En este capítulo se analiza la figura de la obtención vegetal: su alcance, dimensión, requisitos y caracterización frente a otros derechos de propiedad intelectual, para así abordar su ámbito de protección y su tratamiento en el ámbito internacional. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Con lo anterior se lleva a cabo un singular esfuerzo para tratar de forma comprensiva este asunto, buscando la primacía del consentimiento libre, previo e informado de las comunidades potencialmente afectadas. Casi todo lo que nos rodea implica riesgos de algún tipo, aunque no obstante es la cultura del riesgo la que ha coadyuvado al progreso y el desarrollo de la sociedad. El principio de precaución que no es ajeno a esta realidad, responde a la incertidumbre del riesgo, sin limitarse a expresar una actitud subjetiva del miedo. Es, un medio eficaz para la protección, en todo momento y de manera oportuna, de los recursos naturales, para así alcanzar el fin de (...) las normas ambientales. Este libro colectivo constituye a través de una juiciosa recopilación de experiencias de derecho comparado, y de un diálogo en torno a las tensiones que se dan, un llamado de atención para repensar el principio de precaución. El tratamiento de estas cuestiones por parte de los autores, tuvo por norte el equilibrio entre el desarrollo de la sociedad y la salvaguarda de los derechos que podrían afectarse por una situación de riesgo inminente; siempre de cara a la rigurosidad exigida por la ciencia. Esta obra permite al lector contar con valiosas herramientas para realizar una evaluación amplia del alcance actual del principio de precaución, tema que debe tener continuidad en pro de un mejor entendimiento de la gestión del riesgo y de las complejas circunstancias de la invocación y aplicación del principio que debe estar presente en la formulación de las políticas ambientales, dado que las autoridades y los particulares ante la falta de certeza científica absoluta, para impedir la degradación ambiental, deberán darle aplicación cuando exista peligro de daño grave e irreversible como lo establece la legislación colombiana (artículo 1 Ley 99 de 1993). La prevención en materia ambiental, como concepto y principio, es una opción eficaz para aplicar el principio ético de responsabilidad esbozado por Hans Jonas, que propugna por un tratamiento responsable del ambiente de cara a su preservación para las generaciones venideras. En este sentido, la prevención es también un mecanismo de gestión que le da a cada riesgo ambiental el tratamiento particular que se merece, dadas sus características, premura e incluso potencial impacto en lo social, económico y ambiental. El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. El paper realiza una exposición sobre el concepto y contenido de la nulidad y el restablecimiento del derecho como medio de control a la luz de la Ley 1437 de 2011; enfocándola en asuntos ambientales a través del estudio de la licencia ambiental.

En el presente artículo se presenta el panorama y algunos de los más importantes avances que en Colombia se han dado en materia ambiental desde la Constitución Política de 1991. La metodología llevada a cabo es descriptiva y analítica, en tanto se estudian no sólo las normas sino las sentencias más relevantes que se han constituido en un hito en la protección de los derechos ambientales. En este capítulo se estudia la facultad a prevención contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. This paper proposes freedom as the condition of possibility for the construction of trust in human relationships. The methodology used is a review of the scientific literature of the most recent moral and political philosophy. As a result of the dialogue between different positions, it is discovered that freedom, despite being present in the act of trust, is forgotten in the discussion around trust, a forgetfulness that has as its main causes the assumption that trust is natural and the confusion (...) between the propensity to trust and the act of trusting. All this leads to proposing an approach of the act of trusting that starts from the freedom of the trustee and the trustor. (shrink)

Esta investigación pone en diálogo las posiciones de Hobbes y de Spaemann respecto a la naturaleza de la confianza, para lo cual se asume una postura hermenéutica. Los principales resultados de esta arrojan que para Hobbes la confianza ha de ser aprendida, pues la desconfianza es lo primero con lo que se encuentra el ser humano; mientras que, para Spaemann, el hombre es un ser confiado y aprende a desconfiar. Como efecto de este diálogo se descubre que ambos autores tienen (...) como base para la confianza la sociabilidad humana, por lo cual se concluye que la disposición de la confianza se da en la naturaleza humana como condición de posibilidad para el acto de confiar. In this research, a sliding mode regulator with sine mapping is suggested for the stabilization of electricity generators being affected by magnet interaction nonlinearities and generator nonlinearities. To reach this goal, our suggested regulator has the following contributions: it starts from the sliding mode regulator with the modifications that the saturation mapping is used to reach a smoother performance instead of the signum mapping, and the sine mapping is applied to reach an upper bound in the proportional gain error, it (...) is used to reach some chosen constant behaviors for the angle position, angle speed, and current in the electricity generators, and its stabilization is ensured based on the Lyapunov approach. The assembly of products or components by operators in industries is a complex task with recurring problems. In these processes, operators often make errors that can lead to defective products. Therefore, they need to be inspected later to verify their correct assembly. The main problems are caused by several reasons including high employee turnover, lack of experience in manufacturing specific products or confusion in interpreting instructions to assemble similar components. In this paper, a novel structured language aimed to describe the (...) required actions to manufacture a product in industrial assembly environments is presented. The main contribution is to provide a formal language to feed automatic systems that can verify through visual control whether the actions performed by the operator are carried out following the standard described by this language. In general, the use of this formal language will allow to minimize the negative impact of errors during assembly and to reduce waste in many forms in the industry. (shrink)

Nesse âmbito, além do Patrimônio Material de ruas, praças, igrejas, objetos artísticos e históricos, o discurso e ações dos órgãos oficiais e (...) da comunidade, devem também se pautar pela valorização das produções imateriais da cultura. Esses elementos envolvem os sujeitos e os sons produzidos por eles, seus ofícios, memórias, festas e religiosidade. Nesse sentido, o presente artigo visa analisar os Bens Culturais que compõem o cenário da celebração do Senhor dos Passos e descrever os seus valores histórico, religioso e artístico. A metodologia utilizada foi: pesquisa bibliográfica, documental e de campo. Após as três etapas da pesquisa e observação no local, constatado que a Festa do Senhor dos Passos em São Cristóvão possui elementos patrimoniais conectados que a transforma em um evento vinculado à identidade cultural-religiosa da região. Alguns desses elementos já são tombados nos níveis estadual, nacional e mundial, enquanto que outros, embora não reconhecidos pelos órgãos oficiais de salvaguarda do Patrimônio, são valorizados pela comunidade no que concerne a afetividade, memória, dádiva e pertencimento: Patrimônios de Fé, Religiosidade e Culto em Sergipe. Such elements involve the subjects and the sounds produced by them, their crafts, memories, parties and religiosity. In this way, this article aims at analyzing the aspects that make up the scene of the festivities of Senhor dos Passos as a Cultural object and describes its historical, religious and artistic values. The methodology used was the bibliographic, documental and field research. After the three stages of research and on-site observation, it was found that the Festival of Senhor dos Passos in São Cristóvão owns connected heritage elements which turn it into an event linked to the religious-cultural identity of the region. Some of these elements are already safeguarded statewide and at national and global levels, while others, though not recognized by the official bodies of safeguarding of heritage are valued by the local community by affection, memory, donation and belongingness: Heritage of Faith, Religiosity and cult in Sergipe. The moral presentation: an essay on Merleau-Ponty's notion of time in the Phenomenology of Perception: The purpose of this essay is to investigate the notion of memory in Merleau-Ponty, suggesting a possible interpretation of the time and memory within Merleau-Ponty’s genetic phenomenological analysis. Ultimately, our hypothesis is that Merleau-Ponty’s understanding of the problem of representation and perception - particularly the problem of retention - places an ethical ground in perception. We will suggest that the phenomenological approach to memory might pave (...) a different undertaking of morals as constructed in the living-present. Our objective is then to point a moral dimension to the process of presentation-representation that happens in consciousness, and establish that our way into the comprehension of values has both a passive and active dimension that is often underdeveloped in studies of how we establish moral and political convictions. Esse presente artigo tem por finalidade abordar aspectos da Procissão ao Nosso Senhor dos Passos na cidade sergipana de São Cristóvão. A metodologia utilizada foi a pesquisa bibliográfica, com discussão no campo teórico sobre Barroco, Festa Devocional, Tradição, Religiosidade, Procissão, Turismo Religioso, Cultura e Identidade. Também foi realizada a pesquisa de campo, com observação direta. Com esse estudo, ficou perceptível que, como território distante de Portugal, as festas religiosas do Brasil tomaram uma dinâmica própria, absorvendo elementos profanos e se resignificando através do apelo popular. Currently in Brazil, the Catholic party moving a lot of people in the period of their events. Apart from tourist attractions, religious celebrations in the country are also intangible heritage and culture are embedded within "the feast" of Brazilians. This present article seeks to address aspects of the Procession of " Nosso Senhor dos Passos " the city of São Cristóvão state of Sergipe. The methodology used was literature, with discussion in the theoretical field of Baroque, Devotional Feast, Tradition, Religion, Procession, Religious Tourism, Culture and Identity. We also carried out field research, with direct observation.With this study, it was noticeable that, as distant territory of Portugal, the religious feasties in Brazil have taken a very dynamic, absorbing the profane elements and reframing through popular appeal. While philosophical questions about health and disease have attracted much attention in recent decades, and while opinions are divided on most issues, influential accounts seem to embrace negativism about health, according to which health is the absence of disease. Some subscribe to unrestricted negativism, which claims that negativism applies not only to the concepts of health and disease as used by healthcare professionals but also to the lay concept that underpins everyday thinking. Whether people conceptualize health in this manner has (...) implications for medical care and public health, and so we set out to examine this claim in two studies. Participants were asked to assess and compare the health states of two people presented in two vignettes. We found that both lay people and medical students conceptualize health as something more than the absence of disease. We argue that our findings highlight a need to rethink unrestricted negativism and indicate a need to rethink the way the debate has traditionally focused on disease. (shrink)

In this article, we examine the political and educational relevance of Hannah Arendt’s account of friendship. Drawing from Arendt’s central works on friendship, we offer a novel interpretation of the concept by connecting the notion with the idea of educational ‘love for the world’, amor mundi. With this interpretation, we seek to demonstrate that the concept of friendship has both direct educational and indirect political significance. Thereby, we distinguish our interpretation from two previous understandings of the educational relevance of the (...) Arendtian notion of friendship—those by (1) Aaron Schutz and Marie G. Sandy, and (2) Morten T. Korsgaard—in which friendship is either assigned a specifically political role (as in (1)) or its significance to education is narrowly understood (as in (2)). We argue our interpretation of friendship offers both a new contribution to the understanding of the relationship between education and politics in the context of Arendt scholarship, and a novel way of thinking about the educational significance of friendship in the context of contemporary democratic politics, especially the prevailing political polarization. We sometimes fail unwittingly to do things that we ought to do. And we are, from time to time, culpable for these unwitting omissions. We provide an outline of a theory of responsibility for unwitting omissions. We emphasize two distinctive ideas: (i) many unwitting omissions can be understood as failures of appropriate vigilance, and; (ii) the sort of self-control implicated in these failures of appropriate vigilance is valuable. This paper aims to clarify the nature of understanding in medicine. The first part describes in more detail what it means to understand something and links a type of understanding (i.e., objectual understanding) to explanations. The second part proceeds to investigate what objectual understanding of a disease (i.e., biomedical understanding) requires by considering the case of scurvy from the history of medi- cine. The main hypothesis is that grasping a mechanistic explanation of a condi- tion is necessary for a biomedical (...) understanding of that condition. The third part of the paper argues that biomedical understanding is necessary, but not sufficient for understanding in a clinical context (i.e., clinical understanding). The hypothe- sis is that clinical understanding combines biomedical understanding of a disease or pathological condition with understanding illness, which involves some degree of personal understanding of the patient. It is argued that, in many cases, clinical understanding necessitates adopting a particular second-personal stance and using cognitive resources in addition to those involved in biomedical understanding. Neil Levy (2007) argues that empirical data shows that psychopaths lack the moral knowledge required for moral responsibility. His account is intriguing, and it offers a promising way to think about the significance of psychopaths for work on moral responsibility. In what follows we focus on three lines of concern connected to Levy's account: his interpretation of the data, the scope of exculpation, and the significance of biological explanations for anti-social behavior.

The importance of socio-economic impacts from the introduction and use of genetically modified crops is reflected in increasing efforts to include them in regulatory frameworks. Aiming to identify and understand the present knowledge on SEI of GM crops, we here report the findings from an extensive study of the published international scientific peer-reviewed literature. After applying specified selection criteria, a total of 410 articles are analysed. The main findings include: limited empirical research on SEI of GM crops in the scientific (...) literature; the main focus of the majority of the published research is on a restricted set of monetary economic parameters; proportionally, there are very few empirical studies on social and non-monetary economic aspects; most of the research reports only short-term findings; the variable local contexts and conditions are generally ignored in research methodology and analysis; conventional agriculture is the commonly used comparator, with minimal consideration of other substantially different agricultural systems; and there is the overall tendency to frame the research upon not validated theoretical assumptions, and to over-extrapolate small-scale and short-term specific results to generalized conclusions. These findings point to a lack of empirical and comprehensive research on SEI of GM crops for possible use in decision-making. Broader questions and improved methodologies, assisted by more rigorous peer-review, will be required to overcome current research shortcomings. (shrink)

Our EcoDialogue Center is an educational space for human sustainability within the University of Veracruz. We propose that creating sustainable knowledge requires re-thinking how we conceive ourselves as human beings. This requires paying attention to what we call “the quality of being,” which means caring about and attending to the physical–emotional–mental–spiritual as the foundation of education. This way we can create a space where we can dialogue contemplatively where all dimensions of our lives interact; the physical, the emotional, the communitarian, (...) the social politic, the planetarium, and the spiritual being act with social–environmental responsibility. It is common to distinguish between “holist” and “reductionist” views of brain function, where the former envisions the brain as functioning as an indivisible unit and the latter as a collection of distinct units that serve different functions. Opposing reductionism, a number of researchers have pointed out that cortical network architecture does not respect functional boundaries, and the neuroanatomist V. Braitenberg proposed to understand the cerebral cortex as a “great mixing machine” of neuronal activity from sensory inputs, motor commands, and (...) intrinsically generated processes. In this paper, we offer a contextualization of Braitenberg’s point, and we review evidence for the interactions of neuronal activity from multiple sensory inputs and intrinsic neuronal processes in the cerebral cortex. We focus on new insights from studies on audiovisual interactions and on the influence of respiration on brain functions, which do not seem to align well with “reductionist” views of areal functional boundaries. Instead, they indicate that functional boundaries are fuzzy and context dependent. In addition, we discuss the relevance of the influence of sensory, proprioceptive, and interoceptive signals on cortical activity for understanding brain-body interactions, highlight some of the consequences of these new insights for debates on embodied cognition, and offer some suggestions for future studies. Lackey’s (2007) class of “selfless assertions” is controversial in at least two respects: it allows propositions that express Moorean absurdity to be asserted warrantedly, and it challenges the orthodox view that the speaker’s belief is a necessary condition for warranted assertibility. With regard to the former point, I critically examine Lackey’s broadly Gricean treatment of Moorean absurdity and McKinnon’s (2015) epistemic approach. With regard to the latter point, I defend the received view by supporting the knowledge account, on which knowledge (...) is the necessary condition for warranted assertion. After examining two defenses of KA, by Montminy and Turri, I propose two alternative approaches. Although I remain neutral between them, I develop in more detail the view which classifies “selfless assertions” as “presentations”, a type of assertives distinct from genuine assertions. This account is motivated further by allowing for the expansion of the normative approach to other assertives, a feature we may be interested in, in the light of a recent wave of normative accounts of speech acts. O utopianismo científico de Neurath é a proposta para que as ciências sociais se envolvam na elaboração, desenvolvimento e comparação de cenários contrafactuais, as ‘utopias’. Tais cenários podem ser entendidos como peças centrais de experimentos de pensamento científicos, isto é, em exercícios da imaginação que não apenas promovem a revisão conceitual, mas também estimulam a criatividade para lidar com problemas vivenciados, já que utopias são esforços para imaginar como o futuro poderia ser. Ademais, experimentos de pensamento utópicos podem oferecer conhecimento (...) científico para informar debates e decisões políticas, contribuindo para formatar a sociedade. Este ensaio reconstrói um evento histórico como um exemplo da metodologia utopianista de Neurath. No final dos anos 1970 e início dos anos 1980, uma comissão científica e política designada pelo parlamento da Alemanha Ocidental inventou e comparou quatro cenários para políticas energético-econômicas futuras. Conclusões da comissão informaram decisões políticas que puseram a Alemanha Ocidental (e depois reunificada) em um caminho para se tornar uma potência industrial verde. Uma parte fundamental do trabalho da comissão envolveu um apelo à imaginação, permitindo a caracterização sob a metodologia de Neurath. (shrink)

Este artículo explora algunas de las relaciones entre dialéctica y filosofía dentro del programa de una dialéctica modificada de Theodor W. Adorno ¿Cómo pensar la tensión entre las categorías dialécticas y la filosofía desde el prisma de una dialéctica negativa? ¿Qué significa desde el pensamiento de Adorno a liberar a la filosofía y a la dialéctica de su carácter afirmativo? Elaborar estas preguntas es el objetivo de este trabajo.

The "theory of mind" framework has been the fastest growing body of empirical research in contemporary psychology. It has given rise to a range of positions on what it takes to relate to others as intentional beings. This book brings together disparate strands of ToM research, lays out historical roots of the idea, and indicates better alternatives.

Nomy Arpaly rejects the model of rationality used by most ethicists and action theorists. Both observation and psychology indicate that people act rationally without deliberation, and act irrationally with deliberation. By questioning the notion that our own minds are comprehensible to us--and therefore questioning much of the current work of action theorists and ethicists--Arpaly attempts to develop a more realistic conception of moral agency.

Este artículo de reflexión plantea la decisión implícita en el acto educativo y, sobre todo, evaluativo: ¿comprender o juzgar? Á partir de un hecho educativo cotidiano se plantea la alternativa filosófica e irresoluble entre el determinismo y la libertad, proponiendo un enfoque compatibilista que significa que pese a que la acción humana individual hace parte de cadenas causales, somos libres de quebrar o innovar en cualquiera de los eslabones de dichas cadenas, posibilitando así la responsabilidad moral y la ética, y (...) permitiendo un acto realmente formativo. Los aportes de Descartes y Kant, así como de Pestalozzi y Makarenko permitirán proponer la educación como anticipación en un contexto preciso. (shrink)

Este trabajo presenta como objetivo revelar la influencia de los contextos socioeconómicos en las maneras de afrontamiento al cáncer como enfermedad. Se muestra un análisis sobre el cáncer como problema social y de salud; se analiza el papel de algunos entes sociales involucrados, el acceso de los enfermos a las terapias y de los productores de fármacos a las nuevas tecnologías. Se reflexiona acerca de la sobreevaluación de los fármacos que dificulta el acceso a novedosas y efectivas terapias; la supeditación (...) del saber tecnocientífico a los intereses del capital; la creciente contaminación ambiental como detonante al incremento de casos; y la escasez de tecnologías para la prevención y el saneamiento en países subdesarrollados. Finalmente se refiere el programa cubano de lucha contra el cáncer, su situación actual y proyecciones. This paper aimes at revealing the influence of the socioeconomic contexts on the way cancer is faced as a disease. An analysis about cancer as a social and health problem is presented; the role of some social organizations involved the sick's access to therepies and drug producers' access to new technologies. It is reflected on the over-asessment of drugs which makes access to new and effective therapies difficult; the subordination of the technoscientific knowledge to the interests of the capital; the growing environmental pollution as a trigger for cases increase; and the limited technological resources for prevention and cleanup in underdeveloped countries. Finally, it is made reference to the Cuban cancer fighting program, its current status and scope. (shrink)
