This paper is an examination of how research ethics committees have evolved from being advisory committees to more formal regulatory authorities. It is argued that the role of ethics committees should be broader than simple ethical review. Inconsistency in outcome should not be taken to signal failure. Procedural fairness is of the utmost importance. Nor should ethics committees be seen to diminish the ethical responsibilities of researchers themselves.

One of the most significant developments in the area of reproductive health in Ireland is theRoche v. Roche[2009] case. The case concerned a woman who wished to implant cryopreserved embryos made with a former partner, against the partner’s wishes. Of particular interest are questions about the status of the embryo: in Ireland the life of “the unborn” is constitutionally protected. Therefore the courts inRochehad to decide whether embryos were “unborn” within the meaning of the Irish Constitution.

The discovery, in various quarters, of hitherto unknown letters exchanged between Wittgenstein and the chief of his Cambridge friends provides the basis for this new and profoundly revealing collection. Wittgenstein appears in turn shy and affectionate, fierce and censorious, happy to collaborate and sure of his own judgement. Four quarrels and four reconciliations are documented. Wittgenstein's struggles to publish his Tractatus may be followed, as well as his retreat from the world, his being wooed back to philosophy by Keynes and (...) Ramsey, and his plans to leave philosophy. The accompanying editorial notes are based on archival material not previously explored. The Institute Vienna Circle held a conference in Vienna in 2003, Cambridge and Vienna – Frank P. Ramsey and the Vienna Circle, to commemorate the philosophical and scientific work of Frank Plumpton Ramsey (1903–1930). This Ramsey conference provided not only historical and biographical perspectives on one of the most gifted thinkers of the Twentieth Century, but also new impulses for further research on at least some of the topics pioneered by Ramsey, whose interest and potential are greater than ever. Ramsey (...) did pioneering work in several fields, practitioners of which rarely know of his important work in other fields: philosophy of logic and theory of language, foundations of mathematics, mathematics, probability theory, methodology of science, philosophy of psychology, and economics. There was a focus on the one topic which was of strongest mutual concern to Ramsey and the Vienna Circle, namely the question of foundations of mathematics, in particular the status of logicism. Although the major scientific connection linking Ramsey with Austria is his work on logic, to which the Vienna Circle dedicated several meetings, certainly the connection which is of greater general interest concerns Ramsey's visits and discussions with Wittgenstein. Ramsey was the only important thinker to actually visit Wittgenstein during his school-teaching career in Puchberg and Ottertal in the 1920s, in Lower Austria; and later, Ramsey was instrumental in getting Wittgenstein positions at Cambridge. In The legal determinants of health: Harnessing the power of law for global health and sustainable development, Gostin et al. provide a sustained account of how law can and should be used as an instrument of health promotion. We pick up on the themes of this report with a specific focus of the importance of abortion for women’s sexual and reproductive health and the impact that particular ways of framing abortion in law can have on the lives of women and (...) girls. In this short comment, we wish to emphasize that abortion regulations need to move beyond frameworks based on narrow understandings of harm towards more progressive agendas that take into account the social determinants of health in order to reduce barriers to care. This contribution is particularly relevant to the Commission’s criticism that those ‘[l]aws that stigmatise or discriminate against marginalized populations are especially harmful and exacerbate health disparities’. I take as my text propostion 4.0312 of the Tractatus : The possibility of propositions is based on the principle that objects have signs as their representatives. My fundamental idea is that the ‘logical constants’ are not representatives; that there can be no representatives of the logic of facts. Practically the same words occur in Wittgenstein's Notebook for 25 December 1914, where Miss Anscombe translates them: The possibility of the proposition is, of course, founded on the principle of signs as (...) going proxy for objects. Thus in the proposition something has something else as its proxy. But there is also the common cement. My fundamental thought is that the logical constants are not proxies. Stuart Hampshire’s excellent memoir of Waismann in the Proceedings of the British Academy and Anthony Quinton’s introduction to Philosophical Papers give an affectionate portrait of an unworldly scholar alternately seeking to conform to British ways and then shunning them. The idioms and the pronunciation both slightly wrong his English itself witnessed to a profounder alienation. But it was an alienation much more seated in his character and life than that of most of the refugees that so illuminated British university life (...) in the 30’s and 40’s, of whom some indeed became remarkably assimilated. His verificationism is one instance of this, but it is also shown in his treatment of probability (where his ideas were developed further by Waismann). Wittgenstein revived Bolzano's logical interpretation of probability, anticipating Carnap and many moderns. He construed laws of nature as hypotheses that we had to assume. In this article I will show that ‘best interests’ is a concept that fits nicely with many of the features of pragmatism—Holm and Edgar’s rejection of the principle in favour of pragmatism it will be suggested is misplaced. ‘Best interests’ as a principle may be considered an embodiment of the ideals of pragmatic adjudication. The paper starts by briefly introducing the concept of ‘best interests’ and theories of judicial and legal ‘pragmatism’. This article will examine the role of the rational (...) decision-maker in medical law and argue that this role is limited. Friedrich Waismann (1896–1959) was one of the most gifted students and collaborators of Moritz Schlick. Accepted as a discussion partner by Wittgenstein from 1927 on, he functioned as spokesman for the latter’s ideas in the Schlick Circle, until Wittgenstein’s contact with this most faithful interpreter was broken off in 1935 and not renewed when exile took Waismann to Cambridge. Nonetheless, at Oxford, where he went in 1939, and eventually became Reader in Philosophy of Mathematics (changing later to Philosophy of Science), (...) Waismann made important and independent contributions to analytic philosophy and philosophy of science (for example in relation to probability, causality and linguistic analysis). The full extent of these only became evident later when the larger (unpublished) part of his writings could be studied. His first posthumous work The Principles of Linguistic Philosophy (1965, 2nd edn.1997; German 1976) and his earlier Einführung in das mathematische Denken (1936) have recently proved of fresh interest to the scientific community. This late flowering and new understanding of Waismann’s position is connected with the fact that he somewhat unfairly fell under the shadow of Wittgenstein, his mentor and predecessor. Central to this book about a life and work familiar to few is unpublished and unknown works on causality and probability. Picking up the question of what FLaK might be, this editorial considers the relationship between openness and closure in feminist legal studies. How do we draw on feminist struggles for openness in common resources, from security to knowledge, as we inhabit a compromised space in commercial publishing? We think about this first in relation to the content of this issue: on image-based abuse continuums, asylum struggles, trials of protestors, customary justice, and not-so-timely reparations. Our thoughts take us through the different (...) ways that openness and closure work in struggles against violence, cruel welcomes, and re-arrangements of code and custom. Secondly, we share some reflections on methodological openness and closure as the roundtable conversation on asylum, and the interview with Riles, remind us of #FLaK2016 and its method of scattering sources as we think about how best to mix knowledges. Thirdly, prompted by the FLaK kitchen table conversations on openness, publishing and ‘getting the word out’, we respond to Kember’s call to ‘open up open access’. We explain the different current arrangements for opening up FLS content and how green open access, the sharedit initiative, author request and publisher discretion present alternatives to gold open access. Finally drawing on Franklin and Spade, we show how there are a range of ‘wench tactics’—adapting gifts, stalling and resting—which we deploy as academic editors who are trying to have an impact on the access, use and circulation of our journal, even though we do not own the journal we edit. These wench tactics are alternatives to the more obvious or reported tactic of resignation, or withdrawing academic labour from editing and reviewing altogether. They help us think about brewing editorial time, what ambivalence over our 25th birthday might mean, and how to inhabit painful places. In this, we respond in our own impure, compromised way to da Silva’s call not to forget the native and slave as we do FLaK, and repurpose shrapnel, in our common commitments. (shrink)

The problem of causality is one of the central topics of Hume’s philosophy. There are several reasons for its importance: Of all the relations it is the only one in virtue of which we can pass beyond the immediate impression of the senses or an idea of the memory and thus step outside the realm of the given. The only relation “that can be trac’d beyond our senses, and informs us of existences and objects, which we do not see or (...) feel, is causation.” It is a relation which underlies our belief in an external world. To quote another passage from the Treatise: “We readily suppose an object may continue individually the same, tho’ several times absent and present to the senses; and ascribe to it an identity, notwithstanding the interruption of the perception, whenever we conclude, that if we had kept our eye or hand constantly upon it, it would have convey’d an invariable and uninterrupted perception. This article seeks to examine Rorty's contention that literary narrative, not political philosophy, is best able to address the problems of the West. It argues that although Rorty's conception of the novel as a valu able and informative medium is credible, he does not establish it as a valid alternative to political philosophy. Moreover Rorty retains the sort of reasoning that is characteristic of political philosophy, despite his assertions to the contrary.
