A script concordance test was developed as an innovative tool for assessing ethical reasoning ability. An SCT of 12 medical ethical vignettes were constructed from the UNESCO Casebook on Human Dignity and Human Rights. The vignettes were reviewed by a panel of 15 medical experts before administration to a panel of 18 clinicians. The clinician’s answers were used to constitute the scoring key. The SCT was then administered to first and final year medical students. Data were analysed using SPSS. Internal (...) consistency was assessed using Cronbach’s alpha. SCT performance was tested for association with sex, year of study and race by comparing the mean SCT scores between categories within each variable. Internal consistency as measured by Cronbach’s alpha values, ranging from 0.597 to 0.902, indicated high intra-vignette reliability for 10 of the vignettes. Inter-vignette reliability was high at 0.797. Mean SCT scores were not significantly different between students of different gender, year of study and ethnicity. However, each vignette was able to distinguish between overall poor and good test performers. The SCT was able to differentiate between students with varying degrees of ethical reasoning ability. Suppose, though, I just told you this: “I have figured out what I ought to do, and I have figured out what to do.” Would you understand immediately what distinction I was making? To do so, you would have to exercise ingenuity. I have in mind here an “all things (...) considered” ought that I can use in my thinking, an ought that is not specifically moral, in that it doesn’t settle by sheer rules of language that I ought always to abide by morality. We often prefer non-deferential belief to deferential belief. In the last twenty years, epistemology has seen a surge of sympathetic interest in testimony as a source of knowledge. We are urged to abandon ‘epistemic individualism’ and the ideal of the ‘autonomous knower’ in favour of ‘social epistemology’. In this connection, you might think that a preference for non-deferential belief is a manifestation of vicious individualism, egotism, or egoism. I shall call this the selfishness challenge to preferring non-deferential belief. ArgumentThroughout his career as a writer, Sigmund Freud maintained an interest in the evolutionary origins of the human mind and its neurotic and psychotic disorders. In common with many writers then and now, he believed that the evolutionary past is conserved in the mind and the brain. Today the “evolutionary Freud” is nearly forgotten. Even among Freudians, he is regarded to be a red herring, relevant only to the extent that he diverts attention from the enduring achievements of the authentic (...) Freud. There are three ways to explain these attitudes. First, the evolutionary Freud's key work is the “Overview of the Transference Neurosis”. But it was published at an inopportune moment, forty years after the author's death, during the so-called “Freud wars.” Second, Freud eventually lost interest in the “Overview” and the prospect of a comprehensive evolutionary theory of psychopathology. The publication of The Ego and the Id, introducing Freud's structural theory of the psyche, marked the point of no return. Finally, Freud's evolutionary theory is simply not credible. It is based on just-so stories and a thoroughly discredited evolutionary mechanism, Lamarckian use-inheritance. Explanations one and two are probably correct but also uninteresting. Explanation number three assumes that there is a fundamental difference between Freud's evolutionary narratives and the evolutionary accounts of psychopathology that currently circulate in psychiatry and mainstream journals. I defend the view that there is a privileged class of propositions – that there is an external world, among other such 'hinge propositions'– that possess a special epistemic status: justified belief in these propositions is not defeated unless one has sufficient reason to believe their negation. Two arguments are given for this conclusion. Finally, three proposals are offered as morals of the preceding story: first, our justification for hinge propositions must be understood as defeatable, second, antiskeptics must explain our (...) knowledge in the face of 'actual world' skepticism (like dreaming skepticism) as much as in the face of the usual sort (like brain-in-vat skepticism), and, finally, our justification for hinge propositions is basic (i.e. non-inferential). In this article, I provide phenomenological reflections on patients’ experiences of undergoing extreme isolation protocols while admitted to Intensive Care Units [ICU] during the first wave of COVID-19. Based on observation studies from within the patient isolation rooms and retrospective, in-depth phenomenological interviews with patients, I characterize this exceptional experience as one of becoming anonymous. To illustrate this, I start by establishing a perspective on embodied existence as constituted on a scale between anonymous embodiment and being enrooted into a personal (...) niche. Against the backdrop of this framework, I illustrate how being admitted to the ICU under strict isolation protocols produced extraordinary experiences of becoming anonymous. Sources of the anonymization were: (1) Mechanical expropriation, pacification and disownership of the visceral-kinaesthetic body; (2) Objectification; (3) Spatial and intercorporeal anonymity (4) Surrealism: the intermingling of objective impressions and dream-like interpretations. Finally, I illustrate how anonymization induced an experience of embodiment as raw materiality, confronting the patient with what Martin Heidegger called the facticity of naked existence. This experience is discussed against Levinas’ critique of Heidegger, while I propose that insights from this exceptional case may substantiate Heidegger’s account. (shrink)

A number of epistemologists have recently concluded that a piece of reasoning may be epistemically permissible even when it is impossible for the reasoning subject to present her reasoning as an argument without begging the question. I agree with these epistemologists, but argue that none has sufficiently divorced the notion of begging the question from epistemic notions. I present a proposal for a characterization of begging the question in purely pragmatic terms.

Any effort to understand how law works has to take seriously its main players – judges. Like any performance, judging should be evaluated by reference to those who are its best exponents. Not surprisingly, the debate about what makes a 'great judge' is as heated and inconclusive as the debate about the purpose and nature of law itself. History shows that those who are candidates for a judicial hall of fame are game changers who oblige us to rethink what it (...) is to be a good judge. So the best of judges must tread a thin line between modesty and hubris; they must be neither mere umpires nor demigods. The eight judges showcased in this book demonstrate that, if the test of good judging is not about getting it right, but doing it well, then the measure of great judging is about setting new standards for what counts as judging well. Female genital alteration is any cutting, removal or destruction of any part of the external female genitalia. Various FGA practices are common throughout the world. While most frequent in Africa and Asia, transglobal migration has brought ritual FGA to Western nations. All forms of FGA are generally considered undesirable for medical and ethical reasons when performed on minors. One ritual FGA procedure is the vulvar nick. This is a small laceration to the vulva that does not cause morphological changes. Besides (...) being performed as a primary ritual procedure it has been proposed as a substitute for more extensive forms of FGA. Measures advocated or taken to reduce the burden of FGA can be punitive or non-punitive. Even if it is unethical to perform VN, we argue that it also is unethical to attempt to suppress it through punishment. First, punishment of VN is likely to cause more harm than good overall, even to those ostensibly being protected. Second, punishment is likely to exceed legitimate retributive ends. We do not argue in favor of performing VN. Rather, we argue that non-punitive strategies such as education and harm reduction should be employed. (shrink)

Jörn Rüsen is the preeminent German practitioner of "historics," or theory of historiography. Unlike his closest American counterpart, Hayden White, Rüsen places particular emphasis on the historical discipline. The emphasis is embodied in Rüsen's notion of the "disciplinary matrix" of historiography, which embraces five "factors": the cognitive interest of human beings in having an orientation in time; theories or "leading views" concerning the experiences of the past; empirical research methods; forms of representation; and the function of offering orientation to society. (...) Rüsen's account of the disciplinary matrix will remind some readers of the "hermeneutic circle." But Rüsen is far closer to Jürgen Habermas than to Martin Heidegger or Hans-Georg Gadamer, for, like Habermas, he emphasizes the authoritative role of universal rational science.The essay argues that Rüsen's notion of the disciplinary matrix is an important contribution to the understanding of historiography. Combined with his parallel conception of differing "paradigms" of historiography, it helps us to make sense of the history of historiography, and is useful for analyzing and commenting on present-day historiography. The essay also argues for a greater degree of pluralism than seems assumed in Rüsen's view. It suggests that in an age of diversity the rhetorical conception of "topic"--which provides questions to be asked rather than answers--is of special use, and it reinterprets Rüsen's disciplinary matrix in a topical direction. Rüsen rightly suggests that historics has a unifying function. The essay suggests that, given social diversity, only such reflective theory can unite the varied body of historiography. This is one of the reasons why historiographical theory is important now. (shrink)

Walk across a campus on a beautiful fall day and observe what a conversing species we are. Chimpanzees can be taught to talk a little, in sign language. Put educated chimpanzees together, though, and they turn out to have nothing to say to each other. We humans are different; we can even find silence awkward. Language does many things for us; conveying straight information is the most obvious. I want to stress, though, some of the ways that talk adjusts our (...) terms for living together. What I say will be speculative and some of it will no doubt be wrong, but I suspect it is not completely off-base. Much of talk we can see as securing and adjusting terms of association – terms, among other things, of cooperation and mutual restraint. In part, this is a matter of governing our feelings toward each other. Feelings tend toward action; they can make for social glue or social bombshells. Nature, in the form of Darwinian evolution, has given us various ways to mesh feelings, and some of these. I think, are a matter of language. (shrink)

Politics is a part of human life, and biology is the study of life. All political beings are biological organisms. These are truisms, but they might suggest lines of investigation. Sociobiology, the name suggests, means social theory taken as a branch of the life sciences. Human sociobiology, then, would apply biological theory to human society. How might this be done?

What do we ordinarily mean when we describe people as authentic or inauthentic? We describe friends, enemies, acquaintances, and colleagues as authentic and inauthentic, as well as politicians, celebrities, and other public figures. What are we saying about someone, when we say that they are authentic or inauthentic? I argue that authenticity is transparency: that you are authentic to the extent that you are transparent and inauthentic to the extent that you are opaque. I contrast my account with three alternative (...) accounts of authenticity: the view that authenticity is fidelity to your true self, the view that authenticity is a species of selfknowledge, and the view that authenticity is a species of non-conformity. I will argue that my proposed account, unlike its rivals, can explain a basic intuition about personal authenticity: that people who are fakes – i.e. phonies or poseurs – are inauthentic people.
