In the educational strand of cosmopolitanism, much attention has been placed on theorizing and describing who is cosmopolitan. It has been argued that cosmopolitan sensibilities negotiate and/or embody such paradoxes as rootedness and rootlessness, local and global concerns, private and public identities. Concurrently, cosmopolitanism has also been formulated as a globally-minded project for and ethico-political responsibility to human rights and global justice. Such articulations underscore cosmopolitanism in anthropocentric terms. People can be cosmopolitan and cosmopolitan projects aim to cultivate cosmopolitan subjectivities. (...) What is striking about scholarship in educational cosmopolitanism is its lack of serious attention placed on the greatest global threat facing not only but largely created by human beings: environmental degradation. In this paper, I provide an overview of key texts written on the who in educational cosmopolitanism which helps lay the groundwork for an analysis of what is cosmopolitan. Regarding the what, I examine a range of boundary-defying emergencies described in cosmopolitan terms including climate change, radioactive poisoning of the planet, and bioinvasion. In the last analysis, I consider what it would take and what the possibilities are for our species to be truly committed to caring not only for the human world. (shrink)

In the United States, roughly 1 out of 4 births takes place at a hospital certified as Baby-Friendly. This paper offers a multi-disciplinary perspective on the Baby-Friendly Hospital Initiative (BFHI), including empirical, normative, and historical perspectives. Our analysis is novel in that we trace how medical practices of “quality improvement,” which initially appear to have little to do with breastfeeding, may have shaped the BFHI. Ultimately, we demonstrate that a rich understanding of the BFHI can be obtained by tracing how (...) norms of gender/motherhood interact with, and are supplemented by, other normative, historical, and institutional realities. We conclude with suggestions for practical revisions to the BFHI. (shrink)

Fairness is central to the ethical and responsible development and use of AI systems, with a large number of frameworks and formal notions of algorithmic fairness being available. However, many of the fairness solutions proposed revolve around technical considerations and not the needs of and consequences for the most impacted communities. We therefore want to take the focus away from definitions and allow for the inclusion of societal and relational aspects to represent how the effects of AI systems impact and (...) are experienced by individuals and social groups. In this paper, we do this by means of proposing the ACROCPoLis framework to represent allocation processes with a modeling emphasis on fairness aspects. The framework provides a shared vocabulary in which the factors relevant to fairness assessments for different situations and procedures are made explicit, as well as their interrelations. This enables us to compare analogous situations, to highlight the differences in dissimilar situations, and to capture differing interpretations of the same situation by different stakeholders. Neural substrates of fatigue in traumatic brain injury are not well understood despite the considerable burden of fatigue on return to productivity. Fatigue is associated with diminishing performance under conditions of high cognitive demand, sense of effort, or need for motivation, all of which are associated with cognitive control brain network integrity. We hypothesize that the pathophysiology of TBI results in damage to diffuse cognitive control networks, disrupting coordination of moment-to-moment monitoring, prediction, and regulation of behavior. We investigate the cingulo-opercular (...) and frontoparietal networks, which are engaged to sustain attention for task and maintain performance. A total of 61 individuals with mild TBI and 42 orthopedic control subjects participated in functional MRI during performance of a constant effort task requiring altering the amount of effort utilized to manually squeeze a pneumostatic bulb across six 30-s trials. Network-based statistics assessed within-network organization and fluctuation with task manipulations by group. Results demonstrate small group differences in network organization, but considerable group differences in the evolution of task-related modulation of connectivity. The mild TBI group demonstrated elevated CO connectivity throughout the task with little variation in effort level or time on task, while CO connectivity diminished over time in controls. Several interregional CO connections were predictive of fatigue in the TBI group. In contrast, FP connectivity fluctuated with task manipulations and predicted fatigue in the controls, but connectivity fluctuations were delayed in the mild traumatic brain injury group and did not relate to fatigue. Thus, the mTBI group’s hyper-connectivity of the CO irrespective of task demands, along with hypo-connectivity and delayed peak connectivity of the FP, may allow for attainment of task goals, but also contributes to fatigue. Findings are discussed in relation to performance monitoring of prediction error that relies on internal cues from sensorimotor feedback during task performance. Delay or inability to detect and respond to prediction errors in TBI, particularly evident in bilateral insula-temporal CO connectivity, corresponds to day-to-day fatigue and fatigue during task performance. The correspondence between Hannah Arendt and Karl Jaspers begins in 1926, when the twenty-year-old Arendt studied philosophy with Jaspers in Heidelberg. It is interrupted by Arendt's emigration and Jasper's 'inner emigration' and resumes in the fall of 1945. From then until Jaspers's death in 1969, the initial teacher-student relationship develops into a close friendship. Background:In Ontario, Canada, patients who lack decision-making capacity and have no family or friends to act as substitute decision-makers currently rely on the Office of the Public Guardian and Trustee to consent to long-term care (nursing home) placement, but they have no legal representative for other placement decisions.Objectives:We highlight the current gap in legislation for difficult transition cases involving unrepresented patients and provide a novel framework for who ought to assist with making these decisions and how these decisions ought to (...) be made.Research design:This paper considers models advanced by Volpe and Steinman with regard to who ought to make placement decisions for unrepresented patients, as well as current ethical models for analyzing how these decisions should be made.Participants and research context:We describe an anonymized healthcare transition case to illustrate the fact that there is no legally recognized decision-maker for placement destinations other than long-term care facilities and to show how this impacts all stakeholders.Ethical considerations:The case provided is an anonymized vignette representing a typical transition case involving an unrepresented patient.Findings:As a result of a gap in provincial legislation, healthcare providers usually determine the appropriate placement destination without a clear framework to guide the process and this can cause significant moral distress.Discussion:We argue for a team decision-making approach in the short term, and a legislative change in the long-term, to respect the patient voice, evaluate benefit and risk, enhance collaboration between healthcare providers and patients, and promote social justice. We believe that our approach, which draws upon the strengths of interprofessional teams, will be of interest to all who are concerned with the welfare and ethical treatment of the patients for whom they care.Conclusions:One of the main strengths of our recommendation is that it provides all members of the healthcare team (including nurses, social workers, therapists, and others) an increased opportunity to advocate on behalf of unrepresented patients. I defend the normativity of meaning against recent objections by arguing for a new interpretation of the ‘ought’ relevant to meaning. Both critics and defenders of the normativity thesis have understood statements about how an expression ought to be used as either prescriptive or semantic. I propose an alternative view of the ‘ought’ as conveying the primitively normative attitudes speakers must adopt towards their uses if they are to use the expression with understanding.

A unique selection of the most significant interviews given by Hannah Arendt, including the last she gave before her death in 1975. Some are published here in English for the first time. Arendt was one of the most important thinkers of her time, famous for her idea of "the banality of evil" which continues to provoke debate. The “best interests of the patient” standard—a complex balance between the principles of beneficence and autonomy—is the driving force of ethical clinical care. Clinicians’ fear of litigation is a challenge to that ethical paradigm. But is it ever ethically appropriate for clinicians to undertake a procedure with the primary goal of protecting themselves from potential legal action? Complicating that question is the fact that tort liability is adjudicated based on what most clinicians are doing, not the scientific basis of whether (...) they should be doing it in the first place. In a court of law, clinicians are generally judged based on the “reasonably prudent” standard: what a reasonably prudent practitioner in a similar situation would do. But this legal standard can have the effect of shifting the medical standard of care—enabling astandard‐of‐care sprawlwhere actions undertaken for the primary purpose of avoiding liability reset the standard of care against which clinicians will be adjudicated. While this problem has been recognized in the legal literature, neither current ethical models of care nor legal theory offer workable solutions.One of the best examples of the conflict between evidence‐based medicine and common clinical practice is the use of electronic fetal monitoring. Despite strong evidence and professional guidelines that argue against the use of EFM for healthy pregnancies, the practice persists. We investigate the interactions between scalar implicatures and presuppositions in sentences containing both a scalar item and presupposition trigger. We first critically discuss Gajewski and Sharvit’s previous approach. We then closely examine two ways of integrating an exhaustivity-based theory of scalar implicatures with a trivalent approach to presuppositions. The empirical side of our discussion focuses on two novel observations: the interactions between prosody and monotonicity, and what we call presupposed ignorance. In order to account for these observations, our final proposal (...) relies on two mechanisms of scalar strengthening, the Presupposed Ignorance Principle and an exhaustivity operator which lets the presuppositions of negated alternatives project. Our paper addresses the following question: Is there a general characterization, for all predicates P that take both declarative and interrogative complements , of the meaning of the P-interrogative clause construction in terms of the meaning of the P-declarative clause construction? On our account, if P is a responsive predicate and Q a question embedded under P, then the meaning of ‘P + Q’ is, informally, “to be in the relation expressed by P to some potential complete answer to Q”. We show that this rule allows us to derive veridical and non-veridical readings of embedded questions, depending on whether the embedding verb is veridical or not, and provide novel empirical evidence supporting the generalization. We then enrich our basic proposal to account for the presuppositions induced by the embedding verbs, as well as for the generation of intermediate exhaustive readings of embedded questions. (shrink)

The singular position of Montesquieu's political philosophy seems to raise the question: Isn't the opposition between republicanism and liberalism a largely artificial one? On the one hand, the description of the republican vivere civile in the Spirit of the Laws testifies to the important ties that exist between Montesquieu and the tradition of ?civic humanism?. However, this apparent theoretical proximity between Montesquieu and the British Neo-Harringtonians ought not to be taken too far, obscuring the deep divergences that differentiate their respective (...) positions, notably when it comes to the interpretation of history. Montesquieu's break from the republican tradition is exemplified by his rejection of its conception of freedom rooted in the citizens' necessary participation in power. But in the end, this does not enable us to conclude that he subscribes to a purely liberal theory. The British model shows that even if direct participation in the exercise of power is not necessary for the existence of liberty, a certain level of civic involvement and public awareness is needed. The liberal opposition between positive and negative liberty, political autonomy and enjoyment of rights without interference must therefore be transcended. (shrink)

The idea of public reason involves a standard of legitimacy that requires that laws and institutions be acceptable to all reasonable people, regardless of their conceptions of the good. Many philosophers have argued that public reason should be understood as an answer to the question of how to justify state coercion. However, some authors have criticized this traditional account because it overlooks noncoercive state actions that seem appropriate topics of public reason. More recently, some philosophers have defended the traditional account (...) against that objection. In this paper, I argue that these approaches cannot effectively deal with that objection and offer a different version of the traditional account that can do so. This version rests on the ideas of overlapping consensus and stability. According to this version, the point of public reason is preserving an overlapping consensus on a coercive system of laws and institutions and achieving a stable society. (shrink)

Or un tel choix est pour le moins contestable, dans la mesure où il laisse dans l'ombre des figures plus " extrêmes " du mal politique : le nazi, le criminel de guerre, le terroriste. A cet égard, la philosophie politique moderne, quoique décidément rationaliste, a mieux cerné le risque que fait courir à la philosophie elle-même l'" Insensé " ou le " raisonneur violent ". Plural definite descriptions across many languages display two well-known properties. First, they can give rise to so-called non-maximal readings, in the sense that they ‘allow for exceptions’. Second, while they tend to have a quasi-universal quantificational force in affirmative sentences, they tend to be interpreted existentially in the scope of negation. Building on previous works, we offer a theory in which sentences containing plural definite expressions trigger a family of possible interpretations, and where general principles of language use account for (...) their interpretation in various contexts and syntactic environments. Our theory solves a number of problems that these previous works encounter, and has broader empirical coverage in that it offers a precise analysis for sentences that display complex interactions between plural definites, quantifiers and bound variables, as well as for cases involving non-distributive predicates. The resulting proposal is briefly compared with an alternative proposal by Križ, which has similar coverage but is based on a very different architecture and sometimes makes subtly different predictions. According to the standard analysis of degree questions, the logical form of a degree question contains a variable that ranges over individual degrees and is bound by the degree question operator how. In contrast with this, we claim that the variable bound by the degree question operator how does not range over individual degrees but over intervals of degrees, by analogy with Schwarzschild and Wilkinson's proposal regarding the semantics of comparative clauses. Not only does the interval-based semantics predict the existence (...) of certain readings that are not predicted under the standard view, it is also able, together with other natural assumptions, to account for the sensitivity of degree questions to negative islands, as well as for the fact, uncovered by Fox and Hackl, that negative islands can be obviated by some properly placed modals. Like Fox and Hackl, we characterize negative island effects as arising from the fact that the relevant question, due to its meaning alone, can never have a maximally informative answer. Contrary to Fox and Hackl, however, we do not need to assume that scales are universally dense, nor that the notion of maximal informativity responsible for negative islands is blind to contextual parameters. In assessing ethical issues concerning the sex-industry, feminist liberalism ought to combine the concern for the worker that is central to its treatment of prostitution, with sensitivity to the social and cultural embeddedness of self that is central to its treatment of pornography. That would enable us to then look at live-actor pornography as a form of prostitution that raises additional questions about third party consumption — and analysis both more theoretically coherent and practically useful.

_Prostitution and Pornography_ examines debates about the sex industry and the adequacy of the liberal response to critiques of the sex industry. The anthology focuses particularly on the very different ways prostitution and pornography are treated. Unlike other books that deal with the sex industry, this volume brings together academics and industry veterans and survivors to discuss the ways prostitution, pornography, and other forms of commercial sex are treated, and to ask questions about the role that ideas about the self, (...) personal identity, and freedom play in our attitudes about the sex industry. The sustainability movement, currently gathering considerable attention from architects, derives much of its moral foundation from the theoretical initiatives of environmental ethics. How is the value of sustainability to mesh with architecture’s time-tested values? The idea that an ethic of sustainability might serve architects’ efforts to reground their practices in something that opposes consumer values of the marketplace has intuitive appeal and makes a certain amount of sense. However, it is far from obvious that the sustainability movement provides a strong (...) enough conceptual framework for an entire designphilosophy. This issue is complicated by two different sustainable design outlooks which parallel two conceptions of environmental ethics: the practical and the radical. Neverthleless, sustainability need not resort to the philosophical excess of its radical branch to help foster a new public-spiritedness. (shrink)

Since it is Hume who famously asked how an "ought" can ever possibly be deduced from an "is," it is Hume who is typically cast as the representative of empiricism's inadequacy for doing the work of ethics. Yet, as I will show, in his description of the proper functioning of the passions that necessarily involve other persons and their evaluations of us, Hume provides a naturalistic description that is not reductive of value, but rather incorporates values into the very ground (...) of empirical description. Contemporary moral philosophers who dismiss Hume's complex account of the passions as unnecessary for understanding his account of morals, and then fault the account of morals for its failure to move beyond mere description to any kind of normative assessment, ignore how the detail of Hume's own account of the passions suggests a way that an empirical account can in fact be value-laden, as we shall see. For Locke, the personal identity problem was a moral problem from the beginning, an attempt to pin down the conditions for responsibility and accountability. This article discusses the implications of Locke's consciousness theory of personal identity for thought about the continuity of moral agency, arguing that Locke's treatment of personal identity is best understood in connection with his expanded discussion of liberty in the Essay and with his interest in the proper grounds for assessing responsibility for action. By grounding personal (...) identity in an agent's ability to recognize her actions as her own, Locke presents a picture of moral life compatible with skepticism about substance while not skeptical about morality. I argue that this description highlights some important features of self-awareness and personhood without resorting to any metaphysical suppositions such as soul, essence or spirit. (shrink)

:A good deal of contemporary moral nonconsequentialism assumes that agents have perfect knowledge about the various features and consequences of their options. This assumption is unrealistic. More often than not, moral agents can only assess with a certain degree of probability the factual circumstances that are morally relevant for their decision making. My aim in this essay is to discuss the problem of moral decisions under risk from the point of view of nonconsequentialism. Basically, I analyze how objective moral principles (...) can be transformed into subjective, decisional prescriptions, and argue that the standard nonconsequentialist approach to moral decision making, which focuses on probability thresholds, is wrong. In accordance with the fundamental postulates of nonconsequentialism, I seek to solve the problem of risk in moral choice by proposing a theory about the marginal moral value of various options. Actions can vary along various dimensions, and each of these dimensions can offer a different moral value function. Nonconsequentialist marginalism can level the playing field with consequentialism. Whereas consequentialism can simply borrow the notion of expected utility from economics, nonconsequentialism must introduce the notion of expectational obligation to formulate a general principle of moral choice under risk. I finally suggest that further empirical work is needed to delineate the shape of various moral value functions that are critical for applying the general principle of moral decision making under risk to well-known cases. The essence of the correspondence between Arendt and Scholem can be said to lie in three things. Above all it provides an intimate account of how two great intellectuals try to come to terms with being both German and Jewish, and how to think about Germany before, during, and after the Holocaust. They also debate the issue of what it means to be Jewish in the post-Holocaust world whether in New York or in Jerusalem. Finally, the specter of Benjamin haunts (...) the work and in a sense the letters are as much about Benjamin as the other two questions since his life and tragic death epitomize them both. Arendt and Scholem's letters on these weighty questions are lightened by more routine exchanges: on travel itineraries, lunch or dinner parties where important people were present, and so forth. These daily details are woven throughout the correspondence and provide vivid biographical information about Arendt and Scholem that is unavailable in any other source. (shrink)

Each of the books that Hannah Arendt published in her lifetime was unique, and to this day each continues to provoke fresh thought and interpretations. This was never more true than for Eichmann in Jerusalem, her account of the trial of Adolf Eichmann, where she first used the phrase “the banality of evil.” Her consternation over how a man who was neither a monster nor a demon could nevertheless be an agent of the most extreme evil evoked derision, outrage, (...) and misunderstanding. The firestorm of controversy prompted Arendt to readdress fundamental questions and concerns about the nature of evil and the making of moral choices. Responsibility and Judgment gathers together unpublished writings from the last decade of Arendt’s life, as she struggled to explicate the meaning of Eichmann in Jerusalem. We generalize the ultrapower in a way suitable for choiceless set theory. Given an ultrafilter, forcing is used to construct an extended ultrapower of the universe, designed so that the fundamental theorem of ultrapowers holds even in the absence of the axiom of choice. If, in addition, we assume DC, then an extended ultrapower of the universe by a countably complete ultrafilter must be well-founded. As an application, we prove the Vopěnka-Hrbáček theorem from ZF + DC only (the proof of (...) Vopěnka and Hrbáček used the full axiom of choice): if there exists a strongly compact cardinal, then the universe is not constructible from a set. The same method shows that, in L[ 2 ω ], there cannot exist a θ-compact cardinal less than θ (where θ is the least cardinal onto which the continuum cannot be mapped); a similar result can be proven for other models of the form L[ A ]. The result for L[ 2 ω ] is of particular interest in connection with the axiom of determinacy. The extended ultrapower construction of this paper is an improved version of the author's earlier pseudo-ultrapower method, making use of forcing rather than the omitting types theorem. (shrink)
