The trans-jurisdictional discourse on criminal justice is often hampered by mutual misunderstandings. The translation of legal concepts from English into other languages and vice versa is subject to ambiguity and potential error: the same term may assume different meanings in different legal contexts. More importantly, legal systems may choose differing theoretical or policy approaches to resolving the same issues, which sometimes – but not always – lead to similar outcomes. Bullying often results in negative coping in victims, including an increased consumption of alcohol. Recently, however, an increase in alcohol use has also been reported among perpetrators of bullying. The factors triggering this pattern are still unclear. We investigated the role of empathy in the interaction between bullying and alcohol use in an adolescent sample (IMAGEN) at age 13.97 (±0.53) years (baseline (BL), N = 2165, 50.9% female) and age 16.51 (±0.61) years (follow-up 1 (FU1), N = 1185, 54.9% female). (...) General empathic distress served as a significant moderator of alcohol use in perpetrators (F9, 493 = 17.978, p < 0.01), which was specific for males and FU1. Male perpetrators, who are generally less sensitive to distress, might thus be more vulnerable to alcohol abuse. (shrink)

Extensive research has demonstrated that rs1360780, a common single nucleotide polymorphism within the FKBP5 gene, interacts with early-life stress in predicting psychopathology. Previous results suggest that carriers of the TT genotype of rs1360780 who were exposed to child abuse show differences in structure and functional activation of emotion-processing brain areas belonging to the salience network. Extending these findings on intermediate phenotypes of psychopathology, we examined if the interaction between rs1360780 and child abuse predicts resting-state functional connectivity (rsFC) between the amygdala (...) and other areas of the salience network. We analyzed data of young European adults from the general population (N = 774; mean age = 18.76 years) who took part in the IMAGEN study. In the absence of main effects of genotype and abuse, a significant interaction effect was observed for rsFC between the right centromedial amygdala and right posterior insula (p <.025, FWE-corrected), which was driven by stronger rsFC in TT allele carriers with a history of abuse. Our results suggest that the TT genotype of rs1360780 may render individuals with a history of abuse more vulnerable to functional changes in communication between brain areas processing emotions and bodily sensations, which could underlie or increase the risk for psychopathology. This article focuses on the controversy between Reinhold Niebuhr and John Dewey about the function of religion and religious institutions in a democratic society. It shows how Dewey positions his concept of a “common faith” within his project of democratic experimentalism, before revisiting Niebuhr’s criticism of this concept and particularly its anthropological inclinations. Subsequently, the article highlights the affinity of Niebuhr’s interpretation of Dewey’s A Common Faith to Eric Voegelin’s concept of political religions and compares the different concepts of transcendence (...) involved in Dewey’s and Niebuhr’s thinking (with special focus on Niebuhr’s The Nature and Destiny of Man). Niebuhr’s accusation of a shallow progressivism against Dewey is refuted with reference to Dewey’s concept of immanent transcendence. Finally, the potential of Dewey’s A Common Faith for the clarification of the concept of civil religion is discussed against the backdrop of Robert Bellah’s use of this concept. (shrink)

Visualization in 19th-century German geography: Robert Schlagintweit and Hans Meyer as examples. – Visual representations of nature formed an essential part of 19th-century earth sciences. In particular, colonial photography – as a visual source, and as an instrument of the construction of national identities – serves essential research interests of current history and social sciences. The present paper is a case study on the role and function of photography in German geography of the 19th and early 20th centuries. It (...) focuses on the work of the Munich geographer Robert Schlagintweit and the Leipzig colonial geographer Hans Meyer ; the early history of photography in India and the function of images in the geographical exploration of overseas territories are discussed. Although there is nearly half a century between the work of R. Schlagintweit and H. Meyer, their photography shows remarkable parallels. The ideas of both on the practice of visualization are rooted in pedagogic and didactic concepts as well as in popular science. For both geographers photography was essentially a technical help, which often needed graphic revisions. And they both preferred photography to depict people and buildings . Concerning the more comprehensive question of how far their photography transmitted a specific German ‘image of abroad’, it is indicated that such a specific image should have its essential roots in a peculiar visual culture of German earth sciences in the first half of the 19th century. Thus the paper offers a starting point for further studies discussing the change from a ‘Biedermeier image’ of foreign cultures to a more ‘colonial’ one in 19th-century German geography. (shrink)

Seven unknown letters from 1823 to 1831 are published. The famous discoverer of the mammal's egg and founder of the modern embryology Karl Ernst von Baer (1792–1876), born as a German in Estonia and then anatomist and zoologist at Königsberg University, wrote them to his publisher Ludwig F. Froriep in Weimar and his son and successor. Robert F. Baer offered his co-work with a dictionary of natural history (which he criticized), he proposed a map of all research voyages everywhere (...) in the world, and he sent a few small papers about local birds. To Robert F. Baer gave some recommendations concerning his career; he asked for details of a death elephant, and he told that they were awaiting the cholera. (shrink)

The concept of spontaneous order is an important framework in many fields of research in the natural and social sciences today, and it bears heavily on methodological problems related to economics in particular. In fact, all domains of scientific and philosophical research where it can be maintained intelligibly that an undesigned but nevertheless effective order has emerged solely through the interaction of the constituent parts of a given system and also through the interaction of this system as a whole with (...) its environment fall under what is now often preferably called the "paradigm of auto-organization". This paradigm can be traced back to Leibniz (Dobuzinkis 1989, p. 245) or even to the Spanish Jesuits of the Salamanca School of the XVIth century (Lepage 1983, p. 347), and a lot of scientific work has now been done from within its conceptual framework, for instance Varela & Maturana's theory of "autopoiesis", Heinz von Foerster's second generation cybernetic models, Ilya Prigogine's thermodynamics of open systems and dissipative structures, and chaos theory. In economics, the concept of social spontaneous order is intimately linked with Friedrich Hayek's work, and Hayek has himself insisted on the effective kinship of such approaches (Hayek 1979, p. 158). One can say that there is today in economics a full-fledged Theory of Spontaneous Order (TSO) which articulates four distinct arguments. (shrink)

This article elaborates a claim, first introduced by Wilhelm Dilthey, that metaphysics represents an illusory flight from the tragedy of human finitude. Metaphysics, of which psychoanalytic metapsychologies are a form, transforms the unbearable fragility and transience of all things human into an enduring, permanent, changeless reality, an illusory world of eternal truths. Three “clinical cases” illustrate this thesis in the work and lives of a philosopher and two psychoanalytic theorists: Friedrich Nietzsche and his metaphysical doctrine of the eternal return of (...) the same, Sigmund Freud and his dual instinct theory, and Heinz Kohut and his theoretical language of the self. It is contended that the best safeguard against the pitfalls of metaphysical illusion lies in a shared commitment to reflection on the constitutive contexts of all our theoretical ideas. (shrink)

This article offers a comprehensive and critical analysis of Eric Heinze’s book Hate Speech and Democratic Citizenship (Oxford University Press, 2016). Heinze’s project is to formulate and defend a more theoretically complex version of the idea (also defended by people like Ronald Dworkin and James Weinstein) that general legal prohibitions on hate speech in public discourse compromises the state’s democratic legitimacy. We offer a detailed synopsis of Heinze’s view, highlighting some of its distinctive qualities and strengths. We then develop a (...) critical response to this view with three main focal points: (1) the characterisation of democratic legitimacy as something distinct from (and whose demands aren’t identical with those of) legitimacy per se; (2) the claim that the requirements of democracy are hypothetical, rather than categorical, imperatives; and relatedly (3) the question of how we should reconcile the requirements of democratic legitimacy with the costs that may follow from prioritising democratic legitimacy. We argue that there are significant difficulties for Heinze’s account on all three fronts. (shrink)

Summary: Because this book has something of the storytelling of cheerful meetings, von Foerster is made more accessible to the novice; however, it does not lose any of its intellectual sharpness. Henri Atlan and Edgar Morin, in particular, greatly influenced by von Foerster and quite famous in French-speaking countries, give a helping hand to those who wish to explore their work further from the perspective of von Foerster's vision and thoughts. And Atlan and Morin take also the credit for the (...) fact that von Foerster has become better known in the French-speaking community. Let us a hope the book will contribute to the further spread of von Foerster's ideas. (shrink)

This paper offers an overview of "the species problem", arguing for a view of species as homeostatic property cluster kinds, positioning the resulting form of realism about species as an alternative to the claim that species are individuals and pluralistic views of species. It draws on taxonomic practice in the neurosciences, especially of neural crest cells and retinal ganglion cells, to motivate both the rejection of the species-as-individuals thesis and species pluralism.

Drawing on a passage from Ramsey's Truth and Probability, we formulate a simple, plausible constraint on evaluating the accuracy of credences: the Calibration Test. We show that any additive, continuous accuracy measure that passes the Calibration Test will be strictly proper. Strictly proper accuracy measures are known to support the touchstone results of accuracy-first epistemology, for example vindications of probabilism and conditionalization. We show that our use of Calibration is an improvement on previous such appeals by showing how it answers (...) or sidesteps problems that have been raised for previous work in this area. (shrink)
