In this article, we defend two claims about the precautionary principle. The first is that there is no ‘core’ precautionary principle that unifies all its different versions. It is more plausible to think of the different versions as being related to each other by way of family resemblances. So although precautionary principle x may have much in common with precautionary principle y, and y with z, there is no set of necessary and sufficient conditions that unify all versions of the (...) principle. Our second claim is that it is sometimes appropriate to think of the precautionary principle as a midlevel principle in the sense proposed by Beauchamp and Childress in their Principles of Biomedical Ethics, i.e. as a non-rigid moral principle. We argue that if the precautionary principle is conceived as a non-rigid principle that needs to be balanced against other principles before a moral verdict can be reached, then this enables us to address some standard objections to the principle. Within the Participatory Design community as well as the Computer Supported Cooperative Work tradition, a lot of effort has been put into the question of letting field studies inform design. In this paper, we describe how game-like approaches can be used as a way of exploring a practice from a design point of view. Thinking of ethnographic fieldwork as a base for sketching, rather than descriptions, creates openness that invites collaborative authoring. The concept of playful collaborative exploration suggests certain ways (...) of interacting with material from field studies so that it becomes a design material for an open-ended design process. We have carried out field studies, transformed the field material into design material, and set up a design game for working with it together with the people we followed in the field. The design game builds on an idea about the power of narratives and the benefits of constraining rules. We believe that this framework for collaboration opens for playfulness, experimentation, and new design ideas. (shrink)

The term verificationism is used in two different ways: the first is in relation to the verification principle of meaning, which we usually and rightly associate with the logical empiricists, although, as we now know, it derives in reality from Wittgenstein, and the second is in relation to the theory of meaning for intuitionistic logic that has been developed, beginning of course with Brouwer, Heyting and Kolmogorov in the twenties and early thirties, but in much more detail lately, particularly in (...) connection with intuitionistic type theory. It is therefore very natural to ask how these two forms of verificationism are related to one another: was the verificationism that we had in the thirties a kind of forerunner of what we have now, or was it something entirely different? I would like to discuss this question by considering a very particular problem, which was at the heart of Schlick’s interests, namely, the problem whether there might exist undecidable propositions or, if you prefer, unsolvable problems or unanswerable questions: it is merely a matter of wording which of these terms you choose. As I said, it is a problem which was at the heart of Schlick’s interests: it is explicitly discussed already in his early, programmatic paper Die Wende in der Philosophie in the first volume of Erkenntnis from 1930, and there is a short late paper, which has precisely Unanswerable Questions? as its title, from 1935, and he discussed it on several occasions in between also. This volume contains several invited papers as well as a selection of the other contributions. The conference was the first meeting of the Soviet logicians interested in com- puter science with their Western counterparts. The papers report new results and techniques in applications of deductive systems, deductive program synthesis and analysis, computer experiments in logic related fields, theorem proving and logic programming. It provides access to intensive work on computer logic both in the USSR and in Western countries.

This paper examines the existential context of physical and mental health. Hans Georg Gadamer and The World Health Organization’s conceptualizations are discussed, and current medicalized and idealized views on health are critically examined. The existential dimension of health is explored in the light of theories of selfhood consisting of different parts, Irvin Yalom’s approach to “ultimate concerns” and Martin Heidegger’s conceptualization of “existentials.” We often become aware of health as an existential concern during times of illness, and health and (...) illness can co-exist. The paper discusses how existential suffering in Western culture is described, to an increasing degree, as disorders or psychological deficits, and perfectionistic health goals easily can become a problem. We seek to avoid suffering rather than relate to it, with all the tension that may create. The paper argues that suffering is an unavoidable aspect of people’s experience of their lives, and actively relating to suffering must be regarded as a fundamental aspect of health. The need and usefulness of a concept of “existential health” is discussed. (shrink)

This paper examines the psychology of existential guilt with Martin Heidegger and Rollo May’s conceptualizations as the point of departure. The concept of existential guilt describes preconditions for responsibility and accountability in life choices and the relationship to the potential given in the life of a human. It might also be used as a starting point to examine an individual’s relationship to the potential offered in their life and life context and, in this way, the hitherto unlived life of (...) an individual. The following questions are discussed in contexts of identity development, perfectionism, and current cultural shifts in conceptualizations of selfhood: How can humans relate to the fact that only limited parts of who they might be can ever be actualized? Moreover, how can they relate to the fundamental ambiguity and “groundlessness” in the contexts of life where choices are made? There are striking parallels between the role of exploration in the Eriksonian approaches to healthy identity development and the ontological groundlessness that stands out as a premise for existential guilt. There are also parallels between identity fore-closure and normative identity styles and “falling” into das Man in the existential framework. Perfectionistic ideals easily become an objectivization – and closure – of possible alternatives and choices. In contemporary theories of constructions of selfhood, the dangers of alienation from the community on the one hand and escape into what might become totalitarian collectivism on the other is pointed out. The contextualization of personal responsibility offered through the concept of existential guilt might address both dangers. It provides a perspective on how personal responsibility is embedded in contexts of human relationships, relationships to nature, and the finitude, freedom, uncertainties, and suffering that is given through human existence. Existential guilt can wake sorrow and regret over opportunities overlooked and lost. However, most of all, it can be seen as a drive toward repair in the relationship toward both oneself and the other. It takes the form of receptivity, an openness to a life not yet lived, and creative use of imagination. (shrink)

Sex- and age-specific rates of killing unrelated persons of one’s own sex were computed for Canada (1974–1983), England/Wales (1977–1986), Chicago (1965–1981), and Detroit (1972) from census information and data archives of all homicides known to police. Patterns in relation to sex and age were virtually identical among the four samples, although the rates varied enormously (from 3.7 per million citizens per annum in England/Wales to 216.3 in Detroit). Men’s marital status was related to the probability of committing a same-sex, nonrelative (...) homicide, but age effects remained conspicuous when married and unmarried men were distinguished.These findings and the treatment of age and sex effects by criminologists are discussed in the light of contemporary evolutionary psychological models of sex differences and life-span development. Same-sex homicides in which killer and victim are unrelated can be interpreted as an assay of competitive conflict. In every human society for which relevant information exists, men kill one another vastly more often than do women. Lethal interpersonal competition is especially prevalent among young men, which accords with many other aspects of life-span development in suggesting that sexual selection has maximized male competitive prowess and inclination in young adulthood. Companies committed to corporate social responsibility should ensure that their managers possess the appropriate competencies to effectively manage the CSR adaptation process. The literature provides insights into the individual competencies these managers need but fails to prioritize them and adequately contextualize them in a manner that makes them meaningful in practice. In this study, we contextualized the competencies within the different job roles CSR managers have in the CSR adaptation process. We interviewed 28 CSR managers, followed by a survey to (...) explore the relative importance of the competencies within each job role. Based on our analysis, we identified six distinct managerial roles, including strategic, coordinating, and stimulating roles. Next, we identified per role key individual CSR-related competencies as prioritized by the respondents. Our results show that the context, as indicated in this study by CSR managers’ job roles, indeed influenced the importance of particular CSR-related competencies, because each role seems to require a different combination and prioritization of these competencies. Moreover, the results suggest that the relative importance of these competencies within each role may be driven by business logic rather than an idealistic logic. The results are presented as a competence profile which can serve as a reflection tool and as a frame of reference to further develop the competence profile for CSR managers. (shrink)

The aim of the article is to describe the nonverbal communication patterns that passengers of the Delhi Metro use to manage density-induced territorial intrusions, and to identify some of the contextual variables that affect their deployment. After introducing the notion of “interrogative look” and the dataset, the following section depicts the techniques that passengers were observed to employ in order to solve the problem of territorial intrusion without breaking anonymity. The bulk of the analysis deals with the structure and function (...) of “interrogative looks”, an objectively defined pattern of nonverbal behavior that the touched uses to signal her discontent to the toucher. The rest of the section describes a less frequent pattern whereby passengers contagiously signal the playful character of their mischiefs. Next is examined if and how density, i.e., the number of individuals per surface unit, influences as a contextual variable the occurrence of interrogative looks. The closing discussion considers the main findings from the standpoint of their local specificity. (shrink)

This paper conducts a cost–benefit analysis of Australia’s Covid-19 lockdown strategy relative to pursuit of a mitigation strategy in March 2020. The estimated additional deaths from a mitigation strategy are 11,500 to 40,000, implying a Cost per Quality Adjusted Life Year saved by locking down of at least 11 times the generally employed figure of $100,000 for health interventions in Australia. The lockdowns do not then seem to have been justified by reference to the standard benchmark. Consideration of the information (...) available to the Australian government in March 2020 yields a similar ratio and therefore the same conclusion that lockdown was not warranted. If Australia experiences a new outbreak, and cannot contain it without resort to a nationwide lockdown, the death toll from adopting a mitigation strategy at this point would be even less than had it done so in March 2020, due to the vaccination campaign, lessons learned since March 2020, and because the period over which the virus would then inflict casualties would now be much less than the period from March 2020. This would favour a mitigation policy even more strongly than in March 2020. This approach of assessing the savings in quality adjusted life years and comparing them to a standard benchmark figure ensures that all quality adjusted life years saved by various health interventions are treated equally, which accords with the ethical principle of equity across people. In this paper, I offer reasons for thinking that two prominent sceptical arguments in the literature – the underdetermination-based sceptical argument and the closure-based sceptical argument – are less philosophically interesting than is commonly supposed. The underdetermination-based argument begs the question against a non-sceptic and can be dismissed with little fanfare. The closure-based argument, though perhaps not question-begging per se, does rest upon contentious assumptions that a non-sceptic is under no pressure to accept.

We hypothesize that in modern societies the striving for high positions in the hierarchy of organizations is equivalent to the striving for status and power in historical and traditional societies. Analyzing a sample of 4,491 US men and 5,326 US women, we find that holding a supervisory position or being in charge of hiring and firing is positively associated with offspring count in men but not in women. The positive effect in men is attributable mainly to the higher proportion of (...) childlessness among men in non-supervisory positions and those without the power to hire and fire. This effect is in accordance with the positive relationship between other status indicators and reproductive success found in men from traditional, historical, and modern societies. In women, we further find a curvilinear relationship between income percentile and offspring number by analyzing US census data, indicating that women may strive for resources associated with advancement rather than for status per se. Landauer incitava alla lotta contro lo Stato, i partiti e il capitalismo perché sosteneva un’idea di trasformazione radicale della società, fondata su uno spirito nuovo, comunitario, che non avrebbe modificato solo le forme esteriori di dominio, ma gli stessi rapporti tra gli uomini. I suoi discorsi non riuscirono tuttavia a catturare le masse. Landauer decise di partecipare alla rivoluzione tedesca non per realizzare la propria (...) idea ma per tentare di contenere i rischi, propri di ogni rivoluzione, di venire fagocitata dal meccanismo dei partiti e di autodistruggersi attraverso l’uso della violenza. Buber giudica inoltre un errore la sua scelta politica di prender parte al governo dei Consigli, perché lo costrinse ad accettare compromessi e a mettere da parte la sua idea di trasformazione. E tuttavia Buber lo celebra come un martire che accettò consapevolmente di sacrificarsi.Buber remembers his friend Gustav Landauer, the german revolutionar of hebrew origins, who was murdered in 1919 in Munich. But Landauer’s speeches were not able to convince the masses. According to Buber, Landauer decided to take part to the german revolution not for realizing his own ideas, but only to reduce the inner risks of every revolution of being absorbed by partitic mechanism and collapse under his own violence. Secondly, Buber means that Landauer’s politic choice to take part to the government of the Councils was a failure, because he had to come to compromises and give up his idea of transformation. Social attitudes toward usury (here defined using the archaic meaning as the taking of interest on loans) have changed dramatically over the centuries. From antiquity until the Protestant Reformation, usury was regarded as an inherently evil activity. Today, with few exceptions, usury is met with moral indifference. Modern objections to usury are limited to protest against "excessive" interest rates rather than interest per se. With this change in focus, the very meaning of the term "usury" has also changed. Many early (...) pronouncements against the taking of interest emphasized the plight of the poor, but ironically, the poor actually pay the highest rates of interest in the modern American economy. Despite the universality of usury, some socio-economic subcultures still manage to avoid the taking or giving of interest. Orthodox branches of both Judaism and Islam have maintained bans on usury throughout the centuries and up to the present time. This is especially interesting in the case of Judaism, given the popular cultural image of the Jew as usurer. Jewish free loan systems may actually offer a model for modern loan programs that can be designed to aid poor borrowers, who are frequently shut out of mainstream financial services. (shrink)

SummaryIn 1968, a prospective study was started in collaboration with the Family Planning Association to try to provide a balanced view of the beneficial and harmful effects of different methods of contraception. This investigation is now in progress at seventeen clinics and over 17,000 women are under observation. At the time of recruitment, all these women were married white British subjects, aged 25–39 years, who voluntarily agreed to participate. Fifty-six per cent were using oral contraceptives, 25% were using a diaphragm (...) and 19% were using an intrauterine device. During follow-up each woman is questioned at return visits to the clinic and a record of pregnancies and their outcome, hospital referrals, changes in contraceptive methods and the results of cervical smears, is accumulated. Women who default are sent a postal questionnaire and, if this is not returned, are telephoned or visited in their homes to collect the necessary information.So far, data obtained during 56,000 woman-years of observation are available for analysis. Follow-up has been maintained with an annual lapse rate of about 0.3%due to withdrawal of co-operation or loss of contact; adherence to the method of contraception in use at recruitment has been reasonably good, and the reporting of pregnancies and hospital admissions appears to have been both reliable and unbiased.The present data include only 24 deaths, so the mortality associated with different contraceptive methods cannot yet be estimated. With regard to morbidity, however, our preliminary results closely resemble those obtained in the prospective study carried out by the Royal College of General Practitioners and in the principal retrospective studies carried out in Britain and the United States. Women who used oral contraceptives at the start of the study experienced adeficiencyof hospital referrals for cancer, benign lesions of the breast, menstrual disorders other than amenorrhoea, duodenal ulcer, and retention cysts of the ovary; they showed anexcessof referrals for cerebrovascular disease, cervical erosion, skin disorders, self-poisoning, migraine, venous thrombosis and embolism, hayfever, gallbladder disease, amenorrhoea, and sterility. Women who used a diaphragm showed adeficiencyof hospital referrals for carcinoma-in-situ and dysplastic lesions of the cervix uteri and accidental injury; and anexcessof referrals for haemorrhoids and cystitis. Women who used an IUD experienced anexcessof hospital referrals for anaemia, varicose veins and salpingitis. About half of these differences were predicted from other studies while some suggestive evidence already existed for a further five. Of the remaining six, some probably reflect the influence of selective factors or chance.Multiple pregnancies, stillbirths, malformations, the sex ratio and birthweight showed no consistent relationship to method of contraception. The outcome of unplanned pregnancies occurring in women using an IUD, however, was remarkably unfavourable both in terms of ectopic gestation and miscarriage.Clear evidence was found of impairment of fertility after discontinuation of oral contraceptives. Whether this is likely to lead to permanent sterility in some women is uncertain.The study has provided data on the efficacy of a wide variety of contraceptive methods. In general the failure rates are in keeping with those obtained in other large-scale studies, save that those for the diaphragm and the sheath are much lower than those usually quoted.The available evidence does not yet allow a final balance to be struck between the benefits and risks associated with the new methods of contraception that have become widely used during the last two decades. It seems clear, however, that there are no material risks associated with the use of the diaphragm apart from the risk of pregnancy and that there may be some unintended benefits. (shrink)

In his early essay "On the Writer's Philosophy of Life," and in his early letters to (...) Cloudsley Johns, his intellectually "slovenly" friend (who also happened to share his literary ambitions and interests), London insists, again and again, on the proper philosophical foundation of the successful writer. This is how poor Cloudsley, who had previously been told to "get in and systematically ground [himself] in history, economics, biology and the kindred branches" 1 gets browbeaten by his self-appointed mentor and master, a veritable Jack of all trades, in a letter dated March 15, 1900: "To be well fitted for the tragedy of existence (intellectual existence), one must have a working philosophy, a synthesis of things. Have you a synthesis of things? Do you write, and talk, and build upon a foundation which you know is securely laid? Or do you not rather build with a hazy idea of 'to hell with the foundation.'" London then proceeds to catechize his friend on scientific principles such as the indestructibility of Matter, the persistence of Force, and the overall "dynamic principle, true of the metamorphosis of the universe"—principles that Cloudsley is urged to study "carefully and painstakingly" before he can ever claim to have "a firm foundation for [his] philosophy of life" (Letters, pp. 170-71).In London's admittedly heavy-handed ad hominem argument, one recognizes the philosophical sledgehammer of Ernest Everhard, the revolutionary hero of The Iron Heel and one of the fictional exponents of "that cold forbidding philosophy, materialistic monism," 2 which also [End Page 43] served as the scientific foundation of London's own philosophy of life. There are, however, not one, but two components to London's philosophy, which, as I shall argue in this essay, together constitute an essentially dialectical construction, a dynamic juxtaposition of and negotiation with, on the one hand, the "cold forbidding" Medusa of Truth and, on the other hand, the life-enhancing Aphrodite of Romance, the second of which is one of several versions of the vital Maia-Lie (Maia being the Buddhist term for the power that creates or re-creates the world as cosmic illusion).Two points need to be stressed from the outset. First, London's work is implicitly aligned with literary naturalism—the "Zolaistic Movement" of modern American fiction that the genteel writer and editor Thomas Bailey Aldrich famously condemned for its "miasmatic breath" 3 —even though London himself would always qualify his own naturalism by insisting that, artistically, he was "an emotional materialist" (Letters, p. 329), and that his realism was, in the words of Martin Eden, one of his fictional alter egos, "an impassioned realism, shot through with human aspiration and faith." 4 Second, London's work is explicitly aligned with philosophical naturalism (as distinct from supernaturalism)—that is, naturalism as the philosophical or epistemological view that, to quote The Oxford Companion to Philosophy (1995), "everything is natural, i.e. that everything there is belongs to the world of nature, and so can be studied by the methods appropriate for studying that world." In philosophical practice, naturalism and materialism have tended to coalesce, materialism being basically understood as the view that everything is made of matter, which can be studied by the methods of natural science. Like London's philosophical alter ego Ernest Everhard (and also like fictional protagonists such as Wolf Larsen and Martin Eden), London declared himself "a materialistic monist," although, as he admitted to Cloudsley Johns, "there is dam little satisfaction in it." Rhetorically impersonating, as it were, Wolf Larsen, London, in the same letter, asks himself and his correspondent, "what squirming anywhere, damned or otherwise, means anything? Questo tipo di utopia si distingue sia dall’immaginazione fantastica di stati di cose non realizzabili, sia dall’avvicinamento asintotico a qualcosa che in realtà non corrisponde ai desideri umani, com’è per l’idea regolativa di Kant. Tre condizioni rendono realistiche e sensate le utopie politiche: il poter essere pensato, il poter essere soddisfatto e il poter essere conseguito. L’idea di Rawls di una pace tra (...) i popoli, o quella di Margalit su istituzioni rispettose dell’individuo sono esempi di queste utopie realistiche. Richiamando possibilità remote, esse rendono visibili nuove possibilità per il presente, che possono poi venire tradotte in istanze normative di tipo politico-sociale. Ciò vale anche per le utopie private, che allargano le possibilità per l’esistenza. There are three conditions for making utopias realistic and senseful: the possibility of being thought, fulfilled and reached. Rawls’ idea of peoples’ peaceful living, or Margalit’s idea of institutions’ respect of individuums, are examples of this kind of realistic utopias. Through recalling far possibilities they let appear new possibilities for the present, that can be traducted in political-social normative instances. And this method applies for private utopias, too. To renounce those new possibilities means a double traison of ourselves, in a collective and personal sense. (shrink)

In recent years, the issue of accepting a higher cost per health improvement for orphan drugs has been the subject of discussion in health care policy agencies and the academic literature. This article aims to provide an analysis of broadly egalitarian arguments for and against accepting higher costs per health improvement. More specifically, we aim to investigate which arguments one should agree upon putting aside and where further explorations are needed. We identify three kinds of arguments in the literature: considerations (...) of substantial equality, formal equality, and opportunity cost. We argue that considerations of substantial equality do not support higher costs per health improvement orphan drugs, even if such considerations are considered valid. On the contrary, arguments of formal equality may support accepting a higher cost per health improvement for orphan drugs. However, in order to do so, a number of both normative and empirical issues must be resolved; these issues are identified in the article. For instance, it must be settled to what extent the opportunity cost in terms of foregone health for other patients is acceptable in order to uphold formal equality. We conclude that certain arguments can be set aside, and future focus should be put on the unresolved normative and empirical issues related to formal equality and opportunity cost. (shrink)

Je défendrai ici la thèse que le sublime renvoie en réalité à une expérience esthétique de l’événement comme tel, à même de nous faire penser une certaine « Idée esthétique » du temps. Une telle expérience semble d’ailleurs pouvoir trouver forme dans différentes productions poétiques de notre modernité. | : This article proposes a re-evaluation of the notion of “event” in the field of aesthetics, which requires to question the specific temporality of the concept of “sublime”, traditionally associated with a flash, a staggering moment, which precisely constitutes an event. The development leans on the Kantian Analytic of the sublime which, on diverse occasions, highlights the paradoxical character of a sublime that only seems able to fulfil itself at the price of a double temporality, ultimately named regressive. I shall defend here the thesis that the sublime refers actually to an aesthetic experience of the event per se, allowing us to conceptualise a certain “aesthetic idea” of time. Such an experience, as a matter of fact, seems to be embodied in different poetic productions of our modernity. (shrink)

In this essay Martin Kintzinger takes as his starting point observations on the current debate regarding knowledge and asserts a lack of reflection on the status of knowledge in pre-modern societies. In Sebastian Brant’s work ‘Narrenschiff’ and other contemporary critical writings, Kintzinger finds evidence that the medieval critique of experts was not by necessity a critique of expertise per se. Rather, it often was a critique of an expertise based on purely theoretical book learning, deemed unpractical and inapplicable. Significantly, (...) there existed a counter-conception of an expert who possessed both theoretical knowledge and practical experience and who was deemed practically able to cure disease, or give valuable legal advice etc. Of course, the term experientia was first used in this context only around 1600. But Kintzinger argues that experience-based knowledge, which is associated with inductive inference and the modern natural sciences, was not a product of the early modern period. Rather, the notion of experience as a warrant of true knowledge was heavily rooted in medieval thought. This essay subsequently traces the emergence of the notion of experience to Scholasticism, to the thought of Thomas Aquinas and Albert the Great and to the medieval debate on the dualism between the arts and science, and between empiricus and theoricus respectively. D'una banda, s'analitza la concepció del significat de les paraules quePlató sembla defensar en aquest diàleg; de l'altra, s'ocupa del problema dels orígens delllenguatge. Aquestes qüestions s'estudien en relació amb la perspectiva ontològica i epistemològicade Plató: essencialisme, teoria de la reminiscència i les tesis dels sofistes sobre laimpossibilitat de parlar amb falsedat. PurposeTo evaluate the prevalence and treatment patterns of speech and language disorders in Germany.MethodsA retrospective analysis of data collected from 32% of the German population, insured by the statutory German health insurance. We used The International Statistical Classification of Diseases and Related Health Problems, 10th revision, German Modification codes for stuttering, cluttering, and developmental disorders of speech and language to identify prevalent and newly diagnosed cases each year. Prescription and speech therapy reimbursement data were used to evaluate treatment patterns.ResultsIn 2017, (...) 27,977 patients of all ages were diagnosed with stuttering. Stuttering prevalence peaks at age 5 years. Cluttering was diagnosed in 1,800 patients of all ages. Developmental disorders of speech and language were identified in 555,774 AOK-insurants. Treatment data indicate a substantial proportion newly diagnosed stuttering individuals receive treatment, with slightly fewer than 20 sessions per year, on average. We confirmed a previous study showing increased rates of atopic disorders and neurological and psychiatric comorbidities in individuals with stuttering, cluttering, and developmental disorders of speech and language.ConclusionThis is the first nationwide study using health insurance data to analyze the prevalence and newly diagnosed cases of a speech and language disorder. Prevalence and gender ratio data were consistent with the international literature. The crude prevalence of developmental disorders of speech and language increased from 2015 to 2018, whereas the crude prevalence for stuttering remained stable. For cluttering, the numbers were too low to draw reliable conclusions. Proportional treatment allocation for stuttering peaked at 6 years of age, which is the school entrance year, and is later than the prevalence peak of stuttering. (shrink)

Lo studio esamina il tema della legge umana e dell'equità , che risulta di notevole importanza per la comprensione della filosofia pratica aristotelica, in Roberto Grossatesta, Alberto Magno e Tommaso d'Aquino a partire da Ethica Nicomachea V. 10. Dopo una breve premessa in cui si espongono le linee guida del saggio, l'A. si sofferma sul capitolo aristotelico, per poi esporre lo status questionis nei canonisti medievali e nei testi pastorali prima della ricezione dell'Etica; l'ultima parte è dedicata al significativo apporto (...) che questa ha dato alla discussione medievale. Se Grossatesta fa ampio ricorso a tale nozione nella discussione del rapporto tra diritto naturale e diritto positivo, Alberto riafferma l'importanza di tale concetto e l'opportunità di utilizzarlo quando la legge, per il suo carattere di universalità, risulti inadeguata e sia necessario ripristinare la giustizia. La trattazione più sistematica è comunque offerta da Tommaso d'Aquino, in particolare nel commento all'Ethica Nicomachea e nella Summa theologiae, che impiega la nozione di aequitas in un senso più vicino a quello aristotelico che a quello dei canonisti o alla tradizione del diritto romano. La filosofia aristotelica è così all'origine di un rinvigorimento della discussione sull'aequitas canonica che offrirà nuovi sviluppi nel campo della filosofia morale e del diritto in epoca tardomedievale. After a brief discussion of altruism, supererogation, and the duty to rescue in American and Jewish Law, this paper turns to an examination of the challenge to altruism presented by the developing field of evolutionary psychology. Evolutionary psychology is the investigation of animal behavior from the perspective of natural selection. The fundamental issue, as E.O. Wilson says, is the question, "How can altruism, which by definition reduces personal fitness, possibly evolve by natural selection?" According to a seminal article in the (...) field, "Models that attempt to explain altruistic behavior in terms of natural selection are models designed to take the altruism out of altruism." The challenge of evolutionary psychology is that it provides a "genealogy of morals" that many have found to be disturbing. From the evolutionary perspective what crucially matters is the reproductive success of the individual animal, the transmission of its genes to later generations, and this provides the measure of its individual fitness. The evolutionary psychologist's argument proceeds by the introduction of three basic concepts: kin selection , reciprocal altruism, and indirect reciprocity. Each of these concepts is critically analyzed. It is concluded that the current status of altruism and cooperation is not affected by evolutionary history. They do have a genetic basis, but then so does everything about human beings, nastiness as well as cooperation; it does not follow that motives for cooperation are always self-serving. Nach einer kurzen Erörterung von Altruismus, Supererogation und der Hilfeleistungspflicht im amerikanischen und jüdischen Recht wendet sich der Artikel einer Untersuchung der Anforderungen zu, die die Evolutionspsychologie an den Altruismus stellt. Evolutionspsychologie ist die Erforschung tierischen Verhaltens aus der Perspektive der natürlichen Auslese. Das grundlegende Problem ist, wie E.O. Wilson sagt, die Frage: "Wie kann sich Altruismus, der per definitionem die eigenen Fähigkeiten vermindert, durch natürliche Auslese entwickeln?" Nach einem bahnbrechenden Artikel sind "Modelle, die versuchen, altruistisches Verhalten in Begriffen der natürlichen Auslese zu erklären, darauf angelegt, dem Altruismus das Altruistische zu nehmen". Die Herausforderung der Evolutionspsychologie ist die von ihr bereitgestellte "Genealogie der Sitten", die von vielen als eine Beeinträchtigung empfunden wird. Vom Standpunkt der Evolution kommt es entscheidend auf den Reproduktionserfolg des einzelnen Wesens an, auf die Übertragung seiner Gene auf spätere Generationen, und das liefert den Maßstab für seine eigenen Fähigkeiten. Die Argumentation der Evolutionspsychologen fährt mit der Einführung von drei grundlegenden Begriffen fort: "kin selection" , reziproker Altruismus und indirekte Reziprozität. Jeder dieser Begriffe wird kritisch analysiert. Daraus folgt, daß der gegenwärtige Stand von Altruismus und Kooperation von der Evolutionsgeschichte nicht beeinflußt ist. Altruismus und Kooperation haben eine genetische Basis. Aber das haben alle menschlichen Eigenschaften, Bosheit genauso wie Kooperation. Daraus folgt nicht, daß die Motive für Kooperation stets dem Handelnden dienen. (shrink)

There is a growing pessimism about objects based on the view that objects are mysterious unobservables. According to this line of thought objects can disturb our senses or measuring devices only indirectly, via properties or relations – only properties or relations are observables, not the objects per se. As a result, inaccessible objects open a gap between science and reality and scientific realism is lost. Defenders of objects may respond that the scope of this reasoning is rather limited, because its (...) truth is restricted to very specific views of objects and scientific realism. The paper is concerned with three forms of scientific realism confronting them with three basic ontologies of objects. It appears, then, that seen from the perspective of scientific realism the least problematic picture of objects is given by the Spinozian conception of objects and their modes. However, even this conception faces some difficulties and it seems that the traditional metaphysics is not able to provide a scientifically unproblematic notion of object. (shrink)

Empirical research has increasingly turned its attention to distributed cognition. Acts of remembering are embedded in a social, interactional context; cognitive labor is divided between a rememberer and external sources. The present article examines the benefits and costs associated with distributed, collaborative, conversational remembering. Further, we examine the consequences of joint acts of remembering on subsequent individual acts of remembering. Here, we focus on influences on memory through social contagion and socially shared retrieval-induced forgetting. Extending beyond a single social interaction, (...) we consider work that tracks the propagation of socially shared retrieval-induced forgetting throughout larger networks made up of several agents. Although much work has focused on how distributing cognition can augment memory, this is not the primary lesson we draw from the conversational remembering literature. Rather, mnemonic convergence between communicators is a boon to sociality. It allows the formation and maintenance of mnemonic communities, rather than expanding capacity or accuracy of memory per se. (shrink)
