L’ambientazione dell’itinerario che qui si propone rinvia ad un’ermeneutica del diritto che concentra l’attenzione non su un settore – costituito da metodologie e principi ai quali attingere per la soluzione di conflitti nella prassi –, ma su una riflessione rigorosa. Tale ordine di pensiero muove dalla filosofia aristotelica del De Interpretatione, sino ai problemi della globalizzazione, trattati interrogandosi se l’ermeneutica occupi o meno un posto prioritario nel complesso universum giuridico. En el presente trabajo analizamos el tratamiento que hace Isidoro de Sevilla, la más ilustre figura de la cultura hispanovisigoda, que ejerció un notabilísimo influjo durante todo el medievo a lo largo y ancho de la cristiandad, del problema de la pobreza y la injusticia social. En los dos primeros epígrafes estudiamos sus consideraciones teóricas para entender y concebir el problema, y en el tercero nos detenemos en sus tres propuestas prácticas para afrontar –y, quizá, vencer– el mal que representan (...) la pobreza y la injusticia social: justicia, comunidad y, sobre todo, caridad. En un cuarto apartado recogemos las principales conclusiones y, como refuerzo y complemento a lo estudiado, ofrecemos al lector unos breves himnos de la liturgia hispana altomedieval –testigos del mismo espíritu que movió al obispo de Sevilla– que ahondan en la idea central de la propuesta isidoriana: que solo el aumento y ejercicio de la caridad, amor Dei et proximi, puede vencer el mal de la pobreza y la injusticia social, porque solo el amor vence siempre. This paper is an investigation of the role of comedy in philosophical thinking, particularly of how comedy reveals the erotic dimension of philosophical thinking.In the first half of the paper, I show that the relation between comedy and Eros is a powerful means to understand in what way philosophy is not technē. Philosophy in its erotic and comedic character is, rather, engaged with an appearing of things as ‘birthed’ or ‘living.’ In the second part of the paper, I focus on (...) the role of comedy in the Laches. There I study the complex relationship between philosophy as erotic thinking and andreia or ‘manliness.’ I show that philosophy as erotic must distinguish itself from manliness and that the enactment of this differentiation is the core of the Laches. At the same time, manliness is not simply something that philosophy should not concern itself with. Philosophy must ask the question ‘what is manliness?’ as a way of enacting manliness and overcoming it, in an overcoming through which philosophy comes to its own erotic core. (shrink)

RESUMEN El cáncer constituye un serio problema de salud y una de las primeras causas de muerte a nivel mundial, con serias repercusiones sociales, sicológicas, y familiares. Actualmente su prevención y control representa un reto que es necesario asumir teniendo en cuenta todas sus dimensiones. El presente trabajo tiene como objetivo exponer los fundamentos teóricos de la estrategia de intervención sicosocial para la prevención y tratamiento del cáncer en el consejo popular San Juan de Dios. Se revela la fundamentación teórica (...) de la estrategia de intervención desde los diferentes aparatos conceptuales de las ciencias sociales y se hace énfasis en los enfoques sociológicos y sicológicos. Se ofrece el diseño de la estrategia con todos los aspectos contentivos, y se describen las diferentes etapas que la comprenden. ABSTRACT Cancer constitutes a serious problem of health and one of the first causes of death on a global scale, with serious social, psychological, and familiar aftereffects. At present its prevention and control represents a challenge that is necessary to accept bearing in mind all its dimensions. The present work has as objective to exhibit the theoretical basis of the strategy of psychosocial intervention for the prevention and treatment of the cancer in the popular council San Juan de Dios. It reveals the theoretical foundation of the strategy of intervention from the different conceptual devices of the social sciences and emphasizes on the sociological and psychological approaches. The design of the strategy is offered with all the comprising aspects, and there are described the different stages that comprise it. (shrink)

abstract The possibility that organ sales by living adults might be made legal is morally distressing to many of us. However, powerful arguments have been provided recently supporting legalisation (I consider two of those arguments: the Consequentialist Argument and the Autonomy Argument). Is our instinctive reaction against a market of organs irrational then? The aim of this paper is not to prove that legalization would be immoral, all things considered, but rather to show, first, that there are some kinds of (...) arguments, offered in favour of legalisation, that are, in an important sense, illegitimate, and second, that even if legalisation might not be wrong all things considered, there are good reasons for our negative moral intuitions. Moreover, identifying these reasons will help highlight some features of moral decisions in non‐ideal situations, which in turn might be relevant to some other moral or policy choices. (shrink)

In his recent article, ‘A Gift to Theology? Jean-Luc Marion's ‘Saturated Phenomena’ in Christological Perspective’, Brian Robinette has critiqued Marion's phenomenology for confining theology to a one-sided approach to Christology, one that stresses only the passive, mystical reception of Christ. To correct this imbalance, Robinette brings Marion into dialogue with those more active Christologies or ‘prophetical-ethical’ liberation theologies of Gustavo Gutierrez, Johann Baptist Metz and others that stress a life-praxis focused on confronting evil and suffering. In this essay I am (...) arguing that Robinette has not fully developed the ‘logic’ of Marion's phenomenology of the ‘call and the gifted’, in which both a passive and an active element are operative. I explore more fully that very dynamic phenomenological process of the call-and-the-gifted as developed in Marion's work Being Given: Toward a Phenomenology of Givenness. Once viewed in Christological perspective, and especially in light of Christ's death and resurrection, Marion's phenomenology entails an ethical trope consistent with the mission of Christ as rendered in Scriptural revelation, and thus the gap between Marion's work and the prophetical-ethical theologies of Gutierrez and Baptist Metz becomes narrowed. In The Contemplative Self after Michel Henry: A Phenomenological Theology, Joseph Rivera provides a close and critical reconstruction of the philosophical anthropology of Michel Henry (1922-2002) while also addressing the question of how theology contributes to Henry's phenomenology. In conversation with other French figures such as Derrida, Marion, Lacoste, and Barbaras, Rivera undertakes a global thematic study of Henry's work. He shows how, for Henry, the theological debate is shifted onto a phenomenological problem, with a coincident will to (...) pursue the epistemological efforts of Husserl and Heidegger. The chapters tackle some of the most pressing debates in contemporary Continental philosophy, such as the "modern ego," the nature and experience of temporality, and the constitution of the body and otherness, and how a theological discourse may illumine those anthropological structures. The book expands on the modern narrative of the self from Descartes to Nietzsche, opens up the particular lines of inquiry Henry advances in dialogue with those figures and phenomenology in particular, and highlights the surprising theological turns in Henry's late work on Christianity. Because Henry's work is difficult, it is often misunderstood; Rivera's own vision of the self, one that is shaped by Henry but not in full agreement with him, advances insights internal to Henry but also brings into sharp focus many problematic points in Henry's phenomenological theology. An array of classical theological voices appear in the final chapters, such as St. Augustine, Tertullian, Irenaeus, Pseudo-Dionysius, and Gregory of Nyssa, all of whom are set in dialogue with Henry. A fresh and creative articulation of contemplation and selfhood, the volume is a valuable addition to the continuing conversation that seeks to build bridges between phenomenology and theology. Genetic research in human beings poses deep ethical problems, one being the problem of distributive justice. If we suppose that genetic technologies are able to produce visible benefits for the well being of people, and that these benefits are affordable to only a favored portion of society, then the consequence is obvious. We are introducing a new source of inequality. In the first section of this paper, I attempt to justify some concern for the distributive consequences of applying genetics to (...) human beings. This concern transcends a mere preoccupation for material equality. I argue that genetic inequality can undermine the very basis of social cooperation, at least regarding health care. The second section is more practical. My aim is to defend how, at least in some legal and cultural frameworks , the undesired distributive consequences of genetics are more likely to arise and more difficult to avoid. (shrink)

To build cultures of peace, one must often lay aside the "expert" label and become a student in the world who is willing to learn from other cultures in pursuit of peace. To set up an intercultural dialogue on this topic, the Committee for the Psychological Study of Peace, in conjunction with the University for Peace and the Institute for Psychological Research of the University of Costa Rica, sponsored the 6th International Symposium on the Contribution of Psychology to Peace. This (...) special issue extends the dialogue which began at the Symposium. Aiming to help define the role and contributions of psychologists in building cultures of peace, the articles in this issue address: *topics relating to human rights; *how psychologists can contribute to democratization; *how psychology has much to say on the causes and dynamics of intolerance and the processes of building tolerance in the context of intergroup relations; *how psychology can contribute to understanding and fostering nonviolence; *how cultures of peace will not be possible without a concerted effort to bring about global environmental security and that our failure to restore environmental health is fundamentally a psychological problem; and *psychologically informed policies for the promotion of cultures of peace, including the importance of gender equity. Y propongo una concepción postpositiva del conocimiento del Derecho y de validez informada de una teoría crítica de influencia posmoderna al servicio de una concreción justificada de los derechos de las personas. En su libro The Cinematic Footprint (2012), la teórica de los estudios sobre el cine Nadia Bozak propone un análisis de la producción cinematográfica basado en su relación con los consumos y los recursos naturales de los que ésta depende. Desde este punto de vista, este artículo parte de tres escenas de la filmografía del realizador ruso Andrei Tarkovsky para examinar, desde las condiciones materiales de su producción, un campo de interacciones entre imagen y transformación del paisaje más allá de (...) la representación. El trabajo de Tarkovsky es entonces analizado en este texto desde el marco de las relaciones trabadas a lo largo del siglo XX entre imagen, extractivismo y crecimiento vegetal. En particular, los planos examinados son puestos en relación con programas de colonización agraria, agricultura de precisión y técnicas de reforestación como el bombardeo de semillas. El contraste entre la naturaleza extractivista de la mediación por la imagen en estos casos y el carácter de "práctica de cine vegetal" con el que ha sido descrito el cine de Tarkovsky (Uhlin 2015) invitan a rearticular la diferencia entre imagen y crecimiento vegetal en términos de los llamados "medios elementales" introducidos durante la última década en el ámbito de la teoría de los medios. La recepción durante el siglo XX se preguntó si la filosofía nietzscheana era a-, im- o anti-política, es decir, si podía ser asimilada por la democracia, o si era antimoderna, elitista y reaccionaria. El italiano Roberto Esposito ha propuesto leerla como formando e informando el paradigma de la biopolítica. Se discuten cuatro lecturas de esa biopolítica: como formadora del paradigma de la inmunidad, como tanatopolítica, como liberal y neoliberal, y como biopolítica afirmativa. Twentieth-century readers wondered if Nietzschean philosophy was apolitical, (...) impolitic, or anti-political; that is, if it could be assimilated by democracy or if it was antimodern, elitist, and reactionary. The Italian philosopher Robert Esposito has proposed reading Nietzsche's philosophy as forming and informing the biopolitical paradigm. Four readings of these biopolitics are discussed: as part of the paradigm of immunity, as thanatopolitics, as liberal and neoliberal, and as affirmative biopolitics. (shrink)

“ Moral luck” alludes to the fact of being responsible for things over which we have no control. Typically, we have neither control over the consequences of our acts of will nor over the circumstances in which these acts are performed. The Kantian thesis on oral responsibility claims that every kind of moral responsibility claims that every kind of moral luck should be eliminated from our moral language and practice. In the case of consequences, this aim does not seem impossible. (...) But circumstances are more difficult to avoid because the act of will itself has to be performed within the framework of circumstances that the agent cannot control at all, and these circumstances will dramatically bear on his/her responsibility. Therefore, the following anti-Kantian argument can be construed. Either we reject circumstantial luck argument can be construed. Either we reject circumstantial luck or we accept it. If we reject it, then every attribution of responsibility becomes impossible. If we accept it, then we no longer have a good argument against consequential luck, the core of the Kantian rejection of moral luck. In this paper, I defend the Kantian position from this argument, claiming that both kinds of moral luck are relevantly different. This will, nevertheless, lead to a revision of the scope of our judgments of responsibility. They compare how someone acted with how others would act in identical 8or similar) circumstances. Throughout a distinguished career, Bob Hale’s work has addressed this question on a number of fronts, through the development of a Fregean approach to ontology, an essentialist theory of modality, and in his work on neo-logicism in the philosophy of mathematics. This collection of new essays engages with these themes (...) in Hale’s work in order to make further progress in our understanding of ontology, modality, and the relations between them. Some essays directly address questions in modal metaphysics, drawing on ontological concerns. Others raise questions in modal epistemology and its links to matters of ontology, such as the challenge to give an epistemology of essence. There are also several essays engaging with questions of what might be called ‘modal ontology’: the study of whether and what things exist necessarily or contingently. Such issues can be raised and addressed directly, but they also have an important bearing on the kinds of semantic commitments engendered in logic and mathematics, e.g., to the existence of sets, or numbers, or properties, and so on. It is thus explored in some chapters to what extent one’s ontology—and indeed, one’s ontology of necessary beings—interacts with other plausible assumptions and commitments. (shrink)

This article examines a specific case of lying, at the same time judicial and mediatic, promoted from the highest levels of political power, the Leon Trotsky case, from the perspective of the work done by the International Commission of Investigation chaired by the American philosopher John Dewey. After a general justification and contextualization of the subject, and a historical account of the events that surrounded the “Moscow Trials” and the constitution of the Dewey Commission, some of the reasons why the (...) commission concluded that such processes had been judicial assemblies are reported. It closes with a reference to the way Dewey later denounced the media falsification of these events through the book Mission to Moscow. (shrink)

En el presente artículo, se sostiene que el actual escenario internacional se ha caracterizado por una profunda interrelación, y la integración emerge como una estrategia de inserción global de relevancia, especialmente para países como Chile. Esta integración no es sólo económica sino que también incluye el movimiento de personas. No obstante, la integración y la movilidad de personas se ven afectadas por los prejuicios y las desconfianzas, lo que se ha reflejado en el fenómeno migratorio peruano en Chile. Desde esta (...) perspectiva, la construcción de un marco institucional para alcanzar mayores grados de integración de los inmigrantes peruanos en Chile, no sólo requiere avances en el ámbito económico-laboral, sino que también en el área educacional-cultural, promoviendo una educación basada en la interculturalidad, capaz de marcar el camino hacia una mayor tolerancia e integración entre ambas sociedades, y así superar quiebres históricos, como lo fue la Guerra del Pacifico. In this paper, I discuss exploitative transactions in bioethics. Examples of this kind of transactions allegedly include, among others, commercial surrogacy, organ selling, and research with human subjects in developing countries. The most problematic kind of exploitation is what Allan Wertheimer calls “mutually advantageous exploitation:” the weak party’s consent for the transaction is an effective and rational consent. Moreover, W does not suffer any harm by the transaction; on the contrary, the transaction benefits W. My aim in this paper is (...) twofold. From the perspective of individual ethics, I offer a model to understand the nature of the wrongfulness of the strong party’s action. And from the perspective of legal ethics, I suggest some reasons to believe that the prohibition of beneficial exploitative contracts is problematic and can only be justified in very exceptional cases. Bioethics embraces a number of ethical problems connected to medicine, biomedical research, and health law. Most of these have both a universal dimension and a more particular one. Reproductive rights, exploitation, commodification, biomedical research, and the protection of the environment, among others, are issues that can be discussed from a universal perspective.

El Estado es un concepto clave en la filosofía jurídico-política de José Ortega y Gasset (Madrid, 1883-1955). Sin embargo, resulta sorprendente que, pese a la importancia que para este autor tenía dicha noción, no haya sido estudiada con la misma profundidad e interés que otras vertientes de su pensamiento. A este respecto, basta repasar las monografías y los artículos publicados hasta la fecha sobre la figura y la obra de Ortega para constatar que, en términos cuantitativos, las investigaciones dedicadas a (...) la idea orteguiana del Estado han sido apenas testimoniales, y desde luego no son tan significativas como las que se han podido dedicar a otros temas o tópicos más conocidos de su pensamiento. Así pues, el presente libro pretende abordar el estudio de la realidad problemática del Estado en su triple dimensión histórica, sociológica y política. De acuerdo con tal propósito, esta monografía se divide en tres partes: en la primera de ellas, se estudian las instituciones políticas de Roma entendidas por Ortega como precedentes ineludibles para la formación histórica del Estado. La segunda parte de la obra versa sobre el Estado concebido como culminación de lo social, es decir, como órgano diferenciado para el ejercicio del poder público, lo cual conduce indefectiblemente hasta la Teoría de los usos sociales. Por último, la tercera parte se centra en el concepto orteguiano de Estado como forma de organización política, explica la relación que mantienen el Estado y nación en su obra, y expone las líneas principales del programa político pensado por Ortega para modernizar, regenerar y europeizar a España.
