In lieu of an abstract, here is a brief excerpt of the content:Conquest and English Legal Identity in Renaissance IrelandBrian LockeyLike the Spanish administrators of the American territories, English administrators of Ireland attempted to impose their own native legal system on the Irish inhabitants. Nonetheless, important differences existed between the two kingdoms' legal approaches to their respective colonial contexts. Because Spanish jurisprudence was allied with universalist Catholic doctrine and was officially based on Justinian's Corpus Iuris Civilis (the ancient Roman legal (...) code which had close affinities to natural law discourse), Spanish administrators expected New World inhabitants to accept what they considered to be the "universal values" that were inherent in Spanish law.1 In contrast English common law had its roots not in natural law but in the peculiar customs of the English people. Thus, while the Spanish were able to claim that they were replacing unnatural Indian customs with a legal system rooted in universal natural law, the English were attempting to reform what they considered to be the unnatural practices of the Irish by imposing a legal system defined by its insularity and its peculiar affinity with English institutions.2 In this essay I show that Renaissance ethnographies on Ireland by such English administrators of Ireland as Edmund Spenser, Sir John Davies, and Fynes Moryson are fractured by a conflict between a commitment to natural-law theory, which had its origin in continental writings, and a corresponding commitment to the native English tradition of common law. I examine how works by Spenser, Davies, and Moryson dealt with this conflict within their collective project of articulating a legal justification and strategy for the pacification of Ireland. [End Page 543]Despite reports throughout Europe of Spanish-perpetrated cruelty throughout the Americas, the idea that war or conquest could be just or even charitable when prosecuted against oppression originated within the Catholic tradition of scholastic just-war theory.3 Many of the sixteenth-century writers who were writing about war and conquest in legal or ethical terms were Spanish or continental theologians who had attempted to evaluate Spanish imperial policy in the New World. On the one side were such figures as the Scottish theologian John Major and Spanish historian Juan Ginés de Sepúlveda, both of whom had justified Spanish conquest and treatment of the Indians using arguments based on the foundation of natural law.4 On the other side were those who had, on similar terms, voiced criticisms of the cruelties which Spanish forces were inflicting on the Indians. A serious attempt to integrate ethics in management was done by Professor Juan Antonio Pérez López (1934–1996). His thought represents a break with current scholarly thinking on these subjects. The purpose of this article is to explain some of the most significant aspects of his theories, relating basically to his recourse to ethics as what defines the characteristic behavior of human beings, considered as individuals and as members of organizations. Pérez López used the anthropological conception underlying the ethics of (...) Aristotle and Thomas Aquinas to build a solid base for that ethics, starting from the decision-making process. The somatic mutation theory has been the prevailing paradigm in cancer research for the last 50 years. Its premises are: (1) cancer is derived from a single somatic cell that has accumulated multiple DNA mutations, (2) the default state of cell proliferation in metazoa is quiescence, and (3) cancer is a disease of cell proliferation caused by mutations in genes that control proliferation and the cell cycle. From this compelling simplicity, an increasingly complicated picture has emerged as more than 100 (...) oncogenes and 30 tumor suppressor genes have been identified. To accommodate this complexity, additional ad hoc explanations have been postulated. After a critical review of the data gathered from this perspective, an alternative research program has been proposed. It is based on the tissue organization field theory, the premises of which are that carcinogenesis represents a problem of tissue organization, comparable to organogenesis, and that proliferation is the default state of all cells. I examine the current state of the debate on the metaphysics of science. In 1, I identify some of the main questions belonging to the MS, looking into the relationship between science and metaphysics. In 2, I expound the rise of the old wave in the MS, which endorses the belief that metaphysics is a guide to, or a heuristic for, science and outlines the stronger idea that metaphysics makes science possible. In 3, I examine the maximalist MS. This is (...) a contemporary revival of the old wave, reformulating the claim that metaphysics makes science possible. In 4, I look into the new wave in the MS, which argues that science is a guide to metaphysics and, more radically, that metaphysics is to be motivated by, and restricted to, science. In 5, I briefly introduce my own minimalist MS, which contends that science sets the epistemic, methodological and ontological criteria which should work as desiderata of the MS. A statement of hyperarithmetic analysis is a sentence of second order arithmetic S such that for every Y⊆ω, the minimum ω-model containing Y of RCA0 + S is HYP, the ω-model consisting of the sets hyperarithmetic in Y. We provide an example of a mathematical theorem which is a statement of hyperarithmetic analysis. This statement, that we call INDEC, is due to Jullien [13]. To the author's knowledge, no other already published, purely mathematical statement has been found with this property (...) until now. We also prove that, over RCA0, INDEC is implied by [Formula: see text] and implies ACA0, but of course, neither ACA0, nor ACA 0+ imply it. We introduce five other statements of hyperarithmetic analysis and study the relations among them. Four of them are related to finitely-terminating games. The fifth one, related to iterations of the Turing jump, is strictly weaker than all the other statements that we study in this paper, as we prove using Steel's method of forcing with tagged trees. Antonio Negri, one of the world's leading scholars on Baruch Spinoza (1632-1677) and his contemporary legacy, offers a straightforward explanation of the philosopher's elaborate arguments and a persuasive case for his ongoing relevance. Responding to a resurgent interest in Spinoza's thought and its potential application to contemporary global issues, Negri demonstrates the thinker's special value to politics, philosophy, and related disciplines. Negri's work is both a return to and an advancement of his initial affirmation of Spinozian thought in _The (...) Savage Anomaly_. He further defends his understanding of the philosopher as a proto-postmodernist, or a thinker who is just now, with the advent of the postmodern, becoming contemporary. Negri also connects Spinoza's theories to recent trends in political philosophy, particularly the reengagement with Carl Schmitt's "political theology," and the history of philosophy, including the argument that Spinoza belongs to a "radical enlightenment." By positioning Spinoza as a contemporary revolutionary intellectual, Negri addresses and effectively defeats twentieth-century critiques of the thinker waged by Jacques Derrida, Alain Badiou, and Giorgio Agamben. This article elaborates local selective realism in view of the shifting from classical to quantum electrodynamics. After some introductory remarks, we critically address what we call global selective realism, hence setting forth the background for outlining local selective realism. When examining the transition from classical to quantum electrodynamics, we evaluate both continuities and discontinuities in observational features, mathematical structures, and ontological presuppositions. Our argument leads us to criticise the narrow understanding of limiting-case strategies, and to reject the claim that we (...) need a fully coherent theoretical framework to account for the transition from one theory to its successor in the case of electrodynamics. El principal supuesto del texto considera la imposibilidad de un análisis conceptual acerca de la democracia que no incluya en su discusión la tensión entre la posición y ejercicio de la ciudadanía implicada y demandante en este proceso. El análisis propuesto confronta los imaginarios hegemónicos instituidos en la postdictadura con los imaginarios instituyentes que (...) emergen de los movimientos secundarios por la defensa de la educación pública en la ciudad de Valparaíso. Estos imaginarios se expresan en formas de organización en la esfera pública, por medio de la función que ejerce el imaginario radical, que impugnan la construcción de una ciudadanía capturada y una democracia tutelada. This article focuses on the relationship between the categories of democracy and citizenship in Valparaíso during the last post-dictatorship decade from a critical perspective. The main assumption of the text relates to the impossibility of conceptual analysis on democracy without including in its discussion the tension between the position and the exercise of the demanding, involved citizenship in this process. The proposed analysis brings face to face the hegemonic imaginaries established during the post-dictatorship period and the establishing imaginaries that arise from the secondary school movements for defending public education in Valparaiso. These imaginaries are expressed in forms of organization within the public circle, through the role that plays the radical imaginary, which challenge the construction of a captured citizenship and a democracy under custody. For the last 50 years the dominant stance in experimental biology has been reductionism in general, and genetic reductionism in particular. Philosophers were the first to realize that the belief that the Mendelian genes were reduced to DNA molecules was questionable. Soon, experimental data confirmed these misgivings. The optimism of molecular biologists, fueled by early success in tackling relatively simple problems has now been tempered by the difficulties encountered when applying the same simple ideas to complex problems. We analyze three (...) examples taken from experimental data that illustrate the shortcomings of this sort of reductionism. In the first, alterations in the expression of a large number of genes coexist with normal phenotypes at supra-cellular levels of organization; in the second, the supposed intrinsic specificity of hormonal signals is negated; in the third, the notion that cancer is a cellular problem caused by mutated genes is challenged by data gathered both from the reductionist viewpoint and the alternative view proposing that carcinogenesis is development gone awry. As an alternative to reductionism, we propose that the organicist view is a good starting point from which to explore these phenomena. However, new theoretical concepts are needed to grapple with the apparent circular causality of complex biological phenomena. (shrink)

We advance a framework for an inferential conception of physical laws, addressing the problem of the application of mathematical structures to the relevant structure of physical domains. Physical laws, we argue, express generalizations that work as rules for deriving physically informative inferences about their target systems, hence guiding us in our interaction with various domains. Our analysis of the application of mathematics to the articulation of physical laws follows a threefold scheme. First, we examine the immersion of the relevant structure (...) of physical domains into mathematical structures. Second, we assess the inferential power of laws resulting from the mathematical formalism employed in the immersion step. And third, we provide a suitable physical interpretation for the extant mathematical structures obtained from the inferential step. We demonstrate that a deflationary, empiricist framework for an inferential conception of physical laws delivers both an understanding of the mathematical character of physical laws, and a way of responding to some of the standard philosophical riddles associated with laws. This article elaborates the epistemic indispensability argument, which fully embraces the epistemic contribution of mathematics to science, but rejects the contention that such a contribution is a reason for granting reality to mathematicalia. Section 1 introduces the distinction between ontological and epistemic readings of the indispensability argument. Section 2 outlines some of the main flaws of the first premise of the ontological reading. Section 3 advances the epistemic indispensability argument in view of both applied and pure mathematics. And Sect. 4 (...) makes a case for the epistemic approach, which firstly calls into question the appeal to inference to the best explanation in the defense of the indispensability claim; secondly, distinguishes between mathematical and physical posits; and thirdly, argues that even though some may think that inference to the best explanation works in the postulation of physical posits, no similar considerations are available for postulating mathematicalia. This paper examines accounts of the moral wrongness of killing persons in addition to determining what conclusions, if any, can be drawn from the morality of killing persons about the equality of persons, and vice versa. I will argue that a plausible way of thinking about the moral wrongness of killing implies that the permissibility of killing innocent, nonthreatening persons depends on a person’s age. I address objections to this conclusion and discuss some potential implications of the view.

ABSTRACT This article addresses the prospects of applied naturalistic metaphysics from both a global and a local perspective. Adopting a broad Sellarsian approach, I look into whether metaphysics has a place and role in the overall scientific image and assess whether it has its own subject matter as a first- or second- order discipline. After outlining the general argument in section 1, section 2 examines our construal of science and metaphysics, drawing some considerations for restating the question about the viability (...) of naturalistic metaphysics. Sections 3 and 4, in turn, suggest two styles of naturalistic metaphysics that can be respectively applied on a global and on a local basis. I briefly outline their respective goals, problems and categories. I argue, in particular, that globally applied naturalistic metaphysics deals with issues about the fundamental structure of reality, whereas locally applied naturalistic metaphysics tackles riddles arising from the examination of specific unobservable posits in the frontiers of scientific ontology. Section 5 closes with concluding remarks that put metaphysics within the scientific image. (shrink)

We routinely speak of Newton’s laws in classical mechanics without really knowing how Newton understood such laws. This article clarifies some of the ontological, epistemological, and theological presuppositions underpinning his conception of the laws of nature. After introducing the Cartesian background (2), we examine the Newtonian view of laws of nature in three respects, namely: the character of laws of nature in the context of the rules for natural philosophy (3); the emanative conception of space and time in _De Gravitatione_; (...) El artículo presenta la relación compleja, entre aceptación y rechazo, que María Zambrano, pensadora española discípula de José Ortega y Gasset, Premio Cervantes de Literatura, tuvo con la filosofía. Se argumenta que esta relación es heterodoxa, pues cuestionó, por un lado, la relación de la filosofía dominante con la vida, especialmente la manera en que el saber filosófico se desconectó de la misma, dejando al hombre desamparado; y, por el otro, cuestionó, como Nietzsche, el sistema filosófico como forma predominante de (...) expresión filosófica, acusándolo, de paso, de ocultar otras formas en que históricamente se ha hecho filosofía. Estas tensiones con la filosofía la llevaron a asumir una relación personal, una actitud libre con las corrientes filosóficas, donde lo importante no es tanto la coherencia misma de las filosofías sino aquello que le pueden decir a la vida misma.
