In a capitalist economy, taxes are the most important instrument by which the political system puts into practice a conception of economic and distributive justice. Taxes arouse strong passions, fueled not only by conflicts of economic self-interest, but by conflicting ideas of fairness. Taking as a guiding principle the conventional nature of private property, Murphy and Nagel show how taxes can only be evaluated as part of the overall system of property rights that they help to create. Justice or (...) injustice in taxation, they argue, can only mean justice or injustice in the system of property rights and entitlements that result from a particular regime. Taking up ethical issues about individual liberty, interpersonal obligation, and both collective and personal responsibility, Murphy and Nagel force us to reconsider how our tax policy shapes our system of property rights. ABSTRACT Controlled human infection (CHI) models have been developed for numerous pathogens in order to better understand disease processes and accelerate drug and vaccine testing. In the past, some researchers conducted highly controversial CHIs with vulnerable populations, including children. Ethical frameworks for CHIs now recommend vulnerable populations be excluded because they cannot consent to high risk research. In this paper we argue that CHI studies span a wide spectrum of benefit and risk, and that some CHI studies may involve minimal (...) risk. The categorical exclusion of children from CHIs therefore departs from the standard approach to evaluating research risks, as international regulations and ethical guidance for pediatric research generally permit non‐beneficial research with low risks. The paradigm in research ethics has also shifted from focusing on protecting vulnerable participants to recognizing that inclusion can be important as a matter of justice, providing new reasons to question this default exclusion of children from CHIs. Recognizing that pediatric CHIs can raise complex ethical issues and are easy to sensationalize in ways that may threaten the public’s trust in research and sponsor institutions, we conclude by describing additional complexities that must be addressed before pediatric CHIs beyond licensed vaccine studies might be ethically acceptable. Elsewhere, Tak Chan and Stark & Delatycki debate the role of medical professionals in providing parentage determination. Chan argues that doctors are obliged to provide parentage tests when this is requested by parents, provided there (...) is a low risk that the child will be abandoned . Stark & Delatycki discuss some difficulties raised by the ‘risk of abandonment’ condition . Finally, papers by Kate Greasley and David Lang discuss the controversy surrounding the criminal prosecution of abortion doctor Kermit Gosnell. Greasley criticises the way in which some commentators capitalised on horror at Gosnell's extreme practices to advance more general anti-abortion objectives . Lang argues, against Greasley, that the dominant pro-life response to the case was neither self-contradictory nor intellectually dishonest .The issue is dominated, however, by discussions of ‘bioenhancement’ – the use of biomedical technologies to augment human capacities. A common criticism of bioenhancements is that they are anti-social: though they may benefit the user, they will have a negative effect on society-at-large. Such concerns are perhaps well placed in relation to the most obvious contemporary examples of bioenhancement: doping in sport, aesthetic medicine, and the use of stimulants to enhance examination performance. INTRODUCTIONPhilosophical investigations of the concept of responsibility, mirroring its most common function in ordinary language and thought, have been geared for the most part to clarifying intuitions concerning moral and legal accountability for actions. But the resurgence of interest in ethical theories concerned with human virtues has resurrected old questions about our responsibility for our character, attitudes, and emotions. The philosophical tradition that takes virtues as a central moral category has taught us to think of virtues not only as involving (...) dispositions to actions, but also dispositions to desires and emotions. It has also taught us to think of actions as only one of the proper objects of moral evaluation, alongside, for example, motives, intentions, beliefs, desires, and emotions. So it is natural that interest in ethical theories concerned with the virtues would yield interest in responsibility for our attitudes and emotions.Robert Adams has already done much to draw our attention to the different concept of responsibility we are forced to define if we focus on our intuitions about moral accountability for emotions, attitudes, and beliefs, rather than for actions. I disagree with his account of responsibility for such states, but I am indebted to his illuminating discussions of the topics. Thomas Aquinas, who of course is one of the most important architects of the tradition that takes virtues to be central moral categories, holds a very complex set of views about our responsibility for our emotions. My aim in this essay is to develop and explain Aquinas’s views about whether and when, why, and to what extent we can be responsible for our emotions. I hope to show, in so doing, that his view is plausible, and fits well with some of our own conflicting intuitions about the question. (shrink)

This essay considers ways in which Darwin's account of natural processes was influenced by economic, ethical, and natural‐theological theories in his own day. It argues that the Anabaptist concept of “the gospel of all creatures” calls into question alliances between evolutionary theory and social policy that are based on the dominance of conflictual images such as “the survival of the fittest” and questions the negative images of both nature and God that Darwinism has been taken to sponsor. The essay also (...) considers developments in biology that have called into question dualist accounts of human nature as body and soul, thus reminding us that we are fully a part of the natural world and thus contributing, in turn, to a better theological grasp of God's relation to nature. In considering the argument that Thomas Szasz advances on behalf of his claim that there is no mental illness, it becomes evident that despite his stated assumptions, moral valuations are necessarily tied up with assessment of disease. By following his remarks about differential diagnosis, it becomes evident that behavior is the occasion for differential diagnosis, that behavior determines which anatomical deviations are counted as diseases, and that Szasz's insistence on autonomy introduces his own moral assumptions into the concept of (...) disease. Consequently, although none of these considerations disproves Szasz's conclusions about the existence of mental illness, neither can his argument support the weight of that conclusion. The goal of this article is to explain how the concept of Illumination came to be a source of skepticism in the modern West. In ancient and medieval Christian thought it was essentially tied not only to Plato’s philosophy, but especially to Augustine’s invention of the notion that the soul is an inner chamber containing all his knowledge, but also the locus of his encounter with God. The concept of the soul or mind as an inner chamber re-emerged in early (...) modern western philosophy, but it was no longer open to illumination, John Locke having made revelation into an entirely distinct category of knowledge. The set of ocular metaphors of which illumination is a part still has an important place in ordinary language, but can no longer provide for a philosophical theory of knowledge. Thus, different complex metaphors need to be employed. Alasdair MacIntyre’s account of human reason begins with social practices, and can be described as an extensive thesis reflecting the metaphor Knowing as Doing. With his incorporation of Thomas Aquinas into his account of tradition-constituted rationality, it is suggested that interesting parallels might be found with the work of Mulla Sadra. (shrink)

Several attempts to present such justifications are discussed, including those by Murphy, Morris, Sterba, and Hoekema. It is argued that social contractors would not choose a practice of punishment because such a practice is a symbolic expression of society’s disapproval of offenses against the law. Social contractors would instead choose a practice which might (...) have some deterrent effect upon crime but would lack the feature of social contract theory. (shrink)
