This essay examines certain epistemic problems facing administrative states’ efforts to draft efficient regulations for their societies. I argue that a basic feature of the administrative state’s authority, namely its monopoly over the production of legally binding rules for all members of a geographically defined society, creates epistemic problems that impede efficient rule-making. Specifically, the administrative state’s monopoly over the production of legally binding rules prevents multiple public policies from being simultaneously implemented and compared. The resulting singularity (...) of administrative states’ regulatory decisions prevents observation of the counterfactual effects of policies that were possible but which were not implemented. The absence of observable policy counterfactuals frustrates efforts to assess the efficiency of administrative states’ decisions, as it is impossible to determine whether different policies would have generated greater benefits at lower cost than the policy the state implemented. As these epistemic problems are derived from the singularity of administrative states’ decisions, they exist independently of principal agent problems, suboptimal incentives, or the preferences and capabilities of administrative personnel. The paper presents an analysis of the current state of administrative modular buildings and co-working spaces in some European countries and Latin America. The study provides an overview of the concept of modular buildings and co-working spaces, including their history and evolution and their energy efficiency. They also examine the benefits and drawbacks of these types of buildings, as well as the factors that contribute to their success. The authors analyze several case studies of administrative modular buildings (...) and co-working spaces in different European countries and Latin America, such as the UK, Germany, Slovakia, and Ukraine ending with Brazil. The paper takes into consideration the design and construction of these buildings, as well as the services and amenities they offer. The paper also considers the impact of administrative modular buildings and co-working spaces on the environment, as well as their potential for promoting sustainable development. The authors discuss the challenges and opportunities associated with the development of administrative modular buildings and co-working spaces and provide recommendations for future research in this area. Energy-efficient modular buildings and co-working spaces have the potential to support organizations in achieving their sustainability goals while also providing a range of benefits for employees and stakeholders. The purpose of this research is to identify the extent of the efficiency of the internal control environment in the Palestinian higher educational institutions in Gaza Strip from the perspective of employees in the Palestinian universities in Gaza Strip, where researchers used in the study five universities. The researchers adopted in their study the descriptive and analytical approach. The research community consists of administrative employees and academic employees with administrative duties. Senior management or the University Council was (...) excluded. The study population compromises of (392) employees. A stratified random sample was chosen and (197) questionnaires were distributed. (160) questionnaires were received back with a return rate of (81.2%).The researchers used a questionnaire to collect that which then was analyzed using (SPSS) to get the results. The research found the following results: the absence of a fundamental difference between the responses of males and females. The lack of significant difference between the responses of the respondents attributed to the variable age. The lack of significant difference between the responses of the respondents attributed to the variable of years of service. And the existence of a fundamental difference between the responses of the respondents attributed to the university variable. The existence of a fundamental difference between the responses of the respondents attributed to the Qualification variable. The existence of a fundamental difference between the responses of the respondents attributed to the administrative level variable. The research found a group of recommendations including: the need to raise awareness of censorship as the basis for the protection of employees in all administrative levels from making mistake.Updating the systems and instructions of control periodically and parallel with the scientific progress and technology.Benefit from regional and international experiences in the application of internal control standards which commensurate with the administrative system of the institution. This article discusses how cross-sector partnerships (CSPs) for sustainability manage the paradoxical tension between stakeholder inclusiveness and administrative efficiency. Drawing on qualitative data from a case study of a CSP focused on urban sustainability, we show how the inclusiveness–efficiency paradox unfolded throughout the studied collaboration. We discuss how the paradox reemerged in a different guise within each phase of the partnership and how three practices of paradox management helped actors to cope with the tension: “customized inviting” (during (...) the formation phase), “sequential including” (during the preparation phase), and “tailored instructing” (during the implementation phase). On the basis of these findings, we argue that (a) the paradox reoccurred throughout the phases of the CSP because the three paradox management practices accentuated boundaries, thereby helping to resolve the paradox temporarily while at the same time creating grounds for the paradox to resurface, and (b) that the three paradox management practices can be theorized as a special type of boundary work that “plays up” relevant differences between actor groups and thereby ensures collaboration. The study aimed to identify E- Learning strategies and their relation to the efficiency of research performance in foreign and Palestinian universities (University of Ottawa, Munster, Suez Canal, Al-Azhar, Islamic, Al-Aqsa). The analytical descriptive approach was used for this purpose, and relying on the questionnaire as a main tool for data collection. The study society is from the senior management, where the number of senior management in the universities in question is 206. The random stratified sample was selected and (...) (SPSS) was used for statistical data analysis. The study found a significant relationship between E- Learning strategies and the efficiency of research performance in universities. It also reached the participation of senior management in the research that develops the university performance in the Palestinian universities. The senior management indicated that they do not care to follow the policies of implementing the development of scientific research. While the senior management in foreign universities indicated that they are interested in following up the policies of implementing the development of scientific research. The study also showed that senior management in Palestinian universities does not care about providing the appropriate budget for E- Learning. The study recommended that the senior management of Palestinian universities should provide an E- Learning budget and encourage employees to continue using E- Learning strategies. The administration in the Palestinian universities should adopt and support outstanding research, and the need to encourage interest in the implementation of policies for the development of scientific research. Amidst the ideology, efficiency and bitter contention of international economy, the importance of leadership or public administration had long been under-stressed as an avenue for any better solution. Nonetheless, within a changing mode of interaction in the global community, an increasing ethos for the kind of common basis of ethics or agreement, at least in the level of class administrators or noble citizenry including the academicians, business leaders, bureaucrats and so, could be congruent for the public good on the (...) national and international plane. A rapid transformation for the informative society or sharing and humanity or social justice generally is seen to enable the possibility of new openness against the divergences from various reasons. Typically, I consider the public administration other than law, inter alia, could have strands to leap for any grand promise or for any cosmopolitan public value since it tends progressive and less ideological. At the core of ambition underlie the ethics of public administrators or their responsibility for the constituents and global public. The paper deals with two illustrative cases from the experience of South Korea which matters at the negative and positive concept of liberty. They will be investigated, empirically at some extent and in view of the ethics of congressmen and public officers. I, then, turn to explore the western theories and tenets often associated with their moral standard. Policy Interaction Graph Analysis is a Host-based Intrusion Detection tool that uses Linux MAC Mandatory access control policy to build the licit information flow graph and uses a detection policy defined by the administrator to extract illicit behaviour from the graph. The main limitation of this tool is the generation of a huge signature base of illicit behaviours; hence, this leads to the use of huge memory space to store it. Our primary goal in this article is to reduce this (...) memory space while keeping the tool’s efficiency in terms of intrusion detection rate and false generated alarms. First, the interactions between the two nodes of the graph were grouped into a single interaction. The notion of equivalence class was used to classify the paths in the graph and was compressed by using a genetic algorithm. Such an approach showed its efficiency compared to the approach proposed by Pierre Clairet, by which the detection rate obtained was 99.9%, and no false-positive with a compression rate of illicit behaviour signature database reached 99.44%. Having these results is one of the critical aspects of realizing successful host-based intrusion detection systems. (shrink)

The economic importance of optimizing the environmental situation from the perspective of an entrepreneur are assessed in the article. The classification of administrative decisions taken in the course of the business activities is proposed. The authors identified a group of solutions directly providing optimization of environment external to the enterprise, solutions that have an indirect positive impact on the environment and solutions that improve ecology of industrial premises. The nature of economic effect of resulting solutions of various types is (...) taken into account. Vectors of influence of working conditions on the economic results of business activities are described. The nature and strength of the impact of model management decisions results of business activities are defined. Key performance indicators of entrepreneurial activity are identified: employee productivity, the amount of revenue and profitability, solvency, staff stability, the competitiveness of enterprises. Grouping the costs of ecological parameters optimization of the production environment is proposed. Relationship between level of working conditions and socio-psychological climate in the collective enterprise is disclosed. The methods of motivation of entrepreneurs in solving of environmental, production problems are considered. The role of training entrepreneurs engaged of medium and small businesses are underlined especially. Thus, in the article the relationship between environmental and economic problems of entrepreneurial activity is investigated. The article reveals the issues of interdependence of the development of human capital in public administration on the level of its provision by the state in the context of COVID-19. In a democratic, civil, postmodern society, one of the main tasks is the development of systems for managing the efficiency of human capital in the context of public administration, as a means of obtaining higher levels of labor productivity. In this context, a new approach to the human capital management process is being actualized, which includes employee engagement and key factors of employee engagement at every stage. We are talking about a management model that includes the main ideas and offers a new perspective on how to develop and manage the involvement of human resources to achieve high levels of labor productivity in public administration in the context of COVID-19. Raymond Callahan's lively study exposes the alarming lengths to which school administrators went, particularly in the period from 1910 to 1930, in sacrificing educational goals to the demands of business procedures.

In the late XVII century in England has establishes the school of “political arithmetic”, which goal consisted in the analysis of social phenomena on the basis of quantitative indicators. Its main representatives became William Petty, John Graunt and Charles Davenant (1656-1714). The latter left a mark in the history of England as a philosopher, politician and publicist, who made a significant contribution to the development and implementation of the methods of “political arithmetic”. The object of this research is the views (...) of the English thinker, reflected in his pamphlets and treatises of the 1690’s. The subject is the Davenant’s views on the principles and tasks of “political arithmetic” in the context of his political theory. Special attention is given to correlation between Davenant’s views on the development of “political arithmetic’ and his concept of public administration. The scientific novelty lies in the comprehensive examination of the political and economic views of Charles Davenant within the framework of his attitude on the method of “political arithmetic”. The author delivers a thesis on the importance of the political and epistemological context, which formed Davenant’s views on the quantitative indicators. Grasp of quantitative data Davenant correlated directly with the practice of administration. According to the philosopher, a public official having the capacity for “evaluation” and proper interpretation of data could avoid many mistakes in decision-making and reliance on “bad” advices. Concerns about energy security have dramatically increased since the terrorist attacks on September 11, 2001. If U.S. energy use follows business-as-usual projections, the energy system will become increasingly vulnerable. No quick fixes are available to make the United States energy independent. However, there are energy policies that promote efficiency and the use of renewable energy sources such as wind, biomass, geothermal, and solar can gradually reduce dependence on imported oil and natural gas and reduce the vulnerability of the U.S. (...) energy infrastructure to disruption of supplies or to attack. This article reviews recent analyses by the U.S. Energy Information Administration’s and by the Union of Concerned Scientists. These studies showthat efficiency and renewable energy investments can increase energy security while lowering consumer energy bills and reducing local and global environmental hazards. (shrink)

Introduction. Improving control and supervisory activities on the basis of introducing risk-oriented approaches is an urgent area of public administration reforms both in Russia and abroad. Traditionally, assessing the effectiveness of this area is carried out on the basis of the state control intensity indicators (the number of inspections), and assessing risks in controlled areas is carried out on the basis of statistical indicators, partially dependent on state control bodies. To obtain a balanced assessment of the state control effectiveness and (...) efficiency, it is important to take into account other data sources reflecting the citizens’ and the business community position. The purpose of the study is to conduct a comprehensive assessment of the effectiveness and efficiency of sanitary and epidemiological surveillance on the basis of both statistical data and the results of sociological studies reflecting the position of citizens and business. Methods. The authors suggest their own methods for comprehensive assessment of the effectiveness and efficiency of state control. The scientific novelty of the study consists in a comprehensive assessment of the effectiveness and efficiency of sanitary and epidemiological surveillance, taking into account various data sources and making it possible to assess the progress of implementing the reform of state control in this area. Results. The results of the study indicate, in general, an increase in the effectiveness and budgetary efficiency of sanitary and epidemiological surveillance over the last years of the reform implementation. At the same time, at the level of intermediate and immediate results, there are multidirectional trends, and the growth in the total costs of business and the state is ahead of the growth in the results achieved. Conclusions. The use of the authors’ comprehensive methodology for assessing the effectiveness and efficiency of state control makes it possible to obtain reliable data characterizing the actual state of things in the area under consideration. Further improving the efficiency and effectiveness of sanitary and epidemiological surveillance requires expanding the scope of applying risk-oriented approaches and improving the quality of considering the appeals of the citizens who faced with risks of wrongdoing. This article focuses on the collective leadership of the civilian authorities of the British Channel Islands during the Nazi Occupation (1940-1945), and draws lessons from their ethical performance. The first part of the article determines that local officials in the Channel Islands disposed of operative margins, but that - in the interest of collaboration - these were not always used to the full. This article then details institutional factors that contributed to commonalities between the two bailiwicks of Jersey and Guernsey, (...) as they faced up to occupation. The second part of this article follows up with the dissimilarities, one of which is that Guernsey travelled further down the road to collaboration than her sister island. Social capital depletion is credited as being responsible for this; and this situation was further compounded by lack of 'ethical leadership'. The final part explores the relationship between social capital and leadership ethics, suggesting that virtue serves as a catalyst for social capital stock in crisis situations. The core research outcome is that ethical leadership produces tangible efficiency and moral effects in situations of extreme duress (such as Nazi Occupation) where one could have expected very little or no scope for such a thing. This is an uplifting message that runs counter to scepticism as to the practical value of business ethics. Implications are drawn with regard to the challenge of reconciling MNE activities with the moral complexity posed by globalization. (shrink)

Resumen. La presente investigación ofrece la oportunidad de pensar y dialogar sobre la estrategia, los objetivos, las personas y el futuro de la gestión municipal del H. Ayuntamiento de Navolato desde una perspectiva del conocimiento. Se trata pues de averiguar qué características deben cumplir esos recursos para adquirir un carácter estratégico. La información se obtuvo mediante una encuesta semiestructurada, aplicada a 181 individuos. Los datos recabados fueron objeto, en un principio, de dos tipos de tabulaciones. En algunos casos sólo se (...) efectúo una tabulación simple, que consistió en el conteo de una sola variable; en otros casos la tabulación fue cruzada contando dos o más variables de forma simultánea. Para el análisis de los datos se utilizó el programa de tratamiento de datos estadísticos SPSS versión 12 para Windows, que facilitó el tratamiento inferencial de los datos extraídos de la muestra seleccionada. El análisis de los resultados muestra que el Ayuntamiento presenta perfiles favorables para una gestión del conocimiento, óptima y eficaz, al alcanzar una puntuación total de 115, contando con una fortaleza estructural interna. Se concluye que las administraciones públicas no son ajenas a la sociedad del conocimiento, se están acomodando a estas nuevas exigencias, mejorando sus procesos para satisfacer las nuevas necesidades de los ciudadanos. Redefiniendo la función pública y el servicio público, a través de la búsqueda de mecanismos para conocer y medir el valor de la gestión del conocimiento, y así poder llevar a cabo una gestión eficiente y eficaz de estos recursos.Palabras Claves. This research provides an opportunity to think and discuss the strategy, goals, people and future of municipal management of Navolato City knowledge perspective. It is about finding out what characteristics should meet those resources to acquire a strategic nature. The information was obtained through a semistructured survey applied to 181 individuals. The data collected were subjected, in principle, two types of tabs. In some cases only made a simple tabulation, which consisted of a single variable count, in other cases the cross tabulation was counting two or more variables simultaneously. For data analysis software was used for statistical data processing SPSS version 12 for Windows, which facilitated inferential treatment of the extracted data from the selected sample. The analysis of the results shows that the City has profiles favorable for knowledge management, optimal and efficient, to achieve a total score of 115, relying on internal structural strength. We conclude that public administrations are not foreign to the knowledge society, are arranging to these new demands by improving their processes to satisfy the new needs of citizens. Redefining the civil and public service, through the search for mechanisms to analyze and measure the value of knowledge management, and therefore be able to carry out a efficient and effective management of these resources.Keywords. Zakat is a monetary form of religious worship that establishes a bridge between a rich and a poor, helps those who are in need and contributes to peace and tranquillity within a society. When zakat is collected properly under a government control and transmitted to those who deserve, it helped to decrease the gap between the poor and the rich, supported activities of social solidarity and revived the economy as well. Malaysia after its independence in 1957 has developed an interest (...) in Islamic practices by drawing attention to a distinctive practice with the public zakat system. Even though a national- central system of zakat could not be established due to the federal structure of the country, the collection and distribution of zakat has been centralized on a state level. Parts of the practice are being criticized, reviewed and new regulations are introduced. Unlike Malaysia, the zakat practice in Turkey is out of state control, thus it hinders zakat from achieving its real purpose. There is a need to make use of the well-functioning zakat systems around the world and establish a public zakat system in our country so that we can make the most of the benefits that zakat has for individuals and societies. This article aims to be a step in that direction. -/- SUMMARY Zakat is one of the main forms of worship and is at the same time one of the main sources for the state budget in Islam. It aims at making sure that the rich –those with higher wealth and income– protects the poor and the powerless and through this it contributes to the peace in the society. In the Islamic creed wealth in reality belongs to Allah; therefore, those who live an affluent life should not attribute their wealth to themselves alone and help those who, for whatever reason, are unable to meet their needs. Because there is a social dimension to this form of worship, it is the duty of the head of state to collect the zakat and distribute it to the right people. Historically this duty has taken different forms and today, many Muslim countries sustain this collection and redistribution under state supervision. Malaysia is a country where zakat is collected and distributed officially at the state level. In each state, there is an Islamic council responsible for taking care of activities related to Islam and is semi-independent from the government that organizes the zakat process. Some of these do the collection and distribution together, some do it separately. In some states, the process has been totally privatized. Constitutionally, each state is dependent on its own sultan in religious affairs, thus each has its own mufti and partially different zakat practices and eac collect and distributes its zakat within that state. Because religious affairs have been codified as the privilege of the sultans of each state in the constitution during Malaysia’s foundation, there is no attempt at centralizing religious affairs and a centralization of zakat practices; the establishment of an institution to achieve this is not possible. Moreover, the secular character of the federation does not seem yet compatible with making zakat obligatory. However, due to the dominant Shafi‘i tradition and the convention in the country, people see it as imperative to hand over the charity and tithe to state institutions. Furthermore, there are local fatwas – which are considered as legal regulations in Malaysia – that require people with an income over a certain amount to pay zakat. Those who have the most are expected to give it voluntarily. In the 19th century, when wealth sources such as palm oil, cacao, rubber, tin were discovered, Malaysian officials were not able to extend the tithe to these; however, in the last twenty-five years, based on fatwas that income should be taxable under zakat has led to a boom in zakat. In all states, the largest portion of zakat is collected through income, usually automatically deducted from payroll. An influential factor in this outcome is that individually paid zakat can be deducted from income tax. From 2005 on, there have been other regulations to make it possible for legal personalities to deduct zakat from taxes. To increase zakat payment, especially publications have been produced to inform and encourage people, and modern opportunities to make payment easy have been developed. The most often used method is direct deduction from payroll. The second most common method is payment through zakat machines in different parts of the city by cash, check, Islamic credit card and, debit card. In addition to these, online, internet banking, telephone banking, ATM machines, post offices, kiosk machines, sms-zakat options are all available. The distribution of zakat differs from year to year and state to state. In general, there is an observable effort to pay all groups from zakat, but because there are no slaves in some states no payment is done under this category. There are both direct transfers and indirect transfers, such as through the construction of houses for poor people. There have been cases where poor people who had projects were supported with funds and those later returned in zakat. There is support for students in terms of scholarships through fuqarā’, fī sabīl allāh and ibn al-sabīl classes. For the muallafa al-qulūb class, there is a foundation to encourage local people to convert to Islam and help them for food, shelter, clothes and education. For Muslims who suffer as minorities in other countries help is provided through the riqāb, muallafa al-qulūb, fī sabīl allāh and ibn al-sabīl classes. In the ghārimīn class, especially victims of natural disasters such as flood and earthquake are supported. For those who have a right to receive zakat be able to receive it, the state has to side with the powerless and help zakat fulfill its social and individual functions. The way zakat is spent requires state policy and will. For this reason, zakat should be institutionalized and all activities should be organized by a single institution with state power behind it. Determining the recipients and the zakat-payers, and using the funds efficiently is easier with the coordination of state institutions. Extensive zakat councils that include state institutions should consider the ijtihāds in the area of zakat anew and make decisions to create a just and consistent zakat system. For these decisions to be applicable, the question of what kind of a system could be founded in our country should be on the agenda in these councils. Once an institution – official or autonomous but with state power behind it- is created, solutions can be found as they arise in the way. (shrink)

This article traces the career path and personality of a chancery official or secretary in the service of the Gonzaga, the ruling dynasty of Mantua, in the middle years of the fifteenth century. It relates Giovanni Arrivabene to the contemporary social, political and cultural context of this secondary northern Italian power or signoria but touches the wider Italian world at many points, particularly the papal court, whether in Rome or other locations, where Giovanni’s talented younger brother served first as the (...) secretary of Cardinal Francesco Gonzaga and later as an apostolic secretary. The comparison between the two brothers and their interdependence as property owners is a recurring theme. Giovanni emerges with evident limitations which hampered the succession to his father’s superior role in the chancery, where other privileged families also tended to prevail. Humanist educated and efficient, he seems to have been a bureaucrat of routine abilities, not quite astute enough to outpace certain departmental rivals or to avoid being tainted by association with some possibly corrupt practice which caused loss of favour. His later rehabilitation, first as a provincial magistrate concerned with criminal jurisdiction and later as an estate management official, illustrates that private relationships within the narrow world of a civic quasi despotic government were all important. Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight (...) salient case text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. _The assessment of institutional quality and its influence on economic performance is highly relevant in Nigeria due to the country's constantly changing governmental institutions, dynamic market circumstances, and diversified socioeconomic atmosphere. Thus, the study aims to investigate the impact of institutional quality on the economic performance of Nigeria. This study employed ex post facto research, while time series data was used, which spans from 1996 to 2021, sourced from the Central Bank of Nigeria (CBN) and the Worldwide Governance Indicators (WGI). (...) The study employed unit root tests, Johansen cointegration, and the Error Correction Model as estimation techniques. However, post estimation tests such as normality, serial correlation, heteroskedasticity and stability tests were carried to ascertain the level of statistical accuracy outcome of the variables used. The findings suggest that there is a sustained nexus between the quality of institutions and characteristics related to economic growth. Also, it was equally found out that political stability has a significant impact in the short run. This suggests that a unit increase in political instability would definitely amount to a decrease in economic performance in Nigeria during the period under investigation. The study suggests enhancing accountability, transparency, administrative efficiency, and law adherence to improve Nigerian institutions. This can be achieved through reform implementation, capacity building, and good governance mechanisms, while reducing political unrest and fostering stability._. (shrink)

Based on the fact that military establishments have historically played a major role in the transformation of societies, this paper argues that the Nigerian Armed Forces need to be credible and modernized in order to be able to fulfil their constitutional responsibilities. They can do this by providing the necessary support, in terms of professional expertise and administrative efficiency, for the successful implementation of Nigeria’s Vision 2020 and its strategic Seven-Point Agenda. This article explores the cultural dimension in democratic struggle from the vantage point of the public sphere. It proposes that in the public sphere there take place competing and changing interpretations over the `public' through continuous articulation of two analytically distinct representations of public interest - democratic and communal discourses. In an empirical study of the recent credibility crisis in Hong Kong, the author demonstrates first, how the governing coalition sought to maintain its authority through a discourse of `administrative (...) efficiency' embedded in the hegemonic narrative of success, and second, how the challenging discourse of democracy regained momentum through de-mystification of the hegemonic narrative in the event of governing crises. The case study of the recent bird flu crisis offers a specific account of political and cultural challenge to bureaucratic paternalism in the postcolonial context. It is argued that the challenge was powerfully presented as the crisis became a dramatic moment of meaning reconstruction through ironic narrativizing and democratic encoding in the public sphere. Crowdsourced regulation has been discussed to date by legal and social science scholars mainly in the context of legislation and rulemaking, without paying sufficient attention to non-legislative regulatory functions. This article provides a richer theory of crowdsourced regulation which extends to all regulatory functions, focusing on monitoring and enforcement. Regulatory agencies worldwide harness the power of the public using digital platforms to carry out monitoring and enforcement tasks in regulated markets and sectors. For example, agencies operate online complaint databases that (...) invite the public to report mistreatment of consumers and environmental nuisances by regulated firms. Agencies also publish information concerning corporate misbehavior to publicly shame companies into compliance. Crowdsourcing regulatory monitoring and enforcement can help minimize some prominent ailments of the regulatory task, such as poor resources, diminishing deterrence, declining legitimacy, and capture. It can also promote goals and values such as public participation, increased transparency, public trust in regulators, administrative efficiency, and effectiveness in achieving regulatory objectives. However, crowdsourcing regulatory monitoring and enforcement is subject to a new set of legal, administrative, and democratic failures that need to be acknowledged and addressed. The article develops a theory of crowdsourced regulation that supplies justifications and rationales for crowdsourced regulatory monitoring and enforcement, points out its main pitfalls, and normatively evaluates law and policy implications. To enhance their competitive positions in the evolving market, many health care organizations are pursuing the ownership and integration of all elements and stages of health care delivery and payment, with the goal of increasing access to capital and lowering costs through administrative efficiencies and economies of scale. In the main body of colleges and universities, the effect of college teaching psychology management is an important standard to test the quality of college teaching psychology management and its effects on the development of college teaching psychology management. However, the psychology management system used by traditional colleges and universities is challenging to meet the needs of the innovation of the new talent training model of higher vocational education. The construction of the new micro-level teaching organization inevitably requires the psychology (...) management practice, structure, process, and technology at the medium and macro-levels to adapt to it. However, there are many mismatches in Higher Vocational Colleges’ internal and external administrative systems in China, such as low administrative efficiency, generalization of administrative power, low degree of specialization in administrative psychology management, and unreasonable administrative and organizational structure. This paper innovates the psychology management of colleges and universities reforms in combination with the characteristics of the digital age. Based on the collaborative innovation theory of colleges and universities, this paper puts forward the collaborative psychology management innovation network model of colleges and universities. The model combines the psychology management theory with the practical research of collaborative innovation in colleges and universities, expands the application and research field of innovation network theory, constructs the evaluation index system of students’ satisfaction in teaching psychology management in colleges and universities, and discusses it through reading and consulting materials and communication with teachers and students. A questionnaire of college teaching psychology management based on student satisfaction is formed. The experiment shows that teaching satisfaction is improved by nearly 31% compared with before innovation and reform. It can initially get the effect of innovation and reform, meet students’ needs, and promote the improvement of teaching psychology management quality. (shrink)

Human Research Ethics Committee (HREC) reviewers often provide similar feedback across applications, which suggests that the problem lies in researcher awareness of key issues rather than novel, unsolvable challenges. If common problems can be addressed before lodgement by applicants referencing clear evidence-based supports (e.g., FAQs on common application shortcomings), it would improve efficiency for HREC members and expedite approvals. We aim to inform such supports by analysing the patterns in the most frequent feedback made by HREC members during review (...) processes. We collected every instance (N = 4,195) of feedback made on N = 197 ‘low-risk’ protocols by all HREC staff (N = 16) at one institution over the course of a full year (2019). Reflexive thematic analysis to identify themes (and content analysis to determine relative frequency) revealed that the top three themes are consistent with existing literature: Consent, Administrative, and Methodological concerns. However, we identified important new themes that are not captured in previous research, including ‘Risk to Researchers’, ‘Commercial benefit, scope and scale’, ‘Diversity’ (covering issues of cultural sensitivity, language and accessibility), as well as fair right to a complaints process. Our thorough exploration of information-rich primary data marks an important methodological improvement over previous studies and offers a theoretical contribution to understanding themes that have heretofore been overlooked in the ethics review process. By identifying the common challenges experienced in HREC review we can better inform tailored supports to applicants (by extension reducing workload burdens on HREC systems) and reduce their perceived barriers to engaging in challenging but meaningful research. Solomon, P. Fruntasu, V. Popa, V. Mosneaga and I. Bucataru. The aim of the article is to determine the type of optimal political and administrative relations to ensure open and responsible governance in countries with early democratic regimes. Research objectives are reduced to the study of the various models of public administration that have been going on in time, in order to determine the particularities that are compatible with the specifics of the countries with a transition democracy. Research Methodology. The study is based on comparative analysis and inductive and deductive reasoning. The result of the study. At present, the theories and models used by researchers are limited to the two extremes, namely the separation of the politicians of the administrators, on the one hand, and the argumentation of the complementarity between politics and administration, on the other. Both theoretical models have been implemented in practice through three public administration systems: continental, mixed and British. Until now, there are various debates about the viability of the two models in academic environment, and there is no real possibility of achieving a complete separation of the roles and goals of politicians and bureaucrats, and that the supreme power in a state is politics, irrespective of its designation. As regards the political-administrative relationship in the states with an incipient democracy, it is observed over the decades of independence, the use in the relations of the authoritarian methods with a democratic decoration, aimed at satisfying the noble, or rather subject to, narrow interests by the ruling and opposition forces, which absolutely did not take the public interest into account. Conclusions. In the desperate attempt to find a genuine way to approach political-administrative relations in countries with early democracies, we find it stupors that it is hard to suggest the implementation of a pure model, but the optimal model implies the existence of a freely chosen political power and a an autonomous, efficient and stable administrative sector that corresponds to the orders of that power. Mandatory minimum sentencing provisions have been a feature of the U.S. justice system since 1790. But they have expanded considerably under the war on drugs, and their use has expanded considerably under the Trump Administration; some states are also poised to expand drug-related mandatory minimums further in efforts to fight the current opioid epidemic. In this paper I outline and evaluate three prominent arguments for and against the use of mandatory minimums in the war on drugs—they appeal, respectively, to proportionality, (...) consistency, and efficiency. In this comment to the brilliant book on the Constitutionalism in Latin-America, Gargarella, it is accepted that perhaps is the equality the empty promise among the ideals of constitutionalism in this region of the world. It is also accepted that an important part of the reason for this absence of equality lies in the institutional design, in the engine room of the Constitution, concretely in an hypertrophy of presidentialism. A complementary suggestion is added: the ideal of a constitutional democracy presupposes (...) the existence of a State with an autonomous, efficient, professional and robust public Administration. Only with a well-designed tax system and an Administration apt to carry out the proper functions it is possible to build a well-ordered society in which the Rawlsian Difference Principle is respected and honoured. How do we respond to the patient who no longer needs inpatient care but refuses to leave the hospital? Complex hospital discharges commonly involve consideration of legal, financial, clinical, and practical issues. Yet, the ethical and contextual issues embedded in complex inpatient discharges are of concern and have not received adequate attention by medical ethicists. The aim of this work is to encourage clinicians and administrators to incorporate a justice rubric when approaching inpatient discharge dilemmas. This paper presents justice as (...) the ethical principle most neglected in situations involving complex discharges and suggests that a justice focused lens allows clinicians and administrators to move beyond notions of patient autonomy in crafting morally responsible hospital discharge decisions that reflect efficient stewardship of an appropriate share of medically indicated services. Presupposition is the semantic-pragmatic phenomenon whereby a statement contains an implicit precondition that must be taken for granted for that statement to be felicitous. This article discusses the role of presupposition in legislative texts, using examples from Swiss constitutional and administrative law. It illustrates how presuppositions are triggered in these texts and what functions they come to serve, placing special emphasis on their constitutive power. It also demonstrates how legislative drafters can distinguish between “good” presuppositions and “bad” presuppositions by (...) weighing their main advantage, conciseness, against their main flaw, reduced transparency. The present study argues that, if employed carefully, presuppositions can be a useful stylistic means to keep legislative texts free from unnecessary clutter that merely elaborates on the obvious; however, it also suggests that, if applied wrongly, presuppositions can camouflage the duties and obligations placed on the subjects of a law and thus impede its accessibility and its efficient and effective implementation. The paper reviews some publications of domestic researchers, covering the application of information technologies in tax administration. It is concluded that most directions of tax administration in Ukraine, which were stipulated in the national Tax Code and are used in foreign countries with well-established taxation systems, were in a number of ways implemented over 2010-2013. The above specifically concerns public awareness efforts and services delivered to payers, exchange of tax information etc. It is however mentioned that information about a tax (...) payer in our country is actualized in the tax information system only when he or she has begun to carry on business as an economic entity and submit tax accounts. In this context the experience of Germany is analyzed, where information about an economic entity is analytically processed yet on the stage of its registration as a tax payer. Some other aspects of the use of information technologies in administration of tax payments abroad are also covered and it is pointed out that learning the experience reviewed and assessment of the potentiality of its adaptation in the national taxation system would allow to save the budget of Ukraine from losses of revenues due to unfair conduct of potential tax payers and promote more efficient tax administration. Cependant, mondialisation ne saurait rimer avec efficacité sans passer par l’étape incontournable qu’est la traduction.The arrival of the Internet has profoundly changed the rules in every area of society. Exchanges are faster, more visible and more visual, and for the first time in the history of humanity, they are happening on the scale of the entire planet. It would be a mistake to believe that non-governmental groups have been left untouched by this profound societal change. Like all other sectors of society, NGOs, associations, institutions, public sector administration and State presidential or ministerial bodies have had to join the same headlong race for competitiveness, changing the way they function to make their content ever more visible and more explanatory, broaden their media range and expand their on-line services and interactiveness, to reach as many people as possible or make life easier by offering faster responses. The Resolution of the Seimas of the Republic of Lithuania on the Approval of the State Sports Development Strategy for 2011-2020 states that it is important to create and develop a horizontal structure of public administration of sport, which includes many state administration areas and municipal institutions, which would allow to develop cooperation with non-governmental sports organizations and private sector of sports activities. To create legal and economic conditions for the fast development of active and healthy lifestyle and universal sports (...) clubs as primary subjects of the national sport system; to promote their contribution to non-formal sports education and employment of children and young people, development of various sports, interaction between amateur and professional sports. In this respect, the tasks have been set to create a multi-tier system of strategic cooperation with non-governmental sport organizations with public administration structures, to expand cooperation between municipal institutions in the field of sport, authorized by the Government of the Republic of Lithuania so that these resolutions include the National Sport for All Development Program implementation, enhancing the vitality of communities through sport, ensuring healthy lifestyle conditions and developing sports infrastructure through territorial planning documents and investment programs; to create and develop a system of partnerships in the field of sport between public and private sectors; to develop cooperation between institutions of all fields of management by developing and implementing physical activity, healthy lifestyles and work ability, social cohesion through sport, leisure employment and social prevention and other interinstitutional programs, accordingly reorganizing and expanding functions of the institution authorized by the Government, strengthening its administrative capacity. The implementation of the strategy is particularly relevant, as is the case at the level of municipal administrations and councils, to which functions are delegated to implement the priority functions of sport policy. Problems in the implementation of sport policy are analyzed by scientists as well as representatives of sports policy legislators. The aim of the research is to analyze how the sports policy of the Republic of Lithuania is formulated and implemented in the activities of municipal administrations and councils. Research methods -analysis of scientific literature, analysis of laws, analysis of sports management system. Research results and conclusions. The real role of municipalities and the priority to develop community sport, to promote the vitality of communities has not been realized yet. The role of private business for private investment in sports infrastructure for the development of sports movement and cooperation with socially responsible business representatives, the independent role of clubs and non-governmental organizations as a priority have also not been understood and finally not implemented. In the functional division of activities in the sport policy process, all chains of interaction between organizations, acting within the competence, must strive to implement laws and strategic goals of sports policy. In order to achieve these objectives, the activities of the institutions depend on the political decisions adopted jointly by the central government, public programs and projects. It is important that the executive structures are delegated the same kind of functions, so that the implementation of the policy is carried out consistently in all areas of the republic.Improvement of the process of implementing sports policy and the search for the improvement, trying to achieve the efficiency of activities of municipal administrations and councils must be the main goal of all institutions involved in it. The whole system of institutions involved in the development and implementation of sport policy is too centralized. Institutional differences in the management of interdependence and in the resolution of structural problems between national organizations and municipal organizations are very pronounced. This has a negative impact on the status of municipal territorial sports divisions, when grants are distributed from the state budget, selecting sportsmen, performing medical technological examination of promising sportsmen, setting up sports bases, and so on.
