Subjects enrolled in studies testing high risk interventions for incurable or progressive brain diseases may be vulnerable to deficiencies in informed consent, such as the therapeutic misconception. However, the definition and measurement of the therapeutic misconception is a subject of continuing debate. Our qualitative pilot study of persons enrolled in a phase I trial of gene transfer for Parkinson disease suggests potential avenues for both measuring and preventing the therapeutic misconception. Building on earlier literature on the topic, we developed and (...) tested an interview guide that focuses on how the subjects decided to participate, emphasizing the integration of subjects’ various statements that are relevant to assessing the therapeutic misconception, rather than evaluating them as isolated statements. The results indicate that a subject’s understanding of the purpose of research is best explored in juxtaposition to the subject’s motivation for participating. (shrink)

Bioethicists have long been concerned that seriously ill patients entering early phase (‘phase I’) treatment trials are motivated by therapeutic benefit even though the likelihood of benefit is low. In spite of these concerns, consent forms for phase I studies involving seriously ill patients generally employ indeterminate benefit statements rather than unambiguous statements of unlikely benefit. This seeming mismatch between attitudes and actions suggests a need to better understand research ethics committee members’ attitudes toward communication of potential benefits and risks (...) of early phase studies to potential subjects. We surveyed the members of two U.S. research ethics committees using a phase I gene transfer study scenario, and compared the results to a previous survey of potential subjects’ perceptions and attitudes toward benefit and risk for the same protocol. The results show that there is indeed a gap between the subjects’ perceptions and the committee members’ views on what is appropriate to be communicated to research subjects. This discrepancy is the product of both the commonly assumed optimism of the subjects and to a “protective pessimism” of the research ethics committee members. We discuss this discrepancy using “frameworks of trust” and demonstrate the need to incorporate these frameworks into the existing model of informed consent. (shrink)

Nursing Inquiry 2011; 18: 40–49 Valued identities and deficit identities: Wellness Recovery Action Planning and self-management in mental healthWellness Recovery Action Planning (WRAP) is a self-management programme for people with mental illnesses developed by a mental health consumer, and rooted in the values of the ‘recovery’ movement. The WRAP is noteworthy for its construction of a health identity which is individualised, responsibilised, and grounded in an ‘at risk’ subjectivity; success with this programme requires (...) development of an intensely focused health lifestyle. We draw on Bourdieu and Giddens to argue that what is being developed is a ‘reflexive health habitus’, which is not equally accessible to all social groups, and is in tension with WRAP’s recovery-orientated aims. However, it is understandable that such a programme developed in mental health, because people with mental illness are highly stigmatised as ‘a risk’ and viewed as in need of risk management. By developing their own form of self-monitoring ‘at risk’ identity, mental health consumers are, paradoxically, able to construct themselves as ideal health citizens and no longer a risk, thus re-entering the moral community. We conclude by suggesting some changes to WRAP practice. (shrink)

This article interrogates postmodern and Levinasian conceptions of ethics with recourse to Quentin Tarantino's Reservoir Dogs and certain psychoanalytical concepts formulated in Jacques Lacan's Ethics of Psychoanalysis. Since Levinas, ethical thinking has, in some quarters, moved away from conventional questions about moral agency, rights and social justice, on to a concern towards the ultimate unknowability of `the other'. Ethics depends, for Levinas, on an unpredictable, accidental encounter with something Other, that, in its singularity, demands a response; it is precisely the (...) contingency of the encounter that constitutes the ethical difference from the realm of morality and law. Tarantino's movie narratives are also structured around accidents, disclosing the pain and jouissance of accidental expenditures that lie at the heart of any relation to the Other. In the midst of trauma, the Thing emerges, around which goods and signification circulate, that both delimits the identification of the Good and marks a space beyond moral law that becomes the site of radical ethical questioning. The previous edition, published in 1914, was based on a manuscript from which the text for the years 1357 to 1364 was missing. Abstract: When things go badly, we notice that something is amiss, figure out what went wrong and why, and attempt to repair the problem. Artificial systems depend on their human designers to program in responses to every eventuality and therefore typically don’t even notice when things go wrong, following their programming over the proverbial, and in some cases literal, cliff. This article describes our work on the Meta-Cognitive Loop, a domain-general approach to giving artificial systems the ability to notice, assess, (...) and repair problems. This paper argues that professionals who make boundary-related decisions should be guided by relationship-based practice. In our roles as service users and professionals, drawing from our lived experiences of professional relationships, we argue we need to move away from distance-based practice. This includes understanding the boundary stories and narratives that exist for all of us – including the people we support, other professionals, as well as the organisations and systems within which we work. When we are dealing with professional boundary (...) issues, we should centre relationship-building skills that are central to many other aspects of our work. Skills that foster relationships at all levels – between professionals, service users, and services – need to be revalued. Our final recommendation is to create, develop, and foster safer spaces within and outside of organisations, as well as inter-professionally, for the discussion and exploration of boundary-related issues and practice. We are interested in hearing from those with experiences of being marginalised by boundaries so that they can inform a reshaping of our collective ideas around boundary related practices. To foster relationship-based practices in organisations, we have outlined several recommendations here; however, we recognize that these do not go far enough, and that collective action is needed to inform systemic change. The form of Western mainstream film is the crux of its ideological efficiency: by using established formal techniques, films ensure audiences un- derstand that aesthetic decisions support and clarify the narrative to ensure maximum spectatorial satisfaction. However, some films exploit their formal aesthetics in order to prevent clarification, thwarting satisfaction in favour of viewing practices that can be considered perverse in that they withhold, suspend or obstruct immediate pleasure. Contemporary Western filmmaking in the mid-1990s witnessed the emergence of a distinct (...) group of filmmakers and films that, in the popular discourse of cinematic criticism, were together coded as “difficult” or “perverse.” These films were, as a result of the characteristics we identify below, situated obliquely in relation to the larger economic and artistic struc- tures of a commercially oriented “mainstream” cinema. Included in this new form of cinematic production were films from directors such as Tim Burton: Edward Scissorhands ; David Cronenberg: eXistenZ ; David Fincher: Se7en ; Peter Greenaway: The Baby of Maçon ; David Lynch: Lost Highway ; Quentin Tarantino: Pulp Fiction and Lars von Trier: Breaking the Waves . Whilst Western cinema as a whole has a long history of exploring “difficult” or “perverse” material within the overt or covert content of narrative, plot and story, such films demonstrate a particular relationship between the content being explored and the specific formal characteristics utilised in the delivery of that content. Thus where previous examples would utilise standardised formal techniques as a way of both delivering and containing the difficult or objectionable material, the films instead offer instances where the material of the narrative content seems to bleed backwards, affecting the form and rendering the very materiality of the film itself suspect and problematic. Many philosophers have argued against Singer’s claim that all animals are equal. However, none of these responses have demonstrated an appreciation of the complexity of his position. The result is that all of these responses focus on one of his arguments in a way that falls victim to another. This paper is a critical examination of a possible response to the full complexity of Singer’s position that derives from the work of Carl Cohen, Kathleen Wilkes, and F. Ramsey. On this (...) response, a being’s moral status depends not on the capacities and abilities she does in fact have, but instead on the capacities and abilities normal for the members of her species. However, this response is ultimately unacceptable, for it depends on a faulty conception of loss and misfortune and its underlying moral principle is irrational at best and morally objectionable at worst. The failure of even this response to Singer gives us good reason to conclude with Singer that all animals are equal. (shrink)

This article takes its point of departure from late Lacan's meditations on the incompatibility of psychoanalysis with Japanese culture due to its non-European linguistic basis. The article argues that this emphasis on language narrowly conceived fails to keep pace with the interconnected, multi-media, all-encompassing nature of the unconscious today. Illustrating this point, the article focuses on the figure of the hikikomori: middle-class Japanese youths who have withdrawn from all conventional social contact to indulge exclusively computer-based interactions. Thanks to the overlap (...) with the related figure of the ‘Bedroom DJ’, the analysis then moves on to the ambient music of Richard D. James, aka Aphex Twin. It argues for the validity of the concept of an ‘audio unconscious’ distinct from Lacan's unconscious ‘structured like a language’. The final part of the article, however, examines one of James's music videos and discerns in it modes of jouissance that psychoanalysis can still describe. (shrink)

China’s state has responded to pressure from civil society with regulations to limit civil society organizations’ contentiousness and ties to international groups, restricted access to the courts, and creation of GONGOs to vie with grassroots organizations over leadership of civil society. Against liberal theories of civil society, the author argues for a Gramscian model of civil society in which the state takes (...) an active role in constructing its hegemony in civil society. In order to re-assess the utility of Shakespeare’s Hamlet to contemporary problems such as depression – perhaps the dominant symptom of our time – this essay attempts a reconsideration of Jacques Lacan’s famous seminar on Hamlet from the perspective of the contemporary clinic of the Lacanian orientation in psychoanalysis led by Jacques-Alain Miller. Commenting on the role of psychoanalysis at the time of the posthuman, Véronique Voruz notes dryly that “posthumanismposthumanism is a discourse that brings people together in a conversation where nobody knows what the other is saying, but everyone believes they understand each other to a sufficient degree for a conversation to take place”. “Posthumanismposthumanism” is both symptom and signifiersignifier and thus organizes a social bondsocial bond, at least between academics where the jouissancejouissance or pleasure of discourse compensates for the lacklack (...) of meaning. This is both fortunate and ironic because one of the features of posthumanismposthumanism is precisely the decline and even absence of traditional forms of social bondsocial bond, that is to say those organized by signifiers. In this era of planetary-scale technology, the social bondsocial bond is pre-eminently mediated by objects organized in informationinformation networks. The posthuman “internet of things” provides the paradigm of communicationcommunication in which everything is “chipped” and rendered equivalent: humans, animalsanimal and machines. All are objects that relay readable datadata leaving open the question of whether there is another face to these objects that is unreadable, and whose register therefore in psychoanalytic terms would not be meaning but jouissancejouissance. This thesis is a constructive work in the tradition of morality. The thesis divides into three parts. Part One argues that morality is best considered as a tradition (in MacIntyre’s sense) in ethical thinking which begins with the Stoics, develops in Christian thought and reaches its apotheosis in Kant. This tradition structures ethical thinking around three basic concepts: cosmopolitanism, or universal applicability to human beings as such, the dignity of human beings and reciprocity. It is this tradition in ethical thinking (...) which Nietzsche sets out to destroy. Part One then critiques conceptions of morality which take it that universal and exceptionless rules form the core of morality: it criticises both the possibility of putting forward an adequate set of such rules and the proposed relationship between morality and human life that is implicit in these accounts. Part Two begins with Nietzsche’s challenge: that morality is a system of values rooted in nihilistic resentment at the vitality of other, stronger modes of living. It argues that this challenge must be taken seriously, and that the best way to do this is to make it clear that morality has as its fundamental basis a responsiveness to the value of human life; hence it is Nietzsche’s ethics that should be called nihilistic. The rest of Part Two examines the possibility of answering Nietzsche’s challenge by demonstrating a necessary connection between human selfhood and the acknowledgement of the dignity of human beings. Here I argue that neither Christine Korsgaard’s neo-Kantian arguments nor Charles Taylor’s phenomenologically based approach can provide a convincing reason for thinking that there is such a necessary connection. Part Three turns towards pragmatism, and in so doing gives up on the attempt to show that morality is somehow necessary for all human beings. Nietzsche’s challenge is answered more subtly: an empirically backed theory of human selfhood explains the point of morality in terms of our basic need for recognition. I complete the reconstruction of morality by reinterpreting the dignity of human beings in a naturalistic way and adopting a conception of moral rules that is informed by Jürgen Habermas’ discourse ethics. Most philosophy professors want to help their students improve their writing, but determining a good way to do so is not easy. Requiring students to write rough drafts is a good start, but the extra work these require can overload already busy professors. In this article I describe and defend the use of peer-review assignments as a way of improving undergraduate writing. This essay reads Deleuze and Guattari's Anti‐Oedipus, somewhat perversely, as a radical Lacanian means of conceptualizing hypermodern capitalism. If, as Deleuze and Guattari argue, it is psychoanalysis that rediscovers and retraces the death instinct in classical, nineteenth‐century capitalism, Deleuze and Guattari's schizoanalysis better exemplifies the ways in which the deterritorializing flows of twenty‐frrst‐century global capitalism have overcoded and overwritten that classical, nineteenth‐century order of things. Taking Bret Easton Ellis's novel, American Psycho as its symptomatic text, this essay discusses the implications, (...) raised hysterically in the novel, of an unrestricted economy in which the ‘subject’ is no longer held in place by a governing (master or paternal) signifier in relation to a traditional symbolic order. The essay shows how Lacan's notion of ‘the Other’ has been reconfigured, in relation to consumer capitalism, such that it takes the form of a purely machinic imperative that turns the subject into an economically dividuated producing/product. The subject has become a little machine hooked up to the big machine that maintains it in debt in a continual process of consumption‐production of commodities, brands and identities. (shrink)

The promotion of the self‐managing capacities of people has become a marker of contemporary mental health practice, yet self‐management remains a largely uncontested construct in mental health settings. This discourse analysis based upon the work of Foucault investigates self‐management practices for bipolar disorder and their action upon how a person with bipolar disorder comes to think of who they are and how they should live. Using Foucault's framework for exploring the ethical self and transcripts of interviews with people living with (...) bipolar disorder, this discourse analysis finds that the discursive practices of self‐management for bipolar disorder are prescribing a restricted regime for living based upon the quintessential neo‐liberal subject using practices that are focused upon managing an unreliable and problematic self. The article concludes with the proposition that the problem of bipolar disorder (for which self‐management is an answer) is less about the object itself and more about how we construct the nature of the self. A Māori indigenous ontology is used here as an example of an alternative discursive resource through which people make sense of the self and which allows ways of thinking about self‐management that engage with ambivalence and ambiguity rather than restriction and regulation. Peer review is a widely accepted instrument for raising the quality of science. Peer review limits the enormous unstructured influx of information and the sheer amount of dubious data, which in its absence would plunge science into chaos. In particular, peer review offers the benefit of eliminating papers that suffer from poor craftsmanship or methodological shortcomings, especially in the experimental sciences. However, we believe that peer review is not always appropriate for the evaluation of controversial hypothetical science. We argue that (...) the process of peer review can be prone to bias towards ideas that affirm the prior convictions of reviewers and against innovation and radical new ideas. Innovative hypotheses are thus highly vulnerable to being “filtered out” or made to accord with conventional wisdom by the peer review process. Consequently, having introduced peer review, the Elsevier journal Medical Hypotheses may be unable to continue its tradition as a radical journal allowing discussion of improbable or unconventional ideas. Hence we conclude by asking the publisher to consider re-introducing the system of editorial review to Medical Hypotheses. (shrink)
