The aim of the present study is (1) to show, on the basis of a number of unpublished documents, how Heinrich Scholz supported his Warsaw colleague Jan Łukasiewicz, the Polish logician, during World War II, and (2) to discuss the efforts he made in order to enable Jan Łukasiewicz and his wife Regina to move from Warsaw to Münster under life-threatening circumstances. In the first section, we explain how Scholz provided financial help to Łukasiewicz, and we also adduce evidence of (...) the risks incurred by German scholars who offered assistance to their Polish colleagues. In scholarship on the history of philosophy, it is widely assumed that Charles Fourier was a utopian socialist who could not have exerted a significant influence on the development of Karl Marx's thought. Indeed, both Marx and Engels seem to have advanced this view. In contrast, I argue that in 1844 when Marx was developing his anthropology and social critique, he relied upon Fourier's thought to supply a key assumption. After establishing this connection, I explain why Marx's tacit reliance on (...) Fourier creates a problematic undercurrent in his thought. (shrink)

Für die zeitgenössische Philosophie ist das Vererben ein Vermögenstransfer, der unter Gesichtspunkten sozialer Gerechtigkeit zu behandeln ist. Diese Untersuchungsperspektive ist angesichts der massiven Verteilungseffekte, die das Vererben zeitigt, ohne Frage sehr wichtig. Allerdings lässt sie einen Punkt unberücksichtigt: Das testamentarische Vererben kann wichtige Beiträge dazu leisten, dass wir Verstorbene, denen wir zu Lebzeiten nahestanden, in Erinnerung behalten und wertschätzen. Hierbei ist der monetäre Wert der vererbten Güter nicht entscheidend. Wie ich in meinem Aufsatz darlege, lässt sich mit diesem Befund erklären, (...) warum die (von einer wachsenden Zahl von Gerechtigkeitstheoretikerinnen und -theoretikern geforderte) Abschaffung des Rechts zu vererben nicht nur von Vorteil sein würde, sondern auch mit ethischen Kosten verbunden wäre. Ein adäquater philosophischer Diskurs hätte diesen Befund (mit dem sich neoliberale oder rechtslibertaristische erbrechtliche Positionen nicht rechtfertigen lassen) angemessen zu berücksichtigen. Die Frage, ob ein Grundeinkommen für jede Bürgerin und jeden Bürger eine gerechte Institution ist, wird unter Philosophen seit gut 20 Jahren verstärkt diskutiert. Zur Begründung der Institution des Grundeinkommens wird von vielen Denkern eine Überlegung geltend gemacht, die von links-libertären Philosophen entwickelt wurde. Sie beruht auf der Annahme, dass von Natur aus gegebene Dinge und Ressourcen ursprünglich das gemeinsame Eigentum aller Menschen sind und dass private Aneigner derartiger Dinge und Ressourcen deshalb aus Gerechtigkeitsgründen gegenüber den anderen Menschen zur Zahlung (...) einer Entschädigung verpflichtet sind, deren Höhe dem ökonomischen Wert der von ihnen angeeigneten Güter entspricht. In der vorliegenden Untersuchung wird gezeigt, dass diese Begründung des Grundeinkommens auch dann nicht überzeugen kann, wenn man die eigentumstheoretischen Grundannahmen des Links-Libertarismus akzeptiert. Hierfür sind werttheoretische Defizite verantwortlich, die es fraglich erscheinen lassen, ob sich die Größe des ökonomischen Werts der von Natur aus gegebenen Dinge und Ressourcen im Rahmen der links-libertären Philosophie überhaupt überzeugend bestimmen lässt. For a good twenty years now, philosophers have been increasingly discussing whether or not a basic income for every citizen is a just institution. Some of these thinkers ground the institution of basic income on a notion that was developed by left-libertarian philosophers. This notion is based on the claims that things and resources that are naturally given are originally the common possession of all of mankind and that, out of reasons of justice, whoever privately appropriates such things or resources is therefore liable to paying compensation of an amount corresponding to the economic value of the appropriated items. The aim of the present study is to show that even if one accepts the basic assumptions made by left-libertarians about property rights, the above justification of basic income does not hold. This is due to deficits in the theory of value, which render it questionable whether the magnitude of the economic worth of things and resources given in nature can ever be convincingly determined within the framework of left-libertarianism. Written memoranda of conversations, or memcons, provide a near‐contemporaneous record of what was said in conversation, and offer important insights into the activities of high‐profile individuals. We assess the impact of writing a memcon on memory for conversation. Pairs of participants engaged in conversation and were asked to recall the contents of that conversation 1 week later. One participant in each pair memorialized the content of the interaction in a memcon shortly after the conversation. Participants who generated memcons recalled more (...) details of the conversations than participants who did not, but the content of recall was equally and largely accurate for both participants. Remarkably, only 4.7% of the details of the conversation were recalled by both of the partners after a week delay. Contemporaneous note‐taking appears to enhance memory for conversation by increasing the amount of information remembered but not the accuracy of that information. These findings have implications for evaluating the testimony of participants on conversations with major political or legal ramifications. (shrink)

Human cognition has many capabilities modern AI systems cannot compete with. One such capability is the detection, identification, and resolution of knowledge gaps (KGs). Using these capabilities as inspiration, we examine how to incorporate detection, identification, and resolution of KGs in artificial agents. We present a paradigm that enables research on (...) the understanding of KGs for visual-linguistic communication. We leverage and enhance and existing KG taxonomy to identify possible KGs that can occur for visual question answer (VQA) tasks and use these findings to develop a classifier to identify questions that could be engineered to contain specific KG types for other VQA datasets. Die vorliegende Untersuchung zeigt, warum es vielversprechend ist, das Projekt einer kritischen Gesellschaftstheorie in der Tradition der Frankfurter Schule auf der Grundlage einer Theorie der Anerkennung durchzuführen. Die Kategorie der Anerkennung hat in diesem Zusammenhang besonderen Wert, weil sich mit ihr soziale Verhältnisse sowohl analysieren als auch kritisieren lassen. Als Anerkennungstheorie vermag die Kritische Theorie wesentliche Ziele in den Bereichen der Sozialtheorie und der Sozialkritik zu erreichen. Anhand einer neuen Interpretation einiger klassischer philosophischer und sozialwissenschaftlicher Texte zeigt die vorliegende Untersuchung, (...) warum Hegels Praktische Philosophie das Projekt einer kritischen Gesellschaftstheorie in der Tradition der Frankfurter Schule stärker bereichern kann, als bisher angenommen wurde. This paper examines the relation between Cartwright's concept of 'capacities' and Mill's concept of 'tendencies' and argues that they are not equivalent. Cartwright's concept of 'capacities' and her motivation to adopt it as a central notion in her philosophy of science are described. It is argued that the Millian concept of 'tendencies' is distinct because Mill restricts its use to a set of special cases. These are the cases in which causes combine 'mechanically'. Hence for Mill 'tendencies' do not merely (...) describe the operation of causes, but also and perhaps even primarily how they combine. This does not hold of Cartwrightian capacities which are meant to have unlimited applicability. Mill also explicitly denies the realism of 'capacities' in a sense which overlaps with Cartwright's. Her attempt to derive empirist credentials for her notion of capacity from Mill is therefore unsuccessful. (shrink)

It is well known that John Stuart Mill repeatedly acknowledges Harriet Taylor Mill's substantial contribution to On Liberty. After her death, however, he decides to publish the book under his name only. Are we justified in continuing this practice, initiated by JSM, of refusing unequivocal co-authorship status to HTM? Drawing on stylometric analyses, we make a preliminary case that JSM did not write On Liberty all by himself and that HTM had a hand in formulating it. Drawing on plausible standards (...) for authorship ascription, we further point out that authorship status requires, in addition to a substantial contribution, the approval by all contributors. We discuss potential reasons to assume that HTM did not approve the published version of On Liberty and would have objected to including her name on the title page. This paper is a reply to Jonathan Riley’s criticism of my reading of Mill (both published in the Philosophical Quarterly 2003). I show that Riley’s interpretation has no textual support in Mill’s writing by putting the supposedly supporting quotations in their proper context. Secondly it is demonstrated how my reading is not incompatible with hedonism. Mill’s use of the concepts of ‘quality’, ‘quantity’, and ‘pleasure’ are explained and illustrated. I conclude by considering whether the possible redundancy of Mill’s quality/quantity discussion (...) would be problematic. (shrink)

This paper challenges (in a shorter version than the also listed 2002 LSE discussion paper) the first Gettier counterexample to the tripartite account of knowledge. Noting that 'the man who will get the job' is a description and invoking Donnellan's distinction between their 'referential' and 'attributive' uses, I argue that Smith does not actually believe that the man who will get the job has ten coins in his pocket. Smith's ignorance about who will get the job shows that the belief (...) cannot be understood referentially, his ignorance of the coins in his pocket shows that it cannot be understood attributively. An explanation for why Smith appeared to have justified true belief is given by distinguishing between 'belief' and 'belief in truth'. Smith believes the sentence 'the man who will get the job has ten coins in his pocket' to be true (he mistakenly believes that Jones will get the job, of whom he knows that he has ten coins in his pocket) (hence his 'belief'), the sentence is true (hence 'truth'), and he has sufficient reason to assent to it (hence his 'justification'). But he does not believe the proposition expressed. Hence he does not know it either. (shrink)

The aim of the present paper is to show that Hegel's concept of personal respect is of great interest to contemporary Critical Theory. The author first analyzes this notion as it appears in the Philosophy of Right and then offers a new interpretation of the conceptual relation between personal respect and the institutions of property and markets. In doing so, he shows why Hegel's concept of personal respect allows us to understand markets as possible institutionalizations of this kind of recognition, (...) and why it is compatible with a critique of neoliberal capitalism. He argues that due to these features Hegel's notion of personal respect is of great interest to theoreticians within the tradition of critical theory. (shrink)

Nach unserer Auffassung ist der Begriff der Arbeit als „das (disseitige) sich zum Dinge/Gegenstande machen" ein leistungsstarkes Konzept, auf dessen Grundlage in der Philosophie des Geistes von 1805/06 eine aus heutiger Sicht aufschlußreiche Analyse und Kritik der bürgerlichen Gesellschaft entwickelt wird. Der Nachweis dieser These ist der Gegenstand der vorliegenden Untersuchung. Zu diesem Zweck wird eine eingehende Analyse der diesbezüglich relevanten Textstellen aus der Philosophie des Geistes vorgenommen.

In dem vorliegenden Beitrag rekonstruiere ich die linkslibertaristische Kritik des Rechts zu vererben, die Hillel Steiner ausgearbeitet hat, und prüfe, ob diese Kritik zufriedenstellend ist. Ich komme zu dem Ergebnis, dass Steiner in dem von ihm angelegten rechtstheoretischen Rahmen die von vielen Philosophen und Rechtswissenschaftlern angenommene rechtliche Gleichartigkeit des Vererbens und des Verschenkens mit überzeugenden Argumenten in Frage stellt, seinerseits aber das Recht zu vererben mit einer Theorie kritisiert, die gerechtigkeitstheoretische und sozialtheoretische Bedenken hervorruft. Wie ich abschließend darlege, geben die (...) erzielten Untersuchungsergebnisse Aufschluss über das ontologische Profil des Rechts zu vererben und die Eigentümlichkeit dieser Art der Eigentumsübertragung; sie eignen sich deshalb als Ausgangspunkt einer philosophischen Theorie des Erbrechts. This chapter discusses (in German) John Stuart Mill's position on paternalism and how it relates to his book 'The Subjection of Women'. It is argued that Mill's claim (in On Liberty) that one should not be allowed to sell oneself into slavery is making reference to the Victorian marriage contract through which women essentially become slaves of their husbands. As argued in Subjection, women do not freely develop the desire to get married, the social circumstances do not leave them any (...) other options. Necessarily unaware of what married life is like, the decision to get married is like crossing an unsafe bridge without knowing it is unsafe. It is not paternalist, as Mill argues, to alert them to the condition of the bridge and put them in the position to decide for themselves whether they want to cross it (or turn back half way, e.g. by divorcing). Background: Adequate immunity to COVID-19 apparently cannot be attained in Germany by voluntary vaccination alone, and therefore the introduction of mandatory COVID-19 vaccination is still under consideration. We present findings on the potential acceptance of such a requirement by the German population, and we report on the reasons given for accepting or rejecting it and how these reasons vary according to population subgroup. -/- Methods: We used representative data from the Socio-Economic Panel for the period January to December 2021. We (...) linked the respondents’ answers concerning mandatory COVID-19 vaccination to information about their sociodemographic characteristics, state of health, political attitudes, and degree of confidence in the judicial and political systems. We analyzed these data using univariate, bivariate, and multivariate statistical methods. -/- Results: Just over half of the respondents (50.44% [49.08%; 51.79%]) favored mandatory COVID-19 vaccination. Among the supporters, the reason most frequently given (95.22% [94.45; 96.00]) was that, without such a requirement, not enough people would be vaccinated. Among the opponents of mandatory COVID-19 vaccination (49.56% [48.21%; 50.92%]), by far the most common reason given for opposing it was a desire to uphold individual freedom (91.36% [90.31%; 92.40%]). Persons supporting mandatory COVID-19 vaccination, on average, older than those who opposed it; they less commonly had an education beyond secondary school, were less healthy, tended to have no children, had centrist political views, and expressed more confidence in the political system. The largest difference between the two groups was that about 90% of supporters of mandatory COVID-19 vaccination were themselves vaccinated, compared to only about 62% of opponents. -/- Conclusion: The lack of consensus on this issue among politicians and physicians in Germany is reflected in a similar lack of consensus in the German population as a whole. A discussion of the appropriate understanding of individual freedom would be the most promising way to widen the acceptance of mandatory COVID-19 vaccination. Several vaccines against COVID-19 have now been developed and are already being rolled out around the world. The decision whether or not to get vaccinated has so far been left to the individual citizens. However, there are good reasons, both in theory as well as in practice, to believe that the willingness to get vaccinated might not be sufficiently high to achieve herd immunity. A policy of mandatory vaccination could ensure high levels of vaccination coverage, but its legitimacy is doubtful. (...) We investigate the willingness to get vaccinated and the reasons for an acceptance (or rejection) of a policy of mandatory vaccination against COVID-19 in June and July 2020 in Germany based on a representative real time survey, a random sub-sample (SOEP-CoV) of the German Socio-Economic Panel (SOEP). Our results show that about 70 percent of adults in Germany would voluntarily get vaccinated against the coronavirus if a vaccine without side effects was available. About half of residents of Germany are in favor, and half against, a policy of mandatory vaccination. The approval rate for mandatory vaccination is significantly higher among those who would get vaccinated voluntarily (around 60 percent) than among those who would not get vaccinated voluntarily (27 percent). The individual willingness to get vaccinated and acceptance of a policy of mandatory vaccination correlates systematically with socio-demographic and psychological characteristics of the respondents. We conclude that as far as people’s declared intentions are concerned, herd immunity could be reached without a policy of mandatory vaccination, but that such a policy might be found acceptable too, were it to become necessary. Three decades ago Gilbert posited that novel proteins arise by re‐shuffling genomic sequences encoding polypeptide domains. Today, with numerous genomes and countless genes sequenced, it is well established that recombination of sequences encoding polypeptide domains plays a major role in protein evolution. There is, however, less evidence to suggest how the novel polypeptide domains, themselves, arise. Recent comparisons of genomes from closely related species have revealed numerous species‐specific exons, supporting models of domain origin based on “exonization” of intron sequences. Also, (...) a mechanism for the origin of novel polypeptide domains has been proposed based on analyses of insertion‐based polymorphisms between orthologous genes across broad phylogenetic spectra and between allelic variants of genes within species. The law allows family members to make claims about what the deceased would have wanted to happen to his/her organs/tissue even though he/she never has voiced any relevant opinions. I argue that this is illegitimate.

Die moralphilosophische Schrift Utilitarianism gehört mit dem inhaltlich eng verbundenen Buch On Liberty zu Mills wichtigsten Werken. In angelsächsischen Fachbereichen für Philosophie gehört sie zur Pflichtlektüre in den ersten Studienjahren, auch in Deutschland steht sie inzwischen sehr häufig im Vorlesungsverzeichnis. Der Text scheint sich besonders für die studentische Lektüre zu eignen, da er nicht nur ein angenehm kurzer und auch leicht zu lesender Klassiker einer der wichtigsten Strömungen der Moralphilosophie ist, sondern offenbar auch ebenso klassische Fehlschlüsse und Denkfehler aufweist, an (...) denen Studierende ihre kritische Lektürefähigkeiten schulen können. Vor allem der Mill’sche ‚Beweis‘ des Utilitarismus und die offenbar dogmatische Unterscheidung zwischen ‚guten‘ und ‚schlechten‘ Freuden haben viel und heftigen Widerspruch hervorgerufen. Letztere Unterscheidung begründet nach Ansicht mancher Interpreten eine neue Art des Utilitarismus – den qualitativen, im Gegensatz zum rein quantitativen, wie er von Mills Ziehvater Jeremy Bentham propagiert wurde. Nach unserer Auffassung ist der Begriff der Arbeit als „das sich zum Dinge/Gegenstande machen" ein leistungsstarkes Konzept, auf dessen Grundlage in der Philosophie des Geistes von 1805/06 eine aus heutiger Sicht aufschlußreiche Analyse und Kritik der bürgerlichen Gesellschaft entwickelt wird. Der Nachweis dieser These ist der Gegenstand der vorliegenden Untersuchung. Zu diesem Zweck wird eine eingehende Analyse der diesbezüglich relevanten Textstellen aus der Philosophie des Geistes vorgenommen.

I present a game-theoretic way to understand the situation describing Newcomb’s Problem (NP) which helps to explain the intuition of both one-boxers and two-boxers. David Lewis has shown that the NP may be modelled as a Prisoners Dilemma game (PD) in which ‘cooperating’ corresponds to ‘taking one box’. Adopting relevant results from game theory, this means that one should take just one box if the NP is repeated an indefinite number of times, but both boxes if it is a one-shot (...) game. Causal decision theorists thus give the right answer for the one-shot situation, whereas the one-boxers’ solution applies to the indefinitely iterated case. Because Nozick’s set-up of the NP is ambiguous between a one-shot and a repeated game, both of these solutions may appear plausible – depending on whether one conceives of the situation as one-off or repeated. If the players’ aim is to maximize their payoffs, the symmetric structure of the PD implies that the two players will behave alike both when the game is one-shot and when it is played repeatedly. Therefore neither the observed outcome of both players selecting the same strategy (in the PD) nor, correspondingly, the predictor’s accurate prediction of this outcome (in the NP) is at all surprising. There is no need for a supernatural predictor to explain the NP phenomena. (shrink)

This paper challenges the first Gettier counterexample to the tripartite account of knowledge. Noting that 'the man who will get the job' is a description and invoking Donnellan's distinction between their 'referential' and 'attributive' uses, I argue that Smith does not actually believe that the man who will get the job has ten coins in his pocket. Smith's ignorance about who will get the job shows that the belief cannot be understood referentially, his ignorance of the coins in his pocket (...) shows that it cannot be understood attributively. An explanation for why Smith appeared to have justified true belief is given by distinguishing between 'belief' and 'belief in truth'. Smith believes the sentence 'the man who will get the job has ten coins in his pocket' to be true (he mistakenly believes that Jones will get the job, of whom he knows that he has ten coins in his pocket) (hence his 'belief'), the sentence is true (hence 'truth'), and he has sufficient reason to assent to it (hence his 'justification'). But he does not believe the proposition expressed. Hence he does not know it either. (shrink)

The conclusion of the paper reads: There is a view compatible with everything Mill says in these passages that can deal with all three problems. It’s a simple act utilitarianism in which the moral value of an action is determined by its actual consequences. On this view, the consequences of an action, what happens, depends on what the agent wants to bring about, that is to say, they depend on the agent’s intentions. Therefore the moral value of an action depends, (...) given that on simple act utilitarianism it entirely depends on the action’s consequences, entirely on the intentions of the agent – at least in the simple cases at issue between Mill and Davies in which people manage to bring about what they want to bring about. In these cases, varying the intention varies the consequences and thus the moral value. The simple act utilitarian nevertheless recognises that motives are also relevant – not necessarily to the consequences of the actions that do get performed but to which actions get performed at all. Hence motives are of paramount importance in theory and practice. However, as actions are individuated by the agent’s intentions and the action’s consequences, without appealing to the motive giving rise to it, any particular action might be brought about by different motives. Mill’s example illustrates this scenario. Hence it is possible to vary the motive due to which an action is performed without varying the action’s consequences, that is, without varying its moral value. In this sense, the moral value of an action does not depend on the motive with which it is done. Hence Davies’s objection is indeed unfounded and Mill’s footnote is rescued. (shrink)
