This contribution focuses on legal issues raised by the audiovisual broadcasting of performing arts, which has significantly increased due to the SARS-CoV-2 pandemic. First, we contextualize this practice and briefly present the emergence and evolution of the practice of “filmed theater”, as well as any other form of performances (e.g., concert, ballet, opera) originally conceived for the stage but subsequently diffused through other channels. Secondly, we address the current legal issues that have arisen because of the increase of such (...) practice due to the containment measures taken by government. Two axes are of particular attention: the matter of copyrights and related rights, on the one hand, and the question of public financing, on the other. Concerning intellectual property, audiovisual broadcasting leads to several legal consequences and issues: effectiveness of related rights, emergence of new modes of exploitation and new authors, recognition of the recording as an original work, etc. This new practice is, moreover, likely to disrupt the categories established by public funding legal mechanisms, which are often poorly adapted to hybrid artistic objects. The objective of this part is therefore to analyze the new legal issues raised by the audiovisual distribution of performances. Finally, we go beyond exclusively legal issues to examine the very specificities of performing arts and, more specifically, the possible loss that would result from a fixation of a production on a reproducible medium, making its diffusion possible beyond the stage. World War II broke out as the result of an alliance between Germany and Soviet Union with the aim to conquer and partition Poland. Having broken off the treaty of friendship and co-operation, Germany attacked the USSR in 1941, forcing the Soviet Union to change sides from that of a German ally to the ally of the anti-German coalition. In 1943, following the German discovery of the graves of Polish officers murdered by Soviet forces in Katyń, Stalin declared that the (...) crime had been committed by the German army and broke off diplomatic relations with the Polish Government-in-Exile in London which had requested that an official investigation be launched by the Red Cross committee in Geneva. Some one hundred German officers were sentenced to death for the Katyń massacre as the result of Stalin’s prosecution trials. 50 years later, the world was rocked by the discovery of a document signed by Stalin ordering the execution of Polish officers in Katyń.In a secret meeting in 1943 in Teheran, President Roosevelt and Stalin agreed on the plan to annex Poland’s eastern territories.The decision to stage an independent fight for independence during the Warsaw Uprising was justified by the inevitable approach of the Red Army, the fear of German reprisal actions for disobeying the order to participate in fortification works, the fear of a spontaneous uprising fuelled by a Soviet radio broadcast in Polish which appealed to the people of Warsaw to put up a fight against the oppressor.Stalin’s decision to withhold the Soviet offensive and ban American and British planes carrying humanitarian aid for Warsaw from landing in Soviet airports contributed to the downfall of the Uprising. The Warsaw Uprising was a cue for the civil outbreaks that followed in Slovakia, Romania, Bulgaria, Paris and Prague. The halt on the Soviet Army’s offensive, which enabled the German forces to eliminate the Polish centre of political command subordinate to the Government-in-Exile in London, limited the European territory that fell subject to Soviet supremacy. The memory of the heroic fight put up by the entire population of Warsaw deterred the Soviet Union’s ambitions to curtail Poland’s sovereignty. (shrink)

China communicates strategic narratives about artificial intelligence in digital media productions to create a shared meaning about its actions and its image in the global race to develop AI. Building upon the literature in emotions and strategic narratives, this study seeks to clarify which emotions are discursively used in China’s international AI narratives, and their function and significance. Specifically, the study investigates emotion discourses in AI-focused videos disseminated on China’s international broadcasting. The analysis reveals that pride, hope (...) and fear discourses have multiple functions in China’s international AI narratives on CGTN. Hope is used to represent China as a key competitor in the global AI race, who is catching up to the US. China uses pride to showcase its advances in AI applications, to highlight its transformation of traditional industries, and to identity itself as equal to the US. Fear is used to frame US’s perception of China’s AI developments, to suggest their crisis of confidence, but also to refute the “China threat”. Additionally, the fear discourse is used to deliberate anticipated risks, particularly on job loss and data privacy. These emotion discourses forge China’s identity as a future global AI power. The paper then discusses how these findings contribute to key debates about Chinese discourse and media strategy. (shrink)

Les sciences sociales ont longtemps appréhendé le concept d'événement avec méfiance en évitant d'accorder sa juste place à leur capacité de rupture. Dès lors qu'il est question d'événements médiatiques, la perspective constructiviste fait des événements le produit d'une construction déformante de la réalité. Or, un événement est différent d'un fait ou d'une simple occurrence parce qu'il comporte une capacité de rupture qui déborde largement le travail des médias. Celui-ci s'articule en amont à l'activité d'une multitude d'acteurs et en aval au (...) regard d'un public. La question est alors de savoir de quelle façon les événements internationaux affectent un large public. Or, il semble que la médiatisation de ces événements imbrique des normes et des valeurs universelles à des contextes d'interprétation culturellement situés. Parce qu'ils se déploient sur des scènes publiques internationales et convoquent des acteurs transnationaux, parce qu'ils sont retransmis en direct par des chaînes de télévision transnationales, les événements internationaux ont pris la forme « d'événements globaux» et suscitent des émotions qui traduisent l'émergence d'une sensibilité mondiale.The social sciences have long grasped the concept of the event with suspicion by not granting its rightful place in their ability to rupture. When it comes to media events, the constructivist perspective of events is the product of a construction distorting reality. However, an event is different from a simple fact or occurrence because it has a breaking capacity far beyond the work of the media. It is divided into upstream activity of a multitude of actors and downstream with respect to a public. The question then is how international events affect a wide audience. However, it seems that the media coverage of these events overlaps standards and universal values ​​of culturally situated contexts of interpretation. Because they are deployed on public stages and convene international transnational actors, because they are broadcast live by television channels transnational, international events took the form of "global events" and raise emotions reflect the emergence of a global sensibility. The International Panel on Social Progress is an independent association of top research scholars with the goal of assessing methods for improving the main institutions of modern societies. This article examines an innovative experiment in democratizing international broadcasting through embracing a participatory model of production. In spring 2010, a political debate television series was co-created by BBC Arabic and citizen producers, using social media tools. Based around interviews with prominent political and controversial public figures, the programme (G710) was broadcast weekly on satellite TV across the Middle East and the Arabic-speaking world. Combining collaborative ethnography with corporate ‘big data’ analysis, the research team followed the experiment from (...) conception to premature closure. The article argues that the kinds of digital tools deployed in producing the programme, and used by BBC audience research to monitor user practices in real time, have become essential to corporate processes of BBC World Service governance and management procedures, business strategy, accountability measures, marketing practices and editorial decision-making. They act as change agents, presenting methodological problems and opportunities for the BBC’s audience researchers and academic researchers, as well as symbolizing the contradictory logic of empowerment and surveillance. In her introduction to this collection, Tymieniecka presents her phenomenology of life - the leitmotif of the three-volume anniversary publication of Analecta Husserliana - as something that stands out from preceding historical attempts to investigate life in an 'integral' or 'scientific' way. After an incubation lasting throughout the 2000 years of Occidental philosophy, this scientific phenomenology/philosophy of life at last uncovers the entire area of the 'inner workings of Nature', exposing the way in which the 'sufficient reason' and the 'ground' (...) of beingness as such crystallise out of the 'onto poietic' process. This onto-poietic process, continuing as it does in the human creative condition, also reveals the authentic genius of the works of the human spirit. This new and original philosophy, free of fallacious simplifications, speculations and reductionism, opens up a basic starting point for all philosophy.
