Picking up the question of what FLaK might be, this editorial considers the relationship between openness and closure in feminist legal studies. How do we draw on feminist struggles for openness in common resources, from security to knowledge, as we inhabit a compromised space in commercial publishing? We think about this first in relation to the content of this issue: on image-based abuse continuums, asylum struggles, trials of protestors, customary justice, and not-so-timely reparations. Our thoughts take us through the different (...) ways that openness and closure work in struggles against violence, cruel welcomes, and re-arrangements of code and custom. Secondly, we share some reflections on methodological openness and closure as the roundtable conversation on asylum, and the interview with Riles, remind us of #FLaK2016 and its method of scattering sources as we think about how best to mix knowledges. Thirdly, prompted by the FLaK kitchen table conversations on openness, publishing and ‘getting the word out’, we respond to Kember’s call to ‘open up open access’. We explain the different current arrangements for opening up FLS content and how green open access, the sharedit initiative, author request and publisher discretion present alternatives to gold open access. Finally drawing on Franklin and Spade, we show how there are a range of ‘wench tactics’—adapting gifts, stalling and resting—which we deploy as academic editors who are trying to have an impact on the access, use and circulation of our journal, even though we do not own the journal we edit. These wench tactics are alternatives to the more obvious or reported tactic of resignation, or withdrawing academic labour from editing and reviewing altogether. They help us think about brewing editorial time, what ambivalence over our 25th birthday might mean, and how to inhabit painful places. In this, we respond in our own impure, compromised way to da Silva’s call not to forget the native and slave as we do FLaK, and repurpose shrapnel, in our common commitments. (shrink)

David Fairweather Foxon, a Fellow of the British Academy, published English Verse 1701–1750: a Catalogue, a book that not only took a long leap forward into a new century; it also provided a cross-section through the record of all British books and books printed abroad in English in a period in which the total number of books, periodicals, and ephemera began to increase exponentially. The period was also one in which the whole concept of authorship and the relationship between author (...) and the book trade changed substantially, as a result of the Copyright Act. Foxon was born in Paignton, the son of a Methodist minister. Bletchley Park was a crucial experience for him, socially and intellectually. He met a variety of gifted academics, some eccentric, mostly from Oxford or Cambridge, at an early age; it gave him training in codebreaking; and it introduced him to his future wife. Foxon was involved in the recataloguing of the British Museum Library, a gigantic undertaking that had begun in 1929. (shrink)

This article considers the transgressive and transformative possibilities in the sexual silences of the U.K.’s Civil Partnership Act 2004. The absence of a consummation requirement and adultery as a specific ground of dissolution do open up some possibilities but are not unproblematic. These issues are explored in the context of the England and Wales Law Commission’s apparent ‘return’ to a conjugal model in its forthcoming consultation on cohabitation. It is concluded that though the Act may open up possibilities for expanding (...) the legal recognition of relationships beyond those that are sexual, this raises concerns about the further privatisation of care as well as increased state intervention in relationships. Instead, I argue that the purpose and function of relationship recognition should be deconstructed and separated from ideology and romantic mythology about what families and relationships are and should be. If it does wed itself so closely to the conjugal marriage model in the consultation document, the Law Commission will miss a valuable opportunity to ask important questions about the purpose and function of relationship recognition. Tragedy and Citizenship provides a wide-ranging exploration of attitudes toward tragedy and their implications for politics. Derek W. M. Barker reads the history of political thought as a contest between the tragic view of politics that accepts conflict and uncertainty, and an optimistic perspective that sees conflict as self-dissolving. The view that it is better for life to be created free of disability is pervasive in both common sense and philosophy. We cast doubt on this view by focusing on an influential line of thinking that manifests it. That thinking begins with a widely-discussed principle, Procreative Beneficence, and draws conclusions about parental choice and disability. After reconstructing two versions of this argument, we critique the first by exploring the relationship between different understandings of well-being and disability, and the second (...) by more briefly focusing on the idea of a significant reason. By placing these results against the broader historical and ongoing contexts in which the lives of those with disabilities have been deemed of inferior quality, we conclude with a call for greater humility about disability and well-being in thought and practice. In this article, we argue that the monist, who answers ‘one object’, cannot accommodate the asymmetry of material constitution. To say ‘the mass of gold materially constitutes the sculpture, whereas the sculpture does not materially constitute the mass of gold’, the monist must treat ‘materially constitutes’ as an Abelardian predicate, whose denotation is sensitive to the linguistic context in which it appears. We motivate (...) this approach in terms of modal analyses of material constitution, but argue that ultimately it fails. The monist must instead accept a deflationary, symmetrical use of ‘materially constitutes’. We argue that this is a serious cost for her approach. (shrink)

We argue that in contemporary business organizations, in which fundamental purpose is construed to be increased value—especially in ‘participative’ organizations, in which non–hierarchal interaction (for example, work teams) is the norm; and in ‘adaptive’ organizations, in which unpredictable change is the rule—a process of values covenanting will be much more valueable than just espoused values or even values covenants. We propose such a process model for organizational values covenanting and argue that such covenanting reflects an anthropomorphism of the human character (...) development process, validated in terms of the theory of viable systems. Living things are often plastic during their early development and are moulded by the environment. Many human fetuses have to adapt to a limited supply of nutrients, and in doing so they permanently change their physiology and metabolism. These programmed changes may be the origins of a number of diseases in later life, including coronary heart disease, stroke, diabetes and hypertension.

Taste as Experience puts the pleasure of food at the center of human experience. It shows how the sense of taste informs our preferences for and relationship to nature, pushes us toward ethical practices of consumption, and impresses upon us the importance of aesthetics. Eating is often dismissed as a necessary aspect of survival, and our personal enjoyment of food is considered a quirk. Nicola Perullo sees food as the only portion of the world we take in on a (...) daily basis, constituting our first and most significant encounter with the earth. Perullo has long observed people's food practices and has listened to their food experiences. He draws on years of research to explain the complex meanings behind our food choices and the thinking that accompanies our gustatory actions. He also considers our indifference toward food as a force influencing us as much as engagement. For Perullo, taste is value and wisdom. It cannot be reduced to mere chemical or cultural factors but embodies the quality and quantity of our earthly experience. (shrink)

This book is the first extensive treatment of Husserl's phenomenology of time-consciousness. Nicolas de Warren uses detailed analysis of texts by Husserl, some only recently published in German, to examine Husserl's treatment of time-consciousness and its significance for his conception of subjectivity. He traces the development of Husserl's thinking on the problem of time from Franz Brentano's descriptive psychology, and situates it in the framework of his transcendental project as a whole. Some time ago, the editors of Monthly Review invited me to submit a short review of two recent books by Ellen Wood: The Pristine Culture of Capitalism, and Democracy Against Capitalism. I found myself, in the course of re-reading these books, filled with admiration for most of what the author said, and indeed, for the manner in which she presented her case. Given the increasing need for solid organ and tissue transplants and the decreasing supply of suitable allographic organs and tissue to meet this need, it is understandable that the hope for successful xenotransplantation has resurfaced in recent years. The biomedical obstacles to xenotransplantation encountered in previous attempts could be mitigated or overcome by developments in immunosuppression and especially by genetic manipulation of organ source animals. In this essay we consider the history of xenotransplantation, discuss the biomedical obstacles to success, explore (...) recent developments in transgenic sourcing of organs and tissues, and analyze the problem of infectious disease resulting from xenotransplantation (xenosis). We then apply a model of risk analysis to these risks. The conclusions of this risk analysis are used in an ethical evaluation of informed consent in xenotransplantation, with an ethical foundation in Kantian autonomy and Levinasian heteronomic alterity. Our conclusion is that individual and collective informed consent to the infectious disease risks of xenotransplantation requires an open, participatory and dialogical public policy process not yet seen in the United States and Europe. Until that process is created, we propose caution in xenotransplantation in general and a postponement of solid organ xenotransplants in particular. (shrink)

Quantum physics, which offers an explanation of the world on the smallest scale, has fundamental implications that pose a serious challenge to ordinary logic. Particularly counterintuitive is the notion of entanglement, which has been explored for the past 30 years and posits an ubiquitous randomness capable of manifesting itself simultaneously in more than one place. This amazing 'non-locality' is more than just an abstract curiosity or paradox: it has entirely down-to-earth applications in cryptography, serving for example to protect financial information; (...) it also has enabled the demonstration of 'quantum teleportation', whose infinite possibilities even science-fiction writers can scarcely imagine. This delightful and concise exposition does not avoid the deep logical difficulties of quantum physics, but gives the reader the insights needed to appreciate them. Negative facts get a bad press. One reason for this is that it is not clear what negative facts are. We provide a theory of negative facts on which they are no stranger than positive atomic facts. We show that none of the usual arguments hold water against this account. Negative facts exist in the usual sense of existence and conform to an acceptable Eleatic principle. Furthermore, there are good reasons to want them around, including their roles in causation, chance-making (...) and truth-making, and in constituting holes and edges. (shrink)

This volume presents new work in history and historiography to the increasingly broad audience for studies of the history and philosophy of science. These essays are linked by a concern to understand the context of early modern science in its own context.

In the historical context of a crisis in biological psychiatry, psychedelic drugs paired with psychotherapy are globally re-emerging in research clinics as a potential transdiagnostic therapy for treating mood disorders, addictions, and other forms of psychological distress. The treatments are poised to soon shift from clinical trials to widespread service delivery in places like Australia, North America, and Europe, which has prompted ethical questions by social scientists and bioethicists. Taking a broader view, we argue that the ethics of psychedelic therapy (...) concerns not simply how psychotherapies are different when paired with psychedelic drugs, but how psychedelic therapies shape and are shaped by different values, norms, and metaphysical commitments. Drawing from the published literature and interviews with seven psychedelic therapists working in clinical trials in the United States, Germany, Switzerland, and Australia, this article opens the black box of the treatments to consider the values and informal debates currently animating the therapies. Considering questions of patient autonomy, mechanisms of therapeutic action, and which therapies are best suited to pair with psychedelic substances, we examine the ethics of psychedelic therapy as an emergent form of life. To bring this form of life out in fuller relief, we conclude by comparing and contrasting it with ayahuasca use in Amazonian shamanism. (shrink)

This paper addresses the application of the ethical concept of trust and the legal and political concept of public trust to population genomics projects in Iceland, Estonia, and Tonga. Focusing on trust and public trust, the paper explores analogies between the genomics projects and the treatment of other common-pool resources, making use of the notion of trust as an ethical demand, derived from the works of Emmanuel Levinas and Knud Eljer Lgstrup. Essentialism is widely regarded as a mistaken view of biological kinds, such as species. After recounting why (sections 2-3), we provide a brief survey of the chief responses to the “death of essentialism” in the philosophy of biology (section 4). We then develop one of these responses, the claim that biological kinds are homeostatic property clusters (sections 5-6) illustrating this view with several novel examples (section 7). Although this view was first expressed 20 years ago, and has received recent discussion (...) and critique, it remains underdeveloped and is often misrepresented by its critics (section 8). (shrink)

Within recent feminist philosophy, controversy has developed over the desirability, and indeed, the possibility of defining the central terms of its analysis-"woman," "femininity," etc. The controversy results largely from the undertheorization of the notion of definition; feminists have uncritically adopted an Aristotelian treatment of definition as entailing metaphysical, rather than merely linguistic, commitments. A "discursive" approach to definition, by contrast, allows us to define our terms, while avoiding the dangers of essentialism and universalism.

This paper concerns virtue-based ethical principles that bear upon agricultural uses of technologies, such as GM crops and CRISPR crops. It does three things. First, it argues for a new type of virtue ethics approach to such cases. Typical virtue ethics principles are vague and unspecific. These are sometimes useful, but we show how to supplement them with more specific virtue ethics principles that are useful to people working in specific applied domains, where morally relevant domain-specific conditions recur. We do (...) this while still fulfilling the need for principles and associated practical reasoning to flexibly respect variation between cases. Second, with our more detailed approach we criticize and improve upon a commonly discussed principle about ecosystemic external goods that are crucial for human flourishing. We show this principle is far more conservative than appreciated, as it would prohibit many technology uses that are uncontroversially acceptable. We then replace this principle with two more specific ones. One identifies specific conditions in which ecosystem considerations are against a technology use, the other identifies favorable conditions. Third, we uncover a humility-based principle that operates within an influential “hubris argument” against uses of several biotechnologies in agriculture. These arguments lack a substantive theory of the nature of humility. We clarify such a theory, and then use it to replace the uncovered humility-based principle with our own more specific one that shifts focus from past moral failings, to current epistemic limits when deciding whether to support new technologies. Therefore, in Methexiology: Philosophical Theology and Theological Philosophy for the Deification of Humanity, Nicolas Laos elucidates the significance of methexiology for the study of ontology, epistemology, ethics, philosophical psychology, theory of justice, philosophy of history, and philosophy of religion. Laos argues that, faced with the modern and the postmodern crises of meaning, we need a new myth, a new spiritual formula, for the resacralization of humanity and the cosmos, (...) without restoring defunct totems, without using tales as "cheap" substitutes for the lack of a life-giving myth, and without negating history. In his Methexiology, Laos studies the "genealogy" of the modern and the postmodern crises of meaning, and, based on his new interpretation of classical Greek philosophy and Hesychasm, proposes methexiology as a way of overcoming the crises of meaning and as a way of resacralizing humanity and the cosmos through a new metaphysically grounded humanism. Mais comment vont se nouer l'ordre de l'esprit et celui de la (...) charité? Pascal produit ainsi une analyse critique de la philosophie comme telle, de ses capacités et de ses limites, que le présent ouvrage se donne pour tâche de clarifier. Que peut la philosophie? Mais qui décide de ce qu'elle peut, et surtout de ce qu'elle ne peut pas? Comment s'établissent alors ses rapports avec la théologie? Ce que Pascal nous invite ainsi à penser, c'est toujours à la fois la misère et la grandeur de la philosophie. (shrink)

Car le problème de la vie philosophique a été posé dans toute sa radicalité dans l'Antiquité ; il n'était pas complètement oublié à l'époque moderne, comme en témoigne l'oeuvre de Spinoza ; mais à partir du moment "où la philosophie est devenue un métier de professeur, c'est-à-dire au début du XIXème siècle", elle a évacué du champ des problèmes pertinents, des problèmes "sérieux", cela même qui pourtant lui avait donné son horizon et sa raison d'être : la possibilité de définir une vie philosophique, c'est-à-dire une vie juste, une vie bonne, une "vraie vie". This book advances a new interpretation of Hart's penal philosophy. Positioning itself in opposition to current interpretations, the book argues that Hart does not defend a mixed theory of punishment, nor a rule-utilitarian theory of punishment, nor a liberal form of utilitarianism, nor a goal and constraint approach. Rather, it is argued, his penal philosophy is based on his moral pluralism, which comprises two aspects: value pluralism and pluralism with respect to forms of moral reason. It is held that this (...) means, on the one hand, that criminal law has an irreducible complexity due to the compromises it makes to accommodate competing values, and on the other hand, that there need not be one single justification of punishment. This original interpretation is not based only on Hart's key volume on the subject Punishment and Responsibility, but on a careful reading of his complete works. The book will be a valuable resource for academics and researchers interested in Hart's philosophy, the philosophy of law and criminal law. (shrink)

Durch alle in diesem Band versammelten Arbeiten wird der Einfluss der Philosophie des Aristoteles auf das Leibniz’sche Denken näher umrissen. Ein wesentliches Ziel ist es hierbei, einen Beitrag zur Analyse dieser philosophischen Beziehung zu leisten und zu zeigen, dass auch Aristoteles’ Philosophie nach Ansicht unserer Autoren entscheidend zum Verständnis des Leibniz’schen Denkens beiträgt. Die Texte befassen sich mit wesentlichen Themen der Leibniz’schen Logik und Metaphysik, z. B. mit den (...) In this context a fundamental aim is to contribute to the analysis of this philosophical relationship and to demonstrate that Aristotle’s philosophy, in the opinion of our authors, plays a decisive role in the understanding of Leibniz’s thought. The texts address fundamental themes of Leibniz’s logic and metaphysics, e.g. the basic concepts of ‘monads’ (and their ‘corporality’), ‘entelechy’ and ‘nous; the problem of individuation (individual, atomism, unity); substantial forms; knowledge in general, and technology; the transformation of logic; principles (namely those of sufficient grounds, of individuation and of necesssity); future and contingency and transientness; the theory of syllogistic deduction, etc. These themes are regularly considered in the comparison between Leibniz and Aristotle – they demonstrate how Leibniz took over, treated or criticised Aristotelian theses.
