In this article we aim to reduce the force of the expensive tastes objection to equality of welfare by constructing a pluralist welfare egalitarian theory which is not defeated by it. In the first part, we argue that Cohen’s condition of responsibility-sensitiveness is not able to provide a satisfactory rebuttal of the expensive tastes objection for at least a class of theories of justice, namely those that adhere to a methodologically fact-sensitive view. In the second part, we explore the (...) possibility of constructing a welfare egalitarian theory that gives weight to both equality and efficiency. We propose two alternatives, which integrate a utilitarian constraint and a Weak Pareto constraint on equality and show that both theories consistently differentiate between compensable and non-compensable expensive tastes, but should ultimately be rejected because of other unattractive implications. Finally, we develop a fairness-constrained theory of welfare egalitarianism and suggest that it can distinguish between compensable and non-compensable expensive tastes in both a conceptually consistent and a morally plausible manner, without generating decisive additional objections. In this paper I discuss a frequent reply to what is usually called ‘the harshness objection,’ or “the abandonment objection” to luck egalitarianism. This objection has been used by Elizabeth Anderson to argue that luck egalitarianism is not, in any of its versions, an adequate interpretation of the ideal of social justice. According to the luck egalitarian reply discussed in this paper, luck egalitarianism can be saved from the harshness objection by value pluralism. After a few short (...) considerations on luck egalitarianism, on the harshness objection invoked by Anderson, and on pluralism as a strategy of dealing with this objection, I will try to show that, in fact, luck egalitarianism cannot be saved from the harshness objection by value pluralism. Luck egalitarianism is a family of egalitarian theories of distributive justice that aim to counteract the distributive effects of luck. This article explains luck egalitarianism's main ideas, and the debates that have accompanied its rise to prominence. There are two main parts to the discussion. The first part sets out three key moves in the influential early statements of Dworkin, Arneson, and Cohen: the brute luck/option luck distinction, the specification of brute luck in everyday or theoretical terms and (...) the specification of advantage as resources, welfare, or some combination of these. The second part covers three later developments: the democratic egalitarian critique of luck egalitarianism, the luck egalitarian acceptance of pluralism, and luck egalitarian doubts about the significance of the brute luck/option luck distinction. The paper critically examines a series of objections to luck egalitarianism raised by Elizabeth Anderson in her essay “What is the Point of Equality?” According to Anderson, current egalitarian writing has come to be dominated by the distinction between choice and brute luck and that strict adherence to this distinction will mean treating some people in ways we have other egalitarian reasons not to want to treat them.A case is made for moving the debate on by adopting a pluralistic (...) view of the fundamental egalitarian impulse that combines concerns about the influence on people’s lives of brute luck with more traditional egalitarian concerns. It is perfectly consistent with pluralistic egalitarianism to say that someone who faces social oppression or lacks effective access to valued functionings should receive public assistance even if not qua the victim of brute luck. The term “political” egalitarianism is used here, not to refer to equality within the political sphere, but rather in John Rawls’s sense, to refer to a conception of egalitarian distributive justice that is capable of serving as the object of an overlapping consensus in a pluralistic society.1 Thus “political” egalitarianism is political in the same way that Rawls’s “political” liberalism is political. The central task when it comes to developing such a conception of equality is to determine what (...) constraints a principle of equality must satisfy in order to qualify as “freestanding,” or to be justifiable in a way that does not presuppose the correctness of any one member of the set of reasonable yet incompatible “religious, philosophical and moral” doctrines that attract large numbers of adherents in our world.2 (Rawls uses the analogy of a “module” in order to describe the way that a properly political conception of justice “fits into and can be supported by various reasonable comprehensive doctrines that endure in the society regulated by it.”3 Political egalitarianism would be “modular” in this sense.) Rather than getting embroiled in the controversies that have arisen over Rawls’s formulation of this idea, I would like simply to accept the intuition, widespread among political philosophers, that equality is the sort of principle that – if given a proper formulation – could satisfy the requirements of a political conception of justice. After all, regardless of what peoples’ projects, values, or conceptions of the good life may be, it should be possible to design a set of arrangements that would provide equal opportunity to pursue these goals, or that would treat each conception of the good with equal respect, etc. From this perspective, the principle of equality resembles the principle of Pareto-efficiency, or certain formulations of the principle of liberty – it is one that everyone should be able to endorse, insofar as it does not privilege, or presuppose the correctness of, any particular set of projects, values.. Relational Egalitarianism focuses on the construction of equal social relationships between persons. It strongly opposes luck egalitarianism, which understands equality as a distributive ideal. In Cohen’s theory of justice, luck egalitarianism and relational egalitarianism simultaneously exist, and Cohen provides arguments corresponding to each. In this paper, we explore the manifestation of tension between these two forms of egalitarianism in his theory. In addition, we also reconstruct some possible solutions provided by Cohen to soften this tension, (...) including the three approaches of market mechanism, egalitarian ethos and value pluralism, and find them to be unsuccessful. This tension is a serious challenge that needs to be addressed in Cohen’s theory of justice. (shrink)

Some contractualist egalitarians try to accommodate a concern for numbers by embracing a pluralist strategy. They incorporate the belief that the number of people affected matters for what distribution one ought to bring about by arguing that their primary contractualist concern for justifiability to each may be outweighed by aggregative considerations. The present contribution offers two arguments against such a pluralist strategy. First, I argue that advo- cates of the pluralist strategy are forced to abandon the rationale (...) behind the criterion of universal acceptability. Second, I show that pluralist contractualists will be unable to avoid the dreaded conclusion that originally motivated their contractualism. Ultimately, these arguments matter for the nature of egalitarian- ism. They should give those in search of sound distributive principles a reason to make sense of their egalitarian commitment in a non-contractualist way. If a sound set of distributive principles includes comparative and relational princi- ples, while contractualist egalitarianism does not lend itself to being pluralistically combined with non-individualist principles, telic egalitarianism may after all be part of the truth in distributive ethics. Luck egalitarianism makes a fundamental distinction between inequalities for which agents are responsible and inequalities stemming from luck. I give several reasons to find luck egalitarianism a compelling view of distributive justice. I then argue that it is an incomplete theory of equality. Luck egalitarianism lacks the normative resources to achieve its ends. It is unable to specify the prior conditions under which persons are situated equivalently such that their choices can bear this tremendous weight. This means (...) that luck egalitarians need to become pluralists who understand equality not merely in terms of choice, luck, and responsibility. After developing my critical argument that luck egalitarianism is incomplete, I sketch a strategy for rehabilitating and filling out the theory. (shrink)

Several attempts have been made to apply the choice-sensitive theory of distributive justice, luck egalitarianism, in the context of health and healthcare. This article presents a framework for this discussion by highlighting different normative decisions to be made in such an application, some of the objections to which luck egalitarians must provide answers and some of the practical implications associated with applying such an approach in the real world. It is argued that luck egalitarians should address distributions of health (...) rather than healthcare, endorse an integrationist theory that combines health concerns with general distributive concerns and be pluralist in their approach. It further suggests that choice-sensitive policies need not be the result of applying luck egalitarianism in this context. (shrink)

This paper draws on Friedrich Nietzsche’s work to defend the (admittedly non-Nietzschean) conclusion that a non-liberal egalitarian society is superior in two ways: first, as a moral ideal, it does not rest on questionable claims about essential human equality and, second, such a society would provide the optimal psychological and political conditions for individual wellbeing, social stability, and cultural achievement. I first explain Nietzsche’s distinction between forms of egalitarianism: noble and slavish. The slavish form promotes equality, defined negatively as (...) the elimination of privilege. It is non-liberal in its prioritization of equality over the interests of the advantaged. Nietzsche rejects both slavish egalitarianism and liberalism for the same reasons: they questionably assume the equal value of all persons, and they harm cultural achievement, sacrificing the potential of those who are most valuable to cultural development to the interests of the majority. Noble egalitarianism, in contrast, exemplifies Nietzsche’s conception of justice as ‘equality among equals’. It demands that individuals of equal worth or power (such as members of an artistic or political elite) treat each other as what they, in fact, are: equals. It avoids asserting essential equality, demanding instead—against both slavish and liberal forms—respect on the basis of shared superiority. And it escapes the charge of harm to cultural development, commanding respect only where equality already exists. Although Nietzsche quickly assumes that ‘noble egalitarianism’ requires the rejection of all forms of universal egalitarianism, concluding that we should ‘never make equal what is unequal’, in fact it only entails the rejection of slavish methods: equalization through harm to the advantaged. However, non-liberal forms of egalitarianism can be ‘noble’, promoting equality without harm to the advantaged—through, for example, unequal distribution of resources, the equalization of economic opportunities, and economic regulation to prevent the creation of substantial wealth disparities. If egalitarianism can ‘make equal’ without slavish methods, then Nietzsche’s demand for ‘equality for equals’ applies to the newly equal, too. More importantly, his moral psychology of power—the view that our source of happiness and incentive to self-development is the feeling of power in relation to equal resistance or ‘opponents who are our equals’ —supports the superiority of a nobly-achieved, non-liberal egalitarian society. For achieved, practical equality of wealth and opportunity would optimize conditions for the feeling of power: a balance of equal, oppositional powers serving as mutual limitation and resistance. Such a society is superior in three ways. First, it maximizes social happiness by promoting and maintaining the feeling of power in all. Liberal and aristocratic societies, in contrast, allow radical inequalities that not only diminish the power of the disadvantaged, but diminish the opportunities of the advantaged to encounter equal resistance, thus undermining the happiness of all. Second, it promotes social stability by preserving a balance of powers that prevents domination and exploitation, in contrast to the inevitable class conflicts of aristocratic and liberal societies. Finally, it promotes cultural achievement, since the feeling of power in relation to proportional resistance is the psychological incentive for self-development and cultural achievement. (shrink)

Much of the philosophical literature on health inequalities seeks to establish the superiority of one or another conception of luck egalitarianism. In recent years, however, an increasing number of self-avowed egalitarian philosophers have proposed replacing luck egalitarianism with alternatives that stress the moral relevance of distinct relationships, rather than the moral relevance of good or bad luck. After briefly explaining why I am not attracted to luck egalitarianism, I seek in this chapter to distinguish and clarify three (...) views that have been characterized in the philosophical literature as forms of relational egalitarianism. I call these three relational views equality of treatment, equality of concern, and social egalitarianism. I will explain why each claims to be a form of egalitarianism and why these three views should not be seen as competitors. I will argue that each brand of relational egalitarianism describes a plausible plank of distributive justice that bears on the evaluation of health inequalities and on the political institutions that create, sustain, or exacerbate them. To illustrate this pluralistic relational egalitarian approach, I will draw on a case study by Horton and Barker (this volume) to discuss how each of the three planks might be brought to bear on the evaluation of oral health disparities among the children of migrant Latino farmworkers in California. Debates about "equality" are pervasive in our politics today. The widening gap between the rich and the poor is having major effects on our society and politics, galvanizing social justice movements on the left and nationalist-populist movements on the right. On a different register, America's culture war is heating up on topics such as privilege, oppression, identity, racism, patriarchy, implicit bias, and so forth. Many philosophers believe that luck egalitarianism captures “desert-like” intuitions about justice. Some even think that luck egalitariansm distributes goods in accordance with desert. In this paper, we argue that this is wrong. Desertism conflicts with luck egalitarianism in three important contexts, and, in these contexts, desertism renders the proper moral judgment. First, compared to desertism, luck egalitarianism is sometimes too stingy: it fails to justly compensate people for their socially valuable contributions—when those contributions arose from “option luck”. (...) Second, luck egalitarianism is sometimes too restrictive: it fails to justly compensate people who make a social contribution when that contribution arose from “brute luck”. Third, luck egalitarianism is too limited in scope: it cannot diagnose economic injustice arising independently of comparative levels of justice. The lesson of this paper is that luck egalitarians should consider supplementing their theory with desert considerations. Or, even better, consider desertism as a superior alternative to their theory. (shrink)

This paper examines whether Kok-Chor Tan’s institutional luck egalitarianism is successful as a pluralist luck egalitarian theory of justice and morality. In recent years, pluralist luck egalitarianism has become a salient theory of justice. Tan’s pluralist proposal for institutional luck egalitarianism is attractive because it seems to refute the metaphysical and practical challenges against luck egalitarianism. This paper demonstrates that, although Tan’s institutional luck egalitarianism is indeed a most sophisticated systematic pluralist (...) theory of justice and morality, his argument fails because the application of luck egalitarianism to the domain of distributive justice and to the basic institutions of society is not justified from the luck egalitarian point of view. This paper concludes that Tan’s institutional luck egalitarianism does not succeed in demonstrating that his theory is an outstanding achievement of luck egalitarianism. (shrink)

In his Pragmatist Egalitarianism, David Rondel proposes a “pluralist egalitarianism” as a pragmatist resolution to longstanding debates over egalitarian justice. On Rondel’s view, egalitarianism has three distinct and irreducible variables. In this comment, I argue that pluralist views generally do not reconcile anything, but instead posit sites of normative conflict that are in principle invulnerable to remediation by human intelligence. I then propose that although Rondel might be correct to identify three distinct sites of egalitarian (...) concern, there remains reason to prioritize what he calls the “institutional” variable. Pluralist egalitarians think that luck and relational egalitarianism each articulates a component in a pluralist account of egalitarian justice. However, this ecumenical view appears problematic in the light of Elizabeth Anderson's claim that the divide arises because two incompatible views of justification are in play, which in turn generates derivative disagreements – e.g. about the proper currency of egalitarian justice. In support of pluralist egalitarianism I argue that two of Anderson's derivative disagreements are not rooted (...) in the disagreement over justification she identifies, and that the disagreement over justification cuts across standard disagreements between luck and relational egalitarian justice. Imagine a two-person distributive case in which Ernest's choices yield X and Bertie's choices yield X + Y, producing an income gap between them of Y. Neither Ernest nor Bertie is responsible for this gap of Y, since neither of them has any control over what the other agent chooses. This is what Susan Hurley calls the “Boring Problem” for luck egalitarianism. Contrary to Hurley's relatively dismissive treatment of it, it is contended that the Boring Problem poses a deep (...) problem for standard luck egalitarianism. To counter it, luck egalitarianism needs to be recast as a baseline-relative theory. This new version of luck egalitarianism is then put to work against some significant problems that have been encountered by luck egalitarianism: Saul Smilansky's “Paradox of the Baseline,” the “Partiality Worry,” and the “Pluralism Worry.” But baseline-relative luck egalitarianism is not without problems of its own. In the paper ‘Genetic information, insurance, and a pluralistic approach to justice’, Jonathan Pugh1 develops an argument from unresolved pluralism in our theories of justice, via the pluralism this occasions in relation to the specific question of the use of genetic test results in insurance underwriting, to the conclusion that the UK regulatory approach in relation to the use of GTRs in insurance is broadly correct.1 Pugh’s argument is wide-ranging and I cannot provide a complete critique of it in this (...) short comment, but I will gesture towards some strands of the argument that are potentially problematic. The first potential problem in the argument is that Pugh bases his argument on a very extensive range of accounts of justice, including pure maximising consequentialism, strict egalitarianism and libertarianism, among many others. If these are all accounts of justice, it is not strange that there is pluralism of conclusions in relation to a specific question of justice or discrimination, such as the use of GTRs in the underwriting of specific kinds of insurance contracts. Pugh’s range, for instance, includes accounts of justice that deny the direct importance of distributive concerns as well as accounts that see distributive concerns as crucial. The moral philosopher Dan Brock has argued that equality of health outcomes “even if achievable” is problematic as a goal in its own right—because it is open to the levelling down objection. The levelling down objection to egalitarianism has received surprisingly little attention in the bioethics literature on distribution of health and healthcare and deserves more attention. This paper discusses and accepts an example given by Brock showing that prioritarianism and egalitarianism may judge distributions of health outcomes differently. (...) We should accept that levelling down is never a good thing, all things considered, but that equality often is. By discussing variants of Brock’s example, it is demonstrated that if equality, prioritarianism and aggregation are combined, as in a population-wide summary measure of health, such as the health achievement index, this combined set of principles is not open to levelling down. The paper suggests—although a more thorough investigation of the properties of the achievement index is needed—that this measure is always sensitive to inequality in health, is always sensitive to average health, can assign priority to those with lowest health outcomes and is not sensitive to levelling down. Levelling down is not an embarrassment for egalitarians if they adopt a pluralist theory that integrates fairness with goodness. Equality is not the only value egalitarians promote. But equality is so important that we should not reject it. (shrink)

(OPEN ACCESS) In this paper, I criticize two views on how political equality is related to equally distributed political power, and I offer a novel, pluralist account of political equality to address their shortcomings—in particular, concerning their implications for affirmative action in the political domain, political representation, and the situation of permanent minorities. The Equal Power View holds that political equality requires equally distributed political power. It considers affirmative action—e.g., racial or gender electoral quotas—, representation, and more-than-equal power to (...) permanent minorities pro tanto objectionable. The Equal Status View, in contrast, holds that political equality concerns equal relations and status, and it is only contingently related to equally distributed power. I argue that while the Equal Status View is right that equal power can be insufficient for—or even objectionable from the viewpoint of—political equality, it is wrong to conclude that equal power has no independent significance in an account of political equality. My pluralist account shows that political equality entails not only status-based requirements but also independent egalitarian requirements to distribute political power equally. This account provides a finer-grained understanding of affirmative action in the political domain. It justifies affirmative action but holds that it should only be used to realize equal political status until thorough-going social reform allows us to maintain both equal political status and equally distributed political power at the same time. Similarly, representation should be amended with power-balancing institutions, and permanent minorities should enjoy equal status with minimal compromise to power equality. (shrink)

[Samuel Scheffler] Some egalitarian liberals have proposed a division of moral labour between social institutions and individual agents, but the division-of-labour metaphor has been understood in different ways. This paper aims to disentangle some of these different understandings, with an eye to clarifying the appeal of the egalitarian-liberal project and the challenges that it faces. The idea of a division of moral labour is best understood as the expression of a strategy for accommodating diverse values. It is not an apology (...) for economic self-interest or a device for justifying personal acquisitiveness. /// [Véronique Munoz-Dardé] Are there distinctively political values? Certain egalitarians seem to think that equality is one such value. Scheffler's contribution to the symposium seeks to articulate a division of moral labour between norms of personal morality and the principles of justice that regulate social institutions, and using this suggests that the egalitarian critique of Rawls can be deflected. In this paper, instead, I question the status of equality as an intrinsic value. I argue that an egalitarianism which focuses on the status of equality as valuable in itself embraces a theory of value with the worst elements of utilitarianism while leaving behind any of the intuitive appeal that utilitarianism has. In its place I press that we need a political conception of egalitarianism which stresses the role we engage beyond those found in the norms of personal morality. (shrink)

I offer two objections to luck egalitarianism. The no-adequate-account objection takes note of the egalitarian insistence that the disvalue of inequality is only one of a plurality of values or disvalues that needs to be considered in arriving at a judgment about the ranking of alternative distributions of welfare. This turn to pluralism places a reasonable demand upon luck egalitarianism to provide an account of how the different sorts of values or disvalues that are supposed to attach to (...) available distributions of welfare are to be aggregated or weighed against one another in that ranking procedure. I contend that the prospects for developing such an account are dim and that some salient responses to this objection misfire. The churlishness-envy objection against luck egalitarianism is that this doctrine countenances envy directed toward the faultless good fortune of others. This objection places a reasonable demand on luck egalitarians to formulate a version of their doctrine that does not underwrite envious responses toward those who gain through brute good luck. I contend that the most auspicious path toward satisfying the demand not to underwrite churlish envy advances a luck egalitarianism that asymmetrically affirms the badness of arbitrary disadvantage rather than the badness of both arbitrary disadvantage and arbitrary advantage. Since this is the strategy pursued in Shlomi Segall’s Why Inequality Matters, I offer critiques of Segall’s initial and revised versions of asymmetrical egalitarianism in support of my conclusion that luck egalitarianism seems unable to rebut or sidestep the churlishness-envy objection. I conclude that luck egalitarianism seems unable to satisfy either of the two reasonable demands upon it that I raise. (shrink)

By distinguishing between contributory values and overall value, and by arguing that contributory values are variable values insofar as they contribute diminishing marginal overall value, this article helps to establish the superiority of a certain kind of maximizing, value-pluralist axiology over both sufficientarianism and prioritarianism, as well as over all varieties of value-monism, including utilitarianism and pure egalitarianism.

This welcomes Equality: From Theory to Action as an important contribution both to linking egalitarian political philosophy to public policy and as a book which helps communicate a wealth of philosophical ideas in an accessible way to a wide public. On the critical side, it argues that the authors understate some tensions between egalitarianism and pluralism, and that the book’s discussion of egalitarian economic institutions is quite narrow in scope. The issue of distributive justice receives substantial amount of attention in our society. On the one hand, we are sensitive to whether and the extent to which people are responsible for being worse off. On the other hand, we are mindful of society’s worst-off members. There has been a debate over luck egalitarianism, which relates to the former concern, and relational egalitarianism, which echoes the latter. By investigating the psychological processes of these two concerns, this paper examines the (...) reliability of the argument that Elizabeth Anderson, a renowned relational egalitarian, presents against luck egalitarianism and for relational egalitarianism. It also considers whether it is possible to support luck egalitarianism and relational egalitarianism simultaneously, using an online experiment. The results of the experiment show that, first, for ordinary people, the luck consideration is as important as the basic capabilities consideration. Second, while real people consider the degree of compensation through the factors of causality and responsibility, the lack of basic capabilities directs them to determine how much victims of bad luck should be compensated. This suggests that pluralist egalitarianism is on the right track. (shrink)

Telic egalitarianism is famously threatened by the levelling down objection. In its canonical form, the objection purports to show that it is not, in itself, an improvement if inequality is reduced. In a variant that is less often discussed, the objection is that telic egalitarians are committed to believing that sometimes one ought to reduce inequality, even when doing so makes no one better off. The standard egalitarian response to this ‘all things considered’ variant of the levelling down objection (...) is to embed egalitarianism in a pluralist consequentialist moral theory. In section 1, I briefly recapitulate this familiar strategy. In section 2, I argue that this standard pluralist consequentialist response is inadequate. The inadequacy of the standard response, I argue, stems from the fact that the following are jointly inconsistent: (1) a commitment to levelling down's impermissibility; (2) standard pluralist egalitarian consequentialism; (3) inequality being of non-trivial importance; and (4) the most plausible measures of inequality's badness. In section 3, I show that egalitarians can better respond to the all-things-considered levelling down objection by embedding egalitarianism in a nonconsequentialist moral theory. (shrink)

Contemporary political theories have made significant progress toward identifying the principles for an egalitarian society. From this perspective, Edward Bellamy's radical and pluralistic egalitarianism can be read not only as a relevant precedent but as a source of sophisticated arguments capable of enriching current debates. Although unfairly overlooked as theoretical works, Bellamy's utopias can be read today as offering insights that bring together and combine key modern ideals of liberty, equality, and fraternity. Therefore, this article argues that Bellamy's conception (...) of equality involves several dimensions and functions as a background condition for effective freedoms; that these liberties are not at odds with voluntary equality; and that fraternity—understood in Rawlsian terms—makes sense in a free and equal soci- ety, as it is guaranteed both by institutional means and by personal decisions. Relational egalitarianism is a theory of justice according to which people must relate as equals. In this article, we develop relational sufficientarianism – a view of justice according to which people must relate as sufficients. We distinguish between three versions of this ideal, one that is incompatible with relational egalitarianism and two that are not. Building on this, we argue that relational theorists have good reason to support a pluralist view that is both egalitarian and sufficientarian.
