One recurring criticism of the best interests standard concerns its vagueness, and thus the inadequate guidance it offers to care providers. The lack of an agreed definition of ‘best interests’, together with the fact that several suggested considerations adopted in legislation or professional guidelines for doctors do not obviously apply across different groups of persons, result in decisions being made in murky waters. In response, bioethicists have attempted to specify the best interests standard, to reduce the indeterminacy surrounding medical decisions. (...) In this paper, we discuss the bioethicists’ response in relation to the state's possible role in clarifying the best interests standard. We identify and characterise two clarificatory strategies employed by bioethicists —elaborative and enumerative—and argue that the state should adopt the latter. Beyond the practical difficulties of the former strategy, a state adoption of it would inevitably be prejudicial in a pluralistic society. Given the gravity of best interests decisions, and the delicate task of respecting citizens with different understandings of best interests, only the enumerative strategy is viable. We argue that this does not commit the state to silence in providing guidance to and supporting healthcare providers, nor does it facilitate the abuse of the vulnerable. Finally, we address two methodological worries about adopting this approach at the state level. The adoption of the enumerative strategy is not defeatist in attitude, nor does it eventually collapse into (a form of) the elaborative strategy. (shrink)

Past research suggested that when individuals feel that it is their free choice to perform a task, they are more likely to succeed. However, little has been known about the effect of perceived choice of self-control and the psychological processes underlying the benefits of this perception in everyday contexts. To fill this gap, a 7-day experience sampling study was conducted to test whether confidence in sustaining the current self-control activity and perceived value of current self-control could mediate the link between (...) perceived choice and success in the current self-control activity. The results of multilevel analysis suggested that the perceived choice can boost self-control success by increasing expectancy and value of self-control. These findings add mechanistic understanding of the effect of perceived choice on self-control success. (shrink)

Background Supporting physicians in Intensive Care Units s as they face dying patients at unprecedented levels due to the COVID-19 pandemic is critical. Amidst a dearth of such data and guided by evidence that nurses in ICUs experience personal, professional and existential issues in similar conditions, a systematic scoping review is proposed to evaluate prevailing accounts of physicians facing dying patients in ICUs through the lens of Personhood. Such data would enhance understanding and guide the provision of better support for (...) ICU physicians. Methods An SSR adopts the Systematic Evidenced Based Approach to map prevailing accounts of caring for dying patients in ICUs. To enhance the transparency and reproducibility of this process, concurrent and independent use of tabulated summaries, thematic analysis and directed content analysis is adopted. Results Eight thousand three hundred fifty-eight abstracts were reviewed from four databases, 474 full-text articles were evaluated, 58 articles were included, and the Split Approach revealed six categories/themes centered around the Innate, Individual, Relational and Societal Rings of Personhood, conflicts in providing end of life care and coping mechanisms employed. Conclusion This SSR suggests that caring for dying patients in ICU impacts how physicians view their personhood. To resolve conflicts within individual concepts of personhood, physicians use prioritization, reframing and rely on accessible, personalized support from colleagues to steer coping strategies. An adapted form of the Ring Theory of Personhood is proposed to direct timely personalized, appropriate and holistic support. (shrink)

It is evident, in the face of the COVID-19 pandemic that has physicians confronting death and dying at unprecedented levels along with growing data suggesting that physicians who care for dying patients face complex emotional, psychological and behavioural effects, that there is a need for their better understanding and the implementation of supportive measures. Taking into account data positing that effects of caring for dying patients may impact a physician’s concept of personhood, or “what makes you, ‘you’”, we adopt Radha (...) Krishna’s Ring Theory of Personhood (RToP) to scrutinise the experiences of physicians working in intensive care units (ICU) using a fictional scenario that was inspired by real events. The impact of death and dying, its catalysts, internal constituents, external factors, dyssynchrony, and buffers, specific to ICU physicians, were identified and explored. Such a framework allows for ramifications to be considered holistically and facilitates the curation of strategies for conflict resolution. This evaluation of the RToP acknowledges the experience and wide-ranging effects it has on ICU physicians. As such, our findings provide insight into their specific needs and highlight the importance of support on a personal and organisational level. Although further research needs to be conducted, the RToP could serve as the basis for a longitudinal assessment tool supported by the use of portfolios or mentorship due to their provision of personalised, appropriate, specific, timely, accessible and long-term support. This article is a systematic repudiation of Joseph Hamburger's thesis in his book John Stuart Mill on Liberty And Control . Hamburger maintains that Mill wanted to promote the `moral regeneration of mankind' by eroding Christian belief and replacing it with a religion of humanity. He argues that Mill's defense of liberty must be seen in this context, although Mill himself tried to conceal some of his views. Mill in fact permitted interference even in the area of self-regarding conduct. He (...) was against interference by public opinion, but not against interference by superior persons. Mill valued freedom because it enabled superior persons to promote the desired progress toward the religion of humanity. But this article argues that Hamburger fails to distinguish between legitimate and illegitimate forms of interference, a distinction that is central to Mill's case for liberty. Superior persons are not allowed to coerce others from engaging in non-harmful but `miserable' conduct. The progress that Mill envisaged was to be achieved within the framework of freedom for all. This is a study of 288 Korean and 323 Japanese Business executives. The result indicates that, (1) the business executives believe basically in higher level business ethics, but (2) they occasionally have to make unethical business decisions which conflict with their personal values, because of prevailing business practices. (3) However, they think higher ethical standards is useful for long-term profit and for improving workers' attitudes, and the standards can be improved, and (4) to improve ethical standards, model setting by superiors (...) is the most important and clear-cut company policies and code of ethics are essential. I. The Problem of ‘Truth’ in the Logic of Truth.

What should we do about “tainted” public commemorations? Recent events have highlighted the urgency of reaching a consensus on this question. However, existing discussions appear to be dominated by two naïve opposing views – to remove or preserve them. My aims in this essay are two-fold. First, I argue that the two views are not naïve, but undergirded by concerns with securing self-respect and with the character of our engagement with the past. Second, I offer a qualified defence of vandalising (...) tainted commemorations. The defence comprises two parts. I consider two prominent suggestions – to install counter-commemorations and to add contextualising plaques – and argue that they are typically beset with difficulties. I then argue that in some circumstances, constrained vandalism is a response to tainted commemorations which effectively adjudicates the demands of the two opposing views. (shrink)

The term, "objectionable commemorations”, refers to a broad category of public artefacts – such as, and especially, memorials, monuments and statues – that are regarded as morally problematic in virtue of what or whom they honour. In this regard, they are a special class of public artefacts that are subject to public contestation. In this paper, we survey the general ethical and political issues on this topic. First, we categorise the arguments on offer in the literature, concerning the objectionable nature (...) of such commemorations. Second, we review common political responses to objectionable commemorations. Finally, we identify fruitful areas for further philosophical inquiry on this topic. (shrink)

The concept of the cheng xin in the Zhuangzi claims that the cognitive function of the heart-mind is not over and above its affective states and in charge of them in developing and controlling virtue, as assumed by the Confucians and others. This joint cognitive and affective nature of the heart-mind denies ethical and epistemic certainty. Individual perspectives are limited given habits of thought, attitudes, personal orientations and particular cognitive/affective experiences. This paper develops a new functionalist interpretation of Kant that aims to unify his cognitive psychology with transcendental idealism. It argues that Kant’s faculty of cognition describes neither the phenomenal nor the noumenal mind, but a theoretical construct of the transcendental subject, comparable to the abstract Turing machine. This interpretation can be called “transcendental functionalism,” which determines what functions the mind has to realize if it is to be capable of objective cognition. Transcendental functionalism resolves problems associated with other functionalist (...) interpretations of Kant by drawing a systematic distinction between transcendental cognitive functions and their empirical realizations. While transcendental functions stipulate abstract conceptual requirements, their empirical counterparts realize the functional constraints in appearances within the spatiotemporal and causal framework. This distinction also allows a better explanation of why Kant abandoned the subjective deduction of categories in the B-deduction. (shrink)

Kant’s account of the idea of God in the first Critique prefigures but does not imply a theism. It is in his ethical philosophy that this idea is given a theistic interpretation, and that the postulation (or fideic affirmation) of God’s existence, along with immortality, is practically justified as a condition of the possibility of the summum bonum. This paper argues that Kant’s reasoning from his initially austere conception of morality to the summum bonum and to immortality and God’s existence (...) lacks compelling logic. It also argues that Kant’s practical justification of faith, amounting to no more than the claim that practical reason explicates its own inherent need and satisfies this need by faith, fails to satisfy the demand of religious consciousness for an ontology of reason that includes an account of the grounding of reason in what it postulates.
