En este artículo se sostiene que existe una primacía de la práctica y la acción sobre el conocimiento intelectual y la contemplación. Si esta tesis fuese falsa, no resulta comprensible por qué la prudencia y el hombre prudente son la virtud suprema y el modelo de la vida buena en Aristóteles. La cuestión inicial es 1) ¿Cómo entender la racionalidad del deseo o qué significa deseo razonado?, y esto implica dos cuestiones adicionales: 2) ¿Qué es el silogismo práctico y qué (...) relación tiene con la recta razón? y 3) ¿cuál es la relación entre el razonamiento práctico, la prudencia y el hombre prudente? Estas cuestiones son analizadas para establecer algunas de las semejanzas y diferencias entre el silogismo práctico , los diversos tipos de inferencias prácticas y otros tipos de razonamientos, tratando de mostrar la relación que existe entre la formación del carácter o modo de ser, la recta razón y el silogismo práctico. This paper argues that “free will” is vague. The argument has two steps. First, I argue that free will is a matter of degrees and, second, that there are no sharp boundaries separating free decisions and actions and non‐free ones. After presenting the argument, I focus on one significant consequence of the thesis, although others are mentioned along the way. In short, considerations of vagueness help understand the logic behind so‐called manipulation arguments, but also show why these arguments are ultimately (...) flawed. (shrink)

This book explores the relevance of virtue theory to law from a variety of perspectives. The concept of virtue is central in both contemporary ethics and epistemology. In contrast, in law, there has not been a comparable trend toward explaining normativity on the model of virtue theory. In the last few years, however, there has been an increasing interest in virtue theory among legal scholars. 'Virtue jurisprudence' has emerged as a serious candidate for a theory of law and adjudication. Advocates (...) of virtue jurisprudence put primary emphasis on aretaic concepts rather than on duties or consequences. Aretaic concepts are, on this view, crucial for explaining law and adjudication. This book is a collection of essays examining the role of virtue in general jurisprudence as well as in specific areas of the law. Part I puts together a number of papers discussing various philosophical aspects of an approach to law and adjudication based on the virtues. Part II discusses the relationship between law, virtue and character development, with some of the essays selected analysing this relationship by combining both eastern perspectives on virtue and character with western approaches. Parts III and IV examine problems of substantive areas of law, more specifically, criminal law and evidence law, from within a virtue-based framework. Last, Part V discusses the relevance of empathy to our understanding of justice and legal morality. (shrink)

In this paper, I focus on an influential account of phenomenal concepts, the recognitional account, and defend it from some recent challenges. According to this account, phenomenal concepts are recognitional concepts that we use when we recognize experiences as “another one of those.” Michael Tye has argued that this account is viciously circular because the relevant recognitional abilities involve descriptions of the form “another experience of the same type,” which is also a phenomenal concept. Tye argues that we avoid the (...) circularity worry if we explain the reference-fixing of phenomenal concepts in terms of dispositions to re-identify tokens of the same type without appealing to any further phenomenal concepts. However, he argues, this account is incompatible with the intuitive claim that phenomenal concepts seem to involve rich modes of presentation of their referents. Philip Goff and others have similarly argued that a recognitional account of phenomenal concepts would make phenomenal concepts opaque, that is, unable to reveal anything about their referents, which seems problematic. In this paper, I present a new version of the recognitional account that avoids the circularity worry without entailing that phenomenal concepts are opaque. (shrink)

Hasta ahora, las discusiones sobre el multiculturalismo se han presentado como una revisión progresista de los límites del liberalismo en cuanto a políticas de inclusión y reconocimiento. Este artículo plantea que la recepción del multiculturalismo en Latinoamérica, si no quiere ser puramente procedimental, puede plantearse como una deconstrucción de los conceptos de Sujeto y Estado. Para ello hemos adoptado el punto de vista de comunidades étnicamente diferenciadas (que Deleuze y Guattari han categorizado como máquinas territoriales), de modo que sus relaciones (...) de poder y sus procesos de subjetivación puedan ser vistos como expresión de lo intraestatal y lo preindividual, respectivamente. Aunque esta diferencia de perspectiva se plantea, básicamente, como un diferendo entre teorías, al final se sugieren criterios para un debate más amplio sobre las relaciones entre Estado y capitalismo alrededor de las condiciones de existencia de las sociedades premodernas. The purpose of this paper is to compare disagreement in two different WhatsApp groups: one for members of the same family, and another for work colleagues. After the analysis, 427 instances of disagreement were identified in the family group, and 161 in the interactions between work colleagues. The most common strategy in both corpora is ‘Giving opposite opinions’. Nevertheless, the rest of the results present very significant dissimilarities, most notably the higher presence of disagreement in the family WhatsApp group. This (...) higher tolerance for disagreement is corroborated by the choice of linguistic strategies made. Whereas the family members tended to give emotional or personal reasons for disagreement, as well as negative comments on the topic, the colleagues preferred to express their disagreement with mitigating expressions and token agreement. Thus, in the corpora studied, the expression of disagreement seems to be less face threatening for family members than for work colleagues. (shrink)

This paper argues that habits, just like beliefs, can guide intentional action. To do this, a variety of real-life cases where a person acts habitually but contrary to her beliefs are discussed. The cases serve as dissociations showing that intentional agency is possible without doxastic guidance. The upshot is a model for thinking about the rationality of habitual action and the rationalizing role that habits can play in it. A widespread need to explain the behavior and outcomes of AI-based systems has emerged, due to their ubiquitous presence. Thus, providing renewed momentum to the relatively new research area of eXplainable AI (XAI). Nowadays, the importance of XAI lies in the fact that the increasing control transference to this kind of system for decision making -or, at least, its use for assisting executive stakeholders- already affects many sensitive realms (as in Politics, Social Sciences, or Law). The decision-making power handover to (...) opaque AI systems makes mandatory explaining those, primarily in application scenarios where the stakeholders are unaware of both the high technology applied and the basic principles governing the technological solutions. The issue should not be reduced to a merely technical problem; the explainer would be compelled to transmit richer knowledge about the system (including its role within the informational ecosystem where he/she works). To achieve such an aim, the explainer could exploit, if necessary, practices from other scientific and humanistic areas. The first aim of the paper is to emphasize and justify the need for a multidisciplinary approach that is beneficiated from part of the scientific and philosophical corpus on Explaining, underscoring the particular nuances of the issue within the field of Data Science. The second objective is to develop some arguments justifying the authors’ bet by a more relevant role of ideas inspired by, on the one hand, formal techniques from Knowledge Representation and Reasoning, and on the other hand, the modeling of human reasoning when facing the explanation. This way, explaining modeling practices would seek a sound balance between the pure technical justification and the explainer-explainee agreement. (shrink)

RESUMEN En este artículo propongo revisar las aproximaciones de Mabel Moraña y Antonio Cornejo Polar al clivaje paradigmático entre las figuras de José María Arguedas y Mario Vargas Llosa en la cultura latinoamericana. En ese marco, tanto Cornejo Polar como Mabel Moraña desarrollan, en su propio lenguaje, preguntas por los dispositivos de poder y por las estrategias de resistencia que derivan de las relaciones entre literatura y máquinas sociales planteadas por Deleuze y Guattari, en una perspectiva decolonial. Este será el (...) contenido de la primera parte. En la segunda, quisiera seguir el derrotero de Cornejo Polar en la creación del concepto de 'subjetividad heterogénea', que condensa la experiencia de la migración interna en los países andinos y está presente con especial intensidad lingüística y performativa en El zorro de arriba y el zorro de abajo, la última obra de Arguedas. ABSTRACT This article intends to review the approaches of Mabel Moraña and Antonio Cornejo Polar to the paradigmatic cleavage between the figures of José María Arguedas and Mario Vargas Llosa in Latin American culture. Within this framework, both Cornejo Polar and Mabel Moraña develop, in their own language, questions about power devices and resistance strategies derived from relationships between literature and social machines raised by Deleuze and Guattari, from a decolonial perspective. This will be the content of the first part. In the second, it would like to follow Cornejo Polar's path in creating the concept of 'heterogeneous subjectivity', which condenses the experience of internal migration in the Andean countries and is present with particular linguistic and performance intensity in El zorro de arriba y el zorro de abajo, the last work of Arguedas. Are feelings an essential part or aspect of emotion? Cases of unconscious emotion suggest that this is not the case. However, it has been claimed that unconscious emotions are better understood as either (a) emotions that are phenomenally conscious but not reflectively conscious, or (b) dispositions to have emotions rather than emotions proper. Here, I argue that these ways of accounting for unconscious emotions are inadequate, and propose a view of emotions as non-phenomenal attitudes that regard their contents as relevant (...) to one's motivations. Are emotions bodily feelings or evaluative cognitions? What is happiness, pain, or “being moved”? Are there basic emotions? In this chapter, I review extant empirical work concerning these and related questions in the philosophy of emotion. This will include both (1) studies investigating people’s emotional experiences and (2) studies investigating people’s use of emotion concepts in hypothetical cases. Overall, this review will show the potential of using empirical research methods to inform philosophical questions regarding emotion.

The metaphysics of gender and race is a growing area of concern in contemporary analytic metaphysics, with many different views about the nature of gender and race being submitted and discussed. But what are these debates about? What questions are these accounts trying to answer? And is there real disagreement between advocates of differ- ent views about race or gender? If so, what are they really disagreeing about? In this paper I want to develop a view about what the debates (...) in the metaphysics of gender and race are about, namely, a version of metaphysical deflationism, according to which these debates are about how we actually use or should use the terms ‘gender’ and ‘race’ (and other related terms), where moral and political considerations play a central role. I will also argue that my version of the view can overcome some recent and powerful objections to metaphysical deflationism of- fered by Elizabeth Barnes (2014, 2017). (shrink)

This paper defends a version of the Simple View, the claim that someone intentionally φs only if the person intends to φ. To do this, I raise a problem for Bratman’s classic argument (1984, 1987) against it. The problem brings into focus an evaluative dimension behind the View, whose recognition allows for an improved version of it. With this improved version, I then go on to answer other criticisms that have been raised to it.

In this article, I examine recent debates concerning the existence and the nature of basic actions. The discussion is structured around four theses, with which Arthur Danto introduced basic actions to contemporary theorists. The theses concern (i) the relationship between agency and causality, (ii) the distinction between basic and complex actions, (iii) the regress argument for basic actions, and (iv) the structure of practical knowledge in the light of these actions.

A recent quarrel over faultless disagreements assumes that disputes over evaluative sentences should be understood as regular, factual disagreements. Instead, I propose that evaluative disagreements should be understood in Lewisian terms. Language use works like a rule-governed game. In it, the assertion of an evaluative sentence is an attempt to establish one value as default in the conversation; its rejection, in turn, is in most cases the refusal to accept this move.

:In this essay, I present an account of forgiveness as a process of emotional distancing. The central claim is that, understood in these terms, forgiveness does not require a change in judgment. Rationally forgiving someone, in other words, does not require that one judges the significance of the wrongdoing differently or that one comes to the conclusion that the attitudes behind it have changed in a favorable way. The model shows in what sense forgiving is inherently social, shows why we (...) should be pluralists about it, and provides a basis for arguing against the existence of necessary conditions of forgiving. The aim of this essay is to develop a coherence theory for the justification of evidentiary judgments in law. The main claim of the coherence theory proposed in this article is that a belief about the events being litigated is justified if and only if it is a belief that an epistemically responsible fact finder might hold by virtue of its coherence in like circumstances. The article argues that this coherentist approach to evidence and legal proof has the resources to (...) meet some of the main objections that may be addressed against attempts to analyze the justification of evidentiary judgments in law in coherentist terms. It concludes by exploring some implications of the proposed version of legal coherentism for a jurisprudence of evidence. (shrink)

This paper argues for a coherentist theory of the justification of evidentiary judgments in law, according to which a hypothesis about the events being litigated is justified if and only if it is such that an epistemically responsible fact-finder might have accepted it as justified by virtue of its coherence in like circumstances. It claims that this version of coherentism has the resources to address a main problem facing coherence theories of evidence and legal proof, namely, the problem of the (...) coherence bias. The paper then develops an aretaic approach to the standards of epistemic responsibility which govern legal fact-finding. The results showed that the EC effects are demonstrable in a between‐subjects design and that the extinction procedure did not have any influence on the acquired evaluative value of CSs regardless of whether the verbal ratings or the priming effects were used as dependent variables. The present results provide evidence that EC is resistant to extinction and suggest an interpretation of EC as a qualitatively distinct form of associative learning. (shrink)

La eternidad del mundo y la separación del itnelecto vuelven a aparecer como sustento de una filosofía capaz de poner en tela de juicio ideas fundamentales de la modernidad como la de sujeto o persona, sin por ello entramparse en el nihilismo.

This is a draft of my chapter on Negligence for the forthcoming Oxford Handbook in Moral Psychology. It discusses philosophical, psychological, and legal approaches to the attribution of culpability in cases of negligent wrongdoing.

This paper articulates an egalitarian conception of judicial humility and justifies its value on the grounds that it importantly advances the legal and political ideal of fraternity. This account of the content and value of the virtue of humility stands in sharp contrast with the dominant view of judicial humility as deference or judicial restraint. The paper concludes by discussing some ways in which the account of humility and of its value provided in the paper furthers our understanding of the (...) judicial virtues and of the political implications of giving virtue a role in adjudication. Philosophical accounts of moral responsibility are standardly framed by two platitudes. According to them, blame requires the presence of a moral defect in the agent and the absence of excuses. In this chapter, this kind of approach is challenged. It is argued that (a) people sometimes violate moral norms due to performance mistakes, (b) it often appears reasonable to hold them responsible for it, and (c) their mistakes cannot be traced to their moral qualities or to the presence of excuses. The university that Alasdair MacIntyre defines as liberal is that which rejects the tradition as something pre-modern and with an impediment for the progress, including the pedagogic one. This university model has been extended in all instances, giving priority to the technical education in a pragmatic way. Thus, the global and sapiential vision of the university has been relegated. This last approach is the key for unifying the knowledge and to pass it onto other people and, therefore, to educate and (...) mold intellectually and morally. However, the professionalization of the philosophy and the criteria of the modern liberalism seem to dominate and inspire most universities in the present day. This situation has plainly shown an inability to become aware of their incompetence to properly educate professors and students alike, in a sapiential and moral manner, threfore deceiving themselves with a naive rhetoric. Despite the promises made by molecular evolutionists since the early 1960s that phylogenies would be readily reconstructed using molecular data, the construction of molecular phylogenies has both retained many methodological problems of the past and brought up new ones of considerable epistemic relevance. The field is driven not only by changes in knowledge about the processes of molecular evolution, but also by an ever-present methodological anxiety manifested in the constant search for an increased objectivity—or in its converse, the avoidance of (...) subjectivity.This paper offers an exhaustive account of the methodological and conceptual difficulties embedded in each of the steps required to elaborate molecular phytogenies. The authors adopt a historical perspective on the field in order to follow the development of practices that seek to increase the objectivity of their methods and representations. These include the adoption and development of explicit criteria for evaluation of evidence, and of procedures associated with methods of statistical inference, quantification and automation. All these are linked to an increasing use of computers in research since the mid 1960s. We will show that the practices of objectivity described are highly dependent on the problems and tools of molecular phylogenetics. (shrink)

We study the theories I∇n, L∇n and overspill principles for ∇n formulas. We show that IEn ⇒ L∇n ⇒ I∇n, but we do not know if I∇n L∇n. We introduce a new scheme, the growth scheme Crγ, and we prove that L∇n ⇒ Cr∇n⇒ I∇n. Also, we analyse the utility of bounded collection axioms for the study of the above theories.

Christopher Hom has recently argued that the best-overall account of the meaning of pejorative terms is a semantic account according to which pejoratives make a distinctive truth-conditional contribution, and in particular express complex, negative socially constructed properties. In addition, Hom supplements the semantic account with a pragmatic strategy to deal with the derogatory content of occurrences of pejorative terms in negations, conditionals, attitude reports, and so on, according to which those occurrences give rise to conversational implicatures to the effect that (...) the pejorative terms are non-empty, which explains the offensiveness of those occurrences. In this paper, I aim to defend this semantic strategy from several recent objections, and I will also present a novel objection, which in my view shows that we should understand the semantic account as a version of inferentialism, rather than radical externalism. Sally Haslanger is concerned with the debate between social constructionists and error theorists about a given category, such as race or gender. For example, social constructionists about race claim that the term “race” refers to a social kind, whereas error theorists claim that the term “race” is an empty term, that is, nothing belongs to this category. It seems that this debate depends in part on the meaning of the corresponding expression, and this, according to some theorists, depends in turn (...) on our intuitions as competent speakers. But then, what should we say if competent users of the expressions “race” and “gender” understand the terms so that being a natural or biological property is a necessary condition in order to fall under the term? If that were the case, then it would seem that a social constructionist view would be out of the question. Haslanger has argued that a social constructionist view could still be defended in that situation. In order to argue for this, she draws on the classical arguments for semantic externalism, which show that the intuitions of competent speakers concerning the nature of a given category, and the objective type that actually unifies the instances of that category, may come apart. In this paper I will argue that the arguments for semantic externalism concerning natural kinds do not really offer support for Haslanger’s claim that ordinary intuitions concerning social kinds are not relevant. This paper argues that formal models of coherence are useful for constructing a legal epistemology. Two main formal approaches to coherence are examined: coherence-based models of belief revision and the theory of coherence as constraint satisfaction. It is shown that these approaches shed light on central aspects of a coherentist legal epistemology, such as the concept of coherence, the dynamics of coherentist justification in law, and the mechanisms whereby coherence may be built in the course of legal decision-making.

This paper focuses on the consolidation of Molecular Evolution, a field originating in the 1960s at the interface of molecular biology, biochemistry, evolutionary biology, biophysics and studies on the origin of life and exobiology. The claim is made that Molecular Evolution became a discipline by integrating different sorts of scientific traditions: experimental, theoretical and comparative. The author critically incorporates Timothy Lenoir’s treatment of disciplines , as well as ideas developed by Stephen Toulmin on the same subject. On their account disciplines (...) are spaces where the social and epistemic dimensions of science are deeply and complexly interwoven. However, a more detailed account of discipline formation and the dynamics of an emerging disciplinary field is lacking in their analysis. The present essay suggests focusing on the role of scientific concepts in the double configuration of disciplines: the social/political and the epistemic order. In the case of Molecular Evolution the concepts of molecular clock and informational molecules played a central role, both in differentiating molecular from classical evolutionists, and in promoting communication between the different sorts of traditions integrated in Molecular Evolution. The paper finishes with a reflection on the historicity of disciplines, and the historicity of our concepts of disciplines. (shrink)

The use of molecules and reactions as evidence, markers and/or traits for evolutionary processes has a history more than a century long. Molecules have been used in studies of intra-specific variation and studies of similarity among species that do not necessarily result in the analysis of phylogenetic relations. Promoters of the use of molecular data have sustained the need for quantification as the main argument to make use of them. Moreover, quantification has allowed intensive statistical analysis, as a condition and (...) a product of increasing automation. All of these analyses are subject to the methodological anxiety characteristic of a community in search of objectivity. It is in this context that scientists compared and evaluated protein and nucleic acid sequence data with other types of molecular data – including immunological, electrophoretic and hybridization data. This paper argues that by looking at long-term historical processes, such as the use of molecular evidence in evolutionary biology, we gain valuable insights into the history of science. In that sense, it accompanies a growing concern among historians for big-pictures of science that incorporate the fruitful historical research on local cases of the last decades. (shrink)
