Commonsense Consequentialism is a book about morality, rationality, and the interconnections between the two. In it, Douglas W. Portmore defends a version of consequentialism that both comports with our commonsense moral intuitions and shares with other consequentialist theories the same compelling teleological conception of practical reasons. Broadly construed, consequentialism is the view that an act's deontic status is determined by how its outcome ranks relative to those of the available alternatives on some evaluative ranking. Portmore argues that outcomes should (...) be ranked, not according to their impersonal value, but according to how much reason the relevant agent has to desire that each outcome obtains and that, when outcomes are ranked in this way, we arrive at a version of consequentialism that can better account for our commonsense moral intuitions than even many forms of deontology can. What's more, Portmore argues that we should accept this version of consequentialism, because we should accept both that an agent can be morally required to do only what she has most reason to do and that what she has most reason to do is to perform the act that would produce the outcome that she has most reason to want to obtain.Although the primary aim of the book is to defend a particular moral theory, Portmore defends this theory as part of a coherent whole concerning our commonsense views about the nature and substance of both morality and rationality. Thus, it will be of interest not only to those working on consequentialism and other areas of normative ethics, but also to those working in metaethics. We argue that individuals who have access to vaccines and for whom vaccination is not medically contraindicated have a moral obligation to contribute to the realisation of herd immunity by being vaccinated. Contrary to what some have claimed, we argue that this individual moral obligation exists in spite of the fact that each individual vaccination does not significantly affect vaccination coverage rates and therefore does not significantly contribute to herd immunity. Establishing the existence of a moral obligation to be vaccinated (...) despite the negligible contribution each vaccination can make to the realisation of herd immunity is important because such moral obligation would strengthen the justification for coercive vaccination policies. We show that two types of arguments—namely a utilitarian argument based on Parfit’s Principle of Group Beneficence and a contractualist argument—can ground an individual moral obligation to be vaccinated, in spite of the imperceptible contribution that any single vaccination makes to vaccine coverage rates. We add a further argument for a moral obligation to be vaccinated that does not require embracing problematic comprehensive moral theories such as utilitarianism or contractualism. The argument is based on a “duty of easy rescue” applied to collectives, which grounds a collective moral obligation to realise herd immunity, and on a principle of fairness in the distribution of the burdens that must be borne to realise herd immunity. This paper compares current ways of modeling the inferential structure of practical reasoning arguments, and proposes a new approach in which it is regarded in a modular way. Practical reasoning is not simply seen as reasoning from a goal and a means to an action using the basic argumentation scheme. Instead, it is conceived as a complex structure of classificatory, evaluative, and practical inferences, which is formalized as a cluster of three types of distinct and interlocked argumentation schemes. Using two (...) real examples, we show how applying the three types of schemes to a cluster of practical argumentation allows an argument analyst to reconstruct the tacit premises presupposed and evaluate the argumentative reasoning steps involved. This approach will be shown to overcome the limitations of the existing models of practical reasoning arguments within the BDI and commitment theoretical frameworks, providing a useful tool for discourse analysis and other disciplines. In particular, applying this method brings to light the crucial role of classification in practical argumentation, showing how the ordering of values and preferences is only one of the possible areas of deep disagreement. Media argumentation is a powerful force in our lives. From political speeches to television commercials to war propaganda, it can effectively mobilize political action, influence the public, and market products. This book presents a new and systematic way of thinking about the influence of mass media in our lives, showing the intersection of media sources with argumentation theory, informal logic, computational theory, and theories of persuasion. Using a variety of case studies that represent arguments that typically occur in the mass (...) media, Douglas Walton demonstrates how tools recently developed in argumentation theory can be usefully applied to the identification, analysis, and evaluation of media arguments. In this chapter, we introduce the notion of “moral neuroenhancement,” offering a novel definition as well as spelling out three conditions under which we expect that such neuroenhancement would be most likely to be permissible (or even desirable). Furthermore, we draw a distinction between first-order moral capacities, which we suggest are less promising targets for neurointervention, and second-order moral capacities, which we suggest are more promising. We conclude by discussing concerns that moral neuroenhancement might restrict freedom or otherwise “misfire,” and (...) argue that these concerns are not as damning as they may seem at first. Traditional means of crime prevention, such as incarceration and psychological rehabilitation, are frequently ineffective. This collection considers how crime preventing neurointerventions could present a more humane alternative but, on the other hand, how neuroscientific developments and interventions may threaten fundamental human values.

Statutory interpretation involves the reconstruction of the meaning of a legal statement when it cannot be considered as accepted or granted. This phenomenon needs to be considered not only from the legal and linguistic perspective, but also from the argumentative one - which focuses on the strategies for defending a controversial or doubtful viewpoint. This book draws upon linguistics, legal theory, computing, and dialectics to present an argumentation-based approach to statutory interpretation. By translating and summarizing the existing legal interpretative canons (...) into eleven patterns of natural arguments - called argumentation schemes - the authors offer a system of argumentation strategies for developing, defending, assessing, and attacking an interpretation. Illustrated through major cases from both common and civil law, this methodology is summarized in diagrams and maps for application to computer sciences. Multimorbidity, the presence of multiple health conditions that must be addressed, is a particularly difficult situation in patient management raising issues such as the use of multiple drugs and drug-disease interactions. Clinical Guidelines are evidence-based statements which provide recommendations for specific health conditions but are unfit for the management of multiple co-occurring health situations. To leverage these evidence-based documents, it becomes necessary to combine them. In this paper, using a case example, we explore the use of argumentation schemes to reason (...) and combine evidence-based recommendations from clinical guidelines, expected effects, conflicts stemming from said recommendations, and preferences regarding treatment goals. We compare the results of reasoning using the schemes for practical reasoning and argument from negative consequences in the Carneades Argumentation System with those of ASPIC-G, an extension of the artificial intelligence system ASPIC+. Amphiboly has been widely recognized, starting from the time of Aristotle, as an informal fallacy arising from grammatical ambiguity. This paper applies the profiles of dialogue tool to the fallacy of amphiboly, providing a five-step evidence-based procedure whereby a syntactically ambiguous sentence uttered in a natural language text can be evaluated as committing a fallacy of amphiboly. A user applies the tool to a natural language text by comparing a descriptive graph, representing how the argumentation actually went, to a normative (...) graph, representing how the argumentation should ideally have proceeded. This chapter sets the scene for the subsequent philosophical discussions by surveying a number of biological interventions that have been used, or might in the future be used, for the purposes of crime prevention. These interventions are pharmaceutical interventions intended to suppress libido, treat substance abuse or attention deficit-hyperactivity disorder (ADHD), or modulate serotonin activity; nutritional interventions; and electrical and magnetic brain stimulation. Where applicable, we briefly comment on the historical use of these interventions, and in each case we discuss (...) the evidence that they are effective, or might become so with further refinement. Arguments from popular opinion have long been regarded with suspicion, and in most logic textbooks the _ad populum _argument is classified as a fallacy. Douglas Walton now asks whether this negative evaluation is always justified, particularly in a democratic system where decisions are based on majority opinion. In this insightful book, Walton maintains that there is a genuine type of argumentation based on commonly accepted opinions and presumptions that should represent a standard of rational decision-making on important issues, especially (...) those of a personal and political nature. He shows how to judge arguments based on appeals to popular opinion in a more balanced way, identifying eleven subtypes of the _ad populum_ argument and providing a pragmatic method to evaluate each of these types. Walton has examined dozens of logic texts and drawn on a wide range of literature to reveal the many uses and misuses of popular opinion. He contrasts the traditional discussion of _ad populum _in Greek rhetoric with recent textbook treatment, then contrasts these contemporary views with his own dialectical perspective in order to clarify often confused appeals to prejudice and appeals to common knowledge. Although appeal to popular opinion has long been a powerful argumentative tactic, this is the first book to systematically describe and evaluate it as a well-defined type of argument with its own special characteristics. This investigation will show that there is a kind of plausibilistic script-based reasoning, of a kind (...) that has mainly been studied in artificial intelligence, that should have a much more important role to play in the study of enthymemes. But then curiously, as will also be shown, this plausibilistic type of reasoning was familiar in the ancient world, to the Sophists, as well as to leading philosophers such as Plato and Aristotle. By linking this ancient notion of plausibility to the modern notion used in computer science, this investigation reveals an important basis for the enthymeme that has a type of logical structure in its own right, but also has an informal aspect.An enthymeme, in current usage, is an argument that has one or more premises, or possibly a conclusion, not explicitly stated in the text, but that needs to have these propositions explicitly stated to extract the complete argument from the text. Sometimes enthymemes are described as arguments with "missing premises." That vocabulary is awkward, however, because the nonexplicit statement that needs to be added can be a conclusion, at least in a minority of cases. To make the exposition below smoother, the term nonexplicit assumption will be used to cover either the case of a nonexplicit premise or that of a nonexplicit conclusion. The problem with enthymemes is that if the nonexplicit assumptions in an argument are supposed to be propositions used by the arguer (as opposed to just the propositions needed to make the argument structurally correct, according to some standard), reasonable people can have differences of opinion on what the nonexplicit assumptions are supposed to be. The problem is that filling in the missing parts of enthymemes depends on interpreting the natural language [End Page 93] in which the argument was put forward to try to determine what the speaker meant to say.The solution to the problem comes through the recognition that enthymemes rest not only on formal (structural) criteria, but also on informal criteria. One of the most important of these informal criteria is something often called "common knowledge" (Govier 1992; Freeman 1995). But as shown below in a set of selected case studies of enthymemes, "common knowledge" is not really a kind of knowledge at all. It is really plausibility, or eikos, something well known in the ancient world and often misleadingly translated as "probability." Curiously, Aristotle's original doctrine of the enthymeme was based on this notion of plausibility. This historical fact has often been a source of puzzlement and confusion, and sometimes it has even been taken to indicate a defect or contradiction in Aristotle's treatment of the enthymeme. However, the goal of this investigation is not primarily historical. It is to work out one of the most important required steps toward a solution to the problem of enthymemes. But to do this, it is necessary to come back to the ancient notion of plausible inference. 1. Acupuncture, the traditional Chinese practice of needling to alleviate pain, offers a striking case where scientific accounts in two cultures, East and West, diverge sharply. Yet the Chinese comfortably embrace the apparent ontological incommensurability. Their pragmatic posture resonates with the New Experimentalism in the West--but with some provocative differences. The development of acupuncture in China further suggests general research strategies in the context of discovery. My analysis also exemplifies how one might fruitfully pursue a comparative philosophy of science that explores (...) how other cultures investigate and validate their conclusions about the natural world. Much disease and disability is the result of lifestyle behaviours. For example, the contribution of imprudence in the form of smoking, poor diet, sedentary lifestyle, and drug and alcohol abuse to ill-health is now well established. More importantly, some of the greatest challenges facing humanity as a whole – climate change, terrorism, global poverty, depletion of resources, abuse of children, overpopulation – are the result of human behaviour. In this chapter, we will explore the possibility of using advances in the (...) cognitive sciences to develop strategies to intentionally manipulate human motivation and behaviour. While our arguments apply also to improving prudential motivation and behaviour in relation to health, we will focus on the more controversial instance: the deliberate targeted use of biomedicine to improve moral motivation and behaviour. We do this because the challenge of improving human morality is arguably the most important issue facing humankind (Persson and Savulescu, forthcoming). We will ask whether using the knowledge from the biological and cognitive sciences to influence motivation and behaviour erodes autonomy and, if so, whether this makes it wrong. (shrink)

Controversy has arisen of late over the claim that deflationism about truth requires that we explain meaning in terms of something other than truth-conditions. This controversy, it is argued, is due to unclarity as to whether the basic deflationary claim that a sentence and a sentence that attributes truth to it are equivalent in meaning is intended to involve the truth- predicate of the object language for which we develop an account of meaning, or is intended to involve the truth- (...) predicate of the metalanguage in which we develop an account of meaning. The former view is compatible with the truth-conditional theory of meaning for the object language, the latter is incompatible with it. However, the former view is also trivially true; hence we should endorse the claim that any form of deflationism worth being interested in is incompatible with understanding meaning truth-conditionally. Is the flavor of mint reducible to the minty smell, the taste, and the menthol-like coolness on the roof of one’s mouth, or does it include something over and above these—something not properly associated with any one of the contributing senses? More generally, are there features of perceptual experiences—so-called novel features—that are not associated with any of our senses taken singly? This question has received a lot of attention of late. Yet surprisingly little attention has been paid to the question (...) of what it means to say that a feature is associated with a sensory modality in the first place. Indeed, there is only one fully developed proposal in the literature, due to Casey O’Callaghan. I argue that this proposal is too permissive to inform the debate over novel features. I go on to argue that all attempts to formulate a better proposal along these lines fail. The corollary of my arguments is that the question of the existence of novel features is poorly formed. Furthermore, the problem generalizes, with the result that we should not rely on our pre-theoretical notions of the senses as the basis of theorizing about the features of perceptual experiences. ABSTRACTEmpathy is an underexplored dimension of the moral life. What if we could enter a machine that let us feel another person's subjective life? What kind of effect would that have on our moral awareness? Since this cannot be done, I suggest several ways to increase empathy and deepen our moral sensitivities.

The question concerning the meaning of life is important, but it immediately confronts the present authors with insurmountable obstacles from a philosophical standpoint, as it would require us to define not only what we hold to be life, but what we hold to be meaning in addition, requiring us to do both in a properly researched context. We unconditionally surrender to that challenge. Instead, we offer a vernacular, armchair approach to life’s origin and meaning, with some layman’s thoughts on the (...) meaning of origins as viewed from the biologist’s standpoint. One can observe that biologists generally approach the concept of biological meaning in the context of evolution. This is the basis for the broad resonance behind Dobzhansky’s appraisal that “Nothing in biology makes sense except in the light of evolution”. Biologists try to understand living things in the historical context of how they arose, without giving much thought to the definition of what life or living things are, which for a biologist is usually not an interesting question in the practical context of daily dealings with organisms. Do humans generally understand life’s meaning in the context of history? If we consider the problem of life’s origin, the question of what constitutes a living thing becomes somewhat more acute for the biologist, though not more answerable, because it is inescapable that there was a time when there were no organisms on Earth, followed by a time when there were, the latter time having persisted in continuity to the present. This raises the question of where, in that transition, chemicals on Earth became alive, requiring, in turn, a set of premises for how life arose in order to conceptualize the problem in relation to organisms we know today, including ourselves, which brings us to the point of this paper: In the same way that cultural narratives for origins always start with a setting, scientific narratives for origins also always start with a setting, a place on Earth or elsewhere where we can imagine what happened for the sake of structuring both the problem and the narrative for its solution. This raises the question of whether scientific origins settings convey meaning to humans in that they suggest to us from what kind of place and what kinds of chemicals we are descended, that is, to which inanimate things we are most closely related. In order to improve our understanding of the components that reflect functionally important processes during reward anticipation and consumption, we used principle components analyses (PCA) to separate and quantify averaged ERP data obtained from each stage of a modified monetary incentive delay (MID) task. Although a small number of recent ERP studies have reported that reward and loss cues potentiate ERPs during anticipation, action preparation, and consummatory stages of reward processing, these findings are inconsistent due to temporal and spatial overlap (...) between the relevant electrophysiological components. Our results show three components following cue presentation are sensitive to incentive cues (N1, P3a, P3b). In contrast to previous research, reward‐related enhancement occurred only in the P3b, with earlier components more sensitive to break‐even and loss cues. During feedback anticipation, we observed a lateralized centroparietal negativity that was sensitive to response hand but not cue type. We also show that use of PCA on ERPs reflecting reward consumption successfully separates the reward positivity from the independently modulated feedback‐P3. Last, we observe for the first time a new reward consumption component: a late negativity distributed over the left frontal pole. This component appears to be sensitive to response hand, especially in the context of monetary gain. These results illustrate that the time course and sensitivities of electrophysiological activity that follows incentive cues do not follow a simple heuristic in which reward incentive cues produce enhanced activity at all stages and substages. This chapter proposes a dialectical approach to legal interpretation, consisting of three dimensions: a formalization of the canons of interpretation in terms of argumentation schemes; a dialectical classification of interpretive schemes; and a logical and computational model for comparing the arguments pro and contra an interpretation. The traditional interpretive maxims or canons used in both common and civil law are translated into defeasible patterns of arguments, which can be evaluated through sets of corresponding critical questions. These interpretive argumentation schemes are (...) classified in general categories and a distinction is drawn between schemes supporting and rebutting an interpretation. This framework allows conceiving statutory interpretation as a dialectical procedure consisting in weighing arguments pro and contra an interpretation. Government agencies and nonprofit organizations have increasingly turned to randomized controlled trials (RCTs) to evaluate public policy interventions. Random assignment is widely understood to be fair when there is equipoise; however, some scholars and practitioners argue that random assignment is also permissible when an intervention is reasonably expected to be superior to other trial arms. For example, some argue that random assignment to such an intervention is fair when the intervention is scarce, for it is sometimes fair to use a (...) lottery to allocate scarce goods. We investigate the permissibility of randomization in public policy RCTs when there is no equipoise, identifying two sets of conditions under which it is fair to allocate access to a superior intervention via random assignment. We also reject oft-made claims that alternative study designs, including stepped-wedge designs and uneven randomization, offer fair ways to allocate beneficial interventions. (shrink)

As políticas de privatização da educação e as formas pelas quais se materializam têm assumido contornos sem precedentes no tempo presente e são emblemas das mutações da face social do Estado no provimento e garantia do direito humano à educação, como consequência da ascensão e capilaridade dos princípios neoliberais no tecido social que se apoiam, por sua vez, na primazia do capital financeiro e na concentração da riqueza. No Brasil, o direito à educação é matéria do texto constitucional nos títulos (...) “II – Dos direitos e garantias fundamentais” e “VIII – Da ordem social” (BRASIL, 1988), além de outras disposições e tangencia, em maior ou menor medida, todas as legislações infraconstitucionais. Pelo fato de ser fundante e crucial para a garantia do direito humano à educação, a defesa da oferta, currículo e gestão da educação pela esfera pública constitui-se em uma pauta candente para as pesquisas acadêmicas e para o ativismo social, uma vez que se trata da defesa de direitos em risco e de contraposições às mecânicas de poder que contribuem para a corrosão da esfera pública. Balanços analíticos e interpretativos de evidências empíricas, realizadas por pesquisadores sobre o fenômeno da privatização da educação em diferentes países e territórios têm desvelado reconfigurações normativas, práticas gestoriais e desenhos curriculares elucidando a magnitude do alcance das políticas e práticas mercantis e privatistas no âmbito educacional, em escala mundial. As reformas educacionais de cariz privatista induzidas por atores privados têm sido orquestradas por regimes ou modelos de governança da educação denominados como “governo empresarial” por Dardot e Laval (2016), como gestão corporativa da educação (Croso e Magalhaes, 2016) ou ainda por parcerias público-privadas (Robertson e Verger, 2012). Em substância, os processos privatistas se concretizam mediante uma apropriação teórico-prática das políticas educacionais de forma orgânica e multiforme, incidindo sobre a gestão escolar; a formação de docentes e de gestores; assessorias pedagógicas; a oferta de tecnologias educacionais; os sistemas privados de ensino que padronizam projetos curriculares, dentre outros insumos pedagógicos, além do incentivo à programas de escolha parental que disputam os fundos públicos (Adrião, 2018). Essa miríade de formas de privatização da educação ocasiona efeitos nefastos à consolidação da educação como direito público e subjetivo, conquista consagrada em cartas constitucionais da grande maioria dos países do globo, dentre outros códigos legais. No Brasil, pesquisa financiada pela FAPESP e desenvolvida no âmbito da Rede Latino-Americana e Africana de Pesquisadores em Privatização da Educação (ReLAAPPe) sob coordenação geral de Theresa Adrião intitulada Mapeamento das Estratégias de Privatização da Educação Básica no Brasil e coordenada em nível estadual por pesquisadores/as de treze instituições públicas de pesquisa de diferentes regiões do país, mapeia e analisa tendências de privatização materializadas nas redes educacionais dos estados e do Distrito Federal, nas dimensões da oferta educativa, gestão educacional e do currículo (Adrião, 2018)[1]. A pesquisa elucidou a inserção de organizações privadas, fundamentalmente de natureza empresarial, na definição e ou operacionalização de programas educacionais sob a tutela dos entes subnacionais entre 2005 e 2018. Face ao avanço dos multifacetados formatos da privatização da educação, o presente dossiê revela elementos para a problematização do modus operandi do setor privado na escola pública em distintos contextos, de maneira a focalizar criticamente dimensões contíguas entre esta efeméride e a agenda globalmente estruturada para a educação (DALE, 2004). Trata-se de um esforço coletivo derivado de ações investigativas conectadas ao supracitado coletivo de pesquisa para dar visibilidade à teleologia empresarial que tem se reverberado na esfera pública, cuja aquiescência de governos ultraconservadores e determinações históricas da conjuntura atual têm encarregado de conformar. As análises aqui disponibilizadas constituem-se em importantes alternativas analíticas para dissipar narrativas hegemônicas que produzem colapsos na cidadania e nos Direitos Humanos dos estratos historicamente empobrecidos. A tentativa é apresentar neste artigo uma interpretação possível sobre o processo evolutivo da cosmologia da época sob o enfoque da filosofia de Laudan, baseado nas tradições de pesquisa, teorias específicas, modelo reticulado, progresso científico, metodologia, axiologia, etc. Abordaremos sobre a questão da aceitação das teorias específicas, a questão da eficácia na resolução de problemas, entre outras questões importantes para a (...) interpretação mencionada. O recorte histórico será importante enquanto elemento que permitiria visualizar esta interpretação filosófica e sobre como seria possível pensar em um modelo de reticulação neste contexto, na tentativa de apresentar os tensionamentos entre os componentes da tradição de pesquisa, como forma de destacar a necessidade de revisão constante destes elementos historicamente, dentro do processo evolutivo das tradições de pesquisa. Utilizaremos como base especialmente as obras O progresso e seus problemas: rumo a uma teoria do crescimento científico (2011) [1977] e Science and Values (1984). (shrink)

Abstract This paper addresses the role that argumentation schemes and argument visualization software tools can play in helping to find and counter objections to a given argument one is confronted with. Based on extensive analysis of features of the argumentation in these two examples, a practical four-step method of finding objections to an argument is set out. The study also applies the Carneades Argumentation System to the task of finding objections to an argument, and shows how this system has some (...) capabilities that are especially useful.
