Since Rawls's Political Liberalism is by now the subject of a wide and deep philosophical literature, much of it excellent in quality, it would be foolhardy to attempt to say something about each of the major issues of the work, or to sort through debates that can easily be located elsewhere. I have therefore decided to focus on a small number of issues where there is at least some chance that a fresh approach may yield some new understanding of (...) the text: Rawls's distinction between “reasonable” and “unreasonable” comprehensive doctrines; the psychological underpinnings of political liberalism; and the possibility that political liberalism might be extended beyond the small group of modern Western societies that Rawls's historical remarks suggest as its primary focus. I also include a discussion of the much-debated issue of civility and public reason, which could hardly be avoided given its prominence in the book's reception. This paper should therefore be read not as a comprehensive account of the work but as one person's attempt to grapple, very incompletely and imperfectly, with a book that is as great as any philosophy has seen on this topic of great human urgency. He made her see her soul, then, with a speech. And many types of speeches try to do what Hamlet did here. They present us with accounts or pictures of ourselves, attempting to communicate to us some truth about what we really are — or (to (...) use what is already a certain sort of picture) to show us die insides of our human souls. These truths about ourselves are delivered in many different styles and forms: some through structured argument, some through more devious or more violent strategies. One distinguished thinker compared his discourse about the nature of the soul to dry translucent shafts of sunlight diat disperse the dark shadows of false belief. Another represents the recipient of a true account of the inside of her soul as crying out in pain: "These words like daggers enter in my ears." Clearly there ought to be connections between the way a drinker or writer conceives of the soul and the way he or she constructs a discourse to convey important trudis to such a soul — including, and especially, the truth about the nature of the soul. I apply this theory to an analysis of women's inadequate access to high-quality, cost-effective healthcare. I conclude that while quandaries remain unresolved, including getting men to do their share of dependency work, Kittay's book is an important and original contribution to feminist healthcare ethics and the development of a normative feminist ethic of care.

But we know we are far from the world of the Christian ascent, even its erotic Augustinian form. While we are familiar with socialist and fascist aesthetics, liberalism is not usually thought to permit a political role for literature. Nussbaum has attempted to fill this lacuna. She sketches a “liberal aesthetics” by linking three aspects of literature to her normative proposal. The representation of suffering is connected to the capability approach; the presentation of ethical dilemmas to political liberalism; and the reaction of pity to legal and political judgment. Literature is thus hoped to contribute to the stability of (...) liberal democracies. For over 25 years, individual works by Nussbaum on the value of literature have been critiqued on aesthetic grounds: for not dealing with form, for denying the polyphony of texts, for having a limited conception of readerly identification, and for using an elitist and generically limited selection of material. As of yet, no criticisms have, however, considered the full oeuvre of Nussbaum’s defense of literature, and none have examined this aspect of her work in light of her political philosophy. By placing the aesthetic and political aspects of Nussbaum’s work in conversation, this article investigates the proposed relationship between literature and liberalism. It argues that each component of Nussbaum’s liberal aesthetics contains a political danger: foreclosing discussion of intergenerational responsibility; obscuring questions about which doctrines are permissible in the public sphere; and encouraging stereotypes of marginalized people. Literature, understood like this, may risk exacerbating present tensions within liberalism, rather than bolstering its stability. (shrink)

Using the bench trial of Colorado’s Amendment 2 as an example, this article focuses on the more general question of expert testimony in moral philosophy. It argues that there is indeed expertise in moral philosophy but argues against admitting such expert testimony in cases dealing with what John Rawls terms “constitutional essentials” and ‘matters of basic justice.” Developing the idea of public reason inherent in the Rawlsian concept of political liberalism, the article argues that philosophers can and should speak out (...) on public issues, if they do so with due respect for certain restrictions, but that they should not serve as expert witnesses on core constitutional questions, since doing so suggests that they claim a type of authority that would require fellow citizens to defer to their views. Such claims to authority in basic ethical matters threaten the mutual respect for divergent comprehensive doctrines that lies at the core of political liberalism. Philosophers have a duty to serve the public good, and they perform this service in fruitful ways. But they should refuse a public role that appears incompatible with equal respect for the committed ethical searching of their fellow citizens. (shrink)

Amartya Sen has made a major contribution to the theory of social justice, and of gender justice, by arguing that capabilities are the relevant space of comparison when justice-related issues are considered. This article supports Sen's idea, arguing that capabilities supply guidance superior to that of utility and resources (the view's familiar opponents), but also to that of the social contract tradition, and at least some accounts of human rights. But I argue that capabilities can help us to construct a (...) normative conception of social justice, with critical potential for gender issues, only if we specify a definite set of capabilities as the most important ones to protect. Sen's "perspective of freedom" is too vague. Some freedoms limit others; some freedoms are important, some trivial, some good, and some positively bad. Before the approach can offer a valuable normative gender perspective, we must make commitments about substance. (shrink)

Baehr challenges the reader to reconsider the dominant view that liberalism and feminism are 'incompatible.'.

Virtue ethics is standardly taught and discussed as a distinctive approach to the major questions of ethics, a third major position alongside Utilitarian and Kantian ethics. I argue that this taxonomy is a confusion. Both Utilitarianism and Kantianism contain treatments of virtue, so virtue ethics cannot possibly be a separate approach contrasted with those approaches. There are, to be sure, quite a few contemporary philosophical writers about virtue who are neither Utilitarians nor Kantians; many of these find inspiration in ancient (...) Greek theories of virtue. But even here there is little unity. Although certain concerns do unite this disparate group (a concern for the role of motives and passions in good choice, a concern for character, and a concern for the whole course of an agent''s life), there are equally profound disagreements, especially concerning the role that reason should play in ethics. One group of modern virtue-theorists, I argue, are primarily anti-Utilitarians, concerned with the plurality of value and the susceptibility of passions to social cultivation. These theorists want to enlarge the place of reason in ethics. They hold that reason can deliberate about ends as well as means, and that reason can modify the passions themselves. Another group of virtue theorists are primarily anti-Kantians. They believe that reason plays too dominant a role in most philosophical accounts of ethics, and that a larger place should be given to sentiments and passions -- which they typically construe in a less reason-based way than does the first group. The paper investigates these differences, concluding that it is not helpful to speak of virtue ethics, and that we would be better off characterizing the substantive views of each thinker -- and then figuring out what we ourselves want to say. Any defense of universal norms involves drawing distinctions among the many things people actually desire. If it is to have any content at all, it will say that some objects of desire are more central than others for political purposes, more indispensable to a human being's quality of life. Any wise such approach will go even further, holding that some existing preferences are actually bad bases for social policy. The list of Central Human Capabilities that forms the core of my (...) political project contains many functions that many people over the ages have preferred not to grant to women, either not at all, or not on a basis of equality. To insist on their centrality is thus to go against preferences that have considerable depth and breadth in traditions of male power. Moreover, the list contains many items that women over the ages have not wanted for themselves, and some that even today many women do not pursue – so in putting the list at the center of a normative political project aimed at providing the philosophical underpinning for basic political principles, we are going against not just other people's preferences about women, but, more controversially, against many preferences (or so it seems) of women about themselves and their lives. To some extent, my approach, like Sen's, avoids these problems of paternalism by insisting that the political goal is capability, not actual functioning, and by dwelling on the central importance of choice as a good. But the notion of choice and practical reason used in the list is a normative notion, emphasizing the critical activity of reason in a way that does not reflect the actual use of reason in many lives. The writings of Martha Nussbaum broadly defend an account of transcendence as internal, always rooted in the human context. Her account implies that any and all projects of normative theological ethics are superfluous, since they transcend the natural bounds of human experience and reason. This essay points toward a space for theology, specifically Jewish theology, in Nussbaum's work, through an analysis of her recent philosophical and autobiographical writings on Judaism. Nussbaum's account in Upheavals of Thought associates (...) Judaism with carnality and vulnerability; this essay supplements her account by pointing to a non-natural origin of emotional judgments in some of the texts Nussbaum treats. This move serves to temper the emphasis on autonomy in liberal Jewish thought, and provides an account of transcendence which can serve as the basis of a more traditional Jewish theological ethics. This article argues that political liberalism, of the type formulated by John Rawls and Charles Larmore and further developed in Amartya Sen and Martha Nussbaum's capabilities approach, is superior to more comprehensive political views both in domestic and in global affairs. Perfectionist liberalism as advocated by John Stuart Mill and Joseph Raz attempts to erase existing religions and replace them with the religion of utility or autonomy. This is wrong, because in the ethico-religious environment of reasonable disagreement that (...) we inhabit all comprehensive forms of political morality pose a threat to people's liberty and equality. Only thin and narrow conceptions of value like the ones suggested by Rawls, Larmore, Sen, and Nussbaum can guarantee the respect for diversity that is needed in a pluralistic world. Although Rawls famously failed to extend this idea from domestic to transnational matters, the argument of the article is that not only do the principles of political liberalism apply to global mat..
