Public shaming plays an important role in upholding valuable social norms. But, under what conditions, if any, is it morally justifiable? Our aim in this paper is systemically to investigate the morality of public shaming, so as to provide an answer to this neglected question. We develop an overarching framework for assessing the justifiability of this practice, which shows that, while shaming can sometimes be morally justifiable, it very often is not. Samuelson's text was first published in 1948, and it immediately became the authority for the principles of economics courses. The book continues to be the standard-bearer for principles courses, and this revision continues to be a clear, accurate, and interesting introduction to modern economics principles. Bill Nordhaus is now the primary author of this text, and he has revised the book to be as current and relevant as ever.

This book is relevant for anyone involved in the practice of psychology and the social sciences more broadly: researchers, teachers, students, and practitioners. It challenges the status quo with regards to the way that psychology is done, and it offers a unified solution that encompasses both theory and methodology.

This study investigated faculty attitudes towards student violations of academic integrity in Canada using a qualitative review of 17 universities’ academic integrity/dishonesty policies combined with a quantitative survey of faculty members’ (N = 412) attitudes and behaviours around academic integrity and dishonesty. Results showed that 53.1% of survey respondents see academic dishonesty as a worsening problem at their institutions. Generally, they believe their respective institutional policies are sound in principle but fail in application. Two of the major factors identified by (...) faculty as contributing to academic dishonesty are administrative. Many faculty members feel unsupported by their administration and are reluctant to formally report academic dishonesty due to the excessive burdens of dealing with paperwork and providing proof. Faculty members also cite unprepared students and international students who struggle with language issues and the Canadian academic context as major contributors to academic dishonesty. This study concludes with recommendations for educators and recommendations for future research. (shrink)

The task of rhetorical role labeling is to assign labels (such as Fact, Argument, Final Judgement, etc.) to sentences of a court case document. Rhetorical role labeling is an important problem in the field of Legal Analytics, since it can aid in various downstream tasks as well as enhances the readability of lengthy case documents. The task is challenging as case documents are highly various in structure and the rhetorical labels are often subjective. Previous works for automatic rhetorical role identification (...) (i) mainly used Conditional Random Fields over manually handcrafted features, and (ii) focused on certain law domains only (e.g., Immigration cases, Rent law), and a particular jurisdiction/country (e.g., US, Canada, India). In this work, we improve upon the prior works on rhetorical role identification by proposing novel Deep Learning models for automatically identifying rhetorical roles, which substantially outperform the prior methods. Additionally, we show the effectiveness of the proposed models over documents from five different law domains, and from two different jurisdictions—the Supreme Court of India and the Supreme Court of the UK. Through extensive experiments over different variations of the Deep Learning models, including Transformer models based on BERT and LegalBERT, we show the robustness of the methods for the task. We also perform an extensive inter-annotator study and analyse the agreement of the predictions of the proposed model with the annotations by domain experts. We find that some rhetorical labels are inherently hard/subjective and both law experts and neural models frequently get confused in predicting them correctly. (shrink)

In a recent paper, Barrio, Tajer and Rosenblatt establish a correspondence between metainferences holding in the strict-tolerant logic of transparent truth ST+ and inferences holding in the logic of paradox LP+. They argue that LP+ is ST+’s external logic and they question whether ST+’s solution to the semantic paradoxes is fundamentally different from LP+’s. Here we establish that by parity of reasoning, ST+ can be related to LP+’s dual logic K3+. We clarify the distinction between internal and external logic and (...) argue that while ST+’s nonclassicality can be granted, its self-dual character does not tie it to LP+ more closely than to K3+. When the absence of an event causes some outcome, it is an instance of omissive causation. For instance, not eating lunch may cause you to be hungry. Recent psychological proposals concur that the mind represents causal relations, including omissive causal relations, through mental simulation, but they disagree on the form of that simulation. One theory states that people represent omissive causes as force vectors; another states that omissions are representations of contrasting counterfactual simulations; a third argues that people think about (...) omissions by representing sets of iconic possibilities – mental models – in a piecemeal fashion. In this paper, we tease apart the empirical predictions of the three theories and describe experiments that run counter to two of them. Experiments 1 and 2 show that reasoners can infer temporal relations from omissive causes – a pattern that contravenes the force theory. Experiment 3 asked participants to list the possibilities consistent with an omissive cause – it found that they tended to list particular privileged possibilities first, most often, and faster than alternative possibilities. The pattern is consistent with the model theory, but inconsistent with the contrast hypothesis. We marshal the evidence and explain why it helps to solve a long-standing debate about how the mind represents omissions. (shrink)

Ideas of love within religion are usually driven by one of two mythologies – either a personal God who commands love or a mystical God of ineffable love – but both are inadequate for motivating love of neighbour. The first tends towards legalism and the second offers no cognitive guidance. The situation is further complicated by there being different understandings of love of neighbour in the various Abrahamic religions, as exemplified in the approaches of two philosophers, Søren Kierkegaard and Emmanuel (...) Levinas. A better approach is therefore to explore actual practices of love in everyday life, and to discover how love might be performed openly and creatively. One such practice is recognition of vulnerability, and this too is often driven by a mythology, in this case one marked by fear, and by a violence either imposed or avoided. One paradigmatic example is the vulnerability felt by speakers, especially women, in front of an audience. A turning from wilful ignorance of vulnerability and a turning to reliance on collective work, modelled on an awareness of mutual vulnerability and openness to the unknown, will help to change our philosophical and social imaginary. The dark myth of vulnerability can be transformed into finding opportunities in vulnerability for openness to affection and so to an enhancement of life. It is only from the perspective of this new imaginary, and from everyday practices of it, that the double love-command – love of God and love of neighbour – will function as any kind of common ground between religions. People frequently entertain counterfactual thoughts, or mental simulations about alternative ways the world could have been. But the perceived plausibility of those counterfactual thoughts varies widely. The current article interfaces research in the philosophy and semantics of counterfactual statements with the psychology of mental simulations, and it explores the role of perceived similarity in judgments of counterfactual plausibility. We report results from seven studies (N = 6405) jointly supporting three interconnected claims. First, the perceived plausibility of a counterfactual event is (...) predicted by the perceived similarity between the possible world in which the imagined situation is thought to occur and the actual world. Second, when people attend to differences between imagined possible worlds and the actual world, they think of the imagined possible worlds as less similar to the actual world and tend to judge counterfactuals in such worlds as less plausible. Lastly, when people attend to what is identical between imagined possible worlds and the actual world, they think of the imagined possible worlds as more similar to the actual world and tend to judge counterfactuals in such worlds as more plausible. We discuss these results in light of philosophical, semantic, and psychological theories of counterfactual thinking. (shrink)

This article is a contribution to interdisciplinary scholarship addressing the presumption of innocence, especially interdisciplinary conversations between philosophers and jurists. Terminological confusion and methodological traps and errors notoriously beset academic literature addressing the presumption of innocence and related concepts, such as evidentiary presumptions, and the burden and standard of proof in criminal trials. This article is diagnostic, in the sense that its primary objective is to highlight the assumptions—in particular, the disciplinary assumptions—implicit in influential contributions to debates on the presumption (...) of innocence. It advocates a methodologically pluralistic approach, according to which definitions of the presumption of innocence are necessarily sensitive to purpose and method. These relationships and their implications are not always appreciated, and are seldom explicitly elucidated. Notably, philosophers routinely treat the presumption of innocence as epistemic, evidentiary or otherwise featuring directly in practical reasoning. This article identifies jurisprudential and practical reasons why legal scholars and practitioners concerned with criminal procedure and evidence should reject evidentiary interpretations of the presumption of innocence. By encouraging finer-grained engagement with the history and institutional details of common law procedural traditions, the article aims to show why legal scholars might think that philosophical approaches to the presumption of innocence are already methodologically-loaded and, for our purposes, address the wrong questions with deficient concepts. Goldin thus begins the book by asking the basic question "What are we reading?" while also considering why it has been so rarely asked. Yet far from denigrating Chinese philosophy, he argues that liberating these texts from the mythic idea that they are the product of a single great mind only improves our understanding and appreciation. By no means does a text require single and undisputed authorship to be meaningful; nor is historicism the only legitimate interpretive stance. This essay considers the question of conversion unto repentance, as an act of cognition and volition, by the separated soul in the post‐mortem state. It primarily explicates and interrogates Thomas Aquinas's various attempts to rule out this possibility for the damned. Since Thomas's arguments for such impossibility feature his commitment to the radical immateriality of the human soul—and, like it, the angelic spirit—the essay highlights the ontological and moral tensions within that account. The case is thus made for the ontological, (...) logical, and moral inconsistencies of his position, in pursuit of a more holistic anthropology across the soul's various states and a more rationally and coherent eschatology—namely, an affirmation of the irreducible mutability of the created soul on its way towards likeness to God, perhaps, if not certainly, towards universal salvation. In the fourth Immanuel Kant Lecture, Quine summons the specter of Kant’s Ding an sich, the thing in itself. Clearly antithetical to his naturalism, Quine quickly dismisses it as having feet of clay. Despite this short shrift, it is worth examining what he did say about the Ding an sich—in the Kant Lectures, in “Things and Their Place in Theories”, and in “Structure and Nature”. I offer a critical reading of these passages in the context of Quine’s proxy functions, ontological (...) relativity, and structure. I argue that Quine uses the Ding an sich as a foil for his anti-metaphysical, deflationary structuralism—a view that grounds objectivity in true statements, without any transcendental notion of objects, without the Ding an sich. From the mid-1960s until the late 1980s, the well-known general philosophies of science of the time were applied to economics. The result was disappointing: none seemed to fit. This paper argues that this is due to a special feature of economics: it possesses ‘orientational paradigms’ in high number. Orientational paradigms are similar to Kuhn’s paradigms in that they are shared across scientific communities, but dissimilar to Kuhn’s paradigms in that they are not generally accepted as valid guidelines for further research. As will be shown by several examples, orientational paradigms provide economics with common points of reference that support its epistemic coherence and make scientific discourse more easily possible across school boundaries. With the help of systematicity theory, a newer general philosophy of science, one can further elucidate the role of orientational paradigms with regard to scientific progress. (shrink)

Many philosophers maintain that there is a distinction between acts that the agent plays an active role in producing, and acts that issue from the agent in a more passive fashion. According to the standard account, we can make sense of this distinction by maintaining that reflective or deliberative acts are paradigmatic cases of an agent’s playing an active role in the production of action. This chapter argues that this standard account is mistaken. Reflective or deliberative actions will seem to (...) be active only if we conflate three claims: that choice causes action, that motives do not determine choice, and that reflection suspends the effects of motives. The chapter argues that while and are true, is false. Further, is needed to support the claim that reflective acts are active. Given the falsity of, the chapter shows that reflective acts are not necessarily more active than unreflective ones. The chapter closes by suggesting a new model of agential activity. (shrink)

A number of public controversies have emerged around forensic DNA testing backlogs at crime laboratories in the United States. This study provides a first look at public responses to such backlogs, using a controversy in the state of Wisconsin as a case study. First, it builds on research about public understandings of DNA and the “CSI effect” to develop a theoretical framework. Next, it explores news coverage of the Wisconsin backlog. It then uses survey data to show that public understandings (...) of DNA, media use, and demographic factors were related to how closely respondents followed the story about the backlog and/or how much they supported increased spending on DNA testing at the crime lab. Self-reported understanding of DNA predicted following the backlog, whereas perceived reliability of DNA evidence predicted both following the backlog and support. Total television viewing was not related to either following the backlog or support, but watching crime television predicted following the backlog. Reading a newspaper and watching local TV news each predicted following the backlog; reading a newspaper also predicted support. These results suggest a number of theoretical insights into how members of the public may reason about and draw on media messages regarding DNA and DNA testing in responding to forensic DNA testing backlogs. The article discusses the status and role of politics — in its various facets — in the pragmatic sociology of critique. We focus on a number of different dimensions of politics — politics-as-justification, politics-as-distribution, politics-as-constitution, and politics-as-defiance — that can said to be of importance for a pragmatic sociology of critique, but that have not all been taken up equally in this approach. We situate pragmatic sociology in a tradition of thought that views politics as emerging in the settlement of (...) disputes over differences without resorting to violence. However, we argue that pragmatic sociology tends to ignore questions of the constitution of politics, and suggest that one way of bringing the foundational aspect upfront is by conceptualizing and studying defiance, including forms of explicit (dissent) and implicit critique (resistance) of the existing order. Formulations of Anselm’s ontological argument have been the subject of a number of recent studies. We examine these studies in light of Anselm’s text and (a) respond to criticisms that have surfaced in reaction to our earlier representations of the argument, (b) identify and defend a more refined representation of Anselm’s argument on the basis of new research, and (c) compare our representation of the argument, which analyzes that than which none greater can be conceived as a definite description, to (...) a representation that analyzes it as an arbitrary name. Quantificational determiners are often said to be devices for expressing relations. For example, the meaning of _every_ is standardly described as the inclusion relation, with a sentence like _every frog is green_ meaning roughly that the green things include the frogs. Here, we consider an older, non-relational alternative: determiners are tools for creating restricted quantifiers. On this view, determiners specify how many elements of a restricted domain (e.g., the frogs) satisfy a given condition (e.g., being green). One important difference concerns (...) how the determiner treats its two grammatical arguments. On the relational view, the arguments are on a logical par as independent terms that specify the two relata. But on the restricted view, the arguments play distinct logical roles: specifying the limited domain versus supplying an additional condition on domain entities. We present psycholinguistic evidence suggesting that the restricted view better describes what speakers know when they know the meaning of a determiner. In particular, we find that when asked to evaluate sentences of the form _every F is G_, participants mentally group the Fs but not the Gs. Moreover, participants forego representing the group defined by the intersection of F and G. This tells against the idea that speakers understand _every F is G_ as implying that the Fs bear relation (e.g., inclusion) to a second group. (shrink)

Free will and determinism have recently attracted the attention of Buddhist scholars who have defended conflicting views on this issue. I argue that there is no reason to think that this problem cannot arise in Buddhist philosophy, since there are two senses of ‘free will’ that are compatible with the doctrine of non-self. I propose a reconstruction of a problem of free will and determinism in Early Buddhism, given a) the assumption that Buddhist causation entails universal causal determinism, and b) (...) a crucial passage suggesting that Early Buddhism is committed to the principle of alternative possibilities which is arguably incompatible with a determinist interpretation of causation. This passage suggests that Early Buddhism must leave room for a robust, incompatibilist form of free will, and that a conception of indeterminist free will in the spirit of Robert Kane’s theory allows us to make sense of that notion. Like Plato, Protagoras held that young children learn virtue from fine examples in poetry. Unlike Plato, Protagoras taught adults by correcting the diction of poets. In this paper I ask what his standard of correctness might be, and what benefit he intended his students to take from exercises in correction. If his standard of correctness is truth, then he may intend his students to learn by questioning the content of poems; that would be suggestive of Plato’s program in Republic III. (...) But his standard is more likely to be the accurate use of language; in that case he would intend his students to learn to express their thoughts clearly enough that their audience would understand what they were saying. That standard would be independent of the truth of what they are saying; and that would be a precursor to modern techniques by which we try to teach speaking and writing. Truth is not so easy to escape, however, and we shall see that Protagoras’ exercise must assume that the poet is trying to tell the truth. (shrink)

This chapter offers a brief characterization of creativity, followed by a review of some of the reasons people have been skeptical about the possibility of explaining creativity. It surveys some of the recent work on creativity that is naturalistic in the sense that it presumes creativity is natural, as opposed to magical, occult, or supernatural, and is therefore amenable to scientific inquiry. The chapter divides into two categories. The broader category is empirical philosophy, which draws on empirical research while addressing (...) questions that have traditionally been regarded as philosophical. The second category is experimental philosophy, a special branch of empirical philosophy in which experiments are designed by philosophers with the explicit purpose of addressing philosophical questions. This categorization is admittedly somewhat artificial, but it is a familiar one in the prevailing division of intellectual labor, and it will be a useful organizational tool for the chapter.
