U.S. immigration policies and enforcement can make immigrants fearful of accessing healthcare. Although current immigration policies restrict enforcement in “sensitive locations” including healthcare facilities, there are reports of enforcement actions in such settings.

Many critics seem to consider it inappropriate or unnecessary to ask what Montaigne means by the faculty of judgment. Laumonier speaks of "Ie bon sens, qu'il oppose si souvent a la memoire et qu'il appelle encore 'jugement' et 'entendement', c'est-a-dire la faculte de penser et de reflechir juste. " 1 Our appreciation of what is implied by judgment, that is by Montaigne's notion of judgment, has been delayed perhaps by a too facile acceptance of a so-called synonymity of meaning among (...) the psychological terms used by Montaigne. In a discussion of key concepts in Montaigne, Donald M. Frame has accurately summarized the present situation with regard to our knowledge of Montaigne's notion of judgment and other key concepts: "We all have our hunches, but we need more than that. " 2 For the expression of his interest and concern for the intellectual and moral activities and capabilities of the mind, Montaigne draws upon a broad and elementary semantic field. These primary psychological terms are jugement, entendement, sens, raison, discours, and conscience. Al­ though these words may be used synonymously, Montaigne does seem to maintain certain basic distinctions among them; frequent substi­ tutions of terms must be the result of semantic and ideational differ­ ences. Indeed, antiocularcentrism provides the unifying thread of Jay’s work, which reviews the theory of vision from Plato to Bergson in the first three chapters and concentrates on “the culture of modernity” in chapters four through eight; the ninth chapter interestingly and curiously places Derrida and feminist criticism side by side under the aegis of “phallogocularcentrism” and presents Derrida and Irigaray if not as the high points of modernism, then at least as the center of the poststructuralist discourse, which argues for the elevation of the word over the eye and so offers downcast eyes as the new logo for what is now identified as postmodernism. Jay’s last chapter addresses postmodernism as a foreclosure on visual practice or the ocularcentric. The short seven-page conclusion attempts to place a positive note on the author’s admitted denigration of the notion of visuality in modern French intellectual thought and culture by calling for a plural or multiple—“polyscopic”—visual experience. Hence, Jay concludes that his notion of downcast eyes or disillusionment is “no solution” (p. 592) to the problem. Certainly, Broodthaer’s “L’Oeil” on the jacket cover does not present [End Page 162] downcast eyes but rather the very feminine alluring eye of a seductress. In this sense, the real message of Jay’s work is reader, beware! His provocative title and even more provocative subtitle initiate from the outset a critique of one of the long-held and cherished myths about the dominance and prominence of the visual sense in Western culture, especially in modern French thought. It is the unsettling of the comfortableness of this notion which Jay’s work successfully undertakes.The study is well-organized and lucidly written. It forcefully argues the author’s case. Unfortunately, there is no bibliography. The omission of a bibliography undercuts the project and casts scholarly suspicion on the entire venture. In all truth, the inclusion of a bibliography would dramatically call attention to serious lacunae in the scholarship. The French thinkers presented and analyzed, such as Bataille, Barthes, Sartre, Foucault, Derrida, Irigaray, and Lyotard, have been studied in depth—at times brilliantly—but Jay ignores this rich corpus of critical material. In particular, his treatment of important French poets such as Rimbaud, the surrealists, Ponge, and others is so skewed in order to reinforce his denigration of the dominant role of vision in twentieth-century French writing that the reader in the field of French studies questions the quality of the basic research undertaken for the project and the author’s skill at reading with understanding and sensitivity hermetic material in the original French. Once these questions are raised, the very nature of Jay’s study itself becomes suspect.As the reader progresses through the volume, it seems that most of Jay’s analyses of the primary texts are based on English translations and are in fact limited to those works available in translation. While this may not be the actual case, the lack of a bibliography reinforces such a suspicion and contributes to the steady erosion of the credibility of the study. Even worse, it poses a troubling if not invidious question: who is the audience for Downcast Eyes? Surely, the audience is not humanists who specialize in twentieth-century French studies. If the intended audience is one of scholars and their students in cultural history and the social sciences with little grounding in contemporary French intellectual thought as manifested in its literature and literary criticism, this audience needs to begin its reading with Jay’s conclusion which is a masterfully subtle denigration of his own work on... Of the eighteen essays, all but one were previously published in various journals between 1975 and 1989; the eighteenth is an essay or “A Preface” on one of his own collections of poetry, Peace on Earth. By addressing his own poetry, Taggart’s volume cleverly includes himself as poet in this study of what he considers valuable in a work of art. [End Page 398]Finding a poem to be a simple composition of words (principle) and an image suggested by that composition (process), Taggart adopts the title Songs of Degrees from Louis Zukofsy’s seven short poems published in 1956 as Some Time. A song is then a poetic form, a continuing complete statement which actualizes the separate entities (words) of its expression. However, and most importantly, a song does not begin as a visual report; rather, a song moves towards being visualized. Consequently, everything depends on technique and everything turns on its structure, as the mind coordinates the information received by the eye. Degrees, then, emerge as variations of consonance and dissonance or word-sound functions. To write down is to compose; to compose is to create. Hence, a song of degrees is both an actual object and a metaphor for that object.Under the poetic of objectivism, Taggart’s essays are primarily concerned with poets whose work is in accord with his own: George Oppen (three essays), Frank Sampori, William Bronk, Louis Zukofsy (three essays), Bruce Andrews, Susan Howe (two essays), Robert Duncan, Charles Olson, and Theodore Enslin. Taggart demonstrates here that he is a sensitive and intellectually alert reader. These essays on criticism are in actuality essays on Taggart’s concept of poetics. Implicit is Taggart’s bias as an objectivist poet who insists that poetry has a spiritual value in the visionary tradition of Robert Lowell and Robert Duncan and to an extent Wallace Stevens.But perhaps of even greater interest than Taggart’s superb readings of his poetic colleagues—and it can be justifiably argued that perhaps only Taggart can read these poets with the sympathetic eye that they deserve—is the inclusion of three essays on other arts: dance (Trina Collins), stained glass (Mark Rothko), and jazz (John Coltrane). By including these essays with those of literary criticism, Taggart expands the terms poetics and poetry to any text or object which is a moving line and complete at the same time. Form comes from language; language is then based on experience, not belief, and the resulting image is what is revealed and reflected, what is seen. A work (poem, song, text) is valuable because its visionary imagination captures the collective conscience to regain spiritual ascesis. The process of objectification is the metaphor or song, which emerges in degrees of interaction. The song has substance, it is tangible, and it has an objective existence of its own. To be critical is to objectify the composition or structure at hand. Critical is another term for technical, and indeed it is the technical aspect of writing poetry which Taggart so deftly elucidates in his volume of essays.For anyone interested in objectivist poetry, Taggart’s collection of essays is mandatory reading. His insights into this kind of cerebral poetry are invaluable, for he blends appreciation with analysis, information with inspiration, and logic with imagination. Based on a sample of 384 U.S. companies and using data pooled from 1998 through 2000, we find that worse performers in the other social areas are both more likely to make charitable contributions and that the extent of their giving is larger than for better performers. In a beautiful recent essay, the philosopher Walter Sinnott-Armstrong explains the reasons for his departure from evangelical Christianity, the religious culture in which he was brought up. Sinnot-Armstrong contrasts the interpretive methods used by good philosophers and fundamentalist believers: Good philosophers face objections and uncertainties. They follow where arguments lead, even when their conclusions are surprising and disturbing. Intellectual honesty is also required of scholars who interpret philosophical texts. If I had distorted Kant’s view to make him reach a conclusion (...) that I preferred, then my philosophy professor would have failed me. The contrast with religious reasoning is stark. My Christian friends seemed happy to hide serious problems in the Bible and in their arguments. They preferred comfort to intellectual honesty. I couldn’t. To what extent can we, historians of philosophy, claim the virtue of intellectual honesty? Speaking frankly, I do not find the practice criticized by Sinnot-Armstrong’s philosophy professor rare or unusual at all. We very frequently distort the views of past philosophers in order to reach the conclusions we prefer. We just call it “Charitable Interpretation.” In this essay, I discuss and criticize the logic behind so-called charitable interpretations in the history of philosophy. This phenomenon is ubiquitous and is not at all restricted to a particular philosophical strand or ideology. Analytic philosophers and post-modernists, Marxists, liberals, secularists, and fundamentalists, we all engage in the very same domestication project. Even more disturbing than the sheer ideological pervasiveness of this phenomenon is the fact that, on many occasions, superb philosophers and historians take part in this fairly childish endeavor. In the first part of this essay, I discuss the general logic of charitable interpretations in the history of philosophy, mostly by addressing discussions in metaphysics and epistemology. In the second part, I focus on the somewhat less noticed use of charitable interpretations in the study of political philosophy, and point out the quintessential role ideology plays in these discussions. In both parts, I concentrate mostly on the interpretation of Spinoza’s thought. I do so not because I have special fondness for Spinoza (“guilty as charged,” I admit), but because Spinoza is such a beast (and may I add, an enchanting beast) and attracts a disproportionate share of the domestication efforts from historians and philosophers of all creeds and persuasions. In the third and final part of the paper, I will begin to outline an alternative methodology, which suggests that past philosophers can be most relevant to our current philosophical discussion, to the extent that they provide us with well-motivated challenges to our common-sense beliefs. Such challenges have the invaluable virtue of being able to undermine our most fundamental and secure beliefs, and force us to engage with the most fundamental questions. When charitable matching occurs, both the person initially offering the matching donation and the person taking up the offer may well feel they have done something better than if they had donated on their own without matching. They may well feel they deserve some credit for the matched donation as well as their own. Can they both be right? Natural assumptions about charitable matching lead to puzzles that are challenging to resolve in a satisfactory way.

This paper looks at conflicts of interest in the not-for-profit sector. It examines the nature of conflicts of interest and why they are of ethical concern, and then focuses on the way not-for-profit organisations are especially prone to and vulnerable to conflict-of-interest scandals. Conflicts of interest corrode trust; and stakeholder trust (particularly from donors) is the lifeblood of most charities. We focus on some specific challenges faced by charitable organisations providing funding for scientific (usually medical) research, and examine a case (...) study involving such an organisation. One of the principal problems for charities of this kind is that they often distribute their funds within a relatively small research community (defined by the boundaries of a small region, like an American state or Spanish Autonomous region, or a small country), and it often proves difficult to find high-level researchers within the jurisdiction to adjudicate impartially the research grants. We suggest and recommend options appropriate for our case study and for many other organisations in similar situations. (shrink)

We investigate corporate giving behaviors of prestigious business award winners in Korea. In particular, we examine whether firms strategically use corporate giving to enhance corporate reputation. We find that award winners generally make more charitable contributions than nonwinners prior to winning awards and maintain significant charitable contributions after winning awards; multiple award winners make even more charitable contributions than single-award winners; and an increase in charitable contributions does not raise the probability of winning awards in the year after the increase. (...) The results suggest that CEOs of award-winning firms do not use corporate giving opportunistically to enhance their status and reputation. Rather, significant charitable contributions by award winners may be indicative of a sound business strategy to maximize long-term firm value. (shrink)

Charitable Reconstruction and Logical Neutrality.

Since the establishment of the first food bank in 1995, charitable food aid has become entrenched in Finland as a seemingly irreplaceable solution to food poverty. Further, it has recently been suggested that the focus of food aid activities is shifting from food poverty and temporary hunger alleviation towards environmental sustainability through addressing food waste via organized re-distribution of expiring food from retail to charitable organizations. This potentially creates a mechanism that solidifies food poverty and fortifies the paradoxical situation where (...) charitable organizations delivering food aid are dependent on food waste rather than trying to reduce it. To understand the process that has led to this shift, a longitudinal media data analysis on the evolution of the discussion and the interpretations on CFA is presented. By conducting an inductive frame analysis, the paper answers three key questions: How was CFA framed by and through the media in Finland between 1995 and 2016? Has any single frame dominated the discussion at any given point? Finally, what are the characteristics of the frame that focuses on food surplus redistribution? The results suggest that when the practices are framed as potential receivers and redistributors of surplus, perception of CFA is mainly favourable and the root causes for food insecurity are not addressed. Thus, by focusing on environmental sustainability, food aid practices—hitherto depoliticized as a poverty problem—have gained policy relevance in the discursive space of the circular economy; perhaps at the cost of poverty policy and with unintended consequences. Human genetic research databases cast a new light on the controversial issue of which uses of the human body are morally permissible. More specifically, banking human tissue raises issues relating to the ownership of the samples that the participants have donated, to the ownership of the data that are derived through processing the donated samples, and to the management arrangements that better balance the interest of genetic research with the protection of participants' rights. Winickoff & Winickoff suggest that the charitable-trust (...) model is a superior legal arrangement for biobanking compared with private biobanking. This paper critically assesses Winickoff & Winickoff's claim by highlighting some areas of implementation where such a model could be problematic. The charitable trust is certainly an advantageous arrangement because (1) it favors the separation between control and use of the samples, (2) it provides a procedural mechanism that facilitates the participation donor groups in the biobank management and (3) it mediates the different interests that are affected. On the other hand, the charitable-trust model leaves unresolved several issues--among them the ownership of the sample, the right of withdrawal, access and funding mechanism. I conclude that further theoretical and empirical analysis is required in the area. (shrink)

If anything is certain about Socrates' treatment ofpoetry in Plato's dialogues, it is that he never gives a poem a chance to explain itself. He dismisses poems altogether on the basis of their suspect moral content {Republic II and III), or their representational form {Republic X), or their dramatic structure {Laws 719); he calls poets ignorant (...) {Apohgy, Ion) and—not obviously as a compliment—mad {Ion, Phaedrus); and when he wants to use a poem to support his own position, he unhesitatingly distorts its apparent meaning {Protagoras, Lysis). I will not argue that, in spite of this behavior, Socrates occasionally gives poetry its due, nor that even as he dismisses it he is willing to preserve some portion of it. When I refer to Socrates' charitable interpretations of poetry, I mean a way of reading a poem that motivates and grounds the mistreatments I have catalogued. Socrates is, at all times, prone to read a poem charitably; and that is part of his hostility toward poetry. To make this point I will discuss the last mistreatment of poetry I named: Socrates uses a poem in his defense by forcing it to say what its author plainly did not intend. We see the workings ofhis interpretive method in an extended analysis of Simonides in the Protagoras, and perhaps also in a use of Homer and Empedocles in the LysL·. I will argue that what looks at first simply odd in those passages may be shown to follow a principle of interpretation which in some extreme form resembles the principle of interpretive charity. Thus it is Socrates' excessive charity toward poetry that stands behind his abuse of it. That charity points to a new attitude toward poets, perhaps the first theoretically motivated rejection of the author. I think that this fate of 248 Nicholas Pappas249 the author in Socrates' interpretation will illuminate both his hostility toward poetry and his examination of his live interlocutors. More generally, Socrates' example will show how the search for truth in an interpretation is one way to deny appeals to the author. Although Socrates' interpretation of Simonides in the Protagoras has been discussed many times, its purport or explanation is usually left unexamined.1 What is uncontroversial is that in Protagoras 338e-348a, Plato's most extensive depiction of Socrates saying what a poem means, we find Socrates systematically misreading Simonides. He plucks individual lines out ofa poem, combines them with his own highly specific ethical beliefs, and from this conjunction deduces a point which he then attributes to the poet. We must decide whether this is all some sort of joke, or whether on the contrary, as I believe, the interpretation reveals a coherent and deliberate method. The text examined is a nearly continuous piece ofSimonides' writing, roughly twenty-five lines from a much longer poem. It is Protagoras who goads Socrates into interpreting the poem, as part ofthe intellectual battle between them that continues through the dialogue. Protagoras sets an interpretive problem for Socrates to solve: two bits ofSimonides' poem seem to contradict one another, for the first bit says it is hard to become good, and the second denies that it is hard to be noble (339). Socrates begins with the more modest aim of resolving that contradiction, but goes on through the poem to hang a sophisticated moral point on Simonides. At first Socrates tries to resolve the contradiction by saying that Simonides thinks it hard to become good or noble, but easy to remain in that state (to be noble) once it has been achieved (34Od). Protagoras ridicules this explanation, and Socrates quickly drops it in the face of objections (34Ie); but already the tone of Socratic interpretation has been set. In abroad sense, this paradoxical notion ofmoral improvement is a Socratic notion: the steps toward clarity of understanding are slow and taken only reluctantly, but the state of enlightenment can be maintained, Socrates usually seems to think, without effort (see, e.g., Symposium 21 Id ff.). Socrates, in other words, has made Simonides' thought consistent by identifying it with his own. But that is still too broadly... (shrink)

In this article, I explore some harms that emerge from the call for charity in academic philosophy. A charitability gap, I suggest, exists both between who we tend to read charitably and who we tend to expect charitability from. This gap shores up the disciplinary status quo and (re)produces epistemic oppression, which helps preserve philosophy's status as a discipline that is, to use Charles Mills's language, conceptually and demographically dominated by whiteness and maleness (Mills 1998, 2). I am particularly interested (...) in calls for charity made in response to critiques of racist or sexist authors/texts. I suggest that in these cases, interpretive charity perpetuates epistemic violence by creating conditions for testimonial smothering (Dotson 2011); that it functions as an orientation device (Ahmed 2006) designed to bring “unruly” philosophers back in line with disciplinary practices and traditions; and that it requires resistant philosophers to remain in oppressive worlds (Lugones 2003a; Pohlhaus 2011). Although charitability is risky—and charity is disproportionately demanded from already marginalized philosophers—I am hesitant to abandon charity entirely. The outright rejection of charitable orientations toward texts or others commits philosophers to a purity politics that, following Alexis Shotwell, I suggest we resist (Shotwell 2016). (shrink)

Section 170 of the U.S. Internal Revenue Code is known as the “charitable contribution deduction.” This Article explores the section’s rationale as well as its effect on income/wealth distribution. It reaches the conclusion that the deduction can be justified on efficiency and democracy grounds, but is not “charitable,” as its distributive effects are neutral or even regressive.

'May one be pardon’ d and retain the offence?’ asks King Claudius in his tormented monologue in Hamlet. Forgiveness appears incompatible with the retention of the offence, both in the sense of enjoying its consequences and in the sense of the subsistence of the attitude which underlay the offensive act. There are, however, views which allow for, even admire, an attitude of forgiveness towards people who have ‘retained’ their offense in some way. This idea of forgiveness is harder to justify, (...) since no change has taken place in the agent. We suggest that the concept of toleration can serve as an illuminating clue in such an analysis. The tolerant attitude involves a certain kind of reconciliation with people who not only have done something wrong in the past, but insist on sticking to their objectionable conduct in the present and the future. Tolerance, in other words, is not conditioned by repentance or by commitment to behavioral transformation; it is a kind of unconditional ‘forgiveness’ in advance. (shrink)

Through an exploration of traditional, Christian, charitable acts -- both corporeal and spiritual in nature -- I set out to develop an alternative view. Why, for example, is the simple act of laying the dead to rest considered an act of charity? Feelings of pity and commiseration offer an insufficiently firm basis for justifying such an attribution. By adopting the burial of the dead as a sort of touchstone, (...) I suggest that the indigent other finds him- or herself in need of charity at the precise moment that he or she loses the ability to react as a person. Sometimes being charitable comes to expression in relinquishing one’s demands that the other behave as morally responsible people ought to behave. Current philosophical reflections on science have departed from mainstream history of science with respect to both methodology and conclusions. The article investigates how different approaches to reconstructing commitments can explain these differences and facilitate a mutual understanding and communication of these two perspectives on science. Translating the differences into problems pertaining to principles of charity, the paper offers a platform for clarification and resolution of the differences between the two perspectives. The outlined contextual approach occupies a middle ground between mainstream (...) history and sociology of science, bracketing questions of rationality, and individual coherence-maximizing, rationality-centered approaches. It can satisfy those, who believe that science is an epistemically privileged endeavor, and its epistemic content should not be neglected when reconstructing the scientists’ positions. It can also satisfy those who hold that it is naive to believe that the immediate context, e.g. the challenges to a theory, the expectations of the author about his audience, etc., does not affect the position a scientist takes. Its theoretical considerations are exemplified with a close study of the debate following the 1672 publication of Newton's theory of light and colours, also offering a novel reading of the development of his methodological views concerning the demonstrativity of the famous crucial experiment. Although we only show the capacity of the framework to analyze a direct controversy, given that it is hard to think about any scientific text as detached from an argumentative context, this approach has the potential to be a general guide for interpretation. Are philosophical arguments as effective as narratives in influencing charitable giving and attitudes toward it? In four experiments, we exposed online research participants to either philosophical arguments in favor of charitable giving, a narrative about a child whose life was improved by charitable donations, both the narrative and the argument, or a control text (a passage from a middle school physics text or a description of charitable organizations). Participants then expressed their attitudes toward charitable giving and were either asked how (...) much they would hypothetically donate if given $10 (Experiment 1) or told they had a 10% chance of winning $10 and given the opportunity to donate from their potential winnings (Experiments 2–4). Across the four experiments, participants in all of the narrative conditions and in some of the argument conditions tended to express more positive attitudes toward charitable giving and donated about $1 more on average than did participants in the control conditions. These effects appear to have been mediated by the “narrative transportation” scale, which suggests that appeals to donate can be effective if they engage participants’ emotions, imagery, and interest. Building on 42 semi-structured interviews with directors and stakeholders of food charities based in Greater Manchester (UK), alongside online data and Factiva references trends, I argue that the charitable food provision (CFP) sector can be effectively conceptualized as a strategic action field (SAF). To do so, I first focus on the shared rules, understandings and practices characterising the organizations that belong to the field and on the broader field environment that imposes constraints and provides opportunities to the field actors. Subsequently, (...) I examine the characteristics of five particularly relevant charities to describe the social positions and position-takings of the incumbent, the challengers and the group I refer to as sideliners of the field. Hence, I briefly touch upon the Covid-19 outbreak as an exogenous shock to discuss the effect of the campaign carried out by a ‘socially skilled actor’ - football player Marcus Rashford. I conclude by suggesting future research directions to enhance the application of SAF theory as a tool for investigating food support organizing within and across countries. (shrink)

Psychological well-being indicates individuals’ positive psychological functioning and well-being. A growing body of literature, largely based on adults and old people, suggests that volunteering and charitable donations are related to individuals’ psychological well-being. As emerging adulthood is a vital time for lifespan development, the aim of this study is to examine the effects of volunteering and charitable donation on individuals’ psychological well-being on college students. Relying on theories of altruism and the warm-glow theory, this study estimates the relationships among hours (...) of volunteering, amount of charitable donations, and psychological well-being from 1,871 Chinese college students. The linear regression results indicate that students’ hours of volunteering and the amount of charitable donations in the past year were positively associated with their psychological well-being. Volunteering, compared to charitable donations, had a slightly stronger association with psychological well-being. This study provides a rationale for academic institutions to integrate social service activities into the curriculum as a potential tool to promote students’ psychological well-being. (shrink)

Young children routinely display a naturalistic understanding of the world. When asked for explanations, they rarely invoke supernatural or religious explanations even when confronted by puzzling or unexpected phenomena. Nevertheless, depending on the surrounding culture, children are eventually prone to accept God as a creator, to believe in the power of prayer and to expect there to be an afterlife. A plausible interpretation of this dual stance is that children adopt two different cognitive routes to understanding: one grounded in empirical (...) observation and in trusted testimony about the observable world. Based on this route, children gradually build up a common-sense understanding of various natural domains, including the physical, the biological and the psychological. The second route is grounded in children’s early emerging ability to engage in shared pretense. As members of a religious community, children will routinely observe community members engage in activities, such as prayer, which cannot be readily understood in terms of their standard, common-sense framework. Nevertheless, children can charitably interpret prayer as special form of communication, directed at an imagined interlocutor. Cumulative exposure to such belief-based activities is likely to encourage children to transition from charitable interpreters of religious activities to participant believers. (shrink)

There are powerful fairness and efficiency arguments for making charitable donations to soup kitchens 100% deductible. These arguments have no purchase for donations to fund opulent church organs, yet these too are 100% deductible under the current tax code. This stark dichotomy is only the tip of the iceberg. Looking at a wider sampling of charitable gifts reveals a charitable continuum. Based on sliding scales for efficiency, multiple theories of fairness, pluralism, institutional competence and social welfare dictate that charitable deductions (...) should in most cases be fractions between zero and one. Moreover, the Central Limit Theorem strongly suggests that combining this welter of largely independent criteria with the wide variety of charitable gifts results in a classic bell-shaped normal curve of optimal deductions, with a peak at some central value and quickly decaying to zero at the extremes of 0% and 100%. Given that those are the only two options under the current tax code, the current charitable deduction regime inevitably makes large errors in most cases. Actually calculating a precise optimal percentage for each type of charitable donation is of course impractical. This Article suggests, however, that we can do much better than the systematically erroneous current charitable deduction. Granting a 100% deduction only for donations to the desperately poor, along with 50%, 25%, and 0% for gifts yielding progressively fewer efficiency, fairness, pluralism, and institutional competence benefits, promises to deliver a socially more desirable charitable deduction. Despite what Peter Singer and Peter Unger believe, no one violates the ‘rescue principle’ when she makes a frivolous purchase instead of giving to a charity like UNICEF. Nor does any one violate a collective action version of the rescue principle when she makes a frivolous purchase instead of giving to a charity. Garrett Cullity is also mistaken in believing that ‘the transitivity of wrongness’ can be used to reach the conclusion that a failure to give to charity is wrong (...) because a failure to save is. This makes it likely that the requirement to give to charity is based not on the requirement to rescue but instead on the moral requirement to marginally improve the ability of charitable organisations to do their important work. Previous experimental and observational work suggests that people act more generously when they are observed and observe others in social settings. However, the explanation for this is unclear. An individual may want to send a signal of her generosity to improve her own reputation. Alternately (or additionally) she may value the public good or charity itself and, believing that contribution levels are strategic complements, give more to influence others to give more. We perform the first series of laboratory experiments that (...) can separately estimate the impact of these two social effects, and test whether realized influence is consistent with the desire to influence, and whether either of these are consistent with anticipated influence. Our experimental subjects were given the opportunity to contribute from their endowment to Bread for the World, a development NGO. Depending on treatment, “leader” subjects’ donations were reported to other subjects either anonymously or with their identities, and these were reported either before these “follower” subjects made their donation decisions. We find that “leaders” are influential only when their identities are revealed along with their donations, and female leaders are more influential than males. Identified leaders’ predictions suggest that are aware of their influence. They respond to this by giving more than either the control group or the unidentified leaders. We find mixed evidence for “reputation-seeking.”. (shrink)

John Rawls offers an account of public reason that argues that comprehensive doctrines are admissible into public deliberations of fundamental political matters only when they are used to say things that can also be said on the basis of the noncomprehensive liberal political values of freedom and equality. This essay argues that elements of comprehensive doctrines ought to be allowed into public reason even when those elements cannot be translated into the terms of liberal political values. It draws on Ralph (...) Waldo Emerson's conception of communication among citizens and Stanley Cavell's interpretation of Emersonian moral perfectionism to develop a conception of public reason that allows a greater range of views held by citizens to play a legitimate role in democratic deliberations. An Emersonian conception of liberal democracy differs from Rawls's in that it more explicitly views the democratic community as actively engaged in continually revising and perfecting the liberal political values of freedom and equality. Some of the challenges in Sanders et al. (this issue) can be aptly illustrated by means of charity nudges, that is, nudges designed to increase charitable donations. These nudges raise many ethical questions. First, Oxfam’s triptychs with suggested donations are designed to increase giving. If successful, do our actions match ex ante or ex post preferences? Does this make a difference to the autonomy of the donor? Second, the Behavioural Insights Team conducted experiments using social networks to nudge people to (...) give more. Do these appeals steer clear of exploiting power relations? Do they respect boundaries of privacy? Third, in an online campaign by Kiva, donors are asked to contribute directly to personalized initiatives. In many cases, the initiative has already been funded and donor money is funnelled to a new cause. Is such a “pre-disbursal” arrangement truthful and true to purpose as a social business model? Are the wishes of the dead more important than the needs of the living? This question is prompted by consideration of the Hershey Trust Company, a perpetual charitable trust that not only owns and operates the Milton Hershey School in Pennsylvania, but also owns a controlling interest in various Hershey-related for-profit entities. This unusual arrangement, and the conditions under which it was formed, have produced a situation in which a small, private boarding school for low-income students has an endowment of (...) $12 billion (in addition to its other corporate and real estate interests). The trust has been operating according to its founder’s wishes for decades, but some have wondered whether its resources could be put to better use for more urgent needs. This case will invite students to consider the question of how we should weigh the needs of the living against the wishes of the dead. (shrink)
