Efficiency, legitimacy, and the administrative state.Samuel DeCanio - 2021 - Social Philosophy and Policy 38 (1):198-219.
This essay examines certain epistemic problems facing administrative states’ efforts to draft efficient regulations for their societies. I argue that a basic feature of the administrative state’s authority, namely its monopoly over the production of legally binding rules for all members of a geographically defined society, creates epistemic problems that impede efficient rule-making. Specifically, the administrative state’s monopoly over the production of legally binding rules prevents multiple public policies from being simultaneously implemented and compared. The resulting singularity (...)

Managing Competing Demands: Coping With the Inclusiveness–Efficiency Paradox in Cross-Sector Partnerships.Guido Möllering, Andreas Rasche & Leona A. Henry - 2022 - Business and Society 61 (2):267-304.
This article discusses how cross-sector partnerships (CSPs) for sustainability manage the paradoxical tension between stakeholder inclusiveness and administrative efficiency. Drawing on qualitative data from a case study of a CSP focused on urban sustainability, we show how the inclusiveness–efficiency paradox unfolded throughout the studied collaboration. We discuss how the paradox reemerged in a different guise within each phase of the partnership and how three practices of paradox management helped actors to cope with the tension: “customized inviting” (during (...)

The idea of academic administration.Ronald Barnett - 1993 - Journal of Philosophy of Education 27 (2):179–192.
ABSTRACT Academic administration is not to be construed simply as a technical practice, the development of efficient management systems, nor as reactive, as response to the collective views of the academic community, nor in terms of academic leadership, the establishment and implementation of institutional aims. A full account of academic administration will provide a sense of the integral relationship between the academic administrator and the academic community. For that, a prior notion of the academic community is required. Such a notion, (...)

Specialized Justice: Courts, Administrative Tribunals, and a Cross-National Theory of Specialization.Stephen H. Legomsky - 1990 - Oxford University Press UK.
Specialized Justice addresses the question of the desirability of specialization in the administration of justice. Should there be more, rather than less, sub-division of the judiciary into specialized tribunals? What is most desirable in terms of efficiency, speed, true justice, and cost? The author attempts to answer these questions both by examining theoretical paradigms and also by describing the results of an empirical study which he has undertaken. He concludes by examining variables that apply in different jurisdictions and which (...)

Policy Interaction Graph Analysis is a Host-based Intrusion Detection tool that uses Linux MAC Mandatory access control policy to build the licit information flow graph and uses a detection policy defined by the administrator to extract illicit behaviour from the graph. The main limitation of this tool is the generation of a huge signature base of illicit behaviours; hence, this leads to the use of huge memory space to store it. The article reveals the issues of interdependence of the development of human capital in public administration on the level of its provision by the state in the context of COVID-19. In a democratic, civil, postmodern society, one of the main tasks is the development of systems for managing the efficiency of human capital in the context of public administration, as a means of obtaining higher levels of labor productivity. Today we have to state that the achievement of this (...) in the use of human resources can be better achieved by orienting the performance management system to promote the attraction of new human potential in public administration at all levels. In this context, a new approach to the human capital management process is being actualized, which includes employee engagement and key factors of employee engagement at every stage. We are talking about a management model that includes the main ideas and offers a new perspective on how to develop and manage the involvement of human resources to achieve high levels of labor productivity in public administration in the context of COVID-19. The purpose of the article is to study the essence, characteristics and role of human capital in the context of public administration in the context of the existence of the epidemic danger of COVID-19. Democracy, Liberalism, and Discretion: The Political Puzzle of the Administrative State.Stephen Turner - 2020 - In D. Hardwick & L. Marsh (eds.), Reclaiming Liberalism. Palgrave Studies in Classical Liberalism.
Conventional accounts of liberal democracy tend to obscure a basic fact: the phenomenon of administration. The American reception of the administrative state was self-consciously imitative of Continental models of state bureaucracy, as a remedy for the ills of democratic politics, but construed as a means of saving democracy from itself, and from lawyers and legalism, in the name of efficiency. The means was discretionary power, unaccountable to the courts and to voters. Reconciling this to democracy proved a challenge, (...)

Concerns about energy security have dramatically increased since the terrorist attacks on September 11, 2001. If U.S. energy use follows business-as-usual projections, the energy system will become increasingly vulnerable. No quick fixes are available to make the United States energy independent. However, there are energy policies that promote efficiency and the use of renewable energy sources such as wind, biomass, geothermal, and solar can gradually reduce dependence on imported oil and natural gas and reduce the vulnerability of the U.S. (...)

Introduction. Improving control and supervisory activities on the basis of introducing risk-oriented approaches is an urgent area of public administration reforms both in Russia and abroad. Traditionally, assessing the effectiveness of this area is carried out on the basis of the state control intensity indicators (the number of inspections), and assessing risks in controlled areas is carried out on the basis of statistical indicators, partially dependent on state control bodies. To obtain a balanced assessment of the state control effectiveness and (...)

The first part of the article determines that local officials in the Channel Islands disposed of operative margins, but that - in the interest of collaboration - these were not always used to the full. Zakat is a monetary form of religious worship that establishes a bridge between a rich and a poor, helps those who are in need and contributes to peace and tranquillity within a society. When zakat is collected properly under a government control and transmitted to those who deserve, it helped to decrease the gap between the poor and the rich, supported activities of social solidarity and revived the economy as well. Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight (...)

Human Research Ethics Committee (HREC) reviewers often provide similar feedback across applications, which suggests that the problem lies in researcher awareness of key issues rather than novel, unsolvable challenges. If common problems can be addressed before lodgement by applicants referencing clear evidence-based supports (e.g., FAQs on common application shortcomings), it would improve efficiency for HREC members and expedite approvals. In this comment to the brilliant book on the Constitutionalism in Latin-America, Gargarella, it is accepted that perhaps is the equality the empty promise among the ideals of constitutionalism in this region of the world. It is also accepted that an important part of the reason for this absence of equality lies in the institutional design, in the engine room of the Constitution, concretely in an hypertrophy of presidentialism. A complementary suggestion is added: the ideal of a constitutional democracy presupposes (...)

Between Conciseness and Transparency: Presuppositions in Legislative Texts.Stefan Höfler - 2014 - International Journal for the Semiotics of Law - Revue Internationale de Sémiotique Juridique 27 (4):627-644.
Presupposition is the semantic-pragmatic phenomenon whereby a statement contains an implicit precondition that must be taken for granted for that statement to be felicitous. This article discusses the role of presupposition in legislative texts, using examples from Swiss constitutional and administrative law. It illustrates how presuppositions are triggered in these texts and what functions they come to serve, placing special emphasis on their constitutive power. It also demonstrates how legislative drafters can distinguish between “good” presuppositions and “bad” presuppositions by (...)

The paper reviews some publications of domestic researchers, covering the application of information technologies in tax administration. It is concluded that most directions of tax administration in Ukraine, which were stipulated in the national Tax Code and are used in foreign countries with well-established taxation systems, were in a number of ways implemented over 2010-2013. The above specifically concerns public awareness efforts and services delivered to payers, exchange of tax information etc. It is however mentioned that information about a tax (...)

Academic fault lines: the rise of industry logic in public higher education.Patricia J. Gumport - 2019 - Baltimore: Johns Hopkins University Press.
Gumport chronicles the rise of "industry logic," as a departure from "social institution logic," in public higher education in the latter twentieth century. Industry logic refers to colleges restructuring for financial efficiency and developing more ties with industry. Since the 1970s, increased public scrutiny and demands for accountability have pushed colleges to become more corporatized and privatized. Gumport's sociological analysis is grounded in data from nine in-depth case studies that span three sectors of public higher education.

The Anticipatory Corpse: Medicine, Power, and the Care of the Dying.Jeffrey Paul Bishop - 2011 - University of Notre Dame Press.
In this original and compelling book, Jeffrey P. Bishop, a philosopher, ethicist, and physician, argues that something has gone sadly amiss in the care of the dying by contemporary medicine and in our social and political views of death, as shaped by our scientific successes and ongoing debates about euthanasia and the "right to die"--or to live. __The Anticipatory Corpse: Medicine, Power, and the Care of the Dying__, informed by Foucault's genealogy of medicine and power as well as by a (...)
