The objective of the study was to investigate the relationship between childhood IQ of parents and characteristics of their adult offspring. It was a prospective family cohort study linked to a mental ability survey of the parents and set in Renfrew and Paisley in Scotland. Participants were 1921-born men and women who took part in the Scottish Mental Survey in 1932 and the Renfrew/Paisley study in the 1970s, and whose offspring took part in the Midspan Family study in 1996. There (...) were 286 offspring from 179 families. Parental IQ was related to some, but not all characteristics of offspring. Greater parental IQ was associated with taller offspring. Parental IQ was inversely related to number of cigarettes smoked by offspring. Higher parental IQ was associated with better education, offspring social class and offspring deprivation category. There were no significant relationships between parental IQ and offspring systolic blood pressure, diastolic blood pressure, cholesterol, glucose, lung function, weight, body mass index, waist hip ratio, housing, alcohol consumption, marital status, car use and exercise. Structural equation modelling showed parental IQ associated with offspring education directly and mediated via parental social class. Offspring education was associated with offspring smoking and social class. The smoking finding may have implications for targeting of health education. (shrink)

The unifying factor is a combinatorial principle which we present in terms of a game in which the first player challenges the second player to carry out constructions which would be much easier in a generic extension of the (...) universe, and the second player cheats with the aid of ♦. Section 1 contains an axiomatic framework suitable for the description of a number of related constructions, and the statement of the main theorem 1.9 in terms of this framework. The article seeks to instantiate the distinctive features and basic research strategies in legal ontology as they are presented in the early works by the famous Oxford philosopher of law Herbert Hart, published before his major book The Concept of Law. The author tries to isolate the most salient aspects of the analytical legal tradition applicable to Russian legal theory, which can bridge the existing gap between these approaches despite considerable difference both in their background and methodology.

The paper discusses the Anglo-American philosophy of law of the 20th century, more specifically the philosophy of law of Ronald Myles Dworkin and his criticism of the legal positivism of Herbert Lionel Adolphus Hart. The author presents the history of the criticism of legal positivism in Ronald Dworkin’s philosophy of law and distinguishes historical stages. The subject of the study is the critique of legal positivism but not the Hart-Dworkin debate itself, well known in Western philosophy of law. The reason (...) is that the discussion was conducted between Dworkin and Hart’s supporters but not between Dworkin and Hart by himself. The latter responded to the criticism only after twenty seven years. The article explains why Dworkin chose for his criticism Herbert Hart’s version of legal positivism. This is due to the fact that Dworkin highly appreciated Hart’s positivist theory of law and characterized it as the “most clear.” The article presents the methodological foundations of criticism of Hart’s legal positivism in Dworkin’s philosophy of law. It reveals a methodological divergence between the two legal theories, which directly affects the understanding of the concept of law and its content. Therefore, we can assume that the legal theories of Hart and Dworkin are two competing models of law: Dworkin’s model considers law as a set of rules and principles and Hart’s model acknowledges only rules and court decisions as a source of law. The article also presents the key principles of positivism criticized by Dworkin. These principles, firstly, interpret law as a set of legal rules determined through a special legal criterion, secondly, provide the judge with an opportunity to make a decision “at his own discretion” in a situation not regulated by law, and, thirdly, recognize only legal rights and obligations enshrined in legal regulations. It is important to note that in this article the author describes criticism as an independent phenomenon of legal philosophy with a particular focus on the history and foundations of this phenomenon. The article examines K.A. Rodin’s thesis on the possibility of including Wittgenstein’s remarks on intention and action in the context of legal philosophy research. It is shown that although the concepts of intention and intentional action are relevant to the philosophy of law, Wittgenstein’s own ideas did not have a significant impact on their relevance (and some of them did not have it at all). This influence is confined to the fact that, like Wittgenstein, many jurists and legal theorists, mainly (...) those who were influenced by the ideas of H.L.A. Hart, also objected to the causal theory of action. However, the influence is limited to this approach. (shrink)

This article re-examines the House of Lords» decision in Pepper v Hart, which relaxed the rule prohibiting courts from using ministerial explanations of Bills in Parliament in the construction of statutes. It recognizes the importance of context in the interpretation of statutes, but questions the assumption in the case that intention can be attributed to Parliament. It argues that the case can be confined to authorizing the use of ministerial statements in Parliament when such statements can be shown to be (...) inconsistent with arguments made by government before the courts on the meaning of the legislation. Any broader interpretation of the decision raises serious constitutional objections. (shrink)

This Note is intended to stand as a short supplement to the compelling article by Stefan Vogenauer entitled, ‘A Retreat from Pepper v Hart? A Reply to Lord Steyn’ published in the Journal at the end of 2005.1 In his article, Professor Vogenauer calls in question the argument advanced by Lord Steyn in his article in the Journal, entitled ‘Pepper v Hart: A Re-examination’.2 In that article, Lord Steyn called for a retreat from the decision of the House of Lords (...) in Pepper v Hart3 concerning the circumstances in which reference may be made to Hansard as an aid to statutory construction and for a reinterpretation of the decision in line with a theory that a Minister speaking in Parliament who gives an explanation of the meaning or effect of a clause in a Bill should be taken to create a binding legitimate expectation that the executive will apply the provision, once enacted, in that sense. In this Note, I express my agreement with Professor Vogenauer’s argument, and seek to support it with some additional points under three heads: (1) the proper interpretation of Pepper v Hart and its status as authority; (2) the basis in principle for adhering to that interpretation; and (3) conceptual difficulties attached to Lord Steyn’s legitimate expectation thesis. In the second section of Chapter V of The concept of law, Hart lays down the concept of legal obligation throughout a critique of the concept of obligation in John Austin’s predictive theory. The critique aims at the core domain of this theory, which occupies the major part of the section, and shows how wrong it is to describe the legal obligation in terms of commands and habits of obedience. At the end of this section, Hart introduces the concepts of (...) internal and external point of view, in order to criticize the methodological model used by the predictive theory – the great responsible for the mistakes of Austin’s account. The following paper makes a review of the “debate” between both theories and, at the end, it tries to demonstrate how the introduction of Hart’s new conceptions (internal and external points of view) is done to avoid the mistakes occurred in Austin’s predictive theory. This article describes a team-taught environmental studies course called Animal Metaphors. Focusing on animal metaphors in literature and film, the course emphasizes various cognitive and perceptual biases that lead humans to place ourselves above and beyond nature, making us more likely to engage in practices destructive to the environment. Whereas the first iteration of the course underscored various ways in which humans are less rational or moral than we imagine, the new iteration shifted more of the focus to what inspires (...) and motivates humans, gives us emotional resilience, and best creates conditions for mental well-being as we cooperate and collaborate. This seemed an appropriate tack to take in an age commonly referred to as the “Anthropocene.” We thus continued to examine our status as evolved animals while also calling more attention to spiritual or ecstatic experience, music, humor, and the uniquely human ability for shared intentionality. This study is an unusual contribution to the philosophy of mind in that it argues for the sometimes unfashionable view of dualism: that mind and matter are distinct and separate entities as Descartes believed. The author takes as his point of departure the imaginative hypothesis of disembodiment, which establishes the possibility of the mind's being a quite non-material thing. There are clear casual correlations between what is physical and what is mental, and the most serious issue confronting dualism since Descartes (...) has been how such an interaction is possible. In this paper we discuss several generalization of theorems from stability theory to simple theories. Cherlin and Hrushovski, in [2] develop a substitute for canonical bases in finite rank, ω-categorical supersimple theories. Motivated by methods there, we prove the existence of canonical bases (in a suitable sense) for types in any simple theory. This is done in Section 2. In general these canonical bases will (as far as we know) exist only as “hyperimaginaries”, namely objects of the forma/Ewhereais a possibly (...) infinite tuple andEa type-definable equivalence relation. (In the supersimple, ω-categorical case, these reduce to ordinary imaginaries.) So in Section 1 we develop the general theory of hyperimaginaries and show how first order model theory (including the theory of forking) generalises to hyperimaginaries. We go on, in Section 3 to show the existence and ubiquity of regular types in supersimple theories, ω-categorical simple structures and modularity is discussed in Section 4. It is also shown here how the general machinery of simplicity simplifies some of the general theory of smoothly approximable (or Lie-coordinatizable) structures from [2].Throughout this paper we will work in a large, saturated modelMof a complete theoryT.
