Two themes, the elusiveness of wisdom and the distortion of speech, are traced through three important scenes of Herodotus' Lydian logos, the meeting of Solon and Croesus , the scene where Cyrus places Croesus on the pyre , and the advice of Croesus to Cyrus to cross the river and fight the Massagetae in their own territory . The paper discusses whether Solon is speaking indirectly at 1.29–33, unable to talk straight to Croesus about his transgressive behavior: if so, that (...) illuminates the dynamics of speech at a court. At 1.86–90 Croesus may not have fully understood what Solon earlier said to him. Cyrus may understand Croesus' report of Solon's words better than Croesus does himself. Herodotus' readers will also be uncertain what the response of Delphi will be to Croesus' indignant questioning: if a reader has failed to grasp the significance of Gyges' transgression five generations earlier, that reenacts the forgetfulness of figures in the text. At 1.207 Croesus' advice to Cyrus is of questionable wisdom: Croesus too cannot speak directly, and he has anyway learned the wrong lesson from his catastrophe, extrapolating too directly from his own experience. The conclusion suggests some reasons why Herodotus should have chosen to begin his History with Lydia, the kingdom that is on the cusp between East and West, and with Croesus, a figure that resists description in the easy formulations of Greek/barbarian discourse. Caesar’s third-person narrative style has recently attracted much attention, especially regarding his motives for using it, and its relation to those points in the text where he lapses into the first person. This chapter focusses on the nature of Caesar’s third-person style: it differs from ‘typical’ third-person usage in that the reader knows that Caesar-the-narrator and Caesar-the-character are one and the same. Caesar-the-narrator assumes and plays on this knowledge, for example by describing the actions of Caesar-the-character omnisciently but describing those (...) of his antagonists non-omnisciently. The chapter compares Caesar’s technique to that of Xenophon, who also narrates his own actions in the third person, but without adopting the semi-first person that Caesar does. It argues that much of the impact of Caesar’s narrative derives from the complex interplay of Caesar-the-narrator with Caesar-the-character. (shrink)

Community engagement is increasingly recognized as a critical element of medical research, recommended by ethicists, required by research funders and advocated in ethics guidelines. The benefits of community engagement are often stressed in instrumental terms, particularly with regard to promoting recruitment and retention in studies. Less emphasis has been placed on the value of community engagement with regard to ethical good practice, with goals often implied rather than clearly articulated. This article outlines explicitly how community engagement can contribute to ethical (...) global health research by complementing existing established requirements such as informed consent and independent ethics review. The overarching and interlinked areas are respecting individuals, communities and stakeholders; building trust and social relationships; determining appropriate benefits; minimizing risks, burdens and exploitation; supporting the consent process; understanding vulnerabilities and researcher obligations; gaining permissions, approvals and building legitimacy and achieving recruitment and retention targets. Problem: „Was können wir wissen?“ steht heute in einem Spannungsverhältnis zu der wissenspolitischen Frage: „Was müssen wir wissen?“ Was wir wissen müssen, ist einerseits so viel wie nötig, wenn es um Fragen von Sicherheit und Gesundheit geht – andererseits aber so wenig wie möglich, wenn es in Alltag, Wirtschaft oder Wissen­schaft darauf ankommt, Wissen an technische Systeme oder Expertenkulturen zu delegieren. The title of this volume A Man of Many Interests: Plutarch on Religion, Myth, and Magic. Essays in honour of Aurelio Pérez Jiménez is first and foremost a coalescing homage to Plutarch and to Aurelio, and to the way they have been inspiring (as master and indirect disciple) a multitude of readers in their path to knowledge, here metonymically represented by the scholars who offer their tribute to them. Christopher Bennett presents a theory of punishment grounded in the practice of apology, and in particular in reactions such as feeling sorry and making amends. He argues that offenders have a 'right to be punished' - that it is part of taking an offender seriously as a member of a normatively demanding relationship that she is subject to retributive attitudes when she violates the demands of that relationship. However, while he claims that punishment and the retributive attitudes are the (...) necessary expression of moral condemnation, his account of these reactions has more in common with restorative justice than traditional retributivism. He argues that the most appropriate way to react to crime is to require the offender to make proportionate amends. His book is a rich and intriguing contribution to the debate over punishment and restorative justice. (shrink)

Recent work in argumentation theory has emphasized the nature of arguers and arguments along with various theoretical perspectives. Less attention has been given to the third feature of any argumentative situation - the audience. This book fills that gap by studying audience reception to argumentation and the problems that come to light as a result of this shift in focus. Christopher W. Tindale advances the tacit theories of several earlier thinkers by addressing the central problems connected with audience considerations (...) in argumentation, problems that earlier philosophical theories overlook or inadequately accommodate. The main tools employed in exploring the central issues are drawn from contemporary philosophical research on meaning, testimony, emotion and agency. The ever-present possibility of death forces upon us the question of life's meaning and for this reason death has been a central concern of philosophers throughout history. From Socrates to Heidegger, philosophers have grappled with the nature and significance of death. In "Annihilation", Christopher Belshaw explores two central questions at the heart of philosophy's engagement with death: what is death; and is it bad that we die? Belshaw begins by distinguishing between literal and metaphorical uses of the term and (...) offers a unified and biological account of death, denying that death brings about non-existence. How our death relates to the death of the brain is explored in detail. Belshaw considers the common-sense view that death is often bad for us by examining the circumstances that might make it bad as well as the grounds for thinking that one death can be worse than another. In addition, Belshaw explores whether we can be harmed after we die and before we were born. The final chapters explore whether we should prevent more deaths and whether, via cryonics, brain transplants, data storage, we might cheat death. Throughout Belshaw shows how questions of personhood and life's value are bound up with our views on the sense and significance of death. In this paper, I argue that our practice of giving and demanding apologies is rationalized by a belief that apologies make a difference to our normative situation. The characteristic normative effects of an apology are, I claim, that it removes an obligation on others to distance themselves from the wrongdoer, and that it makes the apologizer personally accountable to the addressee for their future compliance with the obligation they violated. However, if we ask what rationalizes that belief, two influential views (...) on the literature on apology – that I call the Reassurance View and the Performing Deference View – prove to be inadequate. In particular, these views cannot explain how apology can be both an expression of remorse for one’s wrongdoing but also a performative through which, by carrying out certain canonical actions, one can – all at once – change one’s normative situation. In order to explain these features of apology, I suggest that we see apology as akin to a normative power, but a normative power that is exercised expressively, or by an expressive action. In particular, I suggest that we see the power of apology as exercised by the performance of the expressive action of dissociation. (shrink)

There seem to be two clearly-defined camps in the debate over the problem of moral expertise. On the one hand are the “Professionals”, who reject the possibility entirely, usually because of the intractable diversity of ethical beliefs. On the other hand are the “Ethicists”, who criticise the Professionals for merely stipulating science as the most appropriate paradigm for discussions of expertise. While the subject matter and methodology of good ethical thinking is certainly different from that of good clinical thinking, they (...) argue, this is no reason for rejecting the possibility of a distinctive kind of expertise in ethics, usually based on the idea of good justification. I want to argue that both are incorrect, partly because of the reasons given by one group against the other, but more importantly because both neglect what is most distinctive about ethics: that it is personal in a very specific way, without collapsing into relativism. ABSTRACT In a recent (2015) Bioethics editorial, Udo Schuklenk argues against allowing Canadian doctors to conscientiously object to any new euthanasia procedures approved by Parliament. In this he follows Julian Savulescu's 2006 BMJ paper which argued for the removal of the conscientious objection clause in the 1967 UK Abortion Act. Both authors advance powerful arguments based on the need for uniformity of service and on analogies with reprehensible kinds of personal exemption. In this article I want to defend the practice (...) of conscientious objection in publicly‐funded healthcare systems (such as those of Canada and the UK), at least in the area of abortion and end‐of‐life care, without entering either of the substantive moral debates about the permissibility of either. My main claim is that Schuklenk and Savulescu have misunderstood the special nature of medicine, and have misunderstood the motivations of the conscientious objectors. However, I acknowledge Schuklenk's point about differential access to lawful services in remote rural areas, and I argue that the health service should expend more to protect conscientious objection while ensuring universal access. This article explores the nature and role of legal powers in private law. I show how powers are special in that they allow agents to change their (and others’) legal circumstances merely by communicating an intention to do so, without having also to change the nonnormative facts of the world. This feature of powers is, I argue, particularly salient in private law, with its correlative or bipolar normative structure; understanding powers and their role in private law thus requires careful attention (...) to this correlativity. In the final section, I argue that the correct explanation of a variety of substantive problems in private law, many having to do with the role of a party's intention, turns on correctly understanding legal powers. The words 'rebellion' and 'revolution' have gained renewed prominence in the vocabulary of world politics and so has the question of justifiable armed 'resistance'. In this book Christopher J. Finlay extends just war theory to provide a rigorous and systematic account of the right to resist oppression and of the forms of armed force it can justify. He specifies the circumstances in which rebels have the right to claim recognition as legitimate actors in revolutionary wars against domestic tyranny and (...) injustice, and wars of liberation against wrongful foreign occupation and colonialism. Arguing that violence is permissible only in a narrow range of cases, Finlay shows that the rules of engagement vary during and between different conflicts and explores the potential for irregular tactics to become justifiable, such as non-uniformed guerrillas and civilian disguise, the assassination of political leaders and regime officials, and the waging of terrorist war against civilian targets. Business ethics as a field of academic endeavour has made significant progress over the past two or three decades. It now boasts a substantial body of scholarly literature, which is a major resource in which much time and effort have been invested and from which much can be gained. However, there is still much work to be done, and the dynamic nature of both academic life and the world beyond it ensures that new issues and opportunities will continue to emerge. (...) Business ethicists, individually and collectively, through the allocation of their limited research resources, will govern how well the field progresses and meets future challenges over the years to come. In particular, through our decisions about what we do or do not study and write about, we will determine the future shape of the scholarly literature – what it addresses successfully and on what it remains silent or inadequate. Implicitly or explicitly, individually and collectively, choices are made, and some are presumably better than others. This paper is a reflection on the progress of business ethics as an academic enterprise. Of course, the development of business ethics as a focus of academic interest has been marked by several review papers already, some reflecting underlying concerns consistent with Enderle’s comment that “in its present stage of development, business ethics appears to be far from being an established academic discipline”. Some might question whether something like business ethics can ever be an academic discipline as such, and for the purposes of this paper it will be helpful to distinguish between disciplines – such as philosophy, economics and psychology – and fields to which the concepts and methods of academic disciplines can be applied. Nevertheless, whatever kind of academic activity business ethics is taken to be, there are significant issues relating to its academic status. (shrink)

In simple terms, psychological dualism purports that there is an underlying complementary, non-material/physical cognitive component associated with a living organism. Thus mind would not simply be an expression of brain function. Science embraces materialism and generally views any form of dualism with disdain. Yet there are a number of accepted phenomena that are suggestive of dualism and in particular are consistent with the existence of souls. One such phenomenon is terminal lucidity, in which people inexplicably return to mental coherence shortly (...) before death after appearing to be lost to “dull, unconscious, or mentally ill” conditions, sometimes for years. The physical/neural plausibility of such rejuvenation is difficult to imagine. Discussions herein introduce terminal lucidity primarily based on some clinal reports. Next, the medium-based communications reviewed in Chris Carter’s Science and the After Life Experience are used to introduce the concept of a soul. Further, a dynamic suggested in Carter’s coverage is then used to offer a simple explanation for terminal lucidity. Finally, for additional context, the state of neuroscience is considered and some brief conclusions are given. (shrink)

The partial structures program of da Costa, French and others offers a unified framework within which to handle a wide range of issues central to contemporary philosophy of science. I argue that the program is inadequately equipped to account for simple cases where idealizations are used to construct abstract, mathematical models of physical systems. These problems show that da Costa and French have not overcome the objections raised by Cartwright and Suárez to using model‐theoretic techniques in the philosophy of science. (...) Technological advancements often lead to revolutions in the creation of art; but, what is unclear is whether such advancements always correspond to revolutions regarding the artistic medium. The notion of an artistic medium is central to our thinking about, engagement with, and appreciation of art. Accounts of the interpretation, understanding, and experience of art must at some point grapple with the role of the artistic medium against such endeavors. Moreover, artists do not choose their medium by accident, but presumably do (...) so with an eye to the specific and unique affordances of their chosen medium. This chapter will explore the ways in which technology affects these issues. One question we could ask is, when does some technology itself become a new artistic medium? Some technological advancements result in the creation of a new artistic medium—like photography—while others do not—like procedural music. Finding “technology” itself to be too broad of a concept to define a distinctive and theoretically useful notion of an artistic medium, this chapter will examine generally what sort of barriers or challenges one might face when thinking of different technologies as themselves constituting an artistic medium. Specific attention will be paid to the notion of the medium and the theoretical and aesthetic work that such a notion plays in regard to works of computer art. (shrink)
