Moral distress has been widely reviewed across many care contexts and among a range of disciplines. Interest in this area has produced a plethora of studies, commentary and critique. An overview of the literature around moral distress reveals a commonality about factors contributing to moral distress, the attendant outcomes of this distress and a core set of interventions recommended to address these. Interventions at both personal and organizational levels have been proposed. An ethic of the fitting: a conceptual framework for nursing practiceNurses are expected to act within an ethos of care cognisant of duty, the right, and the good. Concepts of virtue theory, utilitarianism and deontology are used to outline a conceptual ethical framework for nurses in practice. This ‘Moebius’ framework aims to locate the virtues in a symbiotic relationship with the principles of utilitarianism and deontology. Under this framework, fitting ethical responses are sought. Within an ethic of the fitting, rules (...) and principles do not guarantee the most ethically justifiable outcomes. Within the Moebius approach, the nurse ought to respond with a sense of compassion that befits the moment rather than adhere to a rule at all costs. (shrink)

This article reviews the literature on deception to illuminate the phenomenon as a background for an appraisal within nursing. It then describes nursing as a practice of caring. The character of the Good Samaritan is recommended as indicative of the virtue of compassion that ought to underpin caring in nursing practice. Finally, the article concludes that a caring nurse, responding virtuously, acts by being compassionate, for a time recognizing the prima facie nature of the rules or principles of truth telling.

In general, most, but not necessarily all, patients want truthfulness about their health. Available evidence indicates that truth-telling practices and preferences are, to an extent, a cultural artefact. It is the case that practices among nurses and doctors have moved towards more honest and truthful disclosure to their patients. It is interesting that arguments both for and against truth-telling are established in terms of autonomy and physical and psychological harm. In the literature reviewed here, there is also the view that (...) truth-telling is essential because it is an intrinsic good, while it is argued against on the grounds of the uncertainty principle. Based on this review, it is recommended that practitioners ought to ask patients and patients' families what informational requirements are preferred, and research should continue into truth-telling in clinical practice, particularly to discover its very nature as a cultural artefact, and the other conditions and contexts in which truth-telling may not be preferred. Few issues cause academics to disagree more than gender and race, especially when topics are addressed in terms of biological differences. To conduct research in these areas or comment favorably on research can subject one to scorn. When these topics are addressed, they generally take the form of philosophical debates. While philosophers of mind have been arguing over the status of mental representations in cognitive science, cognitive scientists have been quietly engaged in studying perception, action, and cognition without explaining them in terms of mental representation. In this book, Anthony Chemero describes this nonrepresentational approach, puts it in historical and conceptual context, and applies it to traditional problems in the philosophy of mind. Radical embodied cognitive science is a direct descendant of the American naturalist psychology of William James and (...) John Dewey, and follows them in viewing perception and cognition to be understandable only in terms of action in the environment. Chemero argues that cognition should be described in terms of agent-environment dynamics rather than in terms of computation and representation. After outlining this orientation to cognition, Chemero proposes a methodology: dynamical systems theory, which would explain things dynamically and without reference to representation. He also advances a background theory: Gibsonian ecological psychology, "shored up" and clarified. Chemero then looks at some traditional philosophical problems through the lens of radical embodied cognitive science and concludes that the comparative ease with which it resolves these problems, combined with its empirical promise, makes this approach to cognitive science a rewarding one. "Jerry Fodor is my favorite philosopher," Chemero writes in his preface, adding, "I think that Jerry Fodor is wrong about nearly everything." With this book, Chemero explains nonrepresentational, dynamical, ecological cognitive science as clearly and as rigorously as Jerry Fodor explained computational cognitive science in his classic work The Language of Thought. This analysis examines the practice of care providers in residential aged care lying to residents with dementia. Qualitative data were collected through multiple methods. Data here represents perceptions from registered and enrolled nurses, personal care assistants, and allied health professionals from five residential aged care facilities located in Queensland, Australia. Care providers in residential aged care facilities lie to residents with dementia. Lying is conceptualized as therapeutic whereby the care provider’s intent is to eliminate harm and also control behaviour. Care (...) providers of residents with dementia in RACFs need guidance around lying. An ethical framework cognisant of an ethical theory of good and ethical theory of right supplemented by a theory of virtue is proposed. A complimentary four stage communication strategy that promotes truth telling as a first option while also recommending the lie as a suitable strategy is also promoted. (shrink)

This paper offers a critique of the special issue of Human Studies on “Alfred Schutz and Religion”. Following a line similar to that of Dominique Janicaud I call into question the very phenomenological status of the “phenomenology of religion” developed across the various contributions. Appealing to the Husserlian principle of freedom from presuppositions my critique focuses on the way these phenomenologies of religion talk about “religion”. At their core, the failure contained within these contributions is the failure to properly consider (...) a question which begins any undergraduate Religious Studies program—what is “religion”? I charge that because these contributions take it as “self-evident” what religion “is” they allow a metaphysical assertion into their phenomenology which breaches the “neutrality” demanded of the principle of freedom from presuppositions. Drawing on the work of the Critical Religion project in Religious Studies I further highlight how this metaphysical assertion predicates an unavoidable ideological assertion, one which serves colonial mechanics of exclusion. One of the key insights of Scheler’s approach to the topic intersubjectivity is to recognise that the problem of intersubjectivity is in fact several problems. In The Nature of Sympathy, Scheler lays out an order of precedence in which these problems need to be addressed. One of his major criticisms against analogical arguments and theories of empathy is that they violate this order. Specifically, they provide accounts of what the Other is thinking, but treat this as a solution to how (...) we recognise the Other as Other. In responding to Scheler, Schutz takes up this order of precedence but then makes the signifi cantly bolder claim that intersubjectivity as possibility is not problematic and does not require a solution. The purpose of this paper is to show that Schutz’s argument relies on a Husserlian reading of Scheler’s use of “transcendental psychology” and that rather than sidestepping the problem Schutz in fact tacitly presupposes a solution in the form of the human prejudice. Significantly, this solution radically overturns the aims of Scheler’s phenomenology and even that of the broader Phenomenological Movement. (shrink)

It is the contention of this paper that the majority of scholars deal with a simplified notion of Schutz’s understanding of social science. Specifically they tend to view Schutz’s understanding of social science as containing only three postulates: logical consistency, subjective interpretation, and adequacy. However, such considerations tend to focus primarily upon “Common-Sense and Scientific Interpretation of Human Action” and only engage with Schutz’s other essays in a tertiary manner. This paper argues that only by giving due attention to Schutz’s (...) other work does it become clear what his full understanding social science is. A full picture must necessarily take into account the postulate of relevance or disinterestedness, postulate of clarity, and postulate of compatibility or tested observation. This paper will clarify the relationship of all these postulates which will necessarily require a number of amendments in order to achieve the greatest clarity possible. (shrink)

In The Human Place in the Cosmos Max Scheler argues the question of philosophical anthropology must address three problems: the difference between man and animal; the Cartesian problem of the mind and body; and the essence of spirit. In a recent issue of Human Studies, two articles by Cristian Ciocan and Christian Ferencz-Flatz addressed the first of these problems through investigations of Husserl’s Nachlass. In this paper, I respond primarily to Ciocan by drawing on Scheler’s phenomenology and the implications this (...) has for understanding Husserl’s phenomenology. By looking at Husserl’s published comments, we can see how the attempt to differentiate between man and animal is bound up with his understanding of spirituality. This allows an alternative way of understanding normality and abnormality which shifts emphasises away from how far we can empathise with the Other to emphasise what it means to be normal or abnormal. This will allow us to address an ambiguity of Husserl identified by Ferencz-Flatz. (shrink)

Rapid advances in the domain of science and technology are having an unprecedented effect upon the provision of higher education in universities throughout the world, the pace of change often being so fast as to make planning for the development of the “classroom of the future” an extremely difficult task. The Mobile Multimedia University (MMU) project, a collaborative action between four leading UK based research facilities, has been established to investigate these issues. Included amongst its aims is the use of (...) novel research methodologies to determine the factors which will influence the shape and form of future education provision, and thus the distribution of knowledge to society, such as mobility, telecommunications and multimedia services. This paper describes the use of a Delphi survey in predicting the technological trends and innovations which will affect university education in the near future. It describes the theory underpinning the Delphi method, illustrating this with examples of how such a technique has been successfully used in the past. It then details the specific application of the Delphi approach within the current MMU research project, detailing the preliminary results and discussing the implications of these findings for the future of universities and other institutes of higher education. To date, the study of “religion” and “martial arts” is a lacuna of the field in Religious Studies in which the depth of association has long gone unrecognised. What little study there is, however, suffers from a practitioner’s bias in that those writing on martial arts are also attempting to promote the agenda of their own discipline. This paper attempts a more critical approach to show the study of martial arts can contribute to the ongoing problematisation of “religion” as an (...) analytic category, particularly in its relation to “the secular” and “nationalism”. To do this I will draw on the philosophical phenomenology of Husserl, Sartre and Schutz to argue that “religions”, “nationalisms” and “martial arts” are all names given to modes of naturalisation. By this I mean they are means by which a person “fits” within their life-world and deals with the problems of surviving and thriving. In this case of martial arts, these can be seen as modes of naturalisation through debates on “sportification”. As commonly conceived, the sportification of a martial art risks impeding its “spiritual” aspects. It is the martial artists’ understanding of “spiritual” as something public and serious that mark it out as a mode of naturalisation. In the case of “religion” and “nationalism” these are ideological means of categorising modes of naturalisation, primarily as a means of “Othering”. By looking at the case of Kendo and its origins in the samurai, this paper will show the fluidity with which these ascriptions can be applied to a single “tradition” depending on context. (shrink)

Dr Edwards' stimulating and provocative book advances the thesis that the appropriate axiomatic basis for inductive inference is not that of probability, with its addition axiom, but rather likelihood - the concept introduced by Fisher as a measure of relative support amongst different hypotheses. Starting from the simplest considerations and assuming no more than a modest acquaintance with probability theory, the author sets out to reconstruct nothing less than a consistent theory of statistical inference in science.

In this paper, I examine a variety of agents that appear in Kantian ethics in order to determine which would be necessary to make a robot a genuine moral agent. However, building such an agent would require that we structure into a robot’s behavioral repertoire the possibility for immoral behavior, for only then can the moral law, according to Kant, manifest itself as an ought, a prerequisite for being able to hold an agent morally accountable for its actions. Since building (...) a moral robot requires the possibility of immoral behavior, I go on to argue that we cannot morally want robots to be genuine moral agents, but only beings that simulate moral behavior. Finally, I raise but do not answer the question that if morality requires us to want robots that are not genuine moral agents, why should we want something different in the case of human beings. ABSTRACTThe financial crisis of 2008 was unforeseen partly because the academic theories that underpin policy making do not sufficiently account for uncertainty and complexity or learned and evolved human capabilities for managing them. Mainstream theories of decision making tend to be strongly normative and based on wishfully unrealistic “idealized” modeling. In order to develop theories of actual decision making under uncertainty, we need new methodologies that account for how human actors often manage uncertain situations “well enough.” Some possibly helpful methodologies, (...) drawing on digital science, focus on the role of emotions in determining people's choices; others examine how people construct narratives that enable them to act; still others combine qualitative with quantitative data. There is no doubt that the model presented here is incomplete. Many important categories, particularly negation and the adverbials, have been entirely ignored, and the treatment of Tense and the affixes is certainly inadequate. It also remains to be seen how the many constructions that have been ignored here are to be accommodated within the framework that has been outlined. However, the fact that a standard categorial lexicon, plus the four rule schemata, seems to come close to exhaustively specifying the (...) main clause constructions of English, and also seems to explain a number of major constraints on transformations, encourages us to compare the theory with certain alternatives, and to examine its broader implications. The primary difference between direct and inferential theories of perception concerns the location of perceptual content, the meaning of our perceptions. In inferential theories of perception, these meanings arise inside animals, based upon their interactions with the physical environment. Light, for example, bumps into receptors causing a sensation. The animal (or its brain) performs inferences on the sensation, yielding a meaningful perception. In direct theories of perception, on the other hand, meaning is in the environment, and perception does not depend (...) upon meaning- conferring inferences. Instead the animal simply gathers information from a meaning- laden environment. But if the environment contains meanings, then it cannot be merely physical.
