Par quel sursaut un Aristoclès se fait-il Platon, jusqu'à s'imposer dans la liste des " auteurs philo " Il faut enquêter, non pas sur la vie privée, mais sur la vie intime : rumination intellectuelle, ton sur lequel on parle, motivations amoureuses... Ce qui fait un philosophe, c'est un immense travail sur soi, et la rencontre d'autres philosophes, vivants, de leurs problématiques. Mémoire sémantique + obsession métaphysique, voilà le code génétique du philosophe. Il débute par un (...) attentat religieux, puisqu'il commence sa carrière en niant tel ou tel sacré. Bien sûr, il vaut mieux être mâle, communiquer par les livres adopter la langue dominante, écrire quand on est célibataire. Comment gagner sa vie? Pas forcément en étant enseignant, comme c'est le cas aujourd'hui. Le profil du philosophe nous le révèle orphelin, vivant à l'étranger, souvent laid, jamais fou, et serial thinker, prêt à changer de philosophie pourvu qu'il reste, lui, à menacer le monde donnera ou donnera pas du sens à notre vie? Le philosophe est l'être inquiet qui pense inquiéter l'Être par deux trois mots bien aiguisés. (shrink)

« Je t’aime moi non plus », le titre de la fameuse chanson de Gainsbourg reflète de manière exquise ce que la vie a de beau et d’amer à la fois. A défaut de traiter d’amour, cet ouvrage analyse les méandres de l’aide à sens unique. L’altruisme, ce comportement de don sans attente de retour de service, est abordé ici de manière scientifique et philosophique plutôt que poétique et littéraire. Un objectif est d’en traquer les mécanismes sous-jacents, ceux qui échappent (...) à tout romantisme et se traduisent souvent en calculs de coûts et bénéfices. Il s’agit également d’approfondir les diverses manières de comprendre et de pratiquer l’altruisme. Souvent considéré comme une des plus grandes vertus humaines, l’objet de nombreux écrits philosophiques et psychologiques, l’altruisme peut-il se trouver chez les abeilles et les marmottes ? Posez la question à un biologiste de l’évolution et il vous répondra « Mais oui, évidemment ! ». A première vue, une telle réponse est consternante mais nous verrons qu’à y regarder de plus près, les philosophes et les biologistes ne parlent pas exactement de la même chose en utilisant le même terme. L’hétérogénéité des disciplines intéressées à l’altruisme et des contextes théoriques dans lesquels il est utilisé en ont fait une notion extrêmement complexe et difficile à saisir. Au sein des différentes sciences sociales et du vivant, l’altruisme est un élément pivot dans trois débats dont cet ouvrage prend le temps de retracer les contours. Tantôt, l’altruisme se profile en danger (apparent) pour la théorie de l’évolution darwinienne (chap. 1), tantôt, il sert de cheval de bataille dans la croisade contre l’idéal de l’homo economicus si souvent prôné en économie (chap. 2 et 3), tantôt il est une énigme à découvrir dans les méandres de nos motivations intimes (chap. 3). Dans le cadre de ces différents débats, la notion d’altruisme prend des significations sensiblement différentes. Pour en rendre compte, l’ensemble de l’ouvrage s’articule autour d’une triple distinction fondamentale : l’altruisme peut être compris au sens biologique, comportemental ou psychologique. Chacune de ces notions est utilisée dans un contexte spécifique au sein de sciences qui ont leurs propres traditions et leurs propres débats internes. La structure de l’ouvrage est organisée en fonction de cette triple distinction. Le premier chapitre est consacré à l’altruisme biologique, définit en termes de valeur de survie et de reproduction (fitness) : un comportement est altruiste s’il a pour effet d’augmenter la fitness d’autrui aux dépens de sa propre fitness. L’observation de comportements altruistes au sein du monde animal a posé un des plus grands défis à la théorie de l’évolution depuis la publication de l’Origine des espèces. Des générations de biologistes se sont attelés à la tâche d’expliquer comment un comportement qui augmente la fitness biologique d’autres organismes aux dépends de la fitness de l’agent a pu être sélectionnée au fil de l’évolution. Nous verrons que c’est grâce aux travaux de William Hamilton et d’autres que cette difficulté a pu être résolue. Le deuxième chapitre retrace les attaques d’une frange d’économistes (supportés dans leur effort critique par des théoriciens des jeux et anthropologues évolutionnistes), contre le modèle classique de l’homo economicus. Leur objectif est de montrer que des personnes ordinaires ne se comportement souvent pas en maximisateurs rationnels de leurs gains propres, comme le prédirait la théorie économique néo-classique. Dans le cadre de ce débat, c’est du comportement social spécifiquement humain et plus particulièrement de l’altruisme humain dont il est question. Le terme d’altruisme est alors utilisé dans un sens plus lâche que ne le font les biologistes ; ce que l’on appellera l’altruisme comportemental comprend les actions coûteuses pour l’agent et avantageuses pour autrui. La particularité humaine fournira également l’occasion de traiter la délicate question des rapports entre l’évolution génétique et la culture. Nous verrons que l’étude du comportement animal fournit les premiers éléments d’explication de l’altruisme humain, mais ce dernier ne peut être pleinement compris qu’au terme d’une analyse qui tient compte des capacités qui nous sont propres. Cette analyse nous permettra de saisir pourquoi les êtes humains sont à la fois plus sociaux et plus opportunistes (la contradiction n’est qu’apparente) que les autres espèces animales. Malgré leurs différences, les versions biologique et comportementale de l’altruisme sont très proches au sens où elles traitent des conséquences de comportements. Ces notions ne reflètent qu’imparfaitement la conception ordinaire que nous nous faisons de l’altruisme. L’altruisme tel qu’il est utilisé dans le langage courant correspond davantage à l’image que s’en font les philosophes et les psychologues. Pour déceler les actions altruistes, ces derniers se demandent généralement si elles ont été causées par un motif dirigé vers le bien d’autrui. En ce sens, on parle d’altruisme psychologique qui réfère aux causes plutôt qu’aux effets des actions d’aide. Le troisième chapitre est consacré aux débats qui font rage autour de la question de savoir si les êtres humains sont capables d’agir de manière altruiste psychologique, c’est-à-dire en fonction de motifs exclusivement dirigés vers le bien-être d’autrui. Nous verrons à quel point cette tâche est ardue à moins d’accepter de reformuler la question en termes de motivation primaire à l’action. Au terme de l’analyse, il apparaitra que les trois notions d’altruisme se croisent sans se recouper dans un enchevêtrement de liens plus ou moins complexes. Nous verrons par exemple que l’altruisme biologique (voire comportemental) pourrait bien être une condition nécessaire à l’évolution de l’altruisme psychologique ; des liens tangibles peut ainsi être tissés entre ces différentes notions. Les diverses approches du phénomène de l’altruisme retracées dans cet ouvrage fournissent également des clefs de compréhension des méandres du comportement social animal et plus particulièrement humain. De manière générale, sans apporter de solutions toutes faites, cet écrit peut servir de guide sémantique et initie le lecteur à une littérature interdisciplinaire émergeante, foisonnante, passionnante quoique encore souvent parsemée de confusions et de contradictions. L’analyse des réseaux sociaux est menée dans le domaine des sciences sociales depuis les années 1930. Le premier enjeu pour réaliser ces analyses se situe dans la collecte de l’information sur la structure de ces réseaux et sur leurs activités. Avec l’avènement du Web 2.0 et des technologies du Web sémantique, plusieurs mécanismes de collecte d’information sont désormais envisageables. Cependant, très peu d’utilisateurs sont conscients des facilités d’atteinte et de manipulation de leurs traces d’activités et de leurs données personnelles (...) de plus en plus rendus publics sur les réseaux socionumériques en particulier. Dans cet article, nous étudions les différentes approches permettant l’accès aux données dans les réseaux socionumériques, en nous intéressant − dans le cas précis de Facebook − à la qualité et la quantité de l’information accessible, et par conséquent, aux risques potentiels d’atteinte et de manipulation des données personnelles des utilisateurs par des tiers. Une expérimentation menée via l’API Facebook démontre l’accessibilité à un nombre important d’informations pouvant permettre de reconstruire automatiquement le réseau réel d’un utilisateur à partir de son profil.Social networks have been an object of analysis by the social sciences since the 1930s. The first challenge in performing these analyses is to gather information on the structure of these networks and on their activities. With the advent of Web 2.0 and semantic Web technologies, several different mechanisms can be used for this. However, few users are aware of how easy it is to access and manipulate the traces left by their activities and, especially on the social networks, by their personal data, which is becoming increasingly public. In this article, we look into the different ways of accessing data on the social networks, and – on Facebook in particular – into the quality and quantity of the information available and therefore the potential risks of users finding that third parties are accessing and manipulating their personal information. An experiment conducted via API Facebook shows that a great deal of information is accessible that can be used to automatically reconstruct a user’s actual network from their profile. (shrink)

In the Philippines, all transplant centers are mandated by the Department of Health (DOH) to have a Hospital Transplant Ethics Committee (HTEC) to ensure that donations are altruistic, voluntary and free of coercion/commercial transactions. This study was undertaken primarily to describe the organizational and functional profile of existing HTECs and identify areas for improvement. This is a descriptive cross‐sectional study. There was variation in their logistical arrangements (support from hospital, filing systems, office spaces), operations (length and frequency of meetings, number (...) of referrals) and membership (composition, qualifications, occupation, training). The approval rate for donor‐recipient pairs is high with the majority of cases made by living non‐related donors. Appropriate reasons were cited for rejection. The perception of HTECs is that they are competent and confident in their decision‐making. However, there is a need to standardize HTEC composition, provide operating procedures and additional training which can be done by the DOH. (shrink)

I argue that traditional views on which beliefs are subject only to purely epistemic assessment can reject demographic profiling, even when based on seemingly robust evidence. This is because the moral failures involved in demographic profiling can be located in the decision not to suspend judgment, rather than supposing that beliefs themselves are a locus of moral evaluation. A key moral reason to suspend judgment when faced with adverse demographic evidence is to promote social equality—this explains why positive profiling is (...) dubious, along with more familiar cases of negative profiling, and why profiling is suspect even when no particular action is at stake. My suspension-based view, while compatible with revisionary normative positions, does not presuppose them. Philosophers of all stripes can reject demographic profiling both in thought and deed. It is well-established that algorithms can be instruments of injustice. It is less frequently discussed, however, how current modes of AI deployment often make the very discovery of injustice difficult, if not impossible. In this article, we focus on the effects of algorithmic profiling on epistemic agency. We show how algorithmic profiling can give rise to epistemic injustice through the depletion of epistemic resources that are needed to interpret and evaluate certain experiences. By doing so, we not only demonstrate how (...) the philosophical conceptual framework of epistemic injustice can help pinpoint potential, systematic harms from algorithmic profiling, but we also identify a novel source of hermeneutical injustice that to date has received little attention in the relevant literature: epistemic fragmentation. Epistemic fragmentation is a structural characteristic of algorithmically-mediated environments that isolate individuals, making it more difficult to develop, uptake and apply new epistemic resources. This, in turn, can impede the identification and conceptualisation of emerging harms in these environments. We trace the occurrence of hermeneutical injustice back to the fragmentation of the epistemic experiences of individuals, who are left more vulnerable by the inability to share, compare, and learn from shared experiences. This paper presents a novel framework for evaluating racial profiling, including 'rational profiling' that does in fact decrease crime rates. It argues that while profiling some groups, such as African Americans and Muslims, is impermissible, profiling others, such as white men, may be permissible. The historical and sociological context matters significantly. Along the way, the paper develops a new theory of what expressive harms are, why they matter, and when it is the responsibility of the state to correct them.

Many oppose the use of profile evidence against defendants at trial, even when the statistical correlations are reliable and the jury is free from prejudice. The literature has struggled to justify this opposition. We argue that admitting profile evidence is objectionable because it violates what we call “equal protection”—that is, a right of innocent defendants not to be exposed to higher ex ante risks of mistaken conviction compared to other innocent defendants facing similar charges. We also show why admitting other (...) forms of evidence, such as eyewitness, trace, and motive evidence, does not violate equal protection. (shrink)

Cet article a pour objectif de soutenir que certains éléments de sens communiqués par un énoncé, qui sont le plus souvent vus dans la sémantique vériconditionnelle ordinaire comme implicites, sont susceptibles d’être réanalysés dans une sémantique argumentative, la Théorie des Blocs Sémantiques, comme faisant partie du contenu explicite de l’énoncé, dans la mesure où de tels éléments constituent des « enchaînements argumentatifs » sémantiquement indécomposables.

Many theorists hold that outright verdicts based on bare statistical evidence are unwarranted. Bare statistical evidence may support high credence, on these views, but does not support outright belief or legal verdicts of culpability. The vignettes that constitute the lottery paradox and the proof paradox are marshalled to support this claim. Some theorists argue, furthermore, that examples of profiling also indicate that bare statistical evidence is insufficient for warranting outright verdicts.I examine Pritchard's and Buchak's treatments of these three kinds of (...) case. Pritchard argues that his safety condition explains the insufficiency of bare statistical evidence for outright verdicts in each of the three cases, while Buchak argues that her treatment of the distinction between credence and belief explains this. In these discussions the three kinds of cases – lottery, proof paradox, and profiling – are treated alike. The cases are taken to exhibit the same epistemic features. I identity significant overlooked epistemic differences amongst these three cases; these differences cast doubt on Pritchard's explanation of the insufficiency of bare statistical evidence for outright verdicts. Finally, I raise the question of whether we should aim for a unified explanation of the three paradoxes. (shrink)

I argue that a compelling way to articulate what is wrong with racial profiling in policing is to view racial profiling as a violation of the presumption of innocence. I discuss the communicative nature of the presumption of innocence as an expression of social trust and a protection against the social condemnation of being undeservingly investigated, prosecuted, and convicted for committing a crime. I argue that, given its communicative dimension, failures to extend the presumption of innocence are an expression of (...) disrespect. I take the New York Police Department’s stop-and-frisk policy as an example of racial profiling and argue that its use of race-based forms of suspicion as reasons for making stops is a violation of the presumption of innocence. I maintain that this systemic failure to extend the presumption of innocence to profiled groups reveals the essentially disrespectful nature of the NYPD policy. (shrink)

Racial profiling appears to be morally more troubling when the racial group that is the object of the profile suffers from background injustice. This article examines two accounts of this intuition. The responsibility-based account maintains that racial profiling is morally more problematic if the higher offender rate within the profiled group is the result of social injustices for which other groups in society are responsible. The expressive harm based account maintains that racial profiling is more problematic if it makes background (...) injustice vivid and thereby causes the profiled to feel resentment. I raise problems with both accounts and suggest a third account. On the humiliation-based account, individuals who are subjected to racial profiling in a context of background injustice are placed in a situation in which they cannot prevent appearing to onlookers in a demeaning way. The science of animal consciousness investigates (i) which animal species are conscious (the distribution question) and (ii) how conscious experience differs in detail between species (the quality question). We propose a framework which clearly distinguishes both questions and tackles both of them. This two-tier account distinguishes consciousness along ten dimensions and suggests cognitive capacities which serve as distinct operationalizations for each dimension. The two-tier account achieves three valuable aims: First, it separates strong and weak indicators of the presence of consciousness. (...) Second, these indicators include not only different specific contents but also differences in the way particular contents are processed (by processes of learning, reasoning or abstraction). Third, evidence of consciousness from each dimension can be combined to derive the distinctive multi-dimensional consciousness profile of various species. Thus, the two-tier account shows how the kind of conscious experience of different species can be systematically compared. (shrink)

This essay will argue for ethical procedures governing criminal profiling. A model based upon psychological/behavioral data, witness data, and forensic profiling data is sketched out. This model fits the legitimate uses of criminal profiling as an investigation procedure. Racial profiling as a primary sorting factor does not fit the preferred model and has significant downsides and so is rejected as a primary sorting mechanism in criminal investigation procedure.

Cette étude vise à comprendre les spécificités sémantiques des lexèmes _manipuler_ et _modifier_ afin d’éclairer l’usage qui en est fait en bioéthique lorsque les actions désignées ont comme objet l’embryon, le cerveau, l’ADN, l’Homme, le vivant ou la procréation. En s’appuyant sur les définitions des dictionnaires et sur les réponses à un questionnaire soumis aux locuteurs, et en se servant de concepts de la sémantique combinatoire, de la sémantique argumentative, de la sémantique des cadres et de l’aspect (...) sémantique, l’étude identifie les éléments de signification propres à chacun des deux lexèmes. Ces éléments sont étroitement liés au potentiel de signification des lexèmes et aux traits aspectuels des procès qu’ils désignent. À l’issue de cette étude, un ensemble de traits sémantiques caractéristiques de chaque lexème est proposé, dans une perspective contrastive. (shrink)

Ricoeur, dans "La métaphore vive", distingue trois entités linguistiques (le mot, la phrase et le discours) et quatre disciplines (rhétorique classique, sémiotique, sémantique, herméneutique), dont les deux premières se situent au même niveau, celui du mot. On retrace la genèse de cette division tripartite, puis on montre que la position subalterne qu'elles assigne à la sémiotique est injustifiée et que, pour respecter le "relatif pluralisme des formes et des niveaux de discours", il vaut mieux se situer dans la perspective (...) d'un cadre sémiologique global. Cette étude a pour objectif de démontrer que chez Alain de Lille, la problématique de l’affirmation et de la négation in divinis n’est pas celle de la montée vers Dieu par l’abandon de toute créature. Chez Alain de Lille, la négation constitue l’élément qui permet de penser, au niveau du langage, la différence ontologique qui existe entre Dieu et le monde. Cela n’a été possible que grâce à la convergence de deux traditions : celle de Jean Scot Érigène et celle (...) de Boèce. Parce qu’Alain de Lille approfondit la structure métaphorique du nom divin, il est alors à même de reposer d’une façon originale la problématique de la négation et de l’affirmation dans le discours théologique. Il n’est plus question chez lui de la possibilité ou non de discourir sur la divinité, il est davantage question de règles de sémantique, et donc d’herméneutique, convenant aux discours affirmatif et négatif sur la divinité. This study shows that professional identity should not be viewed as a composed variable with a uniform structure. Based on the literature and previous research, we view teachers? job satisfaction, self?efficacy, occupational commitment and change in the level of motivation as indicators of teachers? professional identity. Using two?step cluster analysis, three distinct professional identity profiles have empirically been identified, based on data of 1214 teachers working in secondary education in the Netherlands. These profiles differed significantly regarding the indicators of teachers? (...) professional identity. Teachers belonging to the found profiles did not significantly differ in their amount of experience. (shrink)

The tendency towards an increasing integration of the informational web into our daily physical world (in particular in so-called Ambient Intelligent technologies which combine ideas derived from the field of Ubiquitous Computing, Intelligent User Interfaces and Ubiquitous Communication) is likely to make the development of successful profiling and personalization algorithms, like the ones currently used by internet companies such as Amazon, even more important than it is today. I argue that the way in which we experience ourselves necessarily goes through (...) a moment of technical mediation. Because of this algorithmic profiling that thrives on continuous reconfiguration of identification should not be understood as a supplementary process which maps a pre-established identity that exists independently from the profiling practice. In order to clarify how the experience of one’s identity can become affected by such machine-profiling a theoretical exploration of identity is made (including Agamben’s understanding of an apparatus, Ricoeur’s distinction between idem- and ipse-identity, and Stiegler’s notion of a conjunctive–disjunctive relationship towards retentional apparatuses). Although it is clear that no specific predictions about the impact of Ambient Intelligent technologies can be made without taking more particulars into account, the theoretical concepts are used to describe three general scenarios about the way wherein the experience of identity might become affected. To conclude, I argue that the experience of one’s identity may affect whether the cases of unwarranted discrimination resulting from ubiquitous differentiations and identifications within an Ambient Intelligent environment, will become a matter of societal concern. Although it is clear that no specific predictions about the impact of Ambient Intelligent technologies can be made without taking more particulars into account, the theoretical concepts are used to describe three general scenarios about the way wherein the experience of identity might become affected. To conclude, I argue that the experience of one’s identity may affect whether the cases of unwarranted discrimination resulting from ubiquitous differentiations and identifications within an Ambient Intelligent environment, will become a matter of societal concern. Both corporate and global governance seem to demand increasingly sophisticated means for identification. Supposedly justified by an appeal to security threats, fraud and abuse, citizens are screened, located, detected and their data stored, aggregated and analysed. At the same time potential customers are profiled to detect their habits and preferences in order to provide for targeted services. Both industry and the European Commission are investing huge sums of money into what they call Ambient Intelligence and the creation of an ‘Internet (...) of Things’. Such intelligent networked environments will entirely depend on real time monitoring and real time profiling, resulting in real time adaptation of the environment. In this contribution the author will assess the threats and opportunities of such autonomic profiling in terms of its impact on individual autonomy and refined discrimination and indicate the extent to which traditional data protection is effective as regards profiling. Je montrerai en premier lieu comment et pourquoi la sémantique formelle peut être employée comme un outil pour déterminer l’engagement ontologique d’une théorie : je soutiendrai d’une part que la sémantique doit être prise au sérieux comme apte à décrire la vérifaction des formules du langage; d’autre part, que les engagements ontologiques d’une théorie sont déterminés par ses vérifacteurs. De là, j’exposerai une méthode générale permettant, étant donné un certain type d’ontologie, de construire une sémantique dont les (...) engagements ontologiques sont en accord avec celle-ci. Pour cela, je définirai la notion de cadre ontologique : il s’agit d’une structure telle que toute sémantique cons-truite à partir de cette structure aura un certain engagement ontologique déterminé à l’avance. J’exposerai quatre cadres représentant deux types de nominalisme et deux types de réalisme, et j’esquisserai à partir de ces cadres quatre sémantiques pour les langages du premier ordre. (shrink)

In this paper, I intend to reconstruct Ockham’s semantics of the categories in order to prove first that his semantics is consistent. Second, Ockham is not skeptical about the possibility to derive the categories from primitives. According to Ockham, one must accept two principles in order to derive the categories. The first is the principle of ‘in quid’ predication, according to which a name of category can be predicated ‘in quid’ of a determined class of terms. The second is the (...) principle of the transitivity of predication, according to which A is predicated of C if A is predicated of B and B is predicated of C. I will show that Ockham’s semantics of the categories makes two assumptions. According to the first assumption, there exist only two types of things, substances and qualities. According to the second, the categories are mutually exclusive. Ockham’s semantics of the categories implies that the categories are both ontological and conceptual and that it is not possible to prove that there is a determined number of categories. (shrink)

Background Hospital ethical climate has important implications for clinical nurses’ service behavior; however, the relationships are complicated by the fact that five types of ethical climate (caring, law and code, rules, instrumental, and independence) can be combined differently according to their level and shape differences. Recent developments in person-centered methods (e.g., latent profile analysis (LPA)) have helped to address these complexities. Aim From a person-centered perspective, this study explored the distinct profiles of hospital ethical climate and then examined the relationships (...) of the profiles with clinical nurses’ service behavior (both in-role and extra-role service behavior). Research design A quantitative study was conducted using cluster random sampling. Latent profile analysis and binary coded hexadecimal (BCH) analysis were conducted using Mplus 8.2. Participants and research context A total of 871 clinical nurses in China were surveyed using the Ethical Climate Scale and Nurses’ Service Behavior Questionnaire. Ethical considerations Ethical approval was obtained from the IRB of the First Affiliated Hospital of Jinan University (No. KY-2020-090). Results A four-profile hospital ethical climate model provided the best fit for the data. The four different profiles not only varied in level, but also in shape: high normative and low egoism (45.8%), high ethical climate (19.9%), low ethical climate (3.6%), and moderate ethical climate (30.8%). These profiles differentially predicted clinical nurses’ overall, in-role, and extra-role service behaviors. Conclusions The results reveal new insights into the nature of hospital ethical climate and how different clinical nurses in these profiles can be best managed to accomplish different forms of service behavior. The detection of hate speech and fake news in political discourse is at the same time a crucial necessity for democratic societies and a challenge for several areas of study. However, most of the studies have focused on what is explicitly stated: false article information, language that expresses hatred, derogatory expressions. This paper argues that the explicit dimension of manipulation is only one – and the least problematic – of the risks of political discourse. The language of the unsaid is (...) much more dangerous and incomparably more difficult to detect, hidden in different types of fallacies and inappropriate uses of emotive language. Through a threefold coding scheme based on the instruments of argumentation theory and pragmatics, a corpus of argumentative tweets published by 4 politicians (Matteo Salvini, Donald Trump, Jair Bolsonaro, and Joseph Biden) within 6 months from their taking office (corresponding to the official end of their election campaign) is analyzed, detecting the types of argument, the fallacies, and the uses and misuses of “emotive words.” This coding results in the argumentation profiles of the speakers, which are compared statistically to show their different implicit strategies and deceptive tactics. Using the profiles of dialogue method we identify a species of ad verecundiam fallacy that works by forestalling of questioning in arguments from expert opinion. A profile of dialogue is a graph structure used to model a sequence of speech acts surrounding both the putting forward of an argument and the response to it at the next moves in a dialogue. The method is applied to a case of cross-examining a software engineer in a legal deposition in a case of (...) intellectual property litigation. (shrink)

It is commonly held that, given multiple medically permissible ways of proceeding, each with a different impact on the patient’s future, it is extremely important, and part of respecting patient autonomy, that patients not be under substantial pressure to defer to their physicians’ presumed authority. Some, however, worry that the focus on patient autonomy can be detrimental and that, at least in cases where it is hard to grasp what it is really like to live with certain outcomes without any (...) first‐hand or second‐hand experience, it is best if patient choice is firmly directed, or at least effectively nudged, by the recommendation of an experienced medical professional. The idea seems to be that, since physicians cannot get their patients to promptly assimilate a large amount of information and experience, physicians must, if they are to really help their patients make good decisions in hard cases, exert non‐argumentative influence on them. But this neglects an interesting possibility, namely the possibility of influencing patients by providing them with evidence regarding what decisions have proved most satisfactory for patients with their profile. Approximations of patient profile tests are already employed in medical practice. But the potential of the profile‐test approach in medical practice (and research) has been obscured by ongoing debate that neglects the significance of the approach with respect to the apparent dilemma faced by patients who need to make informed, autonomous decisions but cannot be expected to fully assimilate, in short order, the knowledge and experience of their physicians.
