When are psychologists entitled to call a certain theoretical construct "consciousness?" Over the past few decades cognitive psychologists have reintroduced almost the entire conceptual vocabulary of common sense psychology, but now in a way that is tied explicitly to reliable empirical observations, and to compelling and increasingly adequate theoretical models. Nevertheless, until the past few years most cognitive psychologists and neuroscientists avoided dealing with consciousness. Today there is an increasing willingness to do so. But is "consciousness" different from other theoretical (...) entities like "working memory" or "mental imagery"? Some argue that under no circumstances can empirical science speak of consciousness as such, while others claim that the scientific goal is "knowing what it is like to be a bat" --- to share an organism's conscious experience . The Bat Criterion is ominously reminiscent of the protracted debate on the consciousness of ants and amoebas that caused so much uneasiness in psychology around 1900. It seems to demand that we first solve the mind-body problem as a condition of doing sensible science, and thereby creates the risk of endless, fruitless controversy. The endless philosophical debate about consciousness helped trigger the Behaviorist revolution about 1913, which threw out the baby of consciousness with the bathwater of perennial, circular debate. We've been that way; let's not go back to it. This paper maintains that the position of behavioristic denial is far too restrictive, but that the Bat Criterion is far too demanding --- that in fact, we only need to specify comparable pairs of psychological phenomena that differ only in the fact that one member of any pair is conscious, while the other is not. This "method of contrastive analysis" is a generalization of the experimental method, with consciousness as a variable whose interaction with other psychological and biological phenomena can be assessed in standard ways. As usual in science, this strategy is pragmatic: If it appears to yield sensible results, it can be a stepping-stone toward further understanding . This paper describes five sets of well-established pairs of phenomena that meet these criteria. Others are presented elsewhere, with more of a theoretical interpretation . Here I simply want to show that any adequate theory of conscious experience must satisfy these demanding but achievable empirical constraints. (shrink)

D’un point de vue patrimonial, le célèbre texte des Éléments de géométrie de Clairaut, publié la première fois en 1741, est traditionnellement considéré comme le début d’une riche histoire plutôt que son aboutissement, en raison notamment du succès considérable qu’il a eu dès sa parution et de la manière dont Clairaut en a défendu le projet, en rupture apparente avec le modèle euclidien. Nous proposons ici une image un peu différente qui s’appuie sur la nature très particulière de la production (...) géométrique foisonnante dans laquelle le traité de Clairaut s’insère et doit être compris. Nous présentons tout d’abord le côté paradoxal de l’ouvrage, qui revendique non seulement une grande originalité mais aussi une non moins grande conformité au genre des « éléments » de géométrie spéculative. Nous indiquons ensuite cinq raisons majeures qui montrent que le texte était en effet largement conforme aux attendus de l’époque, y compris dans sa revendication d’accessibilité et de rupture vis-à-vis du modèle euclidien. Nous dégageons deux originalités de l’ouvrage : le fait de confondre les caractéristiques des géométries spéculatives et pratiques dans un seul et même ouvrage ; et le fait d’écrire un ouvrage de géométrie suivant un « ordre analytique », mais sans algèbre. This article is partly an exercise in academic autobiography, seeking to make sense of the different ways in which I have applied semiotics to secular law on the one hand, Jewish law on the other. The very fact that it can be applied to both shows that its claims are methodological. But it also indicates a possible reformulation of the semiotic issues in philosophical terms: we may view the relationship between the semantic and pragmatic levels in terms of the relationship/balance (...) between certainty/truth (the semantic level) on the one hand and trust (the pragmatic level) on the other. What may distinguish the secular and religious systems is the manner in the issue of trust is be ideologically concealed. (shrink)

I discuss donald davidson's argument for the psycho-Physical identity theory and contend that it fails: it relies on an implausible account of mental and physical events. Davidson proposes a linguistic test for determining whether a given event is mental or physical. I argue that the assumptions that are necessary for employing such a criterion of the mental are either false or presuppose the truth of the identity theory.

This paper is a reading of Aristotle's book on justice (Book V of the Ethics) as what he says it is, a study of the disposition or inclination towards doing just (or unjust) acts. In that light, the content of Aristotle's famous treatments of distributive and corrective justice are only incidental, for their true role is as clues to a meaningful picture of the Just and the Unjust person. Aristotle's treatment of Being Just as a specific virtue is the most (...) detailed treatment he offers of any moral virtue. Being Just as distributive justice emerges as a commitment to the equal treatment of all citizens, but to an equality tempered by always contentious considerations of merited reward. Being Just as corrective justice is a commitment to protecting and repairing the sphere of each person's dignity and opportunity from damaging and sometimes malicious interactions. But more is required. For Being Just means overcoming the disordered and misdirected desire that both Aristotle and Plato call "pleonexia", wanting - tyrant-like - more-of-and-more-than. If that is overcome by re-directed libido, the virtuous will then have to integrate more subtle elements if they are to achieve an inclination to this tempered, but real equality. These elements are two. One is present only implicitly, the passion Aristotle calls nemesis, a demand that the world - and justice within the world - must never permit an evil person to go unpunished or a good one, to suffer harm. That passion cannot be admitted, but at best can only be temporarily stilled. The second impediment arises from the dynamic of human communities that are made up of diverse and actively striving individuals: such citizens, haunted by suspicion grounded in their own pleonexia, demand that the community be one of laws. That creates a true dilemma, for in Aristotle's estimation, no set of rules can cabin any virtue. The Rule of Law is in tension with the particularity of justice in real life, and that tension is ultimately only bearable through the invention of equity, the trusted deviation from the law to preserve the law. In making this abstract I have had to leave untouched the subject matter of the first and two last chapters, but in my paper I do treat these. More importantly, I also show how all political community and the inclination to seek to be a Just Person rests on a gracious act of reciprocal commitment. (shrink)

This dissertation studies how Aristotle understands and justifies his Rhetorical Art. It proceeds by explicating the Art in its intellectual context. Rhetoric emerges as a dynamic investigation of human affairs working through the "given" in speech and thought to a plausible account, while giving consideration to the opinions and characters of both speaker and audience within the horizon of a particular occasion. The basic dynamic determines a structure which is comparable to Socrates' requirements in the Phaedrus. That this is the (...) structure and dynamic is supported by considering the fundamentally contingent nature of human experience, understanding the inference types , common sense principles and starting points by which such experience is explicated, and placing such experience in three mutually exclusive genres. Aristotle's art is essentially the resulting plausible account while actual composition is supplementary. ;Aristotle limits the art by reference to dialectic and ethical life. When it is seen that Aristotle's Organon is not a science of logic and the Posterior Analytics is a rarely applicable mode of presentation, the point of dialectic becomes accessible. It too involves strenuous grappling with speech and thought, but its highest purpose lies in peirastic. Peirastic and sophistry are uses of dialectic which have a contrasting moral color. Peirastic aims at the discovery of ignorance and, at the same time, the difference between accident and essence and knowledge and opinion: Being educated is essentially knowing what one does not know. ;What Socrates only alludes to as political art, Aristotle attempts to expound as praxis perfected into phronesis. Even Aristotle does no more than suggest the nature of phronesis negatively as simultaneously a seeking, a finding and an act which is both self-determination and self-knowledge, and none of these separately; it is profoundly disruptive of existing opinion and most clearly to be seen in the rejection of the laws and rules upon which, as deliberation, it is dependent. The Art differs from Gorgias' rhetoric in its emphasis on the plausible and in its subordination to an ethical self-determination that gains the weight of experience appropriated by intelligence and virtue. After a section of Methodological Preliminaries, I consider Truth and Argumentation in the Jewish Legal Tradition, under the following subheadings: Truth in Judaism, Truth and Norms, Truth and Language, Truth and Logic, Truth and Argumentation. I thus use an external framework in order to pose questions to the Jewish legal tradition, and identify internal resources which may provide partial answers to these questions. But are these partial answers so peculiar, theological, culturally contingent as to lack any value in terms of (...) a potential contribution to these same issues as posed within Western jurisprudence? This may be doubted, given the West’s adoption or construction of the divine right of kings on the one hand and of holistic theories of interpretation on the other, derived from the Bible and later Jewish tradition, mediated and fortified through a Christianised Rome.
