The Mahayana tradition in Buddhist philosophy is defined by its ethical orientation--the adoption of bodhicitta, the aspiration to attain awakening for the benefit of all sentient beings. And indeed, this tradition is known for its literature on ethics, which reflect the Madhyamaka tradition of philosophy, and emphasizes both the imperative to cultivate an attitude of universal care (karuna) grounded in the realization of emptiness, impermanence, independence, and the absence of any self in persons or other phenomena.This position is morally very (...) attractive, but raises an important problem: if all phenomena, including persons and actions, are only conventionally real, can moral injunctions or principles be binding, or does the conventional status of the reality we inhabit condemn us to an ethical relativism or nihilism? In Moonpaths, the Cowherds address an analogous problem in the domain of epistemology and argues that the Madhyamaka tradition has the resources to develop a robust account of truth and knowledge within the context of conventional reality. The essays explore a variety of ways in which to understand important Buddhist texts on ethics and Mahayana moral theory so as to make sense of the genuine force of morality. (shrink)

This twelfth volume of Correspondence contains authoritative and fully annotated texts of all known letters sent both to and from Bentham between July 1824 and June 1828. The 301 letters, most of which have never before been published, have been collected from archives, public and private, in Britain, the United States of America, Switzerland, France, Japan, and elsewhere, as well as from the major collections of Bentham Papers at University College London Library and the British Library.In mid-1824 Bentham was still (...) preoccupied with the Greek struggle for independence against Turkey, though his active involvement waned as he became disenchanted with the behaviour of the deputies sent to London by the Greek National Assembly. His international reputation was reflected in his continuing contact with Simón Bolívar and Bernardino Rivadavia in South America, and with John Quincy Adams, John Neal, Henry Wheaton, and others in the United States, and his forging of new contacts in Guatemala, India, and Egypt. In the autumn of 1825 he visited France, where he stayed with Jean Baptiste Say and La Fayette, and was fêted by the French liberals.Bentham made considerable progress drafting material for his pannomion, or complete code of laws, and in particular for his Constitutional and Procedure Codes, while John Stuart Mill edited the massive Rationale of Judicial Evidence. Bentham became increasingly active in the cause of law reform, and exchanged a series of letters on the subject with Robert Peel, the Home Secretary, and Henry Brougham. He maintained his friendships with John and Sarah Austin, George and Harriet Grote, James and John Stuart Mill, John Bowring, Joseph Hume, Francis Burdett, Francis Place, and Joseph Parkes, re-established contact with the third Marquis of Lansdowne, son of his old friend the first Marquis, and made new acquaintances in James Humphreys, Sutton Sharpe, and Albany Fonblanque. The paper presents a comprehensive solution to the new riddle of induction. Gruesome induction is blocked because “grue” is not independent of our sampling and observation methods. Before presenting my theory, I critically survey previous versions of what I call the “independence strategy”, tracing the strategy to three different papers from the 1970s by (respectively) Wilkerson, Moreland, and Jackson. Next I critically examine recent approaches by Okasha, Godfrey-Smith, Schramm, and Freitag. All of these approaches have their virtues, but none of (...) them rules out every problem case. Nor do any of them alone explain exactly what goes wrong in all types of gruesome reasoning. My account aims to do both. Learning lessons from my criticisms of previous theories, I argue that there are several crucial types of independence. All of them are needed to rule out every problem case. I close by suggesting that the independence solution can also be adopted by proponents of other approaches—Bayesians, fans of natural kinds, and pragmatists. (shrink)

In the latter half of the twentieth century, philosophers of science have argued (implicitly and explicitly) that epistemically rational individuals might compose epistemically irrational groups and that, conversely, epistemically rational groups might be composed of epistemically irrational individuals. We call the conjunction of these two claims the Independence Thesis, as they together imply that methodological prescriptions for scientific communities and those for individual scientists might be logically independent of one another. We develop a formal model of scientific inquiry, define four (...) criteria for individual and group epistemic rationality, and then prove that the four definitions diverge, in the sense that individuals will be judged rational when groups are not and vice versa. We conclude by explaining implications of the inconsistency thesis for (i) descriptive history and sociology of science and (ii) normative prescriptions for scientific communities. (shrink)

Much of the literature on the relationship between belief and credence has focused on the reduction question: that is, whether either belief or credence reduces to the other. This debate, while important, only scratches the surface of the belief-credence connection. Even on the anti-reductive dualist view, belief and credence could still be very tightly connected. Here, I explore questions about the belief-credence connection that go beyond reduction. This paper is dedicated to what I call the independence question: just how independent (...) are belief and credence? I look at this question from two angles: a descriptive one (as a psychological matter, how much can belief and credence come apart?) and a normative one (for a rational person, how closely connected are belief and credence?) Ultimately, I suggest that the two attitudes are more independent than one might think. (shrink)

On an increasingly popular view of rationality, rationality is fundamentally about responding correctly to reasons and there is no independent rational requirement to avoid incoherence: having an incoherent combination of attitudes is irrational not because there is a fundamental requirement of rationality that prohibits it, but rather because you are guaranteed to fail to respond correctly to reasons in having it. This paper argues that any such attempt to explain the irrationality of incoherence in terms of responsiveness to reasons fails. (...) For there is something distinctively irrational about incoherence that is not explained in terms of the guaranteed failure to respond to reasons. Any adequate account of the nature of coherence requirements on belief and intention should take into account the distinctive kind of commitments involved in each type of attitude. A new Evidence Test is applied to the problem of testing whether two Poisson random variables are dependent. The dependence structure is that of Holgate’s bivariate distribution. These bivariate distribution depends on three parameters, 0 < theta_1, theta_2 < infty, and 0 < theta_3 < min(theta_1, theta_2). The Evidence Test was originally developed as a Bayesian test, but in the present paper it is compared to the best known test of the hypothesis of independence in a frequentist framework. In this paper we prove the independence of $\delta^1_n$ for n $\geq$ 3. We show that $\delta^1_4$ can be forced to be above any ordinal of L using set forcing. For $\delta^1_3$ we prove that it can be forced, using set forcing, to be above any L cardinal $\kappa$ such that $\kappa$ is $\Pi_1$ definable without parameters in L. We then show that $\delta^1_3$ cannot be forced by a set forcing to be above every cardinal of L. Limited research has focused on the influence of judge independence on firms' corporate social responsibility (CSR), despite extensive literature examining the impact of the legal environment on CSR. To address this gap, we analyze the staggered adoption of judicial delocalization reform in China. This reform aimed to enhance local judges' independence and our analysis shows that firms have exhibited higher CSR scores since its implementation. Our channel analysis reveals an increase in lawsuits and monetary claims against firms due to the (...) reform, indicating that firms engage in CSR activities to mitigate the negative effects of legal proceedings. The impact of the reform on CSR is stronger for high-litigation-risk firms and weaker for politically connected firms. Moreover, the positive relationship between the reform and CSR is more pronounced in regions with higher levels of government interference with judges before the reform. In summary, our findings highlight the important role of a supportive legal environment in fostering CSR, emphasizing the influence of judge independence. (shrink)

The variety-of-evidence thesis has been criticized by Bovens and Hartmann. This article points to two limitations of their Bayesian model: the conceptualization of unreliable evidential sources as randomizing and the restriction to comparing full independence to full dependence. It is shown that the variety-of-evidence thesis is rehabilitated when unreliable sources are reconceptualized as systematically biased. However, it turns out that allowing for degrees of independence leads to a qualification of the variety-of-evidence thesis: as Bovens and Hartmann claimed, more independence does (...) not always imply stronger confirmation. After criticizing three common conceptions of therelationship between practical ethics and ethical theory, analternative modeled on Aristotle's conception of the relationshipbetween rhetoric and philosophical ethics is explored. Thisaccount is unique in that it neither denigrates the project ofsearching for an adequate comprehensive ethical theory norsubordinates practical ethics to that project. Because the purpose of practical ethics, on this view, is tosecure the cooperation of other persons in a way that respectstheir status as free and equal, it seeks to influence thejudgments (...) of others by providing them with reasons that areaccessible to their own understanding. On this account, theindependence of practical ethics is rooted in an appreciation ofthe constraints that non-ideal circumstances place on the rolethat the philosophically refined premises of moral theory canplay in such public deliberations. Practical and philosophicalethics are united, not by shared theoretical frameworks orprinciples, but by the need to exercise intelligently the sameintellectual and affective capacities. They are separated, notby the particularity or generality of their starting points, butby their responsiveness to the practical problem of facilitatingsound normative deliberations among persons as we find them,under non-ideal circumstances. Since antiquity, Confucians have sought to work with the state in order to implement their philosophy through state sponsorship. And yet, whenever Confucians have sought state sponsorship, naturally the government has adopted Confucian philosophy selectively to serve its own purposes and thus compromised the integrity of Confucianism. Throughout Chinese history, countless Confucian officials attempted to help rulers to do the right thing. They often failed when their advice went against the fundamental interest of rulers. On reflection, this outcome should not (...) be unexpected. The primary goal of rulers is to solidify power; the primary concern of Confucianism is the wellbeing of the people. When the two conflict, it is highly unlikely for a government to prioritize Confucian ideals. In a democratic era, Confucianism can influence society without joining the state apparatus. It can and must promote its social ideals through grassroots democratic participation rather than leave itself to the mercy of state sponsorship. (shrink)

The relation between Church and state is nowadays at stake. This article concerns the relation between Church and state from an ecclesiastical and canonical point of view. It makes clear, how the ecclesiastical doctrine reacts to social developments in relation to the national state in order to safeguard the independence of the Church. The 19th century ecclesiastical doctrine on the Church as a societas perfecta reacts on doctrines on the national states, which claimed absolute sovereignty and by that subordinated the (...) Church to the civil government and civil law. With societas perfecta doctrine the Church defends its sovereignty in the domain of the spiritual good of men. In this way the Church defines and protects its divine origin and independence from the national state. In the first half of the 20th century the democratic and constitutional national states were developed, which acknowledges religious freedom on a constitutional level as a human and a civil right. Because of this progress the Second Vatican Council could formulate its doctrine on religious freedom based on the traditional ecclesiastical teaching of the freedom of the religious act. By then, the independence of the Church is founded and defended on the freedom of the Church, which is guaranteed in national states, which acknowledge religious freedom as a human and civil right. Although one can say that there is discontinuity in the ecclesiastical teaching on the Church as a societas perfecta and the ecclesiastical doctrine on religious freedom, there exists also continuity, because both ecclesiastical doctrines intend to safeguard the independence of the Church in human society. It was proved recently that Telgársky’s conjecture, which concerns partial information strategies in the Banach–Mazur game, fails in models of \. The proof introduces a combinatorial principle that is shown to follow from \, namely: \::Every separative poset \ with the \-cc contains a dense sub-poset \ such that \ for every \. We prove this principle is independent of \ and \, in the sense that \ does not imply \, and \ does not imply \ assuming the consistency (...) of a huge cardinal. In particular, it is argued that Grossmann fails to show that non-existent objects may not be constituents of states of affairs and fails to provide an adequate alternative analysis of states of affairs which putatively contain nonexistent items. Grossmann, in fact, is guilty of a pervasive psychologistic misinterpretation of Meinong according to which Meinong believed that objects have all the properties with which they appear before the mind. In an earlier paper I argued that Alvin Plantinga's defence of pure experiential theism (a theism epistemically based on religious experience) against the evidential problem of evil is inappropriately circular. Eric Snider rejects my argument claiming first that I do not get Plantinga's thought right. Second, he rejects a key principle my argument relies on, viz. the 'independence constraint on neutralizers'. Finally, he offers an alternative to the independence constraint which allows the pure experiential theist to deal successfully with the (...) evidential problem of evil. In this paper I argue that: (a) I have correctly characterized Plantinga's argument; and (b) that Snider's proposed counter-example to the independence constraint fails. Finally, I argue (c) that Snider's proposed alternative to the independence constraint is not a plausible epistemic principle. (shrink)

Rawls in his later philosophy claims that it is sufficient to accept political conception as true or right, depending on what one's worldview allows, on the basis of whatever reasons one can muster, given one's worldview (doctrine). What political liberalism is interested in is a practical agreement on the political conception and not in our reasons for accepting it. There are deep issues (regarding deep values, purpose of life, metaphysics etc.) which cannot be resolved through invoking common reasons (this is (...) the fact of free reason itself), and trying to resolve them would involve us in interminable debates and would hamper the practical task of agreement on the political conception. Given the absolute necessity of a political society which is stable and enduring, it is thus wise to avoid these issues in founding a political society and choosing its basic principles - this is the pragmatic part of Rawls's position. In this paper I argue that this strategy leads Rawls into a paradox: (i) although the intention is to stay independent of comprehensive doctrines, the political conception is in fact totally (and precariously) dependent on comprehensive doctrines (not just on one doctrine but on each and every major doctrine in society). It is dependent on them: for its conceptualisation as an independent idea, for its justification, for the check of its reasonability in relation to the external world, for the formation of identities and value inculcation and hence for the formation of its model citizen; (ii) the very search for independence makes the political conception more dependent on comprehensive doctrines, and by extension makes it potentially more prone to intervention in and tampering with comprehensive doctrines (it is enough to show that it is a strong conceptual possibility to cast doubt on the whole strategy). Thus, for example, the political conception relies on the hope that “firmly held convictions gradually change” and that it would “in fact . . . have the capacity to shape those doctrines toward itself”. The purpose of the Rawlsian conjecture is to give these “hopes” a concrete, practical form by giving advice to proponents of the comprehensive doctrine on how they can do all this and “try to show them that, despite what they might think, they can still endorse a reasonable political conception”. I further argue that this paradox can be overcome by making the core of political liberalism more flexible. (shrink)

The problem of peer disagreement is to explain how you should respond when you and a peer have the same evidence bearing on some proposition and are equally competent epistemic agents, yet have reached opposite conclusions about. According to Christensen's Independence Thesis, in assessing the effect of your peer's disagreement, you must not rely on the reasoning behind your initial belief. I note that ‘the reasoning behind your initial belief’ can be given either a token or type reading. I argue (...) that the type reading is false, but the token reading is extremely weak. (shrink)

In this paper, we deal with a relationship among the law of excluded middle, the double negation elimination and the independence of premiss rule ) for intuitionistic predicate logic. After giving a general machinery, we give, as corollaries, several examples of extensions of \ and \ which are closed under \ but do not derive the independence of premiss axiom.

This paper discusses the relation between medical ethics and general moral theory, the argument being that medical ethics is best seen as independent from general moral theory. According to this independence thesis, here explicated in terms of what is called a disunitarian stance, the very idea of applied ethics, which is often seen as underlying medical ethics, is misguided. We should instead think of medical ethics as a domain-specific ethical inquiry among other domain-specific ethical inquiries. On this alternative kind of (...) picture, such ethical inquiries should start with looking at the particularities of the domain under consideration and then proceed from there. Some possible consequences of this idea for medical ethics are then identified and discussed. (shrink)

This paper traces how media representations encouraged enthusiasts, youth and skilled volunteers to participate actively in science and technology during the twentieth century. It assesses how distinctive discourses about scientific amateurs positioned them with respect to professionals in shifting political and cultural environments. In particular, the account assesses the seminal role of a periodical, Scientific American magazine, in shaping and championing an enduring vision of autonomous scientific enthusiasms. Between the 1920s and 1970s, editors Albert G. Ingalls and Clair L. Stong (...) shepherded generations of adult ‘amateur scientists’. Their columns and books popularized a vision of independent nonprofessional research that celebrated the frugal ingenuity and skills of inveterate tinkerers. Some of these attributes have found more recent expression in present-day ‘maker culture’. The topic consequently is relevant to the historiography of scientific practice, science popularization and science education. Its focus on independent nonprofessionals highlights political dimensions of agency and autonomy that have often been implicit for such historical (and contemporary) actors. The paper argues that the Scientific American template of adult scientific amateurism contrasted with other representations: those promoted by earlier periodicals and by a science education organization, Science Service, and by the national demands for recruiting scientific labour during and after the Second World War. The evidence indicates that advocates of the alternative models had distinctive goals and adapted their narrative tactics to reach their intended audiences, which typically were conceived as young persons requiring instruction or mentoring. By contrast, the monthly Scientific American columns established a long-lived and stable image of the independent lay scientist. (shrink)

Rest's hypothesis that the components of morality (i.e., sensitivity, reasoning, motivation, and implementation) are distinct from one another was tested using evidence from a dental ethics curriculum that uses well-validated measures of each component. Archival data from five cohorts (n = 385) included the following: (1) transcribed responses to a measure of ethical sensitivity collected at the end of the third year; (2) pre- and post-test moral judgment scores; (3) pre- and post-test motivation scores; and (4) implementation scores – performance (...) on eight cases completed during the third and fourth years. Because the ethical sensitivity test had been scored by multiple raters, and interrater reliability did not meet acceptable standards, 120 portfolios were randomly selected from the five cohorts and responses were rescored prior to analysis. Correlations among the measures were low, ranging from −.08 to.34, supporting Rest's contention that the processes are distinct from one another and competence in one does not predict competence in another. We provide a general theorem implying that for a (strongly) dependent theory T the theory of sufficiently well-behaved pairs of models of T is again (strongly) dependent. We apply the theorem to the case of lovely pairs of thorn-rank one theories as well as to a setting of dense pairs of first-order topological theories.

The independence of research is a key strategic issue of modern societies. Dealing with it appropriately poses legal, economic, political, social and cultural problems for society, which have been studied by the corresponding disciplines and are increasingly the subject of reflexive discourses of scientific communities. Unfortunately, problems of independence are usually framed in disciplinary contexts without due consideration of other perspectives’ relevance or possible contributions. To overcome these limitations, we review disciplinary perspectives and findings on the independence of research and (...) identify interdisciplinary prospects that could inform a research programme. We give an alternative proof of the stability of separably closed fields of fixed Éršov invariant to the one given in [W]. We show that in case the Éršov invariant is finite, the theory is in fact equational. We also characterize the independence relation in those theories.
