This volume critically discusses the relationship between democracy and constitutionalism. It does so with a view to respond to objections raised by legal and political philosophers who are sceptical of judicial review based on the assumption that judicial review is an undemocratic institution. The book builds on earlier literature on the moral justification of the authority of constitutional courts, and on the current attempts to develop a system on "weak judicial review". Although different in their approach, the chapters all focus (...) on devising institutions, procedures and, in a more abstract way, normative conceptions to democratize constitutional law. These democratizing strategies may vary from a radical objection to the institution of judicial review, to a more modest proposal to justify the authority of constitutional courts in their "deliberative performance" or to create constitutional juries that may be more aware of a community's constitutional morality than constitutional courts are. The book connects abstract theoretical discussions about the moral justification of constitutionalism with concrete problems, such as the relation between constitutional adjudication and deliberative democracy, the legitimacy of judicial review in international institutions, the need to create new institutions to democratize constitutionalism, the connections between philosophical conceptions and constitutional practices, the judicial review of constitutional amendments, and the criticism on strong judicial review. RESUMO O artigo visa relacionar a tese da centralidade do outlaw, para se pensar o direito, em Hannah Arendt, com a sua compreensão do direito como “direito a ter direitos”, esboçada em “Origens do totalitarismo”. Partindo da desintegração europeia no início do século XX e do surgimento do outlaw contemporâneo, o refugiado, refletiremos sobre o sentido do princípio da legalidade, sua relação, em Arendt, com a plural condição humana e o mundo comum. Mostraremos como estão contidos, na obra mencionada, elementos (...) para uma articulação inicial entre a ideia do direito como “direito a ter direitos” e uma teoria da cidadania na pensadora judia-alemã. Starting from the European disintegration in the early twentieth century and the emergence of the contemporary outlaw, the refugee, we will reflect on the meaning of the principle of legality, its relationship, in Arendt, with a plural human condition and the common world. We will show how there are elements contained, in the work mentioned, for an initial articulation between an idea of law as "right to have rights" and a theory of citizenship in the Jewish-German thinker. Although language processing seems to resist age advancement, linguistic changes in aging are the reflection of systematic decline in cognitive and energy resources. However, aging does not affect language in a global way, being predominant a marked deterioration of production versus a relative maintenance of comprehension at various levels. This review provides updated information on the changes occurring in linguistic aging, focusing on lexical-semantic processing and the role of sociodemographic factors such as education, socioeconomic status and gender; In addition, a (...) brief approach to linguistic processing in the fourth age is attached. As a result, literature shows that lexical-semantic processing is asymmetric; older adults maintain their vocabulary and conceptual knowledge, however, they fail in tasks of access and lexical availability, with notable increase in events of the tip of the tongue associated with dependence on the psycholinguistic variables of the word. At the same time, the educational and socioeconomic level can influence lexical-semantic performance of the older adult, given its relation with the cognitive reserve and the greater elaboration of compensatory strategies. ABSTRACT In this research,1 we aim to analyze how misogyny establishes itself in an interaction on X (formerly Twitter) to legitimize hate speech, under the argument of opinion defense. Theoretically, in light of Interactional Sociolinguistics and Pragmatics, we conceive that impoliteness strategies contribute to the construction of linguistic-discursive violence scenarios in online-mediated interactions, as they both reduce interlocutive distance and generate sexist, misogynistic, patriarchal, and antifeminist metapragmatics. Methodologically, we adopted a qualitative approach to analyze an interaction on X based on (...) the inclusion and exclusion criteria proposed in this study, using the netnographic method. Analytically, we observed that interlocutors C, E, and F frequently used impoliteness strategies in constructing opinion-based discourses to attack feminism and legitimize hate speech. (shrink)

O artigo enseja discutir os dilemas e as possibilidades da política na atual configuração societária. Partiremos da definição de sociedade do conhecimento como sociedade em rede apresentada pelo sociólogo Manuel Castells e, em seguida, exporemos os conceitos arendtianos de totalitarismo e ação, importantes para uma reflexão sobre a política nos dias atuais. Abordaremos as implicações da questão judaica na teoria política arendtiana, na qual sobressai uma perspectiva agônica do poder, isto é, o poder não como lugar das forças anônimas, sistêmicas, (...) reprodutoras do status quo, mas de fundação, resistência, civilidade e revelação dos homens como agentes. O pensamento de Hannah Arendt mostra-se fecundo para compreensão das vias de acesso às práticas que repõem, na sociedade do conhecimento, a política na sua significação original. (shrink)

O presente artigo busca refletir sobre a especificidade da crítica literária desenvolvida por Georg Lukács. A literatura sempre foi um objeto privilegiado em toda sua trajetória intelectual. No entanto, há diferenças consideráveis no modo como ele a aborda, diferenças que respondem, em larga medida, a injunções políticas e históricas. Partimos de considerações mais gerais sobre a relação de Lukács com a literatura, em que se coloca o problema a respeito do papel da história como história literária e como reconciliação entre (...) as necessidades artísticas e aquelas do desenvolvimento histórico. Em seguida, apresentamos mais detidamente alguns aspectos da “estética comunista” de Lukács. Nesse ponto, esse artigo focará na controvérsia contra o sociologismo vulgar, que marcou o desenvolvimento do pensamento estético soviético e teve um papel fundamental na constituição da crítica literária de Lukács. Alguns traços da maneira como Lukács se coloca como historiador e crítico literário aparecem claramente na sua intervenção no debate sobre o romance, um dos episódios do enfrentamento do sociologismo vulgar, que será comentado ao final. O inimigo comunista é examinado nesses longas-metragens tendo como base a retórica reaganista do período.The Cold War and the Communist Enemy on the US Movie Theater Screens in the 1980s The last decade of the Cold War was a turbulent one. Its beginning showed tension comparable to that of the 1950s and early 1960s. As of the mid-1980s, however, there was a détente, the end of the Cold War and the collapse of the bipolar international power system. Movies, like other forms of cultural production, were tools for propaganda and mobilization throughout the Cold War. The purpose of this paper is to analyze how the Cold War was shown in the 1980s movies with the highest box-office sales in the US. The Communist enemy is examined in these feature films according to the Reaganist rhetoric of the period. Resumen La Guerra Fría y el enemigo comunista en los cines norteamericanos de los años 1980 La última década de la Guerra Fría fue turbulenta. Su inicio presentó una tensión comparable a la existente en los años 1950 y principios de los años 1960. O segundo cronista e guarda-mor da Torre do Tombo, Gomes Eanes de Zurara, notabilizou-se pela produção de crônicas acerca da conquista e manutenção da praça de Ceuta no século XV. Com a finalidade de explorar as impressões desse cronista, o presente trabalho abordará como Zurara fez um uso edificante de duas de suas fontes: o discurso do conde D. Pedro de Meneses e um reportatio do sermão do fr. João Xira. Mais precisamente, o alvo deste estudo é examinar em que (...) medida Zurara reproduziu as palavras dessas célebres figuras na expectativa de legitimar a incursão militar da Coroa no norte da África. Com ênfase na descrição do referido oficial da Torre do Tombo, o alvo consistirá em analisar a função da prédica de um religioso e de um cavaleiro para a exortação dos portugueses enviados a essa região em um período de fortalecimento das bases políticas e religiosas de Portugal. Nossa intenção é explicitar a noção de juízo em Hannah Arendt, partindo da legitimidade como contexto de problematização e tomando a finitude humana como horizonte de tematização. Nosso principal argumento é o de que em Arendt o juízo é concebido como político e o gosto é o modelo do seu modus operandi. Essa concepção é fruto da recepção arendtiana da Terceira Crítica, a Crítica da Faculdade do Juízo, de Kant. Finalmente, se trazarán los cimientos para una revalorización crítica de la interpretación de sexto Empírico y se argumentará que la alegoría platónica (...) del carro alado como símbolo de la se halla motivada por la ambigüedad intrínseca del relato, ambigüedad que tiene por objeto mostrar la unidad real de los contrarios aparentes a través del símbolo de las doncellas hijas del sol.: This paper will outline several guiding principles concerning a comprehensive interpretation of Parmenides' proem through the analysis of one of its essential elements: the daughters of the Sun. After examining the actions they perform throughout the narrative and in order to defend an allegorical interpretation of them, some features of the archaic allegorical activity will be defined by the analysis of some examples. Finally, we will trace the foundations for a critical reappraisal of Sextus Empiricus' interpretation and we will argue that Plato's allegory of the "winged chariot" as a symbol of the ψυχή in the Phaedrus could well be closely recreating and evoking the Parmenidean myth of the proem. The hermeneutic disjunction may be motivated by the intrinsic ambiguity of the narration, an ambiguity intended to show the real unity of apparent opposites by using the symbol of the daughters of the Sun. É bem conhecida a divergência entre as posições de Gottlob Frege e Bertrand Russell com relação ao tratamento semântico dado a sentenças contendo termos singulares indefinidos, ou seja, termos singulares sem referência ou com referência ambígua, tais como ‘Papai Noel’ ou ‘o atual rei da França’ ou ‘1/0 ’ ou ‘√4’ ou ‘o autor de Principia Mathematica’. Para Frege, as sentenças da linguagem natural que contêm termos indefinidos não formam declarações e portanto não são nem verdadeiras nem falsas. Já para (...) as sentenças da matemática, Frege defende que elas precisam ser corrigidas através da convenção forçada de uma referência não ambígua. Russell, por outro lado, aceita os termos indefinidos e propõe, através de sua teoria das descrições definidas, uma maneira de avaliar as sentenças em que eles ocorrem; e Quine amplia a teoria de Russell para abranger também os nomes com problemas de referência. Na prática da matemática são comuns os termos singulares indefinidos, sem referência, tais como ‘1/0 ’, ou com referência ambígua, tais como ‘√4’. Apesar de não haver uma sistematização rigorosa desta situação entre os matemáticos, há, no entanto, um conjunto de regras convencionais que tradicionalmente costumam ser aplicadas no tratamento matemático dos termos indefinidos. Nossa proposta é tomar a convenção matemática como inspiração e modelo para apresentar uma interpretação semântica formal para as descrições definidas e os nomes e utilizá-la como um argumento que favorece a abordagem de Russell relativamente à de Frege. A disciplina Filosofia no ensino secundário/médio brasileiro apresenta um movimento de intermitência caracterizado ora pela presença garantida, ora pela presença indefinida e ora pela ausência garantida, tal como define Dalton José Alves. Analisar esse fenômeno pela perspectiva da história das disciplinas escolare,s sob a compreensão de Chervel e Goodson, foi o objetivo deste trabalho. Para a investigação utilizou-se como fontes as leis de reformas do ensino secundário brasileiro, os programas da disciplina e a distribuição da carga horária destinada ao (...) seu ensino determinadas pelas reformas. Concluiu-se que essa intermitência foi favorecida pelas políticas governamentais liberais de cunho desenvolvimentista, pela ausência de um corpus academicus que sustentasse a Filosofia enquanto disciplina na Educação Básica brasileira e pela aparente inadequação do saber filosófico à proposta da escola moderna. Este trabalho identifica a realidade da produção do conhecimento stricto sensu em Educação Física de professores que trabalham em cursos de formação no estado da Bahia – 1982 a 2012 –, em vista as determinações históricas e epistemológicas. É parte da pesquisa em rede EPISTEFNORDESTE. Fonte de dados/informações: 142 produções stricto sensu e 5 PNPG. A metodologia tem base dialética. Resultados apontam que os PNPG, alicerçados na lógica do modo de produção capitalista, geram produções que encerram limites lógicos que são (...) entraves para o avanço da área de Educação Física na construção de uma consistente base teórica que responda aos reais problemas que a área vem impondo historicamente. Este artigo examina a concepção de História Natural de Francis Bacon a partir de sua relação com literatura cética discutida no século XVI. Mais exatamente, procura mostrar que essa obra representa uma radicalização de uma tendência naturalista presente no tratamento cético da noção de “milagre”, tal como reconhecível no De Divinatione, de Cícero, e nos Ensaios de Montaigne, dentre outras obras.

Turing’s much debated test has turned 70 and is still fairly controversial. His 1950 paper is seen as a complex and multilayered text, and key questions about it remain largely unanswered. Why did Turing select learning from experience as the best approach to achieve machine intelligence? Why did he spend several years working with chess playing as a task to illustrate and test for machine intelligence only to trade it out for conversational question-answering in 1950? Why did Turing refer to (...) gender imitation in a test for machine intelligence? In this article, I shall address these questions by unveiling social, historical and epistemological roots of the so-called Turing test. I will draw attention to a historical fact that has been only scarcely observed in the secondary literature thus far, namely that Turing’s 1950 test emerged out of a controversy over the cognitive capabilities of digital computers, most notably out of debates with physicist and computer pioneer Douglas Hartree, chemist and philosopher Michael Polanyi, and neurosurgeon Geoffrey Jefferson. Seen in its historical context, Turing’s 1950 paper can be understood as essentially a reply to a series of challenges posed to him by these thinkers arguing against his view that machines can think. Turing did propose gender learning and imitation as one of his various imitation tests for machine intelligence, and I argue here that this was done in response to Jefferson's suggestion that gendered behavior is causally related to the physiology of sex hormones. The Turing test has been studied and run as a controlled experiment and found to be underspecified and poorly designed. On the other hand, it has been defended and still attracts interest as a test for true artificial intelligence (AI). Scientists and philosophers regret the test’s current status, acknowledging that the situation is at odds with the intellectual standards of Turing’s works. This article refers to this as the Turing Test Dilemma, following the observation that the test has been under (...) discussion for over seventy years and still is widely seen as either too bad or too good to be a valuable experiment for AI. An argument that solves the dilemma is presented, which relies on reconstructing the Turing test as a thought experiment in the modern scientific tradition. It is argued that Turing’s exposition of the imitation game satisfies Mach’s characterization of the basic method of thought experiments and that Turing’s uses of his test satisfy Popper’s conception of the critical and heuristic uses of thought experiments and Kuhn’s association of thought experiments to conceptual change. It is emphasized how Turing methodically varied the imitation game design to address specific challenges posed to him by other thinkers and how his test illustrates a property of the phenomenon of intelligence and suggests a hypothesis on machine learning. This reconstruction of the Turing test provides a rapprochement to the conflicting views on its value in the literature. (shrink)

Political theory is a field that finds nourishment in others. From economics, history, sociology, psychology, and political science, theorists have drawn a rich repertoire of schemas to parse the social world and make sense of it. With each of these encounters, new subjects are brought into focus as others recede into the background, ushering a change not only in how questions are tackled but also in what questions are thought worth asking.

I propose an idealist ontology that makes sense of reality in a more parsimonious and empirically rigorous manner than mainstream physicalism, bottom-up panpsychism, and cosmopsychism. The proposed ontology also offers more explanatory power than these three alternatives, in that it does not fall prey to the hard problem of consciousness, the combination problem, or the decombination problem, respectively. It can be summarized as follows: there is only cosmic consciousness. We, as well as all other living organisms, are but dissociated alters (...) of cosmic consciousness, surrounded by its thoughts. The inanimate world we see around us is the extrinsic appearance of these thoughts. The living organisms we share the world with are the extrinsic appearances of other dissociated alters. (shrink)

This book is a three-part journey into the rabbit hole we call the nature of reality. Its ultimate destination is a plausible, living validation of transcendence. Each of its three parts is like a turn of a spiral, exploring recurring ideas through the prisms of religious myth, truth and belief, respectively. With each turn, the book seeks to convey a more nuanced and complete understanding of the many facets of transcendence. Part I puts forward the controversial notion that many religious (...) myths are actually true; and not just allegorically so. Part II argues that our own inner storytelling plays a surprising role in creating the seeming concreteness of things and the tangibility of history. Part III suggests, in the form of a myth, how deeply ingrained belief systems create the world we live in. In this paper I argue that, to conceive transcendence, Levinas retrieves the Platonic concept of “separation” and deploys it in three ways: metaphysically, semantically, and affectively. Levinas finds in the interaction between being and the Good beyond being of Republic VI 509b a certain “formal structure of transcendence”—one in which a term is conditioned by another while remaining absolutely separated from it. This formal structure is subsequently deployed metaphysically, in the relation between creator and creature; semantically, in the relation between (...) meaning and sense; and affectively, in the relation between the desiring self and its desired aim. Several alternatives vie today for recognition as the most plausible ontology, from physicalism to panpsychism. By and large, these ontologies entail that physical structures circumscribe consciousness by bearing phenomenal properties within their physical boundaries. The ontology of idealism, on the other hand, entails that all physical structures are circumscribed by consciousness in that they exist solely as phenomenality in the first place. Unlike the other alternatives, however, idealism is often considered implausible today, particularly by analytic philosophers. A reason for this (...) is the strong intuition that an objective world transcending phenomenality is a self-evident fact. Other arguments—such as the dependency of phenomenal experience on brain function, the evidence for the existence of the universe before the origin of conscious life, etc.—are also often cited. In this essay, I will argue that these objections against the plausibility of idealism are false. As such, this essay seeks to show that idealism is an entirely plausible ontology. (shrink)

I argue for an idealist ontology consistent with empirical observations, which seeks to explain the facts of nature more parsimoniously than physicalism and bottom-up panpsychism. This ontology also attempts to offer more explanatory power than both physicalism and bottom-up panpsychism, in that it does not fall prey to either the ‘hard problem of consciousness’ or the ‘subject combination problem’, respectively. It can be summarized as follows: spatially unbound consciousness is posited to be nature’s sole ontological primitive. We, as well as (...) all other living organisms, are dissociated alters of this unbound consciousness. The universe we see around us is the extrinsic appearance of phenomenality surrounding—but dissociated from—our alter. The living organisms we share the world with are the extrinsic appearances of other dissociated alters. As such, the challenge to artificially create individualized consciousness becomes synonymous with the challenge to artificially induce abiogenesis. (shrink)

Departing from Anderson’s (2016) suggestion that there are three communities in Peirce’s thought corresponding to his three normative sciences of logic, ethics, and esthetics, I argue that these communities partake in a relationship of dependence similar to that found among the normative sciences. In this way, just as logic relies on ethics which relies on esthetics, so too would a logical community of inquirers rely on an ethical community of love, which would rely on an esthetic community of artists. A (...) community could conduct inquiry together only if it pursued the same goal; and it could pursue the same goal only if it first imaginatively construed it. Any logical or ethical community requires a shared imaginative repertoire of ideal ends. (shrink)

Although Hegel is increasingly recognized as an important figure in the history of political economy, his economic views are never strictly economic. In contrast to other modern thinkers, his primary concern is not the economic efficacy of different practices or institutions but the extent to which they enable and promote the development of human freedom. In this article, I argue that Hegel's pioneering critique of modern liberal economy plays out simultaneously at a more empirical level, corresponding to the properly economic (...) dimension of his analysis, and at a deeper, logical level, which grounds and guides his position. Moreover, I argue that the tendency to favour the first of these levels, found in most of the literature on Hegel's economic thought, reduces the Philosophy of Right's main argument to a more or less vigorous plea for economic interventionism. Against this kind of reading, I show that a renewed focus on the text's logical structure reveals a different and more radical philosophical proposition, which has yet to be fully acknowledged. In particular, I argue that Hegel's dialectical logic leads him beyond the liberalism‐interventionism debate, towards a qualitatively different conception of social and economic relations. (shrink)

The present framing of the cultural debate in terms of materialism versus religion has allowed materialism to go unchallenged as the only rationally-viable metaphysics. This book seeks to change this. It uncovers the absurd implications of materialism and then, uniquely, presents a hard-nosed non-materialist metaphysics substantiated by skepticism, hard empirical evidence, and clear logical argumentation. It lays out a coherent framework upon which one can interpret and make sense of every natural phenomenon and physical law, as well as the modalities (...) of human consciousness, without materialist assumptions. According to this framework, the brain is merely the image of a self-localization process of mind, analogously to how a whirlpool is the image of a self-localization process of water. The brain doesn’t generate mind in the same way that a whirlpool doesn’t generate water. It is the brain that is in mind, not mind in the brain. Physical death is merely a de-clenching of awareness. A broad pattern of correlations between mechanisms of brain function impairment and self-transcendence is shown. The pattern includes such mechanisms as cerebral hypoxia, physiological stress, transcranial magnetic stimulation, trance-induced physiological effects, the action of psychoactive substances and even physical trauma to the brain. In all these cases, subjects report self-transcending experiences o en described as ‘mystical’ and ‘awareness-expanding,’ as well as self-transcending skills o en described as ‘savant.’ The idea that these correlations could be rather trivially accounted for on the (...) basis of disruptions to inhibitory neural processes is reviewed and shown to be implausible. Instead, this paper suggests that an as-of-yet unrecognized causal principle underlying the entire pattern might be at work, whose further elucidation through systematic research could hold great promise. Depth psychology finds empirical validation today in a variety of observations that suggest the presence of causally effective mental processes outside conscious experience. I submit that this is due to misinterpretation of the observations: the subset of consciousness called “meta-consciousness” in the literature is often mistaken for consciousness proper, thereby artificially creating space for an “unconscious.” The implied hypothesis is that all mental processes may in fact be conscious, the appearance of unconsciousness arising from our dependence on self-reflective introspection for (...) gauging awareness. After re-interpreting the empirical data according to a philosophically rigorous definition of consciousness, I show that two well-known phenomena corroborate this hypothesis: (a) experiences that, despite being conscious, aren’t re-represented during introspection; and (b) dissociated experiences inaccessible to the executive ego. If consciousness is inherent to all mentation, it may be fundamental in nature, as opposed to a product of particular types of brain function. (shrink)

The Idea of the World offers a grounded alternative to the frenzy of unrestrained abstractions and unexamined assumptions in philosophy and science today. This book examines what can be learned about the nature of reality based on conceptual parsimony, straightforward logic and empirical evidence from fields as diverse as physics and neuroscience. It compiles an overarching case for idealism - the notion that reality is essentially mental - from ten original articles the author has previously published in leading academic journals. (...)
