Constituent power is an idea with a long tradition in modern political thought but has been largely abandoned since the middle of the twentieth century. Here I offer a new account of constituent power that avoids problems of the classical account, including the paradox of constitutionalism, and clarifies how individuals contribute to creating their shared political order. I argue that constituent power should be understood as an individual power-with: the agential power to constitute a legal (...) order with others. Our individual, banal acts of law-abidingness each partially effect the collective outcome. We generally exercise constituent power unconsciously and automatically, guiding our actions to succeed as defined by law and relying on the legal system to take up our contributions and effectively combine them with others. Vice crimes, crimes prohibited in part because they are viewed as morally corrupting, engage legal theorists because they reveal importantly contrasting views between liberals and virtue-centered theorists on the very limits of legitimate state action. Yet advocates and opponents alike focus on the role law can play in suppressing personal vice; the role of law is seen as suppressing licentiousness, sloth, greed etc. The most powerful advocates of the position that the law must nurture good character often draw on Aristotelian (...) theories of virtue to ground the connection between law and virtue. While Aristotle believed that law and character were linked, it is ironic to note that he did not argue for the position evidenced in our vice laws that law was likely to succeed in instilling virtue. Indeed, Aristotle thought the project of using law to instill private virtue was nearly certain to fail. Aristotle’s deep concern was not for the way law protected private virtue within each person but the way law had to protect civic virtue between citizens. This article argues that even from its foundations, the project of vice crimes as moral instruction is misconceived. The use of law for overly instrumental or narrow reasons opens law and legal institutions to abuse and factionalism. Lawyers, judges and others specially connected to law must first and foremost aim at addressing “legal vices,” vices internal to the institutions of law. Particularly, increasing factionalism and instrumentalism which disconnects law from the pursuit of the common good threatens our civic bonds. Most importantly, where civic bonds are disrupted, citizens have no reason to remain law abiding. The striking lesson, captured both in ancient philosophy and modern history, is that when legal vices grow unchecked and factions use the law to pursue narrow interests, ultimately law abidingness is corrupted and interest groups harm themselves as much as others. Many different and contradictory claims have been made about the political dimensions (or lack thereof) of the ancient Chinese text known as the Zhuangzi 莊子. The two main positions on this topic set the parameters of the debate. One interprets the Zhuangzi to be apathetic toward political participation, focusing on individual survival instead. The other emphasizes the text’s defiant streak and locates a deliberately subversive force within it. A third position redirects the focus of the debate to an important aspect (...) of the Zhuangzi, recognizing that the text intentionally embraces ambiguity and multivocality, and investigates the political implications of this characteristic of the text. This article further explores the Zhuangzi’s engagement with notions of social and political indeterminacy, but through the lens of role performance. Attending to the text’s portrayal of various social actors’ engagement with established roles reveals a different kind of polysemic stance that lies in the intricate dynamics between societal expectations and individual actions. The article employs these examples to examine a type of role enactment that I contend muddies the line between the place of power and the place of resistance. (shrink)

Arguments from popular opinion have long been regarded with suspicion, and in most logic textbooks the _ad populum _argument is classified as a fallacy. Douglas Walton now asks whether this negative evaluation is always justified, particularly in a democratic system where decisions are based on majority opinion. In this insightful book, Walton maintains that there is a genuine type of argumentation based on commonly accepted opinions and presumptions that should represent a standard of rational decision-making on important issues, especially those (...) of a personal and political nature. He shows how to judge arguments based on appeals to popular opinion in a more balanced way, identifying eleven subtypes of the _ad populum_ argument and providing a pragmatic method to evaluate each of these types. Walton has examined dozens of logic texts and drawn on a wide range of literature to reveal the many uses and misuses of popular opinion. He contrasts the traditional discussion of _ad populum _in Greek rhetoric with recent textbook treatment, then contrasts these contemporary views with his own dialectical perspective in order to clarify often confused appeals to prejudice and appeals to common knowledge. Although appeal to popular opinion has long been a powerful argumentative tactic, this is the first book to systematically describe and evaluate it as a well-defined type of argument with its own special characteristics. It enables us to deal with these often deceptive arguments in a critically balanced way and makes an original contribution to an important strand of rhetoric. (shrink)

This study asserts that W.V.O. Quine’s eliminative philosophical gaze into mereological composition affects inevitably his interpretations of composition theories of ontology. To investigate Quine’s property monism from the account of modal eliminativism, I applied to his solution for the paradoxes of de re modalities’ . Because of its vital role to figure out how dispositions are encountered by Quine, it was significantly noted that the realm of de re modalities doesn’t include contingent and impossible inferences about things. Therefore, for him, (...) all the intrinsic forces and elements of entities such as powers and causal or teleological dispositions for ontology demand to be seen necessarily as bound variables from a monist perspective. Although his denial of analyticity and the elimination of dispositional field of ontology, S. Mumford criticizes the monist perspective of Quine’s paradoxical approach to superveniences. Because superveniences create problems while determining type-type identities from a monist mereological perspective. It is observed that Quine faces with a reduction again in terms of his dispositional monism despite his critiques to repulse vagueness from the ontology in his well-known article Two Dogmas of Empiricism. -/- . The essays collected in this special issue explore what legitimacy means for actors and institutions that do not function like traditional states but nevertheless wield significant power in the global realm. They are connected by the idea that the specific purposes of non-state actors and the contexts in which they operate shape what it means for them to be legitimate and so shape the standards of justification that they have to meet. In this introduction, we develop this guiding methodology (...) further and show how the special issue’s individual contributions apply it to their cases. In the first section, we provide a sketch of our purpose-dependent theory of legitimacy beyond the state. We then highlight two features of the institutional context beyond the state that set it apart from the domestic case: problems of feasibility and the structure of international law. (shrink)

Although skeptical of the prohibitive power of no-hidden-variables theorems, John Bell was himself responsible for the two most important ones. I describe some recent versions of the lesser known of the two (familiar to experts as the "Kochen-Specker theorem") which have transparently simple proofs. One of the new versions can be converted without additional analysis into a powerful form of the very much better known "Bell's Theorem," thereby clarifying the conceptual link between these two results of Bell.

The cyborg that Donna Haraway appropriated in ‘Manifesto for Cyborgs’ as a metaphor for political action and theoretical inquiry has ceased to have the potency it did 20 years ago. While Haraway has turned from a central focus on technoculture to companion species, much important cultural work remains to be done, especially in networked and programmable media. Problems with the cyborg as a metaphor include the implication that the liberal humanist subject, however problematized by its hybridization with cybernetic mechanism, continues (...) as a singular entity operating with localized agency. In a word, the cyborg is not networked enough to encompass the emergent possibilities associated with the Internet and the world-wide web and other phenomena of the contemporary digital era. Instead I propose the idea of the cognisphere. As operational concept and suggestive metaphor, the cognisphere recognizes that networked and programmable media are not only more pervasive than ever before in human history but also more cognitively powerful. It is closely associated with what many researchers regard as a major insight: the idea that the physical world is fundamentally computational. While these scientists regard computation as a physical process, the cultural critic is apt to see it as an over-determined metaphor. The binary choice between seeing the computational universe as a literal description of the physical world and reading it as an over-determined metaphor misses a crucial aspect of contemporary cultural dynamics: the interaction between means and metaphor, technology and cultural presupposition. Taking this dynamic into account leads to a more complete understanding summed up in the aphorism, ‘What we make and what we are co-evolve together.’. (shrink)

This article introduces and defends a probabilistic measure of the explanatory power that a particular explanans has over its explanandum. To this end, we propose several intuitive, formal conditions of adequacy for an account of explanatory power. Then, we show that these conditions are uniquely satisfied by one particular probabilistic function. We proceed to strengthen the case for this measure of explanatory power by proving several theorems, all of which show that this measure neatly corresponds to our (...) explanatory intuitions. We should react to deaf parents who choose to have a deaf child with compassion not condemnationThere has been a great deal of discussion during the past few years of the potential biotechnology offers to us to choose to have only perfect babies, and of the implications that might have, for instance for the disabled. What few people foresaw is that these same technologies could be deliberately used to ensure that children would be born with disabilities. That this is a (...) real possibility, and not merely the thought experiment of a philosopher, is brought home to us by the decision of an American lesbian couple to select a deaf sperm donor in order to maximise the chances that their children, Jehanne and Gauvin, would be deaf like them.1 Their choice has sparked controversy, not only among medical ethicists, but in the opinion pages of newspapers across the world. Ought parents be permitted to make such choices?If the parents of Jehanne and Gauvin have done anything wrong, it must consist in violating their child’s right to an open future—limiting its future potential for choice.2 But what does it mean to respect this right?From the moment a child is born, her parents are making choices for her, which will powerfully shape her future. This book urges educational institutions to contemplate the harm they have caused to individual and society by their tragic suppression of the energy essential to the flowering of the mind's full potential. No more strident and uncompromising a voice is to be found on this topic than Whitehead's, in _The Aims of Education and Other Essays_. Walker's interpretation of these essays is set in a story of the lives of several teachers, education students, parents, and a professor. N. Katherine Hayles is known for breaking new ground at the intersection of the sciences and the humanities. In Unthought, she once again bridges disciplines by revealing how we think without thinking—how we use cognitive processes that are inaccessible to consciousness yet necessary for it to function. Marshalling fresh insights from neuroscience, cognitive science, cognitive biology, and literature, Hayles expands our understanding of cognition and demonstrates that it involves more than consciousness alone. Cognition, as Hayles defines it, is applicable not (...) only to nonconscious processes in humans but to all forms of life, including unicellular organisms and plants. Startlingly, she also shows that cognition operates in the sophisticated information-processing abilities of technical systems: when humans and cognitive technical systems interact, they form “cognitive assemblages”—as found in urban traffic control, drones, and the trading algorithms of finance capital, for instance—and these assemblages are transforming life on earth. In “Surmounting Elusive Barriers: The Case for Bioethics Mediation,” Bergman argues that professionals trained in bioethics, reluctant to acquire the skills of mediation, would better be replaced by a cadre of mediators with some bioethics knowledge, to which I respond, “yes . . . but.”.

Causal determinism is the view that all events in the universe are predetermined and that the laws of nature causally necessitate these events. In the debates on free will, there are two different positions called incompatibilism and compatibilism. Accordingly, compatibilist accounts claim that free will and causal determinism can be compatible and coexist. On the contrary, incompatibilist accounts defend that compatibilist accounts are problematic and claim that free will cannot exist in a universe where causal determinism holds. The main approach (...) that we will consider in this work will be the incompatibilist approach of the American philosopher Peter van Inwagen, which he defends in free will debates. The arguments put forward by Peter van Inwagen as the basis of incompatibilism can be summarized as the consequence argument and the Mind argument. The consequence argument, hypothetically takes into account a world in which causally deterministic and claiming that free will doesn't exist in such a world. Peter van Inwagen's Mind argument, on the other hand, claims that agent-causation cannot be sufficient for a definite possession of free will because a person who represents oneself as an agent in every event s/he is involved in, cannot be sure whether the consequences of these events are due to chance. In both arguments, Peter van Inwagen refers to philosophical moves that affirm incompatibilism is consistent for free will debate. Therefore in my dissertation, I argue that incompatibilism is actually a sufficient step towards solving the free will and causal determinism dilemma in a theoretical sense. This work also deals with Peter van Inwagen's views on philosophy of action and philosophy of religion in general. Additionally, in order to draw the relational framework between causal determinism and free will, the concepts of 'event', 'causal powers' and 'states of affairs' are used methodologically. Instead of just having an ethical discussion of free will, I took care to stay within the boundaries of the metaphysics of free will. (shrink)

In this book, Zalta attempts to lay the axiomatic foundations of metaphysics by developing and applying a (formal) theory of abstract objects. The cornerstones include a principle which presents precise conditions under which there are abstract objects and a principle which says when apparently distinct such objects are in fact identical. The principles are constructed out of a basic set of primitive notions, which are identified at the end of the Introduction, just before the theorizing begins. The main reason for (...) producing a theory which defines a logical space of abstract objects is that it may have a great deal of explanatory power. It is hoped that the data explained by means of the theory will be of interest to pure and applied metaphysicians, logicians and linguists, and pure and applied epistemologists. (shrink)

The automatic verification of large parts of mathematics has been an aim of many mathematicians from Leibniz to Hilbert. While Gödel's first incompleteness theorem showed that no computer program could automatically prove certain true theorems in mathematics, the advent of electronic computers and sophisticated software means in practice there are many quite effective systems for automated reasoning that can be used for checking mathematical proofs. This book describes the use of a computer program to check the proofs of several celebrated (...) theorems in metamathematics including those of Gödel and Church-Rosser. The computer verification using the Boyer-Moore theorem prover yields precise and rigorous proofs of these difficult theorems. It also demonstrates the range and power of automated proof checking technology. The mechanization of metamathematics itself has important implications for automated reasoning, because metatheorems can be applied as labor-saving devices to simplify proof construction. (shrink)

Recently, in attempting to account for explanatory reasoning in probabilistic terms, Bayesians have proposed several measures of the degree to which a hypothesis explains a given set of facts. These candidate measures of "explanatory power" are shown to have interesting normative interpretations and consequences. What has not yet been investigated, however, is whether any of these measures are also descriptive of people’s actual explanatory judgments. Here, I present my own experimental work investigating this question. I argue that one measure (...) in particular is an accurate descriptor of explanatory judgments. Then, I discuss some interesting implications of this result for both the epistemology and the psychology of explanatory reasoning. (shrink)

The discovery of the inscription with the name of [M]iltiades, which confirmed the statement in Dionysius Halicarnassensis 7. 3. 1 that a Miltiades was archon at Athens in 524/3, prompts a reconsideration of the problems presented by the accounts in Herodotus and in Marcellinus Life of Thucydides concerning the Philaid family. To the question, who is this Miltiades, the following answers have been given. ‘He is not a Philaid.’ The objection to this answer is that the Peisistratids either occupied the (...) archonship themselves or gave it to members of leading families, such as Cleisthenes the Alcmeonid in 525/4; if then this Miltiades was a member of a leading family, he is almost certainly a member of the Philaid family. ‘He is the elder Miltiades who founded the settlement in the Chersonese.’ In Herodotus' account Miltiades left Athens, where he was already powerful, at the beginning of a tyranny by Peisistratus; then after several operations in the Chersonese Miltiades was rescued by Croesus. The year in which Miltiades left Athens was either 561/0 or 556/5 and almost certainly the latter; for in 561/0 Croesus was not on the throne. The year 546 may be excluded; for in 546 autumn and winter Croesus had neither the time nor the opportunity to concern himself with Miltiades, since Cyrus was then at war with Lydia and seized Sardis.2 If Miltiades was powerful in 556/5, he was at that date no youngster but at least in his thirties—a man born say c. 590. In 524/3, being well on in his sixties and having spent thirty years and more in the Chersonese, this Miltiades is unlikely to have been the eponymous archon. We conclude, then, that the archon Miltiades in 524/3 was a different and younger Miltiades. Having cleared the ground on these two points, I turn to the central problem, whether there were two men called Miltiades, one born c. 590 and the other the general who died of a wound soon after 489, or whether there were three men called Miltiades, one of whom was in a generation intermediate between Miltiades born c. 590 and Miltiades dead c. 489. This article argues that there is a fundamental contradiction between a profit-oriented economic system and long-term environmental sustainability. The ‘solutions’ that are proposed by mainstream environmental economists as well as their ‘ecological economy’ colleagues do not solve the central problems, but serve to further highlight the difficulties of changing capitalism towards sustainability. In a profit-oriented economy, capital accumulation is a prime driving force, and non-growth for the economy at large tends to result in serious economic and social crises. On the (...) other hand, a de-coupling of economic growth from resource depletion and environmental degradation is possible only within certain sectors or product types and within relatively short time perspectives. The assumptions of mainstream economists about infinite economic growth (and infinite dematerialisation) represent a false ontology according to which the powers and mechanisms of the natural world are considered totally controllable by humans as if they were mere epiphenomena of the human world. On the other hand, the assumptions of certain ecological economists about the possibility of steady-state capitalism disregard the relation between capital and surplus value, which constitutes a strong mechanism driving the capitalist economy toward limitless growth. A negative image of community care prevails. This method of care is perceived to be a relatively novel phenomenon and has received mixed media coverage. The negative image of community care has led to the growing belief that this care method has failed. This failure has largely been ascribed to the lack of powers available to control patients in the community and to the method's relative novelty. However, this paper contends that there are two flaws to the above assertion: first, (...) community care is far from new, and second, the inherent problem is not the lack of powers available to control patients in the community, but, essentially, the absence of a secure and stable environment within the community. The problem of the rational and the irrational has been one of the most important problems of philosophy since philosophy's birth, for what is philosophy if not meditation on the structure of the universe and of man, immersed in it: Is the universe rational, or is it at bottom irrational and hence unknowable and unpredictable? Are our means of coming to know being [bytie] rational, or can one reach the depths of being only through intuition, illumination, and so forth? Let (...) me immediately make the qualification that the questions posed are improper, for to separate the rational and the irrational is from various points of view extremely unphilosophical. Just as the one cannot exist without the many, just as there is no being without nonbeing, no left without right, no night without day, and no male without female, so there is in philosophy no rational without the irrational. To disregard or consciously reject either the rational or the irrational level of being leads to truly tragic consequences: not only is an invalid theoretical schema created that impoverishes reality, but a knowingly false idea of the universe and of man's situation in it is formed. Let us recall our, if one may call it that, most recent past. The Stalinist-Brezhnevist ideology without further ado simply forbade the irrational and commanded that the world be regarded as rational, lucid, and transparent. The powers that be taught philosophers and their ilk to "think" of being as exclusively of this world, a very simple world, each part of which was easy to describe, explain, and render comprehensible to all without exception. L. Gozman and A. Etkind have persuasively demonstrated how on the basis of such a theoretical postulate were built the corresponding moral, political, and scientific constructions, which became out-and-out caricatures . For example, the authors wrote, a "simple" person, who "had not studied in the universities," was considered the bearer of true morality and goodness. On the other hand, anything that was incomprehensible, that did not fit into a rationalistic framework, was declared an ill-intentioned muddling of a harmonious world that harbored no essential secrets. But if the world is simple and comprehensible, then all the work of scientists is a meaningless waste of the nation's money, and their discoveries and conclusions are an attempt to take people in. The broadest circulation was given to popularized scientific literature and educational lectures that helped the reader and the listener to develop the assurance that he was clear about everything, with the exception of why specialists were unable to get to the bottom of such obvious questions. Evil and the fear coming along with it — either the fear to become its victim or its agent — is haunting mankind’s consciousness since the dawn of time. The powerful instinctive rejection that evil causes is only natural, and yet it prevents us from cognizing it and, thus, from building more effective defenses against it. Art sublimes the direct blow of our anxiety by transforming evil into symbolic and metaphorical figures which we can imaginably deal with and even accept (...) them, making them specifically interesting and even attractive. Along with artistic indulgence we strengthen the sense of metaphysical control over evil: Eventually shaping evil as a notion and an aggregative image we confirm to ourselves that we do have the ability to rise to the transcendent height of considering the Being as a Whole (or to the phenomenological essential insight), by doing so putting aside the limitations that conditio humana with its partiality and practical trivia lays upon us. Then again, presenting evil as an aesthetic phenomenon we design the kind of a virtual playground where we model it, counteract it and through this, finally establish our moral intuition on a new proven basis. Why is it so needed and reviving for us to create and use these psychological machines, not to mention the catharsis element they bring us, show some works of a prominent modern author Stephen King, the explorer of the theme of evil in the field of pop-culture.
