Este texto es el resultado de un ejercicio crítico de lectura, de mi lectura de Derrida como lector de Freud. A partir del análisis que hace Derrida en su ensayo "Freud y la escena de la escritura", discuto la necesidad de radicalizar algunas de las consecuencias que se siguen de la analogía que Freud establece entre el aparato psíquico y cierta máquina de escritura. Uno de los fenómenos que se desprenden de pensar la psique como un texto es que el (...) sujeto habita incesantemente en la tensión de un entre: entre la herencia y lo porvenir. Este entre devela una temporalidad sui géneris donde los tiempos pasado, presente y futuro se mezclan y se funden. This essay is the result of a critical reading exercise, of my reading of Derrida as a reader of Freud. From Derrida's analysis in his text "Freud and the Scene of Writing", I argue the necessity of radicalizing some consequences that emerge from the analogy established by Freud between the psychic apparatus, and a certain writing machine. One of the phenomena that thinking the psyche as a text points to is that the subject relentlessly dwells in the tension of a between: between the inherited and what is to come. This between unveils a sui generis temporality where past, present and future mingle and fuse. (shrink)

An important historical relation that has hardly been addressed is the influence of Prosper Lucas's Treatise on Natural Inheritance on the development of Charles Darwin's concepts related to inheritance. In this article we trace this historical connection. Darwin read Lucas's Treatise in 1856. His reading coincided with many changes concerning his prior ideas on the transmission and expression of characters. We consider that this reading led him to propose a group of principles regarding prepotency, hereditary diseases, morbid tendencies and atavism; (...) following Lucas, he called these principles: laws of inheritance. El propósito de este artículo es explorar el poder curativo que tienen el relato y la escucha psicoanalítica del trauma para recuperar la agencia que la violencia ha arrebatado. Desde la teoría freudiana del trauma, la de la sujeción de Judith Butler y la de la acción de Hannah Arendt, analizaré cómo la agencia no es un a priori pleno, sino una construcción a posteriori que se logra, retardadamente, en el discurso que se narra para un otro que escucha.

Resumen En esta discusión expongo algunas objeciones a las siguientes tesis de Velázquez 2020: 1) que tanto Descartes como Frege sostienen que las entidades aritméticas son irreductibles a procesos empíricos; 2) que, en el caso de Descartes, dichas entidades son “perennes, inherentes a la propia constitución y funcionamiento de la mente” y 3) que Frege impugnó la filosofía matemática de Mill por psicologista. Sostengo que la segunda tesis no es, per se, controversial, pero que sí lo es en el contexto (...) del artículo de Velázquez.In this discussion I present objections to the following theses in Velázquez 2020: 1) that both Descartes and Frege maintain that arithmetic entities are irreducible to empirical processes; 2) that, in the case of Descartes, these entities are “perennial, inherent to the very constitution and functioning of the mind”, and 3) that Frege contested Mill’s mathematical philosophy for being psychologistic. RESUMEN Partiendo de algunas experiencias del presente, se retoma la interpretación nietzs cheana del resentimiento para explorar la complejidad y ambivalencia del fenómeno e iluminar cuestiones actuales. Así, se vinculan dos tendencias y sus implicaciones: cómo el resentimiento genera la fijación de una identidad amenazadora que lleva a la estigmatización de un otro, a la vez como una forma de rechazo de la contingencia histórica; y cómo el vínculo del resentimiento con la temporalidad, en particular con un tipo de memoria, (...) produce una incapacidad para asumirla creadoramente. Esta reflexión deja abiertas preguntas sobre cómo los cuerpos afectados por el resen timiento pueden revertirlo y dar lugar a formas más vitales de relación con el mundo. ABSTRACT On the basis of selected experiences from the present, the article revisits the Nietzschean interpretation of resentment in order to explore the complexity and ambivalence of the phenomenon and shed light on current issues. To that effect, it connects two tendencies and their implications: the manner in which resentment generates the fixation of a threatening identity that leads to the stigmatization of an other, which, at the same time, involves a rejection of historical contingency; and the manner in which the link between resentment and temporality, in particular with a type of memory, produces an incapacity to assume it creatively. This reflec tion leaves questions open regarding how bodies affected by resentment can twist it around and give rise to more vital forms of relating to the world. (shrink)

ABSTRACT Recently, the hypothesis that purely evaluative disputes are metalinguistic negotiations has gained traction. I resist a strong version of that hypothesis, and argue that some of those disputes are not metalinguistic negotiations. To defend that claim, I argue that metalinguistic negotiations have three linguistic properties that some purely evaluative disputes lack. First, in a metalinguistic negotiation it is felicitous to embed the dispute-initial statement under the subjective attitude verb consider; second, a speaker can reply to that initial statement by (...) using a metalinguistic comparative; and, third, such negotiations address metalinguistic questions under discussion. Some purely evaluative disputes lack these properties, which suggests that they are not metalinguistic negotiations. (shrink)

In doing so, it has concerned itself mostly with such bounded contexts as voluntary simplifiers, anti-consumption movements or so-called ‘ethical consumers,’ thereby fostering an artificial opposition between ethical and non-ethical consumption. This paper proposes virtue ethics as a more apt conceptual framework for the ethical analysis of consumption because it takes into account the developmental dynamic triggered by engagement in consumption (...) practices. We build on MacIntyre's goods-virtues-practices-institutions framework and Beabout's concept of a domain-relative practice and argue that when engaging in consumption activities, agents may pursue goods internal to practices, further their individual life narratives and contribute to the good of their communities, thus developing virtues that perfect themselves both as consumers and as ethical agents. I defend a metalinguistic account of Mates's puzzle: sentences where synonymous expressions cannot be substituted salva veritate. If Andrea thinks that attorneys are different from lawyers, and she thinks that Fiona is the former but not the latter, we may hesitate to substitute ‘lawyer’ for ‘attorney’ in ‘Andrea believes that Fiona is an attorney’, even though ‘lawyer’ and ‘attorney’ are synonymous. I argue that these sentences report de re beliefs about linguistic expressions, thereby blocking such substitutions, and I offer a (...) compositional derivation of their meaning. (shrink)

I argue against the view that metalinguistic usage is a form of conversational implicature. That view, suggested by Thomasson (Anal Philos 57(4):1-28, 2016) and Belleri (Philos Stud 174(9):2211–2226, 2017), has been most recently fleshed out by Mankowitz (Synthese 199:5603–5622, 2021). I provide two types of criticism to the implicature view. From an empirical point of view, metalinguistic usage differs in key respects from standard cases of conversational implicature. From a conceptual standpoint, I argue that the calculation algorithm provided by the (...) implicature view makes undesirable predictions. Although my main objective is negative, I end the paper by sketching an alternative neo-Stalnakerian view of metalinguistic usage, that can be gathered from work by Barker (Linguist Philos 25(1):1–36, 2002; Inquiry 56(2–3):240–257, 2013) and others. It has been argued that moral assertions involve the possession, on the part of the speaker, of appropriate non-cognitive attitudes. Thus, uttering ‘murder is wrong’ invites an inference that the speaker disapproves of murder. In this paper, we present the result of 4 empirical studies concerning this phenomenon. We assess the acceptability of constructions in which that inference is explicitly canceled, such as ‘murder is wrong but I don’t disapprove of it’; and we compare them to similar constructions involving ‘think’ (...) instead of ‘disapprove’—that is, Moore paradoxes (‘murder is wrong but I don’t think that it is wrong’). Our results indicate that the former type of constructions are largely infelicitous, although not as infelicitous as their Moorean counterparts. (shrink)

El presente artículo tiene por objetivo revisar y cuestionar algunos conceptos tradicionales cuando se aborda la temática de las personas adultas mayores, con la finalidad de analizar de manera cronológica y desde una perspectiva de derechos humanos, la normatividad legal que dispuso y prorrogó la cuarentena focalizada en tiempos 1de pandemia a causa del COVID-19. Sustentando que las medidas legales adoptadas fueron discriminatorias por razón de edad, no sólo significando la privación del derecho a la libertad de tránsito, sino que (...) además afectó otros derechos humanos y libertades fundamentales. En este trabajo se revisan las tesis centrales del pensamiento de Ockham —representacionismo, voluntarismo, contingentismo— y la critica de L. Polo a las mismas. Se divide en tres partes: teoria del conocimiento, psicologia y ética, y metafísica.

The ethic of care has often been opposed to the ethic of justice as offering a different and even a contradictory approach to moral problems. This article argues that, from the perspective of the discourse ethic, both approaches are complementary in a very fundamental sense, since each one applies to one of two stages of moral reasoning that are as different as they are interconnected. It argues, in particular, that while justice is concerned with the justification and elaboration of norms, (...) care is concerned with finding a solution for specific moral situations. The article then places considerations of care at the centre of ideal discourse and subordinates the importance of rational understanding and moral justification to intuitive communication. (shrink)

En Suárez no se encuentra un tratamiento sistemático del derecho en sentido subjetivo, pero el Dr. Eximio dispuso de una elaborada doctrina sobre esta cuestión. Suárez entiende el derecho en sentido subjetivo como una potestad o facultad moral del sujeto que se funda en su naturaleza racional. Su pensamiento sobre el particular, especialmente su doctrina sobre el derecho a la propiedad privada, parece haber ejercido una amplia influencia en la Inglaterra del siglo XVII.

En este artículo analizaré algunos puntos de convergencia entre la filosofía transhumanista y la crítica filosófica contemporánea al antropocentrismo. Para ello distinguiré entre un tipo de programa normativo fuerte y uno débil en el transhumanismo. El argumento central reside en que la normatividad fuerte en el discurso transhumanista, al suponer que es posible seleccionar exclusivamente las características “propiamente humanas” para ser conservadas en el estadio post-humano, se basa en una concepción pre-darwiniana de la especie humana, lo cual posee implicancias tanto (...) epistemológicas como éticas. El jesuita Francisco Suárez como eminente teólogo, filósofo y jurista de su época juega un papel relevante como precedente en la construcción de las categorías del pensamiento moderno. Una de estas categorías, no contemporánea del doctor eximio, es la de los derechos humanos. Son muchos los autores que anticipan alguno de sus elementos fundamentales ya en el pensamiento en torno al Derecho que desarrolla Francisco Suárez en sus principales tratados de filosofía jurídica y política como el De Legibus y la (...) Defensio fidei. En este trabajo trataremos de conectar la virtualidad del planteamiento suarista en el ámbito de los derechos humanos, explorando en su obra estos antecedentes y la dirección en la que los mismos se dirigen, así como las posibilidades de dialogo que abre en torno a la construcción de la concepción de los derechos humanos en el contexto actual. Using a comprehensive sample of U.S. non-profit hospitals from 2011 to 2015, we examine the effects of state community benefits regulation on the amount of charity care provided by and the operational efficiency of U.S. non-profit hospitals. First, we document that, under such regulations, non-profit hospitals provide more charity care and less compensated care as a proportion of net revenue. We infer from these findings that CBR has the potential to increase both non-profit hospitals’ amount of charity care and their (...) efficiency of operations. Second, by examining variation in CBR types, we find no differences between having provision or having reporting requirements on the amount of charity care offered. Moreover, when we consider CBR with both provision and reporting requirements, the combination of these two requirements does not incrementally enhance charity care offerings, suggesting that the requirements may serve as substitutes with comparable effect. Lastly, we show that several state-level characteristics influence the relationship between CBR and charity care: CBRs in states with a higher gross domestic product and percentage of revenue received in taxes have incrementally lower associations with charity care, while hospitals in states where populations have, on average, higher household incomes have greater associations between CBR and charity care. Our findings highlight the effects that state-enacted regulation can have on socially beneficial behavior by non-profits. (shrink)

Objectives—To assess the relationship between the approval of trials by a research ethics committee and the fact that informed consent from participants was obtained, with the quality of study design and methods.Design—Systematic review using a standardised checklist.Main measures—Methodological and ethical issues of all trials published between 1993 and 1995 in the New England Journal of Medicine, the Lancet, the Journal of the American Medical Association and the British Medical Journal were studied. In addition, clinical trials conducted in Spain and published (...) by at least one Spanish author during the same period in any other journal were also included.Results—We studied the published articles of 767 trials and found the following indicators of lower methodological quality to be independent predictors for failure to disclose REC approval or ICP: absence of concealment of allocation, lack of justification for unblinded trials, not using a treatment for the patients in the control group, absent information on statistical methods, not including sample size estimation, not establishing the rules to stop the trial, and omitting the presentation of a baseline comparison of groupsConclusion—Trials of higher methodological and scientific quality were more likely to provide information about their ethical aspects. En este artículo se propone una traducción a la lengua castellana de dicho fragmento griego y se analiza la digresión por parte del autor del texto hímnico, tratando de arrojar luz sobre el (...) contexto de producción y ejecución del kontákion en honor del santo tesalonicense. Prisoners sometimes die in prison, either due to natural illness, violence, suicide, or a result of imprisonment. The purpose of this study is to understand deaths in custody using qualitative methodology and to argue for a comprehensive definition of death in custody that acknowledges deaths related to the prison environment. Interviews were conducted with 33 experts, who primarily work as lawyers or forensic doctors with national and/or international organisations. Responses were coded and analysed qualitatively. Defining deaths in custody according to (...) the place of death was deemed problematic. Experts favoured a dynamic approach emphasising the link between the detention environment and occurrence of death rather than the actual place of death. Causes of deaths and different patterns of deaths were discussed, indicating that many of these deaths are preventable. Lack of an internationally recognised standard definition of death in custody is a major concern. Key aspects such as place, time, and causes of death as well as relation to the prison environment should be debated and incorporated into the definition. Systematic identification of violence within prison institutions is critical and efforts are needed to prevent unnecessary deaths in prison and to protect vulnerable prisoners. (shrink)

El artículo presenta los principales resultados de un estudio realizado entre 1998 y 2000 con hombres jóvenes de la Ciudad de Cali, Colombia, profundizando en sus prácticas de distinción en torno al cuerpo, la vestimenta, los espacios de sociabilidad, las mujeres como objetos de ostentación y sus dinámicas de prestigio. El estudio es desarrollado en base a observación participante y a la implementación de entrevistas con grupos de jóvenes entre 14 y 22 años, tanto de sectores medios bajos, como medios (...) altos, e indaga en sus opiniones sobre la moda, el prestigio, la distinción social y los comportamientos que otorgan o quitan el estatus.
