Biomedical and behavioral research may affect strongly held social values and thereby create significant controversy over whether such research should be permitted in the first place. Institutional review boards responsible for protecting the rights and welfare of participants in research are sometimes faced with review of protocols that have significant implications for social policy and the potential for negative social consequences. Although IRB members often raise concerns about potential long-term social implications in protocol review, federal regulations strongly discourage IRBs from (...) considering them in their decisions. Yet IRBs often do consider the social implications of research protocols and sometimes create significant delays in initiating or even prevent such research. The social implications of research are important topics for public scrutiny and professional discussion. This article examines the reasons that the federal regulations preclude IRBs from assessing the social risks of research, and examines alternative approaches that have been used with varying success by national advisory groups to provide such guidance. The article concludes with recommendations for characteristics of a national advisory group that could successfully fulfill this need, including sustainability, independence, diverse and relevant expertise, and public transparency. The use of medical records in research can yield information that is difficult to obtain by other means. When such records are released to investigators in identifiable form, however, substantial privacy and confidentiality risks may be created. These risks become more common and more serious as medical records move to an electronic format. In 1996, the state of Minnesota enacted legislation with respect to consent requirements for the use of medical records in research. This legislation has been widely criticized because—it (...) is claimed—it creates an unnecessary impediment to research. In this article, we show that these arguments rest upon misinterpretation and/or misrepresentation of the 1996 legislation. A consent requirement had actually been present in Minnesota since 1976 (though codified in a patient rights statute rather than a privacy statute). The 1996 law does not require specific consent, as often claimed, but rather only a general authorization. The campaign against the Minnesota legislation appears to have been motivated by concern with respect to the then impending federal privacy rule. The HIPAA rule, as enacted, is in fact less stringent with respect to consent than the Minnesota consent law. On the other hand, the Minnesota consent law has not been effectively applied or enforced. As we change the way we manage sensitive medical information, new efforts are needed to provide protection against the confidentiality risks in research. Patient consent is an important tool in this regard. New instrumentalities are needed to solicit and document consent. (shrink)

No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

Vulnerability is one of the least examined concepts in research ethics. Vulnerability was linked in the Belmont Report to questions of justice in the selection of subjects. Regulations and policy documents regarding the ethical conduct of research have focused on vulnerability in terms of limitations of the capacity to provide informed consent. Other interpretations of vulnerability have emphasized unequal power relationships between politically and economically disadvantaged groups and investigators or sponsors. So many groups are now considered to be vulnerable in (...) the context of research, particularly international research, that the concept has lost force. In addition, classifying groups as vulnerable not only stereotypes them, but also may not reliably protect many individuals from harm. Certain individuals require ongoing protections of the kind already established in law and regulation, but attention must also be focused on characteristics of the research protocol and environment that present ethical challenges. The causal premise of the evolutionary debunking argument contends that human moral beliefs are explained by the process of natural selection. While it is universally acknowledged that such a premise is fundamental to the debunker’s case, the vast majority of philosophers focus instead on the epistemic premise that natural selection does not track moral truth and the resulting skeptical conclusion. Recently, however, some have begun to concentrate on the causal premise. So far, the upshot of this small but growing literature (...) has been that the causal premise is likely false due to the seemingly persuasive evidence that our moral beliefs are in fact not the result of natural selection. In this paper, I argue that this view is mistaken. Specifically, I advocate the Innate Biases Model, which contends that there is not only compelling evidence for an evolved cognitive capacity for acquiring norms but also for the existence of an evolutionarily instilled set of cognitive biases that make it either more or less likely that we adopt certain moral beliefs. How do communities establish shared communication systems? The Common Knowledge view assumes that symbolic conventions develop through the accumulation of common knowledge regarding communication practices among the members of a community. In contrast with this view, it is proposed that coordinated communication emerges a by‐product of local interactions among dyads. A set of multi‐agent computer simulations show that a population of “egocentric” agents can establish and maintain symbolic conventions without common knowledge. In the simulations, convergence to a single conventional system (...) was most likely and most efficient when agents updated their behavior on the basis of local rather than global, system‐level information. The massive feedback and parallelism present in the simulations gave rise to phenomena that are often assumed to result from complex strategic processing on the part of individual agents. The implications of these findings for the development of theories of language use are discussed. (shrink)

In 1963 Niko Tinbergen published a paper, "On Aims and Methods of Ethology," dedicated to his friend Konrad Lorenz. Here Tinbergen defines ethology as "the biological study of behavior," and seeks to demonstrate "the close affinity between Ethology and the rest of Biology." Tinbergen identifies four major areas of ethology: causation, survival value, evolution, and ontogeny. Dale Dorsey considers one of the most fundamental questions in philosophical ethics: to what extent do the demands of morality have normative authority over us and our lives? Must we conform to moral requirements? Most who have addressed this question have treated the normative significance of morality as simply a fact to be explained. But Dorsey argues that this traditional assumption is misguided. According to Dorsey, not only are we not required to conform to moral demands, conforming to morality's (...) demands will not always even be normatively permissible---moral behavior can be wrong. There have been transcripts published of good philosophical discussions by children accompanied with insightful commentary in Analytic Teaching and Thinking: The Journal of Philosophy for Children. Yet before this book, there has not been a comprehensive sampling of such discussions with a commentary that pulls it all together. What makes it even more (...) attractive is that it is written so that the primary focus is places where it should be - namely, on the children's philosophical inquiries as something worthy of the reader's attention for their own sake, rather than on some extrinsic concern such as a theory about children's thinking, a discussion of the Philosophy for Children Program, or a set of philosophical theses that the children just happen to have been exploring.
