Corpus linguistics is becoming a respected method of statutory and constitutional interpretation in the United States over the past decade, yet it has also generated a backlash from a group of scholars that engage in empirical work. This essay attempts to demonstrate both the contributions and the risks of using linguistic corpora as a primary tool in legal interpretation. Its legitimacy stems from the fact that courts routinely state that statutory terms, when not defined as a matter of law, are (...) to be given their ordinary meaning. Judges have responded to this challenge, with the assistance of the linguistics community, by using corpora to determine which meanings are ordinary. However, legal analysts have not determined exactly what makes one meaning ordinary and another not ordinary. This gap has led to a level of disagreement in the field. Moreover, while linguists who engage in corpus linguistic analysis typically emphasize the importance of context, the legal application is peculiarly context-free, in keeping with legal philosophies that eschew reliance on reference to a law’s purpose and the intent of the legislature that enacted it. This move adds a political dimension to corpus analysis as a means of legal interpretation. Yet, the article concludes that by relying on a blend of general and specialized corpora, the legal system can substantially reduce the problem of contextualization, as some linguists and practitioners have already recognized. Prior to the twentieth century, theories of knowledge were inherently perceptual. Since then, developments in logic, statis- tics, and programming languages have inspired amodal theories that rest on principles fundamentally different from those underlying perception. In addition, perceptual approaches have become widely viewed as untenable because they are assumed to implement record- ing systems, not conceptual systems. A perceptual theory of knowledge is developed here in the context of current cognitive science and neuroscience. During perceptual experience, association areas in the (...) brain capture bottom-up patterns of activation in sensory-motor areas. Later, in a top-down manner, association areas partially reactivate sensory-motor areas to implement perceptual symbols. The stor- age and reactivation of perceptual symbols operates at the level of perceptual components – not at the level of holistic perceptual expe- riences. Through the use of selective attention, schematic representations of perceptual components are extracted from experience and stored in memory (e.g., individual memories of green, purr, hot). As memories of the same component become organized around a com- mon frame, they implement a simulator that produces limitless simulations of the component (e.g., simulations of purr). Not only do such simulators develop for aspects of sensory experience, they also develop for aspects of proprioception (e.g., lift, run) and introspec- tion (e.g., compare, memory, happy, hungry). Once established, these simulators implement a basic conceptual system that represents types, supports categorization, and produces categorical inferences. These simulators further support productivity, propositions, and ab- stract concepts, thereby implementing a fully functional conceptual system. Productivity results from integrating simulators combinato- rially and recursively to produce complex simulations. Propositions result from binding simulators to perceived individuals to represent type-token relations. Abstract concepts are grounded in complex simulations of combined physical and introspective events. Thus, a per- ceptual theory of knowledge can implement a fully functional conceptual system while avoiding problems associated with amodal sym- bol systems. Implications for cognition, neuroscience, evolution, development, and artificial intelligence are explored. (shrink)

Friendship, Altruism, and Morality, originally published in 1980, gives an account of "altruistic emotions" and friendship that brings out their moral value. Blum argues that moral theories centered on rationality, universal principle, obligation, and impersonality cannot capture this moral importance. This was one of the first books in contemporary moral philosophy to emphasize the moral significance of emotions, to deal with friendship as a moral phenomenon, and to challenge the rationalism of standard interpretations of Kant, although Blum’s "sentimentalism" owes more (...) to Schopenhauer than to Hume. It was a forerunner to care ethics, and feminist ethics more generally; to virtue ethics; and to subsequent influential interpretations of Kant that attempted to room for altruistic emotion and friendship, and other forms of particularism and partialism. El presente artículo se centra en el estudio de la interpretación del Sofista, de Platón, desarrollada por Heidegger en las lecciones del semestre de invierno de 1924/25 en la Universidad de Marburgo. En particular, en él se ofrece una reconstrucción de la lectura heideggeriana a este diálogo desde la perspectiva que abre la consideración de la filosofía como un modo de existencia. Con este objetivo, se analizan dos claves centrales del comentario de Heidegger: la contraposición de la filosofía con la (...) sofística y la contraposición de la filosofía con la adhesión dogmática a unos principios de escuela. En la parte final del artículo se desarrollan también algunas implicaciones del análisis anterior para la interpretación de la función del interlocutor principal de este diálogo, el Extranjero de Elea, así como de la naturaleza de la investigación filosófica tal y como es presentada por Platón en el Sofista. En definitiva queremos hacer una apología de los pobres, marginados y excluidos en el mundo y, en particular, en las democracias occidentales que se abrogan y llevan a gala el título de democracias incluyentes, que ayude a estas personas a tener una nueva oportunidad (...) que les saque de la pobreza. En el presente artículo nos proponemos realizar una comparación de la posición de D’Agostino con la de otro de los representantes del convencionalismo: William Morgan. A D’Agostino nos referiremos en el primer apartado y a Morgan en el segundo. Nos preguntaremos si Morgan, además de inscribir sus tesis dentro del convencionalismo, participa al mismo tiempo de la concepción internalista del deporte. Aunque uno y otro autor son convencionalistas, existen matices muy distintos entre sus posiciones que caben ser resaltadas, a fin (...) de clarificar su proximidad con otras teorías filosófico-deportivas. In this paper we propose a comparison of the position of D’Agostino with other rpresentatives of convention: Wilüam Morgan. We refer to D’Agostino’s position in the first section and in the second section to Morgan ’s. We ask whether Morgan, moreover of register his thesis within the Conventionalism, participaos also of the internaüst conception of sport. Although both authors are conventionalists, there are many different shades that fit between their positions be highüghted, in order to clarify its proximity to other phihsophical theories of port. En este artículo presento de forma crítica la propuesta de ética del deporte como «bolsa de virtudes» que elaboran tres autores estadounidenses que son Lumpkin, Stoll y Beller. Dicha propuesta debe entenderse como una manifestación de sustancialismo neoaristotélico en deporte, con una clara influencia de MacIntyre. Mi objetivo es mostrar cómo dicho sustancialismo no es suficiente para una propuesta ética del deporte, por lo que abogo por incorporar algunos de los presupuestos del procedimentalismo ético aplicado al deporte. In this article (...) the author presents critically the proposed sports ethics as «bag of virtues» that Americans made three authors are Lumpkin, Stoll and Beller. This proposal should be seen as a manifestation of substantialism neoaristhotelic in sport, with a clear influence of MacIntyre. My aim is to show how such substantialism not enough for a sports ethics proposal therefore advocate incorporate some of the ethical proceduralism budgets applied to sport. (shrink)

Para ello, se abordan los problemas planteados por la crítica reciente en lo que respecta a la aparente incompatibilidad de dicha atribución con (1) el reconocimiento explícito en _ Gorgias _ de no poseer un saber referido a lo justo, y (2) la aparente invalidez de la actividad desarrollada por Sócrates para contar, bajo los criterios que él mismo (...) establece en el _ Gorgias _, como efectivamente política. El trabajo responde a estas dificultades realizando un análisis del tipo de naturaleza que Sócrates atribuye a su propio saber en esta obra, así como de los efectos que su actividad dialógica demuestra ser capaz de producir sobre Calicles. De este modo, el artículo permite aclarar en qué sentido Sócrates es presentado en el _ Gorgias _ como el verdadero político. The tendency to reciprocate – to return good for good and evil for evil – is a potent force in human life, and the concept of reciprocity is closely connected to fundamental notions of ‘justice’, ‘obligation’ or ‘duty’, ‘gratitude’ and ‘equality’. In _Reciprocity_, first published in 1986,_ _Lawrence Becker presents a sustained argument about reciprocity, beginning with the strategy for developing a moral theory of the virtues. He considers the concept of reciprocity in detail, contending that it is a basic (...) virtue that provides the basis for parental authority, obligations to future generations, and obedience to law. Throughout the first two parts of the book, Becker intersperses short pieces of his own narrative fiction to enrich reflection on the philosophical arguments. The final part is devoted to extensive bibliographical essays, ranging over anthropology, psychology, political theory and law, as well as the relevant ethics and political philosophy. (shrink)

Thirty years ago, grounded cognition had roots in philosophy, perception, cognitive linguistics, psycholinguistics, cognitive psychology, and cognitive neuropsychology. During the next 20 years, grounded cognition continued developing in these areas, and it also took new forms in robotics, cognitive ecology, cognitive neuroscience, and developmental psychology. In the past 10 years, research on grounded cognition has grown rapidly, especially in cognitive neuroscience, social neuroscience, cognitive psychology, social psychology, and developmental psychology. Currently, grounded cognition appears to be achieving increased acceptance throughout cognitive (...) science, shifting from relatively minor status to increasing importance. Nevertheless, researchers wonder whether grounded mechanisms lie at the heart of the cognitive system or are peripheral to classic symbolic mechanisms. Although grounded cognition is currently dominated by demonstration experiments in the absence of well-developed theories, the area is likely to become increasingly theory driven over the next 30 years. Another likely development is the increased incorporation of grounding mechanisms into cognitive architectures and into accounts of classic cognitive phenomena. As this incorporation occurs, much functionality of these architectures and phenomena is likely to remain, along with many original mechanisms. Future theories of grounded cognition are likely to be heavily influenced by both cognitive neuroscience and social neuroscience, and also by developmental science and robotics. Aspects from the three major perspectives in cognitive science—classic symbolic architectures, statistical/dynamical systems, and grounded cognition—will probably be integrated increasingly in future theories, each capturing indispensable aspects of intelligence. The dispute about the role of class in understanding the life situations of people of color has tended to be overpolarized, between a class reductionism and an “it's only race” position. Class processes shape racial groups’ life situations. Race and class are also distinct axes of injustice; but class injustice informs racial injustice. Some aspects of racial injustice can be expressed only in concepts associated with class (e.g., material deprivation, inferior education). But other aspects of racial injustice or other harms, (...) such as racial discrimination or stigma, are not reducible to class concepts and cannot be fully addressed through class-focused policies. Overall, any attempt to fully secure racial justice for a racial group will require a combination of race-focused and class-focused policies. Anti-racist outlooks often neglect or downplay either the normative or the explanatory significance of class, or both—for example, by overlooking or downplaying the dignitary harms of class and the material harms of race; missing the historical dimension of class injustice; masking class by a narrowing of the complex normative structure of racial disparities; or not recognizing that a class-focused initiative (like raising the minimum wage) can address substantial racial justice concerns, even though not all of them. “Systemic racism” terminology recognizes class explanatorily but suppresses it normatively. Charles Mills's influential notion of “white supremacy,” while a powerful tool for conceptualizing and illuminating racial injustice, can also contribute to minimizing or masking the justice-related impact of class, as do some of Mills's specific discussions of class in various writings. Chimpanzee behaviour with mirrors makes it plausible that they can recognise themselves as themselves in mirrors, and so have a 'self-concept'. I defend this claim, and argue that roughly similar behaviour in pigeons, as reported, does not in fact make it equally plausible that they also have this mental capacity. But for all that it is genuine, chimpanzee self-consciousness may differ significantly from ours. I describe one possibility I believe consistent with the data, even if not very plausible: that the (...) chimpanzee is aware of itself only as a material being, and not as a subject of any psychological states. As I try to make clear, this possibility exists even if the chimpanzee has psychological states, and is aware of some of them. (shrink)

_Property Rights: Philosophic Foundations,_ first published in 1977, comprehensively examines the general justifications for systems of private property rights, and discusses with great clarity the major arguments as to the rights and responsibilities of property ownership. In particular, the arguments that hold that there are natural rights derived from first occupancy, labour, utility, liberty and virtue are considered, as are the standard anti-property arguments based on disutility, virtue and inequality, and the belief that justice in distribution must take precedence over (...) private ownership. Lawrence Becker goes on to contend that there are four sound lines of argument for private property that, together with what is sound in the anti-property arguments, must be co-ordinated to form the foundations of a new theory. He therefore expounds a concise but sophisticated theory of property that is relevant to the modern world, and concludes by indicating some of the implications of his theory. (shrink)
