This article focuses on the relationship between democracy and the notwithstanding clause in s.33 of the Canadian Charter of Rights and Freedoms. A number of scholars argue that s.33 is inherently ‘democratic’, as it is an assertion of legislative supremacy. The most influential such theory is Jeremy Waldron’s. This article offers a democracy-based critique of Waldron’s democracy-based account of the notwithstanding clause. The argument that the notwithstanding clause is necessarily ‘democratic’ ignores the constitution of (...) the legislature through elections and the risk of self-dealing by the legislative branch, adopts an idealistic view of legislatures at odds with the reality of executive dominance and party discipline, and over-relies on the assumption that the electorate will ensure retrospective accountability for misuse of s.33. Contrary to Waldron and those who have adopted his arguments in Canada in the context of the Charter, the article argues we can be democrats and have faith in the capacities of legislators and voters while still maintaining skepticism about the uses to which the notwithstanding clause may be put. In short, s.33 is not inherently democratic. The political morality of each use of the notwithstanding clause—including whether it helps or harms democracy—must be assessed on a case-by-case basis. This article compares the ways in which Michel Foucault’s and Quentin Skinner’s historical analyses seek to unsettle the limits on present forms of freedom. We do so by comparing their ways of analysing discourse, rationality and agency. The two authors differ significantly in the ways they deal with these three phenomena. The most significant difference lies in their ways of addressing agency and its relationship to power. Notwithstanding these differences, the historical analyses of both authors seek to problematize the (...) ways in which past thoughts and practices limit contemporary forms of freedom. While Foucault seems to go furthest in this endeavour, a comparison may enrich both lines of historical analyses. (shrink)

Canada is caught between two empires and between two constitutional systems. However, neither the British model of a "single sovereign" nor the American people's "sacred fire of liberty" matched the pluralistic identity of Canada, so Canadians engaged in constitutional experimentation. In Canada and the Ethics of Constitutionalism Samuel LaSelva argues that, in order to understand the old Canada of Confederation and the new one that followed the Charter of Rights and Freedoms, it is necessary to see how distinctive Canadian constitutionalism (...) is and how that distinctiveness does not depend on borrowings from the British or American constitutional models. LaSelva supports his argument by exploring different aspects of Canada's contribution to the ethics of constitutionalism including the limits of free expression, the Charter's notwithstanding clause, the origins and functions of judicial review, the Quebec secession debate, Aboriginal self-government, and the conception of Canada as a multicultural and multinational mosaic. Through a careful consideration of how Canadian constitutional pluralism with its focus on the rights of others differs from American and British ideas, Canada and the Ethics of Constitutionalism provides engaging answers to contested questions about how Canada was founded and what it has become. This study shows that the Turkish expression _hani_ exhibits interesting properties for the study of the semantics and pragmatics interface, because, on the one hand, its function is merely pragmatic, but on the other hand, it is subject to the truth-conditional effect of other constituents at LF. This notwithstanding, studies on this expression are remarkably scarce. The only attempts to describe its properties are Erguvanlı-Taylan (Studies on Turkish and Turkic languages; proceedings of the ninth international conference on Turkish linguistics, (...) 133–143, 2000 ), Akar et al. (Discourse meaning, 57–78, 2020 ), and Akar and Öztürk (Information-structural perspectives on discourse particles, 251–276, 2020 ). In the present study, we introduce the first formal semantic and pragmatic treatment of clauses containing _hani_. Unlike previous accounts, we claim that _hani_ can have one of the following two major pragmatic functions: making salient a proposition in the Common Ground or challenging one in a past Common Ground, therefore requiring a Common Ground revision. Despite its variety of occurrences, we argue that _hani_ has a uniform interpretation and provide a compositional analysis of the different construals that it is associated with. Furthermore, we show that a formally explicit and accurate characterization of _hani_ clauses requires operating on indexical parameters, in particular the context time. Therefore, if our proposal is on the right track, _hani_ clauses may provide indirect empirical evidence in favour of the existence of “monstrous” phenomena, adding to the accumulating cross-linguistic evidence in this domain (see Schlenker in Linguistics and Philosophy 26(1):29–120, 2003 and much work since then). Cyber warfare is becoming a new reality with new battles fought everyday on virtual battlefields. For a century and a half, International Humanitarian Law has been a sentry for victims of wars guaranteeing their legal protection from the calamities of war, trying hard to respond to Clausewitz’s “chameleon of war”. Cyber conflict marks new chameleon’s colour together with the unmanned aerial vehicles, autonomic battle systems and other technologies deployed on battlefields. However, it would be greatly erroneous to claim that the (...) International Humanitarian Law may not apply to the new phenomena just because it is caused by the advanced technology. Even if the Geneva Conventions of 1949 are already sixty years old, the International Humanitarian Law in itself has at minimum customary response mechanism, granting, in a spirit of Marten’s clause, protection and authority of the principles of international law derived from established custom, from the principles of humanity and from dictates of public conscience (Protocol I). Notwithstanding, some more complicated fundamental issues also have to be addressed: how the use of cybernetic weapons and means may affect the classic notion of armed conflict? How it can be interpreted in the light of new technologies, i.e. can we still rely on a classic understanding of weapon’s kinetic effect as the main element, or shall we embrace effectsbased “Schmitt’s criteria”. If it so happens, will it make an act without apparent damage to a person/property equal to military hostilities, required by the armed conflict notion and justify the real-life response to it. The effective or overall control tests were used for the attribution of non-state actor’s activity to the state party of an armed conflict but these tests might not meet its purpose in the virtual battlefield of loose networks and open-source communities. If the concept of armed conflict is treated more flexibly, other changes (including issues of attribution) may follow, as well. Perhaps this is the way how the combatant institute will evolve. With classic combatant’s criteria impossible to apply on virtual battlefields, one of the options would be to elaborate concepts of “constant combat function” and “direct participation in hostilities” more precisely, as well as to reconsider state’s affiliation requirements. Backward induction has been the standard method of solving finite extensive-form games with perfect information, notwithstanding the fact that this procedure leads to counter-intuitive results in various games. However, beginning in the late eighties, the method of backward induction became an object of criticism. It is claimed that the assumptions needed for its defence are quite implausible, if not incoherent. It is therefore natural to ask for the justification of backward induction: Can one show that rational players who know (...) the structure of the game, have trust in each other's practical rationality and reason correctly, will act in accordance in backward induction? Several researchers have tried a justification of this kind, but the argument presented in Robert Aumann's paper from 1995 is perhaps the most well-known and influential attempt to provide such a justification. Clausing provides a sustained discussion of the justification problem for backward induction. It is an excellent work and the criticism I will present below does not detract from this evaluation: the issues discussed by the author are complex and it is difficult to get everything right. Furthermore, I hope that the criticism to be presented may be instructive; Even though it has not been Clausing's intention, his logical reconstruction of Aumann's defence of backward induction allows us to see very clearly what is wrong with that argument. Computer simulations are often claimed to be opaque and thus to lack transparency. But what exactly is the opacity of simulations? This paper aims to answer that question by proposing an explication of opacity. Such an explication is needed, I argue, because the pioneering definition of opacity by P. Humphreys and a recent elaboration by Durán and Formanek are too narrow. While it is true that simulations are opaque in that they include too many computations and thus cannot be checked (...) by hand, this doesn’t exhaust what we might want to call the opacity of simulations. I thus make a fresh start with the natural idea that the opacity of a method is its disposition to resist knowledge and understanding. I draw on recent work on understanding and elaborate the idea by a systematic investigation into what type of knowledge and what type of understanding are required if opacity is to be avoided and why the required sort of understanding, in particular, is difficult to achieve. My proposal is that a method is opaque to the degree that it’s difficult for humans to know and to understand why its outcomes arise. This proposal allows for a comparison between different methods regarding opacity. It further refers to a kind of epistemic access that is important in scientific work with simulations. (shrink)

The search for a quantum theory of the gravitational field is one of the great open problems in theoretical physics. This book presents a self-contained discussion of the concepts, methods and applications that can be expected in such a theory. The two main approaches to its construction - the direct quantisation of Einstein's general theory of relativity and string theory - are covered. Whereas the first attempts to construct a viable theory for the gravitational field alone, string theory assumes that (...) a quantum theory of gravity will be achieved only through a unification of all the interactions. However, both employ the general method of quantisation of constrained systems, which is described together with illustrative examples relevant for quantum gravity. There is a detailed presentation of the main approaches employed in quantum general relativity: path-integral quantisation, the background-field method and canonical quantum gravity in the metric, connection and loop formulations. The discussion of string theory centres around its quantum-gravitational aspects and the comparison with quantum general relativity. Physical applications discussed at length include the quantisation of black holes, quantum cosmology, the indications of a discrete structure of spacetime, and the origin of irreversibility. This book will be of interest to researchers and students working in relativity and gravitation, cosmology, quantum field theory and related topics. The ability to read emotions in faces helps humans efficiently assess social situations. We tested how this ability is affected by aspects of familiarization with face masks and personality, with a focus on emotional intelligence. To address aspects of the current pandemic situation, we used photos of not only faces per se but also of faces that were partially covered with face masks. The sample, the size of which was determined by an a priori power test, was recruited in Germany (...) and consisted of healthy individuals of different ages [M = 24.8 years]. Participants assessed the emotional expressions displayed by six different faces determined by a 2 × 3 design. Each person was presented with six different emotional displays with or without a face mask. Accuracy and confidence were lower with masks—in particular for the emotion disgust but also for happiness, anger, and sadness. When comparing the present data collected in July 2021 with data from a different sample collected in May 2020, when people first started to familiarize themselves with face masks in Western countries during the first wave of the COVID-19 pandemic, we did not detect an improvement in performance. There were no effects of participants’ emotional intelligence, sex, or age regarding their accuracy in assessing emotional states in faces for unmasked or masked faces. (shrink)

The goal of this paper is to re-assess reflective equilibrium (“RE”). We ask whether there is a conception of RE that can be defended against the various objections that have been raised against RE in the literature. To answer this question, we provide a systematic overview of the main objections, and for each objection, we investigate why it looks plausible, on what standard or expectation it is based, how it can be answered and which features RE must have to meet (...) the objection. We find that there is a conception of RE that promises to withstand all objections. However, this conception has some features that may be unexpected: it aims at a justification that is tailored to understanding and it is neither tied to intuitions nor does it imply coherentism. We conclude by pointing out a cluster of questions we think RE theorists should pay more attention to. (shrink)

What role does intelligence play in separating the organic from the inorganic, the living from the inert? Reflective equilibrium (RE) is often regarded as a powerful method in ethics, logic, and even philosophy in general. Despite this popularity, characterizations of the method have been fairly vague and unspecific so far. It thus may be doubted whether RE is more than a jumble of appealing but ultimately sketchy ideas that cannot be spelled out consistently. In this paper, we dispel such doubts by devising a formal model of RE. The model contains as components the agent’s commitments and a (...) theory that tries to systematize the commitments. It yields a precise picture of how the commitments and the theory are adjusted to each other. The model differentiates between equilibrium as a target state and the dynamic equilibration process. First solutions to the model, obtained by computer simulation, show that the method allows for consistent specification and that the model’s implications are plausible in view of expectations on RE. In particular, the mutual adjustment of commitments and theory can improve one’s commitments, as proponents of RE have suggested. We argue that our model is fruitful not only because it points to issues that need to be dealt with for a better understanding of RE, but also because it provides the means to address these issues. In his Critique of Pure Reason, in the chapter on the antinomy of pure reason, Kant not only argues that aprioristic cosmology is doomed to failure; he also implies that empirical knowledge about the universe is impossible. Today, such a negative verdict about the possibility of cosmological knowledge seems implausible because physical cosmology has made substantial progress. In particular, the spatiotemporal extension of the universe now seems a matter of empirical investigation in which models figure centrally. But I think it (...) is worth considering the possibility that Kant got something right and that he offers insights that can help us to better understand problems in present-day cosmology. In this article, I explore a striking coincidence: according to both Kant and current wisdom, cosmology faces a serious underdetermination problem regarding the spatiotemporal extension of the world. As a closer analysis reveals, however, Kant and modern cosmology differ on the reasons why underdetermination arises. In current cosmology, underdetermination follows from laws that are knowable a posteriori, and not only from the very idea of cosmological knowledge, as Kant would have it. This suggests that the current underdetermination problem is not fully a Kantian one. (shrink)

The Formalist tradition in late-scholastic philosophy has gone unnoticed in standard historiography. This article’s overall objective is to add the Formalist tradition to what we know about Renaissance philosophy. I first show how the Formalist tradition was born out of some innovative considerations of hierarchies of distinctions in the wake of the Franciscan John Duns Scotus’s teaching on the formal distinction in the beginning of the fourteenth century (especially Francis of Meyronnes’s model of four distinctions and Petrus Thomae’s more elaborate (...) doctrine of seven kinds of distinctions). I then trace how Formalist literature developed from being an exclusively Franciscan affair to becoming a much more widespread phenomenon. Thus, from the decades up to 1500 and onwards, authors from various late-scholastic schools (Thomism, Lullism, Averroism, and others) produced Formalist literature, i.e., treatises on multiple kinds of distinctions. I highlight particularly how one Franciscan philosopher of the sixteenth century, Jean Du Douet, proposed to view the Formalist preoccupation with distinctions as a discipline in its own right, a proper scientia formalitatum. I finally argue that while this proposal met with dismissive reactions, Du Douet’s idea does in fact reflect the role Formalism played in the scholastic curriculum in the late sixteenth century, at least in Franciscan milieus. The ancient virtue of practical wisdom has lately been enjoying a remarkable renaissance in management literature. The purpose of this article is to add clarity and bring synergy to the interdisciplinary debate. In a review of the wide-ranging field of the existing literature from a philosophical, theological, psychological, and managerial perspective, we show that, although different in terms of approach, methodologies, and justification, the distinct traditions of research on practical wisdom can indeed complement one another. We suggest a conciliatory conception (...) of the various features of practical wisdom in management. This we take as a point of departure for a discussion of the significant implications of the subject for the theory and practice of management and for the direction of further research in the field. Lamenting the deplorable state of business ethics is, itself, a staple of the deplorable state of business ethics. But if, as its many critics claim, business ethics continuously fails to deliver on its promise, what could take its place in management education? Die Philosophie des Barockscotismus war einerseits durch die rückwärtsgewandte Anknüpfung an den mittelalterlichen Denker Johannes Duns Scotus, andererseits durch die Anknüpfung an die Entwicklung in der zeitgenössischen Scholastik, vor allem der Jesuitenscholastik, geprägt. Welche Art von Metaphysik hat diese besondere philosophiehistorische Konstellation hervorgebracht? Um diese Frage zu beantworten, analysiert die vorliegende Arbeit das Metaphysikwerk des wichtigsten Repräsentanten des frühneuzeitlichen Scotismus, Bartholomaeus Mastrius (1602-1673); sie erschließt außerdem eine Vielzahl von kaum bis gar nicht erforschten Metaphysikwerken aus der Franziskanerscholastik des 17. und (...) 18. Jahrhunderts. Das eigenartige, erstaunliche Vielfalt einschließende Profil einer in Vergessenheit geratenen philosophischen Tradition wird deutlich. Durch den Fokus auf ein philosophiehistorisches Phänomen außerhalb des Mainstreams leistet die Arbeit einen Beitrag zu einer differenzierteren Sichtweise der intellektuellen Kultur der europäischen Frühmoderne. Baroque-age Scotist philosophy was, on the one hand, characterised by recourse to the Medieval thinker John Duns Scotus and, on the other hand, by an adaptation to trends in contemporary scholasticism, first of all that of the Jesuits. What kind of metaphysics did this particular constellation within the history of philosophy produce? In order to answer this question, the present book analyses the work on metaphysics by the most important representative of early modern Scotism, Bartolomeo Mastri (1602-1673). In addition, the book investigates a multitude of scarcely or never studied works on metaphysics from the Franciscan scholastic tradition of the 17th and 18th centuries. The peculiar profile of a forgotten philosophical tradition with its astonishing plurality becomes apparent. By focusing on a phenomenon from the history of philosophy outside the mainstream, this work contributes to a more differentiated view on the intellectual culture in early modern Europe. (shrink)

Bartolomeo Mastri’s Disputations on Metaphysics is the single most important work on metaphysics produced in the Scotist school during the Early Modern period. This contribution guides through the work by highlighting a selection of key passages that convey an impression of its historical-literary context, its subject matter, its main motifs and scientific aims, but also its limitations. Especially, we see Mastri emphasizing the theological aspect of theology, though he in the end refrains from exploring this aspect of metaphysics within his (...) work on metaphysics. I suggest that this discrepancy between Mastri’s concept of metaphysics and his work on metaphysics showcases the difficulty of organizing this discipline during the phase of transition from the traditional commentary format typical of medieval scholasticism to the Early Modern scholastic Cursus philosophicus literature. Cryptocurrencies such as Bitcoin, SETLcoin, Ether, Solar Coin, or Liberty Reserve exist since 2009. Because of their decentralized control, they are often considered a threat or alternative to the conventional centralized banking system. While the technological implication of some such currencies, especially of Bitcoin, has attracted much attention, so far there is little discussion about the entire field of cryptocurrencies and very little academic literature addressing its ethical significance. In this article, we thus address the impact of “blockchain technology” on (...) the nature of financial transactions from a business ethics perspective. We begin with a survey on relevant literature from neighboring disciplines. Next, we work towards a 3 × 3 framework for current debates on the ethics of cryptocurrencies : we combine the micro, meso, and macro levels of business and society with assessments of the potential ethical impact of cryptocurrencies as morally beneficial, detrimental, and ambiguous. In addition, we highlight possible avenues for future research, such as the changing roles of the miners and regulators, the prosocial use of cryptocurrencies, the antisocial use for shadow banking and transactions in the ‘dark net’ and cryptocurrencies’ effect on inflation and deflation. This chapter uncovers a less investigated aspect of the relationship between the two most important scholastic schools of the Renaissance, Thomism and Scotism: the influence of Scotist literature on distinctions as seen in some sixteenth-century Thomists. The chapter has a primary focus on Chrysostomus Javelli’s engagement in his discussion of divine attributes with the Scotist doctrine of distinctions, but also considers other Thomist sources. First, the beginnings of the highly specialised Scotist literature on distinctions are traced back to the start (...) of the fourteenth century; I show how some early followers of Duns Scotus, in particular Francis of Meyronnes and Petrus Thomae, systematised Scotus’ ontology of the various grades of being by compiling lists of subtle distinctions to be applied to various levels of reality. I give some indications as to the later reception of these models of distinctions in the Scotist school. Special attention is paid to Étienne Brulefer, since his summary of Petrus Thomae’s model of seven distinctions was Javelli’s source for the Scotist doctrine. I then investigate how Javelli worked with Brulefer’s summary, and how he sought to integrate the Scotist doctrine into his own discussion of divine attributes. Thomists traditionally allowed only a rational or mental kind of distinction among divine attributes, and between them and the divine essence. Javelli, however, endeavours to show how the Thomist position may be reconciled with the Scotist doctrine of a formal or ex natura rei distinction. He did not always endorse this conciliatory approach; I hypothesise that he changed his mind on the subject over time. Finally, I show how other Renaissance Thomists reacted to the Scotist system of distinctions; in particular, I draw attention to the Thomists Andreas Bodenstein von Karlstadt, Bartolomeo Manzoli, and Mattia Gibboni da Aquario, who all wrote treatises on Thomist distinction theory modelled on the Scotist system of distinctions. In some of this literature, lists of distinctions based on Thomist metaphysics were compiled in order to replace the Scotist system. I argue that Javelli’s approach is more conciliatory and, in fact, has some overlap with the concordist thought of Giovanni Pico della Mirandola, who himself considered Scotus and Aquinas to be in fundamental agreement as regards the distinction between divine attributes. As a philosopher, whose theory about economics and business is systematically connected to a moral and political philosophy, Aristotle provides a rich conceptual framework to reflect upon personal wellbeing, the wealth of households, and the welfare of the state. Even though Aristotle has mainly been portrayed as an enemy of business, interest in his teachings has been on the rise among management scholars. Several articles have examined Aristotle's position with regard to current managerial approaches such as total quality management, knowledge (...) management, crisis management, and networking. Even though Aristotle is a constant reference point for business ethics scholars, only rarely have there been attempts to see what consequences his thinking would have for reorienting business philosophy and organizational strategy. In this study, we wiD outline how Aristotle's theory of household management can be applied to the management of modern corporations. We argue that conceptions of chrematistike and oikonomia provide a basis to discuss the relationship between business and society and to draw important conclusions for business management. (shrink)

This article pursues the question whether and inasmuch theories of corporate responsibility are dependent on conceptions of managerial freedom. I argue that neglect of the idea of freedom in economic theory has led to an inadequate conceptualization of the ethical responsibilities of corporations within management theory. In a critical review of the history of economic ideas, I investigate why and how the idea of freedom was gradually removed from the canon of economics. This reconstruction aims at a deconstruction of certain (...) axioms of neoclassical economics that hamper contemporary efforts in integrating ethics firmly into management education. I intend to show by these deconstructive endeavors that a constructive use of the idea of responsible freedom could correct and complement the current quantitative focus in business theory through qualitative orientations. I argue that with the help of qualitative success criteria, the strategic integration of the tenets of both business ethics and Corporate Social Responsibility into business practice can be advanced by further research. One point that definitions of art experience disagree about is whether this kind of experience is qualitatively different from experiences related to ordinary objects and everyday contexts. Here, we follow an ecological approach assuming that art experience has its own specific quality that is, not least, determined by typical contexts of art presentation. Practically, we systematically observe typical phenomena of experiencing art in ecologically valid or real-world settings such as museum contexts. Based on evidences gained in this manner, we emulate (...) and implement essential properties of ecological contexts (e.g., free choice of viewing distance and time, large scale of artworks and exhibition-like context) in controlled laboratory experiments. We found, for instance, that for large scale paintings by Pollock and Rothko preferred viewing distances as well as distances inducing most intense art experiences including Aesthetic Aha insights were much larger than typical viewing distances realized in lab studies. Following Carbon’s (2019) terminology of measurement strategies of art experience, the combined use of “Path #1” (real-world context) and “Path #2” (mildly controlled, still ecologically valid settings and contexts), enables us to understand and investigate much closer what is really happening when people experience art. El presente trabajo describe y analiza, desde una perspectiva de género, el escenario laboral de una cárcel de mujeres en Argentina: la Unidad Penitenciaria N° 4 de la ciudad de Santa Fe. Partimos de considerar la articulación entre trabajo y género en la prisión como un dispositivo de gobierno —que funciona de modos tanto represivos como orientados a la producción de determinadas formas de subjetividad— que se constituye, al mismo tiempo, como un sitio potencial para el desarrollo de formas diversas (...) de agenciamiento de las mujeres detenidas. En esta dirección, nos enfocamos, primero, en el modo en que el trabajo vehiculiza imágenes sobre las mujeres detenidas y su “corrección”. En segundo lugar, analizamos los diversos usos y sentidos que las mujeres detenidas hacen del trabajo y de los ingresos allí obtenidos. A partir de ello, mostramos en primer lugar de qué manera el trabajo hace visible el tipo de subjetividad que la institución penitenciaria intenta construir, caracterizada no sólo por exigencias de conformidad a modelos tradicionales de feminidad sino también por el intento de construir subjetividades (micro) emprendedoras y proactivas. Al mismo tiempo, mostramos cómo las mujeres detenidas se valen tanto de la oferta institucional como de una serie de nichos que crean por fuera de esta para construir espacios de agenciamiento que, con ciertos límites, les permiten hacer frente a algunas de las privaciones operadas por la pena privativa de la libertad y por la subordinación de género más en general. In the light of growing political and religious fundamentalism, this open access book defends the idea of freedom as paramount for the attempt to find common ethical ground in the age of globality. The book sets out to examine as yet unexhausted ways to boost the resilience of the principle of liberalism. Critically reviewing the last 200 years of the philosophy of freedom, it revises the principle of liberty in order to revive it. It discusses many different aspects that fall (...) under its three main topics: the metaphysics of freedom, quantitative freedom and qualitative freedom. Open societies worldwide have come under increasing pressure in the last decades. The belief that politics and markets fare best when guided by the principle of liberty presently faces multiple challenges such as terrorism, climate warming, inequality, populism, and financial crises. In the view of its critics, the idea of freedom no longer offers adequate guidance to meet these challenges and should be partially corrected or even entirely replaced by countervailing values. Against the reduction of freedom to the merely quantitative question as to how much liberties individuals call their own, this book draws attention to the qualitative concerns which and whose opportunities society should foster. It argues that, correctly understood, the idea of liberty commits us to defend as well as advance the freedom of each and every world citizen. (shrink)

This essay argues that what is provoking about Ibn Rushd today is not his stance on such topics as the eternity of the world, God's knowledge of singular things, or the immortality of the soul. It is rather his radical philosophical elitisim, i.e., his view that every religion has room for philosophy, but only for the few - the majority must simply follow holy writ and leave all questioning and allegorical interpretation to those few individuals who possess sufficient training in (...) apodictic thinking. I start out with chapters on Salman Rushdie and his view of Ibn Rushd in the novel Two Years, Eight Months and Twenty-Eight Nights and the reception of Ibn Rushd in the Latin scholastic tradition. I then switch to Ibn Rushd’s biography and the context of his work in Almohad Andalusia. I provide an overview of the development of Islamic philosophy up until Ibn Rushd. I then, in five chapters, offer a detailed reading of his fatwa in defense of philosophy (called the Decisive Treatise). I conclude with some general remarks on the relationship between metaphysics and politics in Ibn Rushd’s works, drawing parallels to other thinkers both in the Islamic and in the Western tradition. The book ends with a selection of Danish-language translations of texts by Ibn Rushd that were translated into Latin during the Middle Ages and the Renaissance (his Letter to a friend concerning God’s knowledge of singular things, the last chapter of the Incoherence of the Incoherence, and commenta 5 and 36 from the Commentary on De anima III). Die Philosophie des Barockscotismus war einerseits durch die rückwärtsgewandte Anknüpfung an den mittelalterlichen Denker Johannes Duns Scotus, andererseits durch die Anknüpfung an die Entwicklung in der zeitgenössischen Scholastik, vor allem der Jesuitenscholastik, geprägt. Welche Art von Metaphysik hat diese besondere philosophiehistorische Konstellation hervorgebracht? Um diese Frage zu beantworten, analysiert die vorliegende Arbeit das Metaphysikwerk des wichtigsten Repräsentanten des frühneuzeitlichen Scotismus, Bartholomaeus Mastrius (1602-1673); sie erschließt außerdem eine Vielzahl von kaum bis gar nicht erforschten Metaphysikwerken aus der Franziskanerscholastik des 17. und (...) 18. Jahrhunderts. Das eigenartige, erstaunliche Vielfalt einschließende Profil einer in Vergessenheit geratenen philosophischen Tradition wird deutlich. Durch den Fokus auf ein philosophiehistorisches Phänomen außerhalb des Mainstreams leistet die Arbeit einen Beitrag zu einer differenzierteren Sichtweise der intellektuellen Kultur der europäischen Frühmoderne. Baroque-age Scotist philosophy was, on the one hand, characterised by recourse to the Medieval thinker John Duns Scotus and, on the other hand, by an adaptation to trends in contemporary scholasticism, first of all that of the Jesuits. What kind of metaphysics did this particular constellation within the history of philosophy produce? In order to answer this question, the present book analyses the work on metaphysics by the most important representative of early modern Scotism, Bartolomeo Mastri (1602-1673). In addition, the book investigates a multitude of scarcely or never studied works on metaphysics from the Franciscan scholastic tradition of the 17th and 18th centuries. The peculiar profile of a forgotten philosophical tradition with its astonishing plurality becomes apparent. By focusing on a phenomenon from the history of philosophy outside the mainstream, this work contributes to a more differentiated view on the intellectual culture in early modern Europe. (shrink)

Der Beitrag von Claus Pias geht von zwei Beobachtungen aus: einem Zurücktreten des Medienbegriffs innerhalb medienwissenschaftlicher Forschung und eines Desinteresses sogenannter ›Digitalisierung‹ ihr gegenüber. Er untersucht, inwiefern Medientheorie (von McLuhan und Kittler bis zu den sogenannten Digital Humanities) durch einen starken Medienbegriff an der Herausbildung von Zeitsemantiken und Narrativen von ›Digitalisierung‹ beteiligt war und von ihnen profitiert hat. Als Konsequenz fordert Pias zu medienwissenschaftlicher Grundlagenforschung auf, die mit einer strategischen Revision und Aktualisierung von ›Medien‹ als Begriff und Gegenstand einhergeht. Der (...) Beitrag von Kathrin Peters stimmt mit dieser Lagebeschreibung nur teilweise überein. Die Skepsis gegenüber den Zukunfts- und Dringlichkeitsrhetoriken gegenwärtiger Digitalisierungsoffensiven wird von ihr geteilt, dass allerdings vor allem eine Medienwissenschaft des ›medientechnischen a priori‹ eine Antwort auf den gegenwarts- und an- wendungsfixierten Digitalisierungsdiskurs liefern könnte, erscheint Peters als zu kurz gegriffen. Andere medienwissenschaftliche Ausrichtungen sind dazu ebenso in der Lage: medienwissenschaftliche Analysen zu Kolonialität und Postkolonialität, feministische, gen- der- und queertheoretische Fragestellungen, eine medienwissenschaftlich informiert Wissenschaftsforschung und Affekttheorie – um nur einige zu nennen. Es geht um Konzepte von Medienwissenschaft als Fragestellung, die ihre Gegenstände in den verschiedensten Bereichen hervorbringen, dabei aber zugleich als Mittel und Mittler immer wieder unsichtbar werden. Debate: Media Studies without Media Claus Pias’ article starts out from two points of observation: a recession of the term media within the field of media studies and a dis- interest of the so-called digitalization in this particular term. Pias examines the impact media theory (ranging from McLuhan and Kittler to the so-called Digital Humanities) had on the development of time semantics and the narratives of ›digitalization‹ due to the use of a strong media term, and how media theory profited from it. mAs a result, Pias calls for establishing basis research in media studies, going hand in hand with a strategic revision and update of media, as a term as well as a subject. In her article, Kathrin Peters only partially agrees with this evaluation. She shares the scepticism concerning future-rhetoric as well as priority-rhetoric, both featuring heavily in current digital offensives; however, in her opinion it is not enough to hope for answers on today’s digitalization-discourse from media studies hailing the media-technical a priori. There are other approaches in media studies which are able to offer these answers: analysis of colonialism and post-colonialism, feministic, gender- and queer-theoretical questions, a media-informed science of knowledge and affect theory, just to name a few of them. It is all about concepts of media science being perceived as problems which bring forth their own subjects in various areas of research, yet as a tool as well as an intermediary, they are frequently overlooked. The ontological status of esse cognitum was at the center of complex debates throughout the Scotist tradition (Alnwick vs. Aesculo, Mastri vs. Punch). This article investigates the Scotist Angelo Volpe’s discussion of esse cognitum enjoyed by possible creatures in the divine intellect. Volpe responds to two religious warnings, one against assuming any eternal real being for merely possible creatures, and a second against depriving God’s eternal knowledge of a corresponding object, since that would endanger this knowledge itself. Volpe opts for (...) a solution that allows possible creatures the status of beings of reason (entia rationis) due to their own ontological merit, and the status of real beings (entia realia) due to God’s knowing that they as possibles are not in opposition to real existence. He rejects the view that esse cognitum is a kind of being that holds a middle position between real being and being of reason. Volpe’s historical significance is emphasized. (shrink)

The present paper defends a position advanced in Oetke ) to the effect that a piece of reasoning allegedly advocated by proponents of Indian Materialism does not deserve to be dismissed as a sophism but embodies a significant philosophical criticism. In addition the article argues for the contention that for this type of theoretical assessment consideration of history of reception possesses at best a limited relevance and is even apt to impede the attainment of an adequate evaluation of the matter.

This contribution builds on the idea of integrating truth-fulfilling entities into a truth-conditional semantics. It asks which kind of truth conditions are to be considered for statements of something being really there – as opposed to just being an intentional object. The adverbial theory of perception treats experiences, for example appearances (visual experiences), as ‘adverbially’ classified. As a further approach towards how an object is related to its appearance (being experienced visually), semantical externalism is considered. On this basis, it is (...) proposed that the notion of existence can be understood as a disposition to be experienced: y being really there is explicated as a disposition to experiences that are adverbially characterized as y-experiences. This approach helps to understand the different perspectives of the natural sciences and the arts and humanities. While the natural sciences are directed towards y, the arts and humanities primarily deal with y-experiences. (shrink)

Business Ethics: A European Review, EarlyView.

This paper discusses recent attempts to solve the problem of induction. Two broad strategies to escape Hume's fork can be distinguished. The first tries to localize the justification of specific inductions in uncontroversial empirical knowledge, e.g.mundane scientific knowledge (J. D. Norton) or perception (M. Lange). I argue that related attempts to (dis)solve the problem fail. The second strategy tries to put forward an argument in favor of induction. As a discussion of work by R. White shows, this argument can barely (...) prove that induction is reliable or at least not unreliable. But D. Steel, F. Huber and G. Schurz could show that enumerative induction is necessary and sufficient for a certain epistemic goal or optimal in a certain sense. These proofs, however, only solve the problem of induction if the goal or a certain standard has priority over the avoidance of error. This suggests that the difficulties to justify induction do not so much derive from Hume's fork, but rather from a plurality of sensible epistemic goals that can conflict with each other. (shrink)

Kurt Gödel war nicht anwesend. Dabei hatte der berühmte Mathematiker etwa 15 Jahre zuvor Arbeiten veröffentlicht, die ganz wesentlich und weitreichend mit dem Begriff der Zeit zu tun hatten.

From 30 May to 1 June Cornell University hosted a small conference on the nature of time, organised by the originally Viennese astro-physicists Hermann Bondi and Thomas Gold. Kurt Gödel did not attend, although roughly 15 years earlier the famous mathematician had made a significant contribution to this field.
