biological order and of the pathological loss of same. In each of these chapters I structure my analysis with the idea in mind that the "conflated" view can be held empirically accountable. Major touchpoints in this work include the ideas of I. Kant, J. Thomas E. Hill, Jr., interprets and extends Kant's moral theory in a series of essays that highlight its relevance to contemporary ethics. He introduces the major themes of Kantian ethics and explores its practical application to questions about revolution, prison reform, and forcible interventions in other countries for humanitarian purposes.

The financial Crunch of 2008 was easily explained by both the left and right–too easily. Each insisted that events thoroughly confirmed its own long-held views and utterly refuted those of the opposed camp. This essay argues that there are indeed new lessons to be drawn from the Crunch, lessons that involve balancing the bounty of the Invisible Hand against perils of the Prisoner's Dilemma. Liberal moral imperatives are traced to variables of Personal Choice and External Cost that are typically in (...) tension with each other and thus generate needs for institutional reconstructions that change according to time and circumstance. Personal bankruptcy protection, limited liability corporations, and intellectual property are cited as examples. It is argued that the Crunch occurred because of failure adequately to balance these variables. Three paradoxes came to a head in 2008: Paradox of Efficient Markets; Paradox of Reduced Risk; Paradox of Hard-won Knowledge. The essay concludes with suggestions concerning specific lessons to be drawn from the Crunch and a corresponding list of lessons not to be drawn. (shrink)

Il presente studio si pone in ideale continuità con l’opera di Marcello Gigante Nomos Basileus, analisi fondamentale della nascita e delle interrelazioni tra diritto naturale, diritto divino e diritto positivo nel mondo greco, prendendo le mosse proprio dal punto in cui questi aveva interrotto la sua indagine, ossia sulle concezioni platoniche del nomos e le sue connessioni con il divino, l’anima e l’educazione. In Platone sono rintracciate le premesse teoretiche della concezione, poi diffusa in età ellenistica, imperiale e tardo-antica, e (...) solitamente attribuita agli stoici, del sovrano come nomos empsychos legge incarnata, fonte del diritto positivo in quanto è legge esso stesso. In Platone esiste uno stretto rapporto tra diritto naturale, diritto divino e diritto positivo: che il nomos empsychos sia espressione della legge di natura risulta dal principio platonico secondo cui natura è per l’uomo l’anima e principalmente la dimensione intellegibile e divina che è in essa. I governanti degni promulgano leggi positive che scaturiscono dalla loro anima divina: così può essere garantito il fondamento divino e naturale delle leggi positive. -/- . (shrink)

In The City of God , XI, 10, St Augustine claims that the divine nature is simple because ‘it is what it has’ . We may take this as a slogan for the Doctrine of Divine Simplicity , a doctrine which finds its way into orthodox medieval Christian theological speculation. Like the doctrine of God's timeless eternality, the DDS has seemed obvious and pious to many, and incoherent, misguided, and repugnant to others. Unlike the doctrine of God's timeless eternality, the (...) DDS has received very little critical attention. The DDS did not originate with Augustine, but I am not primarily concerned with its pedigree. Nor am I concerned to ask how the doctrine interacts with trinitarian speculation. I will have my hands full as it is. In Section I of this paper I shall provide a rough characterization of the DDS, indicate its complexity, and focus on a particular aspect of the doctrine which will exercise us in the remainder of the paper, namely, the thesis that the divine attributes are all identical with each other and with God. In section n I shall discuss Alvin Plantinga's recent objections to Aquinas' version of the DDS. I shall then offer a more detailed presentation of what I take to be Aquinas' version , and recast it in terms of a theory of attributes which is significantly different from Plantinga's . Although the recasting of the doctrine will enable me to rebut Plantinga's objections , it by no means solves all the problems of the DDS. In section vi I shall discuss the chief lingering problem facing a defender of the DDS. (shrink)
