Revenge has been a subject of concern in most intellectual traditions throughout history, and even when social norms regard it as permissible or even obligatory, it is commonly recognised as being more counterproductive than beneficial. In this book, Kit R. Christensen explores this provocative issue, offering an in-depth account of both the nature of revenge and the causes and consequences of the desire for this kind of retaliatory violence. He then develops a version of eudaimonistic consequentialism to argue that (...) vengeance is never morally justified, and applies this to cases of intergroup violence where the lust for revenge against a vilified 'Them' is easily incited and often exploited. The Bohm-Bub hidden-variable theory is able to predict the results of measuring a quantum system only in the special case where the set of commuting observables being measured is complete. To handle the much more common case where the set is incomplete, Tutsch has proposed a generalization of the Bohm-Bub model. Unfortunately, as we show here, Tutsch's original method does not yield the correct quantum mechanical transition probabilities. On the other hand, Belinfante's modification of Tutsch's method does yield the correct (...) probabilities, and it gives a satisfactory hidden-variable theory of partial measurement for the case where one or more commuting variable(s) are measured at a single space-time point. In the case where the variables are measured at different space-time points, the theory is inadequate, due to the fact that it is not relativistically covariant, and does not take relaxation of the hidden variables into account. In The Myth of Morality Richard Joyce presents a simple and very influential argument for the truth of moral error theory. In this paper I point out that the argument does not have the form Joyce attributes to it, the argument is not valid in an extensional propositional logic and on the most natural way of explicating the meanings of the involved terms, it remains invalid. I conclude that more explanation is needed if we are to accept this particular (...) argument for moral error theory. (shrink)

As one possibility, contagious sickness and forms of bondage characterize the culture of home, whereas the sailor's condition and less civilized sites offer health, romance, and freedom. But an opposite possibility (...) is that the ship resembles an unhealthy prison and the foreign settings are spoiled, and so hope resides in the curative power still emanating from the civilization of home. The two possibilities may relate to the Goethean-Carlylean pattern of Bildung, whereby the protagonist initially rebels and escapes from home but later repents and returns, recognizing that his America must be "here or nowhere" (Carlyle 1899, 156),1 in Massachusetts rather than in California. Dana indeed desires first to become entirely the sailor but then in terror before that eventuality desires to return to his identity as a Harvard scholar. With respect to the motif of literacy, the initial effort to live fully amid the bracing energies of winds and sea gives way to an appreciation of the curative force of reading and writing books. Yet the two phases are not after all so neatly opposed and divided between two halves of the story. They coexist in a tension that is sometimes also resolved.In 1842, two years after publishing Two Years before the Mast, Dana began to compose "An Autobiographical Sketch, 1815–1841." This "Sketch" (1968) creates a context for the previously published work that justifies the first of the two interpretations. His early life has already featured, in the "Sketch," many incidents of wandering away from home and of rebellion against the restrictions and injustices of society. The turbulent young protagonist especially resents the tyranny of the schoolmasters who administer floggings and later the tyranny of the authorities at Harvard College who unfairly punish a classmate. In his article, "The End of Aesthetic Experience" (1997) Richard Shusterman studies the contemporary fate of aesthetic experience, which has long been regarded as one of the core concepts of Western aesthetics till the last half century. It has then expanded into an umbrella concept for aesthetic notions such as the sublime and the picturesque. I agree with Shusterman that aesthetic experience has become the island of freedom, beauty, and idealistic meaning in an otherwise cold materialistic and law-determined world. (...) My paper starts from the main dimensions of aesthetic experience in the history of Western aesthetics as concluded by Shusterman. In terms of our experiential practices in the fragmentation of modern life and the disjointed sensationalism of the media, I also agree with Shusterman that people are losing the capacity for deep experience and feeling, especially when we are undergoing various extensive series of informational revolutions. My paper is also a response to Shusterman's claim that the concept of aesthetic experience is worth recalling, not for formal definition but for art's reorientation toward values and populations that could restore its vitality and sense of purpose. I mention the recent calls for values and life concerns in art in the Anglo-American aesthetics circles, which has also turned to the possible strength of aesthetic experience, claiming that "Aesthetics is the Mother of Ethics." Amidst the discourse is the review of John Dewey's notion of "aesthetic experience," which claims to support a transcultural view and common patterns, as the relationship is structured around human needs. A basic question posed in the article is whether this Deweyan notion still remains equally influential as in the past and whether it really provides a satisfying answer to the problem of art and value? The discussion will turn then to neo-Confucian aesthetic models for reference, and to point out some meaningful comparative revelations. (shrink)

Is there an explanation of why the state of x's bearing the non-symmetric binary relation R to y is different from its differential opposite, the state of y's bearing R to x? One traditional view has it that the explanation is that non-symmetric relations hold of objects in an essentially directional way, ordering the relevant relata. We call this view ‘directionalism’. Kit Fine has suggested that this approach is subject to significant metaphysical difficulties, sufficient to motivate seeking an alternative analysis. (...) He considers two such alternative explanations, which he labels ‘positionalism’ and ‘anti-positionalism’. Of these he endorses the latter. We argue that anti-positionalism fails to provide a coherent explanation of the distinction between differential opposites, and that one should simply hold the minimalist position that there is no explanation for this metaphysical difference. McCarthy thinks truth more important than I do. Specifically, he thinks that “ ‘truth’ … functions as an ‘idea of reason’ with respect to which we can criticize not only particular claims within our language but the very standards of truth we have inherited” . By contrast, I think that what enables us to make such criticism is concrete alternative suggestions—suggestions about how to redescribe what we are talking about. Some examples are Galileo’s suggestions about how to redescribe the Aristotelian (...) universe, Marx’s suggestions about how to redescribe the nineteenth century, Heidegger’s suggestions about how to redescribe the West as a whole, Dickens’s suggestions about how to redescribe chancery law, Rabelais’s suggestions about how to redescriibe monasteries, and Virginia Woolf’s suggestions about how to redescribe women writing.Such fresh descriptions, such new suggestions of things to say, sentences to consider, vocabularies to employ, are what do the work. All that the idea of truth does is to say, “Bethink yourself that you might be mistaken; remember that your beliefs may be justified by your other belies in the area, but that the whole kit and caboodle might be misguided, and in particular that you might be using the wrong words for your purpose.” But this admonition is empty and powerless without some concrete suggestion of an alternative set of beliefs, or of words. Moreover, if you have such a suggestion, you do not need the admonition. The only cash value of this regulative idea is to commend fallibilism, to remind us that lots of people have been as certain of, and as justified in believing, things that turned out to be false as we are certain of, and justified in holding, our present views. It is not, as McCarthy says, a “moment of unconditionality that opens us up to criticism from other points of view” . In his paper “Flaws of Formal Relationism”, Mahrad Almotahari argues against the sort of response to Frege's Puzzle I have defended elsewhere, which he dubs ‘Formal Relationism’. Almotahari argues that, because of its specifically formal character, this view is vulnerable to objections that cannot be raised against the otherwise similar Semantic Relationism due to Kit Fine. I argue in response that Formal Relationism has neither of the flaws Almotahari claims to identify.

In "Counting and Indeterminate Identity", N. Ángel Pinillos develops an argument that there can be no cases of `Split Indeterminate Identity'. Such a case would be one in which it was indeterminate whether a=b and indeterminate whether a=c, but determinately true that b≠c. The interest of the argument lies, in part, in the fact that it appears to appeal to none of the controversial claims to which similar arguments due to Gareth Evans and Nathan Salmon appeal. I argue for two (...) counter-claims. First, the formal argument fails to establish its conclusion, for essentially the same reason Evans's and Salmon's arguments fail to establish their conclusions. Second, the phenomena in which Pinillos is interested, which concern the cardinalities of sets of vague objects, manifest the existence of what Kit Fine called `penumbral connections', phenomena that the logics Pinillos considers are already known not to handle well. A number of philosophers have recently become receptive to the idea that, in addition to scientific or causal explanation, there may be a distinctive kind of metaphysical explanation, in which explanans and explanandum are connected, not through some sort of causal mechanism, but through some constitutive form of determination. I myself have long been sympathetic to this idea of constitutive determination or ‘ontological ground’; and it is the aim of the present paper to help put the idea on a firmer (...) footing - to explain how it is to be understood, how it relates to other ideas, and how it might be of use in philosophy. This paper concentrates on a particular sort of case where it’s plausible that epistemic requirements can conflict: cases where an agent’s higher-order evidence supports doubting her reliability in reacting to her ordinary evidence. Conflicting epistemic requirements can be seen as generating epistemic dilemmas. The paper examines two ways that people have sought to recognize conflicting requirements without allowing them to generate epistemic dilemmas: separating epistemic norms into two different varieties, and positing rational indeterminacy in cases where principles conflict. It argues (...) that these views incur costs, and that the sense in which they avoid dilemmas does not gain them an advantage over a view that simply recognizes dilemmas as a natural outgrowth of agents’ rational reflection on their own thinking. Are there, in addition to the various actual objects that make up the world, various possible objects? Are there merely possible people, for example, or merely possible electrons, or even merely possible kinds? We certainly talk as if there were such things. Given a particular sperm and egg, I may wonder whether that particular child which would result from their union would have blue eyes. But if the sperm and egg are never in fact brought together, then there is no (...) actual object that my thought is about. Or again, in the semantics for modal logic we presuppose an ontology of possibilia twice over. For first, we countenance various possible worlds, in addition to the actual world; and second, each of these worlds is taken to be endowed with its own domain of objects. These will be the actual objects of the world in question, but they need not be actual simpliciter, i.e., actual objects of our world. What are we to make of such discourse? There are four options: (i) the discourse is taken to be unintelligible; (ii) it is taken to be intelligible but nonfactual, i.e. as not in the business of stating facts; (iii) it is taken to be factual but reducible to discourse involving no reference to possibilia; (iv) it is taken to be both factual and irreducible. These options range from a full-blooded form of actualism at one extreme to a full-blooded form of possibilism at the other. The two intermediate positions are possibilist in that they accept the intelligibility of possibilist discourse but actualist in that they attempt to dispense with its prima facie commitment to possibilia. All four positions have found advocates in the literature. Quine, in his less irenic moments, favours option (i); Forbes advocates option (ii), at least for certain parts of possibilist discourse; many philosophers, including Adams and myself, opt for (iii); while Lewis and Stalnaker have endorsed versions of (iv), that differ in how full-blooded they take the possible objects to be.. Oregon is the only state in the United States where a physician may legally prescribe a lethal dose of barbiturate for a patient intending suicide. The Oregon Death with Dignity Act was passed by voters in 1994 and came into effect after much legal wrangling in October of 1997. At the same time, a cabinetmaker named Pat Matheny was struggling with progressive weakness from amyotrophic lateral sclerosis, or ALS. I met with Pat and his family for a lengthy interview in (...) October 1998 in Coos Bay, Oregon, for a television news report on his decision to get a lethal prescription. Below is an extract from that interview. On the day this introduction was written, 10 March 1999, Pat took the prescribed lethal overdose of barbiturates and died at home. His illness was taking his voice, he could not move his hands or legs, and breathing was becoming very difficult. His mother told me he knew that was for him. (shrink)

In Ludwig Wittgenstein's writings, ethics takes a central place in his thinking. This element investigates his engagement with ethics in both early and later thinking. Starting from the remarks on ethics in the Tractatus Logico-Philosophicus and the framing of these remarks, it presents two influential approaches to Tractarian ethics, before it develops a coherent reading of ethics in the early thinking, focusing on ethical silence and the relationship notions of world and the philosophical 'I'. The reading of 'A Lecture on (...) Ethics' focuses on the critique of ethical theory and the personal dimension of ethics, two themes also running through Wittgenstein's later thinking. It considers Wittgenstein's later ethical investigations, of ethical examples, ethically relevant language uses of language and the connections between reflections on ethics and living. This article addresses a still unsolved puzzle in private law regarding the proper explanation of cases in which courts make substantial awards of damages to claimants whose rights have been infringed, but who appear to have suffered no factual loss in consequence of the infringement. The paradigm examples tend to involve awards of ‘user’, license fee or ‘hypothetical bargain’ damages in cases involving interference with property rights. It suggests that existing explanations of such cases are all unsatisfactory in one or (...) another respect and posits a new and potentially more powerful explanatory thesis, drawing on Hohfeld. Such awards, it argues, compensate right-holders for the loss of legal powers associated with their primary claim-rights—in particular, the loss of powers they are accorded by the law to ‘prevent’ the infringement of certain types of primary claim right ex ante. Legal powers are thus to be regarded as assets or amenities, the loss of which is amenable to monetary compensation. (shrink)
