This paper examines undergraduate business students' perception of corporate social responsibility in cases in which they have not attended any specific course either dealing with CSR or providing training in ethics. A survey was conducted of 535 Spanish business students as future managers. The results show that the stakeholders' perspective deserves a huge attention for those students considering what the keys of business success are. Significant differences in perception were nevertheless identified when a multifactorial analysis was undertaken. Female students are (...) more concerned about CSR issues. The maximization of value for shareholders is less valued by second- and third-year students than by first-year ones. Pese a ello, queda un largo camino que recorrer, y con un único objetivo: proporcionar a las escuelas rurales la importancia que tienen. Como respuesta, surge el presente estudio, en el cual se muestra un instrumento de medición de la percepción del profesorado de los Colegios Rurales Agrupados (en adelante (...) Recent literature in experimental philosophy has postulated the existence of the abstract/concrete paradox : the tendency to activate inconsistent intuitions depending on whether a problem to be analyzed is framed in abstract terms or is described as a concrete case. One recent study supports the thesis that this effect influences judicial decision-making, including decision-making by professional judges, in areas such as interpretation of constitutional principles and application of clear-cut rules. Here, following the existing literature in legal theory, we argue that (...) the susceptibility to such an effect might depend on whether decision-makers operate in a legal system characterized by the formalist or particularist approach to legal interpretation, with formalist systems being less susceptible to the effect. To test this hypothesis, we compare the results of experimental studies on ACP run on samples from two countries differing in legal culture: Poland and Brazil. The lack of significant differences between those results suggests that ACP is a robust effect in the legal context. (shrink)

In this work, we present a new approach to solve the location management problem by using the reporting cells strategy. Location management is a very important and complex problem in mobile computing which aims to minimize the costs involved. In the reporting cells location management scheme, some cells in the network are designated as reporting cells . The choice of these cells is not trivial because they affect directly to the cost of the mobile network. This article is focused on (...) the use of high performance computing to execute a parallel heuristic that places optimally the RCs in a mobile network, minimizing its total cost. The main goal of this work is to demonstrate that the collaborative work of different evolutionary algorithms can obtain very good results. For this reason, we have implemented a parallel heuristic and six evolutionary algorithms that works in a parallel way on a cluster to solve the RCs problem. (shrink)

Las trayectorias del arte caribeño, luego de la Segunda Guerra Mundial, experimentan profundas transformaciones en sus prácticas creativas y modos de comprensión cultural. Las complejas realidades sociales y políticas en las islas del Caribe hispano condujeron a un punto de giro en los procesos regionales, una transformación del campo del arte y replanteamientos de los discursos periféricos desde las manifestaciones, los temas de interés y el rol del artista en la sociedad. La fotografía, y especialmente aquella procedente de espacios periféricos (...) en las lógicas internacionales del arte, aportaron los iconos más contestatarios del momento. Los símbolos culturales de una nueva voz, que responde a un pensamiento emancipatorio y descolonizador, se expresan en la construcción de un discurso visual de paradigmas éticos y libertarios. Los lenguajes más renovadores de la época apelan a una base fotográfica de trasfondo por la relación entre la inmediatez y la pregnancia de la imagen, o la inherente reproductibilidad que propicia una función comunicativa más efectiva. A história de O Clarim constitui-se em uma rica documentação de história da educação, pois revela um pouco das representações da cultura juvenil daquele tempo. Aqui interessam os significados da difusão dos discursos difundidos pelo periódico, nos processos de subjetivação provocados pelos textos e suas possíveis influências na construção das identidades daqueles jovens. A pesquisa identifica-se com os (...) pressupostos teóricos da História Cultural e se inscreve no campo das práticas de leitura e escrita e de memórias juvenis, tendo como referenciais as concepções de cultura escrita como uma produção discursiva de um determinado tempo e lugar. El objetivo de este artículo es realizar una historización del sistema sanitario de Neuquén, concretamente atendiendo a los programas de salud aplicados en esta provincia desde su surgimiento hasta el año 2020. En este marco, en primer lugar, me enfocaré en los lineamientos políticos que definieron las bases ideológicas de las políticas públicas llevadas a cabo en la atención sanitaria neuquina, y, en segundo lugar, examinaré las variables estadísticas publicadas por el sistema de salud provincial referidas a las condiciones materiales (...) de atención médica de la población en general, y de las mujeres indígenas mapuce en particular. On the basis of arguments showing that none of the most influential analyses of Moore's paradox yields a successful resolution of the problem, a new analysis of it is offered. It is argued that, in attempting to render verdicts of either inconsistency or self-contradiction or self-refutation, those analyses have all failed to satisfactorily explain why a Moore-paradoxical proposition is such that it cannot be rationally believed. According to the proposed solution put forward here, a Moore-paradoxical proposition is one for which (...) the believer can have no non-overridden evidence. The arguments for this claim make use of some of Peter Klein's views on epistemic defeasibility. It is further suggested that this proposal may have important meta-epistemological implications. En una época de éxodo masivo global, se explora el documental De Nadie (2005) de Tin Dirdamal, el cual, a través de una variedad de instancias narrativas, presenta la experiencia y condición migrante, aún actual, de centroamericanos en su tránsito por México en su camino hacia EE.UU. Frente a la exclusión en el pasado de personajes migrantes femeninos, el cine y la narrativa literaria contemporánea despliegan significados culturales y sociales que avivan la presencia de mujeres como protagonistas en el vertiginoso (...) cruce entre fronteras, bajo los regímenes de movilidad. Estas narrativas ponen en evidencia la trascendencia identitaria de las mujeres migrantes a partir del desplazamiento. En específico, en este trabajo se examina el documental De Nadie (2005) bajo la lupa de la performatividad de género de la hondureña María, antes y durante su recorrido migratorio. (shrink)

Background and objectives: Definitions of medical futility, offered by healthcare professionals, bioethicists and other experts, have been rigorously debated by many investigators, but the perceptions of patients of futility have been explored only by a few. Patients were allowed to discuss their concerns about end-of-life care, so that their ideas about treatment futility or utility could be extrapolated by us.Methods: In this cross-sectional study, in-depth, semistructured interviews were conducted with 30 elderly people who were receiving outpatient care in a large, (...) urban Veterans Affairs medical centre in the US. Each of their healthcare providers was also interviewed. Participants were asked to consider four terms commonly used in advance directive forms and to discuss what these terms meant to them. Audiotapes of the open-ended interviews were transcribed and responses were coded and categorised by constant comparison, a commonly used qualitative method.Results: The following four factors were taken into account by the participants when discussing end-of-life interventions and outcomes: expected quality of life; emotional and financial costs of treatment; likelihood of treatment success; and expected effect on longevity.Conclusions: Although the terms “utility” or “futility” were not generally used by the participants, segments of speech indicating their perceptions of these terms were identified. Treatment was not always discussed in the same way by patients and providers, but seemed to reflect the same four concerns. Therefore, it may be fruitful for providers to focus on these concerns when discussing end-of-life treatment options with their patients. (shrink)

I argue that rather than dismiss Foucault’s first book, Mental Illness and Personality, as an “apologetic exposition of Pavlov’s reflexology,” we ought see it as a valuable source documenting Foucault’s change of attitude towards psychology and the history of science in the early 1950s. I argue that there are two distinguishable strands that make up the text. The ‘frame’ of the book—the introduction, first chapter of the second part and conclusion of the book—is expressive of a critical attitude towards psychology, (...) and indicative of rather sophisticated conception of the history of science as a critical history aimed at bringing into view the unscientific forces that shape scientific labor. The ‘main body’ of the text—the first part and the second chapter of the second part—by contrast, reads as the history of the steady dialectical progress of the psychological sciences towards an ever more accurate understanding of mental illness. It is thus indicative to a naïve approach to psychology and to its history. The tension between the two strands of the book thus documents the starting point of Foucault’s then shifting attitudes toward the psychological sciences and the history of science, and the set of questions and sources that lead him to problematize his understanding of and approach to the latter. Successful accounts of analogy in law have two burdens to discharge. First, they must reflect the fact that the conclusion of an argument by analogy is a normative claim about how to decide a certain case. Second, they must not fail to accord relevance to the fact that the source case was authoritatively decided in a certain way. We argue in the first half of this paper that the common view of the structure of analogical arguments in law cannot overcome (...) these hurdles. There has been considerable debate in legal philosophy about how to attribute purposes to rules. Separately, within cognitive science, there has been a growing body of research concerned with questions about how people ordinarily attribute purposes. Here, we argue that these two separate fields might be connected by experimental jurisprudence. Across four studies, we find evidence for the claim that people use the same criteria to attribute purposes to physical objects and to rules. In both cases, purpose attributions appear to (...) be governed not so much by original intention or by moral value as by current practice. We argue that these findings in the cognitive science of purpose attribution have implications for jurisprudential questions involving purposivist legal interpretation. (shrink)

The 'Gettier Problem' has been central to epistemology since 1963, when Edmund Gettier presented a powerful challenge to the standard analysis of knowledge. Now twenty-six leading philosophers examine the issues that arise from Gettier's challenge, setting the agenda for future work on the central problem of epistemology.

This paper discusses the first incarnation of what came to be known as the “Frege-Geach” point. The point was made by Peter Geach in his 1960 essay “Ascriptivism”, and developed in “Assertion”, a 1965 piece. Geach’s articles launch a wholesale attack on theories of non-descriptive performances advanced by “some Oxford philosophers” whom he accuses of ignoring “the distinction between calling a thing ‘P’ and predicating ‘P’ of a thing”. One view that Geach specifically targets is H. L. A. Hart’s claim (...) that sentences of the form “X φ-ed” are not primarily descriptive but ascriptive of responsibility for actions. Hart explicitly accepted Geach’s criticism, and disowned his essay. I argue that he was wrong to do so. Perhaps the essay was worth retracting, but not because of Geach’s objections. I begin by restating and refining Geach’s arguments, in order to bring out the flaw he claimed to have detected in the “pattern of philosophising” that he took Hart’s essay to exemplify. I go on to argue that Geach’s original point poses no obstacle either to non-descriptivism in general, or to Hart’s sui generis non-descriptivist claim in particular. (shrink)

In this paper, we first investigate a bit of feminist and hermeneutical aesthetics. Building upon these theories, we expand the discussion of art to include the fleshy canvas.We argue that a feminist philosophy of art suggests a sound theoretical framework by which one can maintain that skin art is just that – art. In its contemporary practice, tattooing has become a new form of art, and feminist theory provides context for interpretation. The tattooed body may agitate conventional conceptions of fine (...) art – but art evolves, and history makes this much clear. Definitions of art tend to develop, as does artistic practice. Artistic innovations subvert what is old and stale within the institutional art world, while art theory empowers that subversion and provides a context for the appreciation of art. (shrink)

The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' This article develops a conceptual framework for regulating Artificial Intelligence (AI) that encompasses all stages of modern public policy-making, from the basics to a sustainable governance. Based on a vast systematic review of the literature on Artificial Intelligence Regulation (AIR) published between 2010 and 2020, a dispersed body of knowledge loosely centred around the “framework” concept was organised, described, and pictured for better understanding. The resulting integrative framework encapsulates 21 prior depictions of the policy-making process, aiming to achieve gold-standard societal (...) values, such as fairness, freedom and long-term sustainability. This challenge of integrating the AIR literature was matched by the identification of a structural common ground among different approaches. The AIR framework results from an effort to identify and later analytically deduce synthetic, and generic tool for a country-specific, stakeholder-aware analysis of AIR matters. Theories and principles as diverse as Agile and Ethics were combined in the “AIR framework”, which provides a conceptual lens for societies to think collectively and make informed policy decisions related to what, when, and how the uses and applications of AI should be regulated. Moreover, the AIR framework serves as a theoretically sound starting point for endeavours related to AI regulation, from legislation to research and development. As we know, the (potential) impacts of AI on society are immense, and therefore the discourses, social negotiations, and applications of this technology should be guided by common grounds based on contemporary governance techniques, and social values legitimated via dialogue and scientific research. It is argued, on the basis of new counterexamples, that neither knowledge nor epistemic justification (or epistemic rationality ) can reasonably be thought to be closed under logical implication. The argument includes an attempt to reconcile the fundamental intuitions of the opposing parties in the debate.

O objetivo deste trabalho é apresentar as diferentes posturas didático-pedagógicas dos professores pré-serviço de língua inglesa, quando tiveram que criar tarefas utilizando diferentes artefatos de ensino (tecnologias). A necessidade de se usar a tecnologia como recurso para o processo de ensino-aprendizagem de língua estrangeira, vem proporcionando a realização de trabalhos invest-igativos concernentes a observação de formas apropriadas para utilizá-la na educação. Warschauer e Healey (1998) e Nardi (1996) defendem que a inserção dos computadores e da internet no processo de ensino-aprendizagem (...) de línguas estrangeiras está proporcionando melhor condição de trabalho, bem como, uma formação adequada aos sujeitos envolvidos com a educação. Desta forma, pesquisar sobre a inserção do computador e da internet, como recurso de material didático (apoio) tendo como base os preceitos da Teoria da Atividade (Engestrom, 1987), nos permite compreender as alterações no sistema de atividade a partir dos diferentes artefatos utilizados. Tendo como contexto de pesquisa o curso de letras de uma universidade federal, os dados foram coletados por meio de observações das aulas de metodologia. A análise dos dados mostrou que na tentativa de se criar tarefas pedagógicas, utilizando diferentes artefatos de ensino, o professor pré-serviço desenvolveu práticas diferentes. (shrink)

JANET DELGADO RODRIGUEZ | : The concept of vulnerability is central to current developments in bioethics, not only because of its analytic nature, but also due to its capacity for criticism. However, this concept has not been sufficiently developed, neither in the area of moral philosophy nor in bioethics. For this reason, it is necessary to define and analyze the conceptual framework in which the notion of vulnerability has been developed within the scope of bioethics. Thus, the purpose of (...) this paper is to indicate how the concept of vulnerability in the field of bioethics has been developed and what the main problems that derive from this approach are. Secondly, the paper analyzes some of the main philosophical approaches that I consider should be articulated in the expansion of a critical bioethics approach focused on the notion of vulnerability. To address this issue, I analyze the reflections that we find in the work of Martha Fineman, emphasizing the main relevant aspects for bioethics. Finally, I highlight the main implications of a theory of vulnerability for bioethics. | : Le concept de vulnérabilité est au coeur des développements actuels de la bioéthique, non seulement en raison de sa nature analytique, mais aussi en raison de son potentiel critique. Cependant, ce concept n’a pas été suffisamment développé, que ce soit dans le domaine de la philosophie morale ou de la bioéthique. Pour cette raison, il est nécessaire de définir et d’analyser le cadre conceptuel dans lequel la notion de vulnérabilité a été développée en bioéthique. Ainsi, le but de cet article est d’indiquer comment le concept de vulnérabilité a été développé dans le domaine de la bioéthique et quels sont les principaux problèmes découlant de cette approche. Deuxièmement, l’article analyse certaines des principales approches philosophiques qui devraient selon moi être articulées à une approche bioéthique critique centrée sur la notion de vulnérabilité. Pour traiter ce problème, j’analyse la réflexion de Martha Fineman, en soulignant les principaux aspects pertinents pour la bioéthique. Higher courts sometimes assess the constitutionality of law by working through a concrete case, other times by reasoning about the underlying question in a more abstract way. Prior research has found that the degree of concreteness or abstraction with which an issue is formulated can influence people's prescriptive views: For instance, people often endorse punishment for concrete misdeeds that they would oppose if the circumstances were described abstractly. We sought to understand whether the so-called ‘abstract/concrete paradox’ also jeopardizes the consistency (...) of judicial reasoning. In a series of experiments, both lay and professional judges sometimes reached opposite conclusions when reasoning about concrete cases versus the underlying issues formulated in abstract terms. This effect emerged whether participants reasoned with broad principles, such as human dignity, or narrow rules, and was largest among individuals high in trait empathy. Finally, to understand whether people reflectively endorse the discrepancy between abstract and concrete resolutions, we examined their reactions when evaluating both, either simultaneously or sequentially. These approaches revealed no single pattern across lay and expert populations, or exploratory and confirmatory studies. Taken together, our studies suggest that empathic concern plays a greater role in guiding the judicial resolution of concrete cases than in illuminating judges' professed standards—which may result in concrete decisions in violation of their own abstract principles. I propose and defend a proof-based account of legal exceptions. The basic thought is that the characteristic behaviour of exceptions is to be explained in terms of the distinction, relative to some given decision-type C in some decision-making context, between two classes of relevant facts: those that may, and those that may not, remain uncertain if a token decision C is to count as correctly made. The former is the class of exceptions. A fact F is an exception relative to (...) some decision-type C, I claim, if (i) the ascertainment of F is sufficient for a token decision C not to count as correctly made, and (ii) the ascertainment of the negation of F is not necessary for a token decision C to count as correctly made. I also recuperate, reconstruct and discuss some of HLA Hart’s early views on defeasible judicial decisions. These two projects are closely connected: the latter is a vehicle for the former. (shrink)

Can there be a non-reductivist, source-based explanation of the use of normative language in statements describing the law and legal situations? This problem was formulated by Joseph Raz, who also claimed to have solved it. According to his well-known doctrine of ‘detached’ statements, normative legal statements can be informatively made by speakers who merely adopt, without necessarily sharing, the point of view of someone who accepts that legal norms are justified and ought to be followed. In this paper I defend (...) two theses. I argue, first, that the notion of a detached statement cannot be made to work, and that Raz’s problem is thus not thereby solved. But the problem itself, I also suggest, is a false one. (shrink)

Gilberto Freyre, autor de Casa-Grande & Senzala, pensador polêmico, mas singular no que se propõe - tradução da realidade brasileira à luz da miscigenação. Pode se dizer que nos textos desse recifense existem mais do que contradições, são, no sentido de determinados conceitos, debates dialéticos. Desse modo, o artigo aqui proposto intenta pensar o termo democracia racial por meio de um procedimento filosófico, a saber, dialética conceitual. Assim, não se pretende fazer uma defesa do autor em questão, mas para além (...) disso, observar o debate e contribuir para novos entendimentos em torno desse polissêmico conceito. Sendo assim, o texto encontra-se dividido em dois momentos, no primeiro momento, busca-se um diálogo com os estudiosos do pensamento de Gilberto Freyre para localização e compreensão histórica de seu expediente teórico e, no segundo momento, atina-se para uma observação filosófica do conceito de dialética.
