Social psychology has based its development on triangle structures. Such are the cases of Symbolic Interactions and Social Representations. These triangle structures are not able even to draw an epistemology of common sense.

This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have (...) been deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. History appears already to the young Gramsci as a system of forces in unstable balance, which struggle to position themselves on the side of history, to identify with it. For this reason, in his reading of Marxism, the unity of history is a result, the product of a successful strategy of hegemony building. This article reviews the Gramscian theory of hegemony and tries to show its coherence with the philosophy of praxis, that is, with the notion of the fundamentally practical (...) nature of reality. In particular, it is argued that, on the one hand, a crisis of hegemony must be understood as disintegrating a hegemonic system, which allows subordinated hegemonic moments to emerge; on the other hand, the crisis itself is determined by the formulation of hegemonic discourses that try to escape their condition of subordination. La novela de Ishiguro _ Nunca me abandones _ (2005) suele calificarse de distópica, asumiendo que refleja una inaceptable injusticia al plantear la explotación de clones de humanos, ‘donadores’ de órganos para sus humanos originales. Empero, el concepto de distopía no puede caracterizar la situación descrita de manera absoluta, pues para la humanidad original realmente no hay un mal funcionamiento social; por su parte, a pesar de padecer enajenación orgánica y la restricción a su libertad, en la novela no (...) hay rebeliones de clones o crisis humanitaria sufrida por los clones. Pudiendo reflejar una utopía, provoca indignación y se categoriza como distopía en el supuesto de que los clones son también humanos o deberían contar como tales, pues así lo parecen. La parcialidad de la categorización distópica revela cierto prejuicio que impide ver que tal es la condición que el ganado enfrenta actualmente en nuestras sociedades. Su explotación no se categoriza como distópica ni injusta, a pesar de que comparte la misma forma de legitimidad en su explotación que los clones (‘para eso son’) y la misma limitación para articular por sí solos la resistencia de manera colectiva y sistemática. Conecto esta reflexión con el análisis de dos ámbitos en los que los animales no humanos son usados para fines no humanos: la experimentación biomédica y la ganadería. (shrink)

Judith Balso desarrolla en este artículo una visión orgánica de la heteronimia de Fernando Pessoa. En ella aspira a mostrar cómo la poesía afronta con sus propios recursos los desafíos y preguntas propios de la ontología. De ese modo Pessoa se coloca más allá de la tradicional separación entre filosofía y poesía propia de la metafísica occidental. Leer a Pessoa significa encarnar en la escritura las preguntas esenciales de lo humano: la cuestión de la existencia, la pregunta por el (...) ser y la nada, la relación del hombre con la Naturaleza, la interrogación del y por el lenguaje, la relación del hombre con los otros hombres. De ese modo se integran en su campo diversidad de inquietudes que van desde la gnoseología a la estética, de la ética a la literatura, del pensamiento de Dios y los dioses. La idea de Balso es que la crisis propia de la metafísica encuentra en Pessoa no sólo una resonancia sino posibles alternativas de renovación. Su ensayo invita a establecer una relación propositiva y carente de prevenciones entre poesía y filosofía. (shrink)

In the current evolutionary debate, the «Baldwin Effect» is increasingly mentioned. The aim of this article is to teoretically analyze the original form of this concept, initially called “organic selection”, through the thought of one of its main advocates: James Mark Baldwin. His evolutionary observations, almost forgotten in Modern Synthesis’s refolmulations of «Baldwin Effect», appear widely original in view of contemporary attempt to «extend» the darwinian paradigm.

La evolución orgánica es objeto de discusión en los ámbitos religiosos, con defensores y detractores. Entre los científicos no existen dudas acerca de la evolución orgánica como un hecho debidamente comprobado, que incluso es admitido dentro de la Iglesia católica. Las implicancias metafísicas de este hecho científico no necesariamente abonan una visión materialista, sino todo lo contrario, e incluso tales implicancias son perfectamente compatibles con la perspectiva aristotélico-tomista y hasta refuerzan los conceptos de creación y providencia.

El artículo intenta mediar entre dos posiciones opuestas: la actitud proveniente del concepto científico, físicomatemático, técnico y tecnológico de la naturaleza, y la actitud de un concepto organológico del mundo de la vida. La actitud ante la naturaleza será, según el caso, objetivante y dominadora, o simpatética y eco-ética. El artículo expone la historia de esta oposición y aboga por un cambio de mentalidad que integre al hombre y la naturaleza en un todo orgánico.

The article discusses possible ways of overcoming the environmental crisis. It is based on Šmajs’ evolutionary ontological understanding of the environmental crisis of nature, which distinguishes between natural and cultural evolution and demonstrates the opposing relationships between them. It critically develops one of Šmajs’ proposals for initiating a biophilic transformation of culture by dealing with some of the consequences of the economic crisis (specifically unemployment).

El presente trabajo se propone discutir acerca de los límites entre el Análisis del Dasein de Medard Boss y la Analítica del Dasein de Martin Heidegger. Tomando como punto de partida la aparición de la dimensión orgánica en las consideraciones de Boss, se discutirá cómo es que se devela una oposición en los énfasis temáticos correspondientes a una consideración filosófica y a una psicológica del ser humano. Dicha oposición será aclarada indagando en las respectivas motivaciones de ambos programas, para (...) destacarlas como sus eminentes límites. Finalmente, comprendiendo dichas motivaciones como límites, el artículo planteará que la insistencia de lo orgánico vigente aún en Boss señalaría problemáticas que pueden competer aun a la Analítica del Dasein del mismo Heidegger. En las sociedades modernas, un gran número de las decisiones que nos afectan descansan en los datos registrados en ficheros informatizados que contienen informaciones sobre millones de personas relativas a un amplio número de facetas de su vida. Para garantizar la dignidad, libertad y el pleno ejercicio de los derechos fundamentales frente al uso torticero de las nuevas tecnologías de la información, el artículo 18.4 de nuestra Constitución ha establecido una nueva garantía constitucional denominada tradicionalmente autodeterminación informativa. Este nuevo derecho (...) es configurado por nuestro Tribunal Constitucional como un derecho fundamental autónomo aunque estrechamente ligado al derecho a la intimidad y un derecho instrumental de garantía de otros derechos fundamentales. El contenido de este derecho es desarrollado en la nueva Ley de Protección de Datos Personales, la Ley Orgánica 15/1999, de 13 de diciembre, que sin duda aporta interesantes y positivas novedades. Sin embargo, al igual que sucedía en el caso de la L. O. 5/1992 LORTAD, siguen existiendo demasiadas sombras que pueden afectar al contenido esencial del derecho a la autodeterminación informativa y que impiden que efectivamente éste pueda cumplir su misión de garantizar la dignidad y la libertad de las personas en las nuevas sociedades de la información. The Crisis of European Sciences and Transcendental Phenomenology, Husserl's last great work, is important both for its content and for the influence it has had on other philosophers. In this book, which remained unfinished at his death, Husserl attempts to forge a union between phenomenology and existentialism. Husserl provides not only a history of philosophy but a philosophy of history. As he says in Part I, "The genuine spiritual struggles of European humanity as such take the form of struggles (...) between the philosophies, that is, between the skeptical philosophies--or nonphilosophies, which retain the word but not the task--and the actual and still vital philosophies. But the vitality of the latter consists in the fact that they are struggling for their true and genuine meaning and thus for the meaning of a genuine humanity.". (shrink)

Background The global COVID-19 pandemic has challenged nurse leaders in ways that one could not imagine. Along with ongoing priorities of providing high quality, cost-effective and safe care, nurse leaders are also committed to promote an ethical climate that support nurses’ moral courage for sustaining excellence in patient and family care. Aim This study is directed to develop a structure equation model of crisis, ethical leadership and nurses’ moral courage: mediating effect of ethical climate during COVID-19. Ethical consideration Approval (...) was obtained from Ethics Committee at Faculty of Nursing, Alexandria University, Egypt. Methods A cross-sectional design was used to conduct this study using validated scales to measure the study variables. It was conducted in all units of two isolated hospitals in Damanhur, Egypt. A convenient sample of 235 nurses was recruited to be involved in this study. Results This study revealed that nurses perceived a moderate mean percent (55.49 ± 3.46) of overall crisis leadership, high mean percent (74.69 ± 6.15) of overall ethical leadership, high mean percent (72.09 ± 7.73) of their moral courage, and moderate mean percent of overall ethical climate (65.67 ± 12.04). Additionally, this study declared a strong positive statistical significant correlation between all study variables and indicated that the independent variable (crisis and ethical leadership) can predict a 0.96, 0.6, respectively, increasing in the dependent variable (nurses’ moral courage) through the mediating impact of ethical climate. Conclusion Nursing administrators should be conscious of the importance of crisis, ethical leadership competencies and the role of ethical climate to enhance nurses’ moral courage especially during pandemic. Therefore, these findings have significant contributions that support healthcare organizations to develop strategies that provide a supportive ethical climate. Develop ethical and crisis leadership competencies in order to improve nurses' moral courage by holding meetings, workshops, and allowing open dialogue with nurses to assess their moral courage. In this article, I present a critique of Robert Geraci's Apocalyptic artificial intelligence (AI) discourse, drawing attention to certain shortcomings which become apparent when the analytical lens shifts from religion to the race–religion nexus. Building on earlier work, I explore the phenomenon of existential risk associated with Apocalyptic AI in relation to “White Crisis,” a modern racial phenomenon with premodern religious origins. Adopting a critical race theoretical and decolonial perspective, I argue that all three phenomena are entangled and they (...) should be understood as a strategy, albeit perhaps merely rhetorical, for maintaining white hegemony under nonwhite contestation. I further suggest that this claim can be shown to be supported by the disclosure of continuity through change in the long‐durée entanglement of race and religion associated with the establishment, maintenance, expansion, and refinement of the modern/colonial world system if and when such phenomena are understood as iterative shifts in a programmatic trajectory of domination which might usefully be framed as “algorithmic racism.”. Avner Baz presents a critique of the working practices of analytic philosophy in recent decades. He challenges the assumptions on which the philosophical 'method of cases' rests, and he presents a pragmatist conception of language on which the method of cases as used both 'armchair' and 'experimental' philosophers is fundamentally misguided.

Are countries especially entitled, if not obliged, to prioritize the interests or well-being of their own citizens during a global crisis, such as a global pandemic? We call this partiality for compatriots in times of crisis “crisis nationalism”. Vaccine nationalism is one vivid example of crisis nationalism during the COVID-19 pandemic; so is the case of the US government’s purchasing a 3-month supply of the global stock of the antiviral Remdesivir for domestic use. Is crisis (...) nationalism justifiable at all, and, if it is, what are its limits? We examine some plausible arguments for national partiality, and conclude that these arguments support crisis nationalism only within strict limits. The different arguments for partiality, as we will note, arrive at these limits for different reasons. But more generally, so we argue, any defensible crisis nationalism must not entail the violation of human rights or the worsening of people’s deprivation. Moreover, we propose that good faith crisis nationalism ought to be sensitive to the potential moral costs of national partiality during a global crisis and must take extra care to control or offset these costs. Thus, crisis nationalism in the form of vaccine nationalism or the hoarding of global supplies of therapeutics during a global pandemic exceeds the bounds of acceptable partiality. (shrink)

The goal of this paper is to provide an account of the role played by logic in the context of what Husserl names the “crisis of European sciences.” Presupposing the analyses offered in the Krisis, I look at Formale und Transzendentale Logik to demonstrate that the crisis of logic stems from the deviation of its original meaning as a “theory of science” and from its restriction to a mere “theoretical technique.” Through a comparison between Aristotelian syllogistic and modern (...) logic, I show why the modern discovery of the purely formal dimension of knowledge which makes possible such a mathematical technization is a positive achievement that hinders at the same time the disclosure of the truly philosophical nature of logic. The correct appraisal of this ambiguous phenomenon will explain why the rise of modern logic represents a decisive challenge for the success of Husserl’s late phenomenological project. (shrink)

Different evocations of “crisis” create distinct categories that in turn evoke certain social reactions. Post-2008, Greece became the epicentre of the “financial crisis”; simultaneously, since 2015 with the advent of the “refugee crisis,” it became the “hotspot of Europe.” What are the different vocabularies of crisis? Moreover, how have both representations of crisis facilitated humanitarian crises to become phenomena for European and transnational institutional management? What are the hegemonically constructed subjects of the different crises? The (...) everyday reality in the crisis-ridden hotspot of Europe is invisible in these representations. It is precisely the daily, soft, lived, and unspoken realities of intersecting crises that hegemonic discourses of successive, overlapping, or “nesting crises” render invisible. By shifting the focus from who belongs to which state-devised category to an open-ended, polyvocal account of capitalist oppressions, we aim to question the state’s and supranational efforts to divide the “migrant mob” into discrete juridical categories of citizens (emigrants), refugees, and illegal immigrants, thereby undermining coalitional struggles between precaritised groups. Reinhart Koselleck is among the most original German theorists of history and historiography. His international reputation is due in part to his contributions as theorist and editor of the remarkable lexicon Geschichtliche Grundbegriffe (GG). The GG is an exceptional reference work that goes far towards realizing Koselleck's program and distinctive version of Begriffsgeschichte (the history of concepts, conceptual history). What is presented here is a translation in full of Koselleck's own entry on Krise (crisis). Few articles in the GG (...) demonstrate more successfully Koselleck's theoretical concerns, his method, and innovative use of sources. (shrink)

El artículo presenta los resultados de una investigación sobre la violencia política en Perú y su actual incidencia en la crisis de legitimidad de las instituciones políticas democráticas. La metodología empleada supone la revisión documental y el tratamiento de otras fuentes sobre las múltiples maneras como el conflicto armado debilitó la credibilidad en los mecanismos y estamentos democráticos. Se presentan elementos concluyentes sobre la continuidad, durante y después del conflicto, de la desigualdad, la frustración en la búsqueda de la (...) verdad y justicia ante la violación de los derechos humanos como causas de la crisis e inestabilidad política en Perú. El artículo permitirá concluir con la grave crisis de gobernabilidad que atraviesa el país, que se traduce en prácticas corruptas que paralizan su desarrollo económico, marcando el paso de una crisis económica a una crisis política: un puente que une los años 1992 a 2018 y que deja como saldo una pérdida generalizada de confianza en la clase política y en las instituciones del poder público en Perú. For too long the questions of how we treat animals and how we treat our fellow human beings have been considered separately. But the contours of the current animal crisis make it clear – the harms we are inflicting on the nonhuman world have devastating impacts on humans: zoonotic diseases caused by habitat destruction and animal exploitation have brought human life to a standstill; mass production of animals for food is poisoning the ground and contributing to catastrophic climate change. Animal Crisis responds to this fractured relationship between human beings and animals by exploring the complex social and political contexts in which animals are harmed, revealing the connections between our callous and cruel attitudes to the animal world and those same attitudes towards vulnerable human groups. Marking a stark contrast to traditional theories in animal ethics, Alice Crary and Lori Gruen argue that there can be no animal liberation without human emancipation. Borrowing from critical social theory and ecofeminism, they build a framework for understanding and combatting the structural forces that shape and enable the diminishment of some for the advantage of a few, isolating critical resources that are crucial for animal and human emancipatory struggles alike. In his last work, "Crisis of the European Sciences and Transcendental Phenomenology", Edmund Husserl formulated a radical new approach to phenomenological philosophy. Unlike his previous works, in the "Crisis" Husserl embedded this formulation in an ambitious reflection on the essence and value of the idea of rational thought and culture, a reflection that he considered to be an urgent necessity in light of the political, social, and intellectual crisis of the interwar period. In this book, James Dodd (...) pursues an interpretation of Husserl's text that emphasizes the importance of the problem of the origin of philosophy, as well as advances the thesis that, for Husserl, the "crisis of reason" is not a contingent historical event, but a permanent feature of a life in reason generally. What does it mean to study places in ‘crisis’ and how does that affect the research done on the ‘rural’? To be considered to be in crisis is not really new as any literature review of rural studies indicates. And yet, we live now in a new context, with new challenges for ‘rural’ research, in particular that of sustainability. Sustainability is the new policy focus and is increasingly reflected in research on rural Europe. Although scholars are beginning to (...) theorize on what is sustainable in and for rural areas, our intention is to take this further. We theorize on what the focus on crisis and, increasingly on sustainability, means for the research we do and the knowledge we produce on rural Europe. Our aim is to bring attention to the politics of past and present knowledge production on the rural to be able to imagine just and sustainable futures. In an analysis of literature primarily from Sweden and the UK, we argue that two construals, that of a rural crisis and that of rural–urban polarization, have set the tone for rural studies and may have overshadowed a more plural approach. We outline what might be needed from rural research to meet future challenges and what the notion of sustainability, with its emphasis on the entanglements of the social, economic and environmental, might mean for the future of rural research. La pregunta por el sentido general del ser emerge, en situaciones críticas, como una indagación noética y existencial que descubre la condición finita y vulnerable del ser ahí. La pandemia Covid19 se ha convertido en el contexto social la oportunidad para pensar en la importancia del cuidado en donde, a raíz del confinamiento y el aislamiento preventivo, se ha modificado de forma infranqueable los ritmos de vida. La rapidación del mundo social de producción y consumo ha constituido el modus vivendi-operandi (...) de nuestras sociedades capitalistas. Por eso, los ritmos de vida acelerados han constituido la forma habitual del ser ahí en la carrera social hacia el éxito, consumada en una vida aparentemente feliz, sujeta a las tendencias del mercado y convirtiéndose, este imaginario colectivo, en el paradigma globalizado al cual aspira cualquier persona desde el nivel de vida o estrato social en que se encuentra. Los relegados del sistema, por su parte, quiénes no están a la altura de la competencia del capitalismo salvaje, se convierten en excedentes sociales postergados hacia el inevitable destino del desecho. Si queremos reivindicar el discurso del ser es en orden al fortalecimiento del cuidado de la vida, como un asunto primordial del ser ahí, para reconocer la raíz humana de la crisis ecológica porque, a la base de esta indagación fundamental se encuentra una deficiente cultura del cuidado que no es otra cosa que el descuido mismo del ser. El objetivo de este artículo, derivado de un proceso de investigación documental, es proponer, a la luz de los aportes de Martín Heidegger, la estructura fundamental de la cura como elemento consustancial de la vida en orden al cuidado de sí, de los otros y del ambiente natural como una respuesta oportuna a la crisis actual. 이 글은 기업, 국가 등의 특정 조직뿐만 아니라 개인의 삶에도 적용시킬 수 있는 위기 관리의 원리와 철학을 『주역』에서 살펴보는 데 그 목적이 있다. 특히 현대인들의 위기상황 에서 실질적으로 적용될 수 있는 『주역』의 위기관리철학을 『주역』에 나타난 위기의 조짐, 위기의 종류, 그 대처방안 등의 구체적이고 실용적인 주제들을 중심으로 살펴보는 데 그 목적이 있다. 주역 ｢계사전｣에서는 역경 이 은나라에서 주나라로의 전환기에 만들어진 책으로 위태로운 말들을 담고 있지만 이를 통해 오히려 사람들의 삶을 평안하게 이끌고자 한 책이라고 언급했다. 실제로 『주역』에는 다양한 위기상황과 그에 대한 대처방안이 (...) 제시 되고 있다. 이 논문에서는 『주역』에 나타난 위기의 조짐으로서의 기미를 통해 우리 삶 속 에서 위기가 닥쳐올 것임을 암시하는 기미들이 어떠한 양상으로 나타나는지를 살펴보았 다. 아울러 위기 또한 거시적인 변화의 측면에서 연구대상으로 바라보는, 『주역』의 기미에 주목하여 본격적인 위기가 닥쳐올 것임을 보여주는 구체적인 조짐의 모습들을 분석했다. 이를 위해 특히 말, 소통의 방식에서 드러나는 본격적인 위기의 조짐을 살펴보고 그것이 심각한 위기로 번지기 전에 취해야 할 대처방안을 살펴보았다. 하지만 인간의 삶에는 미리 예방하지 못하거나, 본인의 의지와 상관없이 본격적으로 닥쳐오는 위기가 존재한다. 이 논 문에서는 『주역』에 나타난 본격적으로 닥친 위기에 따른 대응방식을 멈추고 기다리는 위 기, 적극적으로 대응하는 위기, 활용하는 위기로 구분하여 살펴보았다. 아울러 모든 종류 의 위기에 대해 가져야 할 한결같은 위기 대응의 원칙 또한 살펴보았다. 그리고 마지막으 로 지금까지 살펴본 『주역』의 위기관리철학을 위기관리 매뉴얼로 도식화해 보았다. 본 연구를 통해 『주역』에서는 사전에 위기의 조짐인 기미를 인지할 수 있다고 보고 있으며, 특히 자신이 자초한 인과적인 일에 대한 기미를 경계하고 있음을 살펴볼 수 있었다. 또한 본 격적인 위기가 닥쳐올 것임을 암시하는 조짐을 사전에 인식하고 그것이 더 깊은 위기로 번 져가지 않도록 사전에 예방할 수 있음을 살펴볼 수 있었다. 아울러 본격적으로 닥친 위기 에 대해서도 그 위기의 특징별로 적절하게 대처할 수 있는 방안이 있음을 살펴볼 수 있었으며 일상적으로 항상 위기에 대비해야 하며, 지나간 위기에 대해서도 그것이 반복되지 않 도록 기억해야 함을 살펴볼 수 있었다. In the midst of the current crisis that is threatening to derail the historical project of European unification, Jürgen Habermas has been one of the most perceptive critics of the ineffectual and evasive responses to the global financial crisis, especially by the German political class. This extended essay on the constitution for Europe represents Habermas’s constructive engagement with the European project at a time when the crisis of the eurozone is threatening the very (...) existence of the European Union. There is a growing realization that the European treaty needs to be revised in order to deal with the structural defects of monetary union, but a clear perspective for the future is missing. Drawing on his analysis of European unification as a process in which international treaties have progressively taken on features of a democratic constitution, Habermas explains why the current proposals to transform the system of European governance into one of executive federalism is a mistake. His central argument is that the European project must realize its democratic potential by evolving from an international into a cosmopolitan community. The opening essay on the role played by the concept of human dignity in the genealogy of human rights in the modern era throws further important light on the philosophical foundations of Habermas’s theory of how democratic political institutions can be extended beyond the level of nation-states. Now that the question of Europe and its future is once again at the centre of public debate, this important intervention by one of the greatest thinkers of our time will be of interest to a wide readership. En este artículo paso revista a la noción de barbarie en Michel Henry entendida como enfermedad de la vida. Argumento que ella se contrapone a la cultura, la cual consiste el auto acrecentamiento de la vida. En este marco, comparo la crítica de la cultura y el diagnóstico de la crisis en la fenomenología histórica y en la fenomenología de la vida, haciendo foco en el contraste entre la reivindicación del mundo de la vida y la defensa de la (...) vida acósmica. Luego profundizo en el diagnóstico henriano de la barbarie abordando tres de sus manifestaciones principales, a saber, la economía política, el arte, y la ciencia. Finalmente, cotejo brevemente la posición de Henry con trabajos contemporáneos sobre los “mundos-de-la-muerte” y la ética del care, llamando a elaborar una ética de la vida con miras a su liberación. The text focuses on the status of sciences, starting from the psychiatric discipline, related to the crisis that from the 60s to today has threatened his epistemological presuppositions. Not otherwise, the other sciences, on the the wave of progress and technological development, end up reaching increasingly important results, paying the price of losing the condition and the aim of research and knowledge.

ABSTRACT The financial crisis is, in part, an embarrassment for economic theory. Economists tended to think that severe business cycles had been conquered; that free markets require no regulations to constrain self‐interest; and that large, established companies could be trusted to monitor their own behavior so as to preserve their reputational capital. These three beliefs have proved to be inaccurate. On the other hand, economists justifiably believe that as a process of creative destruction, capitalism requires institutions that allow for (...) innovation and the reallocation of resources toward firms that have successfully innovated. This suggests that we should not condemn wholesale even the financial innovations that played a role in the crisis, which have been remarkably productive and will continue to be, given the right regulations. Nor should economists hesitate to say that political reactions to the crisis that hamper such innovation and reallocation may do far more harm than good. (shrink)

At a time when ideas of crisis and critique are at the forefront of public discourse, this article seeks to understand moments of crisis vis-à-vis critique as a key feature of critical social theory. It addresses Jürgen Habermas’s strong claim that this relationship accounts for a ‘model of analysis’ concerned with grasping the ‘diremptions’ of social life. To elaborate this reading, the article pays attention to the main problems Habermas identifies in conventional ways of understanding the concepts of (...) ‘crisis’ and ‘critique’ in social theory. The aim is to examine the mode in which he reconsiders each of these terms and then reasserts the dialectical link between them. I reconstruct this relationship by taking as cases two of his most substantive works of social theorizing: The Theory of Communicative Action, and Between Facts and Norms. Based on this interpretation, I suggest that though Habermas contributes to resituating the practice of critique as a communicative translation of objective crisis, he does not adequately account for another key movement: when critique actually initiates, enacts and furthers the moment of crisis. The parable “Before the Law” is a pivotal text in the work of Franz Kafka. It tells of a man who looks for the law as the quintessence of his life. But his quest for meaning comes to a crisis because of a fundamental deception. Instead of interpreting the law as a personal mystery, he somehow objectifies it. His abstract view on life begets the obstacle-character that embodies all those who could bar him from finding the law. In this (...) narrative, the failure of finding the law results in a murder in which human life is reduced to bestial death. In this sense, Kafka’s narrative is a tale of anti-creation. In a close reading we analyze the text with attention for the ternary structure, i.e. the intertwined complex of the I-Thou relation and the I-It relation. The literary text is interpreted for its philosophical relevance. Franz Rosenzweig and Emmanuel Levinas but also Gilles Deleuze and Jacques Derrida have an important role in this way of reading.
