Knowing the factors that executives deem critical to governance change can improve our understanding of how such changes come about and can help us evaluate those changes. Interviews with business and finance executives at 11 colleges reveal the importance to governance change of chief executive and board member leadership and interactions, as well as executive communication style. Costs are clear constraints to action, particularly since benefits are not quantified and are difficult to describe. Efforts to discuss governance with internal stakeholders (...) require persistence to overcome narrow, individualized concerns. Communication about governance to external stakeholders is rare and represents a missed opportunity for stakeholder feedback and the development of trust. Executives appear willing to adopt governance forms without considering the idiosyncrasies of their institutional field, limiting the working definition of governance and its potential. For corporations and not‐for‐profit enterprises these findings hold implications for the context in which leadership is exercised and the shape of governance structures. They also pose a fundamental ethical dilemma for leaders to address. (shrink)

The scope of Philosophy in Multiple Voices provides the reader with eight philosophical streams of thought-African-American, Afro-Caribbean, Asian-American, Feminist, Latin-American, Lesbian, Native-American and Queer-that introduce readers to alternative, complex philosophical questions concerning gendered, sexed, racial and ethnic identities, canon formation, and meta-philosophy. The overriding theme of the text is that philosophy is pluralistic in voice, rich in diversity, and ought to valorize democratic intellectual spaces of philosophical engagement.

Pain, crucially, is unpleasant and motivational. It can be awful; and it drives us to action, e.g. to take our weight off a sprained ankle. But what is the relationship between pain and those two features? And in virtue of what does pain have them? Addressing these questions, Colin Klein and Richard J. Hall have recently developed the idea that pains are, at least partly, experiential commands—to stop placing your weight on your ankle, for example. In this paper, I reject (...) their accounts. Against Klein, I use dissociation cases to argue that possession of ‘imperative content’ cannot wholly constitute pain. Against them both, I further claim that possession of such content cannot even constitute pain’s unpleasant, motivational aspect. For, even if it were possible to specify the relevant imperative content—which is far from clear—the idea of a command cannot bear the explanatory weight Klein and Hall place on it. (shrink)

An extensive literature has demonstrated that encoding information in a self-referential manner enhances subsequent memory performance. This ‘self-reference effect’ is generally elicited in paradigms that require participants to evaluate the self-descriptiveness of personality characteristics. Extending work of this kind, the current research explored the possibility that explicit evaluative processing is not a necessary precondition for the emergence of this effect. Rather, responses to self cues may enhance item encoding even in the absence of explicit evaluative instructions. We explored this hypothesis (...) by testing memory for items encoded in either an evaluative or relational context. The relational context was achieved by requesting participants to report the spatial relationship between target stimuli, and visual or verbal referent cues. The results revealed a self-referent memory advantage, regardless of the encoding context or triggering cue. The theoretical implications of these findings are considered. (shrink)

As non-biological machines come to be designed in ways which exhibit characteristics comparable to human mental states, the manner in which the law treats these entities will become increasingly important both to designers and to society at large. The direct question will become whether, given certain attributes, a non-biological machine could ever be viewed as a legal person. In order to begin to understand the ramifications of this question, this paper starts by exploring the distinction between the related concepts of (...) human, person, and property. Once it is understood that person in the legal sense can apply to a non-biological entity such as a corporation, the inquiry then goes on to examine the folk psychology view of intentionality and the concept of autonomy. The conclusion reached is that these two attributes can support the view that a non-biological machine, at least in theory, can be viewed as a legal person. (shrink)

There is a wind of change about to affect the training of all house officers in the United States. The Accreditation Council of Graduate Medical Education has promulgated a set of general competencies for all U.S.-trained residents, with a major thrust focused on bioethics and professionalism that will likely catch residency directors unaware. The ACGME's General Competencies document globally addresses many relationship-based ethical roles and responsibilities of house officers in healthcare. Of note, this document contains a specific section on professionalism. (...) However, the entire document is woven with a sustained thread of medical ethics throughout its other sections. The intent is to imbue each physician with those skills, rules, and aspects of character that will be a foundation for humane, ethical, professional conduct. Professionalism does indeed go beyond ethical principles, accounting for competency and commitment to excellence and, most of all, implying a virtue ethics account of medical practice. The need to address the central place of virtue ethics in house-staff education is apparent, and we now have the right tool for the job—the ACGME General Competencies. (shrink)

One often hears it said that our visual-perceptual contact with the world is “perspectival.” But this can mean quite different things. Three different senses in which our visual contact with the world is “perspectival” are distinguished. The first involves the detection or representation of behaviorally important relations, holding between a perceiving subject and the world. These include time to contact, body-scaled size, egocentric position, and direction of heading. The second perspective becomes at least explicitly manifest in taking up the “proximal (...) mode” and involves the representation of relational “appearance properties,” such as, perhaps , angular size and angular/projective shape at or from a viewpoint. The third perspective is associated with the pencil of rays structured by the position and geometry of the eyes. The relationships between these three perspectives are charted, and their connection with conscious experiential awareness discussed. So, e.g., there is no simple or direct route from the detection of the relations constitutive of perspective2 to detection of the relations constitutive of perspective1. The relations definitive of perspective3 are probably not themselves detected or represented by the visual system, but define the informational arena within which detection of the relations definitive of perspective1 and perspective2 takes place. We describe an approach to textual inference that improves alignments at both the typed dependency level and at a deeper semantic level. We present a machine learning approach to alignment scoring, a stochastic search procedure, and a new tool that finds deeper semantic alignments, allowing rapid development of semantic features over the aligned graphs. Further, we describe a complementary semantic component based on natural logic, which shows an added gain of 3.13% accuracy on the RTE3 test set.

The standard adaptationist explanation of the presence of a sensory mechanism in an organism—that it detects properties useful to the organism—cannot be given for color vision. This is because colors do not exist. After arguing for this latter claim, I consider, but reject, nonadaptationist explanations. I conclude by proposing an explanation of how color vision could have adaptive value even though it does not detect properties in the environment.

The fundamental principles of the classical utilitarian school characterize this trend as an administrative and legal criminology. This had two implications. On the one hand, the motives, and ultimate causes of the behavior and the unequal consequences of an arbitrary rule were ignored. On the other hand, the role of the judge was reduced to enforcing the law, while it was up to the judge to set a penalty for each offence. At the end of the nineteenth century, these principles (...) saw the gradual emergence of another punitive episteme that had emerged as a result of the colonization of the legal space by the positive sciences and etiological action programs. This was not a planned and pre-established course, but the confluence of a series of theories and programs for penal prevention that Michel Foucault summarized as the realization that the law was increasingly functioning as a norm. Now, criminality, besides being the object of scientific interest, also constitutes the indicator of a social problem and therefore its insertion in an economy of changing power. (shrink)

The development of the Values History instrument for use in advance directive decision making has raised the question of the importance of values in eliciting advance directives. This pilot study examines the relationship between the domains of values and advance directives drawn from the Values History in three generation intrafamily triads. Significant correlations between values and advance directives were found primarily within the youngest generation. Results reveal a relatively high familiarity by the participants of the various established forms of advance (...) directives. Also, a significant percentage of parents and grand- parents was found to have signed some form of advance directive. (shrink)

This article discusses the ethical responsibilities that psychology faculty have when psychological information is seriously misrepresented or psychological techniques are misued by nonpsychology faculty. General values derived from the American Psychological Association's (APA) ethical principles are identified and reviewed. The APA ethical code recommends that psychologists limit the misrepresentation of psychological information and protect students from the misuse of psychological techniques. Examples from my experience are presented to illustrate these ethical principles and responsibilities.

The focus on translational research in clinical trials has the potential to generate clinically relevant genetic data that could have importance to patients. This raises challenging questions about communicating relevant genetic research results to individual patients. An exploratory pharmacogenetic analysis was conducted in the international ovarian cancer phase III trial, AGO-OVAR 16, which found that patients with clinically important germ-line BRCA1/2 mutations had improved progression-free survival prognosis. Mechanisms to communicate BRCA results were evaluated, because these findings may be beneficial to (...) patients and their families. Communicating individual BRCA results was not anticipated during clinical trial design. Consequently, options were not available for patients to indicate their preference for receiving their individual results when they signed pharmacogenetic informed consent. Differences in local requirements, clinical practice, and opinion regarding the ethical aspects of how to convey genetic results to patients are all potential barriers to returning individual BRCA results to patients. Communicating the aggregate BRCA result from this study provided clinical investigators with a mechanism to disseminate the overall study finding to patients while taking individual circumstances, local guidelines and clinical practice into account. This study illustrates the importance of increasing the clarity and scope of informed consent and the need for patient engagement to ensure clinical trial participants can indicate their preference regarding receipt of potentially important individual pharmacogenetic results. This study was registered in the NCT Clinical Trial Registry under NCT00866697 on March 19, 2009, following approval from participating ethics committees. (shrink)

One particularly intense controversy has emerged around the value and appropriateness of single disease hospitals. In HIV disease, the single hospital turns out to be an altogether unsuitable and unnecessary innovation. In the instance of tuberculosis, however, it appears to have a critical (...) and legitimate role, particularly for involuntary commitment of patients who have been non-compliant with treatment regimens. To be sure, that role must be carefully circumscribed and the facilities themselves closely monitored. But a hospital dedicated to tuberculosis now occupies a central place in public policy that is not to be found for HIV disease. What considerations promote this difference, and how a single disease hospital for tuberculosis may avoid the pitfalls that make it so inapposite for HIV, are the two questions this essay will be exploring. Some of the authors of the essays on Chinese philosophers prefer the pin yin system of romanization for Chinese names and words, while others prefer the Wade‐Giles system. Given that both systems are in wide use today, important names and words are given in both their pin yin and Wade‐Giles formulations. The author's preference is printed first, followed by the alternative romanization within brackets.

Information disclosure is a common regulatory tool designed to influence business behavior. A belief is that transparency can provoke learning and also positive institutional change by empowering private watchdogs to monitor and pressure business leaders to alter harmful behavior. Beginning in the late 1990s, a private movement emerged that pressured corporations to disclose the identify of their global supplier factories. These activists believed that factory disclosure would lead to greater accountability by corporations for the working conditions under which their products (...) are made, which in time would improve labor practices. In 1995, Nike and Levi-Strauss (Levis) surprised the business community by publishing their supplier lists. This paper describes case studies of Nike and Levis, tracking the evolution from resistance to supply chain transparency through to the decision to be industry leaders in factory disclosure. The paper evaluates the contribution of factory disclosure and proposes that other companies should be urged to move toward supply chain transparency. (shrink)

This article critically evaluates S. Freud's Mourning and Melancholia and challenges both the celebratory and reactionary views that treat this essay as an ahistorical and decontextualized "foundation-stone" of depression. Although many biographies have been written on Freud, the possible influences on his thinking in the area grief and depression have not been examined. Moreover, no reviews have investigated Freud's understanding of mourning and melancholia from the perspective of his own experiences with these difficulties. Following a brief overview of Freud's seminal (...) paper, the historical psychiatric views on depression and the influences on Freud's conceptualization of mourning and melancholia are briefly discussed. I argue that virtual reality is a sort of genuine reality. In particular, I argue for virtual digitalism, on which virtual objects are real digital objects, and against virtual fictionalism, on which virtual objects are fictional objects. I also argue that perception in virtual reality need not be illusory, and that life in virtual worlds can have roughly the same sort of value as life in non-virtual worlds.
