‘Pupil voice’ is a movement within state education in England that is associated with democracy, change, participation and the raising of educational standards. While receiving much attention from educators and policy makers, less attention has been paid to the theory behind the concept of pupil voice. An obvious point of theoretical departure is the work of Jürgen Habermas, who over a number of decades has endeavoured to develop a theory of democracy that places strong significance on language, communication and discourse. This paper is an attempt to gauge the usefulness of Habermas’ approach to understanding the theory of pupil voice, in particular how his theory of universal pragmatics lends itself to a ‘philosophy of between’, a philosophy that finds echoes in the conflicted nature of schooling that ‘pupil voice’ is supposed to rectify to some extent. The paper also explores the drawbacks of a Habermasian approach, in particular his overreliance on rationality as a way of understanding communication. Lacan’s concept of the objet petit a is introduced as an alternative way of understanding pupil voice. (shrink)

Background This study introduces an empirical approach for studying the role of prudence in physician treatment of end-of-life (EOL) decision making.Methods A mixed-methods analysis of transcripts from 88 simulated patient encounters in a multicenter study on EOL decision making. Physicians in internal medicine, emergency medicine, and critical care medicine were asked to evaluate a decompensating, end-stage cancer patient. Transcripts of the encounters were coded for actor, action, and content to capture the concept of Aristotelian prudence, and then quantitatively and qualitatively (...) analyzed to identify actions associated with preference-concordant treatment.Results Focusing on codes that describe characteristics of physician-patient interaction, the code for physicians restating patient preferences was associated with avoiding intubation. Multiple codes were associated with secondary measures of preference-concordant treatment.Conclusions Prudent actions can be identified empirically, and research focused on the virtue of prudence may provide a new avenue for assessment and training in EOL care. Lisa Bortolotti argues convincingly that opponents of the doxastic view of delusion are committed to unnecessarily stringent standards for belief attribution. Folk psychology recognises many non-rational ways in which beliefs can be caused, and our attributions of delusions may be guided by a sense that delusions are beliefs that we cannot explain in any folk psychological terms.

Introduction. Murder, some may suggest, is to be defined as the intentional and uncoerced killing of the innocent; and it is true by definition that murder is wrong. Yet wars, particularly modern wars, seem to require the killing of the innocent, e.g. through anti-morale terror bombing. Therefore war must be wrong.

We argue that the claim that essence-based causal explanations emerge, hydra-like, from an inherence heuristic is incomplete. No plausible mechanism for the transition from concrete properties, or cues, to essences is provided. Moreover, the fundamental shotgun and storytelling mechanisms of the inherence heuristic are not clearly enough specified to distinguish them, developmentally, from associative or causal networks.

What epistemic defect needs to show up in a skeptical scenario if it is to effectively target some belief? According to the false belief account, the targeted belief must be false in the skeptical scenario. According to the competing ignorance account, the targeted belief must fall short of being knowledge in the skeptical scenario. This paper argues for two claims. The first is that, contrary to what is often assumed, the ignorance account is superior to the false belief account. The (...) second is that the ignorance account ultimately hobbles the skeptic. It does so for two reasons. First, when this account is joined with either a closure-based skeptical argument or a skeptical underdetermination argument, the best the skeptic can do is show that we don’t know that we know. And second, the ignorance account directly implies the maligned KK principle. (shrink)

In this paper, we present a Capabilities -based Approach to the acceptability and the tolerability of risks posed by natural and man-made hazards. We argue that judgments about the acceptability and/or tolerability of such risks should be based on an evaluation of the likely societal impact of potential hazards, defined in terms of the expected changes in the capabilities of individuals. Capabilities refer to the functionings, or valuable doings and beings, individuals are able to achieve given available personal, material, and (...) social resources. The likely impact of a hazard on individuals’ capabilities should, we argue, be compared against two separate thresholds. The first threshold specifies the minimum level of capabilities attainment that is acceptable in principle for individuals to have in the aftermath of a hazard over any period of time. This threshold captures the level that individuals’ capabilities ideally should not fall below. A risk is acceptable if the probability that the attained capabilities will be less than the acceptable level is sufficiently small. In practice, it can be tolerable for some individuals to temporarily fall below the acceptable threshold, provided this situation of lower capabilities attainment is temporary, reversible, and the probability that capabilities will fall below a tolerability threshold is sufficiently small. This second, tolerable threshold delimits an absolute minimum level of capabilities attainment below which no individual in a society should ever fall, regardless of whether that level of capabilities attainment is temporary or reversible. In this paper, we describe and justify this Capabilities -based Approach to the acceptability and tolerability of risks. We argue that the proposed theoretical framework avoids the limitations in current approaches to acceptable risk. The proposed approach focuses the attention of risk analysts directly on what should be our primary concern when judging the acceptability and the tolerability of risks, namely, how risks impact the well-being of individuals in a society. Also, our Capabilities -based Approach offers a transparent, easily communicable way for determining the acceptability and the tolerability of risks. (shrink)

The debate over scientific or critical realism is characterized by confusion, which I claim is a result of approaching the issue from both modern and ‘postmodern’ perspectives. Modern thought is characterized by foundationalism in epistemology and representationalism in philosophy of language, while holism in epistemology and the theory of meaning as use in philosophy of language are postmodern. Typical forms of scientific realism (which seek referents for theoretical terms or correspondence accounts of the truth of scientific theories) are positions at (...) home only in a modern framework. Postmodern presuppositions of other participants in the debate account for the ability of opponents to talk past one another. (shrink)

Professional standards in medicine and psychology treat concurrent sexual relationships with patients as violations of fiduciary trust, and they sometimes rule out sexual relationships even after a clinical relationship is over. These standards also rule out sex with research subjects who are also patients, but what about nonclinical relationships where there are not always parallels to the standards of clinical medicine? One way to treat sex in nonclinical research relationships is to treat it as sex is treated elsewhere among adults, (...) as a matter of individual choice and responsibility. Alternately, one could ask oversight bodies to draw lines between research that can safely accommodate sexual relationships and research that cannot. One could even ask researchers to avoid all concurrent sexual relationships with their research participants, as happens in clinical medicine. Each of these options has drawbacks that undermine its value as a definitive solution. The deficiencies of these options highlight the need for a professional code of conduct for nonclinical researchers. (shrink)

In The Shifting Border, Ayelet Shachar argues that the exercise of sovereign power through border regimes no longer tracks territorial boundaries. In my commentary, I first argue that Shachar’s analysis implicitly calls into question the legitimacy of the international order. I then raise the worry that the logic which severs the link between the exercise of sovereignty and territory is the same logic that can be used to (...) justify injustice and atrocity such as ethnic cleansing. Shachar’s normative proposals do not sufficiently recognize or guard against this risk. (shrink)

The writings of Ian Barbour and Arthur Peacocke can be construed as initial contributions to a Lakatosian research program on the relation between theology and science, the core theory of which is the thesis that theology belongs at the top of a nonreducible hierarchy of sciences. The positive heuristic of this program involves showing that theology and the sciences have enough in common epistemologically to be so related and arguing for nonreducibility. In some areas of clinical medicine, discussions about fertility preservation are routine, such as in the treatment of children and adolescents facing cancer treatments that will destroy their ability to produce gametes of their own. Certain professional organizations now offer guidelines for people who wish to modify their bodies and appearance in regard to sex traits, and these guidelines extend to recommendations about fertility preservation. Since the removal of testicles or ovaries will destroy the ability to have genetically related children (...) later on, it is imperative to counsel transgender people seeking body modifications about fertility preservation options. Fertility preservation with transgender people will, however, lead to unconventional outcomes. If transgender men and women use their ova and sperm, respectively, to have children, they will function as a mother or father in a gametic sense but will function in socially reversed parental identities. There is nothing, however, about fertility preservation with transgender men and women that is objectionable in its motives, practices, or outcomes that would justify closing off these options. In any case, novel reproductive technologies may extend this kind of role reversal in principle to all people, if sperm and ova can be derived from all human beings regardless of sex, as has happened with certain laboratory animals. It is widely accepted that virtuous behaviour ought to be motivated in the right way, done for the right reasons, and an appropriate response to the values manifested in a situation. In this article I describe how cases of individuals having poor understanding of the reasons for their behaviour, can nevertheless be conducive to the development of virtue. One way in which giving reasons for one's own behaviour can be inaccurate is when the reasons given are confabulatory. In confabulation, the (...) reasons given for behaviour are post hoc, do not capture factors which actually brought the behaviour in question about, and are not well supported by evidence. Confabulations protect an individual's positive self-representations at the expense of more accurate appraisals of themselves and the circumstances. However, I argue that engaging in the construction of a positive self-narrative can be efficacious in making it a reality. Importantly, this is only possible when agents have the know-how of certain self-relational skills and attitudes, which are captured in a meta-virtue of self-regulation. When individuals can regulate their values and their behaviour effectively, such that they are in keeping, they can ultimately consistently embody virtues. Confabulation can be, and probably often is, part of this process. (shrink)

In this paper I am merely analysing the meaning of Phaedo 99–107 without discussing either its historical significance or its value as a contribution to the logic of science. The paper attempts in fact to be little more than a paraphrase of the Greek, which aims only at accuracy of statement, but I am adding in the third section a note on the relation of this passage to the discussion of method in Republic VI, mainly in order to minimize its (...) relevance. Presenting a contemporary interpretation of stoicism, the essay draws on Agnes Heller's philosophy of existential choice in order to outline a reconstructed stoic theory of happiness and a pneumatic ethics addressing the context and dynamics of cybernetically structured societies in which vocational (professional) ethics play a declining role.

Responsible innovation is gathering momentum as an academic and policy debate linking science and society. Advocates of RI in research policy argue that scientific research should be opened up at an early stage so that many actors and issues can steer innovation trajectories. If this is done, they suggest, new technologies will be more responsible in different ways, better aligned with what society wants, and mistakes of the past will be avoided. This paper analyses the dynamics of RI in policy (...) and practice and makes recommendations for future development. More specifically, we draw on the theory of ‘trading zones’ developed by Peter Galison and use it to analyse two related processes: the development and inclusion of RI in research policy at the UK’s Engineering and Physical Sciences Research Council ; the implementation of RI in relation to the Stratospheric Particle Injection for Climate Engineering project. Our analysis reveals an RI trading zone comprised of three quasi-autonomous traditions of the research domain – applied science, social science and research policy. It also shows how language and expertise are linking and coordinating these traditions in ways shaped by local conditions and the wider context of research. Building on such insights, we argue that a sensible goal for RI policy and practice at this stage is better local coordination of those involved and we suggest ways how this might be achieved. Terence Cuneo & Jada Twedt Strabbing, Samuel Fleischacker, Jonathan Rutledge & Jordan Wessling, and Sameer Yadav have generously engaged with the accounts of divine holiness and its implications offered in my _Divine Holiness and Divine Action_ (2021), criticizing its arguments and in some cases offering attractive alternative accounts. Here I respond to some of their criticisms.

By analyzing the feminist debates on Hans-Georg Gadamer, the author shows that feminist critics point to the need either to supplement or to replace Gadamer's philosophy with a greater sensitivity to the historical implications of women's experience. Thus, they are of the view either that Gadamer's philosophy has yet to come to terms with specific historical situations or that Gadamer's philosophy cannot come to terms with historical situatedness per se. The author contends that Gadamer's femi-nist critics do not locate the (...) source of his residual transcendentalism where it should be located: in the account of aesthetic judgment as a "pure feeling" that underpins his entire philosophy. This has the effect, of appearing to preserve aesthetic judgment as "pure feeling" as an apparently innocent remedy, to which some of his feminist critics actually appeal in opposition to his transcendentalism. The author argues, to the contrary, that aesthetic judgment, as a "pure feeling," is at once too com-plicit in the tradition that feminists seek to engage with, traditionally too insubstantial to make a rich resource for a feminist critique of that tradition, and ultimately too traditionally male-centered to be easily coopted by a feminist philosopher. Transitional justice refers to the process of dealing with widespread wrongdoing characteristically committed during the course of conflict and/or repression. Examples of such processes include criminal trials, truth commissions, reparations, and memorials. Technology is altering the forms that widespread wrongdoing takes. Technology is also altering the form of processes of transitional justice themselves. This essay provides a map of these changes and their normative implications.

Non-therapeutic research with imminently dying patients in intensive care presents complex ethical issues. The vulnerabilities of the imminently dying, together with societal disquiet around death and dying, contribute to an intuition that such research is beyond the legitimate scope of scientific inquiry. Yet excluding imminently dying patients from research hinders the advancement of medical science to the detriment of future patients. Building on existing ethical guidelines for research, we propose a framework for the ethical design and conduct of research involving (...) the imminently dying. To enable rapid translation to practice, we frame the approach in the form of eight ethical questions that researchers and research ethics committees ought to answer prior to conducting any research with this patient population. (1) Does the study hypothesis require the inclusion of imminently dying patients? (2) Are non-therapeutic risks and burdens minimised consistent with sound scientific design? (3) Are the risks of these procedures no more than minimal risk? (4) Are these non-therapeutic risks justified insofar as they are reasonable in relation to the anticipated benefits of the study? (5) Will valid informed consent be obtained from an authorised surrogate decision maker? (6) How will incidental findings be handled? (7) What additional steps are in place to protect families and significant others of research participants? (8) What additional steps are in place to protect clinical staff and researchers? Several ethical challenges hinder research with imminently dying patients. Nonetheless, provided adequate protections are in place, non-therapeutic research with imminently dying patients is ethically justifiable. Applying our framework to an ongoing study, we demonstrate how our question-driven approach is well suited to guiding investigators and research ethics committees. (shrink)

Some commentators speak freely about genetics being poised to change human nature. Contrary to such rhetoric, Norman Daniels believes no such thing is plausible since ‘nature’ describes characteristic traits of human beings as a whole. Genetic interventions that do their work one individual at a time are unlikely to change the traits of human beings as a class. Even so, one can speculate about ways in which human beings as a whole could be genetically altered, and there is nothing about (...) that venture that could not be deliberated in the way other high-impact questions can be evaluated. There might well come a time when it would be defensible to use genetics to change human beings as a class, in order to protect people in the face of changed environmental circumstances or to enhance existing capacities. Moreover, if one understands human nature not in an empirically descriptive way but in a metaphysical way having implications about human behavior, it can make sense to talk about de-naturing individuals through genetic changes. Even under a metaphysical conception of human nature, however, one can still imagine that people in the future might want to alter their traits in pursuit of another normative idea of a good and valuable life, and genetic modifications might function as a pathway to that change.
